CONDITIONS DE VENTE La participation aux enchères implique l’acceptation inconditionnelle des conditions de vente suivantes. L’enregistrement préalable sur présentation d’une pièce d’identité officielle de tout acheteur potentiel est obligatoire. La vente est faite au comptant et en euros. Les prix figurant au catalogue servent d’estimations. Le plus offrant et le dernier enchérisseur sera l’adjudicataire. Il paiera, en sus des enchères, des frais de vente de 20 % pour les lots adjugés en dessous de 100.000 €. A partir de 100.000 €, ces frais seront de 15%. A partir de 150.000 €, de 13% et à partir de 200.000 €, de 10%. Pour les œuvres sur lesquelles le droit de suite est applicable, l’acheteur devra payer, en sus du prix d’adjudication et des frais de vente, le montant correspondant à ces droits selon la législation belge. Pour les lots remportés sur internet durant la vente en Live, une commission de 3% sur le prix d’adjudication sera demandée à l’acheteur. Les frais de transport et d’assurance pour l’envoi des lots seront également facturés le cas échéant. L’acheteur est redevable du montant de la TVA (21% sur les frais), si elle lui est applicable, sur les frais de vente, les commissions de vente en Live et les frais de transport. En cas de contestation ou d’erreur, le lot sera recrié. L’huissier de justice ou le notaire instrumentant tranchera souverainement toute difficulté pouvant subvenir pendant la vente. En aucun cas l’organisateur ne pourra être tenu responsable d’un problème technique ou informatique. Les profits et risques passent à l’acheteur dès l’adjudication. Celui-ci est réputé agir en son nom propre et tenu personnellement responsable du paiement intégral des montants dus. Il devra s’en acquitter dès réception de la facture avant de procéder, dans les meilleurs délais, à l’enlèvement des lots qui lui auront été adjugés. L’organisateur se réserve le droit d’annuler la vente en cas de facture non payée dans les trente jours après l’adjudication. Les indications se trouvant dans les catalogues, annonces, brochures ou tout autre écrit émanant de l’organisateur doivent être considérées comme de simples indications qui n’engagent en aucun cas sa responsabilité. L’organisateur ne garantit en aucun cas l’exactitude d’une déclaration relative à l’auteur, à l’origine, à la date, l’âge, à l’attribution, à la provenance, au poids et aux dimensions ou à l’état matériel du lot. Aucun employé n’est autorisé à donner des garanties à cet égard.
AUCTION TERMS & CONDITIONS Participation in the auction implies unconditional acceptance of the following terms and conditions. Prior registration upon presentation of official piece of identification for any potential buyer is required. The sale is made in cash and in euros. The prices listed in the catalogue are estimates. The highest and last bidder will be the successful purchaser. It will be pay, in addition to the auction selling, 20% of the hammer price for the lots sold for under € 100,000. From € 100,000, the fee will be 15%, from € 150,000, the fee will be 13%, and from € 200,000, the fee will be 10%. For the works on which the resale right is applicable, the buyer must pay in addition to the hammer price and buyer’s fees, the amount corresponding to these rights under Belgian law. For lots won online during the live sale, a commission of 3% on the hammer price will also be paid by the buyer. Shipment costs and insurance for sending lots will also be charged where applicable. The organization of a public exposure before the auction allows the buyer to examine the lots presented so that no claim will be accepted after the
