City Council has no faith in storefront church to locate on Grant Street in Gary By Carmen M. Woodson-Wray Between 11th Avenue and 25th Avenue there are at least five churches of various denominations located on Grant Street and over 700 within the city. Because of this the Gary Common Council unanimously decided to table the petition of Lighthouse of Hope Ministries to open a house of worship at 1520 Grant Street. Rev. Ben Berry, founder and pastor of Lighthouse of Hope Ministries, presented his proposal to the City of Gary to turn the former Union Florist building into a 6unit apartment house on its top floor and a church and outreach ministry to assist exoffenders and others in need who come back into the community on its main floor. His plans were put on hold during the last Gary Common Council meeting when the council voted against a house of worship being located on Grant Street’s business thoroughfare, which would possibly deter a future business tax base to that area. Rev. Berry said he purchased the building in September of 2008 for $35,000 in the name of the church that was appraised by the Calumet Township Assessor’s office still as a flower shop at $175,000. He said the Assessor’s office should not have assessed the building as high as they did since it has been closed since 2008. He said, “Mr. Blumenberg’s office messed up.

They over assessed the value of the property as a flower shop. It should have been taken off the tax rolls and I went to his office four times about this. They are all

backwards and confused.” Rev. Berry says he has paid $2,000 of the $6,000 in taxes owed on the building, but has filed an appeal on the matter. He has

also appeared before the Common Council petitioning his request, but they did not favorably view a storefront church being (Continued on page 2)

Dispute over Ex-Clerk’s pay raises concerns with County Council The Lake County Council was informed this week that they need to be more attentive to the way county officials handle public funds. In a memo to council members County Attorney John Dull said that they need to be better informed about public funds controlled by elected officials. Dull said he found close to 100 accounts with funds that included federal money and other funding sources for which Council has no oversight. Lake County Coroner Thomas Philpot has returned $29,948 to the County after being told he improperly pocketed funds as County Clerk. Concerns were raised after it was reported the former Lake County Clerk Thomas Philpot increased his salary by close to

$25,000 with funds from the child support division. Last Friday Dull issued an opinion that Philpot needed permission from the County Council to divert $24,704 to himself between 2004 and 2009. Dull said Philpot should repay that amount along with $5,243 in interest that would have accrued since 2004. Philpot, who left the Clerk’s office at year’s end to become County Coroner, repaid the Clerk’s office $29,948 last Friday, according to information from the County Auditor’s office. Philpot was receiving the extra pay from the Clerk’s Child Support IV-D No. 428 Fund, federal money distributed by the

state to County Clerks as an incentive to enforce the collection of court-ordered child support payments. According to state guidelines the money can be used as salary bonuses with Council approval. Unaware that Philpot was using

the funds to supplement his salary, Council members were surprised to learn he was receiving the money because they never approved it in any of their budgets. Although there have been few raises given (Continued on page 3)

Randolph announces 2010 legislative survey results I NDIANAPOLIS — State Senator Lonnie M. Randolph (D-East Chicago) recently announced the results of his 2010 Legislative Survey. Questionnaires were mailed to households throughout Senate District 2 in December 2009 and made available on his website. Randolph sought input from his constituents on a variety of issues that were anticipated to come before the 2010 General Assembly. A major issue before the General Assembly this year is texting while driving, and a majority of constituents in District 2 supported prohibiting texting while driving, voting 73 to 27 percent. House Bill 1279 was approved by the Indiana House of Representatives and would make it a Class C infraction to transmit a text message while operating a motor vehicle, with exceptions for handsfree or voice-operated technology. The bill now moves to the Senate for further consideration. Seventy-six percent of respondents are in favor of moving all municipal elections to even-year cycles. Other Indiana elections are held in even years, but municipal elections are conducted in odd years, so there are additional costs. Moving municipal elections to even years would save money and increase voter participation. This provision is not actively moving through the General Assembly, but several election-related bills are, including one that would move all school board elections to the general election cycle beginning in 2010. When asked whether or not convenience and grocery stores should be able to sell cold beer, 60 percent of Hoosiers in Randolph’s district said no. However, public opinion was split 50-50 as to whether alcohol should be sold on Sundays, with half opposing and half supporting the measure. These initiatives do not appear to have enough support to pass through the legislature this year, but a few alcohol-related issues are still alive in the General As-

sembly, including Sunday carryout for microbreweries, Electionday alcohol sales and extended Sunday alcohol sales to businesses already permitted to sell on Sundays, including some restaurants. Respondents supported establishing an independent commission to advise the General Assembly on legislative redistricting in 2011 and in the future, voting 57 to 43 percent. Randolph and other members of the General Assembly have proposed the immediate creation of a non partisan commission for legislative redistricting. Indiana fully invests Highway, Bridge Stimulus Funds More than 1,000 projects spread across all 92 counties INDIANAPOLIS – The Indiana Department of Transportation (INDOT) announced recently it has fully advertised or awarded all $658 million of Indiana’s highway and bridge allocation under the American Recovery and Reinvestment Act. The Recovery Act has funded 1,082 transportation projects spread across all 92 counties, with 62 percent of the funds invested in economically distressed counties. “While the full impact of the Recovery Act has not yet been seen, Indiana’s state and local transportation agencies led the nation in awarding more shovelready projects than any other state,” said INDOT Commissioner Michael W. Reed. “A large number of smaller-sized projects maximized the potential for Indiana contractors to bid and compete for Stimulus work.” Indiana’s Recovery Act funding stretched much further than anticipated as a result of contractor bids coming in 15 to 20 percent

It is believed that Philpot was taking the extra funds on the advice of his attorney David Saks, who is the legal advisor for the Clerk’s office. In a written opinion from Saks two years ago he stated that in 2008 Philpot could give himself the money in the same way other county employees receive supplemental pay. 2

HATCHER HONORED BY Gov. Daniels and Indiana Civil Ri ghts Commission — Former Gary Mayor Richard G. Hatcher was recently honored by Gov. Mitch Daniels and the Indiana Civil Rights Commission. Hatcher was recognized during a ceremony hosted by the Indiana Civil Rights Commission in the rotunda of the Indiana Statehouse in Indianapolis. After it was learned that state law requires elected officials to get Council approval to supplement their salaries, Saks admitted that he errored in advising Philpot on the matter. Philpot has indicated he might run for Sheriff this year, and this issue has some poitical observers wondering if he has been damaged by the controversy. This, along with the fact that Philpot has been on the job as Coroner for a month and ten days and is seeking another office they say that he may face an uphill battle in trying to capture the Sheriff ’s office.

To keep this momentum going, Indiana is aggressively pursuing billions in competitive grants already funded under the Recovery Act. Indiana’s $71 million High Speed Rail application was recently selected to upgrade a congested rail segment connecting Detroit with Chicago through Northwest Indiana. Indiana has also submitted eight applications competing for $1.5 billion nationwide in Transportation Investment Generating Economic Recovery (TIGER) grants.

Even though she said they had questions on the petition, she would not say what those questions were.” Councilwoman Rogers said she spoke to Rev. Berry and his copastor Floyd Henderson prior to the start of the meeting and told them she did not think the Council was going to rule in favor of his petition. She said, “I recognize that there is a need to assist offenders when they come back home, but we need to take a

look at bringing business into Gary, especially on Grant Street and Broadway. Rev. Berry should not have assumed that his petition was going to go his way.” Councilman-at-Large Kyle Allen commented on the large number of storefront churches located in the city and the fact that they do not pay taxes. “I’m not against church or religion, but we have a lot of storefronts and traditional churches with property that do not pay taxes and require city services. Our collection rate is not where it should be and we cannot afford to let someone else not pay taxes.” Councilman Allen said 1/3 of the people of Gary do not pay taxes. “It seems to me that all we do is not collect taxes and approve day cares,” he said.

Speaking in favor of the petition was Co-pastor Harper. He told the council, “By supporting our church it will enhance the community. People are attacking churches, but it will stand. If it weren’t for churches where would we be?” Council president Ronier Scott said having churches on a main thoroughfare such as Grant Street has always been a problem. He said, “I understand it is a main thoroughfare, but we must focus on collecting taxes.” He reminded Council members that there is already an ordinance on the books for commercial properties to remain commercial and not be rezoned. EDITORIAL TAKE CONTROL OF YOUR HEALTH! The Black community is suffering disproportionately from a number of health problems, from high blood pressure, diabetes, obesity, sarcoidosis, heart disease, kidney disease, and a whole host of other debilitating conditions. Once upon a time it was thought that the dreaded scourge of HIV/AIDS would be confined to the homosexual community in America, but, going against the grain of the pundits, it became one of the most deadly threats to Black people in America and around the world. Black people are also excessively impacted by Tuberculosis. According to Black Health in the United States, a Committee to End the Marion Lockdown (CEML) Walking Steel Newsletter online article, "The AIDS case rate is six times higher for Black people than white people while the TB case rate is eight times higher." Jonathan Mann, former director of the World Health Organization's AIDS program, points out in this same article that "in parts of the Bronx, the AIDS rates are similar to some of the hard hit areas of Africa." Black people are also excessively impacted by infant mortality, incarceration rates, school dropout, alcohol and cigarette abuse, and a whole host of other negative conditions. It would be easy to point a finger at racism as the cause for this unsavory state of affairs, and there is an element of truth in that assertion, especially in the issue of access to healthcare. But it is not the whole story. More and more people will come to know that the state of mind plays a huge part in what happens to us. Certainly stress is a culprit in the development of disease, as most people can attest. Because of the challenges that Black people have had to face in the United States and elsewhere, the collective psyche has been bruised, and has resulted in a compromised sociological immune system resulting in a high rate of maladies, including low self-esteem and Black-on-Black crime. Therefore, it must be understood that the notion of health is holistic, and one reason the Black community suffers more than others from various and sundry disorders is directly related to a negative collective state of mind. It is lunacy for those who have been captives to totally rely on their captors for relief. It is for this reason that Black people must take care of their own health. We must eat right, think right and do right. We must seek physical, mental, emotional and spiritual balance. We must change the health of the community one person at a time by doing our part. Until this happens, the community will continue to suffer from dis-ease (disease), and no amount of external intervention will be able to bring about a significant change in collective health. Take control of your health - your life depends upon it! 4

It is appalling that some manufacturers can take federal bailout money and then turn around and oppose a bill that would protect every American motorist from a vehicle repair monopoly. WHAT WAS HE THINKING? After hearing about the indictment of East Chicago mayor George Pabey most folks are wondering, what was he thinking? After witnessing a slew of people in East Chicago going to jail for the “Sidewalk Six” scandal where members of the Pastrick administration were convicted of exchanging votes to get sidewalk repairs and of city work done, how could he be so dumb as to have city workers do work on his private home. Not to mention a house located in Gary. Of course he has been indicted and still has to stand trial, and of course it is said that there is a presumption of innocence until proven guilty.

But still getting put in a position to be charged with a crime like this shows that for the last several decades he obviously ain’t been paying attention to what’s been goin’ on around him. Because the federal prison system now is home for a bunch of folks from East Chicago, who thought they were smarter than the feds only to find out that’s not the case. Word reached that Pabey has hired Scott King and may hire Gary lawyer Fred Work to represent him. Should be interesting to see how that will play out. ‘Cause while King since resuming his practice has had a bit of luck in federal court, Work hasn’t been so lucky.

Enough is enough, the city council put their foot down last week and declared that they ain’t approving any more store front churches. Council members say that these churches are taking up space that could be used for tax paying businesses, and despite

the fact that no new businesses have come to Gary, they are keeping hope alive. During last week’s council meeting where the issue was debated, opponents of store front churches often quoted bible verses to back their argument. Councilman Roy Pratt, quoting from the book of Matthew and saying that the council couldn’t afford to grant tax abatement for the store fronts noted that the scripture says render unto Caesar unto what is Caesar’s and to the Lord what is to the Lord. Community Gadfly Jim Norwacki even got into the act telling the council that while he was in jail he discovered the Ten Commandments during a stay in the Lake County Jail and that he’d found religion; albeit the wrong kind. All nine council members voted not to grant tax abatement to a church that had been seeking it ‘cause they feel that somehow having businesses in the city is more important than spreading the word of the lawd. Given the fact that Jesus never had a church and would have been classified as one of these neighborhood

preachers without a church, he too would have met with opposition from this council. Looks like this council is more intretested in serving Caesar instead of the Lord. -NoseyPAY UP Word is Sheriff candidate Thomas Philpot recently paid back some money that he wasn’t entitled to while he was county clerk. Philpot, who is rumored to be rolling in dough, for some reason decided to fatten his private coffers with funds collected from the Child Support Division that were paid to the clerk’s office. Nosey hears that Philpot, who is rumored to be candidate for sheriff, even though he hasn’t served a full term as Lake County Coroner is exemplary of the greed in county politics. Not only does he want to cash in on all the monetary benefits – he also wants to capitalize on the political offices that are available. Is there no end to his greed?

Indiana Department of Revenue reminds Hoosiers about list of new tax changes this year. Agency strongly recommends electronic filing in light of these changes. Legislative decisions made during last spring’s Indiana General Assembly will impact Hoosier taxpayers soon as they complete their 2009 state tax returns by April 15. Some changes will impact paper filers and Indiana’s unemployed, as well as those taking the earned income credit, and other state tax changes will impact some military spouses. “Many of these changes are due to adjustments made in federal tax law,” said Stephanie McFarland, director of public relations for the Department of Revenue. The state’s most widely used form, the IT-40, has undergone a major revision, including an expansion from three schedules to seven that taxpayers may possibly need to complete, “depending on the individual taxpayer’s situation,” said McFarland. “It’s very different than it has looked over the past decade.” The Department of Revenue recommends that taxpayers use I-File, the state’s free online filing program

to help avoid any confusion the new multi-schedule driven form might present. “We’ve actually made the form easier to read, so we could accommodate space for the new ‘addbacks’ required due to the federal adjustments,” said McFarland. “But that also meant we had to move some information off of the twopage form and onto separate schedules to be completed, and that might feel cumbersome for some people. But I-File will make filing their taxes an easy process.” Tax change to affect unemployed Earned Income Credit increased A new add-back also will impact the unemployed in filing their state taxes this year. New federal tax law allows those who drew unemployment in 2009 to deduct the first $2,400 from their total income reported to the federal government. But unemployed Hoosiers will have to add that amount back into the income they report to the state this year. “However, the state does offer an unemployment tax deduction to those who qualify,” said McFarland. Taxpayers who drew unemployment in 2009 can determine if they

The program provides on-site help from financial aid experts, primarily from Indiana colleges and universities. Woodson-Wray West Side High School graduate Chris Hunter has been signed for the remainder of the 2009-2010 season with the Golden State Warriors in Oakland, California. Hunter has been with the team since November 20, 2009. He was the first Gatorade call-up to the NBA for 2009-10. He first became a NBA player in April of 2009 when he signed with the New York Knicks. A product of the Gary Public School System, Hunter first started playing basketball while attending the Banneker Achievement Academy. He later played for Tolleston Middle School and then on to West Side which won the boys 4A basketball championship in 2002. In 2002 Hunter was the recipient of the Arthur L. Trester Award for athletic and academic achievement. Not only has he achieved athletically, but he has also achieved academically. Throughout elementary, middle and high school he was a member of the Gifted and Talented Program and member of the National Honor Society. After high school Hunter played basketball for the University of Michigan and received a Bachelor of Business Administration Degree. After college he played professional basketball in Poland and Belgium before joining the NBA’s Developmental Team the Fort Wayne Mad Ants where he averaged 19 points per game. The Gary Crusader
