From Editor's Desk One who endures with the change is a conqueror! Law in the real world is a form of rules and regulations for the behavior of individuals and groups. We do not know or understand most of these rules. For example, you do not need to look at written law to know that stealing or destroying someone’s property is a crime. In other words, the law is a system of rules that are created and implemented by a social or governmental organization to regulate behavior. It provides stamps and assurances that support and regulate the individual and the community for the will of the state. The role of legal professionals has evolved as the legal landscape has revolutionized the advancement of today’s legal technology. The first major battle that Ms. Rajeshwari handled was the revocation of the Basmati patent which was granted to Ricetec a company in the United States. She worked hard to find prior art and then after a long and arduous battle the patent was revoked by the USPTO. On similar lines, the turmeric patent was also revoked. The firm also dealt with the Glivec case, which for the first time interpreted section 3(d) of the Patents Act 1970 so as to prevent evergreening of patents. This was a case for a product (imatinib mesylate) for the treatment of blood cancer. It was being sold at 1 lakh per month – in India. there was no product patent granted in India; however, there was a patent application for a crystalline form of imatinib mesylate. And as per the then prevailing regime Exclusive marketing Rights were granted to 28
Novartis who sued and injuncted several companies attempting to manufacture imatinib mesylate. However, the crystalline form of imatinib mesylate was opposed first by Natco Pharma and then by other companies on the ground that the crystalline form as well as the main compound was already in the public domain and has no efficacy over the known substance imatinib mesylate. The Controller rejected the patent application and matter was carried
K e e p Wa lk i n g forward in High court in appeal, IPAB and to Supreme Court. Eventually, the patent stood rejected; but the Supreme court laid down the law that ‘efficacy’ as contemplated in section 3(d) is nothing but therapeutic efficacy, meaning thereby that unless a product shows some better ‘curative effect’, it will not be eligible for patent. This is pathbreaking judgment and is being followed till date. It is this interpretation that prevents frivolous patents from being granted in India. Special client experience Clients are of various types. Rajeshwari & Associates did some defamation case for an erstwhile Nawab whose image was morphed and printed in a newspaper. No fee was agreed. But after the firm won the case and got an apology from the newspaper, the Nawab gifted firm a ‘Shahi necklace’. It was something they could not forget. In another instance, one of the firm’s clients was sued by the furniture
giant IKEA. After an ex-parte injunction the client’s business being carried on under the name “AIKYA GLOBAL” came to a grinding halt. The firm intervened and after strenuous arguments, the court held that both these marks are totally different and the injunction was overturned. The client rejoiced and resumed his business under his earlier tradename.

In a talk with them, let’s get known to their journey in the field of law since inception. • Tell us about the firm. The law firm was initially set up in 2012 (as PAMASIS) with around a team of only 4 lawyers and has grown to become PSL Advocates and Solicitors with a team of around 35 advocates working out 30
of three fully functional offices, one in Delhi, Mumbai and Chandigarh. The firm is led by young counsels being Mr. Sandeep Bajaj and Mr. Sameer Jain (both Managing Partners) who have since day one focussed on tapping resources in the form of young counsels and channelizing their company and able assistance in furthering their goals. • What were the initial challenges you faced? The initial challenges which we faced were managing work and office requirements. I have recently been involved in the process of liquidating a company which has assets over 300 crores and me and my team is closely assisting the liquidator in keeping the company and the business alive, in terms of the spirit of the Insolvency and Bankruptcy Code, 2016. We currently have no plans to further expand our service base. We believe in the best in what we do rather than doing everything and not be the best. • How have you seen diversity change over the years in the legal sector? The diversity is across the type of laws, type of lawyers, type of mechanism for enforcement of legal remedies. The diversity has changed dramatically in terms of the eagerness of the parties to resolve disputes whether amicably or through alternative dispute resolution. I practiced core litigation for close to 10 years in the office of a renowned senior counsel; before me and Sameer joined the forces which led to the establishment of PSL Advocates and Solicitors. of your journey in law and litigation sector? Key achievements have been numerous in the combined experience of the members of the law firm. We as a firm have ensured in growing as a whole. Further, the culture in our firm is extremely relaxed and we call it a family! • Is there any special experience with your clients you would like to highlight? I cannot disclose the names, but there are at least three clients who came to us after they were told that no relief is possible from a lot of places. We were able to get them the desired relief in record time. Therefore, we have a precedent of a high rate of retention. As a full service law firm, it is most essential in having a holistic approach towards the requirements of the clients. Hence, while dispute resolution is a premier front for us, it is the ability to resolve all their
regular legal queries of a client that has kept the firm going strong. • According to you what next generation advocates and litigators should focus on? The next generation lawyers ought to focus on the product they have to deliver; if the focus remains unblemished, the achievements would always be unprecedented. Further, the young generation of lawyers must know that there is no shortcut for burning the midnight oil. None whatsoever!! • The one who you admire the most? Senior supreme court advocate Fali S Nariman has been always a source of motivation for us. • Constant vigilance- a need or a strategy? It is a strategy as it allows you to stay abreast and keep the personalised touch to the clients. • It’s a rat-race out there. How do you cope with that? It is a misconception, there is enough pie for everyone to eat. There is no need for anyone to eat from the other’s plate. Especially in this profession of law. I have never considered us as competitors in the so called rat race. In fact, me and Sameer sometimes sits and feel sad for people who think there is a rat race and they must run. Abdul Kalam, then Secretary, Department of Defence R&D, and the Director General, DRDO. This moment brought him back to the IP field with his appointment as Deputy Director, IPR, at DRDO Hqs.
