EDITORIAL CHINA'S ANTIDUMPING MEASURES ON ACETONE FROM SOUTH ASIAN COUNTRIES

hina is finally getting a taste of its own medicine. This country has been accused of antidumping by several countries in the past. The Ministry of Commerce Beijing has extended China's antidumping measures for acetone imported from Japan, Singapore, South Korea, and Taiwan for a further five years starting 8 June, the Chinese government says. China originally imposed the antidumping duties ranging from 5% to 51.6% for five years starting 9 June 2008. China launched in June 2013 a review of the duties in response to applications from Chinese acetone manufacturers. The review was completed earlier this month. Mofcom concluded that dumping of acetone from Japan, Singapore and other South Asia countries. Some months ago, China filed a dispute against the US at the World Trade Organization (WTO) biennial conference in Bali on December 3, 2013. The dispute centers on that country's disagreement with the method the U.S. uses in calculating whether exports from China violate anti-dumping measures. China brought its dispute to the WTO by using the mechanism of a request for consultation with the U.S. In consultation proceedings, WTO members can initiate a dialogue with each other to address disagreements on WTO matters. After the initial request for consultation was issued by China, the US had thirty (30) days to enter into consultations with China to resolve the disagreement directly. If no resolution is found, China can request the WTO to establish a panel to address the issue no earlier than sixty (60) days after the request was first filed. However, in practice, parties to a dispute often allow themselves more than 60 days prior to requesting that the WTO establish a panel. The request to establish a panel raises the pressure in the dispute process, and indicates the importance of the issue to the disagreeing parties. In the case of China, its government submitted the request for resolution to the US to contest the US methodology in determining whether certain Chinese exports were subject to anti-dumping measures. As the U.S. has imported more than $8.4 billion in U.S. imports of these products, a change in the anti-dumping status of these goods would greatly impact the US. One of the more contentious areas is that of targeted dumping and zeroing, which involve a specific statistical formula when determining if a pattern of differing

export prices exists among purchasers, regions or periods of time. When aggregating the intermediate comparison results, the U.S. used zeroing, which treats as “0” any amounts by which the export price of a transaction exceeds the weighted average normal value. The use of zeroing is contentious due to other countries' interpretations on how zeroing impacts the determination of anti-dumping margin. Other countries, including European Union nations and Japan, state that when applying a “0” number to a negative margin rate, the resulting margin is artificially inflated and creates an inaccurate anti-dumping finding. Not long ago, there was a lot of finger-wagging and threatening of China based on its trade surplus with India. It must also be considered some Indian companies may have benefitted from the application of this law vis-a-vis competitors from China. India is protecting its turf or trade interests more actively as its deficit with China has now grown to substantial amount. With a Narendra Modi-led government at the Centre, it trade interests are bound to get an increased vigilance. Under India law, one weapon in the India's trade war arsenal is an anti-dumping action. Anti-dumping laws provide protection to domestic firms from import competitors engaged in predatory pricing. The Antidumping Act is designed to stop the practice of pricing imports at a price substantially less than the actual market value or wholesale price of such articles in the principal markets of the country of their production with the intent of destroying, injuring, or preventing the establishment of an industry in this country. Thus, the law is supposed to stop importers from intentionally selling a product at a loss in order to drive competitors out of business, thereby establishing increased market power that allows one to raise prices above competitive market levels and increase profits. The Act provides for both criminal punishment, as well as a lawsuit for civil treble damages payable to any person harmed by a violation of the Act to sue for treble damages. Still, the prospect of being awarded treble damages has incentivized aggrieved private parties to pursue actions under the Act in the hope of being financially rewarded for their efforts and creating a larger potential penalty (and thus larger deterrent) for would be predatory importers.
