Circuit Judge Richard Vance sentenced a woman Tuesday to five years of probation and 90 days in prison for embezzling about $35,000 from her Gatlinburg employer. Lori Walker entered an open plea late last year to the charge of theft over $10,000, a Class C felony. She admitted to taking money from her employer, Sheila Ogle,
over the course of more than a year while working at Heartland Chalets and Rental Cabins. Ogle told Judge Vance that Walker was transferring money from the business to personal accounts. Ogle said she had hired Walker to help her run the company in part because of her family’s connections to law enforcement. Walker’s husband is an officer with the Gatlinburg Police Department.
“Because she’s had a family of law enforcement, I trusted her and hired her and turned my company over to her,” Ogle said in court. The two of them quickly became like family themselves, she said. “I loved her like a sister,” Ogle said. Whenever she had to be away from her business, she left Walker in charge. Eventually, though, Ogle said she started noticing charges that couldn’t be explained. For a while,
she trusted Walker’s explanations about where the money was going, but when she started asking more questions she was quickly able to confirm that Walker had been pocketing the money herself. Walker never testified during the sentencing hearing. Vance said the pre-sentencing report indicated she told an interviewer that she started taking money because Ogle had promised her a See theft, Page A4

By DEREK HODGES Staff Writer SEVIERVILLE — Workers were busy Tuesday putting the finishing touches on and moving equipment into the new Sevier County Ambulance Service headquarters, with a grand opening set for 2 p.m. today. While the effort to get the facility ready to host the county’s lifesavers has been going on for a month and construction preceded that by the better part of a year, that’s nothing compared to how long the crews
Huskey said Tuesday. “We started saying, ‘Let’s look at this because it’s about time.’” That statement seems easily justified. The current building at the corner of Blanton and Middle Creek roads next to the existing hospital was constructed 35 years ago and the service has become far larger in — Assistant Director Rick Valentine that time. “We certainly have outgrown the space over there and there’s no room with the ambulance service have for expansion,” Assistant Director Rick Valentine said. “That building been waiting for the new building. “We started on this as soon as I took over in 2002,” Director Steve See ambulance, Page A4
“We certainly have outgrown the space over there and there’s no room for expansion. That building has served the community well since 1975, but we certainly need a new headquarters.”
Looks like Jack Frost may be about ready to put a stiffer shot of winter in Sevier County’s Winterfest later this week. Although the temperature is expected to be a relatively balmy 34 with sunny skies today, Old Man Winter could come barreling through on Thursday with snow, if the National Weather Service forecast is accurate. Meteorologist Lyle Wilson at the NWS in Morristown said Tuesday that Sevier County, from the valley areas into Gatlinburg, can expect to see one to three inches of snow beginning Thursday morning and into Thursday afternoon, with higher elevations seeing two to four inches. “It will be mostly a daytime event,” Wilson said, “but after the snow is over, there could be showers into the weekend, perhaps through Saturday night. Of course, there are could be minor changes occurring as the system moves through that affect the amount of snowfall received.” Officially, the forecast for Thursday calls for a See snowfall, Page A4
Pontiac era ends at Larry Hill dealership By ELLEN BROWN Staff Writer SEVIERVILLE — Dec. 31 was not only the end of 2009 for Larry Hill Pontiac GMC employees in Sevierville — it was the end of an era, too. It was the day the dealership sold its last new Pontiac, a 2009 G6 GXP, to William Henry of Jefferson City. The GM brand stopped its production last year. Henry, who is also the owner of a Pontiac 1965 GTO convertible, has been interested in the brand for more than 30 years. “It seemed like the car to get — the last dream car,” he said of his New Year’s Eve purchase. Last summer GM announced the only 2010 Pontiac would be the Pontiac Vibe, with a limited run of fleet-only Pontiac G6 sedans. Hill’s Sevierville dealership sold out of the vehicles quickly. “Pontiac was a good seller,” Hill said Tuesday. “A lot of customers who were sports car-minded were

In the 1950s, Pontiac became known for
its sportier vehicles. In recent years, “GM felt like they had too many different lines of models,” Hill said. “They were in competition with themselves. They thought that by offering fewer lines, dealers wouldn’t have to stock as many vehicles, and they could compete against
other brands.” GM has also recently eliminated Saturn and Hummer from its production lines. Buicks will replace Pontiacs in Hill’s dealership. Of Buick’s three lines — LaCrosse, Lucerne and Enclave — the LaCrosse has a new, “totally re-designed”
model for 2010, Hill said. “We’re really excited to be getting the new Buick,” he said. “They did cater to ages 55 and older, but now they’re going after a new market, yuppies. This new line is very luxurious, and its chief competition will be Lexus.” Hill started selling cars in Knoxville at age 18. He bought his own dealership in 1982, selling Pontiacs, GMCs and Oldsmobiles. When Oldsmobile stopped production in the 1990s, it did hurt business a bit, Hill admitted, but he managed to pull through just fine. Three of his four children are employed by the Sevierville dealership, where wife Karen also worked 10 years ago until she retired. Hill is also co-owner of Thomas-Hill-Burgin Chrysler Jeep Dodge in Kodak. “It’s been a tough year and a half for the auto industry, but it’s beginning to get better,” he said. n ebrown@themountainpress.com

Twin Creeks Science and Education Center at Great Smoky Mountains National Park has received certification at the Gold Level under the U.S. Green Building Council’s Leadership in Energy and Environmental Design (LEED) rating system.
Twin Creeks Center in park earns ‘green’ certification From Submitted Reports NATIONAL PARK — The Twin Creeks Science and Education Center at Great Smoky Mountains National Park has received certification at the Gold Level under the U.S. Green Building Council’s Leadership in Energy and Environmental Design (LEED) Rating System. Park Superintendent Dale Ditmanson said, “As stewards of America’s most prominent and pristine natural and cultural resources, the National Park Service strives to set the best possible example of developing its facilities in such a manner as to make them as energy efficient and sustainable as we possibly can. In addition, we design structures that minimally disrupt and are visually harmonious
with the settings in which they are placed. The LEED certification process evaluates structures based upon five environmental categories: Sustainable Sites, Water Efficiency, Energy and Atmosphere, Materials and Resources, and Indoor Environmental Quality. Additional credit is given for Design Innovations. In the case of the Twin Creeks, the park included a wide range of practices and materials: minimizing the clearing of the surrounding forest, utilizing many of the boulders uncovered as landscape materials, chipping all the tree cut during construction for use as landscape mulch and constructing wetland pools to filter and clean roof-top and parking area water run-off.
It incorporates low-flow sinks and shower fixtures as well as waterless urinals. The building conserves energy by using large, insulated windows to maximize use of daylight, but also open and close automatically to take advantage of cool mountain breezes instead of air-conditioning. High-efficiency light fixtures adjust automatically to compensate for changes in outside light entering the building. Temperature controls are computerized to reduce energy use on nights and weekends when the building is unoccupied. The Twin Creeks Science and Education Center is located about two miles from and 1,000 feet above Gatlinburg. Its exterior is clad in regional river stone around the base, with

SEVIERVILLE — The Board of Mayor and Aldermen will hold their yearly retreat Feb. 8-10 at Smokies Stadium. That meeting could be the next time the city will discuss a request to build a road that would serve the planned Dumplin Creek development. The board uses the retreats to let department heads review its progress over the past year and discuss ongoing issues. The agenda has not been set, but officials said the issues could include whether to build the proposed road, which would run from Highway 66 to Bryan Road. Developer John Turley has indicated he can’t afford the road currently, and that it’s the main holdup in completing an agreement for WalMart to build a store there, as well as attracting other tenants. City officials are concerned because Sevierville has never used municipal funds to help pay for a road to serve a private development. When the matter was last discussed at a meeting in November, Mayor Bryan Atchley asked for personnel to gather information on the project, including means of funding. At the time, it appeared the board would discuss the issue again this month. Now, officials say they don’t plan to hold a workshop before the retreat, and the road could be on one of the topics discussed at that time. Also Monday, the board: n Voted on second reading to approve amendments to the 2009 budget due to bond refinancing n Renewed a contract for payments in lieu of taxes from Sevier County Electric System n Accepted a bid of $62,846 of a 44-page brochure of the Sevierville Vacation Planner for the Chamber of Commerce n Accepted a bid of $29,995 for installation of a filtration system to replace the old one at the Family Aquatics Center

has served the community well since 1975, but we certainly need a new headquarters. At current, one administrator in the aging structure has an office that used to be sleeping quarters for crew members, who are now cramped into a pair of bunk-style rooms, while another staffer keeps a desk in a janitorial closet next to a hot water heater. “It’s going to be nice to have everybody in their own place and with enough space for all they need to do, Valentine said. The new facility, located adjacent to the under-construction LeConte Medical Center campus and on property leased from Covenant Health, will offer a host of amenities in addition to plenty of office space. Those include individual sleep quarters, more garage bays for parking the service’s vehicles and a sound system that will allow crew members to listen to music of their choosing while still paying attention to the radio calls for their help, a gift from one of the service’s staffers. “Our employees don’t get a lot of downtime in a shift, so when they’re here at the station, it will be nice to have a place where they can really relax and sort of unwind from the stress of the job, Valentine said. “Every one of them is excited today. They’re probably as excited if not more as the crew was in 1975 when they moved out of the Sevier County Nursing Home and into the old building. While not everything will be ready for the entire operation to run out of the new headquarters by today, the bulk of the work will be done in time for the grand opening and the rest will be completed quickly. “We won’t be completely moved in, but we will be operational, Huskey said. “I guess they’ll be spending their last night over there ... barring anything unforeseen. In the end, the real test is if the new building will enable the ambulance service to better assist those who call for their help. Valentine believes it will. “This will be a real asset to the community, he said. “We have better access here, better facilities for our people and the office space that we need to be able to keep everything running smoothly.

Gov. Phil Bredesen answers questions during an interview on Monday
As special session looms, Bredesen nixes early prisoner release By ERIK SCHELZIG Associated Press Writer NASHVILLE — Gov. Phil Bredesen has rejected a proposal for the state to save money through the early release of thousands of prison inmates. The Democratic governor said in an interview with The Associated Press this week that the proposals to release up to 3,000 inmates convicted of nonviolent felonies would not have a lasting impact because the vacated spaces would be filled by inmates held in county jails. “We are paying for prisoners in local jails (and) if we created space, we would move some of those up, Bredesen said. “And the history has been, when there’s open slots in local jails, local judges tend to fill them up with more prisoners. As Bredesen sees it, the only way for permanent savings would be to shut an entire prison, which he is unwilling to do. Bredesen’s immediate focus has been on next week’s special session on education, but he said he hopes to put the final touches on his spending proposal by the time that session starts on Tuesday. The governor said the proposal he’s scheduled to present to lawmakers on Feb. 1 — the last one he will prepare because he’s term limited and can’t seek re-election — will come close to matching recurring expenses with recurring revenues as federal stimulus money is largely phased out. The current year’s budget includes a 10 percent reduction in the state budget, though many of those cuts were obscured by the infusion of $2.2 billion in stimulus money. The State Funding Board has projected the state’s revenues will expand by between 1.8 percent and 2.3 percent in the upcoming budget year, though that modest growth won’t be enough to make

raise and it wasn’t forthcoming. Her husband, Chris Walker, said he didn’t know how the money was spent. “I didn’t notice any extra surge in money,â€? he said in court. said. “She’s the love of my life until this, and we’re trying to get through this. The couple has two children, ages 5 years and 21 months. Walker didn’t seek judicial deferral. “It was not a single, impulsive act, he said, noting that records showed Walker drew from her business’s accounts more than three dozen times.
up for the loss of the stimulus. Bredesen had asked state agencies for proposals for trimming between 6 percent and 9 percent from their spending plans for the upcoming year. But he said in the interview that not all agencies will be asked to make equal cuts. “They’re not all even, they’re staggered, he said. “We’re past the point where you can just do that accross-the-board in any sense. Bredesen in 2008 used a voluntary retirement buyout to eliminate about 1,500 jobs. Democratic lawmakers used savings to delay about 700 more layoffs until the end of the current budget year on June 30. His next budget proposal will include fewer layoffs of state employees than originally anticipated, but Bredesen declined to specify how many of the state’s 48,000 full-time workers still face losing their jobs. “I’m trying really hard to figure out how to avoid putting people on the streets when it’s so hard to find another job, he said. Bredesen said he expects the biggest pressures from lawmakers to come over spending the state’s cash reserves. “The good news is the reserves are high, he said. “And the bad news is the reserves are high, and they’re kind of an attractive target for people. “I know there’s people from both parties who would just sort of rather grab the reserves and run, and avoid doing some of the difficult things that are in this budget, he said. In previous years, the governor has fought effort to tap those reserves to stave off deeper budget cuts. By ERICA WERNER Associated Press Writer WASHINGTON — President Barack Obama and congressional Democrats embarked Tuesday on the tough work of ironing out differences between House and Senate health care legislation with the aim of quickly approving a bill as midterm elections near. “Now is not the time to get stuck on any one point,â€? Rep. John Larson, D-Conn., said as he headed into a meeting with Speaker Nancy Pelosi and other House leaders to discuss their priorities for the final bill. “The important thing for us now is to close ranks behind the president and get a bill done.â€? Both houses have passed legislation to remake the health care system, extending coverage to millions who lack it while cracking down on industry practices such as denying insurance on the basis of pre-existing medical conditions. There are numerous differences between the two bills, include provisions on illegal immigration and abortion, a dispute over a government-run insurance option — the House wants one, but the Senate

House Speaker Nancy Pelosi of California, right, gestures during a news conference on Capitol Hill in Washington on Tuesday to discuss health care legislation. bill omitted it — as well as the size and extent of federal subsidies to help lower-income families afford coverage. Pelosi, D-Calif., suggested Tuesday that House members wouldn’t insist on the federal “public option as long as the final bill provided “affordability for the middle class, accountability for the insurance companies ... accessibility by lowering cost at every stage. “I’d prefer to call it the public’s option, an option for the public to hold the insurance com-
panies accountable and to increase competition, Pelosi said. “There are other ways to do that, and we look forward to having those discussions as we reconcile the bill. The House bill is more generous with subsidies than the Senate measure, and many House Democrats are concerned with ensuring that insurance will be affordable since the legislation will require most people to buy it. At the same time, some moderate Senate Democrats don’t want the bill’s price tag to grow.
At nearly $1 trillion over 10 years, the House bill is more expensive than its Senate counterpart. “The affordability credits is going to be a critical part of this discussion, said Rep. Chris Van Hollen, D-Md. The president planned to begin work with congressional leaders Tuesday to resolve those and other thorny issues. Following the meeting of House leaders, Obama was to meet with Pelosi and Majority Leader Steny Hoyer in the Oval Office, with Senate Majority Leader Harry Reid and Assistant Majority Leader Dick Durbin joining the meeting by phone. In a posting Tuesday on the White House blog, White House Communications Director Dan Pfeiffer wrote that there is “an unavoidable temptation among the media to focus on the five percent of differences between the two versions, instead of the remarkable 95 percent the bills have in common. But, even as difficult work does remain, it is important not to lose perspective of how far we have come and how close we are to enacting health reform.
Roaches, rats, arson used in strip club feud By GREG BLUESTEIN Associated Press Writer
Tennessee officials want Davy Crockett document TAMPA, Fla. (AP) — Officials in Tennessee want a 90-year-old Florida woman to turn over a marriage license application filed by legendary Alamo defender Davy Crockett more than a century ago. But the woman’s son, Vance Smith, said the document has been in the family for years. “She said it was hers and she wasn’t giving it up, he said. Lura Hinchey, archive director for Jefferson County, Tenn., said the original marriage license application of Crockett and Margaret Elder belongs to the county because it is a permanent record. On Tuesday, Jefferson County officials filed papers in a Tampa-area court seeking its return. The historic document is in the possession of Margaret V. Smith, whose son said she inherited it.
“I told her the original belonged to our county because it was one of our permanent records, Hinchey told The Tampa Tribune. “She said it belonged to her and she was going to keep it. Vance Smith said Tennessee officials didn’t ask for the license back until his mother appeared on the TV program “Antiques Roadshow. On the show, she told an appraiser her uncle, a Crockett fan, saved the 1805 document from being thrown out as a Tennessee courthouse was being cleaned out. The appraiser estimated the application was worth $25,000 to $50,000.

ATLANTA — After the upstart Club Onyx started taking business from other strip clubs, the operators of rival Platinum 21 dreamed up ways to shut it down. They tried littering the place with roaches, then infesting it with rats. And when all else failed, prosecutors say, they tried to burn the place down. The January 2007 fire shut down Club Onyx for six months and caused $1.8 million in damage and lost sales, according to court documents. It also led to a federal case against three employees of Platinum 21, who were each sentenced Tuesday to federal prison on conspiracy to commit arson charges. Sandeo Dyson, a 46-year-old security chief who set the club
ablaze, and Boyd Smith, the 41-year-old manager charged with helping to plot the arson, were both sentenced to five years in prison. Harold “Bit Thrower, the club’s corporate manager, was sentenced to three years for arranging the deal. “Setting afire a rival business to gain a competitive edge is not only a threat to free enterprise, it is a crime of violence, said Gregory Gant, the head of the Bureau of Alcohol, Tobacco, Firearms and Explosives’ Atlanta bureau. “Every time an arsonist strikes a match, the loss of human life is a distinct possibility. Competition is heated among the 35 or so strip clubs in the Atlanta area, said a local lawyer who represents the adult industry, adding that he’s aware of at least two other arson plots since the early 1980s among

Hydroelectric dams back online CHATTANOOGA (AP) — The Tennessee Valley Authority is starting the new year with its 29 hydroelectric dams running around the clock for the first time in three years. The Chattanooga Times Free Press reports TVA has more water stored in the reservoirs above Chattanooga than at the end of any year since it erected its network of dams in the 1930s and 1940s. That comes even after 70 days of spilling water through the dams to bring down water levels.
There’s so much water that TVA can’t capture all the potential energy because it doesn’t have the equipment to do so. “This type of situation is far more the exception than the rule,” said Chuck Bach, TVA’s manager for river scheduling. “We have looked at that, but it didn’t make sense.” In the Tennessee River — following a year of above normal rainfall in Chattanooga — an extra 45 billion gallons of water is flowing through the city every day above the mini-
mum flow requirement. That’s as much water every day as Atlanta uses from its main reservoir, Lake Lanier, in six months. The additional water has slowed barge traffic on the river. Barge operations have to stop when the river flows above 90,000 cubic feet per second through the narrow Tennessee River Gorge because the current becomes too strong to navigate safely. “We’ve got lots of water we’re trying to move through our system,” Bach said of the network of 49
dams for flood control in the region. “We try to bring our reservoirs down to their lowest levels ... by the first of January, but that has been a challenge this year because of all of the extra rain we have received.” TVA is spilling water this week through all of its Tennessee River dams except its Wilson and Wheeler Dams, although the flow rate has been reduced since last week, allowing some barge operators to resume operations.

Sen. DeMint is illogical on nominee
Tell me that Tiger Woods, South Carolina Gov. Mark Sanford and Charlie Sheen are getting together to open up a marriage-counseling firm. But don’t tell me that U.S. Sen. Jim DeMint, R-S.C., is holding up Senate confirmation of the boss of the Transportation Security Administration because DeMint wants assurances that the employees of that agency — responsible for making sure that Americans are able to travel safely by air and rail — will never be able to join a labor union. Forget that the nominee Erroll Southers — former city police detective, former FBI special agent in counterterrorism and foreign counterintelligence, and the former state of California official (appointed by Republican Gov. Arnold Schwarzenegger) responsible for oversight of counterterrorism policy — is obviously qualified for the post. Ignore that the TSA, most especially obvious after the Christmas day terrorist’s attack near Detroit on a Northwest Airlines flight, needs a full-time chief. DeMint is committed to keeping America safe from union members! DeMint argues that if employees were granted the right to bargain collectively that would mean that, according to The Washington Post, union leaders would have the power “to veto or delay future security improvements at our airports.” What kind of anti-worker disinformation is this man pushing? DeMint, a graduate of the University of Tennessee with a master’s in business administration from Clemson University, was born on Sept. 2, 1951, which means that he was 50 years old on the day of the Sept. 11 attacks on the World Trade Center. Has DeMint forgotten, or did he just never know, that on that fateful day 343 New York City firefighters -- to search for and, if possible, save the trapped and the terrified — marched into the jaws of death and into the fires of hell? Every one of those New York firefighters was a dues-paying union member of the International Association of Firefighters. But first they were public servants. Did DeMint ever know or has he already forgotten the crew of US Airways Flight 1549 — Capt. Chesley “Sully” Sullenberger III, First Officer Jeffrey Skiles and flight attendants Doreen Walsh, Sheila Dail and Donna Dent? Does he not remember the unbelievably cool and exceptionally courageous leadership that saved the lives of all 155 on board while “landing” their Airbus 320 on New York’s Hudson River? Every one of the US Airways crew, let it be noted, was a dues-paying union member, as was Patrick Harten, the 10-year veteran air traffic controller, whose own composed professionalism under unimaginable pressure made the “landing” and the rescue possible. The passengers of Flight 1549 were rescued from the frigid waters by the ferries and fireboats whose crews belong to the Seafarers Union, the Firefighters Union and the Patrolmen’s Benevolent Association. Surely the South Carolina Republican has not already forgotten Nov. 5, 2009, and the horrific carnage caused by Army Maj. Nidal Malik Hasan at Fort Hood in which 13 were killed and at least 28 wounded, and which only ended after a 5-foot bundle of courage, 34-year-old Kimberley Munley, a civilian Department of Defense police officer and the mother of a 3-year-old daughter, boldly engaged the shooter, fired four times and was herself shot by him in her legs and the arm. What Jim DeMint apparently does not know is that Sgt. Munley, just like every one of those 343 New York City firefighters, was both a dedicated and unselfish public servant and a proud, dues-paying member of a labor union. So, Mr. DeMint, let’s can the hogwash and the horsefeathers about public employees and their alleged “labor bosses,” and let us instead honor the words of John F. Kennedy to “let the public service be a proud and lively career.” — Mark Shields is a veteran political campaign manager and frequent television talk show commentator. Sentence structure
Wesley Teaster gets a second chance; let’s hope he takes advantage of it The famed defense lawyer Clarence Darrow, of Scopes monkey trial and Leopold-Loeb murder fame, once said, “There is no such thing as justice, in or out of court.” His cynical view is sometimes shared by those who don’t like the results of court proceedings — or life in general. There are a number of people who don’t approve of the sentence handed out to Wesley Teaster for his role in the death of Jeremy Chesney. Last month, Teaster pleaded guilty to vehicular homicide by reckless conduct in the May 4, 2008, wreck that left Chesney dead and sent Teaster to the hospital. Teaster was the driver. A charge of driving under the influence was dropped as part of the plea deal. On Monday, Circuit Judge Ben Hooper affirmed Teaster’s sentence and judicial deferral. He received a five-year suspended sentence and, if he doesn’t violate probation, can have his record cleared at the end of the five years. The family and friends of Jeremy Chesney think that’s a travesty of jus-
tice. Who can blame them? They did not support the plea deal, something Judge Hooper acknowledged in affirming the sentence. Chesney’s parents lost their only child, and they watched as the court system allowed the man responsible for Chesney’s death to be free and perhaps have his record expunged. Some say Teaster got preferential treatment because of the influence of his family. His grandmother is Pigeon Forge City Manager Earlene Teaster. If he did, he availed himself of every advantage he could find, as would anyone in the same situation. Just because young Mr. Teaster isn’t going to jail doesn’t mean he escapes punishment. Every day he will relive the incident. Every day he’ll face reminders of what he did and what was lost. Jail time is not the only measure of punishment. Guilt can be as harsh a burden to carry as time spent in a cell, and guilt usually doesn’t go away completely. He also suffered serious injuries of his own, including a debilitating injury that left
him without full use of one arm. Both Chesney and Teaster were coaches. Teaster was a volunteer coach for the Pigeon Forge baseball team — a role he should not be allowed to continue. The two young men apparently were friends. They had their lives ahead of them, with hearts and minds surely full of big plans and ambition. Hooper says he had no choice in granting Teaster judicial deferral. It has merely fueled the deep and unabated divide that has separated the two sides. Read the postings on our Web site to get an idea of how intense the passions are over this matter. A civil lawsuit filed against Teaster by the Chesney family remains unresolved. Time may not heal all wounds. However, this must be remembered: How Wesley Teaster lives the rest of his life will determine his legacy and whether there were lessons learned from this sad experience. He survived the crash. Let’s hope he takes this judicial second chance as a gift from which to do good things.

Seymour teacher’s death to be big loss for community
Public forum Seymour Primary School will bring to our community.
Editor: There are so many news stories today about teachers who have abused the privilege they have been given to work with young children and youth. Perhaps there is even a declining respect for a profession once so highly esteemed. However, there are still torchbearers — persons who teach with such dedication and compassion that others observe and envy the pure joy that comes with influencing young minds in a very positive way. The Seymour community lost one of those torchbearers this last week with the passing of Linda Magouirk, a recent retiree from Seymour Primary School. Linda was loved by many students throughout the years and cherished by her co-workers and friends. She always had a pleasant demeanor, a sense of humor, and the highest standard of professionalism. I know that I speak for many when I say how much Linda will be missed. Many prayers will be raised for the Magouirk family during this time of loss. Barbara Hatcher Former Assistant Principal
New Boyds Creek Highway traffic signal much needed
Editor: Regarding your Dec. 28, 2009 article, “Does light make right?”: As a resident of the area involved, I can say most definitely a traffic light is needed at the intersection of Boyds Creek Highway and Old Sevierville Pike. I travel that intersection twice a day, six days a week, and obviously County Commissioner Keener does not. In fact, it’s not even in his district, so I am not sure why he felt compelled to comment. I have discussed the new light with others in the neighborhood, and everyone agrees that it is greatly needed. Dec. 28 must have been a very slow news day for The Mountain Press to have given such coverage to comments by a commissioner who does not even live in this district. We in the area have known about the proposed light for quite some time, but then, we live here and travel this intersection daily. Thanks, TDOT. We who live here really do appreciate your efforts and look forward to the safety the much needed new traffic light

Printing of arrest reports can be harmful to innocent
Editor: For many years now I have been curious about The Mountain Press policy of the printing of arrest reports. I question this, as I have always been of the belief that a person is innocent until proven guilty. How is it that a person who could be found innocent in a court of law ends up with his/ her name smeared all over the community via the listings of the arrests, before guilt has been proven? I recall a case that occurred a few years ago, where a gentleman had been falsely arrested, but due to the publicity, he lost his job. I do believe that after much ado this was rectified, but the poor gentleman’s name was dragged through the mud throughout your distribution area. Does The Mountain Press feel they have a moral obligation to inform the community before guilt has been determined? Deborah F. Schrumpf Sevierville

Lady Tigers beat Seymour; 3-0 vs. county foes By COBEY HITCHCOCK Sports Writer
PIGEON FORGE — It was ugly, almost painful to watch for more than three quarters. But the final few exciting moments during Tuesday night's battle between county rivals Pigeon Forge (9-1) and Seymour (10-5) saw the homestanding District 3-AA Lady Tigers step up down the stretch to pull out an exciting 45-41 victory over the visiting District 2-AAA Lady Eagles. "We didn't play our best, but Seymour didn't play their best either," said Pigeon Forge coach Paul Reagan, following the fourpoint win. "Both teams looked rusty coming off the (Christmas) break. "But that was a humungous win for Pigeon Forge High School. This is probably our biggest win of the season so far." Tuesday's win also gives the Lady Orange and Black county bragging rights, keeping the Lady Tigers unblemished against Seymour, GatlinburgPittman and Sevier County High School. "So right now, we're 3-0 against the rest of the county," said Reagan. On the other side of the ball was Seymour, which came into Tuesday's contest riding high as the favorites after winning the Pilot Classic at Knoxville Catholic over Christmas break. "We weren't rusty," said a disappointed Seymour coach Andy Rines. "We just weren't ready to play." The Lady Eagles struggled offensively all night, both inside and outside. Seymour uncharacteris-

The Lady Tigers won 45-41. tically had seven airballs fired up in the first half alone from their usually dependable outside shooters. "I don't know what to say," said Rines. "We just couldn't hit a shot all night." After trailing for most of the game, Seymour built its biggest lead of the night, 35-31, when Jordan
Ballard drained a shot from downtown with 6:36 in the game. The Lady Tigers kept battling, however, and took the lead back when Ashley Wojnowski scored her only points of the night on a steal and layup to make it 36-35 Pigeon Forge with 4:22 left. Seymour's Hayley Clark gave the Lady Eagles a one-
point lead on consecutive possessions with a pair of turnaround seven-footers to make it 39-38 Seymour with 2:54 remaining. But Pigeon Forge's Cassidy Martin, Danielle Rauhuff and Kelsey Brooks all came up with clutch free throw shots down the stretch to preserve the fourpoint Lady Tigers win. Seymour Casie Cowan led
City gauging interest for adult tennis league SEVIERVILLE — The Sevierville Parks & Recreation Department is attempting to gauge interest in starting an adult tennis league to be played at City Park in the spring. If there is enough interest, a league may be formed for competitive players, as well as a league for recreational players. Tennis is a sport that requires skill levels to be somewhat equal in order for the game to be both fun and competitive. The department wants feedback or interest in such a league. Several years ago tennis leagues were popular in the Sevierville area. The Parks and Recreation staff has noted that more people are now playing tennis at City Park. Contact Patrick Oxley, athletic supervisor with the
department, at 453-5441 or the City Park office at 453-6616 to express interest. The league probably would run April through June. If there is enough interest, the city will begin to re-establish the leagues, create rules and attempt to re-start tennis in the community. The league is open for male and female players who are 18 or older. Serious tennis players you can join the competitive division. There would be designated practice nights where the courts are open for league participants. The lights at the City Park tennis courts have been turned off for the winter. The lights will be turned on between March 15 and April 1.
all scorers with 18 points, and teammate Shaelyn Brown was the other Lady Eagle in double digits with 10. Martin led Pigeon Forge and was the lone doubledigit scorer for the Lady Tigers with 10 points. Brooks added nine, Rauhuff had eight, Hurst had seven, Kesha Hooker had five and Ashlynn Trotter had four in
the win. "We had some big performances by a lot of girls tonight," said Reagan. "There may not be a lot show up in the stat sheet, but they made plays at the right time." Both teams showed some signs of rust early, but the Lady Tigers managed to build a 7-0 lead with 3:31 in the opening frame after the freshman Martin hit 2-of-2 from the charity stripe for her fourth point in the first. Seymour cut it to a point, 10-9, with 6:46 in the half after Cowan sniped a trey from NBA range. The Lady Tigers made it a 19-11 game with 1:34 until intermission after Trotter connected on two shots from the stripe. But the Lady Eagles answered with two unanswered field goals, the last coming on a 15-footer by Brittany Seagle at the halftime buzzer, making it 19-15 Pigeon Forge heading into the locker rooms. It was all Cowan to start the third quarter. First she hit a 15-footer at the 7:20 mark to cut it to 19-17, and then she sniped her second trey of the night at the 6:01 mark to cut it to 21-20, and then she gave the Lady Eagles their first lead of the night with another 15 footer at the 5:25 mark, making it 22-21 Seymour. The Lady Eagles maintained that one-point edge, 30-29, heading into the fourth quarter. The Lady Eagles will try to get back on the winning track Thursday at Jefferson County, while the Lady Tigers will play at Gibbs. chitchcock@themountainpress.com
NCAA rejects FSU appeal; upholds sanctions

Florida State head coach Bobby Bowden is carried off the field on the shoulder’s of his players after the Seminole’s 33-21 win over West Virginia in the Gator Bowl on Jan., 1, 2010 in Jacksonville, Fla.
From submitted reports
TALLAHASSEE, Fla. (AP) — The NCAA has upheld its decision to vacate up to 14 victories from former football coach Bobby Bowden as part of its penalty in an academic cheating scandal. Bowden retired as major college football’s second most winning coach with 389 wins after Florida State’s 33-21 Gator Bowl victory over West Virginia, Jan. 1. Penn State’s Joe Paterno, who is still coaching, has 394 wins. The 80-year-old Bowden was in California on Tuesday to present a Fellowship of Christian Athletes award named after him and not immediately available to comment on the decision. University officials, however, said they were surprised and disappointed by the NCAA decision. “We believed that our administration did everything it possibly could to
ferret out any and all improprieties in this matter,” Florida State athletic director Randy Spetman said. The NCAA could take wins away in as many as 10 Florida State athletic programs, including possibly stripping Florida State of one of three straight NCAA track championships won between 20062008. The NCAA Infractions Appeals Committee said Tuesday the cooperative efforts of the university in the academic cheating scandal involving 61 Florida State athletes failed to outweigh the aggravating factors in the case. “The case also included impermissible benefits, unethical conduct by three former academic support services staff members and a failure to monitor by the university,” the NCAA statement said.
Major League’s ‘Big Unit’ calls it quits after 22 seasons By JANIE McCAULEY AP Baseball Writer SAN FRANCISCO — Randy Johnson looked so awkward on the mound early in his career, that shaggy hair dangling down his neck as he fired a blazing fastball in every direction but the strike zone. Now, after 22 major league seasons, The Big Unit is walking away from baseball as one of the game’s greatest pitchers. The 6-foot-10 Johnson
announced his retirement on a conference call Tuesday, a decision that had been expected from the overpowering left-hander who reached 300 wins last June. “I really wanted to go out on my terms,” Johnson said. “I just feel like there’s not a lot more for me to do in this game. I just think it’s a natural progression when you play this long. Eventually you have to say it’s time.” A five-time Cy Young Award winner, the 46-year-
old Johnson accomplished just about everything in his remarkable career that a player hopes for in baseball. He owns a World Series ring and co-MVP honors, and was a 10-time All-Star. He threw two no-hitters, including a perfect game, and ranks second on the career strikeout list. Johnson finishes with a record of 303-166 and 4,875 strikeouts in 4,135 1-3 innings for Montreal, Seattle, Houston, Arizona, the New York Yankees and
San Francisco. His strikeouts are the most by a lefthander and second to Nolan Ryan’s 5,714. “It’s all been a bit of a whirlwind. I never really got caught up in what I did,” Johnson said. “I never really dwelled on my achievements. They’re nice. Maybe now I’ll be able to reflect on them.” Johnson overcame several injuries to keep pitching effectively into his mid-40s. He said before last season ended that he looked forward
to going home to Arizona and spending time with his family before making a decision about his future. “It’s taken this long into January because I definitely wanted to just kind of relax from the season being over and make sure I had a clear head when I made this decision, and that I would be making it wholeheartedly and would be sticking to it,” he said. Johnson went 8-6 with a 4.88 ERA in 17 starts and five relief appearances for
San Francisco last season despite missing more than two months with a strained left shoulder that also had a tear in the rotator cuff. He returned in late September as a reliever, a role he couldn’t see himself embracing in order to keep pitching. His final strikeout came on the season’s final day at San Diego, against Adrian Gonzalez to end the seventh inning. Johnson said he developed a better appreciation for relief pitchers last year.

My prediction: Johnson will take 5th straight NASCAR championship in ’10 The end of every year causes people to look back and reflect on what has been. Likewise, the beginning of each new year causes people to look ahead and ponder what might be. So, once again I will attempt to look into what has proven to be a somewhat clouded crystal ball and make some guesses as to what may lay ahead in the coming NASCAR season. Let us start at the beginning. The Daytona 500 is NASCAR’s most coveted race. Any driver with a sense of history wants to win this race and thus place his name beside the all time greats who have already claimed the prize. Perhaps no current driver in NASCAR has a greater sense of history than does Tony Stewart. Because of that, he has been tormented by his inability to win this most prized event. 2010 will finally be the year in which he ends that torment. Stewart is not usually known for putting his best foot forward but this year will break that trend as well. Once the Daytona 500 is past drivers and teams then begin to focus on winning the Sprint Cup championship. So, that prize will be the subject of my next prediction. At the start of the 2009 Chase for the Championship a friend of mine asked me who I thought would win. My answer was a simple one. Until somebody actually beats Jimmie Johnson and his Hendrick Motorsports team, why predict anyone else? The famous professional wrestler Ric Flair used to proclaim that, “If you want to be the man, you’ve got to beat the man!” As far as predicting a winner of the 2010 Sprint Cup championship I see no reason to go against the sagacity of such a wise philosopher as Mr. Flair. Jimmie Johnson will win his fifth consecutive title in 2010. Now, with a Daytona 500 winner and a Sprint

Cup champion declared, who will win the most races in 2010? Certainly, the afore mentioned Stewart and Johnson would be excellent choices for this distinction, but I am going in another direction. In 2009 Kyle Busch suffered through a ‘disappointing’ season. It was disappointing in the sense that he failed to qualify for the Chase for the Championship. Still in that ‘disappointing’ season he still managed four Sprint Cup wins. This year, with a new crew chief I believe Busch will return to his race dominating ways. Granted, his go for broke style sometimes leads to failures, but it also makes him a winner on occasions when he perhaps he should not have been. With that said, I believe Busch will visit victory lane as many as six or more times this season and will thus win the most races of any competitor. On another note, I believe race attendance and television ratings will see slight increases in 2010. I think two factors will contribute to this. First, NASCAR is going to revert to earlier start times which I believe will benefit both of the above mentioned issues. And perhaps more significantly, comparisons this year will be up against some very weak numbers that were put up last year, so there is hardly anywhere to go but up. However, as I said, I believe that up-tick will be but a slight one. There you have it. Those are my predictions for the 2010 NASCAR season. Feel free to make your own and compare against mine. Based on past results, I predict you will do very well if you try. Please contact me by visiting my website at RacingWithRich.com.

Grown children fed up with controlling mother
Zits
Blondie
Baby Blues
Beetle Bailey
Dear Annie: My mother is overly controlling with her grown children. She seems to think that when she gives an opinion, we have to agree. What’s worse, she is so negative about everything. She starts fights with us and expects us to capitulate and say she is right every time. She voices her opinions without thinking them through and has stepped on a lot of toes over the years. She has no friends left. We don’t even celebrate holidays together because it is simply too depressing. Mom will pick a fight on the phone, scream at the top of her lungs and then hang up and refuse to talk to us until we call and beg forgiveness. My father is the only one who is always on speaking terms with her, but he’s afraid to make her angry or she’ll start a fight with him, too. So he stays out of our disputes. The last few times I saw my mother, she didn’t seem well. There’s no point in telling her to see a doctor, because she has already been through four doctors in six months. She hates all of them. In spite of her abrasive personality, I still worry about her. I’ve suggested all of the siblings get together with both parents and voice our concerns, but my brothers and sisters do not want to hear Mom scream at us, and we know she will. Please help before she drives everyone away. -- Sad in Ohio Dear Ohio: People who are perpetually unhappy, pick fights with others and drive friends and family away are often depressed and may even have an underlying mental illness. Your mother’s apparent physical problems are likely exacerbating the situation. Unless
she recognizes that she needs help, she isn’t likely to respond well to any suggestion that she get it. Contact the Depression and Bipolar Support Alliance (dbsalliance. org) at 1-800-826-3632 and the National Alliance on Mental Illness (nami. org) at 1-800-950-NAMI (1-800-950-6264), and ask for assistance. Dear Annie: I am a photographer who has done many weddings. The current trend of strapless dresses, however, has presented wedding dress horrors. Please tell all brides looking for dresses to consider the following: Strapless dresses don’t look great on everyone, especially overweight or large-busted women. If you feel even remotely uncomfortable in the dress, you will look it. If the dress slips down at all when you walk, imagine spending your entire wedding adjusting it and pulling it up. These things are not attractive. More than once, I have seen a surprise appearance by “the girls,” especially when the bride lifts her arms while dancing or to throw the bouquet. Bending over to talk with children or kiss Grandma presents a whole new problem. I have spent hours Photoshopping out creases, dimples, stretch marks and unattractive cleavage. So try a dress with spaghetti straps or a halter, or wear something that shows off your back, but please, no more strapless gowns. -- K.R. Dear K.R.: Thanks for your words of wis-

dom. Brides, take note. Just because it looks good in a magazine doesn’t mean it’s right for you. Dear Annie: The letter from “Hopeless,” who suspects her husband has Asperger syndrome, really helped me grasp my situation. My uncommunicative husband is 60, and I, too, suffer from depression. It’s like we are living parallel lives. I have been with “George” for five years and have become so angry and miserable about his inability to connect. When he’s with me or others he has known a long time, he speaks appropriately, but in the company of strangers, he rants, becomes overly opinionated and rude, and sounds idiotic. I’ve accused him of ignorance and asked whether he was ever diagnosed with a disorder. He has been married three times before, and I am in the process of leaving because I cannot go on like this. It really is a comfort to be able to identify and understand this. Although I still need to leave, it helped me immensely. -- No Longer Struggling Dear No Longer: Before walking out the door, please talk to your doctor about your husband’s behavior and see whether anything can be changed. Americans’ job satisfaction falls to a record low WASHINGTON (AP) — We can’t get no job satisfaction. Even Americans who are lucky enough to have work in this economy are becoming more unhappy with their jobs, according to a new survey that found only 45 percent of Americans are satisfied with their work. That was the lowest level ever recorded by the Conference Board research group in more than 22 years of studying the
issue. In 2008, 49 percent of those surveyed reported satisfaction with their jobs. The drop in workers’ happiness can be partly blamed on the worst recession since the 1930s, which made it difficult for some people to find challenging and suitable jobs. But worker dissatisfaction has been on the rise for more than two decades. “It says something troubling about work in America. It is
not about the business cycle or one grumpy generation, says Linda Barrington, managing director of human capital at the Conference Board, who helped write the report, which was released Tuesday. Workers have grown steadily more unhappy for a variety of reasons: n Fewer workers consider their jobs to be interesting. n Incomes have not kept up
Ned Flanders, Reverend Lovejoy, Kent Brockman, Dr. Hibbert and Principal Skinner. Besides “The Simpsons, Shearer, 66, is best-known from his role as bassist Derek Smalls in the 1984 mock musical documentary “This Is Spinal Tap, and subsequently in the real-life group that film inspired. But Shearer, who began his career as a child actor on such early TV series as Jack Benny’s weekly show, keeps a multiplicity of projects under way. These currently include a new DVD, “Unwigged & Unplugged, reteaming him musically with Tap bandmates Michael McKean and Christopher Guest. He hosts his own signature channel on the “My Damn Channel comedy Web site. And for a quarter-century, he has churned out “Le Show, a mostly solo act of wry humor, satirical sketches and blistering commentary, plus music (some performed by his singer-songwriter wife, Judith Owen). “Le Show is available through numerous radio and Web outlets, and by podcast. It’s a weekly passion project that Shearer has always done gratis — which means he’s free from any vexing business entanglements. “I never have a meeting, I never see a memo, he says. “It’s between me and my audience. Sipping an early morning orange juice during a Manhattan stopover a couple of weeks ago, Shearer describes “Le Show as a place for him to give voice to whatever’s on his mind. “I’m an insatiable news junkie, he says, “so the reading that I do, I would do anyway. The show just gives me a way to answer back. The sensibility of “Le Show, and much of Shearer’s creative output, is conveniently echoed by “The Simpsons, even though he plays no part in its writing. “Matt has a satirical, anti-authority streak, says

NEW YORK — To speak of the latest milestone by “The Simpsons seems to restate the obvious. Long before now, enduring life for “The Simpsons and its brightly jaundiced folk was simply assumed. What began 20 years ago as a fluke then erupted into a pop-culture juggernaut has continued to spin yarns, spawn characters and lampoon society with no end in sight. On Sunday at 8 p.m. on Fox, “The Simpsons is airing its 450th episode. “Once Upon a Time in Springfield will be followed by an hourlong documentary from Morgan Spurlock (30 Days, “Super Size Me), fancifully titled “The Simpsons 20th Anniversary Special in 3-D on Ice. During this season, when NBC’s “Law & Order boasts of having tied “Gunsmoke as TV’s longest-running prime-time drama, “The Simpsons has seized the mantle as TV’s longestrunning scripted nighttime series — period. Ay, caramba! “I think we could do it for another 20 years, actually, Matt Groening, “Simpsons uber-creator, told The Associated Press at a recent “Simpsons tribute by Los Angeles’ Paley Center for Media. Then he dissolved into giggles. “Omigod! Another 20? We’ll TRY, he chortled. “We’ll do our BEST! Here’s hoping the spectacular ensemble of voice talent keeps talking to the end. After 20 years, Dan Castellaneta remains fullthroated as portly, dimwitted dad Homer, Julie Kavner is tower-tressed mom Marge, Nancy Cartwright is lippy firstborn Bart and Yeardley Smith is oversmart daughter Lisa. Of course, these off-screen stars of “The Simpsons are well served by visual artistry that, among things, keeps them shielded from the passage of time. The show’s writers play a huge role, too, with fastidiously crafted scripts that, by comparison, leave most sitcoms in the dust. (Granted, some fans may complain “The Simpsons isn’t as sharply realized as in earlier years, but still.) “What I love about ’The Simpsons’ is, it’s so collaborative, Smith said. “The actors do a third, the animators do a third and the writers do a third. That’s how I see it. Also part of the acting troupe is Hank Azaria, a go-to guy for numerous characters including police Chief Wiggum, Comic Book Guy and convenience-store owner Apu Nahasapeemapetilon. Rounding out the core cast is Harry Shearer, whose stable of roles includes Mr. Burns, Waylon Smithers,
Shearer. “From the beginning, ’The Simpsons’ was taking the side of the family against all the authority figures and institutions that buffeted them in the modern world. Certainly, that resonated for me. Shearer recalls the show’s first script, whose characters assigned to him were highlighted in yellow. In the next script, other characters’ dialogue would be highlighted for him. Much of the time, he didn’t see drawings of the new characters until months after he had created their voices, when the episode was finished: “Oh, THAT’S what he looks like! How many different voices has Shearer done on “The Simpsons in all? “The one real influence that Bob Dylan has had on my life is that, every time I’m asked that question, I give a different answer, says Shearer. “So: hundreds, he replies in a raspy Dylan-esque voice. As the years passed, Shearer’s many voices were part of the emerging world of Springfield, an oblivious community that seemed satisfied to settle for less in nearly everything: public education; organized religion; TV news and kids programming; government, law enforcement, business, and food and drink intake; and certainly environmental issues, such as the nuclear power plant that employs Homer Simpson, of all people, as a safety inspector. What’s the message of “The Simpsons? That people, for all their highfalutin talk, are willing to settle for less if it’s easier or saves them a buck?
Nate Carrasco, 26, of Odessa, Texas, says he’s been pretty unhappy in most of his jobs, including his current one at an auto parts store. “There is no sense of teamwork in most places any more, Carrasco gripes. When the Conference Board’s first survey was conducted in 1987, most workers — 61 percent — said they were happy in their jobs.

with inflation. n The soaring cost of health insurance has eaten into workers’ take-home pay. If the job satisfaction trend is not reversed, economists say, it could stifle innovation and hurt America’s competitiveness and productivity. And it could make unhappy older workers less inclined to take the time to share their knowledge and skills with younger workers.
