SEVIERVILLE — The city has maintained from the start that it won’t help pay for a road that would serve the Dumplin Creek shopping center project along Interstate 40, but has still been listening to ideas from developer John Turley for financing the
thoroughfare. The Board of Mayor and Aldermen has told Turley that it would violate a long-standing policy if the city helped pay for private infrastructure cost. City Administrator Steve Hendrix provided a copy of an Oct. 5 e-mail in which he first made that point to Turley. “As a policy, all private devel-
opments are required to pay for infrastructure cost. The City would be unable to fiscally support the debt service of the multiple proposed private developments in our market,” Hendrix wrote. Even before Turley met with BOMA in February to explain his position, Hendrix had met with bond attorneys, consultants and the state comptroller to review
possibilities to help finance the estimated $12.5 million project. Turley had initially hoped to pay for the road by making his property a special assessment district, which would allow him to obtain a bond to cover the costs and repay that money with a fee placed on tenants as it was developed. KODAK — A truck full of onions caused a major stink when it overturned Monday on East Dumplin Valley Road near the Motel 6 and Smokies Stadium, forcing officials to close the road for hours. The tractor-trailer was carrying more than 40,000 pounds of onions when it overturned, said Bob Stahlke, spokesman for the Sevierville Police Department. The accident happened at about 3:30 p.m. Officers said the onions would have to be transferred to another rig before tow trucks could be used to pull it upright. A passenger in the truck apparently suffered minor injuries, Stahlke said, and charges could be pending against the driver.

KNOXVILLE — Several of the people that Ponzi schemer Dennis Bolze defrauded have already made repayments totaling hundreds of thousands of dollars demanded by the trustee in the bankruptcy case on Bolze’s estate. At least one person is set to go to court after he didn’t repay the money. Among the groups listed in recently filed court documents as having made payments are the University of Tennessee, Friends of Fred Thompson and the Boy Scouts of America. Bankruptcy trustee Wayne Walls is asking the court to allow each of those and a few individuals named in the documents to pay less than they actually received from Bolze, citing issues with retrieving all the funds. Walls sent out letters to most of Bolze’s victims in May demanding that they repay any dividend checks from Bolze into a communal fund held by the trustee as part of involuntary bankruptcy proceedings. The proceeds from the tournament benefit the foundation, which awarded $43,000 in college scholarships in May to graduating seniors. The foundation also awarded $4,500 in dual enrollment scholarships to juniors and seniors last school year. Rader has been selling hole sponsors and teams. Dr. Fry to speak at forum Submitted Report SEYMOUR — The July 8 meeting of the Seymour Library Community Forum will feature a discussion with Dr. Bill Fry on his trip to help with the disaster in Haiti. The 2010 Haiti earthquake was a catastrophe, with an epicenter near the town of Léogâne, approximately 16 miles west of Port-au-Prince, Haiti’s capital. The earthquake caused major damage to Port-au-Prince, Jacmel and other settlements in the region. The earthquake struck in the most populated area of the country. The International Federation of Red Cross and Red Crescent Societies estimates that as many as three million people had been affected by the quake. Fry spent a week on the scene in early April providing medical relief. Call the library at 573-0728 to register for the event so information packets may be prepared. some cases amounts to six figures. The move sparked outrage from some victims, who argue it makes them victims twice over. They contend Bolze took all their savings, leaving them with no way to recapture the money he sent them under the guise of payments as part of his financial fraud. Meanwhile, Walls maintains the action is a fair and completely legal one that he can use at his discretion in such cases. He says it would be unfair not to collect any payments any of the investors got, since they were all apparently made with money Bolze got fraudulently. That makes them the beneficiaries of the scheme, while many of those who jumped into Bolze’s game late didn’t get any such payments. All should have the opportunity to share all the money that can be reclaimed from the scam, Walls says. The documents filed in court last week show six instances in which Walls has decided a “compromise� — allowing the victims to repay only a portion of the payments they received — is the best route to take. The investors named apparently received payments totaling $228,500, includ-

the recession started, he told the Sevierville board he didn’t think that was feasible and asked the city to contribute $8.5 million of the cost. Turleys insists the city would get that back and more through tax revenues from business sales in the shopping complex. The matter was last discussed by the board at its February retreat, when Turley said he might come back with a new proposal. Hendrix said city workers met with Turley and his staff since then, concerning a new proposal by the developer calling for the city to pay for the road, with assurances that Turley would pay the city back. While Hendrix characterized the meeting as positive and productive, he said the proposal was short on the details they’d need before taking it to the board. Tt does not include specifics of how Dumplin Creek would guarantee its ability to repay the money in two years, or a plan of action that would have business ready to start paying CBID sales tax revenues in that period. “Any professional financial institution would require a detailed business plan and the supporting documentation along with the source of information in order to assess the risk associated with the investment,� Hendrix said. “The city should not expect anything less. “We continue to support every effort on behalf of Dumplin Creek and we are willing to explore opportunities. However, the city has informed Dumplin Creek of its position and policy and we still

The city didn’t pay for infrastructure that served Wilderness Resorts or property planned for a commercial development, he said. Court extends gun owner rights nationwide WASHINGTON (AP) — The Supreme Court held Monday that Americans have the right to own a gun for self-defense anywhere they live, advancing a recent trend by the John Roberts-led bench to embrace gun rights. By a 5-4 vote, the justices cast doubt on handgun bans in the Chicago area, but signaled that some limitations on the Constitution’s “right to keep and bear arms� could survive legal challenges.

Justice Samuel Alito, writing for the court, said that the Second Amendment right “applies equally to the federal government and the states.� The court was split along familiar ideological lines, with five conservative-moderate justices in favor of gun rights and four liberals opposed. Chief Justice Roberts voted with the majority. Two years ago, the court declared that the Second Amendment protects an indi-
vidual’s right to possess guns, at least for purposes of selfdefense in the home. That ruling applied only to federal laws. It struck down a ban on handguns and a trigger lock requirement for other guns in the District of Columbia, a federal city with unique legal standing. At the same time, the court was careful not to cast doubt on other regulations of firearms here. Gun rights proponents almost immediately filed a federal law-

The National Hurricane Center in Miami says Alex is expected to become a hurricane Tuesday. It’s center is on a track from Yucatan headed for the Texas-Mexico border and away from the oil spill area off Louisiana. A hurricane watch means that hurricane conditions are possible within 48 hours.

Bredesen OK with budget NASHVILLE (AP) — Tennessee Gov. Phil Bredesen said Monday that the state’s spending plan is in good shape compared to other states that are struggling financially. The Democratic governor said many states were depending on FMAP money, which Congress has yet to approve and it’s uncertain when since the legislation stalled this month. FMAPs, or Federal Medical Assistance Percentages, are used in determining the amount of federal matching funds
for certain state expenditures. Tennessee was expecting about $341 million, but had placed the money in a contingency plan, which means the state’s budget won’t be affected if it doesn’t get the funds. “There’s nothing about this budget that’s going to come apart if it’s not there,” Bredesen said. But he said some states are “just in these impossible situations, where they assumed that they’re getting all the FMAP.” Sen. Randy McNally,

Government can’t control health costs By Alieta Eck Guest columnist
From the patients in my office we can learn why Medicare and Medicaid cannot control costs. Neither the president, the Congress, nor learned journals are telling these stories. A spry, cheerful patient told me that she had fainted under the hair dryer in her beauty salon. The rescue squad rushed her to the emergency room of the nearest hospital. On the way, she was alert and speaking clearly with no weakness of her arms or legs. She told the rescuers that this had happened once before a few years ago. All indications pointed to a simple fainting spell. Maybe she was dehydrated. The warmth from the hair dryer probably caused blood vessels to dilate and her blood pressure to drop. Nevertheless, she spent three days in the hospital with EKG monitoring, and underwent a CT scan, an MRI, an EEG, and endless blood tests — all normal. Several specialists were called in for this “complicated” case. Finally, the patient insisted on going home even though some advised her to stay a little longer. She commented on how she probably would never have even been admitted had she not been covered by Medicare. And Medicare (working people and their as-yet-unborn grandchildren) will probably pay more than $20,000. A television commercial states, “Last year, 9 out of 10 people got their Hoveround for little or no money.” A perfectly healthy appearing actress, sitting in her fancy scooter, folding her wash, says, “With Medicare and my insurance, I paid nothing out of pocket.” Those commercials ignore the fact that someone is paying for those expensive scooters— just not the actual users. In a free clinic, one patient told me she preferred the brand name to the much lower cost generic. “Why?” I asked. “My friend told me the brand name is better.” Her prescriptions are covered by Medicaid. I respectfully declined to write, “brand medically necessary,” and explained that although the medicine was free to her, the state of New Jersey is out of money and the generic will probably work just as well. Are these patients or their physicians committing fraud? No. They are simply acting legally to enhance their own wellbeing, following the incentives set up by the unwieldy system. People with “coverage” do not care what costs they incur, and those who provide services benefit by providing more. As with the oil rig in the Gulf, there is a lot of pressure behind the leak. Adding more pressure — as with the Democrats’ idea of saving money by covering everybody — is not the answer. We have in fact already tried it — in Massachusetts. The one-state version of ObamaCare functions only because of heavy federal subsidies. Massachusetts has tried to limit fees, and still the state is hemorrhaging cash. Massachusetts Medicaid went from $1 billion to $1.75 billion in four years and the taxpayers from the other 49 states subsidized half that increase. Will it take a bomb to stop the leak before we are smothered in oil or debt that our grandchildren will never be able to repay? What will be the result of the looming 21% cut in Medicare payments to physicians? Doctors who have been accepting steadily diminishing payments to care for the elderly are increasingly bolting out of the system. Savvy Medicare recipients will continue to secure their free Hoverounds, but the weaker, more confused, sicker, and more vulnerable will find that fewer physicians will be able to care for them. Once the nation is bankrupt, hospitals have closed, and physicians have found alternate ways to earn a living, real medical needs will not be met. The best medical care in the world will simply cease to exist. Then all Americans will feel the pain. There is a better answer, pointed out by Rep. Ron Paul, R-Texas: “We need a system in America where patients pay cash for basic services, and carry insurance only for serious illnesses and accidents. ‘Health maintenance’ is the responsibility of each of us individually. We cannot continue to collectivize the costs of healthcare and expect things to get better.” — Dr. Alieta Eck has been in private practice with her husband in Piscataway, N.J., since 1988. Off course Eagle’s Landing seems destined to be a money-losing operation Is Eagle’s Landing Golf Course a government boondoggle? The expansion project is $6 million over budget. The former director, who was fired earlier this year, has been accused of financial mismanagement and letting countless people play for free. The course is expanding at a time when the national golf market has become soft and the nation may have too many golf courses. It looks bad. It seems unlikely the city can operate it at a profit in the near-term. There is no turning back at this stage. The added 18 holes and the new clubhouse are almost finished. Officials are now searching for the right person to run the operation. A consulting firm is assisting in the operations now, but has no interest in running the course. Eagle’s Landing will have to make it on its own, unless the city leaders decide at some point to seek proposals from private firms to run it. Taking its operations private would not be unheard of. Virginia Beach, for one, is planning to privatize its
golf courses because, for one thing, expenses exceeded revenues by some $260,000 last year. In a recession, running a golf course at a loss doesn’t please the voters or the taxpayers. Eagle’s Landing is being expanded using the bond issue financed by the Central Business Improvement District. Under the CBID, sales taxes that would go to Nashville remain here to pay for development in the district. That’s how the Events Center was paid for, as well as infrastructure improvements throughout the CBID, which runs from downtown to the Exit 407 area. Some officials think the 36-hole Eagle’s Landing and the modern clubhouse will make the course a destination for outsiders. It had better. There is no way locals can keep the course from running in the red. However, expecting the golf course to become a must-see stop for golfers is hugely optimistic. Maybe when the economy turns there might be some hope, but it looks impossible now. The National Golf Foundation has
these sobering statistics and predictions: 10-15 percent of public courses are facing significant financial challenges (experiencing operating losses at a level that puts them in poor financial health); 100-300 courses per year are expected to close until supply and demand come more into balance. There were 90 more closures than openings (in 18-hole equivalents) in 2009, “continuing the slow market correction of golf’s imbalance of supply and demand,” the foundation says. In the face of a soft golf market, financial pressure on existing courses, a recession and an overabundance of courses nationwide, running Eagle’s Landing in the black instead of the red will be an enormous challenge. Yet, as long as it hemorrhages money, the naysayers and opponents of a local government losing money on a golf course will only grow in number and volume. The consulting firm says it can get the course operating in the black. Let’s hope so. Still, there is a nagging feeling this is more of an obstacle course than a golf course.

Public forum Security seems not to exist in parking lot at Dollywood
Editor: My husband is a long-time employee at Dollywood. He parks in the handicap parking area of the employees’ parking lot. On Friday, June 4, the left rear view mirror of our automobile was damaged to the extent of $299.20. The mirror was broken and laying on the ground when my husband returned to the automobile at approximately 5:30 p.m. The mirror mounting device was damaged and hanging on the side of the automobile. We immediately had the mirror replaced,
as it is against the law in Tennessee to operate a vehicle without a left side rear view mirror. That was done on Tuesday, June 9. Exactly two weeks to the day, my husband came home from the park minus the left rear view mirror. The entire mirror and mounting had been neatly stolen off the automobile. It is apparent to me that the security people at Dollywood are not doing their jobs. This second incident was reported to security at Dollywood; their response: They guess they need to do a better job of patroling the parking lot. I can’t find anyone who has seen them patroling the employees’ parking lot at all.
Most employees are aware of the lack of safety measures enforced at the park. Now I not only worry about the safety of my husband every day that he goes to the park, but now I must worry about our automobile as well. I hope nothing like this ever happens to any of you good employees of Dollywood. We all know that the “park hosts” are the ones who make the park the wonderful family place that it is today. NILES, Ohio — Former Pigeon Forge Tigers baseball star Tyler Cannon has been tearing it up in the Minor Leagues since joining the Mahoning Valley Scrappers — a Cleveland Indians short-season Class A club in Niles, Ohio, and part of the New York-Penn League — last week. In five games with the Scrappers, Cannon is 8-of-21 at the plate and has three doubles, five RBIs, six runs scored and a .381 batting average. Throw in a couple of walks, and Cannon has a .435 on-base percentage in his brief professional career. Cannon doubled in his pro debut last Wednesday, and he added two more doubles this past Sunday, including a game-winning two-RBI two bagger in the top of the ninth to give Mahoning Valley a come-frombehind 5-4 win over the Auburn Doubledays. “It’s been great,” said Cannon. “I’m one step closer to my dreams of playing in the Big Leagues now that I’m in Minor League Baseball. “Besides the wooden bats, there’s really not much of a difference from college baseball. The fifth-seeded American was ousted 4-6, 7-6 (3), 7-6 (4), 6-7 (5), 9-7 by Yen-hsun Lu in a match that lasted more than 4 1/2 hours. Lu sealed the victory in the 16th game of the fifth set with his only service break of the match. The 26-year-old Lu had lost in the first round at Wimbledon four straight times and failed to win a match at the past five Grand Slams. He’s the first Asian man to reach the quarterfinals of any Grand Slam since Shuzo Matsuoka of Japan did it at Wimbledon in 1995. Capriati recovering from ‘accidental’ OD By ANTONIO GONZALEZ Associated Press Writer Former tennis star Jennifer Capriati was recovering Monday from an accidental overdose of prescribed medication, a family spokeswoman said. The 34-year-old Capriati, once ranked No. 1 in a career sidetracked by personal troubles, was in stable condition and expected to make a full recovery, spokeswoman Lacey Wickline told The Associated Press. She declined to identify the medication. Capriati was rushed to a South Florida hospital early Sunday morning, she said. Wickline would not say how Capriati was found or who called emergency services. “In response to an outpour-
ing of concern and support shown by Jennifer’s fans and friends worldwide, we would like to acknowledge that Jen is recuperating at a South Florida hospital from an accidental overdose of medication prescribed to Jen by her personal physician,” Wickline said. “Jen is recovering fully and stably.” Public records show Capriati owns a condo on Singer Island in Palm Beach County, Fla. Riviera Beach city spokeswoman Rose Anne Brown said a person was transported from Capriati’s address Sunday morning but could not provide details, citing privacy laws. want to win in the Minor Leagues, but it’s more about developing into the best baseball player you can be. The wins and losses aren’t quite as meaningful as in college. If you’re a competitor, you obviously want to win, but it’s just a little bit different of an approach.� The majority of college players who sign with MLB teams play in shortseason baseball following a complete college baseball season, although some first-round picks end up going straight from college to Class A or AA clubs the same season. After being drafted by the Indians in the 12th round of the Major League Baseball First-Year Player Draft earlier this month, Cannon — the 360th overall pick — said realistically his eyes are on the higher levels of Minor League Baseball next year, or whenever the opportunity presents itself. “I’m just trying to concentrate on becoming the best player I can be right now,� said Cannon. “And I’ll let the chips fall where they may. We’ll see what happens.� Cannon, who played four seasons for

“Even though we fell a game short of the College World Series, we still accomplished a lot.� Cannon said he’ll always be a Cavalier at heart, just as he will always be a Pigeon Forge Tiger. “I’ll be keeping my eye on (the Cavs) for the rest of my life, and I’ll be cheering for them from here on out,� said Cannon. “And I still remember my days playing for the Tigers like it was yesterday. “I could still probably tell you what happened in just about every game that I played at Pigeon Forge. Time has flown by, that’s for sure, but I had a lot of good experiences at Pigeon Forge High School and I always had a lot of fun there.� Cannon, who left Virginia as the school’s all-time leader in games played and third in school history with 274 hits, said one thing that helped ease the pain of missing the CWS this year was how hectic things have been since joining the Indians’ program. “It was a quick turnaround,� said Cannon. “A week after my Virginia season was over, I was here playing baseball.�
the University of Virginia Cavaliers, said he’s always heard horror stories about the travel habits of Minor League clubs. “And all the stories I’ve heard about bus rides being the worst part of Minor League Baseball are definitely true,� said Cannon. “We had a home game (last) Friday night, and immediately after the game we got on a bus and took a seven-hour ride to New York, and that won’t even be the longest bus ride we’ll be making this summer. “We got into New York at about 4 a.m., and then we had to play that night. But even with that, it’s been great to be playing baseball every day.� Cannon’s college career came to an end Monday, June 14, one game shy of qualifying for the College World Series for a second consecutive year. “It was tough,� said Cannon, referring to the season-ending 11-0 loss. “We ran into a hot Oklahoma team at the wrong time, but that’s the way baseball goes sometimes. “But we still had a good year, we won a school record 51 games, we set attendance records and there’s still a lot of positive stuff that happened for us.

There would be no rally though as the Mudcats tagged the Smokiesâ&#x20AC;&#x2122; bullpen once Cabrera left, scoring five more times over the last five innings. Relievers Jeremy Papelbon and Alex Maestri allowed a combined three runs on six hits over the next three innings, giving Carolina a commanding 8-1 lead. The Smokies did put up a couple of runs late. In the seventh, Russ Canzler reached on an error and then went to third on a double by Marwin Gonzalez. Canzler would score on a sacrifice fly by Nate Samson, briefly cutting the deficit to 8-2. Canzler would score again for the Smokies in the ninth, on a Tony Campana single to finish out the scoring. Carolinaâ&#x20AC;&#x2122;s Matt Klinker (5-4) got the win, allowing two runs (one earned) on four hits in seven innings of work. Cabrera (0-4) took the loss, allowing five runs on seven hits in four innings. He struck out four.

Debt collectors’ pestering of relatives taking toll on couple

Dear Annie: In these tough economic times, my husband and I have managed to stay ahead of things by working hard and being careful with our money. We know we are both fortunate to have jobs. Some family members are not so lucky and have lost their homes. The appalling thing is that bill collectors have started calling us looking for these relatives. I have no intention of helping them. Each time they call and ask for the extended family member, I first ask their name and that of the company they’re calling from, and I write this down along with the date and time. I then tell them there is no one here by that name and never has been and ask that they please not call again. But these snakes still call. I now have a list of these repeat offenders. My question is, to what agency should I report this harassment? And maybe you could let the rest of the world know that they have recourse against these reprehensible tactics. I understand they are owed money, but that is between them and the individuals. It has nothing to do with me. -- Tired of the Harassment Dear Tired: The Fair Debt Collection Practices Act says a debt collector may contact a relative or friend, but only to learn the location of the debtor. They are permitted to do this only once, unless the collector has reason to believe you have new information or that previous information
was false. It can be a form of harassment if a debt collector contacts you repeatedly or is abusive or threatening. You should be able to stop contact by writing directly to the debt collector. You also can lodge a complaint with the FCC. For information on how to do that, go to fcc.gov/cgb/ complaints.html or call 1-888-CALL-FCC (1-888-225-5322). Dear Annie: Is there a scientific or medical term for a person who has an obsession with another person’s terminal illness and death, or is this person just weird? When someone is near the end of life, my friend “Lou” wants to be in attendance as often as possible until the person dies. Lou appears to almost experience euphoria when the person dies, but shows little or no emotion after. I have witnessed Lou’s behavior more than once and wonder whether this is some uncontrollable compulsion or just plain nosiness. -- Keeping My Distance Dear Keeping: Paging Dr. Kevorkian. paraphilia. We agree it is downright creepy, but generally harmless. Dear Annie: The letter from “Not Over the Hill Yet” was ridiculous. She said her teenage grandson asked if he could be nude around his friends because they all did it. My husband and I have two teenage sons and, between us, seven brothers. Not one of these guys has ever felt it normal or natural in any setting to be naked with a group of their buddies. Tell the kid to do us all a favor and keep his pants on. Oh, and by the way, what is the mother of “Jay” doing when her son and his friends are hanging out naked in her home? Are we the only ones who see this as a problem? If there were a bunch of naked girls in front of one of the fathers, the other parents would be horrified. She obviously has a screw loose. -- Not Nude in Glendora, Calif. Dear Not Nude: You make a good point about naked girls, and a lot of readers agree with you about Jay’s mother. We hope those grandparents will stick to their guns.
