KSB county clean-up is Saturday By DEREK HODGES Staff Writer SEVIER COUNTY — Areas around the county will get something of a face lift Saturday morning as a litter of volunteers spreads out to pick up a litter of trash. This is the eighth year Keep Sevier Beautiful (KSB) has coordinated Roads and Rivers Day, a spring and fall effort that seeks to clean up the area’s byways and natural areas. Hundreds of volunteers are expected to fan out across the county, both at seven sites manned by KSB supporters and in their own communities, in an effort to pick up what some have left behind. “We hope to see 200 to 300 people helping out,” KSB Director Janice Hendrix says. “We’ve got students
doing service projects and civic groups that help each year and even some businesses that are going to do their part and are challenging other businesses to help.” KSB will operate pick ups from Pigeon Forge City Hall, Patriot Park, Seymour First Baptist Church, East Tennessee Realty in Wears Valley, Sugarlands Visitors Center in the National Park, Catons Chapel School and Sevierville City Park. While those will be concentrated efforts lasting from 9 a.m. to about noon, Hendrix says anyone in Sevier County who wants to do his or her part can get supplies from KSB volunteers at those locations and use them where they believe they’re needed. “They’re welcome to get those items and go to their neighborhood or their community or a particular
area that they know needs attention,” she says. “We want to get to as many places as we can. We believe this is a good event and a good thing for the county.” The effort, Hendrix says, is good for local resources, like the waterways it cleans, and local residents, who can take pride in having a clean community. Further, picking up the misplaced waste puts a better face on the county for the millions of tourists who come here each year. “We live in such a beautiful community and we want to keep it that way,” Hendrix says. “It’s just a little way to beautify the community.” For more information on the effort, call the KSB office at 7746677. n dhodges@themountainpress.com
SEVIERVILLE — It appears the way local officials are elected won’t be changing anytime soon after a proposal to amend that process was killed by a group of county leaders. The idea considered called for each seat on the County Commission to be given its own designation – such as District 1 Seats A and B – so that candidates run for specific seats. Currently all the candidates in a given district compete for the two or three seats that represent that area. Members of the commission’s Steering Committee began discussion the idea some time ago, with supporters of the proposal arguing it would make elections easier and more organized. While the change wouldn’t modify anything about the districts themselves, with each seat representing the full area, it would allow challenger candidates to target certain incumbents or empty seats, rather than running in the crowd. Opponents argued the move could make it harder for challengers to unseat a sitting commissioner. They suggested the proposal was more intended to protect incumbents than to make elections more See elections, Page A4

By ELLEN BROWN Staff Writer The Sevier County Elder Watch Coalition will host its annual Healthy Aging Workshop from 10 a.m. to 3 p.m. Friday at Fort Sanders Sevier Senior Center. “This is a good event for seniors and/or their caregivers to attend,� said Amy Daniels, Amedisys Home Health Services employee and Sevier County Elder Watch Coalition spokesperson. “The coalition is a variety of different organizations that meet each month, do senior outreach programs and try to educate the public on elder abuse. This (workshop) is part of the education process.� Several presentations will occur throughout the day, including: “Volunteering and Active Lifestyle,� Lisa Yarber of Sevier County Office on Aging; “How to Get Debt Free,� the University of Tennessee Extension Office; “Project Lifesaver� and “Scam Alerts,� Sgt. Rebecca Cowan of Sevierville Police Department; “Sexual Abuse,� Crista Cuccara, Safe Haven Center; and “Emotional Effects of Aging,� Blount Memorial Hospital.
“We change topics every year, depending on what’s going on in the community and feedback,� Daniels said. “These are topics to help seniors and their caregivers in their daily lives.� Cowan, for example, will speak on safe driving for seniors and scams the Sevierville Police Department often sees affecting the elderly. Vendors at the event will include businesses and organizations who cater to seniors and caregivers. Information on their services will be provided. Military widows gather Friday in â&#x20AC;&#x2122;Burg From Submitted Reports GATLINBURG â&#x20AC;&#x201D; Members of The American Widow Project, a nonprofit organization dedicated to this generationâ&#x20AC;&#x2122;s military widows, will gather Friday in Gatlinburg to celebrate their bond due to the con-
nection they all share of losing their loved one in the military. The organization holds events throughout the country to bring military widows together to celebrate their survival and honor their sacrifice. The weekend will be filled with horseback rid-
ing, a cabin retreat in the Smoky Mountains, and a day at the spa. This organization was the creation of Taryn Davis, who lost her husband, Cpl. Michael Davis, in Iraq on May 21, 2007. She began traveling the country to hear other womenâ&#x20AC;&#x2122;s stories.

Bradley will lead a discussion to help parents with children in current economic times. of Investigation opened an investigation into the two women — both of whom are certified nursing assistants — after the case was referred to it. The women are accused of using cameras in their cell phones to take nude and degrading pictures of patients. TBI spokeswoman Kristin Helm said some of the pictures dated to 2007. The allegations led to a brief suspension of new admissions at the facility earlier this year. The center was allowed to resume taking new patients after about a week; state officials said they determined the facility was in compliance with regulations. Administrator Jon Bowers said at that time that the facility had fired two employees for taking pictures, although they weren’t identified at the time. According to a report released by the Tennessee Department of Health, the pictures were discovered when one of the two women left her cell phone at a restaurant. When a server searched the phone’s menu to determine who owned it, the images appeared. The documents released by the department of health don’t identify which nurse had left the phone at the restaurant, but it does include statements from her that she thought the pictures were “cute,” and she meant to keep them as mementoes of the patients. A spokeswoman for Signature HealthCARE LLC, parent company for Pigeon Forge Care and Rehab, said Wednesday the company had no further comment. The charges against Burgess and Longmire were among more than 100 returned by the Sevier County Grand Jury this week. The grand jury is a panel of 12 randomly selected county residents who meet in private to review criminal allegations to determine whether there is enough evidence to justify proceeding with a trial. They do not determine guilt or innocence. A new grand jury is selected every two months and meets at that time to review allegations. If a grand jury determines there is not enough evidence to merit a trial, it can return a finding on “no true bill.” If they find there is enough evidence to proceed, they can return an indictment or a presentment. Indictments are returned in cases where the charges against the accused party have already been announced in general sessions court, and a judge has sent the matter to the grand jury. Presentments are returned when the grand jury issues charges that had not been announced previously. Sealed presentments are kept secret until the

organized. The idea got two chances to advance during September’s Steering Committee meeting, both of them after being brought up by Commissioner Tommy McGaha, who has been the proposal’s most vocal proponent. The first motion on the matter was from Commissioner Harold Pitner, who opposed the move and wanted the group to deny McGaha’s request that the issue be part of the September meeting. That effort failed on a tied vote, with Commissioners Pitner, Frank Parton and Judy Godfrey voting for it, and Commissioners Phil King, Ray Ogle and Carroll Rauhuff voting against. Next, Rauhuff gave the matter his own go, offering a motion that it be put on the commission agenda. That move also failed on a split ballot, with a mirror vote of the first one. With that, it seems likely the proposal is dead for now. It would take approval from the County Commission to make the change, and it would have to go through the Steering Committee to get on the larger group’s agenda.

Commissioners hear push for VA health care center By DEREK HODGES Staff Writer

Iâ&#x20AC;&#x2122;m sure the SEVIERVILLE â&#x20AC;&#x201D; The VA would be appreciative of anything the county future of the countyâ&#x20AC;&#x2122;s curwould provide.â&#x20AC;? rent hospital, which will be vacated when a new facility is opened early next year, was on the minds of several citizens who addressed the County Commission during its meeting this week. Countyâ&#x20AC;&#x2122;s Veterans Services Officer Paul Whaley and members of the group Tennessee Helping Hearts took to the microphone to ask that at least part of the building be used for a Veterans Administration (VA) health care operation. Officials have said they are considering requests from a number of county departments and local agencies hoping to find new space in the facility, which will revert to county ownership when the hospital moves out. The countyâ&#x20AC;&#x2122;s Intergovernmental Committee is set to take up those petitions â&#x20AC;&#x201C; which have come from SafeHarbor Child Advocacy Center, a program that offers college credits for work at the hospital and several county offices â&#x20AC;&#x201C; during its next session. Whaley was the first to broach the topic Monday, saying local folks have been working with the VA for three years to get one of its medical facilities here. With the cost of construction precluding such an action, the supporters have turned their hopes to the hospital building. â&#x20AC;&#x153;That idea has been very well-received by the VA,â&#x20AC;? Whaley said. Whaley speculated as many as 3,000 veterans each year could receive primary care if the county would dedicate 6,500- to 8,000-square-feet to the initiative. The move could save those folks a drive to Johnson City or Crossville and up to a yearâ&#x20AC;&#x2122;s wait to get needed care. â&#x20AC;&#x153;It would be a tremendous benefit to the county and the community,â&#x20AC;? Whaley said. Still, Whaley conceded the well-meaning hopes of local supporters of the idea are yet that. VA officials have not yet committed to using any space the county might dedicate to such a clinic and it could still be some time before that decision is made. â&#x20AC;&#x153;You really donâ&#x20AC;&#x2122;t have a great deal of detail at
Massachusetts grants Kennedy death-bed wish BOSTON (AP) â&#x20AC;&#x201D; Massachusetts lawmakers fulfilled Sen. Edward M. Kennedyâ&#x20AC;&#x2122;s dying wish Wednesday, granting the governor the power to appoint an interim replacement for him so President Barack Obama can regain a critical 60th U.S. Senate vote he needs to pass a health care overhaul this year. The final House and Senate votes came after another vote in which House members refused to attach an emergency preamble to the bill. That left it up to Gov. Deval Patrick to decide whether heâ&#x20AC;&#x2122;ll force the measure into law immediately, instead of the normal 90 days required of all legislation. He could do so as early as Thursday, simply with a letter to the secretary of state declaring an emergency since a special election to replace Kennedy permanently wonâ&#x20AC;&#x2122;t be held until Jan. 19. Democrats revoked the governorâ&#x20AC;&#x2122;s power to fill Senate vacancies in 2004, fearing then-Gov. Mitt Romney might appoint a fellow Republican if Sen. John Kerry, D-Mass., won his campaign for the presidency.

The Tennessee Helping Hearts folks said they have commitments from state and federal lawmakers, including U.S. Rep. Phil Roe, R-Tenn., that they will push to get a VA facility here. Beyond that, they voiced their support for a full VA hospital with a post traumatic stress disorder treatment unit being located in the building. Group members presented a petition with 800 signatures supporting that idea, though there has been no indication from the VA they would consider such a facility here. The group wants the county to dedicate the entire hospital space to the VA if itâ&#x20AC;&#x2122;s willing to open that type of facility. Itâ&#x20AC;&#x2122;s unclear where the proposal goes from here. With no firm commitment from the VA that it would open either facility here if given the space, it seems it would be hard for county officials to push out other deserving groups to leave some or all of the hospital space empty in hopes the health care centers may come. County Mayor Larry Waters said he is committed to working with Whaley and other supporters of the proposal, though, to ensure the county does get the facility if itâ&#x20AC;&#x2122;s possible. â&#x20AC;&#x153;Weâ&#x20AC;&#x2122;ll move the county offices and the others somewhere else if we have to,â&#x20AC;? he said. â&#x20AC;&#x153;This would be a good thing for the county.â&#x20AC;? Travolta describes sonâ&#x20AC;&#x2122;s death in testimony at Bahamas trial NASSAU, Bahamas (AP) â&#x20AC;&#x201D; John Travolta said Wednesday he tried desperately to save the life of his seizure-prone son and made perhaps his first public description of the boy as autistic as he testified in the trial of two people accused of trying to blackmail him. With his wife, Kelly Preston, looking on inside the Nassau courtroom, Travolta said that he performed CPR on his son after a nanny alerted him the teen had fallen ill at a family vacation home on Grand Bahama island. Jett Travolta later died from a seizure. â&#x20AC;&#x153;I ran downstairs with my wife to help my son,â&#x20AC;? Travolta said. Travolta is the star witness at the trial of two people â&#x20AC;&#x201D; paramedic Tarino Lightbourne and former Bahamian Sen. Pleasant Bridgewater â&#x20AC;&#x201D; who are accused of trying to extort $25 million from the movie star. Both defendants pleaded innocent to extortion charges at the trial that began Monday in this island chain off the
Florida coast. Travolta testified that he and Preston were awakened by a nanny around 10:15 a.m. on Jan. 2, the day of Jettâ&#x20AC;&#x2122;s death. Travolta said when he went downstairs, another caretaker was doing chest compressions and he began administering breathing help. Travolta also said â&#x20AC;&#x201D; apparently for the first time in public â&#x20AC;&#x201D; that 16-year-old Jett was autistic, confirming speculation that had swirled for years. The developmental disorder is frequently accompanied by seizures. â&#x20AC;&#x153;He was autistic. He suffered from a seizure
disorder,â&#x20AC;? Travolta told the jury when asked about his sonâ&#x20AC;&#x2122;s condition. The actor said Jett suffered seizures every five to 10 days. He said the seizures would last 45 seconds to a minute and Jett typically slept for 12 hours after each one. The judge dismissed Travolta on Wednesday afternoon but said he would be called back later for further testimony. Travolta, 55, has kept a low profile since Jettâ&#x20AC;&#x2122;s death. He skipped promotional events this summer for his latest film, â&#x20AC;&#x153;The Taking of Pelham 1 2 3.â&#x20AC;? He thanked his co-stars on his Web site for giving him time to grieve.

Dalai Lama visits King murder site Says spot ‘sad but inspirational’ By TRAVIS LOLLER Associated Press Writer MEMPHIS (AP) — The Dalai Lama said his visit Wednesday to the motel where Martin Luther King Jr. was assassinated was sad but inspirational. The Tibetan spiritual leader was in Memphis to receive the International Freedom
Award from the National Civil Rights Museum, which incorporates the site of the Lorraine Motel. The Dalai Lama draped a white shawl over a wreath that hangs over the balcony where King was shot in 1968. He toured the museum with the Rev. Samuel Kyles, who was with King when he was shot. Kyles told the Dalai Lama that in 40 years he’s never found the
words to express his feelings about the day King was killed. “Yes, you can kill the dreamer. No, you can’t kill the dream,” Kyles said. Kyles said the civil rights movement was like the Tibetans’ struggle with China for more autonomy. “This history event gives us conviction today the struggle for justice, against inequality, discrimination ... despite many difficulties and obstacles, can
be won,” the Dalai Lama said. He said he often invoked King’s name as an example of a freedom fighter who was a true practitioner of nonviolence. The Dalai Lama expressed optimism for Tibet’s future, saying totalitarianism was not practical and outdated. “China has the same constitution, the same one-party system, but compared to 30 or 40 years ago, it has already changed,” he said.

Enemies of intolerance still there
When I announced last week that I was leaving ABC for Fox, some readers complained about my “bias.” I replied: “Every reporter has political beliefs. The difference is that I am upfront about mine.” Look at today’s burning issue: President Obama’s pledge to redesign 15 percent of the economy. Virtually every reporter calls his health care plan “reform.” But dictionaries define reform as “improvement.” So before they present any evidence, reporters pronounce Obama’s plan an improvement. Isn’t that bias? The New York Times took its bias to an absurd length. Its page-one story on the big anti-biggovernment rally in Washington, referred to “protests that began with an opposition to health care. ...” Apparently, in the Times reporter’s and editors’ view, opponents of the Obama health care plan oppose health care itself. (The online article was later changed. http:// tinyurl.com/lpv4gm) Economic-policy reporters usually present the views of supporters of new regulations as objective and public-spirited. For a contrary view, at best they’ll ask a Republican or a representative of the regulated business, who is portrayed as self-serving. (Republicans tend to offer a watered-down version of the Democrats’ proposals.) A recent Bloomberg report on President Obama’s plans to rewrite financial regulations is typical (http://tinyurl.com/m257a9): “Obama has proposed new regulations overseeing the systemic risk posed by large financial institutions.” The reporter quoted White House economic adviser Lawrence Summers in support of the plan. Although there are plenty of reasons to doubt that regulators are competent at judging systemic risk, no skeptical economist was quoted (http://tinyurl. com/d4ozuw). Readers are led to believe the program is perfectly feasible. Most reporting on the “stimulus” package has the same flaw. Just to call it “stimulus” is to editorialize, since the idea that government spending can truly stimulate an economy is at best doubtful. Many good economists say it can’t be done (http://tinyurl.com/djudcy). After all, the money is taken from somewhere else. But the economists rarely are quoted. In addition, reporters seem to think they’ve done their job if they merely describe the intentions behind the proposed “reform.” But the burden of proof should be on the sponsors of regulation and spending. They should have to make a convincing case that their new rules are superior to the free market. Who cares about intentions? Fuel-efficiency standards, intended to save gasoline, give us less crashworthy cars, so more people die (http://tinyurl.com/ adv6gm). Subsidies to American farmers destroy Third World markets (http://tinyurl. com/l46rd4). Fannie Mae and Freddie Mac encouraged shaky subprime mortgages and helped cause the housing and financial turmoil (http://tinyurl.com/5j5644). The long list of bad results that have emerged from well-intended regulation ought to dim reporters’ enthusiasm. But it hasn’t. I admit that my guiding political and economic philosophy — libertarianism (http:// tinyurl.com/mr49je) — now shapes my reporting, in this way: It prompts me to ask questions that others don’t ask. I don’t claim to be the expert. But some of my colleagues who write about business know nothing about economics. Many are comically hostile to profit — they dismiss it as “greed” (although they bargain for the highest salaries possible). On my former ABC blog (http://tinyurl. com/quu9j5), some people called me a biased “conservative.” “Your (sic) a shill anyways John. dont (sic) let the door hit you in the you know what.” I’m surprised that the self-described enemies of intolerance can’t tolerate even one MSM reporter who doesn’t share their statist premises. The interventionist state has been the status quo for generations, so I must be something other than “conservative.” “Liberal” is what my philosophy used to be called. It’s the statists who are the reactionaries. Not all the blog comments were hostile: “Congratulations. The mind boggles at the thought of giving free reign on air to someone who actually understands economics.” “Stossel challenges conventional wisdom, so I hope Fox lets him do that.” I think they’ll tolerate me. The rainy season
Torrential downpours have hit the South hard; help if you can Our friends to the south of us in Georgia and Alabama seem to have gotten the brunt of the torrential rains that have hit the Southeast in recent days. It’s been remarkable. A region that was in the middle of a drought just two years ago now gets more rain than it could possible use, saturating the ground and causing runoffs that have swamped roads, homes, streets and pastures. Georgia Gov. Sonny Perdue asked President Obama to declare a state of emergency in the state. Officials estimated $250 million in damage. The rain has abated, but many parts of the region are faced with stagnant water. Hundreds are homeless, and others are living in homes damaged by the flood waters. It’s a mess. We in Sevier County have had a lot of rain, but not much serious impact.
Is is safe to say the drought is over? Let’s say it anyway. The people in Georgia and Alabama probably would agree. Washed-out roads and flooded freeways around metro Atlanta caused commuters headaches on Tuesday. Many neighborhoods are in several feet of murky water. There is widespread flood damage. Those returning to their homes need to avoid drinking the water, even if it looks clear. Lives are disrupted. The rains have been blamed for at least 10 deaths in Georgia and Alabama. Most of those were people caught up in rising waters or tried to drive through flooded streets. The devastation surrounding Atlanta was widespread. In Austell, about 17 miles west of downtown Atlanta, Sweetwater Creek overflowed, send-
ing muddy water rushing into a nearby mobile home park where several trailers were almost completely submerged. We usually think of flooding when rivers overflow their banks. Those are the situations that seem to draw attention, because so many people are affected. But what has been going on in the Deep South is just as tragic. Floods, like tornadoes, always seem to affect those least able to absorb the blow. Mobile home parks, apartments, homes in low-lying areas — the people living in those dwellings appear to catch the brunt of any storms. Let’s keep the victims of these rains in our thoughts in the days ahead, If given the chance to help through an agency like Red Cross, consider doing so.

Local governments should be banned from lobbying It was good to see that neither Clarksville nor Montgomery County was on the Tennessee Center for Policy Research’s list of local governmental bodies that have spent, in total over the past three years, $5.3 million on professional lobbyists to influence state and federal government. The group, which describes itself as an “independent, nonprofit and nonpartisan research organization,” said in its news release that the lobbying efforts amounted to government attempts to increase the power to tax and spend without public oversight. “It is unacceptable that these
local government spend millions on lobbyists despite budget crunches that are forcing them to raise taxes and lay off employees,” said Justin Owen, director of legal policy for the group and co-author of the report. In Middle Tennessee, there were nine instances of government entities hiring these lobbyists, four of which were from Nashville. Other big Tennessee cities that also employed lobbyists were Knoxville, Chattanooga, Bristol and Jackson. The activity wasn’t, however, limited to the metropolitan areas. The Greater Dickson Gas Authority spent $70,000 and
the Water Authority of Dickson County spent $35,323. Although some of the lobbying was conducted in regard to utility matters, other efforts indeed could be construed as the government possibly lobbying against the interests or will of those who pay taxes. For instance, the report states that the Gibson County Special School District hired a lobbyist to push for an act that allowed it to put local taxpayers $23 million into debt to fund a new school by issuing bonds. The act also allowed the school district to raise property taxes to pay interest on the bonds. Perhaps the new school was
needed. We won’t debate the project’s merits. But, as the research group says, there’s something inherently wrong in using taxpayer money to pay a lobbyist to push for legislation that will raise taxes. Moreover, local governments already have lobbyists. They are those senators and representatives elected by and responsible to the people. These elected officials in the state Legislature ought to ban the practice of local governmental entities using taxpayer money to hire professional lobbyists. It’s the wrong use of tax dollars, especially during a time when there is no money to spare.

kind of football.” Coming off last week’s 20-14 triple-overtime win against District 3-AA rival Gibbs Eagles, the Blue-and-Gold (4-0) squad is prepared to face Unicoi this Friday night. The Blue Devils generally run the same type of offense as the Gibbs Eagles, just not as proficiently. Gibbs entered last week’s game against G-P as the No.8-ranked scoring team in the state, averaging better than 41 points per contest. The Highlander defense, however, shut
down that offense until the Eagles managed a game-tying score with just 57.2 seconds remaining in regulation, sending it into the first of three overtime possessions. “There’s no doubt that our defense has been the brightest part of our team so far this year,” said Hammonds. G-P, named the No.9ranked team in the state in this week’s AP prep football poll, doesn’t expect the contest against Unicoi to come down to the wire as it did against Gibbs. But stranger
things have happened in football. “There is a little concern about a letdown,” said Hammonds. “But we had a time-out in practice today and talked about keeping the football mentality. “Even though we’ve played a couple of really hard games this year, we’ve got to learn the lesson that you’ve got to show up ready to play hard every week. “Playing football, you’ve got to understand that mentality. We don’t need a letdown.”
But the Blue Devils may have already ensured that there will be no such letdown this Friday night after scheduling the Highlanders as their homecoming game. Typically, teams try to schedule an opponent they should defeat on homecoming night, which the Highlanders are taking personally. “This will be the first homecoming we’ve played in on the road in several years,” said Hammonds. “I think that is enough right there to create some vibes in your
football team. “We’re kindly looking forward to that. I don’t know if that’s disrespectful, or not. We’ll se how our team responds to it.” Tonight’s game at Unicoi County will be the final non-district battle of the season for the Highlanders, who will close the regular season with five-straight District 3-AA battles, including a three-game stretch against Fulton, AustinEast and Carter. chitchcock@themountainpress.com

GATLINBURG — The Gatlinburg-Pittman Lady Highlander volleyball squad has been busy this week, coming away winners in three-of-four matches with two more district contests upcoming tonight. Cox to retire as Braves manager after next season

By MIKE FITZPATRICK AP Baseball Writer NEW YORK â&#x20AC;&#x201D; Bobby Cox will retire as manager of the Atlanta Braves after the 2010 season, ending a career in which he guided the team to 14 consecutive postseason appearances and the 1995 World Series title. The 68-year-old, a fourtime Manager of the Year, agreed to a one-year contract extension for 2010, the Braves announced before Wednesday nightâ&#x20AC;&#x2122;s game against the New York Mets. He will start a fiveyear consulting agreement to advise the team in baseball operations after he steps down as manager. â&#x20AC;&#x153;While I have decided that 2010 will be my last season in the dugout, I want to make it clear that we will all be working as hard as ever to win

But Givens claims he was â&#x20AC;&#x153;kept in the dark about his conditionâ&#x20AC;? and team officials urged him to keep playing. â&#x20AC;&#x153;The decision was made by the Titans management, coaching and medical staffs to risk serious injury and aggravation to a pre-existing condition without so much as consulting or discussing that situation with David Givens,â&#x20AC;? the lawsuit said. Givens hurt that knee Nov. 12, 2006, in a game against Baltimore. An X-ray determined that the â&#x20AC;&#x153;previously known lesion and defect in his knee had crumbled,â&#x20AC;? according to the lawsuit. Givens, 29, has not played
professionally again. Titans officials said Wednesday they had not seen the lawsuit and had no comment. Coach Jeff Fisher also declined to comment about the lawsuit after practice. Givensâ&#x20AC;&#x2122; attorney, Dan Warlick, said his client is disappointed and felt his injury could have been prevented. â&#x20AC;&#x153;He tries to stay upbeat, but this guy ... was at the top of his game,â&#x20AC;? Warlick said. Givens caught 158 receptions for 2,214 yards and 12 touchdowns in four years with New England, where he won two Super Bowl rings. He left as the Patriotsâ&#x20AC;&#x2122; career leader in postseason touchdown catches with seven. The receiver signed a five-year, $24 million deal with an $8 million signing bonus in March 2006 with Tennessee. Givens had eight catches for 104 yards in his only season with the
Titans. The November injury occurred on the second play of the fourth quarter of a 27-26 loss to Baltimore. Givens stopped and planted his left leg to start blocking on a run play when he went down untouched. He had to be carted off the field. Givens tore his anterior cruciate ligament, meniscus and needed bone plugs inserted to repair a broken bone in the knee. He also needed another surgery in 2007 to clean up meniscus and shave down some of the bone. Warlick said Givens has had at least two more surgeries and is currently undergoing rehabilitation. â&#x20AC;&#x153;He continues to work to try to recover,â&#x20AC;? he said.

Teacher killed at Texas high school
TYLER, Texas (AP) â&#x20AC;&#x201D; A special-education teacher who had a passion for music was fatally stabbed Wednesday morning in a Texas high school classroom, and police took a 16-year-old student into custody. Todd R. Henry, 50, worked with students at John Tyler High School who were either emotionally or behaviorally challenged, according to his older brother, Jody Henry. District Superintendent Randy Reid said the male suspect approached his teacher about 8:50 a.m. and stabbed him in the neck with a sharp object. A teacherâ&#x20AC;&#x2122;s aide and two other students were in the classroom, and the aide subdued the suspect before calling district police, Reid said.
4 arrested in daycare dogfighting ring
CHICAGO RIDGE, Ill. (AP) â&#x20AC;&#x201D; A home day care also was the site of a dogfighting ring, authorities said Wednesday, and investigators who raided the house found a blood-spattered garage floor and battered and malnourished dogs not far from where the children played. Police said four people were arrested, and felony dogfighting charges are pending against several of them, including the day care operatorâ&#x20AC;&#x2122;s husband. Authorities did not immediately release their names. Nine battered dogs â&#x20AC;&#x201D; four of which were puppies â&#x20AC;&#x201D; were rescued, police said.
IRS severs ties with ACORN
WASHINGTON (AP) â&#x20AC;&#x201D; The IRS severed ties with ACORN on Wednesday, joining a growing list of government agencies to end relationships with the community activist group. The Internal Revenue Service said it would no longer include ACORN in its volunteer tax assistance program. The program offered free tax advice to about 3 million low- and moderate-income tax filers this spring. ACORN
provided help on about 25,000 returns, the IRS said. ACORN, meanwhile, said it had already suspended its tax program.
Freed inmate sues lawyer over fees
DALLAS (AP) â&#x20AC;&#x201D; A Texas man exonerated by DNA evidence who expects to receive nearly $4.1 million for his quarter-century in prison has sued his attorney. The attorney says he is entitled to a $1 million cut of the compensation after working to get more money for people who have been wrongly convicted. Steven Phillips filed his lawsuit last week against Kevin Glasheen, who successfully lobbied Texas legislators on the issue. Phillips spent nearly 25 years in prison for a rape and robbery before being cleared. He said Wednesday that Glasheen deserves credit for the new law but that the attorney never performed legal work for him. Under the old law, Phillips would have collected about $1.2 million. According to the new terms he is due nearly $4.1 million.

LOS ANGELES (AP) â&#x20AC;&#x201D; A man already accused of killing two women and suspected in the deaths of as many as 30 more was charged Wednesday with raping and murdering five other victims. John Floyd Thomas, 73, was charged with killing the women between 1975 and 1986. The women â&#x20AC;&#x201D; 56 to 80 years old â&#x20AC;&#x201D; had all been strangled. Thomas will stand trial for all seven deaths simultaneously. He has pleaded not guilty and is being held without bail. Calls to his court-appointed lawyers were not immediately returned. Thomas was initially charged April 2 with two counts of murder after a match from a DNA sample implicated him in the sexual assault and death of a retired school administrator and another woman in the 1970s.

Dear Annie: A young co-worker came into the office last week with a horrible black eye. Her boyfriend had punched her in front of her young children and some of her friends. She spent the entire workday worrying about the safety of her children and reading abusive text messages from the boyfriend. I spent the day doing her share of the work and wondering what I would do if the boyfriend showed up. She told me the friends called the police and they were looking for him. That day, my co-worker vowed to never see the guy again, but they got back together. I’m not going to ask for advice for her because she apparently isn’t listening to anyone. What I’m wondering, Annie, is if you can help me deal with this girl. I know domestic violence is a complicated issue, but this seems black and white to me. She’s in danger, and her children, even if they aren’t in physical danger, are learning some twisted lessons. I can barely stand to look at this young woman. Any advice? -- Disgusted Dear Disgusted: Those “complications” you mention can include the victim believing she deserves the treatment she is getting, thinking the boyfriend is the only one who will ever love her, and worrying that he may try to kill her if she leaves. You cannot “rescue” this co-worker, but if you truly want to help, let her know she and her children deserve better, and encourage her to call the Domestic Violence Hotline (1-800-799-SAFE)
(1-800-799-7233). We hope she will. Dear Annie: My wife and I have been married 59 years. Several years ago, our attorney advised putting everything except our house and my IRA into my wife’s name, which we did. Right now, my only source of income is Social Security and the occasional withdrawal from my retirement account. I use this money to pay our income taxes, all living expenses, including gas, phones, TV, auto, clothing, etc., and all real estate taxes except property my wife solely owns. My wife pays for nothing. If she buys groceries and doesn’t use the credit card (which I pay), she puts the receipts on my desk and I reimburse her. She uses her Social Security income to invest in stocks and bonds in her own name. Is this the customary way for elderly people to divide income and expenses when their assets are roughly equal? -- Feeling Pinched Dear Pinched: Every couple works this out in their own way, and in many instances, if the husband has always been the main source of financial support, the wife would not anticipate a change. But if I said anything detrimental about her to my husband, he would defend her. He no longer had any good words for me at all. He criticized when he used to be supportive and kind.
