By DEREK HODGES Staff Writer PIGEON FORGE — After months of talking about enacting an ordinance regulating digital billboards in Pigeon Forge, when faced with the prospect of actually doing that Monday evening, the only thing Pigeon Forge leaders could think to do is — talk.
The City Commission voted unanimously to defer to another work session the proposed ordinance, which was drafted by city attorney Jim Gass, with several members expressing concerns that there were “questions to be answered.”
The discussion centered around proposed rules that would seek to limit the proximity of the boards to no closer than 1,000 feet and regulate the new technology to ensure it doesn’t create a driving hazard. “The more eye-catching it

Concerns such as those and about the bright boards possibly shining into hotels are what sparked the debate about regulating the signs. With several already approved, city leaders said they want to catch the cat before it gets too far out of the bag. They’re just not sure they’ve found the right net yet. “I just think there are a lot of questions we might want to

There may be a little something extra added to the bag boy’s typical line for folks shopping at local Food City locations today and Wednesday – “Paper, plastic of check?” That’s because volunteers from United Way of Sevier County will fan out to all five of the chain’s stores in the county to help get customers’ purchases bagged up for the trip home. In exchange, they’ll be asking if folks want to make a contribution to the nonprofit to help it fund 24 local agencies serving those in need here. “We will be bagging groceries, wishing folks a happy Thanksgiving and asking them if they would be willing to support United Way,” the agency’s Director of Marketing Elaina DeLozier explains. The annual Bagging for Tips event has become a crucial push to the finish line for Untied Way’s fundraising campaign. “This is our last fundraising event of the year. It’s always a great success and that’s because of the generosity of the community here,” DeLozier says. “It’s a great opportunity for United Way to really be out the in the community, and our volunteers always have a great time interacting with the public.” United Way supporters will staff the lines at the grocery chain’s stores for most of the day from 8 a.m. to 6 p.m. for the next

DeLozier says the effort is part of the lastdrive to bring in the last half of the campaign goal, with the campaign set to end in December. “We’re really trying to push to the meet the campaign goal we’ve set of $500,000,” she says. “We’re going to be doing everything we can to get there.” The event comes not only with the permission of Food City and its parent company K-VA-T Food Stores, it also has their assistance. Regional Manager Steve Trout has promised the company will match the contributions the volunteers collect up to $5,000. “Obviously we’re hoping we can raise at least $5,000,” DeLozier says. “We are so grateful for Food City opening its doors to us year after year and especially for making this generous offer to match the donations. We’re very excited and thankful for that.” n dhodges@themountainpress.com

‘Dickens Christmas’ theme of Sevierville parade set for Dec. 5 From Submitted Reports
SEVIERVILLE — The theme of the 47th annual Christmas Parade will be “A Dickens of a Christmas and feature Victorian carolers, city leaders of the past and present, and 50 members of the 278th National Guard Unit as grand marshals. The parade will be held Dec. 5 beginning at 11 a.m. downtown. In keeping with this year’s parade theme, several entries will be based on “A Christmas Carol by Charles Dickens, including a float presented by Sevier County Public Library system which will include past city leaders reading the classic Christmas tale to children in the library’s reading program. Other new entries will include the Patriot Guard, some Holiday of Hope pageant winners and a Bass Pro Shops pontoon boat float. For the first time two bagpipers and a drummer will lead the parade. “We are the most excited about the honor of having members of the 278th National Guard Unit participate as grand marshals in the Christmas Parade and pray for their safe return from the upcoming deployment, said organizer Carroll McMahan of the Sevierville Chamber of Commerce. “This year’s parade should be a visual delight for those attending. We have had several unique entries for this year’s parade, especially the ones that are really working to carry the ‘Dickens of a Christmas’ theme through. Crowd favorites will be back as well, including the Kerbela Shriners motorized clowns, area mascots, majorettes and Zorb. The parade will conclude with the arrival of Santa Claus on the Tanger Five Oaks sleigh. The parade will originate in the parking lot of First Baptist Church, travel west on Honey Street, north on Forks of the River Parkway, east on Main Street, south on Court Avenue and back to the church. For questions regarding the parade, contact McMahan at 453-6411 or e-mail to cmcmahan@scoc. org.

His father and the pastor stood in the baptistery and baptized Luke in front of the congregation the following Sunday. A Christian writer, Kay King of Eddy, Texas, met the Rimels while on vacation in South Carolina. She wrote a tri-fold pamphlet about Luke entitled “Knot of this World: A Voyage of Hope and provided copies to the Rimels. A special recognition ceremony was held during the worship service at Valley View and the entire congregation gave praise and honor to God.
Tips for fixing the perfect bird
Purchasing, preparing, and serving a turkey can be a daunting task. The Web site holidayfoodsafety.org provides specific helps for your turkey adventures: Be prepared! Before purchasing your turkey, make ample space in your refrigerator, moving shelves if necessary. n Fresh or frozen? There is no quality difference between a fresh or frozen turkey although fresh turkeys have shorter shelf lives. By purchasing a frozen turkey, you can get the turkey in advance and take advantage of special sales. Fresh turkeys provide convenience because they do not require thawing. n What size turkey do I need to buy? When purchasing a whole turkey, purchase at least one pound of uncooked turkey per person. You’ll have enough for the feast and for leftovers too. n When should I buy it? Keep in mind that a whole turkey takes about 24 hours per four to five pounds to thaw in the refrigerator. (For example: A 15-pound frozen bird will take 3 to 4 full days to thaw in the refrigerator.) Ideally, purchase your frozen turkey as far in advance as necessary to safely thaw it in the refrigerator. If buying a fresh turkey, purchase it only 1 to 2 days before the meal and keep it refrigerated. n Always wash hands with warm water and soap for 20 seconds before and after handling the turkey. n Never defrost turkey on the counter. Turkey can be thawed in the refrigerator or in cold water. The refrigerator method is the safest and will result in the best finished product. Leave the bird in the original packaging and place in a shallow pan and allow refrigerator thawing time at a rate of 4 to 5 pounds per 24 hours. To thaw in cold water, keep turkey in the original packaging, place in a clean and sanitized sink or pan and submerge in cold water.

go back and look at,” Mayor Keith Whaley said. “I think this is something we need to think about really hard.” Among those are worries that the ordinance as it’s written might put city leaders in the position of having to decide who deserves to have a digital board. As it stands, the rules dictate that all such requests must be approved by the City Commission. “It can put this board in a tough position of making an arbitrary decision on whether we allow a company to get a digital billboard,” Whaley said. While Whaley didn’t cite specific examples, the ordinance doesn’t dictate how the board should decide who gets the permit if two companies with billboards within 1,000 feet of each other come with requests at the same time. Whaley has previously said, and reiterated in Monday’s meeting, that he prefers the digital signs, calling them “cleaner and more aesthetically pleasing.” Whaley also said the group should consider whether it wants the 1,000-foot rule to apply linearally or in a radius, while Wear wondered how the city would handle a violation of the ordinance if a company has been permitted to run a digital board. It wasn’t just city officials who expressed concerns about the draft ordinance, though. Local businesswoman Pam Ogle pointed out the language is somewhat vague and my be seen as restricting on-premise ground signs like those used at many Pigeon Forge businesses. “The ordinance as it’s written says that it’s to regulate outdoor
signage,” Ogle said. “It needs to be very specific to say that it’s just billboards and not message boards.” While the commissioners were more worried about the impact of the ordinance Monday, previous work sessions have seen them offer concerns about not having any regulations on the boards. Both Commissioners Joyce Brackins and Randal Robinson have expressed support for regulating the signs. State law already provides for rules on the boards that includes stipulations that they be no closer than 2,000 feet on interstates and not exceed a standard brightness. Other cities, including Knoxville which recently acted to ban digital billboards except those already existing there, have already taken action to regulate the signs, though Pigeon Forge is the first government in Sevier County to take up the matter. With those concerns expressed, Vice Mayor Kevin McClure rescinded a motion he made early in the discussion seeking approval for the ordinance and instead introduced one to table it to an as-yet-unscheduled work session. That passed unanimously. n dhodges@themountainpress.com
Government issues record crib recall WASHINGTON (AP) — More than 2.1 million drop-side cribs by Stork Craft Manufacturing are being recalled, the biggest crib recall in U.S history, following reports of four infant suffocations. The Consumer Product Safety Commission said Monday the recall involves 1.2 million cribs in the United States and almost 1 million in Canada, where Stork Craft is based. Sales of the cribs being recalled go back to 1993. Nearly 150,000 of the cribs carry the Fisher-Price logo.
The CPSC said it is aware of four infants who suffocated in the drop-side cribs, which have a side that moves up and down to allow parents to lift children from the cribs more easily. The Stork Craft cribs have had problems with their hardware, which can break, deform or become missing after years. CPSC said there can also be problems with assembly mistakes by the crib owner. These problems can cause the dropside to detach, creating a dangerous space between
the drop-side and the crib mattress, where a child can become trapped. The commission is urging parents to stop using the cribs until receiving a free repair kit from Stork Craft. The cribs, which were manufactured and distributed between January 1993 and October 2009, were sold at major retailers including BJ’s Wholesale Club, Sears and Wal-Mart stores and online through Target and Costco. They sold for between $100 and $400, and were made in Canada, China and
Indonesia. The manufacture date, model number, crib name, country of origin, and the firm’s name, address and contact information are located on the assembly instruction sheet attached to the mattress support board. The firm’s insignia “storkcraft baby” or “storkling” is inscribed on the drop-side teething rail of some cribs. Consumers can contact the company, 877-2740277, to order the free repair kit, or log on to www.storkcraft.com.

same Julien Auction, some of the memorabilia went for hundreds of thousands of dollars, including the glove Jackson wore in a famous 1983 performance of the song “Billy Jean” in which he first performed his dance move the Moonwalk. That little item fetched a hefty $350,000. By contrast and somewhat ironically, Moore’s purchase was the biggest of the sale but came with one of the smallest price tags of the whole event. Jackson was the first owner of the Mercedes, which was made for sale in Europe and was never intended to be sold in America. He reportedly bought the car to use on his Neverland Ranch and later gave it to his aunt as a birthday present. The vehicle was featured on the “Today” show last week and in publications that Moore reads to keep current on the latest sales that might add to the museum’s stock. “We try to turn everything over every couple years or so, so I do try to keep up

S.C. governor faces 37 charges
STATE/NATION BRIEFS
14 years in mosque firebombing
By JIM DAVENPORT Associated Press Writer
NASHVILLE (AP) — A federal judge is sentencing a man who firebombed a mosque in central Tennessee to 14 years in prison. Senior U.S. District Court Judge Robert L. Echols sentenced 23-year-old Michael Corey Golden on Monday. Golden and two other men pleaded guilty earlier to burning the Islamic Center of Columbia last year. Court documents showed the men painted swastikas and racial slogans on the center, then threw two homemade Molotov cocktails into it. Prosecutors say Eric Ian Baker and Jonathan Edward Stone will be sentenced in December.
COLUMBIA, S.C. — Gov. Mark Sanford is accused of breaking 37 ethics laws regarding campaign finances and travel, including using taxpayer money for high-priced airplane tickets that took him around the world and to Argentina for a rendezvous with the woman he once called his “soul mate. The governor’s attorney said he looks forward to answering the “technical questions regarding Sanford’s travel and finances at a State Ethics Commission hearing early next year. Details of the civil charges were released Monday and carry a maximum $74,000 in fines. They came after a threemonth investigation by the panel and could be pivotal in a push by some South Carolina lawmakers to remove the Republican governor from office before his second and final
‘Nude therapy’ nurse resentenced
WICHITA, Kan. (AP) — A Kansas nurse convicted of enslaving mentally ill residents of a Newton group home has been sentenced to 15 years in prison after a judge acknowledged the original seven-year term was too short. U.S. District Judge Monti Belot imposed the new sentence Monday on Linda Kaufman. A federal appeals court had upheld her conviction but sent the case back for resentencing. Prosecutors argued for a longer sentence because of the use of a stun gun and because the victims were vulnerable. Belot also added more time for obstruction of justice. Kaufman and her husband, Arlan, were convicted in 2006 of forcing residents of the home to work naked and perform sex acts, while billing the government and their families for the “nude therapy sessions.
Clemson to get $98M for wind testing
COLUMBIA, S.C. (AP) — Clemson University is getting nearly $100 million in federal stimulus funds to study wind energy. U.S. Department of Energy Secretary Steven Chu said Monday that the South Carolina school had been picked for the facility that will test new wind turbine technology. The Energy Department gave Clemson $45 million in federal funding under the American Recovery and Reinvestment Act. Officials say state and private sources provided $53 million in matching funds, for a total of $98 million. Several other states have received stimulus funds to study wind energy but they pale in comparison to Clemson’s award. Chu says the facility will create needed jobs and could eventually help lower energy costs for consumers.
Jackson’s doctor returns to work
HOUSTON (AP) — Michael Jackson’s doctor returned to work at his Houston medical clinic on Monday for the first time since the pop star’s death and his patients welcomed him back without reservation. Dr. Conrad Murray was greeted by several patients and the pastor of his church when he arrived at the Armstrong Medical Clinic. One church member held up a handwritten sign that read “Welcome Back. Patients later praised Murray’s work as a cardiologist and called him a community role model, saying they have no concerns about being treated by the man under investigation in Jackson’s June 25 death. The doctor has been the focus of a Los Angeles police homicide investigation since telling investigators he administered propofol, a powerful operating room anesthetic, to Jackson to help the pop star sleep. The Los Angeles County coroner has ruled Jackson’s death a homicide, caused primarily by propofol and another sedative. Murray, who was with Jackson when the 50-year-old singer died, has not been charged with a crime.
SouthernBaptist president has prostate cancer
NASHVILLE (AP) — Southern Baptist Convention President Johnny Hunt says that he has prostate cancer and expects to have surgery in January. The 57-year-old Hunt, pastor of the Atlanta-area First Baptist Church of Woodstock, said Monday he believes the cancer was detected early. In a statement released through the Baptist Press, he asked for people’s prayers and said the diagnosis was a reminder of his mortality — but also his faith. Hunt was elected SBC president at the convention’s June 2008 annual meeting in Indianapolis and reelected at this year’s meeting in Louisville, Ky. With 16.2 million members, the Nashville-based SBC is the largest Protestant denomination in the U.S.

Columbia. “We are confident that we will be able to address each of these questions, none of which constitutes findings of guilt and none of which we believe rise anywhere near to the traditional standard of impeachment, Sanford attorney Butch Bowers said Monday. The ethic commission’s investigative report shows it reviewed 668 flights on state-owned planes, 12 overseas trips on commercial planes and 25 reimbursements to Sanford and his wife using more than $10,800 in campaign money. Each of the counts claims Sanford used his office for personal financial gain. The report also shows the commission questioned 61 previously undisclosed flights on privately owned aircraft but did not issues charges after Sanford reported them while the investigation was ongoing.
Gas prices fall to begin busy travel week Associated Press Retail gasoline prices headed downward in most places to begin one of the country’s busiest travel weeks, with more than 33 million people expected to hit the road for the Thanksgiving holiday. Americans are remaining closer to home because of anxiety about the economy and demand for gasoline is weaker now than it was last year at this time. That is telling because a gallon of gasoline then cost only $1.93 as the economic crisis unfolded in 2008. Unlike last year, however, gas is not falling sharply and though prices fell overnight, it still cost about $2.64 per gallon on average, according to Department of Energy data and also auto club AAA, Wright Express and Oil Price Information Service. “I think we will see some increases in the spring like we always do, said Fred Rozell, retail pricing director at OPIS. “But at this point I think we’re going to kind of see a status quo for a while.

Gov. Mark Sanford faces ethics charges he broke state laws more than three dozen times by violating rules on airplane travel and campaign money.
Sanford is accused of improperly buying firstand business-class airline tickets, violating state law requiring lowest-cost travel; nine times of improperly using state-owned aircraft for travel to political and personal events, including a stop at a discount hair salon; and 10 times he improperly reimbursed himself with campaign cash. Herb Hayden, executive director of the commission, said he could not recall another governor facing this number of charges in the past 25 years. Sanford has been under scrutiny since he vanished for five days over the summer, reappearing to tearfully admit to an extramarital affair with the Argentine woman. The travel allegations were uncovered in a series of Associated Press investigations. Some of the allegations about his use of campaign funds were revealed by The State newspaper in

Gasoline prices were either flat or falling in most places, but rose nearly 4 cents across the Midwest, according to a report Monday from the Energy Information Administration. Prices spiked 10 cents in Cleveland, according to the EIA. Crude prices have remained relatively strong, which has helped keep gas prices well above $2.50. A survey by the AAA this weekend found that the number of Americans traveling away from home for Thanksgiving will be
up just 2.1 percent this year from 2008. Crude prices have dragged retail gasoline prices higher throughout the year and rose by 9 cents per barrel on Monday.
Benchmark crude for January delivery settled at $77.56 a barrel on the New York Mercantile Exchange after the release of some surprising housing numbers.

No consensus on special session? By ERIK SCHELZIG Associated Press Writer NASHVILLE — A special legislative session to reconsider a pending change to workers’ compensation insurance requirements in Tennessee should only take place if there’s a consensus among lawmakers, Gov. Phil Bredesen said Monday. Meanwhile, Republican House Speaker Kent Williams of Elizabethton sent an e-mail to lawmakers to say that he perceives
no general agreement on whether to meet in advance of January’s legislative session. “Many members do not believe they had all the pertinent facts as to the impact of the bill when it was enacted,” Williams wrote. Still, he added, “I do not know of any consensus among members for a special session.” The measure sponsored by House Republican Leader Jason Mumpower of Bristol and Sen. Attacks on Carrie not warranted Let me tell you a fairy tale. Once upon a time, a gorgeous blond California girl — let’s call her “Carrie” — wanted to be a beauty queen. Asked about gay marriage, “Carrie” blurted out her truth: “I believe all Americans should enjoy equal rights to get married whether it is same-sex or opposite marriage. That’s the way I was raised, and that’s the way I think marriage should be.” Afterward, a judge proclaimed her answer so offensive he voted against her and wanted to rip off her tiara. Instead of rebuking the judge, pageant officials said that “Carrie” needs to meet anti-gay marriage folk to assuage the “hurt” she has caused them. A media firestorm ensued. “Carrie” explains to the press that her Christian faith taught her that gay marriage was right. She even appears at a press conference with the Human Rights Campaign, which some said violated her contractual obligations. Roll back the tape. What would that alternate Carrie’s life be like right now? Carrie Prejean is right. She has made many mistakes in her young life, including some that Catholics like me would call sins. But when I was 22 years old, Carrie’s age, I had a child out of wedlock. I hope young women watching learn something from Carrie’s ordeal; ideally something like: Don’t have sex with men who aren’t willing to marry you. But if that is too elevated an ideal, try this one: Girls, don’t send any pic to your boyfriend you don’t want your mom or Matt Lauer to see. An embarrassed Carrie wasn’t fully truthful about her private and personal life, which ended up making things more difficult for her. (Could any of those folks who defended Bill Clinton’s right to commit perjury about sex please step up and say a kind word or two for Carrie?) But fundamentally, Carrie is right: None of this spectacle would be happening to her if she had submitted instead of speaking truth to Hollywood power. The hatred she has generated is inexplicable and ugly. The people who are intent on sexually shaming Carrie have no shame themselves. Admittedly, I am getting kind of old. But in my old-fashioned view, boyfriends who release personal information on ex-girlfriends for money and/ or to embarrass them are scum. I don’t understand the newsworthiness of these allegations. Seven million Californians voted for Prop 8. Quite a few of them are people who committed sexual sins of various kinds. Why is this one 22-year-old girl carrying the whole weight of that on her young shoulders? A few people have asked me if Carrie is now going to “stop” working for me. The truth is she doesn’t work for NOM (National Organization for Marriage). We cut a TV ad without asking her approval using publicly available footage, and then we asked her to appear at a press conference to promote it. Out of the goodness of her heart she agreed, for which I remain grateful. I was asked to introduce her at several events, and I would do so again. I really wanted Carrie to work for me because I believed she may have had a calling to help fight for the other Americans who believe as she does that marriage is the union of husband and wife. But Carrie did not want to be a crusader on the gay marriage issue, or the leader of a Christian youth movement. She just wanted to be a model, or an entertainer, or a sportscaster, or a news reader — the kind of thing you’d imagine a 22-year-old beauty queen might dream about. I don’t know why so many people are exulting over the idea they may have killed her young dreams. I hope the people gleeful about this attack are enjoying their pyrrhic victory. What they have done says far more about them than about Carrie, who turns out to be a not-unusual California 22-year-old. — Maggie Gallagher, president of the National Organization for Marriage, is known for her conservative social policy analysis of social trends and conditions. Setting the stage Holiday of Hope pageant for Relay a great success, thanks to many The first Holiday of Hope Beauty Pageant to benefit Relay For Life was an astounding success. The Saturday event made money for the Relay project, it involved hundreds of contestants and their families, and it brought people together for a fun event to benefit a worthy cause. The pageant was sponsored by The Mountain Press, but involved so many people and businesses. There are a lot of thank-yous to be spread around. But at the top of the list is our own Gail Crutchfield, the community editor of the paper. This was her idea and her project from the start. She put in countless hours on it, in addition to her duties at the paper. Any credit for the success of the pageant goes first to her. However, there are many others.
Jessica Davis and the folks at Tennessee Shindig donated the theater and are giving a portion of the money from sales of the pageant video to Relay. Mike Howard of WIVK and Kerensa Joy of the Shindig show were masters of ceremonies. Kristen Gallant, who holds titles in the Cover Miss and Cinderella pageant assisted on stage. Prizes were donated by Dollywood, the Shindig, Ober Gatlinburg, Angel Cakes & Confections, The Track, Mary Kay’s Sharon Hurst, Spin City and Smith Family Theater. Dan Shockley of Awards and Engravings and Amanda Williams of AC Photography were generous with their time. made major contributions. Holiday of Hope was always intended to be fun and entertaining. It truly was that for the 70 contestants, ranging in age from infants to a 91-year-old entrant. The pageant generated some $7,000 for Relay. Let’s hope we can do it again. Relay For Life supports the American Cancer Society and its research and education programs. Few among us haven’t had friends or loved ones touched by this dreaded disease. Progress has been made, but there remains no cure. That’s the goal, and the dollars generated by Relay For Life and other fundraisers can help researchers and scientists find that cure. The Holiday of Hope pageant was one of those fundraising events, and a great one. Thanks again to all who played a role.

Public forum Attorney explains how, why fees may be charged clients
Editor: I am not the attorney at issue in the letter in The Mountain Press on Nov. 20, but I would like to address some of the issues raised. The lady initially questioned the $200 consultation fee. Many attorneys, myself included, charge a fee for initial consultation. A lot of potential clients are merely seeking free legal advice and, after spending a significant amount of time with them and discussing the issues and ways of addressing problems, they say, “Thank you. I have appointments with some more attorneys and I’ll get back to you.” Unless the attorney collects the initial consultation fee, the payment for their time and advice walks out with the potential client. She mentioned the “non-negotiable” $5,000 retainer. That is not the same as a non-refundable retainer. Most attorneys require a retainer fee for any case they undertake. All or a portion of that retainer fee may be non-refundable because it covers the
costs of opening the file; collecting necessary documents, including accident reports, police reports, arrest reports, contracts, medical records, etc.; and research to determine if the client has a viable case. The retainer fee is deposited into the attorney’s pooled trust account, which is covered by Rule 43, Rules of the Supreme Court. The IOLTA (Interest on Lawyers’ Trust Accounts) program was established by the Tennessee Supreme Court in 1984, and the responsibility for its administration was assigned to the Tennessee Bar Foundation. The interest is distributed from the IOLTA, in the form of grants, to organizations that provide direct legal services to the indigent, organizations that seek to improve the administration of justice, and to students, in the form of scholarships at state-supported law schools. IOLTA has granted over $15.8 million to providers of these services. A lawyer may decline to participate by submitting a notice in writing at least annually to the Chief Justice of the Tennessee Supreme Court. Rule 8, Rules of the Supreme Court, Rules of Professional Conduct 1.15(a)(1)(iii). Interest earned on accounts in which the
funds of clients are deposited (with the exception of IOLTA accounts) belong to the clients, and the lawyer shall have no right or claim to such interest. Rule 8, RPC 1.15(a)(1)(i). When an attorney assumes responsibility for investigating a case and representing a client, the attorney invests a tremendous amount of time in developing the facts. Sometimes clients may withhold negative information and portray their position in the most favorable terms. Clients do not always tell the attorney the truth. Clients do not always state their facts correctly. They make mistakes. By the way, a $5,000 retainer fee, billed at $200 per hour, covers 25 billable hours, not 250. Abraham Lincoln stated, “A lawyer’s time and advice are his stock in trade.” Unless we obtain an appropriate retainer fee, we rarely get paid for our time and advice once they are provided to the client. Please remember that this is a business and we are entitled to make a reasonable profit for services rendered to our clients. Charles I. Poole Attorney at Law Sevierville

Charges dropped against Vol safety Jackson By BETH RUCKER AP Sports Writer
KNOXVILLE — Prosecutors dropped attempted aggravated robbery charges against Tennessee freshman safety Janzen Jackson on Monday. However, charges are still pending against two former teammates, Nu’Keese Richardson and Mike Edwards, both 18. Jackson, 18, and Marie
Montmarquet, 22, who was accused of acting as a getaway driver, are no longer facing three charges of attempted armed robbery in the alleged hold up of three men at a convenience store near Tennessee’s Knoxville campus. Jackson and Montmarquet did not know about the robbery beforehand and did not know anything happened until after they left the store, the Knox County District Attorney’s
office said in a press release. “(Jackson) did not know any criminal activity was Janzen going to Jackson occur,” said Jackson’s attorney, Don Bosch. “He did not possess, use or plan to use marijuana. He was simply in the wrong place at the wrong time.”
The three victims told police they were sitting in their parked vehicle just before 2 a.m. Nov. 12 when two males dressed in hooded jackets, one brandishing a gun, approached and said, “Give us everything you’ve got.” According to a police report, the victims opened their wallets to show they didn’t have any money. The victims told police a third man came up and told the two men, “We’ve got to go,”
the report said. The suspects were seen leaving in a Toyota Prius, and police pulled over a vehicle matching the description nearby, the report said. Police spotted a pellet gun and hooded jackets and later found drug paraphernalia and a bag of what appeared to be marijuana. The victims later identified Richardson and Edwards as the robbers. Bosch, Jackson’s attor-
ney, said he was happy the charges were dropped and hoped Jackson could play football again soon. The freshman has been banned from team activities since being arrested. Coach Lane Kiffin dismissed Richardson and Edwards on Nov. 16 but said Sunday he hoped to have things with Jackson resolved quickly. “We’re waiting to get all our information in,” he said.

LOCAL RACING
Jones wins first race at Gresham The World Crown 300 weekend at the brand new Gresham Motorsports Park (Ga.) included various divisions of racing. From the Late Model feature on Sunday to the local divisions racing on the day before, many drivers headed to the facility hoping to be the first driver to take home the winning trophy as being the first ever winner in their class at GMP. Prior to all of that action, the Legends Cars took to the track on Friday, Nov. 13. When the checkered flag flew on the first-ever Legends Car event on the front stretch quarter-mile oval, the #80 Mountain Dew Legends Car with Sevierville’s Blake Jones behind the wheel was the victor, taking the win in the Young Lions division feature. The new track created many challenges for the racers, but Jones was able to adapt quickly, putting his car out in front of the pack. “At the beginning, I had to stay low and protect my position,” said Jones. “Once I got clear, I was able to go up the track towards the flag stand, which helped getting into turn one.” It wasn’t a cake walk for Jones as the other drivers were getting used to the track as well, but when the checkered flag flew, it was Jones celebrating the win. “It is always fun when you can be that close and race like that,” explained Jones. “This is a track that is tough coming off the corners because the motors get bogged down.
Blake Jones
The Legends Cars are fairly good at picking the speed up, but that is definitely a track that you have to keep your momentum going. “It feels great to be a winner at a track like that when a bunch of really big-name NASCAR drivers have won there. It is especially meaningful to be the first ever Legends Car winner on the new track in front of all the fans there.” Jones has been on a hot streak late in 2009. The win at GMP was his third in a row as he went to victory lane twice at Lonesome Pine Raceway (VA) earlier this month. Just like the past three races, Jones is heading to a new track, which could be bad for the competition as he heads to Orange County Speedway in North Carolina this weekend. “We have not been at the big track before,” said Jones. “We have won in the Bandolero on the small track (next to the OCS big track). It is always fun going to a new track and I like going to the fast, big-banked tracks.” From submitted reports

Tennessee senior Defensive Tackle Wes Brown (94) runs for a touchdown after intercepting the ball as he is hit by Vanderbilt running back Warren Norman (27) during Saturday’s game. Tennessee won 31-16.
Vols’ Brown is SEC lineman of week Berry a finalist for national awards KNOXVILLE — Wes Brown’s shoestring interception and 25-yard return for a touchdown in Saturday’s closing seconds — on the last play of his Neyland Stadium career — was enough for the Southeastern Conference to select Brown its Defensive Lineman of the Week. Brown added three tackles in the game, including one for a nine-yard sack, and contributed one quarterback hurry from his defensive tackle position as the Vols defeated Vanderbilt 31-16. But it was the signature moment of Lane Kiffin’s debut season as Tennessee head coach that set off a wild celebration on the UT sideline.
The play came in the closing seconds as the Vols were trying to deny Vanderbilt a tying drive. Brown picked off the errant toss from Vanderbilt quarterback Mackenzi Adams and scored his first collegiate touchdown on his final Neyland Stadium play with just three seconds remaining. “I put my hands out, and the next thing I know I was running with it,” Brown said. “It just happened so fast. I’m not used to intercepting a pass and running with it, so it was just a dream come true for me. Commodores tailback Warren Norman was draped all over Brown for the final 10 yards, but the senior from Athens, Ala., showed a nose for the end zone. “Everybody was saying, ‘That might have been the ugliest thing I’ve ever
seen.’ I felt him hopping on my back but I didn’t want to be denied. I wanted to score, and I couldn’t ask for a better ending.” It was Brown’s second game in a row with an interception, and the former defensive end now is tied for the team lead. Brown’s first touchdown since high school came in his 49th collegiate contest. “What a neat way to end the game on the last play for Wes,” Kiffin said of the former defensive end, who has played the entire season on two bad knees and rarely participates in a full practice. “You can’t have a guy who’s worked harder since he’s been here and been through more things.”

BAGHDAD (AP) — Iraq’s parliament failed Monday to produce an election law that pleased minority Sunni Arabs, prompting U.S. Secretary of State Hillary Rodham Clinton to say that nationwide balloting scheduled for January “might slip to a later date. The United States has linked the pace of its military drawdown to the elections,
though the top U.S. commander in Iraq has said the schedule is on track for now. U.S. combat troops are supposed to be out of Iraq by August, and the rest of the forces are scheduled to leave by the end of 2011. The dispute over an elections law highlights the ethnic and sectarian divisions in Iraq. While more secure than in past years of war, the
country has yet to achieve the political reconciliation vital to long-term stability. Both Sunnis and Kurds have criticized earlier versions of the legislation. The parliament amended the law Monday with a version that pleased the Kurds but failed to appease Sunnis, triggering a likely second veto by the Sunni vice president and a delay in the elections.
Vice President Tariq alHashemi, a Sunni, initially vetoed the law because he wanted more seats for Iraqis living abroad, most of whom are Sunnis. The minority, dominant under Saddam Hussein, has seen its privileged status evaporate since the ouster of the dictator and the election of a government led by the Shiite majority.
Mom: Son in coma heard everything for 23 years BRUSSELS AP)— A man who emerged from what doctors thought was a vegetative state says he was fully conscious for 23 years but could not respond because he was paralyzed, his mother said Monday. Rom Houben, 46, had a car crash in 1983 and doctors thought he had sunk into a coma. His family continued to believe their son was conscious and sought further medical advice. Professor Steven Laureys of Belgium’s Coma Science Group realized that the diagnosis was wrong and taught Houben how to communicate through a special keyboard, said Dr. Audrey Vanhaudenhuyse, who is on Laureys’ team.
Rom used the device to tell a reporter for the German magazine Der Spiegel that: “I screamed but there was nothing to hear. Belgian doctors who treated him early on said that Rom had gone from a coma into a vegetative condition. Coma is a state of unconsciousness in which the eyes are closed and the patient can’t be roused, as if simply asleep. A vegetative state is a condition in which the eyes are open and can move, and the patient has periods of sleep and periods of wakefulness, but remains unconscious and unaware of him or herself or others. The patient can’t think, reason, respond, do anything on purpose, chew or swallow.
But Rom’s parents would not accept that he was comatose or vegetative. His mother, Fina Houben, said in a telephone interview that they took him five times to the United States for tests. More searching finally got her in touch with Laureys, who put Houben through a PET scan that indicated he was conscious. The family and doctors then began trying to establish communication. A breakthrough came when he was able to indicate yes or no by slightly moving his foot to push a computer device placed there by Laureys’ team. Then came the spelling of words using his finger and a touch-screen attached to his wheelchair.

MANILA, Philippines (AP) — Gunmen ambushed a caravan of political supporters and journalists on their way to file election papers Monday, killing at least 21 people in a massacre considered shocking even for a region notorious for violence between rival clans. The National Union of Journalists of the Philippines said at least 10 local reporters were part of the convoy. Their newspapers and radio stations have not been able to reach them, raising fears that they were killed. If confirmed, it would be the “largest single massacre of journalists ever, according to Paris-based Reporters Without Borders. The president’s office termed the attack the worst political violence in recent history.

Woman can’t understand college chums’ coolness; should back off

Dear Annie: I was close to “Bob” in college. Four years ago, when he married “Sue,” whom I vaguely knew, I was the only one of his friends to attend her bachelorette party. A few years after their wedding, I flew across the country and stayed with them for a while. I had fun and sent a nice gift afterward. When I later learned the whereabouts of a mutual friend who had fallen off the face of the earth, I suggested we all visit him, but Sue was adamantly against it. She had been close to this guy in college and said I should respect his wishes to be left alone. So I didn’t go. Since then, I’ve had this vibe that I’ve been dumped as a friend. They are both on Facebook, but don’t acknowledge my membership. I still send Christmas cards and occasional letters, but only rarely get a reply -and it’s always short. I would like to visit again, but I hesitate. Bob has never been great at initiating contact, and Sue and I are not that chummy. Should I confront Bob and end the mystery? Or should I assume this is just how they operate? -Vancouver, Wash. Dear Vancouver: It is not uncommon for some wives to subtly discourage friendships between their husbands and other women. Plus, you might have triggered something that made Sue uncomfortable. A confrontation will only bring denial. If you want to maintain the friendship, you will have to make the greater effort. Continue sending cards and letters,
and be especially friendly to Sue. Let them know when you’ll be in their area, and suggest meeting for dinner. In time, the friendship will either warm up or fizzle out on its own. Dear Annie: We recently hosted a barbecue for our son’s 18th birthday. We invited members of his sports team and their parents, along with a few other friends. Over the past four years, most parents have hosted at least one event for the team, so we thought this would be a good time. We were not expecting gifts, but guests all brought cards. It occurred to me that some might include gifts, and I didn’t want to embarrass anyone, so I put the cards away. The next morning my son opened them, and they all contained various amounts of money. Thank-you notes will be sent. My question is: Did I make a faux pas by not opening the cards that night? Also, most of these people had never been to my home. Am I a snob if I don’t offer to show them around? Am I a show-off if I do? -- New at Hosting Dear New: You’re fine. The cards should not have been opened at the party. As for your home, it’s OK to offer to show guests around when you have a small group over. When you
are entertaining a large crowd outside, however, you should not be ignoring some of your guests in order to give others a guided tour. Dear Annie: Your advice to “Debbie” was dangerous. Please don’t tell her to put a lock on her bedroom door. In case of fire or other emergency, interior doors must not be locked. In a rental, locks on bedroom doors are often illegal. In new home construction, keys to locked doors are placed in view on the trim above the door. Everyone should know where the keys are. Another error people make in their homes is thinking that a window screen will prevent someone from falling out of the window. -- David Dear David: Those are excellent warnings, but we think you might have misunderstood this particular case. Debbie doesn’t want to lock herself in, which could be dangerous. She wants an exterior lock so her sister cannot steal her things when she’s out. When Debbie’s in the room, it is not necessary to keep it locked. Annie’s Mailbox is written by Kathy Mitchell and Marcy Sugar, longtime editors of the Ann Landers column.
