Some of us in The news offices are followers of the Moto GP bike riding and, on Sunday a young and upand-coming rider, Marco Simoncelli lost his life during the second lap of the race in Malaysia. This young man with the wild curly hair and attitude was only 24-yearsold and knew what he was doing on a bike – you don’t reach that level of racing without being incredibly good but, the fact remains that being on a motorbike of any kind is a dangerous place to be. When we learnt to ride motorbikes in the uK it was because I was surveying in london and the traffic had got to the stage where it was pretty much impossible to do my job in a car. The first thing I remember my instructor, Andy, telling me was: “no matter how good you are, or think you are, there is always something that can kill you so never use all your power – you may need it to get you out of something – and remember to have eyes in the back of your head too!” There was nothing the other riders in the GP could have done to miss Simoncelli as he came off but it certainly brings it home to you just how dangerous the sport is and all of you who thrash along the roads in Spain in shorts, T-shirt and flip-flops should take note. Just a couple of seconds of someone not looking what they’re doing and that’s it so, at least make sure you’re wearing the proper gear – it could save your life. On a much happier note, on Saturday I went and had my teeth whitened at the “Perfect White Teeth” salon at the Tamisa Golf Hotel, Fuengirola. I have good, strong teeth but they are uneven and I love my cuppa so tend to get stained from the tea. I expected to see a little difference but, Wow! I still haven’t got a Hollywood smile and, frankly, do I want to look like Simon cowell and blind people every time I open my mouth? But I now have lovely, naturally white teeth again. I’ll tell you all about it next week!
jump on ETA peace bandwagon During a radio interview, he said that the next step in the ETA peace process would be taken by the government elected on that date. Opposition leader Mariano Rajoy, who is tipped to win the election, has said “there is nobody who cannot feel joy (over ETA's declaration)," but added that he would never negotiate with the group.
The announcement ETA announced its “definitive cessation of violence” in a video sent to the BBC and aired last Thursday. In the preamble to the statement, a hooded ETA spokesman flanked by two others said "a new political age is opening" in the Basque Country. "We face a historic opportunity to obtain a just and democratic solution to the age-old political conflict." He continued: "ETA has decided on the definitive cessation of its armed activity. ETA makes a call to the governments of Spain and France to open a process of direct dialogue which has as its aim the resolution of the consequences of the conflict and thus the conclusion of the armed conflict. With this historic declaration, ETA demonstrates its clear, firm
and definitive purpose." Prime Minister José Luis Rodriguez Zapatero said the move was "a victory for democracy, law and reason", adding that after more than 40 years of bomb attacks and assassinations, Spain was now experiencing "legitimate satisfaction" at the victory over terror. He said it should never have happened and must never be allowed to return. The declaration, if followed through, would end ETA's campaign of violence, which has lasted more than 40 years and killed more than 850 people. The declaration came three days after a conference in San Sebastian which was attended by international statesmen including former UN Secretary General Kofi Annan, and protagonists in the Northern Ireland peace process, who called on ETA to lay down its arms. These international mediators
supporters for several months, until last Saturday, when thousands took to the streets of Bilbao (see photo). But ETA's days were probably numbered in any case. Thanks to a concerted Spanish and French crackdown, dozens of ETA militants, including successive leaders, have been arrested and jailed, in recent years and the security forces have said there are probably more ETA members in jail than outside. However, they have also warned that ETA still has hidden caches of arms and explosives and could become active again.
National Day spoilt October 25th marked the 32nd anniversary of the Basque Statute, by which the government in Madrid devolved a number of powers to the Basque regional government, including the right to have its own police force. This is the first year that it has been an official holiday but only the Basque Socialist Party and the Partido Popular attended the celebrations. The Basque National Party stayed away as did all the smaller nationalist parties because of differences over how the ETA peace process should be handled.

ETA has not killed anyone in the past two years and earlier this year it stopped collecting a “revolutionary” tax from businessmen, which was nothing more than protection money. Proposal to Just over 45 per cent of Catalans would vote in favour of independence if a referendum were to be held tomorrow, and merge councils only a quarter would vote against, according to the results of a survey released by the Centre of Opinion Studies (CEO) on Tuesday.
The number has grown considerably since dozens of towns and cities in the region held unofficial referendums on independence late last year and at the beginning of this year. The highest turnout of those eligible to vote was 20%, the lowest was just over eight per cent and an overwhelming majority averaging 98 per cent voted in favour of independence. However, between 80 to 92

per cent of eligible voters stayed away. During a recent visit to Barcelona, Quebec mayor Régis Labeaume told regional premier Artur Mas that he was glad that the Quebec independence movement had lost a referendum in 1995, when 49.42 per cent voted in favour of independence from Canada and 50.58 per cent voted against, because independence would have been disastrous for Quebec.
Former Catalan regional premier José Montilla said recently that with seven million inhabitants and all the necessary infrastructure, independence from Spain was “viable but not desirable or convenient for the majority of the region's inhabitants”. Since winning the regional election a year ago, Sr Mas has become increasingly outspoken about the desirability of breaking away from Spain.

Minister of the Presidency Ramon Jáuregui (pictured) said on Monday that merging local councils could be a solution to improving the functioning of public administrations. The Environment Ministry has published its proposed list of the maritime areas that it wants declared as national preserves, with three glaring absences – the Straits of Gibraltar, Chafarina Islands and Banco de la Concepción. A spokesman said the government decided to eliminate these areas from the initial protected-zone list because they are located in international waters, two of them in areas of jurisdiction that are disputed with Gibraltar and Morocco. Bishops push “anti” vote The Episcopal Conference has appealed to people not to vote for political parties that support divorce, abortion, same-sex marriage, euthanasia or medical research using human embryos. Gaddafi 'buried in secret at dawn' Libyan officials said on Tuesday that the bodies of Muammar Gaddafi, his son Muatassim and a top aide had been buried at dawn in an unknown location in the desert. Witnesses reported that the bodies of the three men were removed overnight from the meat storage warehouse in Misrata where they had been on display. A security guard at the warehouse confirmed the move to the Arabic television station alJazeera. An Associated Press Television News team said it saw three vehicles leave the warehouse area late on Monday, and when they entered the facility the bodies were no longer there. The question of how
to dispose of Col Gaddafi's body has been a political minefield for the new Libyan leadership – which is why it had taken four days for a decision to be reached. There were concerns that a public grave could become a shrine for Gaddafi loyalists or a target of hatred for those who opposed his regime. Meanwhile a committee to investigate the circumstances surrounding his death has been formed, after video footage showed him alive at the time of capture in Sirte on Thursday. Officials said he had been killed subsequently in crossfire. Another atrocity came to
light on Sunday when the bodies of 53 Gaddafi loyalists were found on the lawn of the abandoned Hotel Mahari in Sirte. Fernandez celebrates a landslide win
President Cristina Fernandez de Kirchner won re-election on Sunday in a landslide victory, on the back of strong economic growth. She secured nearly 54% of the vote, with her closest challenger, socialist Hermes Binner on just 17%. Her critics say she has benefited from a weak and fragmented opposition. 'Unwanted' girls get new start More than 280 girls called nakusha, which means unwanted – by parents who would have preferred sons – have been given a fresh start at a mass renaming ceremony in Maharashtra state. Hundreds of people committed to fighting gender discrimination attended the ceremony in rural Satara district, which has one of the country's lowest female populations, with 880 females to every 1,000 males. Security officials on both sides of the US-Mexico border have revealed that US law enforcement agencies have built up networks of Mexican informants which have allowed them to infiltrate some of that country’s most powerful and dangerous criminal organisations. The
informants have helped Mexican authorities capture or kill about two dozen high-ranking and mid-level drug traffickers. The use of informants has been largely clandestine because of concerns about corruption among the Mexican police, as well as laws prohibiting American security forces from

Quake survivors face freezing nights Thousands of people have been exposed to freezing night temperatures since Sunday's 7.2-magnitude earthquake in a mountainous area of eastern Turkey. Deputy Prime Minister Bulent Arinc said 366 people had died and 1,300 were injured, most of them in the cities of Van and Ercis, near the Iranian border, but with hundreds of people missing, the death toll is expected to rise. Rescue teams continue to search for survivors under the rubble of hundreds of collapsed
buildings, but officials said on Tuesday that the chances of those still alive beneath the rubble surviving another freezing night are fading. Both Ercis and the larger city of Van, about 100km to the south, lie on a high plateau surrounded by snowcapped mountains and temperatures at night, with winter closing in, dip below freezing. Some 2,400 rescue workers are involved in the
relief effort, as are 680 medics, 12 rescue dogs and 108 ambulances – including seven air ambulances. Turkey is particularly vulnerable to earthquakes because it sits on major geological fault lines. Two earthquakes in 1999 with a magnitude of more than 7 on the Richter scale killed almost 20,000 people in densely populated parts of the north-west of the country.
US ambassador leaves Syria The US has pulled out its ambassador to Syria, Robert Ford, after he angered the authorities by showing solidarity with activists involved in an uprising against President Bashar al-Assad's rule. A US spokesman said Mr Ford had left Damascus at the weekend after "credible threats against his personal safety". In response, Syria recalled its ambassador to
Washington on Monday for consultations. Last month, Mr Ford and colleagues were pelted with eggs and tomatoes when visiting an opposition figure, and he was briefly trapped in his office by pro-Assad demonstrators. Mr Ford, an Arabic-speaker who has served in several Arab countries, has expressed
solidarity with protesters as well as denouncing Syria's crackdown on its opponents. Mr Ford arrived in Damascus in January as the first US ambassador to Syria for more than five years. According to the UN, more than 3,000 people – mostly unarmed demonstrators – have been killed since protests against President Assad's rule began in March.

UK News Flash floods kill two in Ireland Two people died as more than a month’s rain fell on Ireland in just one day on Monday – the worst floods seen in Ireland in decades – and Dublin City Council implemented its major emergency plans to cope with the aftermath. Ciaran Jones a 25-yearold police officer was swept away by the floodwater as he was directing traffic to safety at Ballysmutton Bridge near Blessington, County Wicklow. A Garda helicopter, the Irish Coast Guard and several mountain rescue teams joined in the search hoping to find him alive, but his body was found later. A woman’s body was also recovered from a flooded basement flat in Dublin. Some commuters were trapped in their cars for four hours as water suddenly poured through the streets after four rivers overflowed and bus and train services were suspended. Killer convicted after nine years 31-year-old Leigh Clift of Lincolnshire Close, Bletchley, who has spent five years in jail after being convicted of grievous bodily harm on a 19-year-old man in 2000 was last week sentenced to serve at least six years for the murder of the same man by Luton Crown Court.

Jonathan Barton was 19 when he was stabbed in the head twice with a screwdriver – that travelled from the left to the right hand side of his brain – by Clift outside the Beacon pub in Milton Keynes over a decade ago. Jonathan did not die at that time but was left unable to move or speak for another nine years until he died in 2009 following a cardio-respiratory arrest after a procedure to reinsert his feeding tube. The jury heard that Clift appeared to wink “provocatively” at Mr Barton as he left the pub which led to an argument.
Jo Yeates killer tells court he was “in a state of panic” The man who has admitted to killing architect Jo Yeates has apologised to her parents for putting them through “a week of hell” and for dumping her body next to a roadside verge. Vincent Tabak, a Dutch 33-year-old engineer denies murder but pleads guilty to manslaughter on December 17th last year saying that “I still can’t believe I did that”, adding that the horror was started by a flirty remark. Tabak told Bristol Crown Court that he waved to Jo as he was passing her kitchen window on the way to the supermarket but she invited him in. He described how he took off his coat and hung it on the coat rack in the hall then they both went into her kitchen. He said that Miss Yeates made a remark about her cat that had recently got into his flat
saying that the cat went into places it shouldn’t go adding that the cat was: “A bit like me.” Tabak took this as a flirty remark and said that he decided to make a pass at her. He got the impression that she wanted to kiss him so he put a hand on her back and tried to kiss her. At that point, Jo Yeates screamed and Tabak put his hand over her mouth to keep her quiet. He said: “I was panicking. I wanted to stop her screaming. I wanted to calm her down.” He went on to explain that after strangling her for less than a minute "she went limp, she fell to the floor", Tabak said, adding: "I still can't understand what happened." Once he realised she was dead he told the court that he was in a state of panic and carried her back to his flat to put her into a bicycle

Jonathan Barton was to spend the rest of his life in hospitals, rehabilitation units and at home where his mother had an extension built so her son could be cared for, the court heard. Sentencing Clift to life with a minimum term of six years, Mr Justice Saunders said: "Many lives have been affected by that moment of madness, caused I have no doubt by drinking excessive alcohol. Anybody who heard the evidence in this court was struck by the enormous waste and futility of what happened."

St. Paul’s closed after the service on Friday, St. Paul’s cathedral in the city of london closed its doors to visitors for health and safety reasons – due to the “occupy london Stock Exchange” protest movement that had encamped around Paternoster Square using fires for cooking which posed a potential danger to visitors to the church. This was the first time the cathedral had been closed to visitors since world war II. The Dean of St Paul’s, the right reverend Graeme Knowles had asked the demonstrators to move away from around the entrance and said that it was “with a heavy heart” that he had to close the doors. White powder scare Part of the Student loans company building in Darlington was evacuated after a suspicious white powder was found in a package. an employee at the premises on the lingfield Point business park reported feeling unwell after opening an a4 envelope containing the powder. Police are still trying to identify the substance and its origin, but they have now allowed staff back in the building.The employee is said to be recovering after medical treatment at the scene. Durham Police's assistant chief constable, michael Banks, said: "This incident is under control and I must reassure people that we are not aware at this stage of any risks to the wider public." cornwall

Grupo 4 strike again Grupo 4 Security, now known as G4S – remember the company that put the security monitoring tag on the false leg of the offender a few weeks back? Yes, well they’re at it again. Last Tuesday all the offenders in Birmingham jail were locked up for almost 24 hours as G4S had lost a set of master keys with the key to every cell on it. Birmingham is the first jail to be transferred to the private security firm earlier this month and G4S insist that they have contingency plans should a situation as this arise. In July the company said that they would have to shed 123 jobs to come into line with government savings but a spokesman for the Prison Officers Association said that would put the officers in danger. There are currently 1,400 prisoners to 650 officers. The company has refused to say whether the keys have been found or not.

Easter bands threaten strike The bands that accompany the religious Easter processions in Malaga have warned they might not be able to participate next year because, if the police continue to stop them from practising in the street, they will not have been able to reach the required level of professional quality. Under a new regulation that came into force on
June 1st this year, the bands are allowed to practise in the street between 8 and 10 pm but irate residents continue to report the noise to the police who then have to take action. The musical director for the Victory band, José Vela, said the problem was that people continued to view their activity as a source of noise and not as the cultural manifestation that
it is. He said the police had received seven denuncias since September which had paralysed the activity of the 700 members of the different bands. The bands are asking City Hall to allocate them a place to practise, preferably outdoors, and permission to do so – otherwise, they say, “we may have to sue City Hall”.
José Breton, who was jailed last week in Cordoba in connection with the disappearance of his two children, apparently told one of the policemen two days before he was arrested that he was “responsible for what had happened but was still not ‘psychologically’ ready to make a statement, adding “I will tell you about tomorrow.” Ruth Breton, 8, and her brother José, 2, were reported missing on October 8th by their father, who told police he had lost them in a park. However, witnesses said they had seen him alone in the park, which was confirmed by CCTV footage. The children had arrived that day from Huelva, where they live with their mother. Police searched a house in the city and a finca on the outskirts

Two earthquakes registering 3.7 and 3.8 on the Richter scale were felt in Cuevas del Almanzora and Zurgena in Almeria province around 2am on Tuesday, followed by an aftershock of 1.6 two hours later. There were no human casualties and no material damage has been reported. A 52-year-old man and his two sons were killed when a landslide trapped them in their cave-home in Cuevas de Almanzora on October 14th. Tuesday's quakes came five months after the two that partially destroyed Lorca, in neighbouring Murcia.
ETA Costa bombers in court The trial of the two ETA terrorists, Oscar Celarain and Andoni Otegi, who are accused of placing a car bomb in Fuengirola on June 21st, 2002, will begin on Thursday, October 27th, in the National Court in Madrid. The prosecution has asked for jail sentences of 146 years for each man. The two stole a car in Coin on June 19th and packed it with 67 kilos of explosives which they had brought from France. They left it outside the Piramides Hotel in Fuengirola on June 21st and then rang the
Highway SOS Association in San Sebastian at 6.30 that morning to warn them about the bomb. Police in Fuengirola were able to evacuate the hotel and neighbouring buildings before the bomb went off at 7 am, injuring six people, including a

child and a policeman, and causing considerable material damage. ETA claimed responsibility for the bombing in July in a statement published in the Basque newspaper “Gara”, stating that it was part of the “summer campaign to capture international attention”. The prosecution is also asking for compensation for the people who were injured. It is the first trial of ETA terrorists since the group declared a “definitive cessation of violence” last week.

Winter is just around the corner How lovely to wake up to the sound of rain after an exceptionally long dry summer. Not quite so lovely to remember the car roof had decided not to go up when I pushed the button and I hadn't managed to get around to getting it fixed! Well, these things are sent to try us but nevertheless I have spent a pleasant weekend putting away the summer clothes, rooting out the cardies and boots and deciding what I need to buy to keep warm and cosy this winter. A cardigan in Spanish is una rebeca. Rather strange for those called Rebecca but a useful and necessary-as-winter-approaches article of clothing. Of course we also need our sudaderas - sweat shirts jerseys - sweaters, chaquetas - jackets abrigos - coats and impermeables - raincoats When you go shopping for clothes you may need something bigger - más grande or something smaller - más pequeño, longer - más largo, or shorter - más corto

Stop the distractions
T
hree members of the Basque terrorist group appeared on a video sent to the BBC News last week saying that given the current political situation, the group had “decided on the definitive cessation of its armed activity” and called on the governments of Spain and France “to open a direct process of dialogue” aimed at resolving the consequences of the conflict. The statement closed: “With this historic declaration, ETA demonstrates its clear, firm and definitive purpose. ETA calls on Basque society to get involved in this process until peace and liberty are achieved.”
E
veryone knows that the majority of Basques have been trying for years to live in peace, free of ETA threats, so their magnanimous offer of “peace and liberty” must have caused much hollow laughter in the Basque Country.
F
ortunately, the Spanish have long memories and can recall several ceasefires which ended as soon as ETA realised it was not going to get its own way with the government in power. As a result polls taken since the statement last Thursday show that two thirds of Spaniards do not believe this is a “definitive cessation” of the violence.

he statement was received cautiously by the majority of politicians who said it was an important step forward, but pointed out that ETA had made no mention of disbanding, handing over its arms or asking its victims for forgiveness.
W
hat ETA has been demanding since the ceasefire it announced in January this year is an acrossthe-board amnesty for all its members both in and out of jail. As a lead-up to that, the group wants all jailed ETA members to be sent to prisons in the Basque Country – where it will be easier for their families to visit them. It will also, of course, be easier for them to conspire about what to do if this current cessation of violence turns out not to be definitive.
B
oth the French and Spanish security forces have been warning the authorities since January that this ceasefire, like the others, was called to give ETA a breathing space and time to redeploy. This time around, however, tenacious pursuit by those same security forces means there are probably more ETA
members in jail than outside. ETA in fact has never been as weak as it is now and we are slowly learning more details about this “cessation of violence”.
A
pparently ETA decided on this step shortly after the May 22nd regional and local elections when a new leftwing pro-independence party called Bildu did spectacularly well in the Basque Country. The government has consistently declared “new” Basque political parties illegal in the past for the simple reason that they were Batasuna – ETA’s banned political wing – under another name. Bildu made a lot of noise about wanting to find peaceful political solutions to the problems caused by ETA’s 43-year-long crusade for independence from Spain so it was allowed to field candidates in the elections.
T
he first thing the newly elected Bildu mayor of San Sebastian did was remove the King’s portrait from the Town Hall, saying he was irrelevant to the Basque people. You can’t get more explicit than that. And last Saturday, thousands of people took to the streets in Bilbao demanding independence from Spain.
F
or a couple of years now, the likes of Sinn Fein leader Gerry Adams, South African lawyer Brian Currin, Archbishop Tutu and an assortment of other international luminaries have been calling on ETA and the government to make peace. The last meeting of international mediators was held last Monday in San Sebastian and made the headlines in both the Spanish and foreign media. The BBC correspondent described it as “carefully choreographed, and most of the main Spanish dailies seem to have had their stories about the ETA announcement prepared before it was even made”.
I
t seems to me that the whole charade was set up to help ETA disband – eventually – without losing face.
F
rom all the reactions following last week’s ceasefire announcement by ETA there are two that stand out the most. One positive response surprisingly came from Popular Party (PP) leader Mariano Rajoy who called the declaration “good news” although he remained cautiously optimistic as the days went by. "It shows how a society knows how to remain united and defend its position because this announcement was made without any concessions," Rajoy said.
B
ut there is a sector of the PP that is already talking about revenge. His PP colleagues, including Madrid regional premier Esperanza Aguirre and Ignacio Cosidó, the party spokesman for interior affairs, immediately called for the prosecution of ETA members – putting a sensitive issue on the front burner before the Basque terrorists lay down their weapons. Aguirre, a PP hardliner, brewed more scorn by adding that the statute of limitations for murder never runs out.
W
hile victims' groups are also demanding justice and would like to see the ETA members prosecuted, one family of a murdered victim has publicly asked the organisations to stay out of the upcoming peace process. Enric Lluch, whose uncle Ernest Lluch, a former Socialist health minister who was shot in the head at his home by an ETA assassin in 2000, said that negotiations should be "left to people who are professional in resolving such issues”. “As victims, we are not objective. Our time will come when it comes to recognise the victims but we cannot get involved in the peace process," said Lluch, who serves as vice president for the Ernest Lluch Foundation in Barcelona.
I
t was a bold but proud statement coming from a family who, like thousands of others, have suffered during ETA’s reign of terrorism of the past 43 years. The Basque terrorists have been blamed for 829 murders and injuring more than 1,000 people in
Spain and France through bombings, shootings and executions. Families are still grieving, yes, but it is time to give peace a chance. The Association of the Victims of Terrorism (AVT), the largest such group, said it wanted justice not vengeance. But from the way they are talking, it seems victims' groups would really like a public lynching.
T
his is the first time that the political parties have come together to welcome an ETA ceasefire, albeit cautiously. Rajoy’s and Lluch’s encouraging words demonstrate good faith that goes to the heart in trying to resolve that long and painful conflict. Of course, the peace process has not begun and as Interior Minister Antonio Camacho has said, it will enter its most crucial stage in the coming months.
B
ut there are diversions that are already being put into place. On Monday, the leader of the Basque Nationalist Party (PNV) Iñigo Urkullu called for an immediate talks to begin the transfers of ETA prisoners to Basque Country jails – a petition that has been made by both the radical abertzale left as well as ETA. In an effort to try to consolidate his power and wrest control of the region from the Socialist and PP coalition partners as well as keeping the abertzale from dominating the peace process, Urkullu also called for early elections believing that his PNV will once again be swept into power.
T
hose who have no interest in trying not to jeopardise the peace process – such as the AVT and a large faction of the PP – should back off. The negotiations should be left to the international mediators, such as Kofi Annan and Brian Currin, and government officials; they must not be distracted. The next most important step is negotiating with ETA to lay down its arms and disband. Bargaining chips such as the transfer of prisoners – which should not include any favours for ETA – need time to be ironed out and cannot be introduced from one day to the next.

Where employees work abroad even for many months at a time they may still be entitled to claim the range of rights including unfair dismissal under the British legislation, the Employment Rights Act 1996 (ERA `96). This could be beneficial as these rights can be wider than those provided under Spanish law. It used to be the case that the ERA `96 did not apply to `any employment where the employee ordinarily works abroad´ but this clause was removed in 1999 and there is now no statutory provision dealing with this issue, rather it is a matter of case law. To fall within this legislation, the employee has to prove that there is a sufficiently close connection with Great Britain. The employees in the cases of Serco v. Lawson (2006) and MOD v Wallis (2010) were successful in substantiating this. In the case of Serco v. Lawson, a UK company employee was working in the Ascension Islands and all services were carried out there. The Judge gave two circumstances where an employment relationship might be sufficiently closely connected with GB so as to enable an unfair dismissal claim to be made under the British legislation and these are: (i) where an employee is posted abroad to work for a business conducted in Britain and/or (ii) where he is working in a political or social British enclave abroad. In MOD v. Wallis the employees were employed by NATO in Europe. These employees were the wives of armed forces personnel and were employed as such by reason of their husbands´ employment.
This was sufficient to establish the connection as they were said to be working in a similar situation to (ii) in Serco and were entitled to claim unfair dismissal notwithstanding that they were not employed within GB. The employees also succeeded in claiming sex discrimination on the basis that it is a matter of EU law and therefore irrelevant which national law is applicable, provided that it is the law of a member state within the EU. However in relation to unfair dismissal, the recent case of Duncombe & others v. Secretary of State for Children, Schools and families (2011) narrowed the criteria somewhat and held that employees working or based abroad can claim this right in GB only in exceptional circumstances where the employment has much stronger connections with the country and with British employment law than with any other system of law. It cannot therefore be assumed that responsibility for an employee passes entirely to the overseas organisation in these circumstances. It will depend on the facts of each case. dies? If the worst comes to the worst and a loved one dies, what on earth do you do? The majority of people who are not Spanish but live here simply don’t have a clue what the procedures are here. When my neighbour died leaving no will and apparently no relatives we paid the funeral bill and followed what we knew she would have wanted but, the legal mess was immense. She had suffered a heart attack and to all intents and purposes was dead by the time they got her to Hospital Clinico in Malaga but, she was on a ventilator being kept “alive”. Various tests were done and there was no brain activity so the machines were switched off but, had there been activity of any sort, would I have had the right to give the permission necessary to switch off or would there have had to have been a court order? I hadn’t a clue along with pretty much everyone else. So, on Friday November 4th starting at 12:30pm there is going to be an informative meeting at JK’s (on La Trocha Industrial estate, Coin, that is behind the commercial centre and the La Trocha Garage) to tell you what you can and can’t do. Subjects covered will be: What the situation is as far as taxes, including death taxes is there a difference, for instance, if your house/apartment is in one of your names only? Jon Sutton will be advising on this side of things. There will be Cath Dillon advising you on further financial matters. Caroline McFarlane and Ven. David Sutch will be telling you about religious services and what options there are. Overseeing the gathering plus giving an informed talk on funeral directors and repatriation etc., will be Tracey Burns. One person has said that this is morbid. It is not. Fuengirola fleamarket wash out
The Fuengirola flea market was unfortunately completely rained off last Saturday morning. Optimistic stall holders were forced to pack up and beat a hasty retreat by the sudden prolonged deluge of heavy rains. The downpour took many of them by surprise with several stall holders simply abandoning goods as they ran to seek shelter. Already closed for two weeks throughout the Fuengirola Feria stallholders were probably hoping for a good turn-out
for the normally busy Saturday morning event that attracts buyers, browsers and sellers from far and wide. Unfortunately this was not to be, even though some did try to battle it out against the inevitable most conceded defeat by 10.00 am with the exception of one entrepreneurial gent who suddenly appeared with a collection of umbrellas for sale, to the cry of “Paraguas” he appeared to be doing a brisk trade to punters without protection!
Brad needs a new home
Brad is a handsome pure bred German Shepherd, who is three and a half years old. His previous owner could not devote much time to him and he regularly escaped from her garden. Now he has found himself at the SOS Animal Refuge where he is feeling very bewildered. Brad loves people, playing ball, and is very intelligent and would be a very rewarding pet to someone prepared to devote some time to him. SOS thinks he would respond very well to proper training to keep him active. He travels very happily in the car and has now been neutered and vaccinated. This little dog was found wandering in Alhaurin el Grande by a kind hearted person who took him to the PET veterinary practice in Alhaurin where he would be safe. Our editor met him the other day when one of her animals was in there and reports that he is a happy little soul who needs a loving permanent home. News New UK Calpe house receives New leisure Citizens donation from A Citizenship Ceremony, organised by the Civil Status and Registration Office, took place last Tuesday in the John Mackintosh Hall. The Deputy Governor, Mrs Lesley Pallett, received the oath of allegiance from around 50 new British citizens, and present them with certificates confirming their new status as citizens of the United Kingdom.

Charles Tilbury from The Calpe House Trust said: “I can’t thank Simplyhealth enough for
their generous donation. Over 500 people every year from Gibraltar stay at Calpe House. The money will be used to refurbish some of the existing accommodation to make it as pleasant an experience as possible at a time when people can feel quite low.” Mike Wagg spokesperson for Simplyhealth adds: “ Calpe House offers people from Gibraltar an invaluable service and we hope that our donation will help the Trust to continue its fantastic work.”
Government launches urban bike scheme – Gibi Bikes The Government has launched its Urban Bike Scheme. The scheme will be known as “Gibi Bikes”. The mission statement is “Go Green”. The Minister for Transport, the Hon J J Holliday, inaugurated the scheme on Monday by officially commissioning the bike station at Market Place. Work has been ongoing on the construction of the stations and today sees the commencement of the testing phase that will see Gibi Bikes employees riding between different stations testing the scheme. This phase of the project is being rolled out with 11 stations being switched on today and the remaining stations coming into use within the next two of weeks. Once all the stations are operational, the scheme will have 100 bicycles at the disposal of the public at any one time and will operate daily from 07.00am to 10.00pm. The sites that have been switched on today are: Frontier (3 Stations), Waterport Road (Watergardens), Europort,
Grand Parade, Referendum Gates, Line Wall Road, Orange Bastion and Market Place (2 stations). The other remaining sites that are due to become operational shortly are: Waterport Road (Waterport Terraces), Victoria Stadium, Reclamation Road, Commonwealth Parade Car park, Rosia Road, Bayview Terraces, Catalan Bay, St. Joseph’s School, Rosia Parade, Eastern Beach and Europa Point Today, the 332 persons who had registered their interest on the scheme’s website have been written to inviting them to become members of the scheme. Anybody who has yet not applied is invited to log on to the GibiBikes web site www.gibibikes.gi and become a member of the scheme. Users will be asked to provide credit card details on registration. These details are held as security for the bike so that, in the unlikely event the bike is not returned, a punitive fee can be deducted from the
card. As an incentive to become a member, those persons that apply for membership before the end of November will be given an extra month’s membership so their membership will expire at the end of December 2012.There will be an annual subscription fee of £24. This will entitle the user to one hour’s free bicycle use per day. If this hour is exceeded then a charge will apply.

The area had been developed from wasteland that had been used for driving practice by people of the Rock coming up to their tests, into what it is today, 16,500 m2 of landscaping and 2,000 m2 of leisure facilities that makes it a major open-air leisure area for the Rock. There is a children’s play park, paved walkways through landscaped green areas, a tourist information centre, café and a restaurant is planned. Mr Caruana described it as “a wonderful leisure facility for families following significant investment by the Government”, adding that the area will be used by both local people and tourists. The area also boasts stunning views of the Rock itself and also Africa over the straights.
Cruise ship arrivals This week sees a few of the big cruise ships arriving at the Port of Gibraltar. Friday 28th has two arrivals. Saga Cruises’ Saga Ruby arrives at 7am and leaves at 2pm while Royal Carribean’s Grandeur of the seas arrives at the same time but stays until 6pm. On Monday 31st, Cunard’s Queen Elizabeth arrives at 8am and leaves at 1.30pm while Thomson’s
Thomson Destiny arrives at 9am and leaves at 5pm. Princess Lines Grand Princess arrives at 7am and leaves at 4pm while Royal Carribean’s Adventure of the Seas arrives at 2pm and leaves at 9pm both on Tuesday 1st November. Now the weather is getting cooler it's an ideal time for exploring since driving and walking is so much more enjoyable than in the summer heat.

nd we are so fortunate in Andalucia to have so much unspoilt countryside to choose from. If you fancy a change from the beach and the mountains, then drive down Gibraltar way where it is striking how the scenery suddenly changes into vast tracts of woodland stretching inland as far as the eye can see. Turn off to San Roque and just a few kilometres from the town are the pine woods of Pinar del Rey, a huge public recreational area of some 338 hectares, with a fascinating history.

ike all schoolchildren I learned about the Spanish Armada, the gallant exploits of Francis Drake and the pivotal Battle of Trafalgar. I was also

thrilled to hear about sunken Spanish galleons filled with treasure. But I'd never really thought much about the more practical issues of how they were actually built.
W
hen Spain was the world's leading naval power shipbuilding was of paramount importance and thousands of trees were needed to supply the timber required. The forest of Pinar del Rey was in fact planted around 1800 to provide the pine trees necessary for the Spanish warships. At the time of the Battle of Trafalgar in 1805 the navy's forces totalled some 150 ships but afterwards the political situation meant that the fleet declined and with the loss of most of
Spain's colonies in the Americas ships were no longer needed in such numbers. Consequently the trees in Pinar del Rey were never cut down – hence the magnificent specimens still growing there. Ferdinand VII then donated the area to the people of San Roque who continue to enjoy it today.

here are two parts to the woods, the southern end is a wonderful picnic spot, fitted out in true Spanish fashion with lots of picnic tables and benches and barbecue facilities. There is easy access on paved roads and plenty of parking. The Alhaja stream runs through this area, with the Alhaja drinking fountain at the main gate and a beautiful

The centre (run by the council of San Roque and Verdemar – a “green” group) is well organised and highly thought of and has been awarded the blue flag, just like the AlcaidesaTorrecarbonera and Torreguadiaro beaches.

he other night whilst watching Johnny English The Revenge , The Return, The Comeback or whatever it was, at La Trocha in Coin, I was understandably reminded of the original series of James Bond Films .

e Adventures of TinTin By Steven Spielberg starring Jamie Bell, Andy Serkis, Daniel Craig TinTin, the intrepid cub reporter with the carefully curled quiff, buys a ship in a bottle and discovers a clue to the whereabouts of a longlost fortune in pirate plunder and, accompanied by his faithful dog Snowy, sets off on a roller-coaster adventure to find the booty – but there are others on the search in this big screen spectacular in which Spielberg pulls out all the stops. Along the way TinTin (Jamie Bell) teams up with whisky-soaked irascible

etting back to my memories of Bond, I remember being enthralled at the antics of Sean Connery in “From Russia with Love” (my first introduction to 007) and from then on I was hooked. I didn’t get to see “Dr No”, the first outing on film, until much later.
Captain Haddock (Andy Serkis, the undisputed king of performance capture) as they face storm-tossed seas and burning deserts. The movie is in topquality 3D, and the performance capture is immaculate in this pacy tale of derring-do which recalls Spielberg's Raiders of The Lost Ark. There is a stalwart cast which includes Simon Pegg and Nick Frost as the bumbling detectives Thompson and Thomson, and Daniel

likely to make a mint at the Box Office and talk is that this is the first in a new franchise designed to enthrall the movie going public for years to come.

I
know now that it’s all bunkum, but as a young lad I loved the car chases and the futuristic high tech toys that made up a large part of the fun for me. I loved all those machine gun headlights, poison dart cigarette lighters and steel rimmed bowler hats together with all of the other wonderful, and sometimes ridiculous gadgets that appeared in the movies.
I
think it was my exposure to these films that fed my liking of all things “tech” and as I have aged, I notice many of these things creeping into everyday life. I mean who would have thought back then we would be walking around with mini computers like smartphones and Ipads and getting our free driving directions from that little woman who lives in that small box you stick on your windscreen , who in turn gets her information from a satellite orbiting around the earth. Back then I used to think the TELEX was a fantastic invention!

hilst researching for this article, I discovered that there have been more than twenty films in the Bond series, despite Ian Fleming only
having written twelve novels – the first being in 1953. I also discovered that other noted authors like Kingsley Amis, Jeffrey Deaver, and John Gardener have written Bond novels. I also wasn’t aware that Ian Fleming had died so long ago (1964).

any readers will no doubt be aware of many of the films and I think they can be likened to Marmite, in that you either love them or hate them. I for one love them and always have. My preference is for the Sean Connery incarnations and I never really saw Roger Moore as a credible 007, for me he was just playing around with the role. I do give credit though to Timothy Dalton who took up the mantle for “The Living Daylights” in 1987 and “Licence To Kill” in 1989. In these two films I think he brought out the darker side of Bond and was altogether less frivolous in the role.
I
sort of liked Pierce Brosnan who took over in 1995 and remained until 2002 having completed four further Bond films and for me the jury is still out on Daniel Craig. I have never seen “On Her Majesty’s Secret Service” starring the one-off George Lazenby and maybe I should add that to my to do list. It should make for a nice rainy Sunday afternoon film.

poofs of Bond are not limited to Jonny English, there have been a number of other offerings like the Austin Powers movies and Casino Royale from 1967 with David Niven. The Bond character is said to have spawned a number of TV series –’ parodies like Our Man Flint, The Man From Uncle, Get Smart and The Matt Helm movies, to name a few. As far as I can discover, Bond number 23 is currently on hold due to financial constraints, although with all the product placement deals with Rolex, Aston Martin, BMW and Bentley to be had, I can’t see it being too long before we are all shaken if not stirred by the next one.

As we are in the week of Halloween, buy two pumpkins, one for your Jack-o’-lantern and another for this delicious, warming soup. This recipe was supplied by Ian Wooldridge, Head Chef of Kimbridge Farm, Hampshire.
Pumpkin Soup Ingredients: ● 1 medium pumpkin, peeled & chopped ● 1 large onion, peeled & chopped ● 4 large carrots, chopped ● 1 large potato, peeled & chopped ● 2 litres of chicken or vegetable stock ● 500gm carton of passata ● 2 tsp of curry powder ● 2 tsp of paprika ● Salt and freshly ground black pepper ● Olive oil for frying ● Cream and dried pumpkin seeds to garnish
Directions Heat the oil in a large saucepan (or preferably a pressure cooker) and add the onion, carrot and potato. Cook until the onion is soft. Add the pumpkin and stock. Bring to the boil and add the passata. Cover and simmer gently until the vegetables are soft and tender. Add the curry powder and paprika and then simmer for a further 5 minutes. Blend with a hand blender, or cool and liquidise. Season to taste with salt and pepper. Serve into warm bowls with a drizzle of cream and a sprinkle of pumpkin seeds.

She was a bit early for Halloween ... the normally well dressed one must have got dressed in the dark! Apparently poor Coleen Rooney hadn’t been told that this season’s fashion is based around elegance when she went to husband Wayne Rooney’s 26th birthday party in Manchester ‘s Wing’s Chinese restaurant in Lincoln Square on Sunday which, on the invitations that went out, named the dress code as “casual”. The dress, by designer Phillip Armstrong certainly didn’t come up to scratch as elegant and with its puckered zip down the back and scarlet lace over what
looked like a bit of white nylon, she must have been seen coming when she paid around £900 for this effort – but she has tweeted that she loved it. The usually well dressed Mrs Rooney had also gone for a professional make-over with her make-up being overdone by Sadie Day (has she got any pan stick left in her make-up kit after what she’d put on Coleen?) and her eyebrows were painted so high she looked like a pantomime dame! She had her hair swept up into a
high chignon with so much hairspray on it was as stiff as a board and to top it all, what about those earrings??? The shoes, Laboutin’s of course, looked too tight or was it just that the 6” heels were pushing her feet so far forward that they just looked that way. Now, this sounds a bit like we’re having an unnecessary go at Coleen. Far from it. She usually looks good with her natural style but whoever persuaded her to go with this lot must have been mad. Or maybe she was just
trying to cheer up hubby Wayne – who arrived in dark shirt and jacket and jeans, after his team’s earlier 6 - 1 defeat against arch rivals Manchester City – with the brightness of it all. Gareth Barry and Joe Hart – two of City’s players but who are also England colleagues of Rooney were at the party. Stick to your own style and keep the light on when you get dressed in future Coleen – it’s far better, and take that frock to the nearest charity shop in time for Halloween!

On September 8th, I entered Mercadona supermarket in Benalmádena-Costa, Avenida Federico García Lorca, just to buy some milk. There an unknown man asked me to help him lift down a carton of milk from the top shelf. Of course I helped him. But he

I am not sure what liability one would still have for the period for which they were tax resident. Editor says: There seems to be a worrying “probably” and an “I am not sure” in this letter so I will be asking for clarification over the next week as to the legal standing of the residencia and will have an article in the paper to clarify exactly where you stand. However, if you live in a country and it is a requirement of that country’s law that you become a resident after that time, you should do so. Don’t forget that, if you do not comply with the law, you could be liable to deportation!

here are basically three types of telescope available – a refractor, a reflector and a Cassegrain or Catadioptric telescope. But they all do the same thing, which is to gather as much light as possible from a faint object and then magnify the image.
A
refractor telescope is what most people think of in telescopes. It has an objective lens at one end that collects the light and sends it straight down the tube to an eyepiece at the other end that you look through. A reflector telescope uses a curved mirror at the far end of the telescope to collect the light and then reflects it back up the tube to another mirror which angles the image to 90° to come out of the side of the telescope into the eyepiece. A Cassegrain telescope is almost a mixture of the two; it uses a lens and a mirror to reflect the image back up the tube to a smaller mirror which then reflects it back down the tube again to come out through a hole in the centre of the main mirror and into the eyepiece.
while a 6mm eyepiece will magnify to around 120 times. But there is a down side to magnification, the more you magnify the image the fainter and less clear it will become so only objects such as the Moon or the brighter planets will benefit from higher magnification. Faint, deep sky objects such as galaxies and nebulas always look better with low magnification.

ach telescope has its own good and bad points. A refractor telescope can be used to look at objects on the Earth such as ships and other distant objects while a reflector always gives an ‘upside down/left to right’ image because of the mirrors. This inverted image doesn’t matter when looking at celestial objects but is useless for looking at Earth bound objects. But because mirrors are cheaper to make than lenses then reflectors tend to cost less than refractors.

ize matters in telescopes, it is the light collecting properties that are important and the bigger the telescope then the more light it can collect. A refractor with less than a 3” lens or a reflector with less than a 6” mirror is frankly not worth paying for. Advertising that claims 200, 300 or even 400 times magnification should also be avoided as it is not the telescope that magnifies the image it is the eyepiece. And a decent telescope should come with a selection of at least two or three interchangeable eyepieces.

yepieces come in a variety of sizes and the smaller the eyepiece the bigger the magnification – so a 20mm eyepiece on a 6” reflector telescope will give a magnification of about 35 times,
o what can you expect to see through your telescope? Well don’t be misled by images you see in magazines or on television. These wonderful full-colour pictures of nebulas and galaxies have been taken with telescopes costing millions of pounds and are usually the result of lengthy time exposures using specialised cameras taking multiple images all combined together. The best that you will see of a nebula or galaxy is a fuzzy blob. You will however be able to see craters and mountains on the Moon, Jupiter and its four largest moons, the rings of Saturn and the changing phases of Venus. Myriads of faint stars in the Milky Way and other objects such as comets that are usually too faint to be seen with the naked eye will now be visible. But you must NEVER look at the Sun through a telescope, it will burn your eye and cause irreparable damage.

y advice then is unless you intend to use your telescope to its maximum and not just leave it collecting dust in a cupboard, then I would recommend buying a pair of binoculars. £100 will buy a ‘toy’ telescope but £100 spent on binoculars will get a very respectable pair and you will see just as much through them, if not more, than with a cheap telescope.

Luke Donald wins the Disney First half failures and captures PGA money title cost Malaga dear Luke Donald considered this his biggest win of the year, he was presented the trophy by Mickey Mouse and Donald Duck but there wasn’t anything Mickey Mouse about the way Donald took the title. The Disney event featured the weakest field of any Donald has played this year. It's the final tournament of the PGA Tour season, filled with dozens of players well down the money list who were desperate to keep their cards for next year. It hardly compares with his wins at the Match Play Championship in Arizona or Europe's flagship event at Wentworth. Perhaps it was only fitting that after Donald ran off six birdies on the back nine Sunday and closed with an 8under 64 to win the Children's Miracle Network Classic, he struggled to hoist the bronze trophy over his head. "It's about a 60-pound trophy," Donald said. "I nearly dropped it on the green."
It felt about as heavy as the burden of expectations he placed on himself all week. Donald knew that his best chance to win the PGA Tour money title, and state a convincing case that he should be voted player of the year, was to win Disney. He had not played at Disney in eight years, and because his caddie was on his honeymoon, Donald had to borrow Gareth Lord from Thomas Bjorn.
He was five shots behind going into the final round, and four shots back at the turn. And then he left no doubt who was No. 1 in the world — or on the PGA Tour. Starting with a simple upand-down from just short of the par-5 10th green, Donald unleashed the kind of golf expected of the world's No. 1 player. He dropped a wedge into 8 feet on the 11th, and an 8-iron to 6 feet on the
12th. Then came a lob wedge to 5 feet on the 13th — Simpson missed from just outside of him — and an 18foot birdie on the 14th to take the lead for the first time. Donald then rolled in a 45-foot birdie putt for his sixth straight birdie, crouching when it fell, slamming his fist in a rare display of emotion, that sent him on his way. He finished with three straight pars. The former BBC darts commentator Sid Waddell has been diagnosed with
bowel cancer. The 71-year old, whose voice has become synonymous with the sport, left the BBC in 1994 to broadcast for Sky Sports.
Waddell thanked fans for their best wishes via Twitter, saying "Bowel cancer's not a barrel of laughs so I'll be switching off from Twitter until things get better." The Cambridge graduate is also a published author and screenwriter. Northumberland-born Waddell is well-loved for his colourful and excitable commentary style, with his best-known lines including "There's only one word for it – 'magic darts"'.

Malaga 0-4 Real Madrid After last week’s disaster in Levante, Malaga faced Real Madrid in what was seen to be a test to see how far Malaga had progressed under Manuel Pellegrini and whether they were seen to be a challenge to the top tier in La Liga. As early as the 3rd minute Joaquin was bought down in the Madrid box, but no penalty said the referee and from then on the first half went downhill. On 11 minutes Higuain collected the ball in the box with a hint of offside but ran on to slot the ball past Ruben. With Malaga chasing shadows Madrid looked comfortable and it was no surprise to see them go two up. A cross by Di Maria was met by Ronaldo in between two Malaga defenders to slot home on 22 minutes. Casillas saved well on 25 minutes from a Malaga attack but Malaga were showing little in the way of any promise they had shown in the earlier games. After the drubbing of the first half Malaga started the 2nd half as you would have expected. Carzola hit the bar and Joaquin and Eliseu forced great saves from Madrid's Casillas. Later on in the half a Rondon shot just missed the goal and Eliseu had another effort saved well. As Mourinho said in his post match interviews 2-4 would have been a fair reflection of the game.
