the world's most popularly celebrated festival. The origin of New Year dates back to the era of emperors. They thought of celebrating a special day which should dot a day for the beginning and end of the year. The First New Year celebrations were noted in Mesopotamia around 2000 yearsBC It was celebrated at the time of Equinox in mid-March by the Egyptians, Persians and Phoenicians while Greeks celebrated it on winter solstice. As per the ancient Roman calendar New Year fell on March 1. This calendar just had ten months and March was the first month of the year. The calendar marked the cycles of the moon, beginning in spring and ending with autumn planting. Numa Pompilius, the second king of Rome divided the year into twelve lunar months by adding January and February. The New Year was shifted to January as it marked the beginning of the civil years in Rome. But this was not fully accepted by the people of Rome who continued celebrating in the month of March only. The Roman emperor Julius Caesar officially declared January 1 to be a New Year in 46 B.C.

Site_Specific 2012 Join us at 12:00 on 14 January 2012 at the Beacon Island Lifestyle Resort The Site Specific team are launching the next step in the land for Plettenberg Bay for 2012. Site Specific has now produced a documentary book on the ground breaking land art event which took place in the town in May this year. It was a hugely succesful "art happening" - and has opened many avenues of possible development including Tourism for the area and

of course, education focusing on the environment and creative expression, which are sorely needed. We have teamed up with the Eden to Addo initiative, and under the guidance of Joan Berning, have created a week-long 85km luxury "land art" trail for 25 people, which will join the five areas we would like to focus on in 2012. The trail will start on the 21st May 2012, and go through Kranshoek - launching the land art piece there, then on to Kwanokhuthula the next day, where the hikers will be welcomed and launch the next piece, then on to

the Bitou area, where a similar land art "launch" will happen, up to The Crags, and then to where the second permanent land art work along the Eden to Addo trail which will be produced by world-renowned land artist Strijdom van der Merwe, at the junction of the R339 to Knysna and the R340 (road to Plett). The trail will ends on Central Beach, where the project will be officially opened at the historic Timbershed on the 27th May Sunday . We hope to raise funds by auctioning off the tickets for the trail. The Eden to Addo team are highly organised with vast experience in making the trail as enjoyable as possible - and will set up top notch camps along the route, produce fabulous meals, provide transport for baggage along the route (no heavy backpacks necessary) and provide expert information on the flora and fauna of the area. During the three weeks of land art "activation" in the Plettenberg Bay area, there will be an intense workshop for potential land artists from these five areas mentioned above, who will be working with top artist and Senior Fine Art lecturer, Gordon Froud, as well as local land artists. The idea is then for the "trainee" land artists to return to their respective areas to create their own land art within their communities at their Community Hall or School, under the guidance of the local land artists, and the Site Specific team. These will then be launched as the hikers make their way along the trail - from one land art piece to the next. On the 14th of January, we will be revealing this plan of action to the local land artists, the municipality and interested public. We will be presenting copies of our book to those who have helped in the process, selling magnificent prints of the land art works that were created in May. Places on the Site Specific/ Eden to Addo land art trail will also be sold. PAWS Report Back & Thank you

Our New Year’s Eve celebrations went off without a hitch. Heartfelt thanks to you all for your co-operation and thoughtfulness with regard to the welfare of our animals and birds during the evening’s festivities. The fireworks display was enjoyed by us all – thank you Bitou Municipality for this show. The Chinese lanterns were lovely and made a wonderful picture in the night sky. Most importantly, our fellow creatures did not suffer unduly and we are happy to report that our Vets were not called upon to handle any injuries or traumas suffered by these animals as a result of distress caused by the letting off of illegal fireworks. Robberg Veterinary Clinic reported that they received calls from people who were concerned about the number of dogs and cats that had got lost as a result of trying to run away from the loud noises, but apart from this we had a very successful night. PAWS also started receiving calls from about 1.00 a.m from people who had

Licence Seizure

Since the announcement by the Minister of Transport on 27 December 2011, calling for the immediate seizure of driving licenses wherein it was said that “drivers arrested for any traffic offence must have their driving licenses seized as well as suspended and/or cancelled” and JPSA being asked for comment thereon, we openly stated that there is no legislation that permits any traffic officer to do this. This has resulted in a flurry of actions and statements to justify this call, as well as a retraction by the Minister, which was then followed up by a reinstatement of seizures by the Acting CEO of the RTMC, Collins Letsoalo on eTV News where he stated that authorities would indeed “seize them and give them back to alleged offenders once they have appeared in court.” JPSA’s and my standpoint on this matter has by contrast, remained constant but we do now feel that there is a need to clarify things thoroughly. Collins Letsoalo quoted section 25(1)(b) of the National Road Traffic Act as the basis on which this will be done. Interestingly enough, JMPD spokesperson, Wayne Minnaar also made a statement to a newspaper that the JMPD will do as has been instructed (seizing licenses), thus showing that they are prepared to selectively act upon some orders given to them, whilst they disregard and ignore others (like that given to them to cease issuing unlawful infringement notices). This also comes after it was reported to the JMPD that one of their officers was stealing driving licenses from people to whom he issues infringement notices. There appears to be a significant degree of confusion with respect to Section 25 of the National Road Traffic Act, wherein executive powers are indeed granted to the CEO of the Road Traffic Management Corporation to suspend and/or cancel the driving licenses of persons who hold such documents under certain conditions. Prior to the National Road Traffic Amendment Act’s proclamation in 1999, this power was conferred on the Transport MEC for each province however in terms of the National Road Traffic Amendment Act which has been incorporated into the latest version of the National Road Traffic Act, MECs no longer possess this power and it is now the exclusive property of the CEO of the RTMC. We therefore wonder why it is that official Department of Transport statements are spreading misinformation by making reference to Transport MECs having this power, when it was withdrawn when it was transferred to the CEO more than 10 years ago. Notwithstanding the fact that

It will be difficult to fill the void he has left. this section does indeed exist and grant powers to the CEO, like all legislation, it cannot be read and acted upon in isolation, and it would appear that other provisions of Section 25 are not being taken into account. Reading Section 25(1)(b) in complete isolation of the rest of this section makes it appear that the CEO may suspend/cancel anyone’s license at will, but this is not the case. Section 25(2) through (10) of the said legislation makes it very clear that any such person as the CEO may determine to be a candidate for suspension or cancellation of their driving license should be subjected to a re-test with respect to the class/es of driving license held, after which their driving licence may be cancelled if they are found to be incompetent. The Act makes no reference whatsoever to the CEO having the power to decree that traffic authorities should be allowed to exercise his powers, nor does it suggest that deputation or traffic officers/authorities may take place. Furthermore, there is a strong likelihood that the National Road Traffic Act is in respect of this provision, in conflict with the Promotion of Administrative Justice Act, which requires administrative action that is lawful, reasonable and procedurally fair. Should the current Acting CEO exercise these powers, it is questionable whether such actions by him would be lawful at all, given the fact that the Labour Court has already found his appointment to have been irregular, invalid and unlawful on 10 March 2011. Mr Collins Letsoalo has said that the matter is being appealed but to date, no evidence of this being the case has been forthcoming and the appeal cut-off date has been exceeded. In light of this fact, any action or order he takes or gives would be deemed as being unlawful and Ultra Vires (beyond his powers) due to the findings of the court unless the matter is in fact on appeal and evidence of this can be provided. It would therefore be wise to leave the suspension and/or cancellation of driving licenses to the courts, which work on a little thing called evidence and require convictions prior to imposing sentences and punitive measures. It is unclear whether the

Acting CEO has indeed acted on his perceived powers thus far, but it has been suggested that he has done so and therefore it would not be unreasonable to expect that legal challenges will ensue once people come to understand that his actions are unlawful. Additionally, the consequences surrounding grounds for litigation in the event that a person’s driving licence was suspended or cancelled prior to conviction where such person were to be acquitted by a court are simply too mind-boggling to contemplate. There can be no doubt that the continued carnage on our roads is, to coin a phrase, “unacceptable” and that decisive and well thought out plans and measures must be taken to stem the tide of people being maimed and killed on our roads. However, the blanket seizure/ suspension/cancellation of driving licences of persons accused of road traffic offences prior to trial and conviction is dangerous ground to be treading on. Granting executive powers in an irresponsible manner, especially to people who have little or no experience in matters with which they are dealing is reckless at best and should be avoided at all costs. We maintain our stance that traffic officers have no lawful powers to seize driving licenses of people they arrest and that suspension and/or cancellation thereof must remain a function of competent courts. We again reiterate that AARTO contains mechanisms to impose demerit-points on and/or suspend or cancel driving licenses and this has been stalled by the RTMC and Department of Transport. JPSA is and remains committed too true, well thought out, planned and executed road safety initiatives and is signatory to the United Nations Decade of Action for Road Safety 2011-2020. The contrast between the application of hot and cold towels— and the body’s response to these changes in temperature—is what makes constitutional hydrotherapy so effective. Heat dilates the blood vessels, cold contracts them. The alternating dilation and contraction creates a pumping action that improves circulation through the

blood vessels to the skin and internal organs. With improved circulation comes a reduction in congestion and inflammation. I have even used this treatment for patients with pneumonia as one component of an overall treatment program. Constitutional hydrotherapy helps the body... Fight off infection Clear mucus from deep in the lungs Improve sleep HOW TO DO IT You can do hydrotherapy at home by yourself, although it is easier (and less messy!) with the help of someone who can place the hot and cold towels on various parts of your body. Note that this method works for all conditions mentioned. Here’s how... Lie on your back in bed or on the floor if it is comfortable for you. (If you are worried about getting the bed wet, use a water-resistant covering on top of the bed.) Have the helper cover your bare chest and abdomen with one thick (bath) towel that has been soaked in hot water and wrung out (as hot as is tolerable). The towel should be moist. Be careful not to burn your skin. Cover the hot wet towel with a dry towel. Place a blanket on top of the dry towel. Remain bundled up in these layers for five minutes. Next, replace the hot towel with thin towels that have been soaked in cold water (as cold as you can tolerate) and wrung out—the towels should still be moist. Cover the cold towels with a dry

towel and the blanket. This phase of the treatment should take about 10 minutes, the time it takes for the towels to reach body temperature. Turn over onto your stomach and repeat the process, this time with the towels placed on your back. Again, five minutes of hot-towel treatment should be followed by 10 minutes covered with thin, cold towels. After the treatment, drink at least 250ml of water and rest for at least 15 minutes. The water helps flush out any toxins that have been released during the treatment. Rest allows you to readjust to room temperature before standing up. If you have an acute condition such as bronchitis, do constitutional hydrotherapy once or twice daily. For a chronic condition such as arthritis or for detoxification, use constitutional hydrotherapy five times weekly. Constitutional hydrotherapy can be used safely by patients of all ages. Letter via the Editor 4 Years in Plettenberg Bay: At the end of December 2011 I will be retiring from Mediclinic Plettenberg Bay. The last four years in Plettenberg Bay has been a wonderful experience. Opening the new private hospital in your town was a privilege to me . On a more personal note: there are a few thank you’s: · To Glen Eden Village and a special word of thanks to Corrie Nel for his positive input as neighbours. · The many patients –with all their positive inputs –even if it was to support the growth of the hospital. · The wonderful group of General Practitioners in town , who supported the hospital team from day one. · The specialists in Plettenberg Bay and Knysna –supporting our hospital. · My wonderful staff –we have had a few “turnovers”, but the last year or two, when we experienced an incredible volume increase. brina Love Ocean Challenge was lauded a great success as top international sport stars, holidaymakers and local athletes competed in the multidisciplinary competition in Plettenberg Bay on 28 and 29 December 2011. Sponsored by Stonehage, international family wealth advisers, and Discovery, the Challenge drew close to 3000 participants to compete in 2 days of sport and fun for the whole family. While day one took place at Plettenberg Bay’s popular Central Beach, the second day of the Sabrina Love Ocean Challenge moved for the first time ever to the prestigious Kurland Polo Estate. The Sabrina Love Ocean Challenge is the main fundraising activity for the Sabrina Love Foundation. Established in 2003 by Tony and Suzy Lubner in memory of their daughter Sabrina, who died at age six from complications of a rare bone disorder, the Foundation supports children and families living with physical disabilities in the Bitou region. Events of the first day included: The 6km Ocean Swim from Robberg Corner to Central Beach once again lived up to its iconic status as Paralympic gold medallist Natalie du Toit and Olympic long distance swimmer Chad Ho finished both in first position in their category. The sea conditions were difficult and times where slower than in previous years. Du Toit addressed competitors ahead of the Swim, encouraging them to “have fun and remember the Sabrina Love message of

hope.” Olympic paddler and Plettenberg Bay local Michele Eray teamed up with Neil Stephenson and came in third in the Surfski Paddle behind the winners Warren and Wayne Jacobs, while the single paddle was won by Kevin Hill in a time of 1:05:55. Comrades Marathon legend Bruce Fordyce hosted the 10km Run, which was won in an incredible time of 38 minutes by Kane Riley and Carlyn Fisher (43:00). Conditions were very hot and humid and although the race took place in the early morning, athletes were battling with the heat. The beach walk was once again the atmospheric climax to the first day event as hundreds of walkers, donned pink T-shirts and hats, welcomed the swimmers to the beach. The second day of the Sabrina Love Ocean Challenge presented by Stonehage and Discovery was hosted at the magnificent Kurland Polo Estate where thousands of supporters of the charity event participated in one or more of the four sporting events on offer. The manicured grounds of the estate were draped in the now trademark Sabrina pink and, contrasted against the lush backdrop of the Tsitsikamma mountain range, made for a beautiful and fitting sight as the fundraising event attracted record numbers. The Kurland Pavilion, better known for its hosting of international polo matches, looked equally gracious serving as the event hub from which the different races reached out into the surrounding mountains, forests and lake. The first event of the day was the 600 meter lake swim over a star shaped course where participants were required to exit the water at two points. Olympian Chad Ho’s pure power through the water was enough to see him round the course in the fastest time to claim the men’s race whilst Kamilla Snyman was equally unfazed by the short running legs and emerged as the winner of a strong female field. Attention was then focused on the 25km mountain bike ride where 400 riders, many of them clad in pink Sabrina riding gear, set off on a wide sweep of the estate reaching high into the beautiful mountain before descending on long

single tracks back through the forests, over sparkling streams and onto the polo fields to reach the event hub. No one was too surprised when local mountain biking hero Kevin Evens broke from the treeline and streaked into the finish chute to claim his 2nd Sabrina Love trophy while Nicky Booyens lead the woman’s race. The sun was already high in the sky when the 430 plus trail runners sprinted off into the forests for ten kilometres of pure trail running bliss. The intermediate course was intended to be achievable for the many first timers whilst still challenge the pro runners and that is exactly what the undulating and varied trail did. Melikhaya Msizi was smiling broadly when he sprinted down the home stretch to tremendous applause from the spectators to comfortably claim the men’s race whilst Nicky Rider held off a close challenge from the Crag’s local Kerry Scott, to claim 2nd place in the woman’s race. For many participants the Sabrina Kids of Steel was the highlight of the day’s proceeding as youngsters racing in their age groups from 6 to 12 were set off on the specially designed adventure duathlon. A short swim was followed by a 1.5km exploration trail through the forests fringing main polo field before the children got to finish under the same arch that many of their heroes had passed under earlier in the morning. The Sabrina Love Ocean Challenge concluded with a spectacular prize giving ceremony with “Tigger” performing the Sabrina song together with the celebrated Plett Fieldband. A Thought for the Week. [Romans 14:17 Amplified] “[After all] the kingdom of God is not a matter of [getting the] food and drink [one likes], but instead it is righteousness (that state which makes a person acceptable to God) and [heart] peace and joy in the Holy Spirit.” We have just entered 2012 and based on what has happened in the world in the previous year, I am pretty sure that many reading this article, even perhaps some who profess to believe in Jesus Christ, are looking towards the new year with some fear and trepidation. Obviously not one of us knows what the future holds, but Christians have this one assurance that they at least know who holds the future! However, nothing that will happen will just occur randomly and God, who is still sitting on the throne and still has everything under control, knows exactly what will take place. And not only that, but He has promised that He will use everything – the good and the bad – to further His plans and purposes to establish all that He has pre-ordained. Paul writing to the Church in Rome assures the believers there – and us – that: “We are assured and know that [God being a partner in their labour] all things work together and are [fitting into a plan] for good to and for those who love God and are called according to [His] design and purpose.” [Rom.8:28 Amplified.] For Christians these words bring hope and peace, a commodity which is indeed extremely scarce in this present day world filled with uncertainty; with violence and crime; with strife and wars. You, too, may well be fearful today and ask the question: But how is it that in spite of all these things even a believer in Jesus Christ can remain optimistic, full of hope and even joy? The answer lies in the words of Paul in Romans, chapter 5, verses 1-5.
