Plett in Spring is fabulous!. Welcome to all our visitors. It is so lovely to share our beautiful area with you. The weather has been sunny, with the odd little breeze to cool. We are seeing more healthy sun-kissed faces and bodies emerging from the winter-pale. Many of our shops have lovely new summer stock . The interiors are being spruced up and re-vamped and a number of new shops have opened. Its super to have Homework back in the Main Street. Staff are getting some great training from Maureen from Trainsmart to inspire spectacular customer service,, and there is a general air of anticipation . We have just returned from a very successful netball tour. It was the 30’th Anniversary of the Western Province Netball Tournament in Cape Town. In our category we came third and we are proud of the lovely team spirit and perseverance. We have a lot to be thankful for. Dear Readersrd On August 23 this year we lost a special local and wonderful friend, Tim van Heerden to a fatal shark attack right here in Plett. One of the events on the social calendar here in Plett is the annual Surfer’s ball and this year the organisers would like to hold the ball in honour of Tim and create a fund where the monies raised from the Surfer’s Ball will be used in assisting the development of Plett lifesavers, financially assisting the NSRI and ultimately making Plett the safest beach in South Africa. The date set for the Surfers ball is the 12th of November 2011, obviously putting an event like this together costs money so we request your generous contributions towards making this year’s ball a success. HIGH COURT JUDGE RULES THAT BRUMMER ACTED UNCONSTITUTIONALLY AND QUESTIONS HIS IMPARTIALITY; RATEPAYERS FORCED TO FUND BRUMMER’S FOLLY
The Cape Town High Court has questioned the impartiality of Bitou Speaker Mr. Brummer in a historic decision, dismissing his application against six ANC Councillors. The Court also held that his swearing in the Council Chamber was unbecoming of a Speaker. In a judgment handed down on Wednesday, 28 September 2011, the Honourable Ms. Acting Justice Cloete of the Cape High Court dismissed with costs the urgent application launched by Mr. Brummer, a longstanding member of the DA, in his official capacity as Speaker of the Bitou Municipal Council against, amongst others, the six ANC councillors. Moreover, Cloete AJ granted the ANC councillors’ counterapplication, declaring certain conduct of Brummer as unconstitutional The ANC councillors and, specifically, councillor Lulama Mvimbi, the former executive mayor, have been vindicated by Cloete AJ’s judgment. Cloete AJ held that Brummer misconstrued his powers as Speaker when he refused Mvimbi an opportunity to address the Council at the meeting on 29 June. What is more, Cloete AJ held that Brummer acted unlawfully when he directed Mvimbi to leave the Council chamber after Mvimbi objected to Brummer’s aforesaid ruling. Significantly, Cloete AJ held that Brummer’s conduct raised “serious questions about his impartiality in his role as Speaker“. Cloete AJ was particularly concerned about a series of official press statements issued by Brummer, which gave a “one-sided and artisan account of events” and were contradicted by the transcription of the recordings of the meetings. The dispute arose at a meeting of Council on 28 June, when Brummer called on Mvimbi to speak, only to order him to sit almost immediately after he began speaking and, within seconds thereafter, summarily directed Mvimbi to leave the Council chamber. Following this ruling, Brummer repeatedly adjourned the Council meeting over the course of a week. Initially, Brummer sought to justify these adjournments on the basis that Mvimbi was not entitled to be present at the meeting of Council; Later, Brummer alleged that Mvimbi and the ANC councillors were deliberately disrupting the meeting. Brummer’s application for interdictory relief Brummer approached the Court for an order directing the ANC councillors to adhere to his directions under the Rules of Order, governing meetings of Council. Yekiso J granted an interim interdict in these terms on 7 July. Notably, Brummer also cited the DA councillors and the COPE councillor as parties to the litigation. However, as noted by Cloete AJ, Brummer alleged that while Mvimbi instigated the disruption, he was entitled to relief against all the ANC councillors, be-
cause they “have at times reacted [to Mvimbi's disruption]“. Brummer did not complain of any conduct by the DA or COPE councillors. But in her judgment, Cloete AJ dismissed with costs Brummer’s application for final interdictory relief on the basis that he had “fundamentally misconceived his role as Speaker“. Cloete AJ’s finding is premised on two bases. First, Brummer maintained that as Speaker, he has “autocratic rights and that…[he is entitled] to expect prompt and unquestioning obedience to his directions“. But Cloete AJ held that Brummer’s attitude “is fundamentally at odds with the constitutional entitlement of members of a Council set out in section 160(8) of the Constitution [viz., to participate in Council proceedings in a manner that is consistent with democracy]“. Moreover, according to Cloete AJ, Brummer lost sight of the fact that his directions must be lawful. Second, Cloete AJ held that Brummer’s conduct at the meetings “raises serious concerns regarding his impartiality in the role of Speaker“. Cloete AJ went on to hold that this concern “is deepened by a series of press statements released by Brummer to regional and national media outlets, setting out what he considered to be the chronology of events“. Cloete AJ remarked that certain material allegations in Brummer’s press statements conflicted with the recorded transcriptions of the Council meetings. In particular, Cloete AJ referred to Brummer’s allegation that when he directed Mvimbi to be seated at the 29 June meeting, Mvimbi “proceeded to shout [him] down, became abusive and threatened a member of the community“. In another press statement, Brummer alleged that he was compelled to expel Mvimbi from the meeting in light of his “persistent bad behaviour“. But, Cloete AJ rejected Brummer’s misleading and inaccurate characterisation of Mvimbi’s conduct after Brummer directed him to take his seat, holding that “Mvimbi’s reaction to Brummer’s instruction…can hardly be regarded as behaviour which constituted ‘a persistent disregard of the directions of the chairperson‘” as contemplated in the Rules of Order. The exchange between Brummer and Mvimbi that resulted in the latter’s expulsion lasted a mere 27 seconds, and the recording of that exchange reveals that Mvimbi addressed Brummer in a respectful and restrained manner. The ANC councillors’ counterapplication for declaratory relief Cloete AJ granted all of the prayers sought by the ANC councillors. First, Cloete AJ declared that Brummer’s direction at the 29 June meeting that Mvimbi was not entitled to address the meeting, followed by his direction that Mvimbi be expelled from the Council chamber, were unlawful. Cloete AJ accepted the ANC councillors’ argument that Brummer was constitutionally obliged to allow Mvimbi to address the matter before Council. Instead, Brummer unilaterally decided the matter. When Mvimbi objected to this violation of his right to speak, Brummer prematurely and arbitrarily decided to expel
Mvimbi from the Council chamber. Second, Cloete AJ declared that Brummer’s use of profanity, when he told the councillors that he was “seriously pissed off“, constituted language unbecoming of a Speaker. Cloete AJ found that “[Brummer's] profanity was clearly directed at Mvimbi and his fellow ANC councillors“. According to Cloete AJ, this conduct underscored her conclusion that Brummer failed to exercise his powers as Speaker in an impartial manner. Third, Cloete AJ declared unlawful Brummer’s failure at a Council meeting of 8 July to treat an urgent motion as opposed and to allow debate on the matter, notwithstanding that Mvimbi expressly brought it to Brummer’s attention that the ANC wished to opposed the motion. This urgent motion was tabled by Brummer and proposed that pending litigation between the municipality and the new executive mayor, cllr. Booysen, be withdrawn. Brummer alleged that he did not notice that Mvimbi had raised his hand to indicate opposition to the motion. Brummer alleged that when Mvimbi brought it to his attention, he had already “moved on to the next agenda item and there was nothing he could do about it“. But Cloete AJ rejected Brummer’s explanation, holding that by virtue of Brummer’s overly mechanical application of the Rules of Order, he had unlawfully prohibited debate on the motion, in violation of the ANC councillors’ constitutional right to participate in the business of the Council. In granting the declaratory relief, Cloete AJ rejected Brummer’s argument that the dispute was moot. Cloete AJ held that the dispute was an “existing or live controversy“. According to Cloete AJ, Brummer’s insistence on his entitlement to apply the rules in a “mechanical and autocratic manner“, as well as the release of a series of “one-sided and partisan” press statements, “the probabilities are that he will continue to exercise his powers as Speaker in this manner, thereby infringing the constitutional right of [the ANC councillors] to participate in the business of the Council and to enjoy free political expression at its meetings“. Conclusion It is a matter of grave concern that the DA/ COPE coalition has allowed Brummer to embark on this frivolous litigation at the taxpayers’ expense in an ill-advised effort to justify his authoritarian and unconstitutional conduct. We are reminded that the DA/ COPE coalition decided that the municipality would fund Brummer’s application. In contrast, the executive mayor refused to authorise funding of the ANC councillors’ defence, as provided for in the Municipal Finance Management Act. As a result, the ANC councillors had to fund their defence from their own pockets. Fortunately, the Justice and Equality Fund stepped in to assist the ANC councillors as their funds were drying up. As a direct result of Brummer’s arrogant and self-serving conduct, the ratepayers of Bitou – over and above funding Brummer’s legal team to the tune of approximately R 600 000 – now face a cost order, which may be in excess of R 500 000. Little over a month ago, the executive mayor, cllr. Booysen, assured Bitou ratepayers that the “responsible councillors” would be held liable for the costs of this application. But, a week has passed since the ruling of Cloete AJ. In stark contrast to the slew of press statements issued by Brummer and Booysen during the court proceedings, we are now met with just a stony silence. According to the ANC councillors’ attorney of record, Mr. Hardy Mills, Brummer rebuffed an approach in July to settle the matter on the basis that each party pays their own costs. In an email addressed to Mr. Mills, Brummer said that he was too busy to meet and insisted on proceeding with the litigation. As Brummer explained: “in for a penny, in for a pound“. We call on the DA/COPE coalition to account to the Bitou ratepayers as to who will foot the bill of Brummer’s folly. More importantly, in light of Cloete AJ’s ruling, the DA/COPE

Oriented Birds F.C and Vodacom League news After a long wait, finally Vodacom league resumed this past weekend in our new home, new horizon sport field. There was a lot of confusion and twists before the games as S.A.F.A called us at the last minute Friday 8hooam that we must submit players medical certificates before 10am or they will not release our players cards but thanks to one surgery who opened their doors early for us to do players neck up. After we emailed the certificates to them, they called to confirm that they have received them and our cards are on the way to us. When we received our cards we realized
that they sent us the wrong documents, it’s the players cards for a Mpumalanga based team called Secumba F.C. Anyway we did everything we can to get the players cards before the kick off as we could lose all point as fined cash if we didn’t get the cards that day What really disturbed us is that four (4) of our key players we not included/sent some with other cards but fortunately we always have soldiers who are ready for a war. Coming to the game... well even though we lost 2-0 to Ikapa Sporting, our boys showed character and hunter, they fought back and created a lot of chances 2nd half but unfortunately it was not our day as the Capetonians grabbed the three point. We sat down after the match, rectified our mistakes and we are looking forward to our next game on the 15th/10/11 in New Horizon sport field @ 15hoo against Blackpool F.C ( CAPE TOWN). Lastly we wanna thank all our fans and supporters, Plee C.F.A. for their support, we really appreciate it and please keep on supporting these your boys. Delvin does Plett proud The 2011 Sunday Times Food Awards winners were announced on Thursday, 6 October, at a stylish cocktail evening atthFoodcorp Innovation Centre’s, 7 Floor in Cape Town. The heated three-day cook-off was celebrated by Mondli Makhanya, editorin-chief of Avusa Media, MC Nataniël and the country’s most well -known foodies. This year’s winners were: Wynand van Rooyen of the Mount Nelson Hotel in Cape Town who took the coveted title of 2011 Sunday Times Chef of the Year; Ashleigh Heeger from the Test Kitchen by Luke Dale Roberts was awarded Young Chef of the Year; Megin Meikle and Darren O’Donovan from HTA School of Culinary Art in Randburg won the Chef School Challenge; and Delvin Reck from Scotty’s Restaurant and Bar in Plettenberg Bay was honoured for the second year running with the Sunday Times’ Stalwart of the Kitchen title. Delvin is rightfully very proud of this achievement. All entrants are required to send in 2 of their own recipes, with photographs of their dishes. A panel of international and national judges scrutinise the recipes, methods and photographs. Delvin was one of 4 chosen to compete in the cook-off in this category. All competing chefs followed the same protocol and cooked from a mystery basket of ingredients that were compulsory to use in their dishes. The mystery baskets remained confidential until the cookoff time, and all plates were presented to the judges anonymously. Contestants were given thirty minutes to plan a three-course menu and to set up the kitchen in preparation of their dishes. Delvin’s award winning meal emerged from a mystery basket containing Asparagus, Feta Cheese, Lamb and Angel Fish. The awards aim to recognise individuals within all areas of the food industry; whether they are at the start of their culinary career or have worked behind the scenes for many years. “The competition becomes better each year and we would like to

Info from PAWS Once again, the people of Plettenberg Bay have voiced concerns regarding both the welfare of the animals in the Bitou area, as well as the roles that the CVC (Community Veterinary Clinic) and PAWS (Plett Animal Welfare Service) play in looking after our animals. Recently Dr. Bert van Reenen who is the Principle of the Bitou CVC wrote a very informative reply to a Letter via the Editor from a concerned citizen of Plett in which he laid out the purpose of the CVC and its handling of the sterilisation and vaccination programme for the Bitou area. Their funding comes directly from the Bitou CVC Charity Shop in Plett and relies on the contributions made by the public to that shop. PAWS takes care of all medical needs of the animals, as well as funding sterilisation and vaccination programmes. PAWS works with all the vets in the Bitou District for the welfare and care of the animals. Our vet expenditure for the month of September alone was R58, 514.04 and this includes sterilisations, vaccinations and general animal care. The Service is also responsible for the general welfare of the animals in the Bitou area with regard to abuse, animals in distress, confiscations, Lost and Founds, re-homing and adoptions, education programmes put together and handled by PAWS committee members especially for children and, as well as being the “Front Man” for all of the above, our Inspector Robert is responsible for

In the meantime, we intend, with the permission of the current owner, to build a facility to house all strays and unwanted animals, which are currently being housed at a Kennels and Cattery, over the Season. It is envisaged that this Clinic, when completed, will have a reception/office area and surgery facilities for the vets who work with us via the CVC. We hope this allays some of the fears of the public with regard to the welfare of our animals. As you can see, both the CVC and PAWS do brilliant work in this field. The CVC relies on its Charity Shop for funding and PAWS is totally dependent on the generosity of the public to carry out the mammoth task it faces. South African citizens urged to provide accurate, truthful and honest information
Eastern Cape Premier Noxolo Kiviet has urged South African citizens to provide accurate, truthful and honest information to Stats SA officials who are currently conducting the 2011 Census count. Kiviet was addressing media at the Bhisho State House office after being counted by Census enumerators on Monday. “This process can only assist government if everyone gives honest information. There is a detailed questionnaire that will provide government with adequate data to do planning for our country’s future. People should participate fully in this process,” said Kiviet. Stats SA executive manager in the Eastern Cape, Zandisile Nkosiyane, said plans were in place to ensure a successful count for 2011. He said every precaution had been made to ensure that criminal elements did not use the Census count to rob households. “Our officials are identifiable by a yellow uniform, yellow cap, a bib with Stats SA Census written on it and an identity card. We have also hired people to do the count in the areas they live in, so they will not be strangers to their communities,” said Nkosiyane. Splendid proud ships, the vehicles of a voyage. they were commissioned and recently launched blue-sea faring Portuguese ships built here in the new but vast Goa ship-yards. many had just had a bottle of port broken on their bows for good luck. And the trade winds were at last fair. The fleet was thus almost ready to soon set to embark for their true home Lusitania; and set course for the epic voyage halfway around, and also up and down, the world. The voyage to sail around Africa. They left Goa amid some fan-fare. Oh the longing to see Cabo Sao Vincente rising in the ditsance like a beacon, a candle in a distant window. Back to the Tagus, the little port valleys and hills of oporto or the busy southern coast. The ships was ready at last. It had taken so many years to craft her from indian woods, here in Goa, though they had far more labour here than in the shipyards back in Portugal. india had been so humidly hot weatherwise... and even the salt tinted port and brief taste of home was not sufficient to quench that thirst. India with its monsoons and spicy food. Well that was good! Potuguese and indian cuisine were bed-fellows - could share a bunk as it were. Lack of funds is the Challenge We don't have the budget to run this Club. We are competing against well organized teams in this league. Already we have spent close to R23 000 - Joining fee R10 000, players registration fee R 60 each, medical form doctor to examine each player R200 each. Total of 27 players, courier to Johannesburg for players cards R1,200, said Chairman Vincent. Understandably, every member of the club OB family is disappointed. All of us would have wanted to see our team stay in Bitou or in Eden but with lack of funds we don't have a choice. We are all losing here, more especially the players; even the supporters because there will be no top flight football in Plett for years. For the sake of the soccer loving people in our city and our region, Vincent said he will convene a special general meeting before 21 October to discuss the Club’s future plan. After the match the then S.A.R.F.U president Dr Louis Luit. presented the referee with a gold watch that cost thousands of rands, regarding him as the best referee of the tournament. At this time referee Bryce Lawrence did not see Danie Rossouw when he grabbed Radike Samo down he was seen by the French touch judge Romain Potte the Springboks did not produce entertaining rugby from the pool stages. Letter via the Editor Static Speed Trap on Oddlands Road I have over the past couple of years sought to establish the status of the static speed trap on Oddlands Road (coming down the hill) and have either been told that it does not work or that it is set to trap at 60kph. I have certainly never heard of anyone receiving a speeding fine from the unit in question. Today I received a ticket dated 20th September clocking my vehicle at 55kph in a 40kph zone resulting in a R150 fine. So the unit is working and set to trap at 40kph. In the light of the fact that I am normally one of the slowest vehicles down the road in question, I fear that there are going to be many receiving speeding tickets. If anyone has books or newish magazines they no longer want, please consider donating them to the Friends. We place these books into the library, replace if there is a copy (damaged) already and sell the rest to raise funds to buy new books for the library. Your Central Library has one of the best supplies of new books in the country because of this system. We bought 13 new books and placed 71 from donated stock from the period May to August 2011. Women of Worth (WOW) Training FAMSA has trained women from different communities to become WOW facilitators. This training covers domestic violence, selfesteem, group-work & how to start support groups. This training empowers women to developed confidence and understands their rights. After the training they will provide support to survivors of abuse and start sustainable projects for unemployed women. FAMSA will be presenting a two day WOW training workshop for women in New Horizon area. This training will take place on the 27& 28 October 2011 from 9H00 – 15H00. A big thank you to the PBCPA for an excellent response. Yesterday, Friday, at about noon I received a call from a lady for urgent assistance at Luna Lodge in Dorethea Ave, Poortjies. It was said that an intruder is trying to enter the house. Luna Lodge is situated about 400m from my house. I phoned the PBCPA Emergency Crime number and immediately went to Luna Lodge, arrived there about 90 seconds after I made the phone call. Already on the scene were Andries from Smhart, Waldo from Plett Security and 2 SAPS vehicles. I was very impressed. Surely, they can't get better than that. Kind regards, Paul
