Letter via the Editor The Library Matters The Western Cape Library Services is a free public service partially funded by tax payers. The visit from Provincial Library Services last week required the library staff to process 900 books, before new books could be made ready to be issued to the public. New procedures now make it necessary to close for a full day. Notification for this delivery of books was placed at the library. The library receives new books three times a year Provincial Library Services must keep library staff updated to ensure a smooth running service to the public. The Assistant Director of Library Services & the Regional librarian who visited for the workshop considered it more economical to hold their workshop at Plett Central Library. Rather than transporting staff to the Regional library in George. There are now six libraries in the Plett area and 17 staff members. The workshop was held at no cost to ratepayers.

Bitou’s Problem Plants Why are invasive plants and weeds such a threat? - They are able to reproduce and spread at alarming rates - They increase the risk and intensity of fires - They deplete water resources - They reduce biodiversity - They threaten fynbos - The have no natural control agents - They provide no support for wildlife - Some are extremely toxic The Bitou Municipal area lies within priceless indigenous forests, mountain fynbos and a coastal dune thicket. Living here we must be sensitive to the fact that any invasive plants which we allow to prosper can spread into these natural areas. Categories are 1, 2 and 3. Category 1 – Lantana – untidy flowering shrub/climber. Flowers are pink, red crimson, orange, yellow or a combination with white. Toxic to livestock and humans, fruits are spread by birds and it is considered to be one of the worst weeds in the world. To control, hack away prickly branches, destroy stem/root with herbicide before they sprout. Black and silver wattle, Rooikrans, and Port Jackson – category 1 & 2 – These are serious invaders replacing fynbos and clogging river beds and infesting sandy dunes. Acacias produce seeds which can remain dormant for 50 years. Cut trees and saplings low and paint stumps with herbicide Long leaved Wattle – a major invasive of fynbos and woody areas, favours moist sites. A biological control programme using a gall-forming wasp is in

INTERNATIONAL FOOD FAIR The Parish of Formosa will be holding an International Food Fair at St Mary’s Church, New Horizons on Friday 18th November at 5:00pm. They produce excellent timber and have been harvested to replace yellowwood and stinkwood. However, they are difficult to eradicate which must be done by hand when small, bearing in mind that they have a tough root system. Trees regenerate from root suckers and herbicides are recommended after cutting. Pines – category 2. Pines are invading our fynbos across the Bitou region. They release their seeds through the cones when cut or burnt. Wood makes excellent braai wood. Cestrum – category 1. It is found in coastal bush and has a very strong leaf aroma. The plant’s unripe berries and shoots re poisonous, ripe berries are purple-black while flowers are whitish green. Stumps must be treated with herbicide. Ginger lilies – category 1. All four of these canna-like plants are declared weeds and must be destroyed. They invade shady places and forests’ under storey. All traces must be dug out to prevent continued growth. Some of the category 3 / ornamental plants include Australian silky oak, myoporum, Pearl acacia, Brazilian pepper tree, Pepper tree wattle, New Zealand Christmas tree, Eugenia, Seringa fruits of which are poisonous, sword fern a serious invader and tubers

should be removed from properties frequently. Peanut butter cassia, yellow flowers smell like peanut butter. Letter via the Editor National brown hyena and carnivore survey needs your help My name is Louisa Richmond-Coggan, I am PhD student studying brown hyenas and other carnivores across South Africa. I need your help, I am contacting

hunting and farming associations, conservation organisation and affiliated organisations all over south africa and asking them to send the link to my online questionnaire to all their members either via a website, email or newsletter. So far I have over 130 all from cattle farmers. The research is part of my PhD, I am wanting to find out the opinions of all types of hunters, farmers and private land owners to carnivores including brown hyaenas. The survey will provide a way for me to determine where in South Africa hyaenas are present as currently this detailed information is not available. Brown hyenas are listed as near threatened but little is known about them and people's perceptions towards them on a national scale, for this reason my survey will provide new data and in turn will influence carnivore management and conservation. Being told where carnivores are not is just as valid as being told where they are. Your opinion is extremely important to me and I am very keen to hear what you have to say about carnivores and brown hyenas and in turn to find out where they are across South Africa. The information you provide is vital to the project.

Owners of one car had gone for an hour's walk whilst the other owners were sitting at the Lagoon. Both "car guards" had disappeared when owners returned to their cars. Letter from the Mayor Fifth Letter 8 November 2011 Information Technology. First and foremost our thanks to Jeremy Ord and his team from Dimension Data who paid us a preliminary visit on 26 September and then followed up with a 5 member working team who then did an initial evaluation over three days a week later. Even at this early stage it is clear that we have some very serious IT problems which require urgent attention. There is however also some good news in that some of the programmes are from reputable companies who can and will back up their products. To single out just one of the problems; it was found that our official website (www.plett.gov.za) is woefully inadequate and in fact non-compliant with what we are legally required to display. It will be attended to as a priority in order to improve the quantity and quality of information available to the public. We have a follow-up meeting with the Dimension Data team on 9 November 2011. Personnel. Municipal Manager. The oral part of the Municipal Manager's disciplinary hearing has now been completed before Judge Pete Combrinck. The Judge ordered that the municipality's representative must submit its written Heads of Argument by 26 October and then the Municipal Manager's representative must submit his written reply by 9 November, where-after judgement will be given on 1 Dec’11. Alleged “Copper Theft.” Four persons working in the Water Department were arrested when trying to sell pipe fittings belonging to the municipality to a scrap metal dealer. They have been suspended and the disciplinary process against them is in progress. Organisation Structural Design. It has been clear from the outset that the way in which the municipality is structured is far from ideal. The existing structure is top-heavy and there are too many departments. There are a number of instances where the reporting structure gives rise to a one-on-one reporting structure and even an instance where there is no reporting structure. In many instances there are not even job descriptions for positions. On a broader basis, key responsibilities have been arbitrarily moved from one department to another without clearly spelling out exactly who is responsible for what and without the necessary skills being in place to discharge the responsibility. As you can imagine this makes the overall management very difficult and it is not only impossible to carry out functions properly but also impossible to manage and hold the personnel accountable. All these problems will be dealt with during the structural re-design of the entire organisation. The Provincial Government has come to our assistance to make this possible. They are currently evaluating tenders. We are hopeful that a professional service provider will be appointed soon to commence with the work by end of November. Only once it has been determined exactly what structure is needed to do the work of the municipality efficiently, what posts are needed, a proper job description for each post has been done and a suitable person with the required skills has been placed in the relevant post will it be possible to start managing the municipality in an efficient and sustainable manner. I, for one, look forward to the day when we know exactly who is responsible for what and management can then manage properly. Staff Discipline. This was challenged by the highest bidder and the municipality lost with costs awarded against us. The court set aside the award but did not go as far as awarding the bid to them. They have appealed that aspect and we are awaiting the court’s decision. The Moby Dicks bid process had to be abandoned due to alleged irregularities. It has been pointed out to us that the process that was followed was also not correct and a new and correct process will be initiated in due course. Audit 2010/2011. A team from the Auditor – General has been busy auditing our 2010/2011 books for the past few weeks. Last week I received a letter from the A-G informing me that the municipality had failed to submit its financial statements to him on due date as required. We had missed the cut-off by a week. The A-G's finding was that the late submission was as a result of insufficient capacity on the part of the municipality. We will deal with that shortcoming during the organizational redesign. I understand that we will receive the audit results by end November. Finances. Council will soon be asked to decide on whether or not to take up a R30m loan to alleviate our immediate cash flow problems. This is not a long term solution, but rather crisis management. Despite drastic cost cutting measures and turning over every cent, our monthly expenditure still exceeds our monthly income, which of course exacerbates our overall financial position. We have a revenue enhancement project but it will take time for its effect to become apparent. Blue Flag status. As everybody probably knows by now, two of our beaches, Robberg 5 and Keurboomstrand have attained Blue Flag status. A big thank you to Mark Fourie and his team. Letter via the Editor The Library Matters The Western Cape Library Services is a free public service partially funded by tax payers. The visit from Provincial Library Services last week required the library staff to process 900 books, before new books could be made ready to be issued to the public. New procedures now make it necessary to close for a full day. Notification for this delivery of books was placed at the library. The library receives new books three times a year Provincial Library Services must keep library staff updated to ensure a smooth running service to the public. The Assistant Director of Library Services & the Regional librarian who visited for the workshop considered it more economical to hold their workshop at Plett Central Library. Rather than transporting staff to the Regional library in George. There are now six libraries in the Plett area and 17 staff members. The workshop was held at no cost to ratepayers.

Greetings and warm welcome to our weekly edition. Well let me start with our previous game that we lost against F.C Tyberg in Cape Town. Preparations prior to the game were excellent as always and we had every time in order up until the last minute where we had to drive off to Cape Town with only eleven(11) players due to work, injuries and school exams as most of our players are still students, those who are working could net get time off as it was Friday. There was absolutely nothing we could’ve done to change the environment at that time. I’m glad that was our last game to be played on Friday away this first round. Our next game is against Mitchel’s Plain F.C HERE IN NEW HORISON ON SATURDAY 19/11/11 AT 15HOO. Our last league game were at home was rigorous and we taking initiative to continue with our objective to win all our none games. Letter via the Editor The Library Matters The Western Cape Library Services is a free public service partially funded by tax payers. The visit from Provincial Library Services last week required the library staff to process 900 books, before new books could be made ready to be issued to the public. New procedures now make it necessary to close for a full day. Notification for this delivery of books was placed at the library. The library receives new books three times a year Provincial Library Services must keep library staff updated to ensure a smooth running service to the public. The Assistant Director of Library Services & the Regional librarian who visited for the workshop considered it more economical to hold their workshop at Plett Central Library. Rather than transporting staff to the Regional library in George. There are now six libraries in the Plett area and 17 staff members. The workshop was held at no cost to ratepayers.

I’m grateful to the families who came and supported their children during a beauty pageant on the 4th November 2011 at Kwanokuthula’s hall, not forgetting the judges who took time from their busy schedule together with educators who willingly went the extra mile each and everyday . The contestants were stunning and dead gorgeous but there were only 6 winners from the set of 4 groups of contestants. May we continue the much needed support and make it a habit. We are keeping our doors open for organization grade R leaner's starting this week of November and the space is usually limited so rush ASAP to Bongolethu ECD Centre.

We are looking for somebody can donate us with anything that can help us at our sewing because we doing sewing at St Monica’s church at Kwanokuthula but our problem is that we need material to do something we can sell for this organization. Letter via the Editor Being a long time local, I have been very disappointed in the service delivery we have experienced lately in Plett. We have had to have a few things repaired or installed and it seems that every person or business we have dealt with have either kept us waiting, broken appointments or just plain not showed up at all! We have on every occasion had to keep phoning to ask them to come, and when promised they are coming, we are let down and have to phone them to find out where they are and wait for weeks for someone to actually arrive. There’s always some excuse. Everyone seems to be complaining about not having work and that the recession is bad, but we are literally throwing money at them and they still don’t deliver!! I think everyone needs to pull up their socks, stop complaining about having no work and actually deliver to people who need your services! RE Letter to library from Margaret Gould In reply to Ms. Gould's criticism, here are some facts with regards to the closure of the library on the 7th and 9th November. The library received over 600 books. Five functions taking roughly 10 minutes had to be performed to each book to prepare it for the public. That wouldmean nearly 100 man hours. Therefore it had to be done during working hours. Another 200 books had to be prepared to hand back the George Provincial Library. The training session included a motivation session presented by training staff from George and staff members from all five libraries in Bitou attended the training session. Obviously it also had to be done during working hours. I am sure most library users, unless they have to hand in or take out four books a day, read the newspapers or use the copier daily, would not have been out by the closure. In fact many businesses including banks and supermarkets sometimes open later for training or stocktaking. I have found the staff more friendly and co-operative. Remember, they work with a denanding public every day. So spare a thought for them Delano Cowley

Bryan Wallick—Piano Wednesday November 23, 2011 Bryan Wallick is gaining recognition as one of the great American virtuoso pianists of his generation. He was a gold medallist in the1997 Vladimir Horowitz International Piano Competition in Kiev, and he has performed throughout the United States, Europe and South Africa. He made his New York recital debut in 1998 at Carnegie Weill Recital Hall and in London’s Wigmore Hall in 2003. He studied in New York City under Jerome Lowenthal and was the first Juilliard School graduate to receive an undergraduate Honours Diploma (2000) and an accelerated Masters Degree (2001). Mr. Wallick continued his studies in London at the Royal Academy of Music where he was the recipient of the Associated Board International Scholarship, receiving a Post- graduate Diploma with Distinction. Mr. Wallick’s 2010-11 highlights included performances with the Brevard Symphony Orchestra and the Johannesburg Philharmonic, and he will make his debut in 2011/12 with the Cape Town Philharmonic. Plant for the Planet

Academy at Simunye Centre, KwaNokuthula The Barefoot University Foundation in partnership with Plant -for-the Planet Children Foundation hosted Plant-for-the Planet Academy at Simunye, th Kwanokuthula on the 11 of November 2011. The purpose of the academy was to empower youth with environmental education. Plant-for-the Planet Academy was embraced by the presence of Barefoot University Foundation, Kjell from Germany, the academic facilitators, teachers and 130 students from Bitou schools. The Campaign “Stop talking, Start planting” is a creation of the advertising agency Leagas Delaney, Hamburg to support the important work of the children from the global student initiative plant-for-the-Planet. Giving us the background of Stop talking, Start planting, Jenny Lawrence from Barefoot University Foundation said, everyone loves talking about the climate crisis but talking isn’t going to stop glaciers from melting. Hence, Felix Finkbeiner, the 9 year old boy from Germany decided to take action on the damage happening in the environment. He started talking to schools, world leaders, wrote a book called Tree by Tree and soon will be talking to the World Climate Summit in Durban. Yvette Asap, the school teacher from Raphael Walddorf School offered to give the introductory story to the present guests. The message of the story was that we should plough with respect, sow with joy and reap with gratitude. Kjell played Felix Finbeiners’ video presentation for the guests. He elaborated on the video presentation and also asking

questions from the students and teachers. The students were very interactive during the academy and jenny was impressed to notice the understanding shown by students on environmental issues. The academy consisted of games and exercises, which made students understand how and why CO2 toxic emissions are affecting the climate all over the world. Later, in the day, the groups formulated practical action plans to implement in each school. The aim was to establish Plant-for-the Planet Clubs at each school and to encourage as many learners as possible to be involved in the widespread tree planting. The learners left the academy with a clear understanding of how trees help to mitigate global warming. Statement from the Speaker, Cllr Brummer, in reply to press statement by ANC’s Cllr. Mbali

Please be so kind as to publish the full text of my reply for your readers' edification. Dear Councillor Mbali re: “ILLEGAL ADJOURNMENT OF COUNCIL MEETING.” I am in receipt of your letter dated 1 November 2011, which was apparently hand delivered to my office on 2 November 2011, which has reference. It is not clear exactly who you addressed the letter to and what the actual purpose thereof is. It appears, at the outset to be a complaint against myself for allegedly contravening the Rules and Order. Should that be the case and you feel that my actions complained of constituted a breach of the Code of Conduct for Councillors you should, in terms of the Council's Standing Procedures, submit your written complaint to the office of the Municipal Manager. The second page of your letter, judging by the final sentence, appears to be addressed to me and I will endeavour to deal with that as best I can. You are correct in stating that in terms of Rule 8 of our Rules and Order the speaker has the right to decide when and where council will meet. However, it is incorrect to say that I “refused” to adhere to Rule 48 during the Special Council Meeting held on 26 October 2011. Rule 48 gives councillors a mechanism whereby they can call for a meeting to be adjourned to another date and further regulates the process of doing so by means of Subrules 48 (2) through (7). It also then provides by means of Subrules 48 (8) and (9) procedure to be followed upon reconvening the adjourned meeting. No such motion under rule 48 was moved on the day so I could not have “refused” to adhere to the rule. Unfortunately the question of, whether or not a speaker may adjourn a meeting of his own volition, is not specifically addressed in our Rules and Order. It appears from your letter under reply, that you contend that a speaker can only adjourn a meeting if a motion is moved by a member under rule 48. That is one way of interpreting the absence of a rule dealing specifically with such an eventuality. However, as we have all learned in the councillor training courses, we have attended since being elected, where a rule does not exist or is unclear, we must turn to the common law and case law for guidance and clarity. COMMON LAW. The Learner Guide received by all of us when attending the training course on “Rules of Procedure: Conduct at Meetings of a Municipal Council” specifically deals with unregulated eventualities and how to deal with them. For ease of reference I quote from the above mentioned guide with which you are familiar: “When a specific matter is not governed by legislation, common law usually applies. South African common law is mainly the 17th and 18th century Roman-Dutch law that was transplanted to the Cape. This forms the basis of modern South African law and has binding authority.” [Emphasis added.] “Statutory rules of procedure are not capable of providing for all eventualities that may occur at meetings. Our law therefore requires that the principles embodied in the common law be followed where formal rules are silent.” The following examples illustrates the effect of common law rules on meeting procedures[Where no specific rule exists] The chairperson must preserve order and ensure that the meeting is conducted in a lawful manner. When a meeting becomes unruly and disorderly so that it cannot continue with its business the chairperson may close the meeting. The chairperson may not close a meeting of

own volition. He/she may only do so when mandated by the meeting except in the following circumstancesWhere a meeting becomes unruly; Prior to the taking of the vote; To ensure the attendance of a member whose presence is essential for the conduct of the meeting or the submission of information.” [Emphasis added] Clearly therefore a speaker may under special circumstances adjourn a meeting. As you know, I have on a number of occasions had to do just that when bad behaviour and unruliness in a meeting made it impossible for council to conduct its business in an orderly fashion. Indeed, that was one of the reasons why I adjourned the meeting on 26 October 2011. The second reason was that it was essential that the Acting Municipal Manager remain present to submit information to the meeting in reply to questions already under reply when he was forced to leave the meeting due to the abuse he was subjected to by councillors while trying to impart the information to the meeting. The basis for my ruling can also be found in the above mentioned Learner Guide, as follows: “A world renowned expert on rules of order, procedure and practice in legislative assemblies in the British political system [which greatly influenced the South African scene] made the following observations 'The great principles that lie at the basis of English Parliamentary law.... are: to protect the minority, to secure the transaction of public business in a decent and orderly manner, to enable every member to express his opinions within those limits necessary to preserve decorum and to prevent unnecessary waste of time, to give full opportunity for the consideration of every measure and to prevent any legislative action being taken heedlessly and upon sudden impulse.' These principles are equally important for local government in the present day South Africa and municipalities should be mindful thereof when developing their own rules.” It follows therefore, that speakers should also be mindful of these principles when conducting meetings, which I was. CASE LAW. In addition to the common law one must also consider case law where this is available. Although it is not always possible to find case law where the facts and circumstances match exactly, guidance can nonetheless be found. The Provincial Government: Western Cape and Nelson Mandela Metropolitan University: Institute for Law in Action handbook supplied to councillors at the recently held training courses uses the very question we seek to find a solution to as an example of how case law influences the law and how it must be applied. “Does the speaker have the power to adjourn a council meeting of own volition? The answer to this question is to be found in the constitution of the body which is holding the meeting or, if they exist, its standing rules. This was the view in Makume v Northern Free State District Municipality case. The court found that the municipality did not adopt rules. It consequently followed that the answer to the question had to be found in the common law. The judge then scrutinised various cases and concluded that the common law, as set out in the cases, does not permit the chairperson to adjourn the meeting and in the absence of circumstances preventing the effective continuation of business, it was clearly invalid.” [My underlining] To summarise, if the council's rules and order do not allow a speaker to adjourn meetings of own volition, (as is the case in Bitou) both the common law and case law disallow it, UNLESS circumstances preventing the effective continuation of business exist. Our rules and order does not make allowance for unilateral adjournment, so clearly under normal circumstances the speaker may NOT adjourn the

meeting of own volition. This, however, depends upon the circumstances when the decision is taken. CIRCUMSTANCES. From the speaker's chair I faced the following situation, to which I then applied the above principles, when I took the decision to adjourn the meeting. Several councillors were speaking at the same time and without first obtaining the permission of the speaker to do so. [Rule 27(1) & (2)]. The councillor/s refused to give precedence to the speaker when called to order. [Rule 28] Councillor/s were not addressing the chair but were directing themselves directly to the Acting Municipal Manager and refused to come to order. [Rule 26] Councillor/s were challenging the ruling of the speaker on several rulings. [Rule 24(d)]. Councillor/s repeatedly declined to withdraw an expression when required to do so by the speaker. [Rule 24(e)] Councillor/s indulged in tedious repetition and unbecoming language. [Rule 24(f)] Councillor/s were pointing fingers at the Acting Municipal Manager and verbally abusing him to the point where he had to leave the meeting to protect himself as the speaker was unable to do so due to the Councillor/s involved refusing to abide by the rulings of the speaker. [Rule 24 (1) (a), (b) and (d)]. Councillor/s refused to abide by the ruling of the speaker on points of order and explanation. [Rule 44(1)] Councillor/s behaved so badly generally, and specifically towards the Acting Municipal Manager, that he had to leave thereby obstructing the business of the meeting. [Rule 24(1)(a),(b) & (c)] Councillor/s prevented the Acting Municipal Manager and the stand-in Secretary of council from speaking, despite the fact that they had been requested to take part in the meeting by the speaker in terms of Rule 2(2) and that their participation was vital to proper proceedings. [Rule 24(1)(a), (b), ©, (g), Rule 44(1)] Clearly the misbehaving councillors had no intention of abiding by the rules and order and/or the directions of the speaker making it impossible to conduct an orderly meeting. The circumstances were therefore such that the effective continuation of the business of the meeting had become impossible, and adjourning the meeting at that point was perfectly lawful under both the common law and case law. With regard to your demand that the meeting be reconvened “within 48 hours” I am afraid I must advise that this cannot be acceded to. The meeting has been scheduled to reconvene at 09:00 on Thursday 10 November 2011, in the council chamber. In the interest of clarity, please note that Section 29(1) of the Municipal Structures Act, 117 of 1998, confers the power to call meetings upon “a majority of councillors.” “29.( 1 ) The speaker of a municipal council decides when and where the council meets subject to section 18(2). but if a majority of the councillors requests the speaker in writing to convene a council meeting, the speaker must convene a meeting at a time set out in the request.” [Emphasis added] I trust that the above adequately addresses your questions regarding the legality of the adjournment of the council meeting on 26 October 2011. Notice of Road Closure The Prince Alfred's Pass is closed until 30 November 2011 on weekdays from 8h00 until 15h30. This closure is applicable on the section between de Vlugt and Avontuur. The road is closed due to resurfacing and the section from Knysna and Plettenberg Bay is not affected. An alternative route via Speelmanskraal will be indicated to road users by traffic control. Letter via the Editor Rhodie / Zimbo Pensioners. The braai held at 139 Longships last Friday was a great success. In spite of the wind and rain we had an attendance of at least 70. The grand sum of R10,000 was raised with some promised donations still to be added !! Well done everyone…..we are always amazed at the generosity of you all , especially at times like these when the economy is down and everyone is battling. Everybody seemed to agree with the idea of using the money for some of our desperate fellow countrymen living in this area, rather than send it as before to the pensioners in Zimbabwe. There are a number of groups collecting for the latter and we feel that there are many worthy (and desperate) pensioners down here who need the help. We will be opening a special “Flame Lily” account for the money and will form a committee (any volunteers ??) to distribute where it is most needed in this area. We have had some suggestions from various people as to who they feel may be worthy recipients, but we feel that as we are “giving away” other peoples monies, it must be done properly with insight and sensitivity regarding the particular financial circumstances of some of our dear ex Rhodie/ Zimbo pensioners living in this Garden Route area. Serious thought must be given to whom needs help most . Please feel free to offer any advice or ideas.
