2nd letter from the Mayor

Wow! What a response to my newsletter. I don't know how to even start thanking all those many, many people who have expressed their support and offered their skills and time to assist with the task of once again making Plettenberg Bay and the Bitou Municipality something to be proud of. Thanks everyone! Before sending out last week's newsletter, I was afraid that the bad news, which I felt I had to convey, would have a negative impact on our town's struggling economy. What was especially worrying to me is that by revealing the extent of our financial and governance problems – (Yes, I'm saying problems and not challenges) –it would scare off potential investors and creditors to the detriment of our town's economy. It appears, however, that people want to know the truth, and they want to know the whole truth, bad as it may be. But fortunately it is not all gloom and doom. There are some very bright spots as well. So I'm going to divide my newsletters into two parts from now on, the Good News and the Bad News. GOOD NEWS. Amongst all the gloom and doom of fraud, corruption, maladministration and mismanagement in many of the departments, the Water and Sewage department showed us all that, even under the most terrible conditions that the municipality has worked under for years, a department and its people can overcome the general collapse in standards and service delivery and still shine. Not only do they shine, they deliver potable water and discharge waste water at a standard far exceeding the average standards in South Africa, and they deliver service comparable with the very best in the world! They have achieved this without massive expenditure and have done so Quietly and efficiently. They just put their heads down and did the work at hand. Well done all those involved! MORE GOOD NEWS. We are starting, with the help of the Acting Municipal Manager, Duppie du Plessis, to get a better idea of where we actually find ourselves as an organisation, especially with regard to our financial status. It is still a surprise-a-day as things emerge. I will share some of these with you under Bad News. I have met with the MEC for Local Government, Anton Bredell, and he has agreed to provide expert assistance in the fields of Local Government, Human Resources and Town Planning. We are already receiving extensive legal assistance and this will continue .The really good news in this is that it means we do not have to pay consultants to do this work. It could save the municipality several million rand in the long term. We are also to receive similar assistance with our financial management. Bad News. Where to start? Financially we are in dire straits. It overshadows everything and dictates every decision we take. But more about that lower down. LEGAL WOES. Please note that what follows cannot be taken to be the official standpoint of the municipality or to have any legal significance. It is simply a layman's understanding of some pretty complicated legal stuff. As the legaleagles say, it is entirely WITHOUT PREJUDICE. We walked into several legal wrangles which we have had to try to deal with as best we can, always

keeping in mind that we have to limit costs. Almost immediately we found that the municipality was involved in all kinds of expensive litigation apparently without good reason or prospects. SUPREME COURT OF APPEAL APPLICATION. The suspended Municipal Manager and the Bitou Municipality had sued me and my attorney for defamation (R300k each) in the High Court in Cape Town. This despite the fact that it is well established in the common law and case law that a state or state department and /or official cannot sue for defamation. Several hundred thousand in legal costs later, the Deputy Judge President of the Cape High Court, Judge Janet Traverso ruled against them with costs. They then applied to the High Court for leave to appeal a very clear judgement coming from the second most senior and highly respected judge in the Province. Leave to appeal was denied with costs. Still the spending did not stop. They then proceeded with an application for leave to appeal to the highest (and most expensive) court in the land, the Supreme Court of Appeal in Bloemfontein. That is where this council found the matter. It was a ridiculous state of affairs and council had to take a decision to stop the process before more money went down the drain. As you all know, however, Council was prevented from doing its work and by the time we were in a position to take the necessary steps to stop the process it was too late. On 1 August the application was turned down, again with costs awarded against the municipality. Apart from all the money already wasted, this means that the municipality will now also have to pay my and my attorney's substantial costs. We will try to limit these costs as far as possible. If it is found that this whole futile exercise amounted to fruitless and wasteful expenditure, the municipality is compelled by law to recover the money from those who authorised the expenditure. CIVILS 2000 ARBITRATION. In short, Civils 2000 is the contractor who rebuilt Main Street. In the process it appears that the project was not properly managed and many changes and additions to the original plan were made during the process. This gave rise to additional costs, eventually totalling in excess of R4m, being claimed against the municipality. Drawn-out preparations for arbitration to take place this week ensued. When we eventually managed to recover the working files from the firm of attorneys representing us, it turned out that, to put it mildly, the process had not been handled as well as it could have been and that we were essentially in a hopeless position going into the arbitration hearing. Late on Friday afternoon, the attorney who had taken over the case at the last moment, John Gillespie, and our Counsel in Cape Town, managed to pull the proverbial rabbit out of the hat. They managed to negotiate a settlement at R1.455m. That is less than half the original claim. The additional saving on three day's arbitration hearing is enormous. TENDERPRENEURS AND PAVING BLOCKS. We have suspected for a long time that our procurement processes were being flouted and that tenderpreneurs connected to the previous regime and officials were siphoning millions out of the municipal coffers. We were,however, always prevented from obtaining hard proof. Now we find proof of this all over.

A local supplier has started recovery of road-building materials and concrete pavers used on three road building projects, mainly in Kwanokuthula. The contractor had bought the material on account and agreed that the supplier retains ownership until paid in full. The contractor defaulted and the supplier is now entitled to recover all the material supplied unless the municipality pays up. Needless to say, the tenderpreneur has already been paid by the municipality. It appears that the total amount involved is in excess of R500k and it is highly unlikely that the tenderpreneurs involved will be able to pay. The total damage to the municipality will of course be far higher as all the work already done will be destroyed in the process and will one day have to be redone. In the meantime those who were supposed to benefit will be left with a mess. One must of course also have sympathy for the supplier who finds himself with a huge irrecoverable debt which must impact severely on his business especially in these times where the building industry is in the doldrums. We have to try to avert this disaster and will keep you informed of our progress. So what is next... I could go on, but suffice it to say our debt continues to rise and we will deal with it: We are scrutinizing every expenditure and concentrating our resources only on our core responsibilities, as set out in the Constitution. We cannot continue to fund projects that are the responsibility of provincial or national departments, such as education or child development; nor can we fund unfunded mandates. We have to stop all donations by the municipality – we cannot give away money we don’t have. We cannot use municipal money for other than strictly service delivery for the foreseeable future. With the help of experts we will determine the budget we need to work within, and then we will work within that budget. More about this in my next newsletter. You asked for truth and transparency and that is what I will give you. Please do not pay heed to the many rumours currently circulating. We know that there is an SMS doing the rounds saying that we have dismissed 100 people. This is not so. If we could have our way we would not dismiss a single person. Sadly the way things stand it is inevitable that there will be some job losses, but we will limit these as far as possible. Again, thank you for your over-whelming interest and support. Africa to send troops, food parcels to UK as riots spread

ETHIOPIA. The African Union today adopted a unilateral resolution to deploy army troops and care packages to England as looting and violence spread from London to other major cities. Spokesperson Charity Khumalo said “We can no longer stand by while these savages tear themselves apart.” The AU, meeting today in an emergency session to discuss the ongoing rioting in the UK, has declared that they will do “everything in their power to help bring civilisation to England”. “It’s just so sad, you know?” said Khumalo, speaking from the organisation’s HQ in Addis Ababa. “Sitting here and watching them on TV while their society implodes. The Santa Shoebox Project

is a non-profit organization that collects Christmas gifts for the socially disadvantaged children throughout South Africa, by way of a social and community network of families, friends, schools and churches. Established in 2006, it is an initiative of the Kidz2Kidz Trust, a registered Public Benefit Organization (PBO number 930031301 - Public Benefits Organization Kidz2Kidz Trust), that offers assistance to children in need. The Santa Shoebox Project is instrumental in involving people from all walks of life, especially children together with their parents, in giving to children from a distinctly vulnerable social background who may never have received a Christmas gift before. In essence it is therefore also about children learning the joy of giving, by personally choosing and filling the gift boxes, and then decorating and labelling each with the recipient’s name. Uniquely, the donor knows the first name, age, gender, and care institution of the child the gift was bought for. The Santa Shoebox Project not only manages the network and distributes the gifts, but also provides content guidelines for each individual gift box, to ensure that every child receives an age appropriate gift. Typically this will comprise of some practical necessities, such as toothpaste and toothbrush, face cloth and soap, as well as some sweets, educational supplies, a toy and an item of clothing. Many people have a desire to contribute to their community or do their ‘little bit for charity’, but often don’t know where to start. The Santa Shoebox Project takes pride in channeling all that positive energy and goodwill into something that is credible, achievable, makes a real difference in a specific child’s life and leaves the donor feeling really good about him or herself. Spearheaded by Kidz2Kidz founder Dee Boehner and coordinated by Irenè Pieters since 2007, the project has grown in leaps and bounds. It started in Cape Town (in 2006) with 180 Santa Shoeboxes, and grew to 2000 in 2007, 8000 in 2008 and 16 000 in 2009. In 2010 the project again more than doubled in size to close on 32 000+ Santa Shoeboxes, which

The waters were lapping against the mountains. it was a clear day. the bounty was plentiful. Cape Buffalo, Zebra and Elephants mingled with Bushbuck and swarms of waterfowl everywhere one looked. A Cape Mountain Lion roared and the roar echoed down the kloofs. it was Robberg, the priapism of a peninsula and the place known as the Spear into the Sea to the End of Earth. There was an ancient clan Elder, whose sun-withered and time-parched skin sagged with wisdom and experience, and whose speckled piercing kind eyes told many stories without words. He was called "Oyster-catcher" for his love of oysters and deftness at finding them. Shellfish. The initial abundant basic protein that gave genesis to our human brain and its capacity. The staple food of the strand-loper or beach-comber. The alikreukel, limpets, perlemoen, clams, mussels and oysters and even sea urchins if necessary; so tasty and nutritious. Oystercatcher decided to sit back and rest in the shade of the cave near the midden he and his forebears had used for generations, as the building pile of calcified discarded shells showed. he carefully placed his fishing spear nearby in its customary place; for it was an heirloom that was renowned in the clan. He scanned the familiar vista before him. There on the shore was the familiar colour -spectrum of the beauty of nature: a myriad of water fowl, ungulates, antelope and other

creatures in all shapes and sizes. Endless blue water that could not be drunk stretching to the waking and sleeping place of the sun. There cavorting in the frothy sea were the mystical animals, like salt water hippopotami or voluminous pachyderms; those that blew smoke like steam into the air. They seemed to talk to the sky, eyeball the sun with giant leaps of spray, and greet it loudly with fluked tails. He somehow felt a kinship, an ancient primordial sense of co-existence and non-threatening mutual awareness with them. There were rumours that when the elephants sang in their deep distant voice, that the "salt-elephants" heard them and were heard to reply. Some of the sage shaman of te clan had reconted they could feel or perceive the ancient language and participate in the converstaion. When a new shaman was initiated or clan chief chosen, they had to perform a duty. A test of courage and bravery, skill, yes. but also a sign that they were favoured. When the moon lowered the sea, they had to swim out to the great rocks of the sharp point that ended the land, the rocks named for the sea-elephants. It was indeed brave, and perlilous. And very cold. There their task was to talk with the sea-elephants. It was said that a true shaman could look into the eye of the creature and bond with it. That they would stare at each other and speak without sounds. A sharing of the beauty and harmony of life. For here was it thus; a balance in harmony of the five elements. And thus for the people, the whales were as sacred as the Eland. A few times in his long life time they had washed upon the shore-line. There were times when all the people had tried to push the leviathans back to the ocean, thanking

Our Michele is the US Surf Ski woman Champion!

Michele Eray won the woman’s US Surf Ski Championship in San Francisco on Saturday! There Was an international field of top paddlers including racers from South Africa, Australia, and the United States. The race follows a 17 mile course that takes paddlers from Fort Baker in the Golden Gate National Recreation Area, under the Golden Gate Bridge, and west along the rugged Marin Headlands to Point Bonita. Racers turn and proceed to the finish line at OSCS Sailing at the Berkeley Marina. The beauty of the course is matched by the challenging conditions, including strong winds and currents and large waves which are expected to test the endurance and water skills of the most experienced competitors. The US Surfski Championship is part of the International Surfski World Series. Dawid Mocke dominated the US Champs, while Michele Eray overcame the pain of an arm injury to take the women’s title by over 11 minutes! Dawid Mocke(SA) defended his title, and Michele Eray (SA) won in her first try at the US Surfski Championships on Saturday. Matt Bouman and Sean Rice (SA) rounded out the top three for the men, and DeAnne Hemmens and Kristen Podolak where 2nd and 3rd for the women. I stayed at Carter Johnson’s awesome houseboat in the Sausalito area for the first few days. Carter has to go down as the World’s Best Host. Not only did he move out of his own house so that we could all crash, he even arranged a cool chef called Texan Tom and his wife Sandy to make us unbelievable French Toast for breakfast. So far the trip has been great, ran up onto Golden Gate Bridge, then paddled underneath it! Serious current that. Did I mention it’s cold? This wind can freeze your bones! We checked out a very cool hippy town called Bolinas, tasted many local beers (the whole microbrewery industry here is massive). Now I am at race HQ in Berkeley, staying with Michael and Boris from Nelo USA. They have one SERIOUS truck. Now I am waiting to go to the start at Fort Baker, looking forward to catching some runs. I picked up some tendonitis in my wrist just before I flew out here, pretty bummed as I have had to sit out on all the paddles. It is still pretty sore, however I have been fortunate enough to see Scott Kelly, physio legend! So hoping for a

Could anyone please advise to which Charity this money is being donated? Surely the Management should advise the public that this month they donated X amount to X charity and so on. At a later stage digital thermometers were purchased and donated to all the public health care services, this time 13 in all, reported in What’s New. Those were the donations for 2010. If the writer has a specific cause that she feels deserves assistance, and serves ALL sectors of the Bitou community, she is more than welcome to put forward a request and we will consider her cause when funds are available. Press Release by the ANC

Yet again, the DA has shown that it is not fit to govern the municipality of Bitou. They do what they always do best, run to the media for protection when they fail to make political impact where and when it matters the most. Right on the hills of Johan Brummer’s lengthy but politically naked letter to the newspapers, Memory Booysen has joined in. Like Brummer, Booysen’s letter is full of inconsistencies and contradictions. In an attempt to justify their decision to bring provincial personnel to this municipality, the DA claims that the ANC and senior managers plotted their failure. The senior officials are accused of not cooperating with the DA-led Council. This is far from the truth. Booysen says that the suspension of the Municipal Manager, Mr Lonwabo Ngoqo, was prompted by the DA’s desire to deal with lack of cooperation from the senior managers. By inference they are still going to deal with other senior officials. This is not surprising as the DA has been calling Mr Ngoqo, the ANC Municipal Manager. What they don’t tell the public is that Ngoqo was appointed by full Council without any dissenting voice. So, he can’t be said to be ANC Municipal Manager as the DA has been claiming. The ANC has not and will not use any official to fight its political battle with the DA. We are capable to do that on our own and that is what we will keep doing. It is interesting that Booysen has the temerity to assure the ratepayers that the municipality will not bear the costs of the court case initiated by the DA. From what we know, only the court can make a decision as to who must bear the costs. Unless the DA wants to tell us that the case has been concluded. The DA has for a long time been telling everybody that there is wide-spread

We also approved the creation of a new CBD in the Ladywood area. It is no secret that the DA was opposed to our building the Main Library in New Horizons. We will not be surprised if they can turn that building into a white elephant. The DA is opposed to opening the town for middle income housing projects thereby fighting to retain racially segregated residential planning. These are the things the DA must tell the people if they are going to be implemented or not instead of picking up on Women’s Month events as if that were of our main concern. In his letter, Booysen says they decided to disarm the law enforcement officials because they have received complaints. He doesn’t say after investigating complaints against the officials. And this is at the heart of the DA rule. Anybody can go and make allegations against any official and the DA will not investigate but act against that official. But the truth is that the law enforcement officers are being punished

because Brummer calls them “ANC goons”; and some of them share girlfriends with senior DA leaders. So, those in power misuse their power to settle lovers’ tiffs and crushes. This is bringing a new phenomenon in politics of this town. Booysen can’t complain about “bad press” image. The ANC never went to the press to bad mouth the DA. Not in the past, and not now. They are the ones who had been using the media as their unofficial councillor. Am I the only person in Plett that has heard of a proposal for a new 104 bed hotel to be built on the lagoon? ONCE MORE...an appeal to the Bitou Council to improve the markings of the many pedestrian crossings in the Main street. To obliterate some of them would do no harm. A few weeks ago I wrote about the same subject and the fact that according to law our crossings are not legal due to lack of signs indicating to the driver the approach to a crossings. Last Saturday I was one such driver. As approached the crossing opposite the First National bank a pedestrian suddenly appeared from behind a car parked over the painted stripes indicating the start of the crossing. Fortunately I managed to stop before causing bodily harm, I did however receive a tongue lashing accompanied by some known finger gestures. Heaven forbid if I had injured the person. Besides the costs and time wasted trying to vindicate myself, if the worst had happened, the Bitou Municipality would ultimately have been responsible. Having been involved in my capacity as community liaison officer during the upgrading of the Main road I was very aware of all

NOTICE: BITOU MUNICIPALITY APPLICATION FOR BENEFICIARIES: VEGETABLE ALLOTMENTS & PIG PRODUCTION SYSTEM: FARM HUYSOORD – WITTEDRIFT Interested persons (families) that are willing to become beneficiaries for farming of vegetable allotments, and or Pig Production Systems at the Municipal Farm Huysoord in Wittedrift are hereby invited to submit their names and details to the Traffic and Law Enforcement Office situated in Marine Drive Plettenberg Bay. Applicants will be scrutinized and selected in accordance with the following selection criteria. Tenants Selection Criteria: Tenants must be aged between 18 – 65. Sufficient training knowledge or experience to utilize the opportunity and a love for vegetable gardening or pig production is not required, but would be strongly advised. Tenants must live permanently within easy cycling or walking distance from Wittedrift. Tenants should be South African Citizens. Tenants must be in good health and able to do a full day’s physical work outside. Married persons, and those with larger families to support would receive preference. Tenants should not have a permanent employment. Tenants should not be government employees. Tenants should not be councillors or political leaders. Tenants should have an existing vegetable garden or adequate knowledge of gardening activities. Preference will be given to tenants whom are already in possession of pigs. Our fundraiser this month is the movie "Jock of the Bushveld". This will take place on Saturday, the 29th August at 13h00, at the Plett Movie House. The cost of a ticket is R100.00, which includes fabulous lunch platters and drinks. Tickets are available from the charity shop and Marine Way Animal Hospital. All funds received will be used for spays in Kwanokuthula. We urgently need to continue to sell "ZUKI - The life of a Pitbull". Funds received from sales of this booklet are used purely for cash rewards, for information leading to arrests for dogfighting.
