California’s New Laws 2023

Pricing protections, reproductive / healthcare rights, and minimum wage changes

California—There are about 23 new state laws which will take effect January 1st, 2023, and many of these new laws have been in the works for years. Some of the new laws going into effect were formulated as a result of the nation’s elections, the overturning of Roe v Wade by the Supreme Court, and California’s fame for being a sanctuary state.

The state’s presidential electors will be casting ballots for the candidates that win the popular vote, and Senate Bill 103 ensures these electors don’t change the candidates or abstain from voting.

The state will find suitable land for construction with the passage of SB 561, which will require an audit of all the surplus state property.

SB 107 helps create a sanctuary state for transgender health care, and will help shield youth and their parents from legal action occuring from states with restrictions.

Reproductive healthcare will be protected through several measures, and California will participate / cooperate with other states to share reproductive information. Other measures will boost the education for training for abortion providers and will protect individuals from civil liabilities. And, AB 2223, called the Contraceptive Equity Act, will protect employees from discrimination based on their reproductive health choices, including using contraceptives.

The safety of bicycle riders is being enhanced with AB 1909, which will allow bikes to cross streets on the pedestrian signals, and it requires drivers to change lanes when

safe and possible, to pass bicyclists.

California is changing who can own a firearm, and now with AB 2239, any person convicted of misdemeanor child or elder abuse on or after January 1st, 2023, is prohibited from possessing a firearm in California. This law joins the current status, anyone convicted of felonies or certain misdemeanors, is prohibited from owning guns in this state.

Assembly Bill 1949 makes it illegal for an employer to not grant bereavement leave for up to five days for an employee, for the death of a family member.

For law enforcement, SB 960, will allow individuals who are not citizens or a permanent resident of the U.S. to become police officers in the state. Now, these individuals only need to be legally authorized to work in the U.S.

It is now illegal to sell or make clothing or products out of animal fur in California (AB 44).

Covid-19 workplace measures will continue for the next year, through Assembly Bill (AB 2963), and now doctors who spread Covid-19 misinformation will be more easily taken to task with the California Medical Board, through AB 2098.

Pay raises, minimum wage increases from $14 an hour to $15.50 an hour, which was decided in 2016 by SB 3, and now SB 1162 ensures salary transparency for available job

Supervisors Meet with New Senator

Members of the Inyo Board of Supervisors and key staff had a chance to meet last weekend with newly elected State Senator Marie Alvarado-Gil to discuss issues and challenges affecting Inyo County.

Senator Alvarado-Gil stopped in Bishop last Saturday as part of a goodwill/fact-finding tour of California’s sprawling 4th District, which also includes Mono, Amador, Alpine, Calavares, El Dorado, Mariposa, Madera, Merced, Nevada, Placer, Stanislaus, and Tuolumne counties.

The Senator began her visit with a tour of the Bishop Airport courtesy of CAO Nate Greenberg, Assistant CAO Meaghan McCamman, and Deputy Public Works Director Ashley Helms. According to Greenberg, the airport was of particular interest to Senator Alvarado-Gil because it is one of only a few airports operating commercially in the entire 4th Senate District.

The afternoon included individual visits with Supervisors Kingsley, Roeser, and Griffiths, during which the local officials had the opportunity to discuss everything from economic development to infrastructure to connectivity for isolated communities of Inyo County. Senator Alvarado-Gil also spent time with City of Bishop Administrator Deston Dishion and members of the Bishop City Council.

The visit culminated in a public meet-and-greet during a posada at the Tri-County Fairgrounds hosted by the Inyo-Mono Cattlewomen.

Board members expressed gratitude for the chance to discuss areas of concern and for the engagement from the Senator.

“We appreciated the opportunity to visit one-on-one with our new state legislator,” said Vice Chairperson Jennifer Roeser. “Opportunities like this are rare, but crucial to rural counties like Inyo County. The Senator’s proactive engagement was a breath of fresh air and a very promising start in our relationship moving forward.”

Mammoth Lakes Recreation (MLR) has announced that it has been awarded $1,460,000 from the Sierra Nevada Conservancy (SNC) for its “Sherwins Trailhead” and “Sherwins Area Trails and Trailhead Expansion” projects.

Both projects are located on Inyo National Forest (INF) land in the wildland-urban interface with the Town of Mammoth Lakes (TOML). The mixed conifer forests, iconic vistas, and many recreation offerings make these projects a great opportunity to improve access from the Town center and Mammoth Creek Park, where the TOML is currently constructing a Community Recreation Center (CRC) and mobility hub, to these many extraordinary natural resources via the trailhead and proposed interconnected trails.

SNC awarded $950,000 to MLR to implement the shovel-ready plans for a trailhead facility off Sherwin Creek Road. The Sherwins Trailhead will create a seamless, integrated recreation experience for locals and visitors of the Mammoth Lakes Area and protect sensitive archaeological sites and habitat by defining and developing the trailhead. The current site has become a de-facto trailhead for a wide variety of recreation uses including hiking, mountain biking, equestrian use, dog walking, snowplay, snowmobiling, Nordic and backcountry skiing. Partnering with INF and the TOML, the trailhead facilities will include ADA accessible vault toilets, paved parking area, interpretive panels, bike rack and tools, waste receptacles, and bear-proof storage containers.

MLR has also been awarded $510,000 as a planning grant for 20 miles of proposed trails in the Sherwins and expansion of the trailhead. The Sherwins Trails and Trailhead Expansion Project will serve people accessing the Sherwins, Mammoth Meadow, Mammoth Rock Trail, and the Mammoth Lakes Basin. The current site-conditions indicate the need for a sustainable public trail system, as evidenced by several user-created trails, erosion and degradation of sensitive habitat and an abundance of archeological resources in the vicinity. The existing user-created trails intersect riparian areas and archeological sites, are prone to erosion, and have no regulatory or wayfinding signage.

MLR, INF and the TOML will partner in the project to perform environmental analysis on approximately 20 miles of multi-use/non-motorized trails, an expanded paved parking area, an ADA accessible picnic area and shade pavilion.

“This is precisely the lane that MLR was created to operate in,” said Craig Albright, MLR Board President. “Providing guidance, prioritizing projects, and leveraging the tax revenues of Measures R and U to enhance the Recreational, Arts and Cultural experiences in Mammoth Lakes for both our citizens and visitors alike. Kim Anaclerio is doing great work and the MLR Board is blessed to have her skill set getting things done for the betterment of our town.”

Both projects will enhance and integrate into the existing Mammoth Lakes Trail System (MLTS) within the Town’s municipal boundary, as well as the several hundred miles of wilderness trails originating from the Mammoth Lakes Basin. The trailhead and trails connect regionally, allowing access to internationally renown Yosemite National Park, Kings Canyon Sequoia National Park, Devils Postpile National Monument, several congressionally designated Wilderness Areas, and the John Muir, High Sierra, and Pacific Crest Trails.

Retail theft problems are being addressed with AB 1700, which sets up a website to officially report stolen goods to the state’s Attorney General, and then AB 2294 allows law enforcement to hold those individuals in custody if they are accused of being a part of an organized retail theft scheme.

Immigration status in the state’s courts will remain prohibited / undisclosed, SB 836, in an open court in a criminal case, by either party, unless allowed by the judge.

It’s no longer legal, with AB 1287, to charge more for women’s products than men’s items (such as charging women more for their “pink razor / shaver” than the “black razor” for men). Called a “pink tax,” women in California won’t be subjected to gender-based pricing anymore.

California’s food packaging can’t contain PFAS (Perfluoroalkyl and polyfluoroalkyl chemicals / substances), and AB 1200 prohibits the sales of foods packaged in PFAS.

California’s AB 1594 will allow the state attorney general, local prosecutors, and basically anyone harmed or who suffered gun violence in California, to sue the gun manufacturers.

The state will attempt to ease homelessness with AB 2011, which will help with housing production by turning empty or unused spaces (for example, an empty retail store) into housing starting in 2024.

Six counties (Tuolumne, Glenn, Orange, Riverside, San Diego, and Stanislaus) will initiate the CARE Court, SB 1338, which will provide mental health care for those who have been court-ordered, and who are unhoused, and who are severely mentally ill. By 2024, the rest of the state must implement this law / system.

The “Feather Alert System,” designed to be similar to the Amber Alert System, will go into effect for missing indigenous people who have gone missing “under unexplained or suspicious circumstances.” (AB 1314)

Old legal convictions / criminal records, for non-violent or non-sex-related offenses, will now be allowed to be sealed permanently. (AB 731)

Three new state holidays join the list: June 19 is Juneteenth (AB 1655); April 24 is Genocide Remembrance Day (AB 1801), and the Lunar New Year (AB 2596).

COMMENT PERIOD STARTS FOR NEW STATEWIDE FIRE HAZARD SEVERITY MAP

The State Fire Marshall has released the much-anticipated Fire Hazard Severity Zone (FHSZ) map and has begun a public comment period for the regulatory process. The FHSZ is a comprehensive map that ranks California’s State Responsibility Area (SRA) – or rural, unincorporated areas – based on the likelihood different areas will experience wildfire.

As expected, the new map shows increased fire hazard, reflecting California’s increase in wildfire occurrence and severity because of many factors, including a changing climate. The map has been updated to more accurately reflect the zones in California that are susceptible to wildfire, to help provide transparency for planning and preparedness efforts, and to provide communities a forecasting tool so that the public can take steps to prevent and prepare for wildfire. The hazard mapping process incorporates local climate data and changes in burn probability based on recent trends in fire occurrence.

A few key issues:

• This current revision only updates areas in California’s SRA. This does not include cities or large urban areas.

• This process does not change rules or requirements for homes or properties in these areas related to wildfire prevention, preparedness, and mitigation. The same requirements will remain regardless of whether a particular area is reclassified or not.

• County meetings scheduled for public review. These maps are being shared for your comments and questions during the regulatory process. Information on the public hearing process and hearings can be found on CAL FIRE’s website.

For individual homeowners, please search your address using a new FHSZ Viewer at osfm. fire.ca.gov/FHSZ.

Public comment for this proposed action is open through February 3, 2023. CalFIRE will host an opportunity for in-person comments and questions on January 24, 2023, at 11:00 AM at the Inyo County Administration Office located at 224 N. Edwards St. Independence, CA 93526.
