Publication: During the Probate process the attorneys will need to publicize the property for a duration of time to give any heirs or interests to claim their interests and or contest their interest in the property.
Contesting: If an heir or other interests contest the sale or their share of interest that could prolong the probate process and could take longer to settle.
FiduciaryDuties: If a party to the Probate thinks the appointed administrator is not performing their Fiduciary Duties to the Estate, it can be brought before a judge to have them removed and a court-appointed administrator put in place.
Stipulations: The judge or parties may stipulate how the property will be sold ie. How much money to sell property, terms such as no sales to family members or it cannot sell below a certain dollar amount, no corporations or LLC can take title to the property.
