THE international com munity continues to mourn the passing of Queen Elizabeth II on Septem ber 8 at Balmoral Castle in Aberdeenshire, United Kingdom. I am taken aback that some are expressing shock that a 96-year-old has died. She was four years short of the century mark. Born in April of 1926 to the late King George VI and Queen Elizabeth, Elizabeth II’s seven decades as Queen of the United Kingdom and the Commonwealth of nations is being touted as the longest of all the other British monarchs. To underscore the signifi cance of her lengthy tenure, Queen Elizabeth II began her reign in 1952 --- one year prior to the formation of the Progressive Liberal Party (PLP) and 15 years prior to Majority Rule and 21 years before The Baha mas achieved independence from her nation. At the time of her transition, The Bahamas, Grenada, St Vin cent and the Grenadines, Jamaica, St Kitts and Nevis, Papau New Guinea, St Lucia, New Zealand, Canada, Belize, Solomon Islands, Tuvalu and Aus tralia were still members of theWhenCommonwealth.former Prime Minister Hubert Ingraham read Governor General Sir CA Smith’s proclamation of King Charles III being our new monarch in Parlia ment Square, the response throughout The Baha mas was ho-hum to say the least. to persistent rumours of scores destitute families living in dilapidated apart ments throughout the city. There are also rumours of homeless people living in the International Bazaar. It is that bad in Freeport. Nobody wants to talk about these Bahamians who have fallen on hard times because it is too embarrassing.Proclaiming a new British monarch means nothing to Bahamians who are debat ing whether to defer paying this month’s rent or buying much needed groceries or trying to find a place to bathe and sleep. Queen Elizabeth II appeared to be a down-to-earth indi vidual who connected well with those in her pres ence. We can celebrate her many accomplishments without forgetting the fact that during her 15 years as head of the colony between 1952 and 1967, there were no colleges or universi ties and only a handful of high schools in The Baha mas. Government High is where privileged Bahami ans attended. Also, the Out Islands were undeveloped. It had to take a Black PLP government to right this wrong -- a pressing matter that could’ve been easily addressed by Buckingham Palace with a simple stroke of a pen. But I digress.

In today’s Tribune Business section, Fidelity Bank chief executive Gowon Bowe has warned that the government should “naturally expect the criticism” after a delay in launching its RISE programme.Thegoal of the programme was to help out those most in need after the government changed its approach to VAT.On coming into office, the govern ment reduced VAT across the board to ten percent – but removed the exemp tion on breadbasket items.

Over on the other side of death she is just, to use the words of C S Lewis in The Lion, the Witch and the Wardrobe, a daughter of Eve who will have to give an account of her life and reign to the King of Kings and Lord of Lords. She will be treated no dif ferently than the vagrants who loiter on Bay Street. As the titular head of the Anglican Church, I sin cerely hope that she made the right decision in obey ing the gospel of Jesus Christ before her transition, considering that she was afforded a privileged exist ence that the overwhelming majority of humanity can only dream of having. SUCH a short time ago we lost our Sovereign Queen - Queen of The Commonwealth of The Bahamas - monarchists will mourn anti-monarchists will see an opportunity to lobby - push for the removal of the Sovereign as Head of State to a Democratic Republic like the majority of the Commonwealth of Nations.Partypolitics for sure the PLP has always wanted the removal of the sovereign and there will be no doubt with the 50th anniversary coming up next year their lobby will strengthen and suggest it might be appro priate to take the issue to The People in referenda and see their decision this will divide.

On one hand, we have the delays in implementation of social services sup port for those in the greatest need.

Now, of course, there will be lots of political noise around such a situation – but the solution is simple. In her speech, Lizzo said, “When I was a little girl, all I wanted to see was me in the media. Someone fat like me, Black like me, beautiful like me.” This is a common dream. May people in entertainment longed to see themselves on television screens, album covers, and billboards. Some of us have young people in our lives who have more role models who look like them than we ever had at their age. We see the way they think and all they dare to try, and we know that they believe they can, at least in part, because they are seeing it done in real time. Representation matters, and sometimes we get it in parts. We may see a woman, but not a Black woman. We may see a Black woman, but not a fat Black woman. We want to see more of ourselves. It not only lets us know that we are not alone, but that we can. We can do what ever we see people who look like us doing.

The increased revenues were driven by the economy’s re-opening, and the end of lockdowns and other restrictions such as curfews, which the Davis administration has sought to take credit Meanwhile, for.Mr Thomp son tried to link the fiscal performance to inflation and the cost of living crisis, arguing that “life is not better for most Bahamians” due to high food, gasoline and energy prices.

The Ministry of Finance figures will likely be seized upon by the Opposition to mount renewed attacks, even though $11.8m is relatively miniscule when compared to the Govern ment’s $3bn-plus spending for the 2021-2022 full year. However, given the magni tude of The Bahamas’ fiscal crisis, every dollar counts, although it is unclear how much of the travel spend relates to the Minnis admin istration which was in office for the fiscal year’s first twoand-a-half months.

Mr Bowe also reiterated previous calls for more indepth Budget analysis that identified areas of strength and weakness, and the gov ernment policies that are both succeeding and failing,

so Bahamians and other observers can have greater understanding of why this is so as well as help to achieve the necessary adjustments.

for the 12 months to endJune 2022. “Spending on the use of goods and ser vices widened by $19.8m (3.2 percent) to $633.4m, relative to the same period in the prior year. This accounted for 93 percent of the annual budget,” the Ministry of Finance said.

While the Government has argued that the rate cut, from 12 percent to 10 percent, has reduced the overall tax burden for Bahamians since it is spread across a broad range of VAT-able goods, it has also increased the cost of previously zero rated and exempt items at a time when imported inflation ary pressures are eroding spending power and dispos able incomes, thus creating a cost of living crisis.

“We’ve seen that in the last 12 months,” he said. “Both political parties throw mud at each other, and neither demonstrates empirically how it’s played out. This is not Monopoly money; it’s the taxpayers’ money. We make decisions not by the roll of the dice but by empirical analysis, and that goes for Opposi tion and the Government.”

“That’s what we need. The more important thing is work is going on at that airport. I believe that is the more important thing; that we try to make sure we have something in place to handle a few more flights. Nothing is going to happen overnight.”MrAlnebeck said he, too, was in “wait and see”

Many observers believe the situation will not improve until the Grand Lucayan and Grand Bahama International Air port are redeveloped into world-class facilities. How ever, Mr Alnebeck argued that the emphasis needed to be placed on attracting airlift rather than upgrad ing the airport, adding that the latter needs merely to be functional based on Exu ma’s“Theyexperience.don’t have the most fantastic airport but they have the airlift,” the

Thevehicles.ex-City Markets headquarters and ware house was the main asset owned by the failed super market chain’s employee pension plan, which was formally called the Baha mas Supermarkets Ltd Profit Sharing Retirement Plan. Branding the situ ation “unfortunate”, Mr Watchorn told Tribune Business: “We’ve given a real go at trying to get a deal done and settlement down“Wethere.appreciate there are some pensioners still wait ing to get their retirement benefits out of that transac tion, but unfortunately we were unsuccessful in get ting all parties to agree to what we had offered. From a business perspective, we have to move on and let it run through the legal procedures and see what comes out of that. I am con fident AML has done what it can to get a settlement, but at this point we’re just resolved to let the matter be addressed through the court.“We believe we’ve exhausted.... we put a lot of work into trying to get an agreement everybody could be happy with and, unfortunately, we were not successful in getting that done. We wanted to do right by everybody, but ultimately had to move on.

No overnight flight crews in Freeport for 7-8 years

Mr Watchorn acknowl edged there were concerns from an AML Foods shareholder perspective “in having funds tied up in an asset we don’t have use of”, meaning the portion of the purchase price that has already been paid. It is now a decade since City Markets collapsed, and almost six years to the day that AML Foods signed the deal to purchase the former head office, and the retirees are no nearer to seeing monies long due to them.

FROM PAGE A20

Despite Freeport’s strug gles, Mr Alnebeck said

“Strategically, we cannot wait. We have a business to run, and have to make the best decision for the business. For Cost Right, there’s no secret that we’ve been looking for a new home for some time, and this transaction [involving the Solomon’s SuperCen tre building] came up.” Rather than the former City Markets headquarters, Cost Right will instead be relocating several hundred

AML Foods alleged that BSL Retirement Plan Ltd was part-owned and controlled by Mark Finaly son’s family, with his father, mother and two sisters among the directors. Even though a majority of ben eficiaries voted against the BSL Retirement Plan transaction, AML Foods claimed the former pen sion trustees, formerassetsmentvalue,inplan’sexchangingtrusteesarguedanyway.proceedingex-CitytheirConstanceTurnquest-KnowlesChristineandRolle,breachedfiduciarydutiestoMarketsstaffbytoexecuteitTheBISX-listedgroupthattheformerwereeffectivelythepensionkeyassetforsharesacompanythathadnosinceBSLRetirePlanLtdhadzerountilitobtainedtheheadofficeproperty.

Mr Watchorn declined to detail AML Foods’ set tlement offer. And he did not name the other three parties, or identify the two that had consented to AML Foods’ proposal or the one that rejected it. However, based on previous Tribune Business articles on the City Markets head office saga, one party is likely to be the employee pension plan’s trustees, Dennis Williams and Rosalie McKenzie.

While AML Foods was able to secure a written agreement to its proposal from one other side, and a verbal approval from another, it was unable to gain acceptance from the third and final party. “At this point we’re going to leave it to the court to work it out,” Mr Watchorn said. “There are a number of matters before the court, which I cannot comment on.

yards up the road on the East-West Highway.

Court filings seen by this newspaper detailed several alleged transactions involv ing the former head office and Finlayson family corpo rate

The documents detailed alleged efforts to carve-up the 6.52-acre prop erty via a series of related party deals. These involved several “unrecorded and unstamped” conveyances purporting to transfer the now-derelict building and its associated warehouse to different corporate vehi cles, many of which were “at least part owned or con trolled” by the Finlayson family.Inparticular, the BISXlisted group details a May 2014 scheme where the pension beneficiaries would agree to transfer the exCity Markets headquarters building to a vehicle called BSL Retirement Plan Ltd in exchange for shares in that entity. In doing so, they would also give up their interest in the pension plan.

CITY MARKETS RETIREES IN FRESH PENSION BLOW

The impasse largely stems from relations between the other three parties, rather than AML Foods, whose purchase has effectively been caught in the middle of their dispute. AML Foods’ latest annual report, for the 2022 financial year, said: “On September 21, 2016, the company signed an agreement to purchase a building located at Sol dier Road industrial site for $3.359m.“Subsequent to the pay ment of the final purchase price in July 2017, a dis pute arose as to the ability of the vendors [the pension fund trustees] to provide good title to the property. This dispute is currently before the Supreme Court. Included in other assets is $3.138m which excludes VAT.”Previous legal filings by AML Foods, which were detailed in an earlier 2020 Supreme Court judgment by Justice Diane Stewart, alleged that the BISX-listed group was battling a series of “opaque” transactions as it seeks to uphold “the validity” of its acquisition.

mode and “hoping for the best” with just one day to go before Electra America Hospitality Group’s due diligence period for the Grand Lucayan expires on September 15. That is the deadline for the prospec tive buyer to pay the $5m deposit towards the $100m purchase price, unless it is extended or new terms are agreed.Freeport business sources have told Tribune Business there is a growing sense of unease over whether Electra America’s Grand Lucayan acquisition will proceed to a closing given both the property’s history

and lack of information on the sale’s progress.

Mr Alnebeck, like this newspaper, confirmed he had heard suggestions that other potential Freeport and Grand Bahama inves tors are placing their plans on hold until there is con firmation of the Grand Lucayan’s fate. “There’s very little if any activ ity,” he added. “It’s a hard destination to get excited about until we know what happens.”Asfor the Grand Lucayan, he said: “It started as a Sheraton and Westin, then became a Radisson and then became a Memo ries, then a Lighthouse Point. It’s in desperate need of figuring out a formula that will actually work.”

Pelican Bay continues to be boosted by the Grand Bahama Shipyard. “We actually had a decent first two weeks in September due to the fact Crowley had a dry dock in Grand Bahama, so we had a sub stantial amount of room nights associated with that,” he told Tribune Business. “The first two weeks in September were better than they normally are. That’s what happens. We had one ship in dry dock, and got 35 rooms for 20 days. It makes a big impact for us. We’re running about 50 percent [occupancy], which is better than the 30 percent we ran in ChesterAugust.”Cooper, deputy prime minister, previ ously said there were three remaining bid ders for the contract to

redevelop Grand Bahama International Airport via a public-private partner ship (PPP) model with the Government. However, the Government may have to begin the necessary upgrades itself prior to the selection of a winning bidder.Electra America’s plans involve three resort prop erties. A four to five-star branded luxury lifestyle hotel, featuring 198 rooms and 24 villas and targeted at corporate and leisure busi ness; a four-star convention hotel with 535 rooms, fea turing an amphitheatre and convention centre; and a 257-room condo-hotel style family resort with suites that are double the size of the Grand Lucayan’s exist ing rooms.

Another is likely to be the Finlayson family. Mark Fin layson, via his Trans-Island Traders vehicle, and his family, headed by Sir Garet ‘Tiger’ Finlayson, were the majority 78 percent owners of City Markets and its immediate parent, Baha mas Supermarkets, when the company collapsed and ceased operating in 2012.

resolution was not accepted and that the retail group has “exhausted” all possible remedies.Headded that it will now be up to the Supreme Court, and judicial system, to resolve the fate of the 6.52-acre property that also includes a warehouse facil ity and is part of the Soldier Road Industrial Park. The legal process will likely take several further years, and the AML Foods chief said the property “continues to deteriorate” in the absence of a settlement - a develop ment that will further cut the monies obtained by retirees from any eventual sale.“We believe we had pur chased the former City Markets building with the intention to relocate Cost Right there,” Mr Watchorn told Tribune Business. “It’s been subject to various liti gation. At AML, we had worked quite hard towards the end of 2021 into early 2022 with the various par ties to reach some kind of settlement, some kind of agreement.”Whilenot providing any details, he explained that the proposal was designed to satisfy the interests of all sides involved in the dispute while also enabling AML Foods’ purchase to pro ceed. Besides the Solomon’s and Cost Right owner, Mr Watchorn said three other parties were involved, making a total of four.

It’s unfortunate that the facility continues to dete riorate, and it’s unfortunate the pensioners are still wait ing on funds. They have to continue to wait to get a retirement from that.”

Pelican Bay chief said. “We sometimes think it’s the air port and not the airlift, but that’s not the case. Having a nice airport is not going to solve it. We need to have the product that drives the demand, that drives the airlift, and then need an air port to deal with that airlift.
