evaluation has become a viable fix for revenue-strapped municipalities in Westchester. Greenburgh and Yonkers are among 12 municipalities preparing to revalue residential and commercial properties, many of which have not been assessed in 60 years. Municipalities across the county have been hemorrhaging money in recent years as property owners have filed successful tax certioraris to lower their property tax burden. Certioraris, filings by property owners claiming their tax bill is too high, have increased in Westchester from 894 in 2006 to 9,068 in 2012. Yonkers and Greenburgh have the most tax certiorari filings in the county. The city of Yonkers will be forced to borrow more than $10 million to settle 3,500 cases. Greenburgh Supervisor Paul Feiner said Greenburgh loses $10 million a year on tax certioraris. Bronxville, Rye and Pelham have been doing revaluations over the last 10 years, while Revaluation, page 6

Hudson Valley Hospital Center (HVHC) officials claim an internationally known New York City architectural firm was a negligent malpractitioner when it designed a new building for the Cortlandt Manor hospital that did not comply with state and local building and safety codes. The hospital seeks a court judgment requiring the firm, Perkins Eastman Architects P.C., to pay an unspecified amount in compensatory damages and additional costs. The design errors resulted in extra work costs and construction delays that put the project more
than $2.2 million over budget, attorneys for the hospital claim in a complaint filed in March in state Supreme Court in Westchester County. Completed in 2010, the approximately $110 million project added more than 100,000 square feet of space to the 128-bed hospital on Crompond road. The project included construction of a fourstory, 83,000-square-foot patient tower. Perkins Eastman signed a contract with HVHC in 2005 for the architectural and interior design work. The 32-year-old planning, design and consulting firm has designed numerous health care facilities nationwide, including the Elizabeth Seton Pediatric Center in Yonkers, a 165,000-square-foot Hospital, page 6

From campus to community, a Mount Vernon fixture rebrands

ince shortly after the Civil War, The Wartburg has been a quiet presence occupying a secluded place in Mount Vernon. Now it’s about to raise the volume to promote its new and expanded services and stretch its service reach into Westchester County and the Bronx. Founded as a children’s orphanage and sponsored by the Lutheran Church as a social ministry, The Wartburg Adult Care Community for more than a century has built a reputation as a nursing home operator that provides additional residential and day services largely for elderly residents with low or moderate incomes. It operates on a $54 million budget. As Mount Vernon’s largest employer, it provides jobs for about 800 area residents on a former working farm tucked away off the Hutchinson River Parkway and Lincoln Avenue. “We’ve been very quiet,” said David Gentner, president and CEO of the newly rebranded Wartburg. Outside his office, a construction crew worked noisily on the Wartburg’s new rehabilitation center that will open in August. “Things have been safe and comfortable and stable,” he said. But for leaders at Wartburg – the “The” recently was dropped from its name so as not to suggest one fixed location for its services – and for other health care providers, things are no longer so comfortable as the U.S. implements reform measures included in the Affordable Care Act and New York carries out

its cost-cutting redesign of the state’s Medicaid program. For senior health care, the focus is shifting from long-term institutional care in nursing homes such as the 240-bed facility on the 34-acre Wartburg campus to providing community-based health services and home care that keeps patients in their homes. “Historically we’ve been a fee-for-service destination” that serves a significant number of Medicaid patients, Gentner said. “But the incentives have changed and our focus has changed. It’s gotten much more competitive and everything’s changing. Wartburg needs to change.” As part of that change, Wartburg is preparing to launch its own health care insurance product. The nonprofit has applied to the state Health Department for approval of its managed long-term care plan for Medicaid patients. Enrollment in the plan will be open to Bronx residents as well as residents of Westchester County. “It’s a big deal for Wartburg,” Gentner said of the insurance venture, which will be managed in-house in Mount Vernon. “We’re blessed because we have the resources and capital to do it.” That effort to expand its service region also marks a significant change at Wartburg. Seventy percent of its residents previously lived within a five-mile radius of the campus; and the remaining 30 percent lived within a 10-mile radius, Gentner said. “Obviously that’s one of the things that we’d like to change as we look to community-based models.” But the old model of the Wartburg as a residential center for the elderly will not be

entirely discarded for the new. The nursing home, Wartburg’s largest program and a facility with an occupancy rate historically in the 90 percent range, will maintain 210 beds, Gentner said. For seniors not needing skilled nursing care, the Wartburg’s assisted living facility has 105 units and includes a memory care wing for patients with dementia or Alzheimer’s disease. The Wartburg also has 34 rustic stone cottages for seniors able to live independently. This month, the Wartburg community will dedicate its recently opened Friedrichs Residence, a 61-apartment affordable housing building on the Mount Vernon campus. The Friedrichs project and the rehabilitation center for short-term patients now under construction represent a $53 million investment, Gentner said. The projects were launched with an approximately $27.6 million HEAL NY grant awarded to Wartburg by the state in 2010. The grant “was a real game-changer for us,” Gentner said. “Because that fixed all of our issues on campus and also dramatically changed our balance sheet.” Having fixed the quiet

ocial media is worthless. Social media is essential. Those contrasting views were on display March 21 at Benjamin Steakhouse in White Plains in a debate over the value of social media presented by the Business Journals and Wag magazine. On one side was marketing consultant Brandon Mendelson, author of “Social Media is (Expletive).” On the other side was Kristen Ruby, founder and CEO of Mount Kisco-based Ruby Media Group L.L.C. and a social media marketing and public relations strategist. Ted Miller of Mount Kisco-based DataKey Consulting L.L.C. also participated in the debate, which was moderated by Elizabeth Bracken-Thompson of Thompson and Bender L.L.C., a public relations firm based in Briarcliff. When they weren’t trading barbs, Ruby and Mendelson were espousing the merits, or in Mendelson’s case, the pointlessness of social media. “It allows you to communicate and aggregate your content,” Ruby said, referring to sites like Facebook, Twitter, Pinterest and Instagram. Mendelson called social media a buzz-

word created by corporations, allowing them to continue to control the balance of power. “Social media involves a very vocal minority,” Mendelson said. Ruby spoke about the impact social media has had with her clients. Benjamin Steakhouse and Stacyknows.com teamed up for a holiday party that later turned into an event to mark 26 Acts of Kindness, an initiative started by journalist Ann Curry after the Sandy Hook shooting. The companies used social media to get the word out, and Curry even showed up, having heard about it through Twitter. “That’s just good marketing,” Mendelson retorted. “It had nothing to do with social media. Sandy Hook was everywhere; it was a major news story. It was brilliant marketing.” Mendelson argued about the usefulness of Twitter, claiming that only 15 percent of people use it and most of its users are jour-
nalists, like Curry. He maintains a Twitter account and said most of his followers are fake, created by companies with the purposes of spamming. Ruby said that there is still a place for media like print, and said it is important that companies fully integrate. “The best campaigns still use print,” Ruby said. “In the old days there was just one medium. You have to use multiple channels.” Miller said that social media has made word of mouth very important, given the speed information spreads. He said that while consumers will trust advertisers only 29 percent of the time, they trust friends on social media 92 percent of the time. “It’s staggering,” Miller said. “People’s voices have been amplified and are being heard loud and clear.” Mendelson said that social media has been
really good for social media marketers. He said The Coca-Cola Co. did a study and found it did not get a boost from social media, and that most companies don’t have the resources to spend on social media. Ruby said many industries have benefitted from putting themselves out there via social media. Retailers and restaurants have seen boosts from offering exclusive coupons only on Facebook, for example. In 2009, Mendelson traveled across the country to raise money for breast cancer charities. He generated lots of followers on Twitter and many “Likes” on Facebook, but they did not translate into actual dollars. “It was a live demonstration that social media doesn’t work,” Mendelson said. “You can’t qualify social media with sales.” Ruby said that Mendelson became bitter toward social media because of his failed fundraising efforts, drawing “ooos” from the crowd. “Your book is the dumbest thing I’ve ever heard,” Ruby said. Bruce Newman, vice-president of Carmelbased Productivity Institute L.L.C., a company that specializes in social media marketing, said all three panelists made very good points about the merits or demerits of social media. “Who won?” Newman said. “It really depends on your perspective.”

‘For Sale’: Making a marketing campaign BY JOHN GOLDEN jgolden@westfairinc.com
(This is the first story in an occasional series following the stages and progress of a property deal in Westchester’s commercial real estate market. The Business Journal is tracking a team from the Stamford, Conn., office of CBRE Group Inc. in the marketing and sale of the Thornwood Conference Center property in the town of Mount Pleasant.)
“I
do a tremendous amount of data raising,” said William V. Cuddy Jr., executive vice president at CBRE Inc. On a raw, sleety day in late January, Cuddy was in his office in downtown Stamford, Conn., where about 45 commercial brokers work the northern metropolitan markets from Connecticut’s Fairfield County to New York’s Hudson Valley. Raising data – Cuddy has been identifying prospective buyers to target across several industries for a former IBM Corp. property being sold by a debt-burdened religious congregation – is critical to the marketing campaign launched in October by a nine-person team in CBRE’s Stamford office. The effort is led by Cuddy, CBRE Vice President Budd Wiesenberg and Senior Vice President Gene Pride, who heads the office’s private capital group. The distinctive property is the approximately 262-acre Thornwood Conference Center at 582 and 590 Columbus Ave. in the town of Mount Pleasant. It includes two parcels, one developed as a corporate office campus and an undeveloped 165-acre tract. CBRE prefers to sell them as a package, though they could be sold separately to different investors or end users. Secluded from public view, the featured property on the developed parcel is a 364,000-square-foot conference center built for IBM in 1985. It includes a 300seat auditorium, 350-seat dining room and 249 hotel or dormitory rooms. The massive green-roofed complex is a short walk from an approximately 46,000-square-foot office building used by administrative staff of the property owner, Legion of Christ Inc. The Legionaries of Christ, as the international congregation of Roman Catholic priests is commonly known, is headquartered on the wooded, rolling Thornwood campus and has used the conference center to train and house seminarians studying for the priesthood. But the main building is only lightly used now and the Legionaries will vacate the premises when a buyer is found. A religious nonprofit, Legion of Christ paid $33.7 million to acquire the property from IBM in 1996. The Legionaries proposed to develop the 165-acre parcel as the site of

Westchester University, a Roman Catholic liberal arts institution. The owner in 2008 completed about three-fourths of the environmental quality review required by the state for the project, but abandoned the university plan because “the demand hasn’t developed for it,” Legionaries spokesman Jim Fair said last fall when the property went on the market. Founded in Mexico 72 years ago, the conservative order of priests has been rocked by scandal following the death in 2008 of its founder, the Rev. Marcial Maciel Degollado, who was found to have sexually abused boys and to have fathered children. Pope Benedict XVI in 2010 ordered a Vaticandirected reform of the Legionaries, who have seen “a little bit of a drop” in seminarians in the wake of the scandal, Fair said. The scandal also exacerbated the order’s financial problems. The Legionaries spokesman said the decision to sell the Thornwood property and another Westchester property, Our Lady of Mount Kisco Retreat Center, on a former residential estate in the town of New Castle, was primarily financial. The order wants to pay down its debt, which includes a $37.3 million mortgage secured in 2009 with Allied Irish Banks PLC on the New Castle and Thornwood properties. The Legionaries last August hired CBRE to market the Thornwood property for sale. CBRE competed with other real estate brokerage firms for the contract. The vendor selection process “was done confidentially,” Cuddy said. “I know there
were multiple other firms, but I don’t know who they were and how quickly they were eliminated.” From August into October, the CBRE team assembled the elements of the marketing package – among them, land surveys, topographical maps and building floor plans. A plane and pilot were hired for aerial photos of the property. Cuddy said it took six weeks to put together the offering memorandum. Replete with color photos, the 26-page booklet with bound laminate covers advertises the Thornwood Conference center as a “prime development opportunity.” Cuddy would not disclose his firm’s marketing costs or project budget, though he said CBRE had a cost advantage over some competitors. “We have the benefit of being able to do a tremendous amount of this work in-house,” he said. An email blast announcing the offering was sent to more than 16,000 investors and developers. For email marketing, “Sixteen (16,000) is toward the upper range,” Cuddy said. The brokerage also packaged and mailed more than 1,000 hard copies of the offer memorandum. “Initiating a campaign in the fourth quarter is usually the most difficult,” Cuddy noted, with holidays slowing business activity. “And in this year, the Sandy event.” Hurricane Sandy “was disruptive,” he said, with damaged properties claiming the attention of affected developers and owners in the region. “We identified five or six key buckets,
key constituencies” to target as prospective buyers, he said. They include academia, residential developers, the hospitality sector, senior living and congregate care companies, research and development, especially in medical science, motion picture production and corporations in the tristate region with use for a conference center. Customized emails and letters were sent to prospects in each constituent area. Cuddy called the site a great location for a medical science-related user. “We’ve been pleasantly surprised by the activity from that sector.” “Also the development community is back.” After four years of little activity by developers in Westchester, “We’ve had pretty strong interest from the development community.” The undeveloped parcel is zoned for single-family homes, he said. Where the Legionaries’ university died in planning, Cuddy envisioned an engineering school. “I think for us and the county, that would be the home run of all home runs.” “We don’t know who the end user is ultimately going to be, but we want to be sure we’ve got our tentacles out for any of them.” At the start of spring, the CBRE team was preparing for the next stage in marketing. The firm on April 2 will issue a call for offers from “interested parties that have engaged with us and registered with us their interest” in the Thornwood property, Cuddy said. Bids must be submitted to CBRE by April 23. Cuddy said the offer call will be sent to prospects that number “north of 75 and south of 100. It’s a healthy enough response that we’re going to be giving them instructions for how we’d like to see their offer.” CBRE brokers have been available to give tours of the property for prospective buyers on Tuesday afternoons and Thursday mornings. But with the call for offers, prospects will have daily access to the property. “This is a complex property,” said Cuddy. The undeveloped site includes 30 acres of wetlands within the New York City watershed that drain toward the Kensico Reservoir. “It takes a while for people to do their due diligence.” “It may be a single sale or we may need to mix and match” buyers with separately sold parcels, he said. “But the market is going to tell us.” “This property is so different from other product. This isn’t an apartment building or a triple net-leased industrial building. This is a very unique existing conference center and an undeveloped piece of property. …It could end up as many different things and with a wide range of users.” “I think it’s played out as we had hoped,” Cuddy said of the marketing campaign. “We have interest from a wide range of parties.” “This is as engineered,” he said.

wo centers of hospitality in Westchester County recently added new chefs to their farm-to-table culinary operations. Ryan Sachs has joined Tarrytown House Estate & Conference Center as chef de cuisine at Cellar 49 restaurant in the historic Biddle Mansion on the grounds of the hotel and meeting complex at 49 E. Sunnyside Lane. A New Mexico native and former Arizona resident, Sachs previously was lead line cook at Six Peaks Grille in the Resort at Squaw Creek in Lake Tahoe, Nev. Both Tarrytown House and the Lake Tahoe restaurant are owned by Destination Hotels & Resorts Inc. in Englewood, Colo. The menu at Cellar 49 offers a modern twist on classic tavern fare, according to Tarrytown House’s management. Sachs in a press release said the restaurant “has an interesting appeal that is very unique to Westchester County and the tristate region. I’m excited to be here and look forward to
leading the team in pushing the culinary envelope for our guests.” Outside Armonk, Brynwood Golf & Country Club has hired Cesar Guaraca as executive chef, tapping into kitchen talent at the Cipriani Group of international restaurants. Marco Arconte, Brynwood’s new food and beverage director, also joins the country club at 568 Bedford Road from the Cipriani company. Guaraca spent most of his 16-year career creating menus for many of the Cipriani restaurants as well as for exclusive catering events as executive chef of the Cipriani Group. Arconte most recently directed food and beverage operations at the Cipriani Restaurant in Manhattan. “Our success is defined by our ability to bring the best qualified talent to Brynwood, and we’re fortunate to have attracted these men to the club,” Brynwood co-owner Jeffrey Mendell said in a press release. Brynwood’s new executive chef in the announcement described himself as “absolutely the definition of a foodie’” who enjoys working with all styles of food, from Asian to Italian and Mediterranean.

By DaviD SeiDen, CPa Citrin CooPerman Every year around this time, I start receiving phone calls from area code (305). The calls are from Florida “Snow Birds” who want to tell me they finally got their Florida driver’s license and therefore there is no need for me to prepare a New York Resident Income Tax Return for them. It is at this point I need to remind the caller that simply changing one’s driver’s license or spending less than 184 days in New York does not mean they are no longer taxed as a New York resident. In order to understand where an individual is required to pay state income taxes, it is important to understand the terms: “resident”, “nonresident”, “domicile” and “statutory resident.” Unfortunately, certain of these terms are often used synonymously by both taxpayers and taxing authorities, despite there being significant implications of being classified as one versus the other. Domicile Most states define domicile as the locality in which a person intends to make their fixed and permanent home. A person can only have one domicile at a time. Once a domicile is established, such location will continue to be his/her domicile until the person can show “with clear and convincing evidence” that they have changed their domicile to a new location. The most significant challenge a person has in supporting a change in domicile is proving “intent.” For example, if a person sells his existing New York home (without replacing it with another home in New York) and purchases a home Florida, there should be little doubt that the person’s intention is to change his domicile to Florida. However, if the same person retains his New York home and purchases a home in Florida, determining the person’s intentions becomes much more difficult. Many states, including New York, look to five factors to determine a person’s intent when the person has multiple homes: (1) Size and value of homes; (2) Business connections in the state; (3) Location of items of sentimental value; (4) Time spent in a given location; and (5) Location of family. In addition to “intent,” there are other “points of evidence” states look to when determining if an individual has changed domicile, including: new driver’s license; change of address announcements; re-registering cars; registering to
vote; etc. Many tax advisors consider this type of evidence as “window dressing.” That is, just having this evidence, without the intent, will likely not reach the “clear and convincing evidence” standard held by most states. However, without obtaining the window dressing, a state will likely deny the change in domicile without looking at the person’s intent. Statutory reSiDent A person can change his/her domicile but still be taxed as a resident. This is known as being a statutory resident. In general, a non-domiciliary who maintains a permanent place of abode (i.e., home) in a state for substantially the entire year and spends more than 183 days in the state is deemed a statutory resident. There are numerous issues to consider when evaluating statutory resident status, including: (1) what is a “permanent place of abode”; (2) how long is “substantially the entire year“; and (3) what is a “day” when evaluating the “more than 183 days” test. reSiDent anD nonreSiDent In general, a resident is an individual that is classified as either being domiciled or a statutory resident in a given state. If an individual is deemed a resident, the state typically subjects to tax all of the individual’s taxable income. A nonresident is an individual who is not classified as a resident. A state can require a nonresident to file and pay state tax if the individual receives income from such state (e.g., income from property located in the state). Based on the above discussion, it is clear that there are numerous hurdles an individual faces when attempting to change domicile. Many of these hurdles require careful up-front planning along with contemporaneous documentation. With the proper planning, individuals can and do successfully fend off state tax auditors and reap the benefits of being domiciled in a state that has little or no income tax. Mamaroneck and Scarsdale are in the process for the first time in 40 years. In Westchester, where most municipalities have not done a revaluation in 60 years, properties are reassessed if any major renovations are done to the property. The other municipalities that have joined with Yonkers and Greenburgh for revaluations include Peekskill, Mount Vernon, Bedford, North Castle, Pleasantville, Ossining, New Castle, North Salem, Briarcliff Manor and Mount Kisco. Yonkers will bond $3 million for the project, having already bonded $1 million, and has sent out a request for information to see what would be involved and how much it would cost. Request for proposals to get companies to bid on doing the revaluations are expected to be sent out soon. Greenburgh recently released its 2013 capital budget with $1.5 million set aside for revaluation. “This would stop the bleeding,” Feiner said. “Our revenues are going down; we cannot stabilize the tax rate if the revenues keep going down. We are giving away millions of dollars every year.” Feiner estimates revaluation will cost the town at least $4 million. But he said money would be saved in the long run as a result of no longer having to settle tax certioraris, a viewed shared by other municipalities. In Yonkers, a citywide revaluation has not been done since 1954. City Assessor Mark Russell has been pushing for one since he started his job 20 years ago. “It’s only fair that you pay the taxes that reflect the current market value of your property,” Russell said. “When you’ve gone 60 years without a revaluation, you cannot expect the assessment rolls to be fair to all property owners.” Russell said that a citywide revaluation would reduce certiorari and small claims assessment review filings by 50 percent.

New Rochelle recently hosted a League of Women Voters-sponsored forum on revaluation that featured assessors from throughout Westchester. New Rochelle City Manager Charles Strome has been a supporter of revaluation, having seen his city plagued by tax certioraris. He thinks that public opposition has curtailed revaluation efforts over the last 60 years. “People think their taxes are going to go up,” Strome said. “It’s just not very popular. I’m not sure the public understands it, but they are afraid of it. I’m optimistic about a lot of things, but I am not optimistic about revaluation.” County Executive Robert P. Astorino opposed to a countywide revaluation due to the cost – $80 million. In 1996, revaluation would habe cost the county and estimated $26 million. In Westchester, municipalities do their own assessments and collection of taxes with the county having no role. When Andrew J. Spano was county executive, the county formed the Collaborative Assessment Commission to study whether the county should do revaluation, which led to The Oblique Aerial & Street Level Photography Project in 2010. The $1 million project made it easier for municipalities to get better aerial photographs of properties to assist in assessments. In 1996, the county considered a countywide revaluation and a bill was approved in the state Senate and Assembly, though it was vetoed by Gov. George Pataki, who was swayed by last-minute lobbying efforts from the business community, including IBM Corp. and PepsiCo Inc. Pataki in his veto message delivered in October 1996 said the revaluation bill “would have profound and perhaps devastating effects on local economies, because of the onerous tax burden it imposes on local businesses. This bill would challenge the ability of small businesses throughout the county to keep their doors open and would codify serious inequities in the tax rates.” George Oros, chief of staff to Astorino,
said that while the county will not directly be involved, they would offer assistance if necessary. “Getting the county involved is not necessarily a good thing,” Oros said. “The county will provide whatever resources we have or any kind of data we’ve gathered, but the authority and responsibility rest with local municipalities.” While municipalities claim that revaluation will reduce tax certioraris, Jeffrey Rodner, a tax attorney that specializes in certioraris for the White Plains law firm Gellert and Rodner, does not believe it will have much of an impact. “It’s a crapshoot,” Rodner said. “It depends whether the firms that are hired are accurate in their estimates. There are always people going to be grieving.” Rodner said that revaluation will raise
prices on older homes and will cause senior residents to pay higher property taxes. “Revaluation will shift the burden from newer homes to older homes,” Rodner said. “These homes haven’t been assessed in years; there is a significant amount of appreciation since they were last valued. What kind of burden do you want to put on your elderly residents?” Amy Allen, managing director of advocacy and international business for the Westchester County Association, said the issue was a hot potato and that municipalities need to be more forthcoming about the cost. “We sat with a group of municipal officials and every time we asked what the actual cost would be, we got stymied,” Allen said. “I’d like to see what the plan would look like before offering an opinion. Yes in concept, but it depends on how you get there.”
HVHC with accurate information regarding its performance under the contract. “As an architectural firm with specialized expertise in the design of health care facilities in the state of New York, Perkins had an obligation to perform its design services pursuant to a high standard of care,” the hospital complaint stated. Hospital officials negotiated a special provision in the architect’s contract that required the firm to provide its services “in accordance with industry-accepted professional architectural standards appropriate for the size, complexity and other characteristics of the project in the jurisdiction where the project is located.” The design lapses led town of Cortlandt officials to deny the hospital a building
permit as project construction was about to begin, according to the complaint. The town’s rejection caused a delay of more than two months while the project was redesigned to add required features, including a new stair tower, a revised design for the stair tower foundation and smoke and fire walls throughout the hospital. The redesign for code compliance added about $2.2 million in project costs in the form of extra work and construction delays, resulting in a budget overrun of about the same amount, according to the complaint. And because Perkins “missed” the code compliance issues, HVHC “lost any chance of either stopping the project or redesigning the project to meet its budget,” hospital
attorneys claimed. HVHC officials also negotiated another special contract provision by which Perkins agreed to fully indemnify the hospital against all damages, including attorneys’ fees and defense costs, caused by the firm’s negligent performance. Attorneys for Perkins Eastman in February filed a motion to partially dismiss the hospital’s original complaint brought in January. Three allegations that defense attorneys argued should be dismissed were dropped from the amended complaint recently filed by hospital attorneys. Attorneys for the architect said HVHC refused to pay Perkins Eastman’s final invoices when the expansion project was completed.
Bronx linen service bound for Yonkers A Bronx-based linen service is slated to move to Yonkers with plans to expand its workforce. Assistance on several levels was green-lighted March 27 by the Yonkers Industrial Development Agency (IDA). Fast Linen Service Inc. plans to buy a 32,000-square-foot property at 945 Nepperhan Ave. to replace its current 6,000-square-foot leased location on White Plains Road in the Bronx. The company said its move to Yonkers will allow it eventually to triple sales. Fast Linen expects to provide 42 fulltime equivalent jobs once it completes the move. It now employs 30 in the Bronx. The project will also provide an estimated five construction jobs. “This is a win for Yonkers and the region,” said Mayor Mike Spano, who is also chairman of the Yonkers IDA. “Current employees can stay with the company, yet people will also be able to obtain the new jobs that will result from
the larger location. Fast Linen expects to triple its sales and we are glad they have chosen Yonkers as the place to do that.” The Yonkers IDA will provide an estimated $45,810 in mortgage tax exemptions and $61,975 in sales tax exemptions on materials used in construction and renovation on Nepperhan Avenue. Fast Linen expects to spend $3.6 million to buy and renovate the property. No time table was given for completion of renovations and moving. The IDA also expects to negotiate a temporary property tax abatement. The jobs brought to Yonkers will pay between $18,000 and $50,000 a year, with a total estimated payroll of $1.05 million annually, the IDA reported. “Providing about a hundred thousand dollars in tax incentives to bring more than 40 jobs to Yonkers is a good return for the city,” said Spano. — Bill Fallon

Dealing with being the boss The older I get the more frustrated I get. Things come up in the business and I find I just don’t want to deal with them. Seems like sometimes there’s unwillingness on my part to address the seriousness of the issues at hand.
THOUGHTS OF THE DAY: Along with ownership come certain responsibilities. When you don’t want to deal with something, figure out why. Lay out a standard way to handle issues and learn to follow the path you’ve laid out. Give yourself time off. Business owners have more than one job. The obvious job is selling, making and delivering the sausage – the goods or services of the business. The job behind the job is all about what it takes to keep the business on track and productive. That’s where dealing with underlying issues and challenges comes into play. Spend time defining your job at the top of the organization. Include in your job description goal setting, regular review of the
company’s overall performance, looking forward to identify new opportunities and ways of doing things and securing the company’s assets and building additional ones for the future. Keep your focus on the big tasks that drive your company forward. Hand off the rest so the company can grow. Go through your daily routine and identify tasks that get in the way of doing your job as CEO. Are you too deep into details? Assign responsibilities to others. Is there no one to delegate to? Train or replace. Do you get distracted or interrupted? Schedule your time in blocks to help you stay on point. Set up meetings where you ask people to take action and report back on results. Coach them on what they could do next. Stay out of the mix personally. Learn to step back and wait it out. Challenge the people around you to deal with more glitches on their own. Remember that a dozen people working to solve problems are likely to accomplish more than you can by controlling all the decisions and actions. Trying to push forward without perspective can be unproductive. Few problems have to be resolved as quickly as you

might think they do. It may be that your desire to delay is actually a helpful trait that gives you time to observe, reflect and decide. Take a look at why you’re delaying. Is it avoidance? Or are you simply giving the situation time to play out? Find someone you can talk with who is level headed, observes accurately and helps you sort through options. If you’re alone at the top of the organization, find an employee who fills the role of confidant. Have someone who can help you keep things in proportion. Focus your efforts on becoming a problem diagnostician. There are lots of reasons why things don’t go right in a business. And often the obvious signs are just symptoms covering over bigger issues. Set up a system to identify and assess problems. List issues on a white board. Map out the obstacles that contribute to, or result from, the problems. Document lessons learned as people deal with the issues that crop up. Look for common threads. Check in with owners of similar businesses to see if they’re having the same kinds of problems and to find out how they’ve put issues to bed. When issues crop up persistently, consider
hiring outside expertise to get another view on how to put things back on track. Ask employees for their advice on how they would solve persistent problems. Get them engaged in the debate and resolution of issues. Teach them to be problem solvers. When the business goes through a challenging period it’s common to feel a sense of frustration, of burn out, of avoidance. If you feel overwhelmed, give yourself a break. Get away, even for a long weekend. Let others take care of things for you while you take a time out to recharge your batteries. Looking for a good book? he Yorktown Town Board is divided over what to do with a $3 million, 8,000-square-foot building in Shrub
Oak. The building has served as the sales office for Trump Park Residences, an $80 million, 141-unit active adult community off Barger Street, owned by Cappelli Enterprises Inc.
According to a written agreement, once 50 percent of the residential units were sold, the building was to be razed and replaced with a gazebo and a walking track. Even though half of the units remain unsold, a Cappelli spokesman said they no longer need a sales office. Some town officials, including Supervisor Michael Grace would like the structure to remain and be used for town purposes, like an office for the Parks and Recreation Department.
“The town has some needs for a building like that in the northern end of town,” Grace said. “A building like that could hold administrative offices and allow for us to run community programs.” At a work session, some residents were resistant to the idea, worried about what the town would do with the land, but Grace said it would simply be used as an office. While there is no set value for the building, estimates by Grace and Cappelli

the agreement made during the approval portion of the project. “I don’t believe in reneging on agreements,” Bianco said. “How do we benefit from this? This belongs to the land trust.” Councilman Dave Paganelli agrees with Bianco, while Councilman Terrence Murphy sides with Grace. Vishnu Patel could not be reached for comment. “Our motto is progress with preservation,” Murphy said. “I have no problem with preservation, but we have already preserved 3,000 acres of open space. You have a building on that piece of land, why would you want to wreck it just to have grass grow?” John Schroeder, president of the Yorktown Land Trust, negotiated the easement along with the Westchester Land Trust. He said that preserving 40 acres was the trade-off for Cappelli being able to put in several amenities and that the building would be taken down. “Buildings are not supposed to be there,” Schroeder said. “Our position is that the building has to come down or be moved.” A recreation easement approved by the town that sets aside five to 10 acres of the property to be used as a walking trail, paid for by Cappelli, also states that buildings should not be on the site. “As far as we are concerned, Yorktown has an obligation to enforce the conditions of a recreation easement,” Schroeder said. “The building must be removed from the site.” Joseph Apicella, executive vice presiRaze, page 14

Natural Markets Food Group, the former Natural Markets Restaurant Corp., plans to create 10 additional jobs when it moves its headquarters this spring from Scarsdale to the Irvington riverfront. The company, which operates Mrs. Green’s Natural Market organic grocery stores, has leased 11,555 square feet of space at 1 Bridge St. in Irvington. The move from 700 White Plains Road in Scarsdale is expected to be completed in early May. Owned by Bridge Street Commercial L.L.C., 1 Bridge St. is a 100-year-old brick building that was part of the Lord & Burnham greenhouse factory complex. The waterfront property, parts of which sustained flood damage in Hurricane Sandy, has been converted to office suites and lofts and retail shops and restaurants. CBRE Group Inc. brokers Timothy Donohue and Kevin Langtry arranged the lease on behalf of the expanding tenant, while Bridge Street Commercial was represented in-house. Donohue said the organic grocer plans to add about 10 new jobs with the relocation. Natural Markets Food Group operates 11 Mrs. Green’s markets in Westchester and Putnam Counties, Long Island and Fairfield County, Conn.

Varta Microbattery Inc. has relocated its Westchester County office from White Plains to a 6,254-square-foot space at 555 Theodore Fremd Ave. in the International Corporate Center at Rye. Based in Germany, Varta specializes in the research, development, production, sales and marketing of industrial and consumer battery systems. Its U.S. engineering, sales and customer service departments are in Rye. The company also maintains regional offices, a U.S. distribution network and warehouses on the east and west coasts.
The long-term lease was announced by Faros Properties L.L.C., the Manhattanbased landlord of the three-building, 170,000-square-foot International Corporate Center at Rye. Apartment portfolio sells
A portfolio of nine nonperforming collateralized loans for eight multifamily buildings in southern Westchester recently was sold at a 29 percent discount on the assets’ current value. John Barrett, head of investment sales at Admiral Real Estate Services Corp. in Bronxville, exclusively represented the seller, an affiliate of Situs, the Texas-based commercial real estate loan servicer, in an allcash deal. Barrett said the notes were sold to affiliates of Gentar Management, an owner of multifamily assets in Westchester. The properties include 50 rental units in seven walk-up apartment buildings and a vacant multifamily shell. Six buildings are in southwest Yonkers and one each is in Mount Vernon and Pelham. Barrett said the par value for the collateralized notes at the time of the sale was $5,027,766. The portfolio contains eight notes in the first lien position and one subordinate note. Barrett said the properties “have suffered from poor management and deferred maintenance issues for several years but have significant upside from the acquisition cost.”

Eileen Mildenberger, who served two years as executive director of the Westchester County Industrial Development Agency (IDA), has been named the county’s director of economic development. She will be replaced at the helm of the IDA by Jim Coleman, a marketing executive and former chief of staff to a Republican state senator from Putnam County. County Executive Robert P. Astorino announced their appointments at the monthly meeting of the county IDA board. The board unanimously approved Coleman’s appointment as the agency’s executive director, effective April 8. His annual salary is $115,450. Mildenberger succeeds Laurence P. In her new post, Mildenberger, a White Plains resident, will act as the county’s liaison to the business community and help businesses and entrepreneurs stay and grow in and relocate to Westchester. She will also oversee the county’s tourism and film office. Coleman, a Scarsdale resident, in December ended a two-year stint as chief of staff to state Sen. Greg Ball. Since then, he has worked as director of marketing, acquisitions and development at Unicorn Contracting Corp. in Garrison, a builder of affordable housing and medical office buildings, according to his LinkedIn page. Coleman, an African-American, also will lead the county Minority and WomenOwned Business Enterprise, an agency within the county executive’s office that promotes equality and eliminates barriers to obtaining state contracts by minorityowned and women-owned businesses. “These moves strengthen our outstanding economic development team,” Astorino said in a press release. Mildenberger and Coleman “bring talent, experience and a continuity to our economic development efforts.”

The Larchmont Village Board unanimously passed an ordinance banning singleuse disposable plastic bags from checkout counters in the village. The March 19 resolution mandates the use of reusable bags and paper bags produced of recycled materials. “Plastic bags are environmentally harmful and completely unnecessary,” said Jordan Christensen, Hudson Valley program coordinator for Citizens Campaign for the Environment (CCE), an advocacy group that dates to 1985 and that claims 80,000 members in New York and Connecticut. “CCE commends the Village of Larchmont for passing a resolution that will substantially increase reusable bag use among residents. This law will prevent the use of tens of thousands of plastic bags each year, which pollute Westchester’s parks and beaches and damage the Long Island Sound.” According to the CCE, in the last two years, the village of Mamaroneck and city of Rye had similar bans on plastic bags pass unanimously. And Westport, Conn., and both Southampton and East Hampton have already implemented bans in an effort to protect the Atlantic Ocean and Long Island Sound. “The village of Larchmont is the latest municipality in a growing regional movement to protect the Long Island Sound and to reduce litter by banning disposable
bags,” said Christensen. “Globally, waterfront communities have been leading this movement in order to protect the beaches, estuaries, and oceans that their residents rely on.”

Tappan Zee Constructors L.L.C. began preconstruction geotechnical surveys March 25 to determine soil conditions in and near the Hudson River in preparation to build a new Tappan Zee Bridge. The tests will help designers determine the proper size for piers and supporting foundations for the new bridge. The barge-based operations will run continually Monday through Friday and possibly Saturday, and are scheduled to take approximately eight weeks to complete. The first barge eased into place Monday amid sleet and snow and a second is expected Tuesday, March 26. Additional barges are expected to follow as construction gins up. Tappan Zee Constructors, a consortium of builders and engineering firms, said the noise output will be minimal. None of the work is expected to disrupt traffic.

After 67 years, 800,000 volunteer hours and more than $5 million raised for its parent health facility, Lawrence Hospital Center’s Bargain Box in Bronxville will close its doors in June. “We are sad to lose the Bargain Box,” said Tracy Conte, vice president of Lawrence Hospital Center, in a prepared statement. “It has been an institution here in the village for 67 years and has had a great run. The decision to close was difficult for everyone involved, especially our volunteers, but everyone agreed the time has come.” The ground-floor store on Palmer Avenue offered everything from old books to furnishings to sports equipment and costume jewelry. It was run by the Lawrence
Hospital Auxiliary, of which Helen Lovell is president. “Throughout its history, our volunteers have given 800,000 hours of service and sales from the Bargain Box have amounted to more than $5 million that’s been donated back to the hospital,” said Lovell. “I am sure that the friendships that have developed working together through the years will continue.” The hospital reports the store had seen sales slide and donations drop off recently. The hospital has no immediate plans for the 3,000 square feet that will be vacated when the store empties, reporting it will explore options for how to best utilize the space for patient care. The Bargain Box will remain open until June 21. It will continue to accept donations until the end of May.
discrimination by ignoring local zoning restrictions. As part of the settlement, the county has to build 750 units of affordable housing by August 2016. County Executive Robert P. Astorino, who was not in office when the settlement was reached, has constantly been at odds with HUD since taking office in 2010. In a letter to Astorino, HUD claims the county has failed to promote zoning for affordable housing and has failed to adopt legislation prohibiting landlords from rejecting tenants that receive Section 8 subsidies. HUD is threatening to withhold $7.4 million in federal aid if the county does not
comply by April 25. The county executive’s office claims that they have been ahead of schedule of the settlement’s terms, and accused the federal government of trying to bully the county. “HUD’s latest action of unilaterally demanding that the county give up either its constitutionally protected rights or $7 million that it was promised two years ago shows that HUD has no regard or respect for fairness,” Edwin McCormack, communications director for Astorino said in a statement. McCormack said that the county has supplied volumes of data to prove that
zoning in Westchester is not exclusionary. The county has built 305 units since the settlement. “The impasse is over HUD’s refusal to accept the county’s well documented conclusions,” McCormack said. The county and HUD have butted heads in court before over the county refusing to adopt a law prohibiting landlords from rejecting Section 8 tenants, with a federal judge ruling against the county. home prices rise, but trail largest metros
In January, home prices in the 20 largest U.S. metropolitan regions posted their largest annual gains since the summer of 2006, according to the Standard & Poor’s/ Case-Shiller Home Price Indices released March 26. The monthly composite that tracks home price trends in the country’s 10 largest cities increased 7.3 percent compared to January 2012, while the composite that tracks prices in the 20 largest metros increased 8.1 percent. “The two headline composites posted their highest year-over-year increases since summer 2006,” said David M. Blitzer, chairman of the Index Committee at S&P Dow Jones Indices, in the report. “This marks the highest increase since the housing bubble burst.” Each of the 20 largest regions posted annual gains, led by the Atlanta, Detroit, Las Vegas, Los Angeles, Miami, Minneapolis, Phoenix and San Francisco metropolitan areas, which all posted double-digit annual gains. Out of the 20 regions tracked by S&P/ Case-Shiller, the New York region had the smallest gains at 0.6 percent compared to January 2012. However, the index measuring home prices in the New York metropolitan area was higher than the previous year for the first time in 24 months. “After more than two years of consecutive year-over-year declines, New York reversed trend and posted a positive return in January,” Blitzer noted.

dent of Cappelli Enterprises, said his company is interested in donating the building to the town rather than knocking it down in favor of open space. “There’s plenty of grass,” Apicella said. “We’ve already set aside 40 acres. People can run to their hearts content. We’re not looking to make a profit; we want to do something good for a community that’s been very good to us. Why would we knock the building down?” Cappelli Enterprises has taken a big hit on the residential complex since it opened in 2007. More than half of the units remain unsold, and the units that have been sold are selling at only 70 to 75 percent of what
Cappelli Enterprises was originally asking. Initial asking prices for the one, two and three-bedroom homes ranged from the mid-$500,000s to $1.2 million. Apicella said they are now asking $250 to $300 per square foot. Apicella blames the recession for the sluggish sales. “It is still a struggle,” Apicella said. “It’s a beautiful spectacular property with an unbelievable amount of amenities. You name it, we have it there. The economy has just sucked the life out of the project.” While Grace and Apicella tout the value of the building, Schroeder maintains that an agreement is an agreement. “Whether the building is worth $3 million or $3,000, there cannot be a building there,” Schroeder said. “Our situation and our mission are very clear on this.”

The man the accountants turn to Got money? Get the bull’s-eye off your back

A
ton of money has come your way: an inheritance or you sold the successful business or a large sum via your prowess from beyond the 3-point arc. It’s a bona fide Hallmark moment: You’re having a liquidity event! Somehow the wealth managers will find you. Those managers will, as Greenwichbased Ray Chodos tells it, need to distinguish themselves. “When wealth managers want a new client because of a liquidity event –” the quick acquisition of capital “– they need to be the prettiest girl in the beauty contest,” Chodos said. Eventually someone wins the beauty pageant and an agreement is struck. The talk is of faith and of rates of return. The client thinks all is well. Then, the post-liquidity event king or queen of the world, riding high in a Mercedes limo, skids on ice and rearends a pickup. Suddenly, the driver of the pickup is saying, “Hello liquidity event!” and the one-time king or queen is reduced to penury. It happens all the time – notably but not uniquely to pro athletes who seemingly routinely lose millions overnight – and it is not the financial adviser’s fault any more than it is the adviser’s task to point out you could stand to lose a few pounds. It is Chodos’ job as principal in Wealth Preservation Group (wealthpreserve.com) – an international consortium of attorneys, accountants and advisers – to make you an unappealing target. “What I do is insulate your wealth from those who would involuntarily part you from it,” he said. As such, he tends to receive references – 80-85 percent of his business – from those who see the books and who know the worth: accountants. (Chodos occasionally works with his son, Adam Chodos, a U. Penn- and Dukeeducated lawyer/accountant and Wealth Preservation Group member.) “Now, let’s say my Mercedes limo has rear-ended that broken-down pickup truck,” Chodos said. “Does a law firm take the pickup driver’s case? It might be a good case, but if there are no attachable assets, the law

“What I do is insulate your wealth from those who would involuntarily part you from it.” – Ray Chodos firm does not take the case. And the reason is that once a lawyer takes a case, the judge will usually insist that lawyer must stay with the case. It’s the attachable assets that make the case attractive to lawyers. It is very easy to find out assets in the public record; things in your name are generally attachable. “Culpability is important,” he said. “But more important is: Does the defendant have assets? After all, the lawyer has to be paid.” Chodos said the limo vs. pickup truck scenario takes very different paths if the limo is an entity unto itself. By New York state law, you cannot name an unrelated entity in a lawsuit. “So that means the plaintiff’s lawyers can go after the car, but they cannot go after, say, your house, which is owned by another L.L.C. “And what that means is: If you own 15 office buildings, do not make them a single corporation,” he said. Chodos’ skill at making people and businesses unattractive to lawsuits keeps him on
the move. His fees run from $5,000 to six figures, depending on the complexity of the assets. “I do not look for people; I’d say 80 to 85 percent of my business comes from CPA recommendations.” In one case, he digested 68 pages of documents – “wills, leases, mortgages, divorce agreements” – just to figure out what was needed to begin the insulation process. “But at this point, I still know only what they have given me. They might be up to something they’re not sharing, perhaps illegal activities.” A recent trip found Chodos in Las Vegas, where the owners of a large roofing company sought his advice. What Chodos found astounded him. “These were respected, confident business people, 66 and 58 years old and worth close to $15 million between them,” he said. “Yet they had everything in a single corporation: equipment, buildings, commercial lots in other states and $3 million in working capital. “They work with solvents, adhesives –
both toxic – and with flames. These goods have to be transported. And I told them what their exposure was. If adhesive fumes from one of their jobs should seep into a casino, I told them they could be reduced to zero. They told me their accountant had never mentioned this to them. They fired their Nevada accountant and hired one in New Haven.” On the financial end, the leap to insulation involves a leap from being a standard corporation (C Corp.) into a limited liability corporation (L.L.C.), a move that Chodos delegates to the CPAs. “It can require some complicated gymnastics to accomplish,” he said. Chodos’ consultations also involve insurers, with whom Chodos works closely. An anecdote reveals why he is needed. “It is very common for Canadians to own American businesses in states like New York and Minnesota with their common borders. Now let’s say the Canadian owner of a truck registered in Ontario is heading to a Canadian-owned business in New York and has an accident in New York. Who pays? The receiver? The sender? Is it ambiguous? What you do not know can definitely hurt you. “But we do not sell insurance,” he said. “We would not know the right questions to ask. We bring in paid consultants.” Besides asset insulation, Chodos addresses business succession. He spins a quick tale of multigenerational battles that come from failure to address this vastly under-addressed issue. “A successful man has a family; he has a business; the children are grown; then he starts another family; it’s a recipe for litigation.” The answer might be a trust, but Chodos is always circumspect. “There are so many factors,” he said. “That’s why I can never say to a client that I will take you on for $40,000. The analogy would be a doctor saying I’m going to take your blood pressure, but I won’t be listening to your heart.” Whether for asset insulation or business succession, Chodos allows himself a free rein to investigate, discussing details with insurers, human resources personnel, plant managers and attorneys. “I need to make them behave like a large company without the expenses of being a large company.” WCBJ • April 1, 2013

KATONAH MUSEUM OF ART The Katonah Museum of Art (KMA) is a cultural destination offering ever-changing exhibitions that feature art from all cultures and time periods. The museum attracts visitors from Westchester and Fairfield counties, as well as the larger tri-state region. Located at the northern end of Katonah’s “Museum Mile” just off Route 22 and near John Jay Homestead and Caramoor, the Katonah Museum of Art is a few minutes taxicab ride from the Katonah Metro North station. According to KMA Interim Executive Director Belinda Roth, the museum is, “a welcoming cultural oasis for art lovers of all ages. We strive to exhibit art that truly inspires and to offer exceptional education and public programs. The museum is a resource to help create and stimulate great thinkers and develop life-long learning skills.” The museum mounts 10 exhibitions per year in its main galleries, Sculpture Garden and Learning Center, a space where families can explore handson art activities. designed the 10,000-square-foot building where the KMA offers adults stimulating lectures, workshops, trips, and social events. Among the many programs for children and families are Stroller Tours, Family Days, Saturday Story Time, Schools Out/Arts In vacation day programs, and art classes for ages three through 12. The museum’s innovative Arte Juntos/Art Together program for underserved new immigrant families has been recognized as a model program by the federal government. The KMA’s current exhibition, Beyond the Bed: The American Quilt Evolution (on view through June 16), traces the dynamic evolution of the North American quilt from the beginning of the 19th century to the present day. The exhibition features some of the finest quilts from across the country. In the quilt lab, visitors can create their own quilt blocks, which will be used in community quilts to be donated to babies in the Bedford Hills Correctional Facility and My Sister’s Place, a Westchester County shelter for battered women. Visitors can also learn about the AIDS Names Quilt and how to design a digital quilt. The annual Spring Benefit, “Kaleidoscope,” will be held Saturday April 27 at the Museum and will begin with cocktails in the Sculpture Garden, followed by dinner and dancing. Center refines blocking technique

f you build it, they will come” worked swell for a movie ballfield carved into a cornfield. The new take on the adage as espoused by Legoland Discovery Center Westchester is: “If they build it, they will come.” At 32,300 square feet – about 75 percent of an acre – and containing 3 million plastic blocks, Legoland Westchester at 1 Ridge Hill Blvd. in Yonkers is the fifth such center nationally and 10th globally. United Kingdom-based Merlin Entertainments Group, the owner, puts the price tag to open at $12 million. It is expected to employ 100, though there was no listed breakdown by full- and part-time workers. Merlin runs sites globally, including in Australia, Hong Kong, China and 10 European nations. Merlin’s brands include the London Eye (the giant Ferris wheel on the River Thames), Madame Tussauds wax museums and several iterations of adventure lands, aquariums and wildlife parks. They attracted a total 46.4 million visitors in 2011, which was up 13 percent from 2010. The other four American Legolands are in Atlanta, Kansas City, Dallas-Fort Worth and Chicago. “We’re second to Disney in total visitors worldwide,” said Legoland Westchester manager Chris Mines, who assumes the reins having previously worked for Merlin at the London Eye and at the Las Vegas Madame Tussauds for

12 years total. “We began this Westchester program in November. Just to construct Miniland of more than a million blocks took 20 builders nearly six months to complete.” Miniland encompasses New York City and Westchester landmarks in day/night cycles that take just five minutes, not 24 hours. “It’s been a new experience, but real fun so far,” he said. The new Legoland can accommodate between 650 and 750 persons. The target audience is children ages 3 to 10 and their families. A birthday party offering begins
May 9. Mines said that after summer he would look to introduce corporate events. There is a 98-seat theater. Children must be accompanied, which prevents the site from becoming a daycare center. It is, in fact, something of an engineering school. “We encourage interactive learning between parents and children,” Mines said. There is an onsite Builder Academy to teach construction techniques. “The skills required to build a good model are the fundamental engineering skills,” Mines said. “We
even have an earthquake table. We switch on the power and if the building is not built properly it will fall. It really shows them the importance of a good foundation.” The site was set to open officially March 27, having already enjoyed a limited opening a week prior for 100 lucky gatecrashers from a pair of regional schools. Tickets are $18 for ages 3 to 12 and $22 for 13 and up; children under age 2 get in free. Prebooking perks include special ticket prices and priority entry to the attraction.

Reduce stress and increase productivity at work BY MICHAEL COCILOVO
W
ork can be a stressful place whether you earn your living in a corporate setting, home office, a factory, health care facility, school or other setting. Some stress is good. It motivates us and makes us stronger. Too much stress, however, can negatively affect our health and reduce productivity. Fortunately, there are specific things we can do to help us reduce our stress at work and better cope with it. 1. Make sure your workplace is cheery and well lit. Too often we tend to work in small, cramped areas that are dreary, dark and just plain depressing. One of the most important aspects of reducing stress is making sure we are happy and motivated to be at our workstation. So first, brighten up your space by painting your area a bright and cheery color if possible. Try to make sure you have access to bright, indirect outside light and a window that you can open for fresh air. If this is not possible, then at least make sure that you have ample lighting to illuminate your workstation. Improper lighting in a work environment can cause health-related issues

such as eyestrain, fatigue, physical stress and headaches. 2. Address the ergonomics of your workstation. Poor posture, lack of proper equipment and incorrect positioning of your computer and chair are all contributing factors to neck and back pain. Working at a computer can cause a lot of distress in a number of different parts of the body, including neck and back, shoulders, wrists and hands. Here are some simple things we can do to minimize these problems: • Seat height should be such that our thighs are horizontal, lower legs vertical, and feet flat on the floor or on a footrest. The seat height should also allow a 90 degree angle at the elbows for typing and the backrest should offer firm support, especially in the lumbar (lower back) region. • The computer monitor should be clear and easy to see without leaning forward or looking up or to one side. The height where the top of the screen is should be level or within 15 degrees below eye level, and less than an arm’s length away from you. • The computer keyboard and keyboard tray should allow for comfortable typing or keying. Your keyboard should be at a height that allows your elbows to be bent about 90
degrees and close to your sides. The computer mouse should be situated so that it does not require a lot of forearm movement or force. • If your job requires long periods on the telephone, then a telephone headset or speaker phone should be invested in so you avoid awkward neck and shoulder positions while talking and doing other tasks, such as typing. While many of these suggestions may seem minor, when your wrists, arms, neck, eyes or back are at an uncomfortable or awkward angle day after day for extended periods of time, the impact it has on your health will be major. While workplace injuries such as slips or falls are obvious in their impact on productivity and health, less obvious strains and pains can wreak havoc on your overall health and ultimately have a negative impact on productivity. Simple quick adjustments can often eliminate longterm problems. 3. Take breaks and remember to stretch. No matter how well a workstation is designed, problems may arise if attention is not paid to the way the work is done. Working at a computer often involves very few changes in body position and this lack of movement can lead to muscle pain and
strain. The best way to avoid this is by taking a break for a few minutes every hour spent at a workstation. In addition, simple stretches to the neck, shoulders, arms and wrists and low back are an important way of reducing the tightness and stiffness that often comes from sitting in one position for long hours. The ability to work in a comfortable and happy environment is a benefit not only to your health and mental attitude, but also to the bottom line.
