estchester County’s largest private owner of top-tier office buildings has signaled his part in changing the vacancy-plagued Platinum Mile with plans for a large-scale residential development on a corporate campus in White Plains. Robert P. Weisz, chairman and CEO of RPW Group Inc., told an audience at a recent real estate forum presented by the Business Journal’s parent company, Westfair Communications Inc., that he plans to build 300 units of housing on the 74-acre site of 1133 Westchester Ave., an approximately 620,000-square-foot multitenant office building that formerly was solely occupied by IBM. ITT Corp. has its global headquarters there and the county’s largest law firm, Wilson Elser Moskowitz Edelman & Dicker L.L.P., will relocate its Westchester office from the Gannett Office Park across Interstate 287 in Harrison to the 49-year-old Platinum, page 6

Lowey revives fair-pay legislation

With the national average at 77 cents, women in the region fare better than women nationwide. The comparatively better local figure earns no praise from the region’s long-serving female in the U.S. House of Representatives, Nita Lowey. She is now working to revive a plan that failed last year

to level the paying field. She calls the disparity “shameful.” But what Lowey sees as a remedy for genderbased discrimination is, in the eyes of a pair of prominent business groups, another regulatory millstone that threatens to drown them. Key to their argument is that differing jobs merit different pay – apples and oranges – despite efforts to quantify and analogize every task. They see changes to the current law leading to “second guessing” of pay decisions in the courts. Lowey, page 6

P

ast the foosball table, jukebox and green-lit bar in the corporate reception area, Dolf van den Brink’s office is the first on the left as one enters a long room of work cubicles at Heineken USA headquarters in downtown White Plains. In an open-collared blue shirt, the office’s 39-year-old occupant works at a computer monitor at a modestly sized desk. A visitor is surprised to learn the no-frills space, with a glass wall that exposes its occupant to passing office traffic, belongs to the company president and CEO. Van den Brink wanted that open visibility and smaller, more spartanly functional office when he arrived in White Plains in October 2009 after a four-year management stint as commercial director and deputy general manager of Bralima, Heineken’s operating company in the Democratic Republic of Congo. “Africa is very important to the Heineken Group,” he said in a recent interview at Heineken USA’s 12th-floor headquarters at 360 Hamilton Ave. “It’s one of the fastestgrowing regions.” His time in Africa was “probably one of the best learning experiences in my life, certainly in my business life. I kind of cut my teeth in terms of leadership, change, bringing people along.” Managing 12 beer and soft drink brands and a distributor network of 4,000 wholesalers, the Dutch businessman doubled the company’s market share and tripled revenue in Africa for Heineken. The company has been van den Brink’s only employer in a fast-rising 15-year career that began at Heineken Group headquarters in Amsterdam in the Netherlands. Though enjoying that success, “I was very thrilled when I got the call to move from Kinshasa, Congo, to Westchester New York,” a smiling van den Brink said. He arrived at a company that was losing share, with its brand reputation as an upscale import, in a market in decline since the recession. “The beer market

started slipping in 2008 and it really went down in 2009,” van den Brink recalled. “We went down faster than the total market.” Van den Brink replaced Don Blaustein as CEO of Heineken International’s U.S. subsidiary, a post Blaustein held only for two years. Blaustein succeeded Andy Thomas, who also held the top job at the Dutch brewer’s White Plains headquarters for two years. Van den Brink set about making personnel and physical changes at a company hobbled by a common corporate affliction: “a certain degree of complacency creeps into your organization,” he said. The young CEO set about turning formal and closed-off executive offices with dark wood walls into transparent, light-filled spaces. He replaced the CEO’s wall with glass. “People were able to look into my office,” he said. “It took about two weeks before people were comfortable walking past.” “You can’t breed creativity in a culture that’s very hierarchical, very formal and in these silos.” The new CEO listened to and shared his personal values with the office’s 120 employees and encouraged candor and transparency in the workplace. He continues to foster “the challenger culture,” van den Brink said, “where people dare to disagree, dare to be brave. …Be candid and speak your mind.” The CEO also had to address the outside forces and strategic issues challenging the company. Wine and spirits brands and the rise of craft beers had eaten away at Heineken’s market share. Two dominant mainstream American brewers in 2007 merged to form the MillerCoors joint venture. That was followed by the 2008 acquisition of Anheuser-Busch by Belgian-Brazilian brewer InBev to form the world’s largest brewing company. “You had this very dramatic industry landscape change,” said van den Brink. “We really were not paying attention to that to the right degree.” Heineken also had a reputation here as a one-beer company. “For 75 years we were a single brand operation,” van

den Brink said. “Today it (the flagship Heineken brand) is less than 60 percent of our portfolio. What we have done is build a portfolio on the shoulders of the Heineken brand and the Amstel (light) brand.” Heineken USA’s market resurgence has been driven by Heineken N.V.’S marketing agreement and $7.6 billion acquisition in 2010 of the Mexican and Brazilian beer operations of Fomento Económico Mexicano S.A.B. de C.V. (FEMSA), Mexico’s second largest brewer. The deal fueled Heineken’s growth in the multicultural and ethnic markets with beers that include the Dos Equis, Tecate, Sol, Indio, Carta Blanca and Bohemia brands from Mexico. Dos Equis is now the fastest-growing brand for Heineken USA. Sales volume of Don Equis Lager grew 25 percent in the U.S. last year and Tecate Light also grew strongly, according to Heineken N.V. in its 2012 annual report on global operations. Van den Brink said one of Heineken USA’s fastest-growing products is its Beers of Mexico package. “That’s a fundamental shift from where we were in the early 2000s, said van den Brink. “Last year we were growing ahead of the market again.” With first-quarter beer sales down this year in the U.S., Heineken USA’s sales to retailers declined in the low single digits, but still outperformed the overall market and gained more market share, its parent company reported. Under van den Brink, the company has targeted innovative advertising campaigns to the millennial generation whose oldest members are entering their 30s. The company has proven adept at social media

marketing and is the top-ranked beer brand among Facebook and Twitter users, according to a Heineken USA spokesperson. The brewer’s innovation in branding and packaging was seen again in March, when the company unveiled its redesigned Heineken “star bottle,” a taller, sleeker, more modern version of the iconic squat green bottle. Van den Brink sees more growth and innovation ahead for his company. “Where we play, the upscale or high-end, is really, really growing very fast,” he said. Imports such as Heineken’s account for about two-thirds of the high-end market while craft beers from domestic microbreweries make up about one-third, he said. With beer brands doubling in number every five years, crafts and imports “are having to be squeezed into the same coolers in the grocery stores,” van den Brink noted. “The trick is to stay on the shelf. That’s a real battle.” “There’s also a battleground for tap handles,” the CEO said. Heineken USA has added sales staff and has “put a lot of new resources” into its on-premise business selling its draft beers. The company last June launched Passion4beer.com, a website designed as an informational resource for bar professionals. To compete in the growing spirits segment of the alcoholic beverage market, Heineken last year acquired U.S. distribution rights to Strongbow, the country’s number-two-selling hard cider. “Cider is at this moment one of the fastest-growing alcohol segments,” van den Brink said. And Heineken aims to market one of the world’s leading cider brands.

Opposition to Pleasantville development Senior living facility targeted

A

citizens group has formed to oppose an assisted living facility in Pleasantville. Developers are not backing down. United Homeowners of Pleasantville opposes plans by Benchmark Senior Living, a Wellesley, Mass.-based for-profit provider of senior care. Benchmark proposes turning a 3.5-acre parcel behind the United Methodist Church at the intersection of Bedford and Maple Hill roads into a 24,000-square-foot, 87-unit assisted living facility. Benchmark is in contract with the church to buy the property, contingent on receiving approvals from the village of Pleasantville. The company filed an application with the village to create a floating zone that would allow assisted living on parcels larger than three acres. The Pleasantville Board of Trustees voted itself lead agency in February and is considering the proposal. United Homeowners of Pleasantville, mostly neighbors of the property, fears the facility will be out of character with the neighborhood and the village. An online United Homeowners petition has garnered 56 signatures and the group has circulated a flyer throughout the village. William Stoller, a member, thinks it is wrong to put such a project in a residential neighborhood. “This area has been zoned for single-family homes since the 1950s,” Stoller said. “An assisted living facility is simply out of place. These types of developments go in downtown or in a commercial area. Not a residential area. There is nothing like this on that side of the village. It’s big and inappropriate.” The members of United Homeowners of Pleasantville have previously opposed other attempts by United Methodist Church to sell its property to developers, but Stoller said they would have no objection if the plan shifted to residences. “Benchmark isn’t residential,” Stoller said. “It’s an institutional facility with elderly people in their mid-80s. Many of them are in wheelchairs that need help.” The group also has concerns about the potential traffic impact with staff arriving around the clock, and fears it will be a drain on police and the ambulance corps. Proponents of Benchmark feel it will bring much needed property tax revenue to a village struggling to stay within the tax cap. But Stoller does not think this project is the way to raise revenue. “You’ll save a few hundred dollars, but change the nature of the village forever,” Stoller said. “As the process continues, people will see this is not within the character of Pleasantville.”

In response to initial complaints from residents and the New York state Department of Transportation, Benchmark changed the entrance point, using Bedford Road instead of Maple Hill Road. The Maple Hill Road entrance involved vehicles cutting through the church lot and was met with criticism. David Steinmetz of Zarin and Steinmetz, the White Plains law firm representing Benchmark, said he and Benchmark representatives met with 40 residents to discuss their concerns before submitting an application. “I don’t know anything about this organization,” Steinmetz said. “It seems like they oppose any attempt at development specifically at the Methodist Church.” Steinmetz and village officials contend the opposition flyer contains inaccuracies and the village issued an open letter to address some of the claims.

The flyer states if the village grants Benchmark a floating zone, the move would allow senior facilities anywhere in Pleasantville. The village said the floating zone would require a minimum three-acre site along a state or county road for a facility to be built. “Nobody should be misguided by any information contained in the flyer,” Steinmetz said. “The application is going to be reviewed and judged based on the empirical data presented by Benchmark and the facts surrounding the application.” Opponents also question Benchmark’s financial dealings. “Benchmark has a clear desire to create value for its financiers,” Steinmetz said. “It’s going to run a quality first rate appropriate facility.” Mayor Peter Scherer said the village asked Benchmark to provide more information about the visual impact and landscaping.

“There is no decision imminent,” Scherer said. “There is still a lot of work to be done before any proposed acceptance of this. The neighbors are simply exercising their right to free speech.” Scherer said the village board will hold a work session with the planning board to discuss the Benchmark application. “We take that responsibility seriously,” he said. Trustee Mindy Berard said the situation becomes difficult when a group circulates alleged misinformation. “Everybody should be playing with the same set of facts,” Berard said. “Everybody has a right to speak out, but speak out factually. I wish people would be more responsible.” Berard said developments like Benchmark are one of the only ways to increase the tax base. “These are important fiduciary responsibilities we have here for the village,” Berard said. “I am looking forward to the process.”

Jobs rebound

State and regional uptick; some sectors lag BY SAM BARRON sbarron@westfairinc.com

T

he state’s private sector job count reached an all-time high in March, with unemployment declining broadly but not universally. Regional data echoed state figures. Utilities, transportation, health care and teaching witnessed job growth. But government, construction and manufacturing continue their anemic jobs picture and according to a White Plains staffing company, the Affordable Care Act’s full reckoning poses a hiring question mark. According to figures released by the state Department of Labor, New York added 14,100 private sector jobs in March, with a total private sector job count of 7,426,100. The state’s unemployment rate fell to 8.1 percent, down from 8.8 percent last month. Westchester posted an unemployment rate of 6.8 percent; Putnam was at 6.3 percent; and Rockland 6.4 percent, among the lowest rates in the state. All three counties saw improvement: Westchester’s unemployment rate decreased from 7.2 percent for all last year, Putnam from 6.6 percent last year, and Rockland

from 6.8 percent. Putnam, Rockland and Westchester have a combined unemployment rate of 6.7 percent, down from 7.5 in February and down from 7 percent for all last year. The region has a lower unemployment rate than the state and the U.S, which both hover at 7.6 percent. The three-county region’s unemployment rate is second among metropolitan regions, behind Ithaca, 5.3 percent. The seven-county Hudson Valley region, which also includes Sullivan, Ulster, Orange and Dutchess counties, has an unemployment rate of 7.2 percent. From February to March, the three counties added 5,000 jobs, a 1.1 percent increase to the total employed number of 469,100. Trade, transportation and utilities in the three counties gained 1,900 jobs over the past year, a .8 percent increase and 400 jobs over the past month, a .4 percent increase. Professional and business services added 3,200 jobs over the past year, a 4.5 percent increase and 2,100 jobs over the past month, a 2.9 increase. Education and health services added 1,100 jobs over the past year, a 0.9 percent increase and 200 jobs over the past month. Over the past year, construction shed 1,000 jobs, a 3.5 percent decrease, while

manufacturing shed 800 jobs, a 3.2 percent decrease jobs. The two industries were flat month to month. The public sector continues to decrease, with government jobs decreasing by 900 over the past year, a 1 percent decrease and 300 over the past month, a 0.3 percent decrease. The region’s job growth rate continues to lag behind the rest of the state, ranking ninth of 14 metropolitan regions. Staffing companies have seen firsthand the improved job market in the region. Richard Greenwald, president of Concorde Staffing Group in White Plains, said business has been increasing. Overall, he noticed businesses are hiring more full-time employees “We are seeing a significant jump in terms of companies inquiring about other people,” Greenwald said. “Things are moving in the right direction. Hopefully the trend will continue.” Despite seeing growth, Greenwald does not think the job market will return to prerecession levels. “If a company laid off 10 to 15 employees, they might hire five people back,” Greenwald said. “They’ve been able to go without those employees for so long, they have become more efficient.

Weisz building this year. RPW Group bought the office property in 2006 from IBM for a reported $76 million. Weisz’s plans to develop a 150-room extended stay hotel at the front of the property, announced in 2007, stalled in the subsequent recession and have not been revived. Weisz said his residential development is in early planning and it would be “premature” to talk in detail about it. No plans have been submitted to the city of White Plains, he said. Still the prominent developer’s announcement pointed to the growing momentum for adaptive reuse of the county’s underoccupied office parks among both municipal officials and real estate professionals. As at 1133 Westchester, the reuse proposals include residential construction designed to attract both young professionals who cannot afford to buy homes in Westchester’s pricey housing market – a demographic and membership focus of both leading business advocacy groups, The Business Council of Westchester and the Westchester County Association (WCA). The new mixed-use developments also would serve older downsizing residents who increasingly choose to stay in the county after retirement, Weisz said. The city of White Plains last year revised its campus office zoning to allow residential and retail uses in planned office park developments. The town of Harrison is considering

In Lowey’s District 18, the Labor Department reports the average male earns $67,866, while the average female earns 83 percent of that: $56,507. In Sean Patrick Maloney’s District 19, the numbers are $64,051 for men and $50,774 for women, a gap of 21 percent. In Eliot Engel’s District 17, men earn $50,165 to women’s $43,059, a 14 percent gap. The Paycheck Fairness Act has been reintroduced in the 113th Congress and Lowey is a co-sponsor of the bill. She reports it is currently pending in the Education and the Workforce Committee. There is also a so-called “discharge petition” circulating in Washington, D.C., which Lowey has signed. If the petition gets 218 signatures the bill will have to be considered by the full House of Representatives. As of April 22, the discharge petition had 188 signatures, Lowey said. “Our country has a shameful wage gap,” Lowey told the Business Journals via email. “The women of this country and their families deserve better. That’s why I voted for the Lilly Ledbetter Fair Pay Act and why I am a co-sponsor of the Paycheck Fairness Act,

similar changes to its comprehensive zoning plan. “We’re frankly not inventing anything,” Weisz said of his housing proposal, which would be the first such venture for a commercial landlord who for more than three decades has focused on acquiring and redeveloping office, retail and warehouse space. “We’re following the trend. …People want to live where they work and play.” Others on the panel of real estate and government experts agreed that housing is the biggest problem facing Westchester County. “What we need to address is housing,” particularly affordable housing for office park workers, Weisz said. White Plains Mayor Thomas M. Roach saw a ready market for new housing in White Plains among young employees. “The next generation is not putting up with an hour in the car to get to work,” he said. “The young people don’t want to drive because it interferes with their ability to text.”

Roach predicted a residential flight from the exurbs to suburban cities such as White Plains. “That’s what I’m going for, full tenancy in White Plains, and then all you guys will do much better,” he told a real estate industry audience. “Since I’ve been mayor, we’ve been pushing very hard to make (White Plains) a cool place,” attracting young adults “Young professionals are demanding places to live” in the county, said Marissa Brett, WCA executive director for economic development. They want office park residences that also have retail and entertainment amenities, she said. “The reality is you have to have that lively 24/7 excitement,” said George M. Constantin, president and CEO of Heritage Realty Services L.L.C. Constantin, whose company owns the soon-to-be-renamed Gannett Office Park in Harrison, said the rise in vacancies on the Platinum Mile “presents the opportunity to bring in change and modernize. The reality

is, office buildings have to change over time; we need to modernize them and need to be competent on a global scale.” Weisz said the “tremendous vacancies” in the county’s office parks are “mainly a result of buildings being old. We have one of the oldest inventories in office buildings.” “Westchester County is still going through a transition period,” said Stephen M. Banker, executive managing director at Newmark Grubb Knight Frank in Greenwich, Conn., “a transition period that was caused by IBM’s mass exodus from the market. It’s going to take time.” Weisz said he thinks the county’s current glut of office space will be reduced by “the combination of new owners addressing these issues and municipalities addressing the zoning issues.” With the work-live-play concept being adapted here, “I think we’re going to see a very different landscape in the next five to 10 years,” he said.

which would strengthen and close loopholes in the 50-year-old Equal Pay Act.” The Lilly Ledbetter Act was passed in 2009 and is credited with improving women’s pay via legal recourse. Lowey and others cite pay data that demonstrate the law is flawed and needs revision. The Paycheck Fairness Act looks to close perceived loopholes in federal wage regulations, including more workplace openness concerning wages. The new law also targets sex-based discrimination in general and imposes stronger deterrents to stop it. The Paycheck Fairness Act differs from the Fair Pay Act, also as yet unpassed, which would ensure equal pay for jobs that are comparable, but not identical. The 160,000-member American Association of University Women is backing both resolutions: the Paycheck Fairness Act (H.R. 377) and the Fair Pay Act (438). Paying men more than women for the same job has been illegal since 1963. But enforcement of the law is weak, contend supporters of the Paycheck Fairness Act, including the American Association of University Women, which has winnowed the data and claims a third of the pay disparity cannot be reasoned as anything but discrimination. Opponents believe otherwise.

“It would no longer be permissible to pay employees differently based on market forces, negotiating ability or even the amount of revenue they generate for the employer’s bottom line unless the employer could prove it was a ‘business necessity,’” reports the U.S. Chamber of Commerce in a message to members. The Paycheck Fairness Act, the chamber contends, “would open up compensation and employment decisions to secondguessing by courts and juries, and would ultimately lead to an inefficient, cumbersome and costly salary-setting process.” The National Association of Manufacturers in a recent letter to U.S. senators, said, “It also would allow women to seek compensatory and punitive damages for pay disparities, and make it easier to pursue classaction lawsuits in these cases. As a result, employers would be exposed to increased threats of litigation – even when unintentional pay disparities may have occurred. “The Paycheck Fairness Act almost certainly would compel many employers to purchase additional legal liability insurance, increasing their costs and limiting their ability to raise wages, increase benefits or hire new workers,” said the manufacturers’ letter. Both the national chamber of commerce

and national manufacturers contend the real beneficiaries of this law would be trial lawyers, not women. When the Paycheck Fairness Act was scuttled last year, U.S. Sen. Kirsten Gillibrand said, “Shortchanging women on the job doesn’t just rob them of a fair paycheck. It makes families less secure and slows economic growth across the board. With more dual-income households than ever, and with more families relying on working mothers to make ends meet, the key to economic growth and security for the middle class is equal pay for women.” The federal Bureau of Labor Statistics reports 41.5 percent of New York state households rely on women as the primary breadwinners and that women account for 42.6 percent of all family earnings. Those numbers, among others, have led to the naming of April 9 as Equal Pay Day, “a day symbolizing when – more than three months into the year – women’s wages finally catch up to what men were paid in the previous year,” Lowey said. As Senate bill No. 84, Lowey reports the Paycheck Fairness Act could reach the Senate floor this month, but is unlikely to muster the 60 votes required to move it forward toward a possible House reconciliation effort.

hen “Radiance” begins performances May 2 in Pleasantville, it will mark the latest production of Axial Theatre, a nearly 15-year-old professional company dedicated to presenting new work. That mission is not only Axial’s distinction, but also the biggest challenge it faces every time it takes to the stage, said Howard Meyer, the group’s founder and artistic director. Speaking recently at the company’s home of the past four years, St. John’s Episcopal Church, Meyer reflected on Axial’s carving out a niche in the face of some very real obstacles. “Our mission is to do new plays, so we are not producing Arthur Miller. We are not producing ‘Annie,’” he said. It might bring excitement to the local arts landscape, but also makes drawing an audience tougher. “The tendency is to go to what you know,” Meyer said. “That’s been a challenge, the fact that we’re not going with household name recognition, whatever it be, playwright, director, star.” But Axial is creating something unique, Meyer said, operating on what in the trade is called “a company model,” where actors, directors and playwrights are both paid and work year-round. “This is always a coveted thing, to create an environment where there’s continuity,” he said, noting he’s committed to having each of the company’s 15 members involved in each production. Axial also took a very practical and forward-looking step in the fall of 2011, bringing in a managing director to focus on marketing and audience development for the company with a $200,000 annual budget. Jaki Silver, a New York theater veteran, welcomed the role. “We’re trying to create and brand ourselves more and more,” Silver said. To that end, she cultivates tie-ins with local businesses, from bars to restaurants, with opening nights also featuring wine-andcheese receptions. But, she added, there’s still a lot to be done to increase attendance. “It’s not an easy sell,” she said of the new-play mission. “It’s so much building an audience for something they don’t know they want.” But, Meyer added, Axial – which has earned critical and audience praise – has built a solid foundation. “We attract people who are looking for something more edgy or unique.”

Axial’s audience members, he added, tend to be in their 30s and 40s, “which is nice because they can grow with us.” Axial also works with a number of guest artists and has had success drawing those in the region looking for a professional environment to develop new work. “We’re as committed to developing as we are to producing,” Meyer said. “That’s super important to us, engaging the Westchester artistic community.” Axial started in 1998 and has presented more than 40 theatrical events, from full productions to staged readings. All is an outgrowth of Howard Meyer’s Acting Program, which began in 1994 and today trains more than 125 students of all ages each year. Student productions are presented in January and August, which complement the main Axial shows each spring and fall. Some former students have gone on to Broadway (“Once”) and television (“Boardwalk Empire”), but the work of the students is more important than the acclaim. As Meyer said, “We don’t have a ‘star’ graduate yet, but who cares?” Silver, the managing director, echoed that the message is key. Those involved with Axial, she said, “strive to do work that really is a social dialogue.” “Radiance,” written by Meyer, directed by Christopher Grabowski and featuring Obie Award-winning actor Christopher McCann, explores both toxic environments and toxic relationships against the backdrop of Los Alamos National Laboratory in New Mexico. Yes, it’s a play by Meyer, who said he realizes that might raise a few eyebrows. But, “Radiance,” he noted, has earned outside acclaim, a semi-finalist at the Eugene O’Neill National Playwrights Conference in 2011 and 2012, among other recognition. Meyer said it would be foolish to “put a play on the stage that’s not as good as anything else. … There’s no way this place could succeed if it were a Howard Meyer vanity production.” At the company’s annual benefit in late March, the theater’s home – basically a church hall where the stage is designed to suit each production – was transformed from cocktail party to auction room, nightclub to theater all in the span of a few hours. And at the end of the successful evening, it had served as yet another way to raise both Axial’s profile and funds for its future. After all, said Silver, “It’s a small business like any other. Our business just happens to be live theater.” Axial Theatre will present “Radiance” by Howard Meyer May 2-19 at St. John’s Episcopal Church in Pleasantville. nvestors and executives in biotechnology companies at a panel on biotech capital saw a strong funding market for a more mature industry, though some cautioned about potential financial failures among the growing numbers of unaccredited investors in complex biotech companies. The panelists spoke at a recent breakfast meeting in Tarrytown of ACG New York Inc., the metropolitan chapter of the Association for Corporate Growth. Scott Livingston, a nanotechnology investor and chairman and CEO of Livingston Securities L.L.C. in Manhattan, said the biotech funding market “is as good as it’s been in a long, long time.” That is due to lab technology advances at companies and a strong equity capital market, he said, and in large part to the federal JOBS Act of 2012, which eases regulatory restrictions on smaller stock offerings and allows crowdfunding for small investors and emerging growth companies and small businesses. “That has the potential to permanently change the biotech funding environment for earlier-stage companies,” Livingston said. Livingston later wryly noted that the crowdfunding phenomenon also will give rise to business fraud and lost securities investments. “If I were a parent sending a kid to law school, I would tell them to specialize in class action law and sue all those crowdfunding websites,” he said. “This group of crowdfunding (sites) is going to go out under a mass of lawsuits.” John J. Pacifico, president and CEO of Orthocon Inc. in Irvington, warned that crowdfunding and the JOBS Act could bring unaccredited stock investors to biotech companies. “People who don’t really understand the complexity of investing in biotech are starting to invest in biotech,” he said. “That could create a potential disaster” and lead to a cycle of financial failures, investors leaving the market and new legislation and protections that bring in new small investors. He and other panelists cited the maturing of the biotech industry in the U.S. “A lot of fat in the system has been taken out,” Pacifico said. Companies that have gone public “have now actively delivered on their promises,” he said. The market is investing in biopharma and medical companies with “highly defensible” intellectual properties, Pacifico said. Investment in those companies will continue “primarily because of the defensible posture that they have.” Arthur Klausner, CEO of Utah-based

Jade Therapeutics and Gem Pharmaceuticals L.L.C. of Alabama, said public stock offerings in biotech today “are for companies who are very close to having revenues or have revenues. The time for companies to go in with great IPOs is gone.” “I don’t see a crash of the biotech stocks, but I think when the market corrects, you could see the bio stocks overcorrect,” Klausner said.

CEO John Pacifico Livingston noted that Regeneron Pharmaceuticals Inc. in Greenburgh, the state’s largest biotech company, survived several market crashes “and they’re worth $10 billion now. So keep investing.” Livingston said major investment firms such as Goldman Sachs and Morgan Stanley “are not part of the answer” for biotech companies going public for financing. “We need to change the way IPOs are done,” he said. “We need to have local companies become local champions of the economy” and invest in these early-stage companies. One such biotech company in Yonkers, Contrafect Corp., this month announced it has a new international equity investor. Chinese billionaire Shengda Zan and his Zongyi Group’s $8.6 million investment will help finance initial clinical trials of Contrafect’s drug treatment for potentially fatal bacterial bloodstream infections. Laurence Gottlieb, CEO of Hudson Valley Economic Development Corp., told the ACG crowd of efforts by public and private officials, including Scenic Hudson board member Steven C. Rockefeller Jr., who heads his family’s capital investment company, to connect the Chinese with companies in the region seeking an equity infusion. “It wasn’t easy to find people who were willing to meet with these folks,” Gottlieb said. Dr. Robert Nowinski, founder and CEO of Contrafect, twice visited China to meet with his company’s potential partners. Gottlieb said the Zongyi Group’s investment in Yonkers “is the largest investment out of China to a private biotech” company in the U.S.

r. Erika Schwartz, a national expert on bioidentical hormone therapy, wellness and disease prevention, is an advocate of change when it comes to health care. “Our whole health care system is based on disease identification and treatment,” she said in a recent interview. “Hopefully more money will be spent on prevention.” Schwartz said too many people are reacting to a diagnosis rather than working to prevent one. While acknowledging the importance of tests such as pap smears, mammograms and colonoscopies, Schwartz said they are not preventative. “All of those were really (developed) just to diagnose disease, to find them early.” Schwartz, a onetime director of emergency medicine at Westchester Medical Center, said when she went into private practice, she recognized the need for a change in focus. “What I do is really prevention and wellness,” she said of the care and education she offers through a Manhattan office, lectures and teaching and her published works. A new edition of her definitive 2002 book on hormones will kick off a series of books, with “A Healthcare Manifesto: The Hormone Solution Update” due out soon. In addition, Schwartz said The Bioidentical Hormone Initiative, a group of physicians dedicated to the treatment of age-related endocrine dysfunction, is another way she is hoping to make an impact. Affiliated with SUNY Downstate College of Medicine, the initiative works to help educate the next generation of doctors. “We provide them with continuing education credits,” she said. Sometimes, she said, the search for knowledge and commitment to help somehow get lost in the technical – and the ego. “I find that by the time they’re third year (students), they’ve forgotten what they’re there for.” Schwartz said today’s schooling is clinically sound, but she feels it should go further. “The medical education is at fault,” she said, but adds that doesn’t surprise her since it’s been that way for centuries. “The focus has stayed on sickness and the treatment of sickness.” She continued, “Even if you do see a doctor, most of us don’t really listen to what the doctor has to say.” Since people are “mostly healthy,” she noted they often only consult a doctor when things are not right.

Often, then, the doctor doesn’t know them well and scrambles for a quick fix. They might rely on electronic records to skim your history, spend a short amount of time with you, make a quick evaluation and send you on your way. “Why do we so sheepishly accept that? And we take that from everybody.” Schwartz says it was nearly 20 years ago when she made a change in her own practice, realizing the norm just wasn’t working. “I was kind of wasting my patients’ time and money,” she said. Time between appointments, she said, was basically spent “waiting for them to get sick.” Instead, now she sees the time as an opportunity for maintaining and improving health through diet and exercise to other lifestyle changes, including supplements and hormones. All are part of the same goal: “The outcome of taking them correctly and balancing them is really prevention.” Schwartz never seems to tire of discussing the doctor-patient relationship. It might be part of her commencement speech this year at SUNY Downstate, where she will become president of the board of managers in May. And it was also the topic of a recent lecture in Venice. Schwartz said what she has cultivated in her patients is an awareness she hopes becomes commonplace, a recognition that “the responsibility for keeping ourselves healthy belongs to us.” And the power of this shift in perspective should not be underestimated. “It’s not teaching people to stay forever young, but teaching them to stay healthy.” For more on Dr. Erika Schwartz, visit drerika.com.

don’t rush to get a new employee on board I was in too much of a hurry last year and hired the wrong person. It turned into a real headache as we clashed about nearly everything, from how to do the work, to who was responsible for what. Finally I let her go. It cost me a lot of time, energy and lost opportunity. What can I do different next time?

thoughts of the day: Assessing pre-hire is crucial, if difficult. Understand your company’s culture. Take the time to build a hiring system. Train new hires on culture as well as skill. Build bench strength and deal with mistakes quickly. Most interviewers focus on interviewing for job skill. Statistics indicate that hiring managers are doing a good job of figuring out which candidates have the skills needed to do the job and which don’t. Only 1 in 10 fails for skill. Spend more time learning how to perfect the attitude/behavior interviews. Recognize that every company is unique. Specific skills

are needed to perform tasks specific to the company. There are also attitudes and codes of behavior unique to each company. Entrepreneurial companies have cultures that tend toward throwing people into the deep end of the pool, asking people to solve problems with imperfect information, encouraging people who continue to learn new things and rewarding people who take initiative well beyond the defined scope of their job. That’s fine as long as you hire for those attributes. But watch out if that’s your culture and you hire someone who values a well laid out set of procedures, someone who waits for the boss to give direction, who avoids risk and who values routine, repetitive activities. Right person, wrong company. Make a list of attributes that do and don’t work in your company. Look at the strongest and weakest performers in your company today. Put skills aside, list successful and unsuccessful behaviors and attitudes. Build a set of questions that help you find out where candidates are coming from relative to your company’s success behaviors. Ask candidates questions about what they prefer. Ask candidates to describe their best

and worst bosses. Ask them to relate attributes and behaviors of those bosses to what works and doesn’t work for them. Use the same questions on every interview and keep notes on candidate answers on file. Track successful and unsuccessful hires and compare with interview answers. Look for patterns. While you don’t want a company of robots, it is important to recognize that culture and values can be the glue that binds employees together. Put new employees through an orientation program to help them understand the company’s stated and implied rules of behavior. Assign a mentor to each new employee. Encourage diversity of backgrounds, while developing a uniform code of behavior. as much as possible, hire from the bottom; train and promote. Have every person in the company be responsible for identifying and training their replacement. Four things will result. One, new hires who don’t make it will be at the entry level, lowest risk, easiest to fill positions. Two, employees in line for promotions will have already proven themselves on culture fit. Three, employees will know they fit and have a future within your company. Four, it will be much easier to fill open

positions, focusing on skill training rather than culture and behavior. Even with a system to hire, a sound onboarding process and a program to grow talent internally, you’ll still make hiring mistakes. It’s impossible to be perfect all the time. When there is a problem address it quickly. Implement skill and behavior training and look for immediate results. Assess the facts of the situation and avoid living in the land of hope. If things don’t turn around quickly, be prepared to admit there’s a mistake and encourage the employee to move on. Looking for a good book? he healthcare sector is a key economic engine for Westchester County and the surrounding region. It employs 30,000 people, making it the largest employer by far, and generates approximately $10 billion in economic activity. But this vital sector faces dramatic changes due to the Affordable Care Act and ongoing shifts in market forces.

WCA’S HEALTHCARE CONSORTIUM WILL HELP REGIONAL HEALTHCARE INDUSTRY STAY AHEAD OF THE CURVE

To get ahead of the curve, the Westchester County Association (WCA) has formed the WCA Healthcare Consortium, comprised of over 50 CEO’s, senior executives, and experts in healthcare, business, and academia, to proactively manage change. The goal is develop a plan to create a more efficient and effective healthcare system at a reasonable cost for all. The Consortium is an outgrowth of the WCA’s Blue Ribbon Task Force on Healthcare Reform, and was announced at a press conference on April 10th. Bill Mooney, WCA president, points out that with looming revenue cuts and rising costs, “There is no question the region’s healthcare sector is facing unsustainable pressures.” Mooney notes that the WCA formed the Consortium because “we want to take charge of our own destiny as a community and bring together the best minds in the business community and the healthcare community to begin to resolve some of the issues.” Current Consortium members include CEO’s and senior executives of hospitals, large physician groups, home care agencies, nursing homes, assisted living facilities, insurers, trade associations, and business, as well as leading healthcare experts in the County’s academic institutions. What unites all of these stakeholders is one common threat: uncertainty. Hospitals and other providers need to figure out how to coordinate care across different silos, while businesses face a dizzying array of choices in complying with ACA and providing health benefits to employees. This uncertainty has instilled a sense of urgency among Consortium members to shape what happens in our region in healthcare. “We have come together as a community, getting all the intellectual capital in the room from the healthcare industry and private business, to drive efficiencies and to stay ahead of what, quite frankly, could be fairly described as—potentially—a tsunami for employers, employees, retirees, hospitals, doctors, nurses and for everyone in our community,” Bill Harrington, WCA chairman explained at the press conference. He added that healthcare “is the driving issue that business should be focused on.”

E

very July 4th, the TV channels roll out “Yankee Doodle Dandy,” the story of Broadway’s Cohan family that won Jimmy Cagney an Oscar. “Mr. President,” Cagney intones, “My mother thanks you. My father thanks you. My sister thanks you. And I thank you.” The Cohans would appreciate that something of a stage sequel rose in their wake and that, still, the show must go on. A familycentric showbiz family named Prince – originally out of White Plains, now Mount Kisco, and originally mom, pop, brother and sister – continues across 50 years and 300 events annually to break a leg by giving the audience what it wants. “When we started, it was mostly orchestra music,” Jill Prince said. “Now, we find the client’s needs and match them with the music and entertainment that would fit their event.” That match could mean the classical strains of Mozart or the hip-hop beat

of Beyonce. It could mean photo booths, or jugglers, or a Vegas night with croupiers and showgirls, even living statuary. Music, however, remains a powerful part of the equation. “If I go to an event and there’s no music it’s sort of flat, no pun intended,” Jill said. “It makes for a better ambience.” Fifty years ago, Westchester County bandleader Hal Prince – no relation to the Broadway producer/director – and his singing wife Anabel founded Hal Prince Music and Entertainment. They had met when he was trumpet player in the Concord Hotel house band in Sullivan County and she was a singer in the lounge. Their coworkers included Buddy Hackett and Steve Lawrence and Eydie Gormé. The Princes’ boy Jay, now 56, and girl Jill, “forever young” in her words, joined the troupe and it is going strong today as Hal Prince Music and Entertainment, handling the full panoply of entertainment for the full gamut of events. Jay called his house band work “our meat

and potatoes,” saying he performs about 80 gigs per year. His résumé include guitar work for disco queen Donna Summer. Jill, although a trained classical pianist and former Jazz Band member at Yonkers’ Roosevelt High School, handles the business side. “At weddings we can provide 10 violinists to play as the guests stroll from cocktails to the dinner,” Jill said. For those with a medieval bent, Hal Prince can arrange for heralding trumpeters in medieval tights. A reception can feature a DJ, the Jay Prince Band (10 to 15 pieces) or a combination of both. When Hal Prince hires musicians, Jill said, “They are the best musicians in the tristate area.” The company provides DVDs of its contract talent for advance planning. Corporations and nonprofits are among the Hal Prince’s 300 clients-events per year. Jill said photo work is popular at business gatherings, whether ongoing during the event and broadcast on plasma screens or as a red-carpet paparazzi-themed entrance. “We supply the photographers, celebrity lookalikes, even the plasma screens,” she said.

“Whatever is required.” A recent trend, Jill said, is for a DJ to spin songs while a live backup band plays. She called it “the equivalent of really amazing karaoke at your party.” DJs are popular at younger gatherings, including bar/bat mitzvahs, while the recent Business Council awards dinner in New Rochelle featured a Hal Prince-designed Hollywood reality. Hal Prince died in November 2010, but Anabel still sings, dividing her time between Florida and Somers. “She was an orchestra leader for many years and now sings primarily for enjoyment in her community chorus,” Jill said. “She’ll sing for friends, at events, breaking into impromptu song. If it’s a milestone birthday, she’s likely to sing something.” The company’s talent stable includes bands, orchestras, DJs, string quartets, harpists, strolling violins, soloists, duos, trios, theme bands, jazz groups “and more.” Besides its Main Street, Mount Kisco, office, Hal Prince maintains a presence in Manhattan by appointment at 146 E. 37 St. The web address is halprince.com. Dessi came up with the idea when he heard about a successful Long Island digital summit and wanted to host one closer to home. He noticed no one had registered the domain name westchesterdigitalsummit.com. He registered it and the event was born. “I thought, ‘OK, I guess I am producing it,’” Dessi said. “I couldn’t believe there was nothing like this in Westchester.” After finding a partner in Zanzarella, he set out finding a keynote speaker, focusing on best-selling oenophile and social media pioneer Gary Vaynerchuk, who runs winelibrary.com. Dessi had an inside connection, having worked with Vaynerchuk at Buddy Media, a software company. Once Vaynerchuk said yes, the floodgates opened. “We had 67 applications to speak,” Dessi said. “We were able to create a really diverse roster of speakers. It’s a global digital summit that just happens to be held in Westchester.” Speakers besides Vaynerchuk include representatives from Westchester companies like Heineken USA Inc. and IBM Inc., as well as from Facebook and FOX News. Forbes Magazine named the gathering “a conference to attend” in 2013. “We want to get people excited and shake things up,” Dessi said. “I want to expose these businesses to digital marketing and show them that there are vendors outside of Westchester.” Dessi said it was a thrill to get speakers like Brandon Steiner of Steiner Sports Marketing Inc. and Josh Glantz of Publishers Clearing House Online. “We are a premiere county, the seventh-wealthiest in the nation and there is nothing like this here,” Dessi said. “I am excited to get people thinking. I don’t do conferences for a living; I just wanted to bring this exposure to Westchester.” To date, 350 people have signed up for the conference, from high school and college students to entrepreneurs, small business owners to CEOs of major corporations. “We’ve got everybody, which is part of the idea,” Dessi said. “Everybody is affected by digital media. Businesses don’t know what they don’t know.” Dessi expects the summit to become an annual event while also hosting smaller conferences throughout the year discussing issues like search engine optimization, email and social media. For Dessi, the light-bulb moment came when he attended a conference in 2008, as

part of his former job in ad sales. “I was bored out of my mind and on my fourth cup of coffee,” he said. A presentation by Vaynerchuk stirred him to action. “ Va y n e r c h u k said that if you’re into Smurfs, blog about Smurfs,” Dessi said. “Find a way to monetize it. It was like being hit in the head with a 2 x 4. That’s the way I Vaynerchuk want people to feel when they leave the summit. I want people’s heads to be spinning.” Too many small businesses have a myopic view of social media, Dessi said. “You need to have an understanding of search engine optimization and how it works,” Dessi said. “You need to know about cost-click advertising. It’s more than just posting a status.” The digital summit is also a chance to spotlight Westchester. A team from Georgia is flying up for the event and many of the attendees will come from outside of the county. In the future, Dessi is hoping to make the event a three-day event to allow attendees a chance to explore Westchester. “We are Westchester County, New York,” Dessi said. “We need to own the fact that there is a pedigree to that. There are cache businesses in Westchester. We are not second fiddle to New York City, we are a premiere suburb. I’ve been to conferences in Silicon Valley that were held in the suburbs. Why can’t we replicate that in New York? I’m shocked no one has done this before.” Dessi, a Chappaqua resident, said that Westchester is the best place to host a convention. “We’re a 35-minute train ride from a major world city,” he said. “We have the space, the talent, the companies, the business councils and the media. There is absolutely everything here to do this on a global scale.” The Business Council of Westchester is an event sponsor. John Ravitz, Business Council executive vice president, said digital savvy is important for businesses. “Businesses need to learn to improve their brands,” Ravitz said. “Digital media has influenced so many different types of businesses. It’s so important for businesses to have a strong social media component in their portfolio.”

Business Council shines stage lights on honorees

The Business Council of Westchester went Hollywood April 18, lauding six business and academic leaders in a festive, Oscars-themed event at its 12th annual Business Hall of Fame dinner at Glen Island Harbour Club in New Rochelle. Celebrity impersonators Marilyn Monroe, George Clooney and Joan Rivers enlivened a red-carpet entrance. “Joan,” said Business Council President and CEO Marsha Gordon, “you look great.” Attorney Stephen Jones, Business Council chairman of the board, smiled nearby. Honorees were named in five categories: • Judy Huntington, president of the College of New Rochelle, took home the Women in Business award. • Glenn Pacchiana, president and CEO of Briarcliff Manor-based Thalle Industries was awarded the Family Owned Business award. • Ruth Mahoney, president of KeyBank’s Hudson Valley/Metro N.Y. district, earned the Corporate Citizen trophy. • Mamaroneck-based Murphy Brothers Contracting won the Small Business award. • The Entrepreneurial Success award was handed to Patrick Vaccarro, who opened the White Plains office of law firm Jackson Lewis in the early 1980s.
