riday June 2nd was a day for dreams in Mount Vernon. A half-dozen real e s t a t e d e ve l o p e r s pitched plans for projects. If every one of their ideas comes to fruition, a half-billion dollars in investments would create more than 1,200 dwellings. Their ideas ranged from projects ready to break ground to concepts that are still aspirational, from low-income housing to luxury living, from maintenance of existing housing stock to transformational propositions. About the only thing they had

in common was the desire for financial assistance from the city. And that’s how developers’ day began Friday morning at a meeting of the Mount Vernon Industrial Development Agency. The first request was for a doover. Greater Centennial AME Zion Church operates 12 buildings and 158 apartments south of downtown. Built 40 years ago, they are some of the oldest low-income housing in the city. Property taxes had already been abated, and in 2014 the developer borrowed $13.8 million to renovate the buildings. olding up a copy of a recently printed cover story titled, “Retail is F*cked,” John Barrett, president of the Commercial Investment Division of Hudson Gateway Association of Realtors, posed a question to a group of real estate professionals.

“Is retail dead?” he asked. James M. Aries, senior vice president and director of acquisitions at Urstadt Biddle Properties Inc., did not hesitate. “You see that all the time, and there’s clearly truth to that,” said Aries of articles like the one Barrett referenced. “We believe that we’re not immune to the retail problems in the wake of e-commerce and economic cycles, but we believe that our

program is built to be safe.” Based in Greenwich, Urstadt Biddle focuses primarily on grocery-anchored shopping centers and service-oriented retail, segments that Aries believes customers still prefer to visit in person. “I think there’s been a healthy streamlining in retail,” he told the audience at Hudson Gateway headquarters in White Plains. “A lot of the weaker guys are out.” Aries was one of five panelists

addressing the state of the retail market in the Hudson Valley at the June breakfast meeting of HGAR’s Commercial Investment Division. Jonathan Gordon, president and CEO of Admiral Real Estate Services in Bronxville, agreed with Aries that headlines predicting doomsday for retail are nothing new. “Retail has been under attack for the last century,” he said. “Forty years ago, you had 300

dventure seekers will soon have a new spot to play in northern Westchester. Construction work is ramping up at the Charles Point Marina, a multipurpose attraction on a redeveloped 11-acre site at 5 John Walsh Blvd. on the Peekskill riverfront. The development, projected to cost $5 million to $6.5 million, will transform the 45,000-square-foot main marina building into a dining and event space on the second floor and an entertainment complex on the ground floor, which is partially leased by the National Maritime Historical Society. The project is led by Diamond Properties co-owner William Diamond, who signed a 50-year lease for the property with the Peekskill Industrial Development Agency in 2014, Peekskill restaurateurs Louis Lanza and John Sharp and Captain Lawrence Brewery founder Scott Vaccaro. Furthest along in development is Spins Hudson, a 40,000-square-foot entertainment center set to open later this month. Diamond, owner and operator of Spins Bowl Entertainment Group and Grand Prix New York in Mount Kisco, said that familyfriendly, multipurpose centers are what many communities are looking for. The focal point of the entertainment center is a sprawling, four-level indoor and outdoor aerial ropes course that includes more than 70 elements, from monkey bars and zip lines to balance beams. Other obstacles challenge visitors to maneuver a bicycle or surfboard between platforms or hop across anchor-shaped footholds. The ropes course can accommodate up to 35 people at any given time, according to the center’s manager Alex Zabawski. Lower floors are aimed at children ages 7 and up, while the upper floors are designed for the older crowd and offer views of the Hudson River. Ninety-minute sessions start at $8 for children and $29 for those 12 years and older during off-peak hours. “An hour flies by when you’re up here,” said Zabawski.

The event center will also feature a Captain Lawrence brewery and bar, an outpost of the Elmsford-based craft brewing company. The downstairs level will also house a smaller kitchen and dining area set to open this fall. But don’t think about grabbing a drink before heading to the ropes course. Zabawski said employees will keep a Breathalyzer on hand to prevent any tipsy daredevils from taking part. A 5,000-square-foot laser tag area, complete with “loud, energetic” music, glowing towers and a fog machine, is also within Spins Hudson. Up to 32 players per game will be able to test their skills in the twostory area. “This second floor definitely ups the ante,” Zabawski said. Spins Bowl operates other entertainment centers in Poughkeepsie, Wappingers Falls and Carmel. Spins Hudson, however,

will have one key difference from the company’s other locations: there is no bowling at Charles Point. Instead, visitors can play either bocce or shuffleboard near retractable window-paneled doors. There will also be a 50-game arcade and prize redemption center. The entertainment complex has made quick progress since receiving the go-ahead from Albany in September that added the site to a list of properties exempt from a law restricting manufacturers, wholesalers and retailers from sharing interest in a liquor license. Also in the main marina building, construction is underway on the Factoria at Charles Point, a 14,000-square-foot restaurant, catering facility and event space on the top floor. Set for an opening later this summer, the eatery will feature two full-service bars and outdoor seating. Lanza, a partner in Hudson Hospitality Group, a holding company that owns Hudson Room, Taco Dive Bar and Buns-nBourbon in Peekskill, is driving that venue’s development along with Sharp, who co-owns the downtown bars and eateries Birdsall House and Gleason’s.

New York bucks Trump on Paris Climate Agreement BY RYAN DEFFENBAUGH rdeffenbaugh@westfairinc.com

resident Donald Trump’s decision to withdraw the U.S. from the Paris Climate Agreement was met with a promise from several New York officials to uphold their end of the accord, in part by ramping up renewable energy production. Gov. Andrew M. Cuomo announced shortly after Trump’s June 1 announcement that New York would join in a climate alliance with California and Washington to meet the goals of the Paris agreement. Cuomo the next day announced another initiative, Clean Climate Careers, which seeks proposals from developers for up to $1.5 billion in renewable energy projects. The 195-country Paris Climate Agreement allows countries to set their own benchmarks for reducing greenhouse gas emissions with the goal of keeping global temperatures from rising more than two degrees Celsius before the end of the century. The U.S. committed to reducing its greenhouse gas emissions between 26 and 28 percent from 2005 levels by 2025 and also committed up to $3 billion in aid for poorer countries. In pulling out of the deal, Trump said

the climate agreement would hurt U.S. business and damage its sovereignty. He said he was “elected to represent the citizens of Pittsburgh, not Paris,” when announcing the withdrawal. Cuomo called Trump’s choice reckless. His efforts to maintain the goals of the agreement in New York place the state among a large group of cities and corporations — including Westchester-based companies such as PepsiCo and IBM — and other states that have reasserted their commitment to reducing greenhouse gas emissions in line with the Paris accords. Since the U.S. Climate Alliance launched with its three founding states, Connecticut and eight other states have joined, including Delaware, Hawaii, Massachusetts, Minnesota, Oregon, Rhode Island, Vermont and Virginia. Puerto Rico has also joined the alliance. The alliance commits each state to a goal of reducing emissions at a level that would meet the U.S. commitment in the Paris agreement. As coalition members, each state must also try to meet or exceed the emissions reduction targets of former President Barack Obama’s Clean Power Plan. Separately, New York Attorney General Eric T. Schneiderman was one of 20 state

attorneys general to join the “We Are Still In” pledge. The pledge has been taken by the leaders of more than 1,000 states, cities, universities and corporations. It commits each to the emission reductions goals of the Paris Climate Agreement. Schneiderman also leads a coalition of state attorneys general that promises to challenge any rollback of the Clean Power Plan. The mayors of New York’s five largest cities by population — New York, Buffalo, Rochester, Yonkers and Syracuse — also have all in some way promised commitment to the goals of the climate agreement. As part of Cuomo’s Clean Climate Careers initiative, the state will issue requests for proposals to build renewable energy projects that his office said will generate more than 2.5 million megawatt hours of electricity a year. The solicitations will come from both the New York State Energy Research and Development Authority and the New York Power Authority for $1.5 billion in new projects in wind power, commercial solar and solar arrays, along with other forms of renewable-energy technology. Those projects would be part of a major scaling-up of renewable energy resources that New York will need to meet its own

greenhouse gas reduction goals, which are more aggressive than those the U.S. committed to in the Paris Climate Agreement. Cuomo has set state targets to reduce emissions to 40 percent below the state’s 1990 levels by 2030, and an 80 percent reduction by 2050. That effort is intertwined with the state’s Clean Energy Standard, which requires utilities and other energy suppliers to quickly phase in enough renewable power sources to allow New York to receive half its electricity from renewable sources by 2030. The standard has been criticized by some environmental and business groups, however, for its inclusion of a multibillion-dollar subsidy to help keep three upstate nuclear plants in operation. New York is also part of the Regional Greenhouse Gas Initiative (RGGI), an alliance of nine states in the Northeast and mid-Atlantic region that caps emissions from power generation. In January, Cuomo pledged New York would reduce greenhouse gas emissions 30 percent below 2020 levels by 2030 and encouraged other RGGI states to do the same. Cuomo said the Clean Climate Careers program could help create 40,000 jobs in clean energy by 2020.

One year in, Westchester Power pushes a new era of clean energy BY RYAN DEFFENBAUGH rdeffenbaugh@westfairinc.com

N

ew York’s Clean Energy Standard mandates the state power itself with 50 percent renewable energy by 2030. Dan Welsh, the program director for Westchester Power, thinks Westchester can do even better. “We want to move much faster than that,” Welsh told the Business Journal from the nonprofit’s office in Mount Kisco. “We just need a nice, catchy, ‘Something by Something’ title.” Helping push Westchester’s power supply toward increased use of renewable, locally produced energy is the next part of the mission for Westchester Power, according to the energy consortium’s leaders. The group was launched in March 2016 by Sustainable Westchester Inc., a nonprofit organization that includes more than 40 municipalities in the county, including now the county itself. Westchester Power started as the state’s first community choice aggregation (CCA) program. CCA programs allow municipalities to band together to negotiate directly with energy suppliers on a fixed, bulk discount rate. Westchester Power includes 20 municipalities in the county. Last year, the group considered bids to supply electricity to residents in its consortium and awarded two contracts. ConEdison Solutions, a subsidiary of Consolidated Edison Inc., will supply the 90,000 homes and businesses in ConEd service territory with electricity at a fixed rate over a two-year period. A parallel deal with Constellation Energy Group, a division of Exelon Corp., supplies fixed-rate electricity to 20,000 homes in the northern part of the county, which is served by New York State Electric and Gas Corp. Welsh, who has a background in information technology and most recently worked as a database manager for the Harrison Central School District, was hired to direct Westchester Power in September. He heads up a small staff with two other full-time employees, two part-timers and three consultants that help guide the group. While similar programs exist in states such as California, Illinois and Massachusetts, Westchester Power is the pilot program for community choice aggregation in New York. “We’re still here after a year, right?” Welsh said. “All the basics have worked.” There were bumps along the way — such as customer confusion and low NYSEG rates

that cut into savings — but Welsh described Westchester Power as an organization past its “infancy stage” and ready to expand its reach. “We’re just scratching the surface right now,” he said. The group has a tagline for its next effort: “emPowering Green Energy.” With Sustainable Westchester’s backing, Westchester Power will attempt to position itself as a leader for a range of efforts to boost renewable energy production in the county. With a team of self-professed “energy geeks,” Welsh said Westchester Power can help introduce communities to energy technologies that may be too complicated for people to pursue on their own. “Part of our role is to go out there, vet these technologies and facilitate ways for people to get in without having to go through all that struggle,” he said. Westchester Power has contracted with a company to help it build a platform that will handle customer data and create an interface that offers customers a range of options for renewable energy and efficiency projects to potentially participate in. The group sees community solar as an especially promising option for the county. That refers to solar installations that don’t have a single user. Instead, multiple customers can pay to subscribe to the energy credits from the solar array’s power production, offsetting their individual bills. The projects open up solar power to people who can’t develop such systems of their own, including renters or homeowners with rooftops not suited for panels. The concept is still new to New York. The state’s first project launched last year in Tompkins County. Westchester Power can act as a gobetween for landowners and solar developers to help facilitate projects in the county while also offering its wide customer base as possible subscribers to new community solar developments. Customers in Westchester Power already have the option to pay slightly more for a 100-percent renewable energy supply. Of Westchester Power’s 20 member communities, 14 opted to offer the renewable option. Westchester Power thinks it can facilitate increased renewable energy production within the county. That supply could then be used to replace energy the consortium currently receives through its two aggregation contracts, Welsh said. “There’s a whole lot of entrepreneurial energy,” he said of the renewable energy sector in Westchester. “So we want to » » POWER, page 7

GIRLS HIGH SCHOOL FIGHTS SPAM FAXES If you have a product you want to promote, think very carefully before you send an unsolicited fax to Bais Yaakov of Spring Valley. The Orthodox Jewish high school for girls in Rockland County just might find your advertisement so annoying that it will sue you. That’s what the school did on May 26, filing three class action lawsuits in federal court, White Plains, demanding from $5 million to $15 million from each defendant. And that was not the first time the school has sued companies that swamped its fax machine with unwanted advertisements. It has filed 16 complaints in the past five years, in Alabama, Florida, Massachusetts, Minnesota, Nebraska, New Jersey and New York. The school’s White Plains attorney, Aytan Bellin, has filed as many as 95 consumer protection lawsuits, according to court records. “Sorry, I can’t talk to you,” Bais Yaakov school principal David Sussman said when called, and then hung up. Bellin did not respond to a message asking to discuss the cases. Their authority to sue is courtesy of the 1991 Telephone Consumer Protection Act and the 2005 Junk Fax Prevention Act. The legislation bans the use of a facsimile machine, computer or other device to send unsolicited advertisements to a telephone fax machine. The law exempts senders who have an established business relationship with the recipients. Even then, the fax must provide contact information for opting out of future messages. Congress found the fusillade of faxes so onerous that it gave recipients the right to sue and to obtain $500 for each violation of the law. The state General Business Law also restricts unsolicited faxes. Last month, Bais Yaakov sued Textbook Warehouse of Alpharetta, Georgia, for sending 33 unwanted faxes from June 2013 to September 2014 that offered textbooks, workbooks and paperbacks for sale. The faxes included a phone number for removing the school from future faxes, but did not comply with the letter of the law on opting out, the complaint claims. Bais Yaakov also sued School Safety Czar, a Las Vegas, Nevada company that sent 21 faxes for communications gear such as twoway radios, and Maximus Inc., a Weston,

Virginia company that transmitted nine faxes promoting job recruitment services. The harm, Bais Yaakov says in its complaint, is the waste of paper, toner, fax machine, telephone line and staff time for handling the annoyances. The lawsuits were filed as class actions on the belief that a whole lot of other consumers have been spammed. The school is not alone in feeling that uninvited faxes are a nuisance. Telephone Consumer Protection Act lawsuits have increased from 14 in 2007 to 4,860 last year, according to Web Recon. Organizations like JunkFax. org advise consumers how to “get even” and JunkFaxDefense.com helps businesses defend themselves from the lawsuits. Bais Yaakov has had some success in penalizing pesty promoters. In 2015, for instance, a U.S. magistrate judge in Trenton, New Jersey, approved a $2.6 million class action settlement against Peterson’s Nelnet. The judge awarded the school $500 in damages for faxes it had received selling college test prep guides and $5,000 as an incentive award for bringing the case. SECOND DEVELOPER PLEADS GUILTY TO VOTING CONSPIRACY IN SULLIVAN COUNTY Two out of three real estate developers accused of corrupting a Sullivan County village’s electoral process to advance their housing project have pleaded guilty. Shalom Lamm, 57, of Bloomingburg, pleaded guilty on June 6 in federal court in White Plains to conspiracy to corrupt the electoral process. Kenneth Nakdimen, 64, of Monsey, pleaded guilty to the same charge on May 25. Co-defendant Volvy “Zev” Smilowitz of Monroe awaits trial. The corruption charge carries a 5-year maximum prison term. Lamm and Nakdimen are scheduled for sentencing in September. The developers were accused of trying to take over Bloomingburg’s government so that they could not be stopped from creating a Hasidic Jewish enclave in the Sullivan County village and make hundreds of millions of dollars, according to the indictment. They began buying land in 2006. Originally, they proposed building Chestnut Ridge, a 125-unit townhouse community with a golf course. After the village rezoned the property, they submitted plans that more than tripled the housing to 396 units and eliminated the golf course. The developers had plans for several projects that could accommodate thousands of families, the government stated. They chose the village because its small population, 420 people, made the govern-

30-year PILOT with a $6.7 million tax abatement, a $3.6 million sales tax exemption and a $625,268 mortgage tax exemption. “Now you’re taking steps to resurrect a dead economy,” Thomas said. “This is a starting point.” Enclave Equities of Purchase is close to breaking ground on a cluster of five low-rise buildings with 179 market-rate apartments on MacQuesten Boulevard. Demolition of two dilapidated warehouses has begun near Metro-North Railroad’s Fleetwood station. Financing for the $47.9 million project has been lined up. The company has pledged to use as many local contractors and construction workers as possible. Construction can begin this summer. Enclave has all the approvals it needs, but one. Without tax abatement, company official Sam Mermelstein said, the project can’t work. The company is asking for a PILOT for 25 to 30 years, beginning at $184,260, and sales tax and mortgage recording tax exemptions.

The IDA approved a resolution to start the process by a 4-0 vote. After the IDA business concluded, developers’ day continued with an afternoon pep rally outside of City Hall. The mayor introduced David J. Gentner, president of the Wartburg retirement community, the city’s largest landowner with 34 acres, its largest employer and, at more than 150 years of operation, one of its oldest institutions. About 7,000 retirees live within five miles of the campus near the Pelham border. About 5,000 have incomes of $100,000 or more. Wartburg wants to shift the balance of its residential portfolio toward market-rate units. It plans to invest about $65 million on 100 to 150 apartments and it hopes to partner with a developer by the end of the year. Alexander Development Group and The Bluestone Organization are ready to build 42 Broad St., a $90 million, 16-story, 249unit tower near the Fleetwood train station.

The project had been delayed by legal challenges. Now the partners are within weeks of closing on financing. The residential tower is billed as a luxury project with all market-rate rentals. Mark Alexander, company principal, compared the location with Riverdale. “It’s a fabulous community,” he said. Simone Development Cos. wants to build two 70-unit, 18-story buildings cattycorner to Mount Vernon West train station. The $60 million project would be aimed at middle-income renters. “If you are a fireman, policeman or city worker,” Simone partner L’Judie Simmons said, “these buildings are for you.” Company President Joseph Simone said he hopes to get all city approvals by the end of the year. “I have a true love of Mount Vernon,” said Simone, whose family moved from the Bronx to the Fleetwood neighborhood when he was a child. “And I’d like to see it flourish again.” Carlton A. Brown, of Direct Investment Development in Mahatten, envisions a $125 million project at 20 S. Second Ave. “What I like about Mount Vernon is that it’s a community that is under-invested,” Brown said. “All of our work is in communities that have been written off but have underlying value.” He said he looks for ways to transform lives, especially the lives of children, by transforming neighborhoods. For example, about 100 of the 320 Library Square apartments would be set aside for the “creative class,” artists, dancers, musicians. “That’s a class that makes a community different,” said Brown.

Post Road. “I think certain retailers are certainly screwed and certain markets are probably screwed,” Auster said. “I wouldn’t want to own a mall or any type of a power center in most of this country right now, especially Middle America.” But Westchester County, with its proximity to New York City and high household incomes, is in a unique and favorable position, panelists said. “Retailers are going to continue to need stores,” Auster said. “I think stores are going to continue to get smaller and there will be less of them going forward, but I would place my bet on those stores being in New York first and closing here last before anywhere else in the country.” Auster believes that brick-and-mortar stores are highly important for retailers aiming to expand their online presence. “Those retailers that are pushing into that e-commerce space need those stores for brand recognition,” he said. “If you’re Williams Sonoma and you’re looking to

sell a lot of stuff online, if I don’t drive by that shopping center and see that Williams Sonoma store, I am not going to go onto Williams-Sonoma.com to buy that product. I’m going right to Amazon.” Panelists also noted that lease negotiations in the retail sector have seen a change since the Great Recession. “Pre-2007, I think landlords had a list of backup tenants, so there was a little bit more urgency to lease negotiations on both sides,” Gordon said. “Today, we’re seeing slower absorption because of these changes.” Along with those changes, outlooks on lease terms have also shifted. At The Westchester mall in White Plains, “We’re willing to go to three- or five-year (leases) if it makes sense to get the space filled, to get the lights on, to stop people from perpetuating this narrative of there’s vacant space in the mall, there’s vacant space wherever,” said Steven Sayers, general manager of the Simon Property Group mall. Property owners are also focused on providing experiential opportunities to

attract customers to their shopping centers. “It’s up to us as the landlords, developers and tenants to provide a proper retail environment for millennials that gives people a reason to show up,” said Peter Kempner, owner of The Kempner Corp., a real estate investment firm in White Plains that specializes in acquisition, ownership and operation of shopping centers and retail properties. To offer customers that proper environment, The Westchester has undergone a multimillion-dollar renovation over the past year. The mall unveiled a children’s play area, technology lounge and a Savor Westchester dining area. Other enhancements include modernized elevators and lobbies, all new facades on major mall entrances and new landscaping and flooring. “You look at malls 20 or 30 years ago, and they were dark, they were dingy, but you could still get people in in droves,” Sayers said. “People want a localized, individualized experience that no one else has ever had before. A food court just used to be a way to extend the stay; now it’s a driving force.”

The church projects a $219,960 deficit this year, growing to $422,800 by 2026. Centennial asked the IDA for a new 30-year PILOT, beginning with a tax abatement of $411,500. Nothing can be done for the current tax year, IDA officials said, and they held out only vague hope of a remedy. The rest of the day was more upbeat. MVP Realty Associates LLC has proposed The Pointe, a $105 million plan to build 210 affordable housing units and retail space at South Fourth Avenue and East Third Street near Mount Vernon East train station. Once upon a time, Mayor Richard Thomas said, Fourth Avenue was a destination where people strolled and shopped. “Hundreds of jobs have been lost,” he said. “That’s a high crime area. Now it’s mostly shut down.” As with many housing developments, MVP is looking for financing from a range of government sources: New York State Housing Finance Agency, low-income housing tax credits, city urban renewal money, Community Development Block Grants, state brownfield credits, Federal Home Loan Bank Funds and more. Matthew Gross of MVP said he hopes to break ground for the first phase, a 110-unit building, next summer. The Mahatten-based company submitted a preliminary IDA application for a

From page 1 Gordon observed that today’s retail environment is in a state of flux. “We’re seeing the concept of the omnichannel, where retailers are looking for a seamless internet and brick-and-mortar presence,” Gordon said. “We’re seeing that the internet-proof type of retailers, such as gyms, food, entertainment, those are the types of uses that are still expanding.” Scott Auster, managing director at Grid Properties, said the popular narrative in retail right now “is that it’s screwed.” “I think the reality is a lot more nuanced and gray,” he said. A Harlem-based developer, Grid Properties was recently granted approval by White Plains city officials to redevelop an empty commercial lot on West Post Road, at the southern gateway to the city’s downtown business district, as Boulevard, a $160 million retail and boutique fitness center that would also include 12 townhome units. The group plans to meet with municipal boards, sustainability committees and environmental groups to organize green initiatives. That includes workshops and lectures on sustainable energy and the environment. The group will also work on expanding the county’s demand response technology, energy storage capacity and constructing more electric vehicle charging stations. “As we go do our community outreach, we’ll have all these different offerings for people to participate in,” Welsh said. “This is what we are starting to think of as the new energy ecosystem for Westchester.” Meanwhile, community choice aggregation is cleared to expand beyond Westchester. The Public Service Commission approved the programs for municipalities statewide in April 2016, one month after Westchester Power officially launched. Brad Tito, a program manager for the New York State Energy Research and Development Authority, said NYSERDA has found more than 100 communities

that expressed varying levels of interest in developing a CCA program during the agency’s outreach efforts. Westchester Power is still the only active program in the state, however. Launching a community choice aggregation program takes time. They require new local laws, a fully developed plan from the municipalities and approval from the Public Service Commission. Tito said that while a negotiated fixed electric rate can help customers in a CCA program save money, there are benefits beyond the potential savings. “What we are hearing (communities) are very much interested in is, ‘How do we use a CCA to help develop local renewable projects?’” . Welsh noted that Westchester Power’s renewable energy push comes at an interesting time for the county. The planned 2021 closure of the Indian Point Energy Center in Buchanan has created anxiety about how the power produced by the 2,000-megawatt nuclear plant can be replaced. Welsh said anytime more people are thinking about how they get their energy, it creates an opportunity to spread awareness about Westchester Power. “We want people to feel good about the fact that there is an active effort here. There is a group with a cutting-edge, groundbreaking program making great strides. And we intend to chip a big piece off that concern.”

They decided to run a slate of candidates in the March 2014 election with the goal of replacing the planning board. They recruited people to vote who did not live in town, had never set foot there and did not intend to live there, according to the indictment. They disguised the scheme by backdating apartment leases to make it look as though the impostors were eligible to vote. They staged apartments to look like they were occupied, opened bank accounts, submitted change-of-address forms and removed mail that had been delivered to the apartments. None of their candidates won. The U.S. Attorney’s Office also charged Harold Baird, a former town supervisor in Mamakating, with conspiracy to submit false voter registrations. He did not live in Bloomingburg but registered to vote there and ran for a village trustee position in the 2014 election. He has pleaded guilty. Smilowitz’s attorney, Justine Harris, said in December that the charges against

her client are unfair and unwarranted. “Mr. Smilowitz looks forward to his day in court,” she said.

APPELLATE COURT SUSPENDS KATONAH ATTORNEY FOR TWO YEARS A Katonah attorney has been suspended from the practice of law for two years for professional misconduct. The state Supreme Court Appellate Division in Brooklyn ordered Randall G. Lawrence to stop practicing law as of June 30. He was charged in December with 10 infractions by the grievance committee for the Ninth Judicial District. Lawrence consented to discipline and stipulated that, among other things, he converted down payments from three real estate transactions for his own use. He also admitted to improperly handling a checking account and taking an unsecured loan from a client without memorializing the terms. The May 31 court order cited several mitigating factors, including Lawrence's otherwise unblemished disciplinary record in 29 years of practice and his pro bono legal services. Lawrence did not respond to telephone and email requests for comment. He is “taking some time off,” an out-ofoffice reply said, “and will not be practicing law for the foreseeable future.”

REGENERON, YONKERS PARTNERS IN EDUCATION TEAM UP A partnership between Yonkers Partners in Education, a private nonprofit that supports the Yonkers Public Schools, and Regeneron Pharmaceuticals Inc. will allow Yonkers high school students to learn alongside Regeneron researchers. The partners launched the Regeneron STEM Institute on May 30, a three-year program aimed at high school students committed to the fields of science, technology, engineering and math. Initially, 17 students were accepted into the program. The Regeneron STEM Institute will offer designated Yonkers students the chance to choose a research topic and work with mentors from Regeneron’s labs in Tarrytown and other parts of Westchester County. Regeneron provided a $75,000 grant to Yonkers Partners in Education to fund the program. The company said that it’s hopeful the institute can inspire students to pursue a career in a STEM field after high school. “Regeneron believes in the power of

science to help solve our world’s most pressing problems and we are eager to see what these promising young scientists learn and discover as a result of this new initiative,” said Hala Mirza, vice president of corporate communications and citizenship at Regeneron. “In a school district with more than 28,000 students and very limited resources, it is incredible to see these talented and deserving students receive the support they need to explore their passion for the sciences,” said Wendy Nadel, executive director of Yonkers Partners in Education.

CEO RETIRES, SUCCESSOR NAMED AT EMPIRE RESORTS Empire Resorts Inc., the Monticello company building the first state-licensed casino in the Catskills, announced the retirement this month of CEO Joseph D’Amato and the appointment of Ryan Eller, president and chief operating officer of Empire Resorts, to succeed him in the top post. D’Amato also retired from Empire’s board of directors. Eller, a former Genting Americas Inc. executive, joined Empire Resorts in April to oversee the company’s $1.2 billion resort casino development in Sullivan County, recently renamed Resorts World Catskills, as well as Monticello Casino and Raceway. He will retain the president’s title in his new role.

D’Amato, who retired after a 47-year career in the gaming industry, joined Empire Resorts in 2009 as chief financial officer and was named CEO in January 2010. Emanuel Pearlman, executive chairman of Empire Resorts, in the announcement lauded D’Amato for having “worked tirelessly to help ensure the company was awarded a gaming facility license to develop and operate a resort casino in the town of Thompson in Sullivan County” and for having “led by example throughout his tenure.” Pearlman said D’Amato will help in the transition by serving as an Empire consultant for the next year as the company prepares for the expected March 2018 opening of Resorts World Catskills. “While we are sorry to see Joe leave the company as a permanent member of the team, we’re fortunate to have Ryan’s talent and knowledge as he undertakes the CEO responsibilities,” Pearlman said.

TRION WALK-UPS SELL FOR $9.7M Trion Holdings has sold two four-story walkups at 55 Sheridan Ave. in Mount Vernon for $9.7 million. The deal marked one of the highest prices in the local multifamily property market in recent years, the Yonkers-based company said in a news release. At 70,000 gross square feet and 66 units, the deal

works out to $138.57 per square foot and $146,970 per unit. The deed transferred in April from ACF Realty Corp. to Sheridan Gardens LLC. The relationship between the two entities was not explained in the company’s release. ACF’s address is the same as Trion’s and the transfer was signed by Filippo Milio. Sheridan’s address, 103 Ashburton Ave., Yonkers, is the same as that of Milio Management LLC, and the mortgage lists Antonino C. Milio and Carmela Milio as managing members. Trion’s president, Carmelo Milio, said in the news release that the property was “management intensive” but stabilized after the company implemented strict collection policies. It achieved a 21.2 percent internal rate of return over the 13 years that Trion owned the property. The property generated annual gross revenue of more than $1 million and net operating income of $567,171, according to a spec sheet published last year by Cushman & Wakefield. Trion specializes in buying undervalued multifamily properties in the tri-state area. It has bought, sold or managed more than $250 million in assets over the past 30 years, according to its website. eveloper Martin Ginsburg and Ginsburg Development Cos. joined with state and local officials to unveil the final piece of the developer’s $65 million Harbor Square project in Ossining. 3 Westerly Bar & Grill, an eatery next to Ginsburg Development’s 188-unit luxury apartment complex on the Ossining waterfront, held a ceremonial ribbon cutting to unveil the restaurant at 3 Westerly Road on June 2. The nautical-themed restaurant offers views of the Hudson River and features a main dining area that can seat up to 100 guests, along with a bar and a number of large-screen televisions. An outdoor seating area includes a full bar, sofas and arm chairs under a trellis ceiling. Menu options range from brick oven pizza and burgers to seafood. The 300-seat eatery is operated by Jeremy Casilli, a restaurateur whose other venues include AOA Bar and Grill in Tribeca, Pier 115 Bar & Grill in Edgewater, New Jersey, and the Soho and Tribeca Grand Hotels. “The main ingredient in this whole project is fun. There hasn’t been much going on north of the Tappan Zee Bridge,” said Casilli, adding that he and Ginsburg Development have “worked diligently to create a universal hub for all types of guests.” The transit-oriented development is just steps from the Ossining stop of Metro-North Railroad’s Hudson Line. ment. However, the project came to a standstill in the credit market crisis and Great Recession. Cappelli later withdrew from the project, which Ginsburg revived in 2012 as a rental development. Having held its grand opening in June 2016, Harbor Square is now 90 percent leased, according to the landlord. The building, features one- and two-bedroom apartments along with a top-floor club lounge, fitness center, spa, rooftop pool and sundeck. Elsewhere in Westchester, Ginsburg Development is planning to break ground later this month at Fort Hill, a $64.5 million mixed-use development in Peekskill. The company recently cut the ribbon at the $110 million, 330-unit River Tides at Greystone complex in Yonkers. ona College has appointed William B. Lamb, who currently leads a business school in suburban Boston, as dean of its School of Business in New Rochelle. Lamb, who joins Iona on Aug. 1, was selected following an international search and review of more than 60 potential candidates, Iona officials said in the announcement. He succeeds Vincent J. Calluzzo, Iona’s current provost and senior vice president for academic affairs, who served for nearly 10 years as business school dean before moving to the provost’s role two years ago, and Charles Cante, a professor of information systems who has served as Iona’s interim business school dean since 2015.

Growing revenue and sustaining It Our company is facing a growth hurdle: We’ve never averaged the level of sales per day that we have an opportunity to do this year. I’m worrying whether I’m trying to take on too much, while still being excited about the opportunity for so much growth. How do I best steer my company through this challenge? THOUGHTS OF THE DAY: Avoid the trap that too many businesses experience: up and down growth due to taking on work they cannot sustain. Be mindful of the gifts the economy will or won’t throw your way. Plan out growth in stages. Figure out what your workforce, plant and equipment and even your suppliers can reasonably take on. Since most companies operate within their means, it is unlikely to expect you’ll double output, or even increase it by 50 percent, with your current resources. The more growth, the more challenges, the more things needing fixes, the more time and resources that get used up dealing with all of that. If you run out of time, you’ll need to speed things up by purchasing ready-made or near-ready solutions. Can

you afford that? How big is your war chest? Consider partnering with another provider to spread out the work and the risk. Rather than taking on all of the challenges within your company, bring on one or more partners to divvy up the opportunity and the risk that goes with it. Take a look at the economic cycle that you’re in. Are buyers ready and able to spend on new solutions? How many potential customers will continue just doing what they’re doing today, until you’re ready to go after them? Get accurate research to tell you how big the market is and what to expect in the future. What are the long-term prospects for the new product or service you’re pursuing? Can you continue to cash in on opportunity as you grow?

LOOK HOW WE HAVE GROWN

If buyers pursue a different solution now, what’s the role of brand loyalty? How many can you get back when you’re ready to take them on? What competitive advantages will you gain later on by first focusing on a select group of high quality customers? Who are your competitors? Why is there a gap in services right now? Is this a temporary opportunity or a long-term market shift? How long before any 1,000-pound gorillas enter the market and what can you do to avoid them? What about buying a competitor to get a leg up? Make a plan for growth over time. Build a set of success stories by winning over one customer, and then the next one. Use success stories to help sell the next round. Focus on profits. Better to make a significant profit on a smaller growth hurdle, than take on a huge growth opportunity and end up with little or no profit to show for the effort. Map out expansion. Build solutions before you need them. Have to hire new people? Find someone to help you bring on “right fit” employees. Need a lot of additional supplies? Go shopping for vendors who can support your growth needs. Need

more space? Line it up ahead of time. Build a budget for expansion. Define how much you can afford to put toward growth. Slow down the pace of growth so that you can catch and correct mistakes early on and stay within budget. Use the money you save to fund future growth. Define how to track activities and results: profit/item delivered, reserves vs. plan, time and cost to produce, quality and error rate, customer satisfaction, FTE (revenue per full-time equivalent employee). Ivy Realty, Onyx Equities join BOMA Hall of Honor BY JOHN GOLDEN jgolden@westfairinc.com

wo commercial real estate companies that have made major building acquisitions and investments in the Westchester office market in recent years were honored by the Building Owners and Managers Association of Westchester with its Hall of Honor Award for supporting and encouraging economic growth in the county. Ivy Realty, based in Greenwich, and Onyx Equities, headquartered in Woodbridge, New Jersey, were presented the award separately before an audience of about 150 professionals from the commercial real estate industry at the BOMA chapter’s annual awards dinner on May 11 at Abigail Kirsch at Tappan Hill Mansion in Tarrytown. Ivy Realty was cited for its recent $30 million capital improvement program at White Plains Plaza, the 700,000-squarefoot mixed-use complex in downtown White Plains that includes the 15-story 1 N. Broadway and 445 Hamilton Ave. office buildings. The new landlord has significantly raised tenant occupancy in the complex since buying the property two years ago in a distressed sale.

Eric Levy, Ivy Realty’s vice president for asset management, accepted the award for the Greenwich company, which has acquired more than $1.5 billion and 11 million square feet in commercial real estate assets since its founding in 1996. Onyx Equities LLC raised its presence in the Westchester market in 2014 when it regained ownership of 1311 Mamaroneck Ave., the former Parker Corporate Center in White Plains, in a loan default after selling the approximately 326,000-square-foot office complex for $81.8 million in 2008. Onyx in late 2014 paid $56.6 million to acquire 1111 and 1129 Westchester Ave., a 335,000-square foot office complex on the Platinum Mile in White Plains where PepsiCo Inc. had established temporary headquarters during renovations to its Purchase corporate campus. BOMA officials said Onyx has renovated all of its White Plains assets. Accepting the award for Onyx Equities was Jeffrey Fuller, property management director. Also honored by the BOMA chapter was Dean Bender, partner at Thompson & Bender, the public relations and advertising firm based in Briarcliff Manor. He received the BOMA President’s Award for his 18 years of volunteer service on BOMA Westchester’s board of directors. Bender is the board’s

public relations adviser, handling all publicity as well as the chapter newsletter. BOMA officials also presented three Best of BOMA Awards. • Mamaroneck Self Storage, developed by Murphy Brothers Contracting Inc., won the Reposition/Repurpose Award. The 40,000-square-foot self-storage facility at 426 Waverly Ave. was designed by Port Chester architect Kim Martelli and built by Murphy Brothers Contracting on its own property in the village. BOMA officials said owners Sean and Chris Murphy collaborated with Steven Winter Associates, an energy consulting firm in Norwalk, to construct the facility under a New York State Energy Research and Development Authority program to rate 52 percent more energy-efficient than required by the state building code. Laura Murphy, manager of Mamaroneck Self Storage, accepted the award. • BOMA presented its Medical Use Operations Award to Northern Westchester Executive Park, a Yorktown Heights office complex owned and managed by GHP Office Realty. GHP acquired the former Taconic Corporate Park in 2014 in a distressed sale and invested $6 million in capital improvements to the two-building complex at 26492651 Strang Blvd., where Mercy College

leases space for its Yorktown campus. The landlord has attracted new tenants that include NewYork Presbyterian/Hudson Valley Hospital and PCSB Bank, which relocated its corporate headquarters from Putnam County. BOMA officials said the tenant mix at Northern Westchester Executive Park “creates a synergy unparalleled in the typical Westchester office park, presenting Mercy College with direct access to working professionals and current students with direct access to regional employers.” Andrew Greenspan, principal of GHP Office Realty, accepted the award. • Reckson, a division of SL Green Realty Corp., received BOMA’s Most Active Leasing Team or Broker Award for SL Green’s Westchester portfolio of 13 Class A office buildings in downtown White Plains, Valhalla, Rye Brook and Tarrytown. Reckson’s three-person leasing team of Larry Kwiat, Robert Swierbut and Willard Overlock last year completed more than 30 deals in the portfolio, brokering leases that ranged from under 1,000 square feet to over 50,000 square feet and totaled approximately 300,000 square feet for the year. The team completed 13 leasing transactions in this year’s first quarter. Kwiat, senior vice president for leasing at Reckson/SL Green, accepted the award.

PURCHASE STUDENTS MEET DALAI LAMA A group of students from Purchase College who are studying abroad had an audience with the Dalai Lama on June 2 in Dharamsala, India. Professor Suzanne Ironbiter, third from the left, has led the Tibetan Buddhist Philosophy & Art class in India several times and has a personal relationship with a member of the Dalai Lama’s staff. This was her third audience with the spiritual leader of the Tibetan people. SUNY conducts “study abroad” programs in more than 60 countries.

FOOD BANK HONORS SUPPORTERS Four organizations were recognized by Food Bank for Westchester during its 12th Annual Hunger Heroes breakfast at Abigail Kirsch at Tappan Hill Mansion in Tarrytown. The event was emceed by Christa Lauri, a newscaster at Verizon FiOS1 News. “We are grateful to our ‘Hunger Heroes’ for helping us to eradicate hunger in Westchester County. Through their support, we are able to make a significant impact against hunger for our neighbors,” said Leslie Gordon, president and CEO of the Food Bank. • Claremont Elementary School in Ossining received the Community Partner Award. The school hosts the Eat Healthy NY program for 4th graders and has a garden that feeds 60 families every summer. It distributes 185 backpacks every other week containing food for students and their families to have on the weekend.

The second annual Tech Supports for Cognition and Learning conference hosted by Arc of Westchester and Mercy College took place on the college’s Dobbs Ferry campus and attracted about 150 attendees. Arc and Mercy this year invited AHRC New York City, which helps an estimated 15,000 clients in the five boroughs, and the Westchester Library System to join as event hosts. The conference gathers experts in the fields of technology, education and learning, clinical and direct-service supports to explore how technology can help people with disabilities in order to maximize their independence and overcome cognitive limitations. Among the speakers were Tony Gentry of Virginia Commonwealth University who gave a presentation on using smart-home technologies to support independence and choice, Cathy Bodine of the University of Colorado addressed the group by satellite about workforce accommodations for people with cognitive disabilities and John Rochford of the University of Massachusetts talked about making the internet accessible to people with cognitive disabilities. Richard P. Swierat, executive director at Arc said, “The intent of this conference is to engage and excite a community of thinkers who will continue to build bridges between technology and cognitive supports for people with disabilities.”

Planned Parenthood Hudson Peconic (PPHP), based in Hawthorne, has named Vincent Russell as president and CEO. Russell joined PPHP in August 2015 as the chief operating officer and became interim president and CEO in January 2017. “Vince’s strong commitment to PPHP’s mission, knowledge of our operations and staff, equanimity and proven executive leadership as interim president/CEO make him the right person to lead our organization during this time of unprecedented challenges,” said Joan Rosen, chairperson of the organization’s board of directors. Russell had been with Northern Westchester Hospital. He received his bachelor’s degree from the United States Military Academy at West Point, a master’s degree from Florida Institute of Technology and a health care certificate from Villanova University.

CPW GOLF TOURNEY COMING UP Cerebral Palsy of Westchester (CPW) hosts its 16th Annual Golf Classic on June 27. The event takes place at Quaker Ridge Golf Club in Scarsdale. In addition to a day on the links, participants can take part in special features such as a hole-in-one competition. After the tournament, the evening’s festivities will include dinner, silent auction, raffle and a presentation of the tournament winners. COLEMAN SCHOOL HONORED The John A. Coleman School, with campuses in White Plains and Yonkers, has been named a 2017-18 School of Excellence by the National Association of Special Education Teachers (NASET). This is the 10th consecutive year that the Coleman School has received the award. NASET seeks to promote standards of excellence and innovation in special education research, practice and policy in order to foster exceptional teaching for exceptional children. The school provides early childhood and special education services to children from more than 40 school districts in Westchester, Putnam and the Bronx. It serves about 1,000 children and their families each year. The school is sponsored by the Sisters of Charity of New York and is part of the St. Elizabeth Seton Children’s Foundation, which also includes the Elizabeth Seton Pediatric Center and the Children’s Rehabilitation Center.

The 2017 Masked Ball Annual Gala held by Winnakee Land Trust at Astor Courts in Rhinebeck was sold out, with more than 380 attending. Many of the guests wore colorful masks for the festivities, which included entertainment by a Hudson Valley Circus Arts acrobat and a masked fiddler. Speakers included Dutchess County Executive Marc Molinaro and former New York state Sen. Steve Saland, who honored Win-

nakee board member and President Emeritus Sally Mazzarella. She has been succeeded as president of the land trust by Carl Meyer, who has served on the organization’s board since the early 1990s. Molinaro praised Mazzarella for opening “…access to trails, historic landmarks and our majestic Hudson River. For us and the generations to follow, she has helped to define who we are and how we hope to live.”

SYED NAMED TO HOSPITAL BOARD Omar Syed has been named to the board of directors of the Northern Westchester Hospital Foundation. Keeva Young-Wright, president of the foundation, made the announcement. Syed, a Katonah resident, is assistant director of the hospital’s Gamma Knife Center and is a neurosurgeon with CareMount Medical. He specializes

in brain tumors and spinal surgery. Syed received his medical degree from NYU School of Medicine, completed his internship in surgery and residency in neurosurgery at Columbia Presbyterian Medical Center and had a fellowship at the University of Tennessee/Semmes-Murphey Clinic in Memphis.

PAULIN ENTERS WOMEN’S HALL OF FAME State Assemblywoman Amy Paulin was inducted into the Westchester Women’s Hall of Fame during the YWCA White Plains & Central Westchester’s “In the Company of Women” luncheon at the DoubleTree in Tarrytown. The Women’s Hall of Fame was established by the nonprofit Women’s Research and Education Fund that promotes equality and justice for women in Westchester. “I am in the company of extraordinary women whose lives of purpose have given women everywhere the hope, tools and opportunities they need to succeed and lead productive lives,” Paulin said. Also honored during the luncheon were: Millie Hernandez-Becker, president and CEO of Skyqueen Enterprises; Patricia Mulqueen, member of the YWCA board; and, Jin Li, neurologist with Westchester Medical Center. Keynote speaker was Lauren Leader-Chivèe, cofounder and CEO of All in Together, a nonprofit dedicated to engaging American women in politics and civic action. In White Plains, Westchester Jewish Community Services (WJCS) has announced the appointment of Lisa Scott as director of Center Lane, Westchester’s only LGBTQ youth and community education center. Center Lane offers support groups and counseling in a place where LGBTQ youth can be themselves without the fear of harassment. It operates at locations in White Plains and Yonkers, and has support groups in Peekskill. Scott had been with My Sisters’ Place

as director of community education and prevention programs and as domestic violence education and prevention programs manager. Her experience includes working with the Girl Scouts in California and Colorado, and developing and managing a bullyingprevention initiative. Scott has a bachelor’s degree in English and theater from Colorado State University and did graduate work in English at the University of Tennessee.

VNSW Foundation’s Spring Benefit Gala

he foundation formed to support The Visiting Nurse Services in Westchester recently held a Spring Benefit Gala at the Willow Ridge Country Club in Harrison. More than 200 guests attended, contributing approximately $110,000 to the foundation, which will be helping to support the Visiting Nurse Services’ home health care and community services. During the event, U.S. Rep. Nita Lowey, who serves New York’s 17th Congressional District, received the organization’s Distinguished Service Award. Dr. Amy Ansehl, who is chairperson of the Westchester Visiting Nurse Services Group Inc. board of directors, received the Community Leadership Award. The emcee for the evening was Michael Gargiulo, an anchorman at NBC News 4 New York.
