ith at least 800 IBM Corp. employees in the Hudson Valley region notified last week that they will lose their jobs, community leaders are mobilizing in an attempt to soften the blow on the area economy. IBM employees in Dutchess County started receiving layoff notices on June 12, when the computer technologies giant told the state Department of Labor that 697 employees will lose their jobs in that county. A total of 369 workers will be let go from the East Fishkill plant and 328 from IBM’s Poughkeepsie facility. In Westchester County, the exact number of employees who will be affected at IBM headquarters in Armonk is unclear, though reportedly at least 100 workers have received notices. IBM has not officially notified the state of any impending layoffs in Westchester. As of June 19, IBM had distributed 2,390 pink slips in North America, according to Alliance@ IBM, a national group of union employees at IBM affiliated with Communications Workers of

AN IRISH TEAM OF DEVELOPERS has begun construction of a luxury condominium building on a Larchmont site that was unloaded by another developer thwarted in its decade-old plan to build a rental apartment complex there. The Cambium, a 149-unit, seven-story residence at 10 Byron Place, is rising on a 1.5-acre site that adjoins the Larchmont-Mamaroneck Maxwell Avenue recycling center and a New York Sports Club. The razed site formerly housed a lumber yard and three single-family homes.

John Myers, principal of Ceres Realty Group in Katonah, said the approximately $70 million project is the first multifamily development to be built in Larchmont since the 1980s. It is a short walk from the village’s Metro-North Railroad station and near a cluster of condominium and co-op apartment buildings built as part of the village’s master plan for residential development near the commuter train station. “This is the final piece of that master plan,” said Myers, who has opened a Cambium sales gallery at 1921 Palmer Ave. in Larchmont. “Everything else is built over there.” Irish, page 6

T

he immigration battles in Washington, D.C., lose their abstractness at 6:30 a.m. on Don Bosco Place in Port Chester, where day laborers gather and where a newly incorporated immigrant workers’ headquarters opened this month. “I want to say we are all human beings, wherever we come from,” said Carlos Gomez, a 50-year-old Colombian without documentation. “We’ve got nothing. We’ve got no choice. You get sick, you have to go to the hospital; then you get a big, big bill. Housing costs a lot. Also, we’re taken advantage of. Wherever we came from, we need housing; we need education; we need to be legals.” If Gomez is lucky and an honest contractor or homeowner hires him, he hopes to earn perhaps $125 for the day. If he is lucky again, this being the summer construction season, he might pick up three or four days of work per week. Gomez has not seen his family in 14 years. “We dream about reform,” he said. “For 14 years no mom, no kids, no family, no brothers. When you’re illegal, you’ve got too many problems. Don Bosco and Billy are angels for us.” Don Bosco is the Don Bosco Community Center on Don Bosco Place, associated with the Holy Rosary Church next door. “Billy” is the church’s 79-year-old deacon, Billy Vaccaro. He said the national discussion on immigration reform has helped bring a longstanding problem to people’s attention. “The whole immigration policy needs to be on a road to citizenship,” Vaccaro said. “We support dictators; we support regimes that torture – and then our companies go down there for cheap labor. Forces are definitely in place that want the status quo. By remaining here to become American citizens and enjoying the American dream, these immigrants become a great asset to the country, like all the previous immigrants who came here.” Holy Rosary celebrates masses in both Spanish and English. 1904, now ministers to a community that was 59.4 percent Latino in the 2010 census. Latinos made up 21.8 percent of the overall population of Westchester County in 2012. There is a national big picture – it numbers an estimated 12 million or by some estimates as many as 20 million, immigrants living or entering the country without permission – but nearly everything a person needs to know about the immigration issue plays out on the Don Bosco queue of day laborers and, later, the female laborers who also try to eke out livings on the fringes. Some have come for purely economic reasons, but, said Gonzalo Cruz, “Violence is a big factor – people fleeing violence.” The 34-year-old Cruz is the lone salaried worker at Don Bosco Workers, which incorporated June 10 as a nonprofit. Though new to a corporate letterhead, Don Bosco Workers already helps 200 male workers and, with a push into sectors beyond heavy labor, 50 women. It runs sign-in sheets, enters skills and employers into a database and listens to grievances when, as Gomez put it, “Nobody used to listen.” “If a woman can paint or do construction, she is welcome for that work, too,” Cruz said. “We also have day laborers who are African-American.” His initial week heading the new nonprofit was memorable. For six days in June, he ate only honey and drank only water, part of a national hunger strike to bring attention to America’s day laborers. Three days after ending his fast, Cruz said that he was still getting hot flashes when he ate solid food. Conversations with day laborers and with Cruz painted a picture of polarized employers not much different than an old Western movie: good guys and bad guys. “Some people are good to work for, responsible contractors,” Cruz said. “And other times, they will look at the worker at the end of the day and say, ‘I’m not paying you.’ They just refuse to pay. And they know the worker is an illegal who in the past probably could not fight them.” Cruz and other day-laborer activist groups, including Catholic Charities of New York, United Community Centers of Westchester (with offices in Mount Kisco,

better route is often the Department of Labor.” Frank Slobig, a former diocesan priest who went on to marry and father five children, never lost his penchant for activism and today is outreach coordinator for Don Bosco Community Center and for Caritas of Port Chester. Now retired, Slobig moved more than three years ago from Washington, D.C., to volunteer with his friend in Port Chester, the Rev. Steve Schenck. “He was the magnet,” Slobig said of Schenck, who died in November 2012. “Being undocumented makes it difficult to get decent employment,” Slobig said. “One man who comes here is an electrical engineer. We have highly skilled people who have to settle for low-cost jobs. It all hinges on immigration reform. How long it has taken is ridiculous.”

A Boston-area real estate investment firm led by a former top Wall Street executive has cracked the Westchester commercial market with a $34 million property purchase in downtown White Plains. DSF Group is looking to follow its metropolitan New York debut with more acquisitions in Westchester and Fairfield County, Conn. Joshua Solomon, president and chief investment officer at DSF Group, said the firm closed June 14 on its purchase of AVE White Plains, an extended-stay corporate apartment building at 25 Martine Ave. The seller, Korman Communities Inc., based in suburban Philadelphia, Pa., in 2004 paid approximately $35.9 million for the roughly 90,000-square-foot building, which includes 2,000 square feet of vacant street-level retail space. Solomon said DSF is renovating the

building for conversion to 124 boutique luxury apartments that will be available to renters by early July. Renamed Halstead White Plains Metro North, the complex of studios and one- and two-bedroom apartments is managed by Bozzuto Management Co., a division of the Maryland-based Bozzuto Group, which operates several other DSF properties in the Boston and Washington, D.C., metropolitan areas. Bozzuto also manages 15 Bank Apartments in downtown White Plains. Solomon said the AVE extended-stay building was not listed on the market when his company was steered to it by an industry contact in White Plains. “We’re intent on getting a toehold in this market and found a great opportunity,” he said. In the metropolitan New York market, “We particularly like Westchester County and Fairfield County.” Solomon in 2000 co-founded the private real estate investment firm with his father, Arthur P. Solomon, and a third partner, Thomas Mazza, DSF’s chief operating officer. Arthur Solomon was senior partner and head of real estate investment banking and real estate principal invest-

ments at Lazard Frères & Co. and served as CEO of Lazard’s five real estate funds. He previously founded and was senior partner of the real estate investment banking group at Drexel Burnham Lambert. Headquartered in suburban Waltham, Mass., DSF Group has invested more than $1.5 billion in about 4 million square feet of commercial and residential space, primarily in suburban Virginia and the Boston area. The renovating landlord in White Plains this month donated furniture and home goods from 50 apartments at 25 Martine Ave. to Furniture Sharehouse, the Westchester nonprofit that provides free furniture to economically disadvantaged residents in the county.

T

he Affordable Care Act has left the realm of “what” and now encounters “how.” Yet the regional business voice tasked with spreading the word on implementation sees denial, calling it, “Our biggest obstacle.” That appeared to change June 18 at the Warner Library in Tarrytown, where 23 business persons received a tutorial from The Business Council of Westchester on the 2010 Patient Protection and Affordable Care Act and asked questions. Antagonism toward the act – House Republicans have repealed it 37 times – was absent or unstated, seemingly replaced by inquisitive acceptance during the nonpartisan, 90-minute forum. The individualized nature of many questions offered a window into the complexity of health care: “What happens when …” “I just lost my coverage and …” “I am a sole proprietor, but …” Responses could be quite specific, but within the big picture, The Business Council offered itself as “a bridge” between businesses and the law. Said John Ravitz, executive vice president and COO of The Business Council, “We’re a

resource. We’ll be that bridge, one business at a time if needed.” The assembled learned the entire process is online and that those remaining without Internet access will call a state center to have their information uploaded. “They hear Obamacare or Affordable Care Act and they’ve been hearing it for a long time,” Ravitz said. “Now, it’s coming.” Attendees ran the business spectrum, identifying themselves by profession at Ravitz’s request: CFO; health care worker; comptroller; administrator with the state Department of Environmental Conservation; pediatric dietician; travel agency principal; licensed therapist; county library system worker; small business worker; media executive; and several who offered simply “self employed.” The “when” of the equation is carved in stone, with insurance exchanges to be in place nationally Oct.1 and the enforceable law in place Jan. 1, 2014. New York, like 15 other states, will design its own exchange; the remaining states will use a federally created exchange. Details on the New York exchange – complete with its gold, silver and bronze service levels – should be online by mid-July. At the Warner Library, The Business

Council’s manager of communication outreach, Glen Ganaway and Ravitz and illuminated the Affordable Care Act as it now stands. They were clear about one thing, as Ganaway put it, “The situation is fluid.” “We’re not trying to be Chicken Little about this,” said Ravitz, a former 12-year state assemblyman from Manhattan. “We’re just saying the results are going to happen.” The Business Council has run 10 such informational sessions, with Ganaway navigating the presentation and Ravitz in support mode. The forums following the Warner Library are to be held in the libraries of Mamaroneck, Bronxville, Montrose, Pound Ridge and Greenburgh. The Business Council is also hosting the sessions at its White Plains headquarters and, said Ravitz, “We’ll go to you to make a presentation if it’s more convenient.” The forums are conducted in conjunction with Community Services of New York, which sponsors the effort via a $40,000 grant. Both Ravitz and Ganaway praised county libraries for participating. On Oct. 7 at a spot to be determined, The Business Council plans to hold a breakfast with breakout sessions and officials on hand to answer questions. On the consumer bottom line, the hope

is exchange competition will serve to chill prices. As Ganaway said, “Private exchanges will offer commercial versions of the state plan. You can use it the same way, but options within it will certainly be different.” One difference, Ganaway noted: The state exchange offers tax breaks on insurance coverage retroactive to 2010 of 50 percent for companies with 50 or fewer employees (35 percent if it’s a nonprofit). After 2016, companies with 100 or fewer employees will reap the same tax breaks. There is no such tax break available through the private exchanges. Lisa Winn, education manager for White Plains-based American Booksellers Association said after the 90-minute presentation, “It’s a little frustrating without all the answers available.” But she said she would return to her job better informed. “There was a lot of information. It made me think about things I wasn’t even aware of yet.” One important detail has already been ciphered: how to determine a full-time worker. The answer is more a mathematics equation than a review of attendance records, with 30 hours per week constituting full time. Those happy with their coverage can simply continue as they have been doing.

ith New York state’s commitment to implement a common standards-based curriculum in all public schools by next year, one nonprofit educational foundation in Yonkers is asking Westchester County business leaders to make a smart investment: provide financial and intellectual resources to the public education system. Yonkers Partners in Education (YPIE) led a discussion Thursday on the partnership of business and education at a breakfast conference sponsored by The Business Council of Westchester at Xaviars X20 in Yonkers. The group, which hosted state education and business leaders, rallied around the idea that corporations are pivotal to helping students not only become college-ready but also become effective future employees in the workplace, too. YPIE addressed the challenges of the state’s Common Core Standards initiative, which outlines universal goals, concepts and procedures on what students should be learning at each grade level. The group sees ways that business leaders can collaborate with educators across multiple platforms even with the new standards. “With changing technology, companies have new ways of doing business,” Marsha Gordon, president and CEO of The Business Council of Westchester, said. “Small businesses count on schools to produce students who can carry out what they need students to do on the job.” JPMorgan Chase has partnered with YPIE to fund a software program called Naviance since 2009. The company tripled its initial investment to $90,000 last year, helping nine high schools and seven elementary and middle schools. Naviance, a college-readiness tool that allows students to take career inventory surveys and upload college applications, is a worthwhile investment, JPMorgan Chase Vice President Dennis McDermott said. The software allows students to create personal profiles and submit college applications. During the 2011-2012 school year, Naviance drew about 25,000 student visits, and students

altogether submitted 18,000 documents electronically to colleges, including transcripts, letters of recommendations and applications, according to Melissa Shuffield from JPMorgan Chase media relations. The software also allows the Yonkers Public Schools and YPIE to compile reports based on the data it provides about where high school students go after graduation. McDermott said JPMorgan Chase provides not only financial support but sends in retired employees and company directors to work directly with high school students as guidance counselors. “We’re not just blindly sending in checks but bringing in the expertise of the people working in the business world,” McDermott said. Other businesses are partnering with Westchester school districts to provide summer youth internships for about 200 students. Student interns shadow employees in companies ranging from biomedical engineering to software development. “These companies are getting them business internship opportunities,” said John Ravitz, executive vice president of The Business Council of Westchester. “We work with kids and give them what they need to know when going into job interviews. We want to put the future force in the industries they have a passion for.” State Education Commissioner John B. King said not every school has stateof-the-art tools, but schools can still standardize learning content with the new educational approach that will be implemented for incoming high school students in the 2014 academic year. “Not every school district has the ability to administer computer-based assessments,” King said. “We’re looking at how to get there in a reasonable way.” Companies that came out to support the Yonkers school district, the fourth largest in New York, included JPMorgan Chase, IBM Corp., General Electric Co., Regeneron Pharmaceuticals Inc. and Contrafect Corp. Partnerships between business leaders and educators will become the vehicle to graduate students who will be skilled and effective in the workforce, said Robert L. Corcoran, General Electric Foundation president and chairman.

Nationally, employees in the software group and marketing sectors took the biggest hit with 222 jobs eliminated, and the semiconductor research and development sector followed with 165 job cuts, according to Alliance@IBM. In Dutchess County, the county, state and five organizations have combined forces and are prepared to take action once IBM notifies the Department of Labor of the exact number of those who will remain jobless as opposed to those who are retiring, being relocated within the company or who have received job offers at other companies. The county was scheduled this week after press time to have a teleconference with state labor officials to discuss the interaction the department had with IBM, according to Ron Hicks, Dutchess County’s deputy commissioner for strategic planning and development. “We know so far that IBM has hired firms to provide services that are similar to the ones the Labor Department has,” he said. “These unemployment services may simply

The company last year sold the 40,000 square feet of office and retail space it owned in Manhattan at 225 Fifth Ave., a 12-story luxury condominium property near Madison Square Park. Myers said proceeds from that Manhattan sale are financing the Larchmont construction. “At the moment, we’re working with our own cash,” he said. The Irish developer stepped in after the property’s previous owner, Forest City Residential Group, based in Cleveland,

be handled by IBM, and the most the workers might have to do is file for unemployment. But we don’t know that yet. We need to be ready to go and set up sites where affected workers can meet with us and have access to hardware, software and the Internet. But we’re reassured because IBM understands they have an obligation to transition these employees.” The county has already identified three resource center locations in Poughkeepsie and southern Dutchess that could potentially be furnished with computers, copiers and phones for former IBM employees to help them with their job searches, Hicks said. The county has reached out to community organizations and has asked them to provide services including résumé writing workshops and budget counseling. The Dutchess County Regional Chamber of Commerce, a member of the alliance providing services to laid-off workers, plans to invite a larger-than-usual number of companies to its annual job fair, scheduled on Sept. 18. The venue will either be the Poughkeepsie Grand Hotel or the Civic Center depending on how many people register to attend. In previous years, about 60 companies attended, but now the chamber is pushing for 100 by reaching out to companies in Westchester

Ohio, met strong public opposition to its plans to build a rental apartment complex. Town of Mamaroneck officials also favored owner-occupied units to rentals, Myers said. Forest City in 2009 sold the Larchmont property to Byron Place Associates for $14 million. Forest City has focused its Westchester development plans on its proposed apartment and retail development at Echo Bay in the city of New Rochelle. Myers said the Cambium will include three levels of underground parking. Prices for one-bedroom and two-bedroom units average $650 per square foot. Condos range in size from about 800 square feet to approximately 1,600 square feet. The developer recently ended a 10 percent discount offer for preconstruction buyers. The Cambium is expected to be ready for occupancy by early 2015 or possibly late 2014, he said. “Since the construction started, there’s been a big increase in activity” at the Cambium sales office, said Myers. “The downsizers are sick and tired of mowing the grass and fixing the roof,” he said. Those prospective buyers have strong ties to Larchmont but don’t want to stay in their single-family homes. “That’s where we’re seeing the strong interest.” Cambium sales director Susie Joyce

Sean Patrick Maloney, a Putnam County Democrat, said he would endorse a “community transition team” that brings together community organizations, elected officials and business leaders to help families affected by IBM’s downsizing. “This is devastating news for our neighbors and friends at IBM,” Maloney said in a press release. “But I want them to know that their community is here for them, and we will do whatever possible to get them through this difficult time and get them back to work as soon as possible.” Although Westchester stands in a holding pattern until it has a better grasp of the number of residents who will be unemployed, county officials said they will be ready to assist when needed. Eileen Mildenberger, director of the Westchester Office of Economic Development, said if software-related positions are where the cuts come from, there is optimism those laid off won’t be out of

work long. “The Hudson Valley has high-tech industries that are growing and high-skilled laborers are needed to work there,” she said. “We also provide resources that help employees seeking jobs and match them up through our workforce investment board.” Meanwhile, in Armonk near IBM headquarters, store owners hoped that ripple effects from the cuts wouldn’t rattle stores in the region. Tazza Café, at 382 Main St. in downtown Armonk, has still been getting a slew of customers during its morning coffee rushes and afternoon lunch breaks. It’s been business as usual, said café owner James Monica. “We see a decent amount of people who say they’re with IBM, but they’re mostly people who visit IBM to do business there, not the regular employees,” Monica said. Nearby, at DeCicco’s, a grocery store that opened this month, owner and president John DeCicco looked at the bright side of the cuts. “If layoffs at IBM continue, it helps us be a better company,” DeCicco said. “Usually people don’t see the supermarket business as glamorous and high-paying, but when the time comes, we hire people with different educational levels and industry backgrounds.”

said the Palmer Avenue office is “getting a lot of people from Manhattan. The rents are so high and fairly many of these young couples can’t afford to live in the city anymore.” Myers said the Irish team plans to focus its development efforts in Westchester County. “We’re not doing anything else until we get this (Larchmont project) further along,” he said. “It looks like the city is

becoming very competitive. We don’t have much competition in Westchester.” Though condominium development in Westchester came to a halt in the recession five years ago, Myers said the partners expect to see ample demand for their residences at 10 Byron Place. “The housing market in Larchmont didn’t suffer nearly as much as many other locations,” he said. “It’s fairly strong. There’s vitality in the market.”


Nursery property coveted as sports venue Two parties have staked their claims to Greenburgh lot

he town of Greenburgh has initiated plans to move forward with a request for proposals (RFP) and open bidding on the sale of the former Frank’s Nursery, a vacant 7-acre property at 715 Dobbs Ferry Road. The town acquired the land in a 2011 tax foreclosure and received an offer from Game On 365 L.L.C., which proposed to buy it for $1.7 million with the promise of paying another $1.3 million over 13 years. Town officials announced they’d agreed to the deal at a press conference last month. But critics questioned the agreement, claiming that its phrasing didn’t properly ensure payment of the $1.3 million. They also questioned why the town had not accepted an offer from Ardsley-based House of Sports, which had jumped in with a $3.5 million cash offer to take the property “as is.” Earlier this month, the town changed

course and offered the property to House of Sports. Both companies wanted to transform the dilapidated parcel into a sports facil-

ity. Each threatened to sue the town if its rival bought the land. At a June 18 work session, town officials decided to start the process again and issue a standard RFP.

House of Sports CEO Donald Scherer said his company’s development project, which he said could be 50,000 to 70,000 square feet of space, could cost from $10 million to $15 million. Before any development, he said he would need to discuss with the town ways to clean up the property. “We would have to address the environmental contamination because the property is filled with carcinogens from chemical factories in White Plains,” Scherer said. “We need to do some remediation, so it’s a safe environment for kids. That could mean pumping out the groundwater. We’ll see how the town and DEC (Department of Environmental Conservation) want us to handle that.” The town board is expected to authorize the RFP this month. Greenburgh Town Supervisor Paul Feiner said he expected that the starting bid would be $3.5 million, matching Scherer’s previous high offer . Game On project manager Martin Hewitt said an open bidding process is

The town board is setting the parameters for acceptable uses of the property by potential buyers. The town is in the process of drafting a municipal Comprehensive Plan, a guiding map for local zoning and development. Feiner said town officials will make sure the RFP is consistent with the plan, which he expects will be released in the fall. “We haven’t finalized the RFP document yet,” Feiner said. “We don’t want to make this a commercial strip.” “My gut feeling is we probably would sell the property by sometime next year,” Feiner said. “One of the complaints the last time we did an RFP is that we didn’t give people enough time to bid. This time, we’ll put up signs on the property early, reach out to people and give the community an opportunity to participate in the review process before we finalize any plans.”

getting a handle on inventory Last time we did inventory was three years ago. Inventory is a big project. It takes a lot of manpower to do it. I feel like, “why bother?” even though I know things are slipping through the cracks. Help me figure out a better way. THOUGHTS OF THE DAY: Many small businesses overlook inventory – that doesn’t make it right. Managing inventory flow can put dollars in your pocket. Get a firm handle on what needs to be ordered and plan it out. Regular inventory counts make it easier to correct errors, spot losses and identify opportunities for savings. Set up a place to receive, store and distribute goods. Cut down on the number of people who can order and pick up materials. Log everything in and out. If parts need to go out into the field, set up a standard stock for each truck. The best of intentions can turn into the worst of outcomes if you don’t have access control. People stop by inventory stor-

age, pick up parts they need and forget to write down what they took. Clients don’t get charged. Parts disappear. Profits decline. Who wants that? You work too hard negotiating prices with clients to give back even a small portion of profits through loss of control. With each order, develop a parts request form. Note on the form if the order is for standard materials or if extra or unusual parts are needed. Get the parts request forms to a central desk that reviews what’s in stock and places orders to meet delivery date, work with preferred vendors and get the best possible price. Reduce the amount of time that parts sit around. Work with suppliers who can deliver parts with a few days to spare, not weeks or months ahead of time. That will help protect cash flow. It will also help to reduce losses and miscounts in cases in which inventory gets used for something other than what it was planned for. Set up inventory storage racks and keep everything locked up. Assign someone with good detail and clerical skills to keep track of what goes in and out of inventory, backed

up with a purchase order system. Issue a purchase order (PO) when inventory stock is requested from a vendor. Record the agreed -upon price of the parts on the PO. When the order comes in, check it into inventory, using the PO to verify quantity and price. Set up an internal system to check inventory out of stock. Record who got what parts and when they got them. Make people accountable for recording what’s used and returning unused inventory to stock. Once you can control inventory in and out, back that up with a regular counts of what’s sitting in storage. Don’t try to count everything at once. Set a day/week or time/ day to count. Work through sections of the warehouse each week. Have a check sheet to write down when counts don’t match what is expected to be on the shelves. Assign someone to do research on what’s missing. Create a form to log lost, broken or missing parts that people in the warehouse, the factory and the field can all use. Keep track of who is having the most problems and who is the most accurate. Set up training sessions to improve accuracy. Treat losses seriously, reward accuracy.

Teach your people in the warehouse and those who are asking to pull inventory out of stock, that inventory is just like cash. Manage the pennies and the dollars will take care of themselves. Finally, having an accurate inventory count will give you more leverage with your bank. Inventory is like cash. If you can’t sell it back to the manufacturer or distributor, at least you can use it to make something you can sell. While it is sitting around, it has value. INBRIEF State launches third regional funding round

Empire State Development officials said up to $760 million is available this year for economic development projects across New York in the third round of the Consolidated Funding Application (CFA) process started by Gov. Andrew Cuomo. Channeled through the 10 regional economic development councils created by Cuomo in 2011, project grant applications will be accepted from businesses, municipalities, nonprofits and the public. The deadline for applications is 4 p.m. on Aug. 12. The CFA is available at https://apps.cio. ny.gov/apps/cfa/. The consolidated application streamlines and speeds up state agencies’ reviews of projects and eliminates the slow navigation through multiple agencies and funding sources that applicants previously faced in Albany. Thirteen state agencies will award funds through 29 programs in the third round of applications. Program funding is outlined in the 2013 Available CFA Resources Manual. The 2013 REDC Guidebook lists the competitive guidelines for this year. Both guides

Job numbers lost to recession return in full

New York is the first state to regain all the jobs it lost in the recession, according to TD Economics, an affiliate of TD Bank. TD Bank has 14 branches in Westchester County and another 25 in the Hudson Valley south of Columbia and Greene counties. Its economic arm released its Small Business Recovery Report June 11. The economists offered no metrics of types of jobs lost vs. jobs regained, but stated small- and medium-sized businesses get the credit for the recovery. Two sectors in particular, TD Economics reported, are doing well and are dominated by smaller companies: the accommodations and food sector; and the professional, scientific and technical services sector. The economists label hiring in those sectors “brisk.” TD Economics echoed the findings from some 31,000 telephone calls and another 5,000 personal visits small businesses by TD Bank small business relationship managers when gauging banking needs. This is the third designated “business blitz” conducted by Portland, Maine-based TD’s economic arm.

Pepsi enters upstate yogurt venture

Pepsi’s march into foods other than soft drinks continued this month with the June 3 opening of a yogurt plant in a Genesee County business park. The $206 million Muller Quaker Dairy plant in Batavia is a joint venture of Purchase-based PepsiCo and Germany’s Theo Muller Co. Pepsi owns Chicago-based Quaker Oats Co., which also is a participant in the venture, initiated in 2011. The 350,000-square-foot plant in the Genesee Valley Agri-Business Park will produce a variety of yogurt products. It will employ 150 to 180 workers and is expected to churn out 120,000 cups per hour. The plant is beside a $20 million yogurt plant opened last October by Alpina Foods, based in Bogota, Colombia. “PepsiCo continues to perform at an extremely high level while simultaneously transforming our portfolio for the future and strengthening our position in high-growth food and beverage categories,” said CEO and chairwoman Indra Nooyi. “We have invested over many years to expand our global nutrition offerings in ways that allow us to capitalize on new growth opportunities, and the new Muller Quaker Dairy facility demonstrates continued progress against this key business priority.” Pepsi did not announce its stake in the venture. Theo Muller was founded in 1896 in

Bavaria and is a major producer and distributor of dairy products in Europe.

Outlets eye wealthy Latin travelers

Citing a boom in travel from Latin America to the U.S., Indianapolis-based Simon Property Group Inc. recently initiated a drive-and-save plan to generate traffic to some of its properties. The target demographic, according to Simon: “well-heeled South American tourists.” Simon owns Woodbury Common Premium Outlets in Central Valley, with 220 stores, and The Shops at Nanuet, where Sears and Macy’s remain open during mall reconstruction. Woodbury is part of the promotion; Nanuet is not. The retail development company teamed with Budget Car Rental Inc. to incentivize Simon shopping for those who opt for Budget. When travelers make a Budget reservation in Boston, Miami, New York or Orlando, they will receive a shopping voucher that can be redeemed for a package of coupons, discounts and other special offers at Woodbury Common and at Burlington Mall and Wrentham Village Premium Outlets in Boston; four malls in Miami; and three malls in Orlando. To move a firm

“I

t’ll turn up,” could be the unofficial motto of a major move. Unstated and understood is that the entire relocation process is a vortex of confusion. A law firm has no such wiggle room and neither the 160 lawyers of Wilson Elser Moskowitz Edelman & Dicker L.L.P.’s White Plains office nor their clients expect it. Rather, as the firm’s director of marketing, Kristin Coda, said of the coming move from 3 Gannett Drive across the street to 1133 Westchester Ave. in White Plains, “You would not know it’s taking place. A client can call July 3 before the move and call again the morning of July 8 after the move – call the same number – and that client would not have a sense that we moved. That’s the point.” She called the effort “a symphony with everyone doing their part.” The firm moved originally into 57,000 square feet at 3 Gannett. Across 12 years, it gerrymandered an additional noncontiguous 85,000 square feet into its office there. The 1133 Westchester Ave. address has 6,000 fewer square feet – 136,000 total – but makes up for the loss in layout and amenities, according to managing partner John Flannery. “Pretty much everything you’d see in a top-flight building in Manhattan,” he said. Said Robert Roarke, managing partner of Wilson Elser’s New York metro region, “There were simply too many inefficiencies in a build-out that is now three floors without a common hallway.” Besides adjoining hallways, the total 620,000-square-foot RPW building at 1133 Westchester Ave. offers Wilson Elser an executive dining room, full-service cafeteria, fitness center, sundries shop and a child care center, which offers services from infancy to kindergarten. The 3 Gannett building has none of those, although landlord Heritage Realty Services recently debuted a new dining room and full-service cafeteria across the street at 2 Gannett Drive and 4 Gannett Drive has hosted Strata Health Club since 2008. On June 14, in the Wilson Elser offices, it was law as usual, except for a blizzard of coded Stick’ems affixed to chairs, tables,

desks and, especially, to filing cabinets and to the contents within. The codes had colors and numbers so that items as disparate as individual files and individual conference tables find their designated spots. Nothing was posthaste; planning began in January. “This is not new for us,” said Roarke. “We have 24 offices and from time to time we move. We have good experience and I’m happy to report this move has gone well. July 3 is our last day on Gannett Drive. And July 8 we’re in our new office, with zero disruption in service.” “We’re always thinking clients first,” Coda said. “That’s the business we’re in,” Roarke said. Computers will be moved, installed and completely tested over the long July 4 weekend. The firm itself will notify the state of change of address, a legal requirement germane to bail hearings and receiving docu-

ments. Additionally, Coda said, “We’ve written a communication to go to the attorneys’ clients saying we’re moving and [the attorneys] can attach a personal note.” “We’ve done this before,” Flannery said. “It’s a huge benefit to have Jimmy. It means lawyers spend very little time moving, and this is a goal. They’re basically responsible for packing up their photos and diplomas, but if they want to leave those, they’ll be bubblewrapped, coded and shipped with the rest of the office.” “Jimmy” is James DiBenedetto, Wilson Elser’s administrative director, who, by his own reckoning, has supervised some 25 moves for the firm. A previous move in Manhattan and this one, he said, are “easily” his two biggest. “It’s nothing too difficult,” DiBenedetto said. “This is a pretty easy, pretty straightforward logistical move: Get it out; get it over there; set it up. No surprises.” “In terms of function, there will be no

hiccup,” Flannery said. As a consumer gets estimates, so Wilson Elser issued an RFP for its move. The firm selected New York City-based Certified Moving, which specializes in moving law firms. DiBenedetto said payments vary for the work, which is, by its nature, customized: about $4 to $7 per square foot (in the $500,000-$750,000 range for Wilson Elser’s move). Many of the 230 truckloads required to move the firm will be filled with paper files. “Every day, we work on digitizing,” Roarke said. “But paper is still a reality. If you come up with a solution, let me know.” Still, after 39 years with the firm, he said: “I can’t say I was this calm in other moves. It comes with working with the right people.” The firm expects clockwork, but its clients can be more casual. “On July 8 our new address becomes official,” Coda said. “We’ll update it and say so in our communications for the next 60 to 90 days.” WCBJ • June 24, 2013

women’s bar association names new president

T

he Women’s Bar Association of the State of New York appointed White Plains attorney Donna E. Frosco as its new president. Frosco, who is a Chappaqua resident, previously served as treasurer and vice president of the association. Magistrate Judge Lisa Margaret Smith, of the U.S. District Court for the Southern District of New York, installed Frosco into office at the association’s annual convention June 8. The association, which is one of three statewide bar associations in New York, has more than 3,800 members in 18 chapters throughout the state. Elder care emerging as workplace issue By Bernard A. Krooks

A

s baby boomers age, work-life balance is taking on new meaning, with important implications for business. The government estimates that by 2018, nearly a quarter of the U.S. workforce will be 55 or older. Given the recession’s blow to retirement accounts, many boomers will need to work longer than they’d anticipated. At the same time, many will be caring for fragile parents who are living longer, due to medical advances. A study by AARP’s Public Policy Institute labels care of the elderly the “new normal” for American families. Care needs can erupt suddenly and dramatically, disrupting long-established roles and responsibilities. And there are indications that today’s caregivers are dealing with increased disabilities, requiring them to provide more intimate, physically demanding assistance.

Businesses that fail to adapt to these demographic shifts stand to lose big. Gallup reports that employees missing work to care for a loved one costs companies close to $25 billion annually. This number may be shocking, but consider that according to AARP, the typical caregiver for an elderly person devotes almost 20 hours per week for five years to the task. All that juggling results in stress and burnout, which in turn can cause health and morale problems. Valued and experienced employees can be lost if they’re unable to navigate both work and family life. Elder care demands misunderstood Unfortunately, the burdens of elder care aren’t widely appreciated, and the conflicts faced by caregivers may sometimes be interpreted as a lack of career commitment. AARP points out that if unequal treatment results from such assumptions, it constitutes “family responsibilities discrimination (FRD).” According to the National Alliance for Caregiving, some employees conceal their family situations because they fear just such a response. And, indeed, FRD is becoming an

important public policy issue, with advocates pushing for legal reform. At present, although federal law protects workers against bias based on many factors – disability, sex, race, religion, national origin – there is no focus on discrimination against caregivers as a group. Only four states and the District of Columbia have laws on the books that specifically protect family caregivers, and New York is not one of them. AARP and other advocates are working to change that. To date, legal action has largely relied on claims of sex discrimination (women comprise 65 percent of family caregivers), responsibility for someone with a disability, or breaches of family and medical leave law. The Family and Medical Leave Act (FMLA) mandates that companies employing 50 or more individuals must allow as much as 12 weeks of unpaid leave each year for care of a parent, spouse or child. But elder care often involves intermittent, crisis-driven demands, and may involve family members not covered under the law. Some advocates are suggesting that FMLA be amended to protect any primary caregiver and to apply to small businesses. Ways to help There are many steps that businesses could take to prepare for these changing social needs. Research by the National Alliance for Caregiving indicates that both employers and employees benefit from the smaller turnover rate, higher productivity and improved morale that often result when workplace elder care programs are established. Because the demands of elder care are not common knowledge, stereotypes sometimes exist concerning older employees whose workdays are repeatedly disrupted by family crises. Addressing this topic in diversity training could help to create business cultures that recognize and validate the sometimes significant outside demands placed on caregivers. Much has been written about the business advantages of workplace flexibility. Telecommuting, compressed work weeks and modified start/stop times could enable workers to better coordinate their personal and professional responsibilities. Hourly employees, who may work variable shifts, could benefit from predictable scheduling that enables them to plan ahead. Since frequently revised “just-in-time” schedules often result in high absenteeism and turnover, this change could save employers money in the long run. Benefit plans could include options for subsidized home care to cover emergencies. Human resource departments could help employees identify government programs, fee-based services and community support

groups to assist them with workers’ caregiver responsibilities. Due to their great numbers, baby boomers will continue to precipitate social change, as they have throughout their lives. And their emerging role as caregivers to an older generation will have far-reaching implications for families, public policy and the economy. Savvy business leaders will take steps to accommo-

date the inevitable pressures to be faced by this cohort of highly experienced employees. Bernard A. CAMPAIGN SEEKING MANDATE RELIEF LAUNCHED The WCA is a founding member of a grassroots coalition of citizens, local government, business and school districts that have joined together to put pressure on Albany to take immediate action on a bi-partisan bill to stop future unfunded mandates. The STOP (“Stop Taking Our Power”) Albany coalition is seeking mandate relief—that is, relief from mandated items, such as Medicaid and pensions. They are costing Westchester $454 million or 85 cents out of every dollar of the county tax levy, that could be better spent on local services and education. On May 23, members of the STOP Albany coalition held a press conference at WCA’s offices to launch the grassroots campaign, which includes sending a letter to state representatives via STOPAlbany.com, and signing a digital petition via Facebook (facebook.com/STOPAlbany) and Twitter (twitter.com/STOPalbany.com). “The WCA advocated for the passage of the two percent tax cap, as we believed it would drive the mandate relief so needed by our local schools and governments,” notes Amy Allen, WCA’s managing director, advocacy and international business. “That half of the equation has not materialized, so the time has come to take action with a unified voice.” She added that

he New York State Bar Association joined leaders in international law on June 17 at a celebration that recognized the opening of the New York International Arbitration Center at 150 E. 42nd St. in New York City. Judith S. Kaye, former chief judge of the state of New York, will act as chair of the

New York International Arbitration Center. State Bar President David M. Schraver said in a press release that New York has a long and illustrious reputation as a global center for the resolution of complex international legal issues. “The opening of the New York International Arbitration Center solidifies that reputation and sends a strong message that New York remains firmly committed to meeting the needs of the worldwide legal

The New York International Arbitration Center, formed with the support of 36 firms, offers high-tech facilities including large hearing rooms with video-conferencing equipment, LCD monitors and spaces for simultaneous interpretation. The location will begin mediation sessions in July. The New York State Bar Associations Task Force on New York Law in

International Maters recommended building an international arbitration center was created in 2011. The task force was created by then-President Stephen P. Younger and co-chaired by James B. Hurlock of New York City and the late Joseph T. McLaughlin. The task force was asked to review New York’s laws as an international standard

and to examine New York’s role as a neutral forum for resolving international disputes. The task force had international experts in commercial law, arbitration, media and litigation and represents major law firms, law schools and arbitration centers. “New York has for years been the ideal site for arbitrations from around the world. Among many other things, New York has a consistent, widely respected body of applicable commercial law,” John Wilkinson, the chairperson of the Dispute Resolution Section, said in a release. “Now, with this wonderful new facility, New York simply has it all when it comes to international arbitration. Nowhere else is even close.” Kaye hosted the reception with Patricia O’Brien, United Nations undersecretarygeneral for legal affairs and legal counsel, delivering the keynote address. The reception provided a tribute to McLaughlin who was a pioneer in international arbitration in New York.

“D

aphnia,” Matt Weisberg told an inquiring reporter aboard a brightly painted bus parked on a lawn outside Foxfire School in Yonkers. We eyed a jumpy, wriggling creature doing a primitive dance on two computer screens wired to microscopes in a refitted city bus that, in another era, might have carried a commune-hopping hippie family across the country. “It’s a small freshwater crustacean,” Weisberg elaborated. The shrimp is its relative. “You didn’t know that?” Westchester County Executive Robert P. Astorino teased the inquiring reporter. Astorino had stopped by to check out this mobile science lab, the BioBus, on one of its several stops this month at public schools and youth venues in the county. In the performance of official duty, he obligingly peered into a microscope in search of daphnia through its high-powered lens. “Do you see anything?” Weisberg asked. The county executive muttered a yes, though not too convincingly. “It’s creepy,” said a boy in a sixth-grade class, watching the brown-bodied specimens gyrate Gangnam-style on the monitors. “This kind of experience taps their creativity,” Iris Pagan, executive director of the Westchester County Youth Bureau, said outside the bus as another Foxfire class climbed aboard for a 45-miunte exploration of microscopic daphnia – called water fleas in unscientific circles – and students’ own cheek cells. “You want them to have this kind of experience that’s going to open their brains to ask questions about the world,” said Pagan. The county youth bureau partnered with Regeneron Pharmaceuticals Inc. in Greenburgh, the state’s largest biotechnology employer, to schedule a series of BioBus visits that have reached youths from Peekskill to Mount Vernon. The educational outreach especially targets communities and students with limited access to the donated scientific lab equipment aboard the bus, which in its youth did civic duty in that ancient capital of hippiedom, San Francisco. This was the gasguzzling, solar-paneled lab’s second stop on Foxfire’s North Broadway campus. Regeneron has been a BioBus sponsor since 2011, connecting it with more than 30 schools in Westchester and in the Albany area, where the company operates a manufacturing plant in Rensselaerville. Regeneron spokesman Peter Dworkin in a press release described the company’s

deep commitment to advancing STEM, that increasingly oft-heard acronym for science, technology, engineering and mathematical studies in which many American schools are found to be lagging. Dworkin said Regeneron especially promotes the S in STEM – science education, “in order to deepen the pipeline of students prepared to compete and excel as our future workforce.” “Companies, like Regeneron, that are driven by science have a responsibility and opportunity to address the STEM achievement gap,” he said. “We collaborate with educational organizations and government to increase the number of students excited, engaged and educated in STEM.” Aboard the BioBus, staff scientists see that excitement in students engaged in hands-on and swab-your-mouth learning. From surveys of disembarking students, BioBus staff has noted a threefold increase in the number of those highly interested in a science career. “We don’t really have anyone but the students to answer to,” BioBus worker Matt Weisberg said between classes in Yonkers. “So we can make it about them. At the end of the day, they are our judges.” Weisberg grew up in Scarsdale and New Rochelle and last year earned an undergraduate degree from Brown University, where he majored in computational biology. Last September, he followed his older sister, Sarah, aboard the BioBus as an employee. In a curtained rear compartment, Weisberg led a Socratic lesson in cellular identity as students’ cheek cells floated outsized on a large flat screen connected to the bus’ most powerful microscope “Ooh, that’s nasty,” one boy said as he watched isolated human cells randomly mix and mingle on screen. “No it’s not!” said a scolding girl, perhaps a budding scientist, who had volunteered her cells for the demonstration. “The idea that we are the teamwork of billions of living organisms working together is a very difficult idea to grasp,” Weisberg told us. “That’s what I love to talk about – connections between things that seem different.” At 24, Weisberg is too young to drive the BioBus without its owner paying a hefty insurance premium. The driving is chiefly left to BioBus founder Ben Dubin-Thaler, who rolled out the GMC rig and educational concept in 2007 and who runs it through his New York City nonprofit, Cell Motion Laboratories Inc. and hurried back to New York City, where he and staff are preparing a major expansion of their mission with the opening of a stationary lab, Bio Base, on the Lower East Side. It will train BioBus volunteers and offer professional development classes for teachers. It will also be a place where students can follow up on their initial eye-opening experience aboard the bus, he told us over the phone. Arriving in New York as an undergraduate at Columbia University, Dubin-Thaler saw the disparity between people with access to “a very good education” and those who lack that opportunity. “That bothered me the whole time I was at Columbia,” he said, “but I never knew what to do about it.” Pursuing a doctoral degree in cell biophysics at Columbia, Dubin-Thaler noticed that visitors to his lab with no professed interest in science – the janitor on his floor was one – “would get really excited about what they saw under the microscope.” He saw the power of “hands-on experience” in sparking an interest in scientific learning. “The bus just kind of popped into my head,” he said. It was a convenient way to bring his research lab to students. Dubin-Thaler knew the bus model that he wanted for his venture – a GMC transit bus known as The Fishbowl – and went searching for it online. “The first link that popped up was Craigslist South Dakota,” he said. A family there had converted a 1974 bus into a recreational vehicle with solar panels on its roof. In a previous life, it had carried Golden Gate Transit passengers across the

San Francisco bridge. Dubin-Thaler paid $15,000 for it, and BioBus was born. “On a good day, it’s getting about six miles to the gallon, seven if we’re really lucky,” he said. Dubin-Thaler and other staff scientists on board, such as Sarah Weisberg, have set aside their career plans to become university professors engaged in laboratory research in their fields. “There are lots and of smart people doing research right now,” said DubinThaler. “There aren’t a lot of smart people figuring out new ways in science education.” With six years on the road, the BioBus has nearly 350 educational stops “all over the country, but mostly in the New York metropolitan area,”’ he said. It has hosted nearly 80,000 youths, many of them from low-income neighborhoods in the boroughs and Westchester. “There’s not a lot of educational interventions that have the numbers that we do,” he said. “From the very beginning, what really made it work was the donations we received” from corporations. An early sponsor, Olympus Microscopes, donated the first high-tech equipment, “the same kind of microscope I use in the lab” at Columbia. At Regeneron, “They’ve been just amazing,” said the BioBus founder and chief driver. “This is not just a publicity thing for them. They are just committed to scientific education.
