The 529 –more than a college savings plan

As tuition and learning expenses increase, planning for your children's or beneficiaries' educational future is crucial. For many caregivers still grappling with student loan nightmares, saving up for your children's education is a cost-effective option.

A 529 plan is a significant solution for securing your child's education future as the state-sponsored initiative offers tax advantages for contributions into the account.

THE BASICS

Every state offers at least one 529 plan. However, tax incentives on deposits are not mandatory, which is why they vary among states. Many states offer a tax deduction or tax credit for contributions to a 529 plan, enabling parents to lower their tax liabilities by saving for their children's education. For most 529 plans, contributions are taxable, money in the account grows tax-free and distributions are tax-exempt when used for qualified education expenses.

KINDERGARTEN THROUGH 12TH GRADE PRIVATE EDUCATION

Recent law changes allow you to pay tuition with 529 plans for qualified kindergarten through 12th grade private schools. The spending limit per beneficiary is $10,000 per year. However, the payment only covers tuition, not other school-related expenses. Tax implications vary among states. Check your state's tax codes to verify if K through 12 withdrawals have the same treatment as college withdrawals.

THE 529 MAKES FOR A GREAT MULTIGENERATIONAL LEGACY PLAN

Account holders of 529 plans have the liberty to change beneficiaries as they see fit. Thus, if you open an account for your child, and overfund it, you can roll over the remainder of the account to your grandchild and continue to fund it even further. Your money can always be put to good use for your beneficiaries. This allows for true multigenerational educational planning with tremendous tax deferral benefits.

CONSIDER YOUR OPTIONS

The 529 plan offesr a truly attractive way to save for your child’s education, but it certainly isn’t the only way. Sit down with a financial planner who can better understand your goals, factor in your current tax situation and model your potential future financial life to determine which tool(s) will give you the most appropriate customized approach to supporting your child’s future education.

YOU CAN CONVERT UNUSED OR UNNEEDED BENEFITS TO A ROTH IRA

The latest 529 plan development is that you can rollover up to $35,000 per beneficiary of unused or unneeded benefits into a Roth IRA account in the beneficiary's (student's) name. The provision offers tax relief for people who had to pay taxes or incur penalties for leftover funds in their 529 plans.

The rollover must follow Roth conversion rules. Thus, you cannot exceed the annual Roth contribution limit set at $7,000 per year for 2024. The beneficiary must also have earned income equal to or at least as much as the transferred amount. You cannot transfer the entire $35,000 at once.

The 529 plan account must be in existence for 15 years to qualify for a Roth conversion. Changing beneficiaries within the account's period of existence may reset the clock. Additionally, you can only convert funds that have been in the 529 plan for at least five years.

Your Modified Adjusted Gross Income (MAGI) determines your eligibility and contribution amount to a Roth IRA. In 2024, single filers with less than $161,000 and married individuals filing jointly with MAGI less than $240,000 are eligible for Roth IRA contributions. Your contribution amount diminishes if your income lies within the limit.

The rule does not apply for 529 plan conversion to a Roth IRA, because income limits do not directly apply. You can take advantage of this provision if your income is too high, making you ineligible to open a Roth IRA account or make maximum contributions. In theory, if you’re a high earner, you could set aside funds in a 529 plan and convert the account to a Roth IRA in 15 years.

to local nonprofit providing comfort to pediatric cancer patients

Since its beginnings in 2020, Greenwich-based Hats4Healing has donated more than 2,500 hats to comfort pediatric cancer patients globally.

“A big goal of mine over the years has been to establish a sense of community and unity,” said Hats4Healing President Sofia Iuteri, who started the nonprofit when she was 16 and is a rising sophomore at Washington & Lee University in Lexington, Virginia.

The organization has more than 200 volunteers worldwide, including students from Greenwich High School, local knitting groups, senior centers, retirement communities and church groups. But Iuteri is looking to broaden its presence.

Previously, she self-funded Hats4Healing with minimal donations. Now she’s looking for paid advertisers on its digital platforms.

Iuteri has also received a $6,000 Johnson Opportunity Grant from Washington & Lee University. She has allocated a significant portion of the grant to creating “knit-for-acause” kits, which she launched this summer in the hope that they will drive revenue, build community and foster volunteer engagement.

The knitting kits include knitting needles and yarn, step-by-step instructions for how to knit hats and custom Hats4Healing stationery to write a personalized note to a pediatric cancer patient.

“The ‘knit-for-a-cause’ initiative aims to further support the cancer community by enabling volunteers to create handmade hats that offer warmth, comfort and a sense of unity (with) pediatric patients,” Iuteri said.

The next step is to form partnerships with people like Taylor Sundby, M.D., a pediatric oncologist with the National Institute of Health (NIH) in Washington, D.C., and develop more involvement on the Washington & Lee campus as she seeks other granting opportunities.

As Iuteri added, “The Washington & Lee connection will enable Hats4Healing to reach hospitals in Washington, D.C., (and) surrounding regions that are medically underserved.”

Connecticut to build 758 new housing units with mix of state and private financing

On August 22 the Connecticut Department of Housing (DOH) and the Connecticut Housing Finance Authority (CHFA) announced a financing agreement for six developments across the state. Four of the six developments are in Fairfield County.

“We’re excited that these finance agreements are done, and construction can begin, “said Connecticut Housing Commissioner Seila Mosquera-Bruno. “These units will become permanent homes for our residents who deserve high-quality affordable living. DOH will continue to work as fast as possible to ensure our families and individuals have affordable housing options in their own communities.”

The announcement notes that the DOH is providing over $25 million in loans and grants, while the CHFA is providing low-income housing tax credits (LIHTCs) that are expected to draw over $93 million in private investments.

362 units will be funded through the new Build for CT program. The program is a collaboration between the DOH and CHFA to support the creation of apartments aimed at providing an affordable option for middle-income renters.

“These new developments exemplify our commitment to creating economically diverse communities through strategic public-private partnerships,” said Nandini Natarajan, CEO and Executive Director of CHFA. “By leveraging programs like Build For CT and LIHTC, we’re not only providing quality, affordable housing for a wide range of income levels but also driving significant private investment into Connecticut’s neighborhoods. These developments are a testament to what can be achieved when we combine resources and collaborate to address the state’s housing needs.”

The developments include Monterey Village in Norwalk, a 161unit community which is 4 percent LIHTCs. It is expected to generate over $21 million in private investment, while all units will be restricted to households earning 60 percent of the area median income or less.

Wall Street Place, also in Norwalk and colloquially known as “The Tyvek Palace” after construction stalled out years ago, is also slated for development in a collaboration between Wall Street Recap

Associates, LLC and the Norwalk Development Agency with support from the city. DOH has earmarked $13.6 million for the project plus 4 percent in LIHTCs expected to raise around $55 million in private investments. The end result should be the development of 155 new units, restricted to households earning between 20 to 80 percent of the area’s median income.

Oak Park Phase I in Stamford will see 1940s vintage housing stock replaced with 61 units designated

for households earning 60 percent of the area median income or less, and 19 reserved for very low-income families. The first phase will also bring with it a new part-time community coordinator position. DOH will provide $4 million in financing for this project, and CHFA will grant LIHTCs for 9 percent of the financing, garnering more than $17 million in private investment.

Westport will also see the construction of 19 units at 122 Wilton Road. The units will serve individu-

als at or below 60 percent of the area median income. DOH has provided $7,555,000 in funding to acquire the property adjacent to the Saugatuck River. The project is a collaboration between WRCH, a local company, and Homes with Hope, a local non-profit working to end homelessness across Fairfield County.

Outside of Fairfield County, Waterford Woods in Waterford and Ponemah South Mill in Norwich will create a combined 362 new housing units.

Yonkers doctor sues his billing company

A Yonkers medical practice is demanding $1 million from its billing service for allegedly mishandling insurance claims.

Dr. Binod Shah and Spinal Pain & Rehab Medical PC accused Bays RVP Billing & Consulting of breach of contract, in a complaint filed on Aug. 28 in Westchester Supreme Court. "If claims are not timely submitted," the complaint states, "they are rejected and Shah and Spinal Pain do not get paid."

Shah, of Scarsdale, founded Spinal Pain in 2005. He is a physiatrist who has held himself out as an expert in treating rotator cuff injuries, arthritis, neck pains and spinal problems.

In 2021, Shah hired Bays, of Hackensack, New Jersey, to handle billing, collections and claims appeals, according to the complaint. He authorized the company to use his National Provider Identifier, a unique number that enables doctors to bill for Medicare services and to electronically exchange information with other doctors and health plans.

Bays failed to bill in time for Covid tests, causing Spinal Pain to lose significant revenue, the complaint states, and used the NPI number to submit claims for other entities.

Claims submitted for work that Shah or Spinal Pain did not perform could expose him to liability under the federal False Claims Act, according to the complaint.

An attorney sent a cease and desist letter on March 21, demanding that Bays "immediately stop the fraudulent use of Shah's NPI number for entities other than Spinal Pain," the complaint states, and to turn over copies of all bills that use Shah's NPI number.

Shah is asking the court to order Bays to defend him and to cover the costs of any actions brought under the False Claims Act or by a state licensing agency. He is also asking for a judicial order requiring Bays to provide copies of all claims submitted under his NPI number and to cease using his number for other entities.

Bays did not reply to an email asking for its side of the story.

Core4Capital looks to transform workplaces and add to portfolio

Last month, Core4Capital Corp. President and CEO Steven Spitz welcomed the tenants of 2975 Westchester Ave. in Harrison to a ribbon cutting of the building’s new fitness center. The gym boasts state-of-the-art exercise equipment, high-definition TVs and a wall art collection featuring celebrity fitness icons like Arnold Schwarzenegger, Jane Fonda, Chuck Norris, Richard Simmons and Jack LaLanne.

The fitness center serves as a prime example of Core4Capital’s interest in upgrading its Westchester County workspaces. As the demand for high-quality residential spaces continues to surge in Westchester, with new luxury apartment complexes dotting the landscapes of New Rochelle, White Plains and beyond, Core4Capital wants to bring the same sophistication and comfort to the business world.

Since acquiring 399 Knollwood Road in White Plains in 2015 and 2975 Westchester Ave. in 2018, the company has undertaken extensive renovations to enhance both properties.

The two buildings underwent comprehensive upgrades, including new landscaping, lighting, carpet-

ing and paint.

Core4Capital also has significant art holdings, commissioning artist Jenna Krypell’s three-story “Ascend,” an acrylic resin work, for permanent display in the lobby at 399 Knollwood. While that building already had a fitness center, Core4Capital refreshed the space with new equipment and amenities and remodeled the building’s restrooms. Plans are in development to remodel and upgrade the café in 2025.

Meanwhile, 2975 Westchester Ave. received an even more dramatic transformation, with the new 1,700-squarefoot fitness center, complete with showers and lockers. The cafés and restrooms are scheduled for updates in 2025. Pickleball courts, EV charging stations and expanded covered parking with energy- efficient solar panels are just a few of the plans under consideration for the near future.

Eye on Small Business: Royal Regency Hotel, Yonkers

A beacon of Greek-American comfort, warmth and service, Yonkers’ Royal Regency Hotel is celebrating 30 years of hospitality in Westchester County.

The hotel was established in 1994 on a site that previously housed the Greek-born ice-cream king Tom Carvel’s corporate offices and training center. At the time Konstantinos and Phyllis Paxos acquired it, they had no particular ties to Yonkers. But it was close to their original hospitality business, the Royal Coach Diner in the East Bronx, now closed.

When the Westfair Business Journal checked in to discover what it takes

to run an independent hotel in an age when the industry is dominated by behemoth companies likes Hilton and Marriott, the Paxoses’ daughter and now co-owner, Maria Paxos-Pampafikos, said that every business has its difficulties. Being independent, she said, certainly comes with its own set of challenges, but the “ability to be nimble” and “make quick changes when necessary” are key. She added that “being answerable only to our guests” was one of the main reasons the hotel had been able to remain independent. She quoted a national statistic that only 3% of small-business organizations will survive beyond 10

years. A Forbes Advisor report of May 2024, quoting the Small Business Association (SBA), said that only 34.4 % of small businesses can expect to survive beyond 10 years.

Staying abreast of technological advancements has also been vital to the hotel’s performance. Transformative updates in 2015 saw motion sensors replace light switches in many areas, cutting down on energy waste, with digital thermostats in common areas and ballrooms maintaining consistent, comfortable temperatures while at the same time saving energy.

Following Covid, the three-story, 93-room hotel switched to providing full housekeeping services every third day or upon request, reducing laundry and saving water and energy. Guests are encouraged to reuse towels through informative cards in rooms, contributing to water and energy conservation.

LED lighting has been installed across the property to curb power consumption, while an air curtain at the main entrance stabilizes lobby temperature, conserving power.

Referring to Royal Regency’s customer base, she said the hotel had a combination of transient and small business guests. “There are infinite reasons for needing a hotel room,” she said, including, but not limited to, guests from out of town attending an event – the hotel hosts social functions, fundraisers and meetings – in one of the hotel’s event spaces; out-of-town

guests visiting family or friends; or contractors needing a place in close proximity to their work site.

Paxos-Pampafikos made relative light of the question of staffing – a problem facing many in the hotel sector, which has seen increasing strikes nationwide in recent days -saying that “not everyone is meant for a lifelong career in hospitality.” But for those who do consider it, she said, Royal Regency will train, coach and encourage staff to build on their skills, in an effort to prepare them to transition to their next positions. Those, she said, would ideally be within the company. “We prefer, and make every effort, to promote from within our organization whenever possible.”

As for the thorny question of dining – another notoriously tricky area for all hotels, but especially independents –Paxos-Pampafikos said that the hotel’s restaurant, Marcellino’s, was leased to a third party that had existed in the Yonkers market for many years. “We currently have no involvement in the day-to-day operation of the restaurant,” she said.

While that is doubtless a shrewd business model, Marcellino’s has been drawing plaudits for many years. And with incoming executive chef Frank Cucinelli, who is passionate about food, service and serving the larger community through food recovery efforts, taking up the baton, that can only add sheen to an already polished hotel.

The Center for Disaster Medicine at New York Medical College Secures Grants to Expand Critical Emergency Training Programs

The Center for Disaster Medicine (CDM) recently received two awards that will bolster emergency preparedness across New York State and underscore the CDM’s commitment to provide essential training, technical assistance, and educational activities related to emergency preparedness for disasters, terrorism, and public health emergencies. The latest comes in the form of a $250,000 award from the New York State Senate for voluntary training for school districts in emergency preparedness and response and a $100,000 one-year contract renewable for up to five years from Dutchess County to provide Tactical Emergency Casualty Care (TECC) training to members of the County’s Rescue Task Force.

“We are grateful for the funding and eagerly

anticipate these new opportunities to deliver disaster medicine preparedness training. These initiatives will enhance public safety, improve public health outcomes, and have the potential to make a substantial impact on a broad audience,” remarked David Markenson, M.D., M.B.A., director of the CDM and senior associate dean for research, who serves as the principal investigator for the awards.

The funding provided by the New York State Senate comes on the heels of the pilot program that the CDM conducted for the City of Yonkers School District to provide education and training to more than 3,900 school professionals, students, parents, and community members. Members of the Senate including Senate Majority Leader Andrea Stewart-Cousins and Senator

Shelley Mayer, chair of the Senate Education Committee, saw first-hand the value these trainings provided to Yonkers and championed efforts to provide funding in the 2024-25 state budget to expand these trainings to other areas of the state. The new trainings, a combination of in-person and virtual presentations and activities over a one-year period, will be provided to schools that voluntarily opt in to the program. The educational plan will be tailored to each school districts’ needs and capabilities.

The school training will cover a combination of topics including Stop the Bleed, naloxone to combat the opioid epidemic, preparedness for public health emergencies, disaster, and terrorism; mental health emergency recognition, de-escalation, and intervention; incident com-

mand training and personal preparedness; as well as instructor training in CPR, and first aid. Moreover, the program aims to ensure sustainability and expansion by training teachers and students as instructors.

State Senator Shelley B. Mayer said, “I am proud to help secure $250,000 in state funding, with the leadership and support of Majority Leader Andrea Stewart-Cousins, for the CDM to expand their innovative emergency preparedness training programs for school communities. I am pleased Yonkers Public Schools were home to the pilot program, where nearly 4,000 individuals were trained. During this pilot program, I saw firsthand the value of this training and am thrilled the CDM will be able to expand its programming to additional districts. I thank the CDM for their work and Majority Leader Stewart-Cousins for ensuring this was included in the New York State Budget.”

“The grant from the NYS Senate represents a critical step in our mission to empower school districts with the tools they need to help safeguard students,” said Dr. Markenson. “We believe this training will instill confidence in parents that their schools are well-prepared to protect their children.”

The contract from Dutchess County will be used to conduct training for first responders, fire service and law enforcement in Rescue Task Force operations, including immediate medical care and the extraction of injured individuals from dangerous environments as quickly and safely as possible. This training includes both the TECC program and the CDM developed Rescue Task Force™ and Cold Zone Operations™ courses and includes rescue task force basics, hot, warm, and cold zone operations, active shooter/hostile event response scenarios, patient simulations, and a variety of first aid and life-saving skills and techniques. The program will be conducted by the CDM’s Division of Operational and Tactical Medicine that focuses on researching and teaching the best practices for delivering high-quality, high-impact care in environments outside the realm of traditional medicine.

“We are confident our Rescue Task Force trainings will give first responders, fire service, and law enforcement the tools and confidence they need in such situations and potentially decrease preventable deaths,” said Dr. Markenson.

Both programs highlight the CDM’s efforts to advance disaster, operational and tactical medicine preparedness and response capabilities throughout the region, helping communities remain resilient in the face of emergencies.

LONG TERM CARE IN NEW YORK STATE: A BUSINESS IMPERATIVE THAT NEW YORK MUST GET RIGHT

There are no two ways about it: New York State’s long term care system is under pressure, and that pressure a ects your business.

When we say long term care, we mean the public nancing and programming to help New Yorkers live with the supports they need – whether in their homes, or, as their circumstances require, in institutional settings such as nursing homes. Long term care is really best thought of as a continuum of services for people as they grow older, or as they live with physical or emotional di erences, regardless of age.

You may be reading this and think that long term care is someone else’s concern – and that it doesn’t matter to your business. The reality is di erent: long term care is very expensive, no matter how you slice it, and this cost a ects your employees’ productivity.

Undoubtedly you have employees living with disabilities or illnesses or caring for loved ones that do. The same can be said for your employees who are keeping their elderly parents safe. Without e ective and well-funded programs, the pull to care will take more employees out of full-time work and reduce the quality and reliability of their commitment to you. That a ects your bottom line.

Despite these pressures a ecting workplace continuity, policymakers have yet to elevate lasting solutions that stabilize our workplaces by allowing working individuals to focus on their jobs. The pandemic certainly didn’t help things, as worker shortages and burnout exacerbated by the pandemic continue to pervade the healthcare industry, even four years from the pandemic’s onset.

Medicaid reimbursement, which funds much of our long term care continuum, failed to match the actual cost of care even before the pandemic. As state budgets look for savings, Medicaid funding for long term care remains a target for cuts. At the same time, e orts on the federal level to invest in the care economy have foundered.

Dependence on Medicaid for long term care services is greater than many realize – for instance, Medicare generally funds only 100 days of skilled nursing care for an individual – a reality that too many learn ‘the hard way.’ Nor can long term care insurance o set the gap as fewer and fewer people can a ord the premiums as that industry continue to experience tremendous pressure as our population ages.

There are some signs of promise. For one, through an executive order Governor Kathy Hochul has created a body to develop a ‘Master Plan for Aging’ in New York State. A broad array of stakeholders has been meeting regularly and recommendations for a Master Plan are advancing. The open question, however, is whether Master Plan recommendations, however clear eyed, will nd the funding needed to make them real.

Second, the Governor has called for a separate body, the New York State Commission on the Future of Healthcare to examine healthcare redesign across our state, writ large. Much of this group’s work is ahead of us, but we are hopeful it will lead to meaningful change and support for the continuum.

Third, New York State has been awarded approximately $6 billion in Federal funding to implement a Medicaid waiver program designed to examine and address health related social needs – the stu in people’s lives, that, if left unattended, can lead to more complex and negative healthcare outcomes, down the road. This can include food, housing, and other foundational pieces that give people stable lives. This work is just beginning in New York State, but it holds some potential to provide additional resources for long term care.

While all this percolates, businesses would be wise to adopt exible caregiving policies that allow their workers to contend with realities at home – and be the anchors for those that rely on them. Such exibility will permit your employees to give the best of themselves to their work, knowing they have the latitude to manage their commitments at home.

In parallel, business leaders can serve as vocal champions to call for the investment in long term

care funding and programming that will allow their workforce to thrive because their employees will hold con dence we are covering the home front by investing in a system that provides true and lasting care for their loved ones.
