Council race features mayoral rematch Mayor Elizabeth Kautz: City has ‘improved immensely’ during her tenure by John Gessner SUN THISWEEK

Saying Burnsville has “improved immensely” since she became mayor in 1995, Elizabeth Kautz made her case Oct. 15 for re-election over challenger Jerry Willenburg, who attacked key parts of the mayor’s record. Willenburg provided most of the fireworks in a Burnsville Chamber of Commerce-sponsored fo-

rum for mayor and City Council candidates. Willenburg also ran in 2008, losing to Kautz by four percentage points in the closest race of Kautz’s career. Willenburg opposed construction of the city’s $20 million Performing Arts Center, which Kautz had championed and which had gained final council approval on a 3-2 vote. Updating his argument Oct. 15, Willenburg said the

PAC, which opened in 2009, costs the city about $1.7 million a year, has averaged nearly $400,000 in operating losses over three years and should be sold. Before the PAC was built, a consultant projected annual losses on center operations of as much as $350,000. The 2011 loss of more than $275,000 was about $115,000 less than had been budgeted. Other annual costs include debt

service, management fees and employee salaries. The most ringing endorsement of the PAC came not from Kautz, who didn’t mention it, but from Suzanne Nguyen, a newcomer to city politics and one of four candidates for two council seats. “We have parks. We have the ice center. We have the golf course,” Nguyen said. “And we have something that I feel is just putting

Prepare to be scared at Frightmares, the Halloween attraction at Buck Hill. Visitors checked out a oneman scary character roaming the grounds on Oct. 12. The Burnsville ski area features haunted attractions and more than 100 ghouls, goblins and vampires in character. Frightmares is open October 17 to 21 and 25 to 28 at 7 p.m. Tickets are available at Buck Hill.

By the end of this month, Eagan homeowners will be able to raise chickens in their backyards thanks to an amended city ordinance. On Oct. 16, the City Council unanimously approved an ordinance amendment to allow residents to raise a few chickens on residential property. Mayor Mike Maguire and Council Member Cyndee Fields were absent. “This will be educational for the families who have chickens, and for that reason I support this,” said Council Member Gary Hansen, who grew up on a farm that raised chickens and other animals. The decision is welcome news for Eagan resident Barb Harpster, who plans to raise a small number of chickens in her backyard. “I’m very glad we are joining other cities in allowing chickens,” Harpster said. “They’re great for organic gardening.” Harpster, who grows a variety of heirloom vegetables and flowers, noted that chickens provide natural pest control and fertilizer. proposal will return to the Eagan City Council for a final approval. Met Council Member Wendy Wulff said she believes the amendment is a local issue that should be decided locally. Eden Prairie-based real estate developer Hunter Emerson faced resistance from residential groups immediately after announcing

its plans in May to build 173 homes on the 80-acre site. The developer’s plans for the site at 1310 and 1290 Cliff Road also call for a clubhouse, community gathering space, neighborhood parks and a bike path that would connect the new development to the Fairway Hills neighborhood and Lebanon Hills Regional Park. Home prices would range from

$200,000 to $650,000. Though no one spoke against the proposal at the Metropolitan Council meeting, residents packed City Council and Planning Commission meetings in June to voice their opposition. Several people expressed concerns about the loss of one of Eagan’s two golf courses (Lost Spur is the other), while others said they

worry about losing green space. One group put up signs saying “Save Parkview” throughout the neighborhood surrounding the property, and someone anonymously sent threatening letters to members of the City Council. Parkview co-owner RobSee PARKVIEW, 19A

St. Paul crime lab hearing resumes Tuesday Public defenders expect post-conviction petitions by Laura Adelmann SUN THISWEEK

Walter Swift spent over 26 years in prison for a rape he did not commit because his court-appointed attorney did not challenge the science that wrongly convicted him. Steve Toney was sentenced to life in prison for rape and sodomy based on bad science, and served 13 years before he was exonerated in 1996 after DNA testing excluded him as the perpetrator. Toney had repeatedly asked his attorney to have DNA testing done before his case ever went to trial. “She refused,” said Lauri Traub, a First District public defender, whose questioning of witnesses with state trial team attorney Christine Funk in Dakota County courts revealed significant testing, training and procedure failures at the St. Paul drug crime lab. Traub cited the Swift and Toney cases at an Oct. 12 public defender training event, where she encouraged defense attorneys to become educated about scientific data and processes used in court cases. The scientific inquiry Traub and Funk conducted resulted in testimony that led St. Paul Police Chief Tom Smith to shut the lab down and replace St. Paul Police Sgt. Shay Shackle as director. An outside firm has also been hired to conduct a review of lab practices. During the hearing, set to continue Tuesday, the state has effectively conceded that drug testing at the St. Paul crime lab

Public defense attorney Lauri Traub urged colleagues at an Oct. 12 training event to become educated about scientific data and processes used in court cases.

was unreliable. The hearing’s focus is now on whether contamination at the lab was so widespread samples that went through the lab are unreliable for retesting. Dakota County prosecutors are in the unusual position of defending the lab that Dakota County Attorney James Backstrom has directed the county stop using after testimony revealed the lab’s lack of standard operating procedures, training, documentation and

validation testing to ensure consistent and reliable testing. Dakota County Chief Deputy Attorney Phil Prokopowicz refused comment about his situation defending the lab’s practices at the hearing, but said one of the witnesses he plans to call to testify is Eric Gruenwald, an analyst for the Bureau of Criminal Apprehension where Dakota County now sends its drug evidence. Of the 98 pending drug cases retested by the BCA for Dakota,

Washington and Ramsey counties so far, Prokopowicz said 97 test results were confirmed. One Ramsey County drug case was dismissed Sept. 27 after retesting found the evidence was not methamphetamine. Dakota County has also reduced or dropped charges in about five drug cases the BCA refused to test because only trace evidence remained, Prokopowicz said. He added the county also has at least 20 cases with trace evidence at the BCA awaiting retesting. While the Frye-Mack ruling will only directly pertain to the four remaining cases included in the hearing, chief public defender Steve Holmgren said there could be hundreds more drug cases in the three counties that could also be challenged as a result of the crime lab revelations. He said the state is anticipating post-conviction release petitions and is seeking grant money to help fund the added defense work. Holmgren added Washington and Ramsey counties are also working on challenging some of the other testing procedures at the St. Paul crime lab, such as fingerprints and blood stains. “If they are not using scientific methods in the drug lab, it certainly raises issues about what methods they are using for fingerprints or whatever,” Holmgren said. Dakota County primarily used the lab for drug testing, but could have a few fingerprint or

blood stain cases there as well, he said. But appeals could also come from cases around the state, because the Minnesota State Patrol also used the crime lab to test evidence in its cases. Holmgren said many in the criminal justice system were surprised to learn of the St. Paul crime lab problems. “I think most of us or all of us basically were working under the assumptions that these folks are scientists and use scientific methods,” Holmgren said. “We were stunned, I think the entire justice system was stunned. Nobody had any suspicion that this was really as shoddy as it has turned out to be.” Holmgren said the FryeMack hearing illustrates how important it is for crime labs to be accredited in Minnesota, and he expects the issue will come up at the Legislature next session. There are 18 agencies in Minnesota that are self-identified crime labs, and the Ramsey County Sheriff’s Office also runs an unaccredited lab. There are few accredited crime labs in Minnesota: the two BCA labs, the Minneapolis Police Department and the Hennepin County Sheriff’s Department. “I’m hoping the state takes a position that there needs to be some oversight and an accreditation process,” Holmgren said. Police say a convicted sex offender led them on a high-speed chase through Eagan Tuesday, which ended with the man threatening to jump off a Mississippi River bridge. Oudone Xiong, 37, of St. Paul was on probation in Ramsey County for first-degree criminal sexual conduct, and had allegedly told his probation officer on Oct. 16 he felt suicidal. The probation officer reported Xiong’s claim to police at 1:47 p.m. that day. Eagan officers were told Xiong was driving a blue Ford Ranger near Pilot Knob Road and Duckwood Drive. Officers found Xiong parked behind a business near the intersection of Krestwood and Duckwood drives. Before officers could approach Xiong, he drove

away, according to police records. Two Eagan officers began following Xiong at about 2:35 p.m. on a high-speed chase. While driving east on Duckwood Drive, Xiong failed to stop at the intersection of Denmark and Duckwood Drive and continued north on Denmark, according to police. He again allegedly failed to stop at a red light at Yankee Doodle Road and turned west onto Interstate 35E. Officers chased Xiong at speeds reaching 90 mph. When Xiong approached the I-35E bridge over the Mississippi River in Mendota Heights, he stopped suddenly, fled his truck and began climbing the railing to stand on the edge of the bridge. Police say Xiong held on to the railing and threatened to jump. At some point, the Minnesota State Patrol, Mendota Heights Police

Officers ended up negotiating with Xiong until about 8:30 p.m., when Xiong agreed to be evaluated at Region’s Hospital. The incident caused traffic to be backed up between Mendota Heights and St. Paul. Xiong is currently held at Ramsey County Jail, and is expected to be charged by the Dakota County Attorney’s Office with fleeing a police officer in a motor vehicle. Opinion ECM Editorial Obermueller’s moderate politics appealing in 2nd The political center isn’t a place Republican John Kline has had to worry much about in his five terms as U.S. representative in Minnesota’s 2nd District. That may prove true again once the ballots are counted on Nov. 6, but redistricting has given the 2nd a more purplish hue. Gone are Carver, Le Sueur and western Rice counties. Hello, South St. Paul and West St. Paul — older, first-ring suburbs that like to send Democrats to office and are used to having one, Betty McCollum, in Congress. Mike Obermueller, an Eagan attorney who served one term in the Minnesota House of Representatives, is the fifth Democrat to try to unseat Kline, a Lakeville resident and retired Marine colonel. Obermueller deserves to be elected. He’s young, bright and determined to

win the expanded center in the new 2nd. His views and political instincts are a rebuke of the obstructionism that has discredited the Republican House majority. Raised on a dairy farm near Marshfield, Wis., Obermueller worked his way through college and law school before settling with his family in Eagan, where he is active in the Dakota County Regional Chamber of Commerce, the Knights of Columbus, the Eagan Art Festival and the Eagan Athletic Association. He proudly proclaims that he was the first Democrat to win former Gov. Tim Pawlenty’s old Minnesota House seat since Eagan was still cornfields. A notable achievement, but it was in 2008, an especially hospitable year for Democrats. Likewise, Obermueller was unseated two years later in a nationwide

sweep by Republicans. As a legislator, he voted against several DFL Party tax-raising initiatives and voted for a vetoed 2009 budget fix that would have imposed a $1 billion tax hike on the state’s highest income earners. It included a “blink-off ” provision for better fiscal times, he says. At the federal level, he supports keeping the middle-class breaks in the Bush tax cuts and says the economy can withstand an increase on upper-bracket earners. Obermueller’s critique of the historic Affordable Care Act — Obamacare, which he supports and Kline wants to repeal — is spoton. “I don’t think we did enough on the cost-control side of things,” he told ECM Publishers news staffers in Dakota County. “There wasn’t a real true

discussion about how you change the payment model so that we keep the person healthy rather than just paying for service going down the line.” A central plank in Obermueller’s campaign is rooting out government waste, fraud and abuse. Citing a recent Government Accountability Office study, he says tens of billions of dollars can be saved through measures such as procurement reform and modernization of medical record-keeping. Waste, he says, undermines government credibility in taxpayers’ eyes. “When they feel that way, they don’t want to pay any taxes for things they do care about,” he says. Obermueller opposes the “premium support” plan for Medicare backed by Mitt Romney and Paul Ryan. Kline is rigidly conservative, with consistently high

ratings from the American Conservative Union. Unlike many of the Tea Party members of his Republican caucus, he voted in 2011 to raise the federal debt ceiling. But he supports “Cut, Cap and Balance” — excessively harsh budget medicine that includes calling for a balanced-budget amendment to the Constitution. He chairs the House Education and the Workforce Committee and wants to slash federal involvement in local schools. Yet he opposed the No Child Left Behind waiver in Minnesota while the state’s educators cheered. Kline is a favorite of the for-profit college industry, which showers him with campaign donations, but the industry has been called out in Congress for unsavory student-loan practices. Kline also has a growing reputation in his district for

not making himself available during election season. His office rebuffed efforts by the Dakota County Regional Chamber of Commerce to recruit him for a candidate forum with Obermueller. And this is the second straight election cycle in which Kline’s press office refused requests from Sun Thisweek Newspapers to make the candidate available for an hour-long endorsement interview. The new 2nd District deserves a representative who’s less ideological and more respectful of its voters. Mike Obermueller is that candidate.

veteran global manufacturer. She has kept our credit rating at AAA and laid the foundation for future development of the northwest quadrant of our city. Her hard work and proven ability to build quality relationships around the state and nation has paid dividends in improved roads and infrastructure so integral to the vitality of the community. She believes that government’s role is to develop the infrastructure of a community and then let the private sector fill it with abundance. As a 28year resident of Burnsville, I can say with confidence that we are in a pretty good place. Leadership matters, and Kautz continues to provide that leadership. On Nov. 6 vote Elizabeth Kautz.

(which look nice but don’t serve us any better than asphalt or concrete streets), fancy lights on poles and now her latest beautification project – large stone “Welcome to Burnsville” markers where each road enters Burnsville at a cost of $50,000 per marker. These costly “improvements” have not really benefitted the residents or the businesses of Burnsville. Meanwhile, residential housing has been way over built and many homes, condos and apartments stand vacant. There are vacant commercial buildings all over the city and the turnover of failed businesses in the Burnsville mall and strip malls is no less than shocking. Retail and business growth has been stagnant. As a 32-year resident of this city I say we need new leadership in our city and we need it now. Jerry Willenburg has the ability and the vision to make needed changes to the way Burnsville is managed – changes which will result in improvement to economic growth, transportation and public safety. His plans include the development of parks and recreation facilities that will be enjoyed by all Burnsville residents. Willenburg also proposes the establishment of a retail and business coalition which will assess what Burnsville has and what it needs and will take the steps necessary to bring needed changes to fruition. I urge voters to go to his website to review the extent

of his proposals for Burnsville. Willenburg almost unseated Kautz four years ago – let’s all vote for Jerry Willenburg this time and make it happen.

Letters Kautz exhibits common sense To the editor: From 2007 through 2010 I served our city as state senator. I represented and legislated in a manner reflective of the district, doing my best with each and every decision to vote for common sense, responsibility and a respect for our entire community. It is those same perspectives that Elizabeth Kautz employs as our mayor and part of the reason why I wholeheartedly endorse her. While I applaud all who step forward to offer their service to our community, it takes a unique individual to produce positive results year after year. Kautz is a proven leader and she has done it with style, grace, intellect and a passion for Burnsville second to none. Some will say that it is simply time for a change and I would not argue the point if there was a reason to change. Or if change represented a positive step forward. But at this time, and in this election, that is not the case. As a state and nation, we have much more work ahead to fully restore our economy to its full potential. To keep Burnsville strong we need experienced leadership to ensure continued success. Consider this. Over the past six years, during some of the worst economic downturn in decades, Kautz has helped bring hundreds of jobs to our area with new retail, restaurants, and a major expansion from a

Willenburg has the right vision To the editor: It’s time for fresh thinking and stronger leadership in the Burnsville office of mayor. Elizabeth Kautz has held the office for 18 years and has had plenty of time to accomplish her goals for the city. She lost sight of the priorities of the residents while accomplishing her personal goals at considerable taxpayer expense. Examples of her accomplishments are the Performing Arts Center (which costs us over $1.5 million per year), stone paver streets

Supports Daley To the editor: It’s September in Minnesota and the kids are back in school, the national political conventions are over and people are starting to focus on the campaigns for state and local offices. I urge people to look carefully and reject the misleading claims being tossed about. Just as with a company that is going broke or a family that is trying to stay afloat, spending more money isn’t the answer. The Republican majorities understood that and helped turn a major projected deficit for Minnesota into a surplus, while still providing the funds we needed for education, human services, public safety and other important purposes. Yet, all we hear from the Democrats at this point is that we didn’t spend enough and should spend more. Sen. Ted Daley knows how to maintain our balance and build Minnesota’s economy, encouraging job growth and providing benefits for Minnesota families. And, as a CPA he understands what it takes to protect taxpayers while he works to strengthen families. Daley also believes in listening to the people and interacting with all segments of the community. He will continue to speak for us in the Minnesota Senate.

Support Currier To the editor: We are writing in support of DeeDee Currier’s re-election to the District 191 Burnsville-Eagan-Savage School Board this November. Currier’s commitment to this school district is unsurpassed. She served this community as a school administrator at both the elementary and secondary levels and later became a school board member. Since then she has become the coordinator of the Adult Enrichment Program for Shakopee schools. It’s easy to claim to have a passion for something, but it’s another thing to prove it. Currier has devoted her entire career to attempting to provide all learners with tools and knowledge essential to compete in the world economy. She has always championed the full range of learners, including students in special, regular, and gifted programs. It takes a person with a broad perspective to understand, interpret, and strive toward solving the challenges faced by schools today. Currier recognizes that a strong school district affects all of us whether or not we have children in the school system. She is committed to keeping our property values strong by supporting a school district that offers options from early childhood education to rigorous curriculum for K-12 to co- and extracurricular youth sports/activities to adult education to senior opportunities. We hope that you will join us in voting to re-elect DeeDee Currier to our ISD 191 School Board in November. GREG and SANDY STOFER Burnsville

Hill is a true leader To the editor: Ron Hill is a man of action, and we know that our actions speak louder than our words. Two recent examples are Hill’s leadership in the development of a new strategic plan for School District 191 and his guidance during the recent levy referendum. He has worked hard to put the word “public” back into public education. Hill is a person of high integrity, an individual committed to his family, church, community, and

Impressed by Peterson To the editor: Many of us are in a new district this year for the Minnesota House due to redistricting. Through the endorsement process, I have gotten to know Roz Peterson and have been impressed by her qualifications, experience and approach to important issues. Peterson has been a business owner, a member of the District 194 School Board and a leader in the local Chamber of Commerce. She brings to this election the rare combination of experience in business and government. Her calm and positive attitude toward problem solving is an ideal qualification for office. Electing Peterson to the House will reduce gridlock and increase our chances of positive solutions to the many challenges we face as a state. I have decided to support Roz Peterson for election in House District 56B and ask you to join me in voting for her. DAN McELROY Burnsville

Four good ones To the editor: On Nov. 6, Burnsville residents will have a great opportunity to continue the outstanding civic leadership and progress we have seen in past years with the re-election of Mayor Elizabeth Kautz and City Council Member Mary Sherry. In addition, we can continue our history of outstanding leaders with the election of Steve Cherney to the City Council and the re-election of Ron Hill to the ISD 191 School Board. How fortunate Burnsville has been with such dynamic leadership. CHUCK ERICKSON Burnsville

To the editor: Republican Pam Myhra is a candidate in House District 56A. Her House record since 2010 is evidence that she doesn’t espouse the principles on her own website: responsible government – sensible spending within its means. The woman who followed this rigid, inflexible approach voted to delay $2.4 billion to K-12 public schools. Myhra directly benefited her rich banker friends because school districts across the state had to take out loans to make payroll. What part of “sensible spending” did she mean when banks came in handy with loans to governmentfunded public schools? Maybe she meant “within its means.” What it means is the losers were children, Myhra picking

THE NEW TRADITION What is the Cremation Society of Minnesota? The Cremation Society of Minnesota is Minnesota’s largest provider of cremation services. Society members come from all social, religious, and economic backgrounds, finding unity in their mutual attraction of the simplicity of the cremation rite. They choose to dispense with costly and unnecessary pomp associated with conventional funerals, and commit themselves and their families to this dignified disposition at the time of death. Our membership plan allows families to make all arrangements in advance, thereby relieving survivors of the need to make urgent decisions while in the state of grief. Preplanning provides families with complete peace of mind, both emotionally and financially. At the time of death, our counselors are available to assist your survivors in arranging for memorial services, obtaining certified copies of the death certificate, cemetery services, grave makers and monuments, obituaries for the newspaper and paperwork for Social Security and Veterans’ benefits.

The Cremation Society Of Minnesota also services Wisconsin

Questions & Answers About Cremation Society of Minnesota Q. How does the Cremation Society of Minnesota Work? A. The Cremation Society is notified immediately at the time of death. Then the member’s body is transported to the Society’s crematory where it is held until proper medical authorization is secured. The cremation permit is then completed, and the body is cremated. Q. Does the body have to be embalmed? A. No. With the Cremation Society of Minnesota’s modern facilities the body does not have to be embalmed.

Q. At the time of death, what is the cost for the cremation service? A. The cost of the basic cremation service which includes removal of the body from the place of death, cremation, filing of the necessary papers and cardboard container suitable for burial is presently $1395.00 for members. This is payable at the time services are rendered. The charge to non-members, whom we also service, is more. Q. How do I join the Cremation Society of Minnesota? A. Fill out the registration form and mail it to our office with a one time registration fee of $15.00 per person. This fee defrays the cost of setting up and maintaining your records. It is not refundable nor an offset to the final service costs. We will register you and send you wallet-sized membership cards and certificate of registration. Letters Honorees questioned To the editor: An Oct. 12 letter to the editor from Richard Iffert refers to a recent report from the Legislative Evaluation Assembly and mentions that state Rep. Doug Wardlow was chosen by that organization as an “honoree.” It also describes this organization as “nonpartisan.” A quick check of the organization website, however, leads one to wonder about the value of such an honor and the claims of nonpartisanship. Every single one of the 26 House and Senate honorees or honorable mention recipients – every single one – is a Republican. They are generally among the very most conservative members of the Legislature. This makes sense as you peruse the website contents and the description of the board members of this organization. It clearly supports an ultra-conservative ideology. Both Wardlow and Sen. Ted Daley (one of the 2011 “honorees” of this extreme right wing group) were elected by slim margins in districts that have swung back and forth politically and clearly reflect a more middle of the road electorate. Being honored by this organization indicates they are not providing representation that properly reflects their constituencies. WAYNE SAMES Eagan

False assertions about Morgan’s voting record To the editor: Last week a supporter of Roz Peterson attacked Will Morgan’s record in the Legislature. Morgan represented me for four years. I followed his work pretty closely. I never recalled any of those votes mentioned in last week’s letter. So, I did my homework. Turns out that in April of 2009 there was a vote in the House to repeal the mortgage interest deduction. Morgan voted no. That’s right, he voted no. You can check it out on the House Journal from that year, Page 4094. As far as the other assertions the letter writer made about music downloads and home heating fuel, there doesn’t even seem to be a record of those votes occurring. I don’t know how Morgan could have voted for them. It seems that Peterson and her supporters are having a hard time making Morgan look bad, so they are willing to make things up, or just say the opposite of what Morgan actually did. I’m guessing we’ll be seeing more of that in these pages and in the mail. I hope everyone will recognize that says more about Peterson’s character than it does about

Morgan’s and it’s too bad. JEN WALLER McDEVITT Burnsville

Voting for Jim Carlson To the editor: Targeted mailings on behalf of incumbent legislators have been cavalier with the facts. A recent political mailer denigrates a 2007 vote to raise the per diem rates for state senators. It complained about per diem increases by former senators in hopes that you will not compare total compensation figures among senators and will ignore actual amounts claimed by the current incumbent. I checked the facts. So nice that Sen. Ted Daley criticized his predecessor, but for his own compensation claimed more than his predecessor. During his two years in office Daley averaged $11,668 per year (even though there was a shutdown) while Jim Carlson averaged $11,260 over his four years. The point of this deceptive mailer is to make you think there is an ugly problem, when in fact there is not. Records show more money went in the pocket of the current Republican senator than the former Democrat senator. Links are on our website if you need to check for yourself. Vote for Jim Carlson to bring back fiscal responsibility, ethics, and honesty to the Minnesota Legislature. LYNN CARLSON Campaign manager for Jim Carlson

Another Catholic voting ‘no’ To the editor: It is easy to picture a wedge that is being used to split wood. If the wood already has a small crack, that is a good place to set the wedge and then to drive it into the wood to leverage it into two pieces. It takes more imagination to think of a wedge in politics, but political strategists have long known how to identify and to then use wedge issues. You identify smoldering fears and prejudices, and then fan them into open flames by suggesting some imagined threat. The voter photo ID amendment evokes the Latino population overrunning our country, and

the marriage amendment evokes gays, etc., corrupting society’s institution of marriage. It does not matter that this signaling goes on without our awareness, just as a dog whistle works beyond the audible range of the human ear. That’s part of the strategy. Never mind that divorce and cohabitation had been undermining marriage long before gay rights issues had surfaced. And never mind that voter impersonation is extremely rare. The wedge will still work; reality is incidental. The photo ID wedge would affect primarily the young, the old, and those on the margins of our economy, most of whom would vote for Democrats. On the other hand, the marriage wedge would motivate the self-proclaimed protectors of “family values” to come to the polls, most of whom would vote for Republicans. Getting your base to the polls while shutting out the opposition – now that’s ingenious strategizing. Too bad that it also sets up a divisive “me” vs. “them” dynamic that feeds the ruinous polarization of our country. Predictably many church leaders took the strategist’s sucker bait and fell into their trap. Here was a chance to enlist the government in the enforcement of church rules by embedding them into the constitution. However, our country works only as a pluralistic society where there is space for those who are “not like me.” That is at the core of our national Constitution. If we don’t accept that, our nation will split and tear itself apart. You choose. RAY LARSON Eagan

True to his word To the editor: Dave Jensen’s campaign slogan is “We are All in this Together,” and he proved true to his word by reaching out to others at the Sept. 16 Candidate Diversity Event at Savage City Hall. He listened as the group stated they want to be a productive part of the community and be involved in social events. One woman spoke at length about her concern that longer hours and days for Head Start and like services are not available for their children to get that early boost in education. They also want more adult

education to improve their language and professional skills which will then allow them to better use their intellectual skills to become more productive Americans. Jensen supports fully funding education and ending the continual borrowing from education funds. Another common theme that came up was the need for access to health care at a lower cost. As a geriatric nurse practitioner supervisor for years, Jensen sees this as a moral issue and not a commodity to be provided to only those who can afford it. Health care should be available to everyone and will work toward that goal. At one of the event tables, training on how to read and use the November ballot was professionally given to everyone. At other tables they were welcomed to learn about the amendments we will be asked to make choices about. When Jensen is elected representative, he hopes to hold more community forums where we can all listen and learn and hopefully work to understand each other’s needs and where we could possibly help. Does this sound like a community you would like to live in and take part in? If so, vote for Dave Jensen to be your state representative from the Savage and 56A part of Burnsville. SHARON SCHMIDT Savage

Re-elect no one To the editor: Re-elect no one. I know that this may seem radical, simplistic or silly to some of you, but if you’re disgusted by the ineptness, corruption, and obfuscation of the Burnsville-Eagan-Savage School Board and administration, then ejecting the culprits is the logical solution. The same reasoning applies to the Burnsville City Council, Dakota County commissioners, Minnesota legislators, and the federal government where the thin line between cronyism and criminality becomes blurred. So join the Committee to Re-elect No One. No meetings. Just place a sign in front of your house or apartment saying “Re-Elect No One” and you automatically become a member. District 191 volunteer receives recognition District 191 volunteer Greg Amell of Burnsville recently received the 3M Community Volunteer Award, which is presented to just 15 employees and 10 retirees nationwide each year. Amell is an advanced product design specialist/ technical supervisor at the corporation based in Minnesota. The 3M Foundation donated $1,000 to the nonprofit of Amell’s choice and he requested the funds go to science and math programs at William Byrne and Sky Oaks elementary schools in Burnsville. Amell is very deserv-

ing of the prestigious 3M award, according to Barbara Gierada, a sixth-grade teacher at William Byrne Elementary School, home to the district’s STEM (science, technology, engineering and math) magnet school. “Greg has been tireless in his efforts to engage students in science and math,” she said. “His dedication to the enjoyment of learning science and how it applies to the real world is evident in every lesson he shares,” she said. This year, Amell will be sharing information with students on cryogenics, electricity and magnetism, chemistry, catapults, simple machines and more at William Byrne, Sky Oaks and Burnsville Alternative High School.

EdenPURE reopens Ohio factory creates 250 new jobs ®

New models shipped direct from warehouse at 49% savings Richard Karn, North Canton, Ohio

I was fortunate enough to attend the grand opening of the new EdenPURE® factory in North Canton, Ohio. The new plant brought hundreds of new jobs back to Ohio and reversed the common practice of sending Midwest manufacturing jobs to China. Now, EdenPURE® continues to ramp up production for the coming Winter with exciting new models and hundreds of new employees as this Made in America success story continues to grow. American Labor, American Quality With over 3 million portable heaters sold EdenPURE ® is the best selling portable infrared heating system in North America. However, like any classic, EdenPURE ® has dozens of would-be competitors who create Asian copies at low prices using cheap, foreign labor. Don’t be fooled by these imitations. Look for the EdenPURE® logo and the Made in North Canton, Ohio stamp. Save like millions of others on your heating bills and say “NO” to cheap foreign imitators. Save up to 49% on 2013 EdenPURE®s Now readers can save up to 49% ($229 the largest savings ever on new EdenPURE ® s). EdenPURE® is not just the best-selling portable heating system in North America. As an EdenPURE® owner I rank EdenPURE® #1 for quality, safety and efficiency. And now is the perfect time to save like never before on our expanded 2013 EdenPURE ® line made in our brand new North Canton, Ohio facility. With two models EdenPURE® can meet all of your heating requirements 365 days a year. Stay Comfortable 365 Days a Year “Never be cold again” is the EdenPURE® promise. EdenPURE® provides you insurance against the cold all year long. Stay comfortable on those unseasonably chilly evenings no matter the season. I live in California but believe me it gets cold at night. Keep your expensive furnace turned down until it’s absolutely necessary. And if we are fortunate enough to experience a mild winter as many of us did in the Midwest last year, you keep your furnace off all season

Never be cold again

How it works:

Heats floor to the same temperature as ceiling.

3. The soft heat “rides” the humidity in the room and provides even, moist, soft heat ceiling to floor and wall to wall without reducing oxygen and humidity.

1. Electricity ignites powerful SYLVANIA infrared lamp. 2. The quartz infrared lamp gently warms the patented copper heating chambers.

technology uses copper heating chambers to take the energy provided by our special SYLVANIA infrared bulbs and distribute our famous soft heat evenly throughout the room. Now our copper isn’t ordinary. It’s 99.9% pure antimicrobial copper from an over 150 year old American owned company in Pennsylvania. So your EdenPURE ® heater is continuously pushing soft, healthy, infrared heat throughout your room. How to Order During our 2013 introduction you are eligible for a $202 DISCOUNT PLUS FREE SHIPPING AND HANDLING FOR A TOTAL SAVINGS OF $229 ON THE EDENPURE® MODEL 750 AND A $175 DISCOUNT PLUS FREE SHIPPING AND HANDLING FOR A TOTAL SAVINGS OF $192 ON THE EDENPURE® PERSONAL HEATER. This special offer expires in 10 days. If you order after that we reserve the right to accept or reject order requests at the discounted price. PERSONAL

MODEL 750

As Al Borland on Home Improvement I was the man with all the answers. However, as Richard Karn I still look for money saving and efficient heating in my home. I have an EdenPURE® Infrared Portable Heater in my California home and like millions of others found it to be a super-safe, reliable source of portable heat all year long. and save even bigger. New, More Efficient Models The engineers at EdenPURE ® listened to their millions of customers and somehow managed to improve the #1 portable heater in North America. Through old fashioned American ingenuity the new EdenPURE® line is more efficient to save you even more money. The EdenPURE ® Personal Heater now heats a larger area, an increase from 350 square feet to 500 square feet. That’s a 30% increase in efficiency! And EdenPURE ® is proud to introduce the 2013 Model 750. The new Model 750 is perfect for larger areas and heats up to 750 square feet. But the best thing about the Model 750 is the price. We priced the Model 750 at only $50 above the Personal Heater. This means you receive a 33% increase in performance for only $50. That’s American engineering at its best! The EdenPURE® can cut your heating bills and pay for itself in a matter of weeks, and then start

putting a great deal of extra money in your pocket after that. Super Safe Infrared Heat Now remember, a major cause of residential fires in the United States is carelessness and faulty portable heaters. The choice of fire and safety professional, Captain Mike Hornby, the EdenPURE® has no exposed heating elements that can cause a fire. And a redundant home protection system that simply shuts the EdenPURE® down if it senses danger. That’s why grandparents and parents love the EdenPURE®. The outside of the EdenPURE® only gets warm to the touch so that it will not burn children or pets. And your pet may be just like my dog who has reserved a favorite spot near the EdenPURE ® . You see the EdenPURE® uses infrared heat. And just as pets enjoy basking in a beam of sunlight they try to stay close to EdenPURE ® ’s “bone-warming” infrared heat. The Health Secret is in the Copper

All of the testimonials are by actual EdenPURE® customers who volunteered their stories, and were given another EdenPURE® heater as thanks for their participation. Average homeowners save 10% to 25%.

FORUM, from 1A reduced its debt, earned a AAA bond rating, taxed judiciously, built a trust fund to replace aging infrastructure and contained city government costs by reducing staff and deploying technology, the mayor said. Crime is down 39 percent since she took office, Burnsville has added private-sector jobs and city government has laid the groundwork for future redevelopment in the 1,700-acre Minnesota River Quadrant west of Interstate 35W, Kautz said. “We do all this with everyone being part of the decision-making process, Kautz said. “We have a protracted process that allows everyone the voice to speak and to give us their thoughts. I ask again for your vote on Nov. 6. I will continue to serve this community with passion and with great love. Candidates, including Willenburg, were unanimous in their praise of Burnsville’s AAA bond rating. But Willenburg also noted that in an Oct. 10 rating of three new general obligation bond issues in Burnsville, Moody’s Investor’s Services added a “negative outlook – not a downgrade – to the AAA rating on the city’s $59.7 million in general obligation debt. Willenburg read from the Moody’s report, which said consecutive years of “significant declines in taxable values in Burnsville, the city’s “weaker demographic profile compared with its neighbors and the “modest enterprise risk posed by the city’s Performing Arts Center might “pose downward pressure on the city’s rating. “I think we need to respond to a red flag like that, said Willenburg, who also took aim at the Heart of the City downtown redevelopment initiated during Kautz’s tenure. “We have rows of townhomes and condominiums that sit empty, business

Burnsville city election candidates appeared at an Oct. 15 forum at City Hall. They are, from left, council candidates Bruce Johnson, Suzanne Nguyen, Steve Cherney and Mary Sherry, and mayoral candidates Jerry Willenburg and Elizabeth Kautz. and retail space that was built and has never been leased out, Willenburg said, adding that the signature Grande Market Square building has fallen into foreclosure. Said Kautz, “The Heart of the City is doing quite well, thank you very much. Willenburg called for a business coalition that would catalogue existing businesses and vacant spaces and recruit complementary businesses to the city. Kautz pointed to the most recent city-commissioned survey of Burnsville business owners. “The business community in the last survey says the city of Burnsville is very friendly, she said. “Ninetytwo percent of our businesses say that the city is going in the right direction. City government has a strong record of “convening businesses and residents to get input and chart the city’s course, Kautz said. “We have a strong economic development position here in Burnsville, and that is our greatest asset, she said. Willenburg said a key challenge is attracting young families to an aging community with an aging population.

Council candidates Candidates for two four-year council terms are Nguyen, one-term incumbent Mary Sherry, former council member Steve

Cherney and Bruce Johnson. Dan Gustafson, whose term is expiring, isn’t seeking re-election after two terms. Sherry, a former Planning Commission member, said she’s been volunteering in Burnsville since moving to the city 36 years ago. “I’m running to ensure an effective, collaborative City Council, she said. “When I took office in 2009, the combative tone (on the council) changed. I’m able to take a firm stand on what I believe is right, yet I respect others’ opinions: council members, citizens and business owners. Increasing the tax base is the city’s biggest challenge, Sherry said. With mining expected to continue for another 20 years in the Minnesota River Quadrant, the city faces “challenging discussions about interim land uses there before full redevelopment occurs, she said. Some aging strip malls are also ripe for redevelopment, Sherry said. “I think there are some wonderful opportunities for some vibrant neighborhood development, places that would be walkable for the people who are living in those neighborhoods, she said. Cherney, who was elected to the council in 1999 and lost his re-election bid in 2003, said he’s “back in the hunt with the support of family and friends. He promised fiscal con-

servatism, a focus on core services and “out-of-thebox thinking for solving problems. “I will vote to restrain unnecessary spending, and I will work with and support other council members in that effort, Cherney said. “I will listen to the citizens of Burnsville as I always have and continue to work on their behalf. I truly enjoy this level of government. Nguyen, a speech and language clinician in the Minneapolis schools, said she has a master’s degree in speech and communications. “My strength is communication, she said. “I seek to listen, understand and respect. I’m positive, and I believe in collaboration. I love Burnsville. I think it’s the best city to live and raise families in America. Johnson, whose campaign literature states that he wants no increase in the annual city tax levy, said Burnsville “may have to look at lowering some of the restrictions and fees to attract business to the community. And we need to continue to expand the tax base. The city needs to enforce and strengthen propertymaintenance codes to address substandard properties, Johnson said. Thisweekend Trick-or-treat through the sculpture garden Eagan’s C Caponi aponi Art Par Park rk p presents resents family Halloween event Oct. 27 by Andrew Miller SUN THISWEEK

Things may get a little bit spooky, but don’t expect any lurching blood-smeared zombies or other macabre terrors at Caponi Art Park’s Halloween event next weekend. Geared to families – and held during daylight hours (1 to 4 p.m.) – “Halloween at the Art Park on Saturday, Oct. 27, offers guests a “trickor-treat tour of several sculptures, led by costumed guides who will provide some background on each piece.

The sculptures on the tour – all permanent fixtures at the park, and all created by the Eagan art park’s founder Anthony Caponi – were selected based on some modicum of inherent creepiness. Among the offerings on the sculpture tour are “Pompeii, awash in what seem to be petrified skulls and skeletons, and “Snake, a massive coiled reptile. At each stop on the tour, children will get a piece of candy that relates to the sculpture. Last year’s tour saw Milky Way candy bars

passed out at the sculpture “Walk in Outer Space. Visitors received Twizzlers at “Struggle of the Elements and were encouraged to try to replicate the sculpture’s twisty-turny curves with their licorice. In addition to the sculpture tours, children can make Halloween crafts and participate in a superhero-themed scavenger hunt. Guests are encouraged to wear costumes, and harvest-festival treats such as hot apple cider and popcorn will be available. There’s also a giant leaf pile. Young and old can jump right in. “We have 60 acres of oak trees that will likely be dropping their leaves very soon, said Jenna Strank, Caponi’s communications coordinator. “I imagine the leaf pile will be at least 15 feet across and 3 feet deep. Admission to “Halloween at the Art Park is free with a $5 per person suggested donation; the “trick-or-treat tour is for ages 5 and up. More about the event is at www.caponiartpark.org. Eagan earns historic victory Girls conference title is school’s first ever

Five of the top seven runners from Lakeville South’s 2011 South Suburban championship team also ran in this year’s race. But this time the Cougars couldn’t keep up with Eagan. “Our team was very young last year,” Langenhahn said. “This year our runners have more experience and they put in more miles over the summer.” The Wildcats, ranked No. 1 in Class AA, have not lost to a team from Minnesota this season. That, and their South Suburban championship, makes them “the prohibitive favorite” in the Section 3AA meet, Rosemount head coach Chris Harder said. The section meet is Oct. 25 at Valleywood Golf Course in Apple Valley. “At first, I thought they were oblivious to (the rankings),” Langenhahn said. “But as the season has gone along, I think they’re now motivated to stay on top.”

Sophomores Kelli Praska (seventh, 15:09.5), Karina Johnson (10th, 15:14.2)

and Anna Van Wyk (11th, 15:21.7) completed the top five. Senior Elizabeth Frick (18th, 15:41.9) and ninthgrader Olivia Mitchell (20th, 15:45.0) also ran for Eagan.

• Burnsville sophomore Faysal Mahmoud won the boys individual championship at the South Suburban meet, completing the 5,000-meter course in 16:19.9. Eastview senior Nick Oelke was second in 16:26.6. Mahmoud’s teammate, junior Ali Ahmed, was fourth in 16:37.6. • Rosemount (51 points) won the boys team title, with Burnsville (92) and Eastview (93) taking second and third. Eastview seniors Oelke, Zach Tollefson and John Donlan were second, eighth and ninth, making the Lightning the only boys team with three individuals in the top 10. • Apple Valley was fifth in the boys team standings. The Eagles were led by senior Nick Hughes, who finished 10th individually. • Burnsville, Apple Valley and Eastview were sixth, seventh and eighth in the girls team standings. Junior Vivian Hett led Burnsville with a fourth-place finish in 15:03.0. Apple Valley sophomore Camille Sjoquist finished sixth in 15:06.6. Eastview is not one and done as a boys soccer program. The Lightning finished second in the state tournament last year with a talent-rich lineup. Because a number of those players wouldn’t be returning, some might have assumed it would be a while before the team returned to state. Twelve months later, Eastview is going back. A 1-0 victory over Apple Valley in the Section 3AA championship game Tuesday night at Park High School in Cottage Grove sent the Lightning to state for the second year in a row – and the second time ever. Eastview will play a state quarterfinal game next week, with the date, opponent and location to be determined Saturday when a conference call is

held to seed the teams. The Lightning takes a 12-2-5 record to state. “We don’t have the great individual talent we had last year,” Eastview coach Scott Gustafson said. “This is more of a blue-collar team. These kids work hard, know how to win and have a lot of character. We’ve also had different guys score key goals for us.”

Perseverance pays off for Lightning Eastview girls return to state tourney by Mike Shaughnessy SUN THISWEEK

Eastview’s girls proved you can fight Murphy’s Law. In the second half and during overtime of the Section 3AA soccer final, just about everything that could go wrong for the Lightning did go wrong. Shots rang off the crossbar. A potential game-winning penalty kick in overtime was stopped. Eastview’s first two attempts in the game-deciding penalty-kick shootout missed the net. But the Lightning kept working and converted on its final three penalty kicks. That was enough for a 3-1 advantage in the shootout and a 1-0 victory over Park of Cottage Grove on Tuesday night. Eastview qualified for the state tournament for the second consecutive year and will play in the Class AA quarterfinals next week. The date, opponent and location will be determined in a conference call Saturday. It was a hard-earned section championship for Eastview (14-3-1), which trailed Apple Valley 2-0 with eight minutes left in the second half of an Oct. 11 semifinal game before coming back to win 3-2 in overtime. “Our philosophy at Eastview is to never give up, never get discouraged, and keep playing hard until the game’s over,” said senior goalkeeper Anhthu Huynh, who made a key stop on Park’s first attempt in the shootout. “We do talk about that, but at some point you have to have results, too,” said Eastview coach David Herem. “A lot of people talk about working hard, but these girls are willing to do it.” For one Eastview player, the shootout represented a second chance. Senior forward Melisse Chasse, one of the Eastview captains, had a chance to end the game with the so-called “golden goal” when she lined up a penalty kick with 3 minutes, 56 seconds remaining in the second overtime. Chasse got another chance in the shootout and was one of three Eastview players to convert. Kayla Tuthill and Jazzy Chanthalakeo were the others. “I’d like to be able to say I scored the first time,” Chasse said. “But I’m glad I got a second chance. You’re not always going to get that.” Tuthill and Wilberding hit the crossbar with shots in the second half as No. 1-seeded Eastview struggled to put away Park, the No. 2 seed playing on its home field. “If you hit the crossbar, people think that’s a miss,” Chasse said. “The way we look at it, it means we’re doing what we’re supposed to do and we’re getting closer and closer” to scoring. Last year Eastview reached the state tournament and was seeded third, but lost to Centennial 1-0 in a shootout. That game also was played at Park High in Cottage Grove. The 2011 state disappointment was on the minds of several players as they returned to the Park field on Tuesday night. “It’s definitely motivation,” Huynh said. “I couldn’t stop thinking about that state tournament game for a long time after we lost.” “I will let my goalkeeper use that for motivation,” Herem said. “But I can tell you that we’ve never talked about last season. This year’s state tournament is not last year’s state tournament.” Eastview’s record and No. 5 state ranking would seem to merit being seeded in the state tournament, but Herem said he isn’t taking anything for granted. “I’ve gone to section seeding meetings where we’ve been voted fifth,” Herem said. “Now that we’re in the state tournament, we know we’re going to have to play somebody good. And that team’s going to be on an emotional high because they’re in the state tournament. So we have to be ready to play.”

The South Suburban Conference cross country meet is held at Eagan High School, which on the surface seems to be a built-in advantage for Eagan runners. One problem with that theory: From 1990 through 2011, Eagan had never won a Lake Conference or South Suburban girls or boys team championship. Last week that finally changed, much to the Wildcats’ delight and relief. The No. 1-ranked Eagan girls team won the SSC championship by 23 points last Friday on its home course. Wildcats coach Lisa Langenhahn described running the conference meet at Eagan as “a Catch-22. Either you know the course and love it, or you know the course and hate it. I think our girls like the course, but they also know where the tough hills are, and it’s easy to think, ‘Oh, no, we ran this hill during training.’ ” Eagan placed five runners in the top 11 at the SSC meet, scoring 34 points. Defending conference champion Lakeville South, second with 57 points, was the only other team with more than one individual in the top 10. Langenhahn said each of the Wildcats’ top seven finishers ran faster than they did at last year’s conference meet. Senior Danielle Anderson successfully defended her individual conference championship, finishing the 4,000-meter course in 14 minutes, 4.6 seconds. That’s about 26

SOCCER, from 14A er raced toward it with three Apple Valley defenders in pursuit. When Schlosser slowed to control the ball, the defenders converged and blocked his shot. But it deflected to Teske, whose shot found the upper right corner. Teske “has a lot of talent, even though that was only his second goal this year,” Eastview senior Jacob Opheim said. “He’s a great teammate, and he’s the kind of player you like to see score a goal like that.” Neither team allowed many scoring chances in the first half. Early in the second half, Opheim took a shot from the top of the penalty area that just missed the post to the right of Apple Valley goalkeeper Ethan Meiburg. A few minutes later, Devon Veldhouse of Apple Valley missed the far post on a similar attempt. Eastview’s victory continued the Lightning’s recent run of success against Apple Valley. Eastview is 3-0-1 in the last four games between the teams. Apple Valley dominated the rivalry from 1997, when Eastview High opened, through 2010, when the Eagles won their ninth state championship. Apple Valley, in fact, never lost to Eastview

in that span. The tide turned last season, when Eastview defeated Apple Valley twice, once in the regular season and once in the section playoffs. The teams tied 1-1 in a Sept. 13 South Suburban Conference game. Apple Valley started this season with a 14-game unbeaten streak and spent time at No. 1 in the state rankings. The Eagles finished 14-2-3. Eastview returns to the state tournament under somewhat different circumstances. Last year the Lightning charged into the state tournament unbeaten and ranked No. 1 in the state. The team lost to Eden Prairie in the Class AA championship game. Four players who could have returned to the Lightning this season instead enrolled at the Minnesota Thunder Academy, making them ineligible for high school soccer. Some viewed it as a talent drain that Eastview wouldn’t be able to overcome. Opheim said it got old after a while to keep hearing about who wasn’t back, but the Lightning didn’t use it as fuel to stoke their fire. “We just kind of ignored it,” he said. “We couldn’t do anything about it anyway. All we could do was play our

game.” Eastview went undefeated (7-0-2) in the South Suburban Conference to win the league for the second year in a row – and possibly establish itself as an elite program. “I hope so,” Gustafson said. “When I took the job, I thought we’d be able to compete consistently for conference and section championships. It took a few years, but I think we’re there now. But our section is so tough. When you look at ourselves, Apple Valley and Eagan, those are three of the better programs in the state.” Gustafson said there might be more parity than ever in boys high school soccer, noting that several perennial powers, including Eden Prairie, didn’t make it to the state tournament. That leaves the Lightning feeling good about its chances. “I think we can be back at the dome,” said Opheim, referring to the Metrodome, the site of the state semifinals and championship game. “And we’re hoping, if we play the way we know we can, to win the state championship.” Mike Shaughnessy is at mike.shaughnessy@ecm-inc. com or facebook.com/sunthisweek.

BOOKS, from 1A Donna’s wishes, Jim said, though he wasn’t sure how she’d hoped to accomplish that. “I’d been struggling, frankly, for a number of years as to finding an appropriate place for those books,” he said. “And I found that about three blocks from my house at Sky Oaks.” The Swindal collection was bequeathed on Sept. 27 to Sky Oaks Elementary School. Media specialist Nancy Meyer and three teachers came to the house with a pickup truck. The collection includes fairy tales, children’s literature, books of stories embedded with math problems, books about world cultures, books of poetry – “all kinds of stuff,” said Jim, a retired Toro executive Many are now in the school library, said Sky Oaks Principal Kay Fecke, a former teaching colleague of Donna’s and longtime friend of the Swindals, who married in 1986 – the second marriage for both – and lived in Burnsville. Some of the books went to younger teachers to help build their classroom libraries, Fecke said. A few leftovers were donated to a children’s charity. “Not a one of them went

to waste,” said Fecke, whose adult son had Donna for a second-grade teacher at Edward Neill Elementary in Burnsville. “It didn’t surprise me at all when Jim invited me over to see the books that Donna had,” said Fecke, a former District 191 sixthgrade teacher. “Poetry was a passion of hers. She had her second-graders writing poetry, and it was beautiful. I know, because my son was there.” Donna taught elementary school in District 191 from 1969 to 2000, when she retired. She taught at Edward Neill, Sioux Trail, Marion W. Savage and Hidden Valley, where she worked the last years of her career as a resource teacher, helping colleagues and working with gifted students as well as those needing extra help. Intellectually rigorous with a knack for meeting kids on their level, Donna was an adjunct professor of education at Hamline University from 1996 to 2000. In 1993 she was District 191’s Teacher of the Year and a runner-up for state Teacher of the Year. “It was always such a thrill to watch her diagnose and work individually to help children reach their potential,” Fecke said. “She practiced the art of teach-

ing with such passion that I think everybody who had a chance to work with her, bar none, would say she was always willing to give a hand, be a mentor, work to find the right key for every child.” Donna, whose son and daughter graduated from Burnsville High School, spent thousands on books and other school supplies, all of which made their way into her classrooms, Jim said. As a volunteer, she helped organize and catalogue the Kerlan Collection of children’s books at the University of Minnesota. Donna patronized her local library, checking out 20 to 30 children’s books at a time, Jim said. “She would check out these big stacks of books every week and read them in bed at night,” he said. “There were people from the library who came to her memorial service because she was so well-known.” She loved writing, reading and teaching poetry. A selection of her poetry was read at the service and preserved in a booklet for family and friends.

19A said at the June meeting. In 2004, the council declined to change its guide plan to allow Wensmann Homes to develop the Carriage Hills golf course property. The city was subsequently sued by the developer, which claimed it incurred losses as a result of the council’s decision. The case eventually went to Minnesota Supreme Court in 2007, and the city settled with the developer before a ruling could be made. Though Wensmann intended to redevelop the property, its plans were stalled in 2008 by the recession. Another developer has since started construction on the property. Several steps will need to be taken before Hunter Emerson can break ground. Among other things, the City Council would need to rezone the site as residential and approve detailed plans before the project can move forward.

PARKVIEW, from 1A ers would be the most feasible option. Zaviheim entered into a purchase agreement with Hunter Emerson in May, which is contingent upon a guide plan change, rezoning and plat approvals that would allow a project to move forward. When the City Council approved submitting the proposal to the Metropolitan Council in June, council members agreed the plan would be the most viable option for the property. Council members added that they fear if they left the property owner without a viable option, the city could face litigation as it did over the Carriage Hills development. “We can’t favor a public benefit that disproportionately falls on a private property owner, Mayor Mike Maguire

CHICKENS, from 1A “The educational value to my kids is wonderful,” said Harpster, who has two children. “It’s a great way for them to learn about animals and responsibility.” The issue was brought to the City Council in June by some residents who challenged the city’s current ordinance prohibiting chickens and other farm animals in nonagricultural areas. The amendment, which is set to go into effect Oct. 26, allows residents to raise up to five chickens in the backyard of a single-family home. Residents will be prohibited from raising chickens at townhomes or apartments, and will be prohibited from keeping roosters on residential property. The amendment also prohibits the slaughter of animals and the sale of eggs on residential property. Backyard chicken owners will be required to have fences to keep the birds within the property and to “reasonably” match the exterior of the chicken coop to the home’s finish. The amendment requires chicken coops to have a 10foot setback from property lines and a 25-foot setback from dwellings. Residents are required to obtain a $50 permit, which can be revoked if the owner fails to comply with requirements of the ordinance or of the homeowners’ association. The Eagan City Council unanimously approved an ordinance amendment to allow up to five backyard chickens on residential properties. erty inspected to obtain a permit and a renewal. The permit fee is consistent with the city’s fee for pigeons on residential properties. Council Member Paul Bakken suggested that city officials examine lowering the permit fee in the future if feasible. Chickens won’t be allowed in homes or garages due to health concerns. According to the University of Minnesota Extension, which studies agricultural issues, humans can contract bacterial and respiratory infections by keeping chickens in their living spaces. Though Avian flu is a common concern, there are no cases being transmitted from birds to humans in the United States, according to the U of M Extension. Although residents will not be required to inform their neighbors before acquiring chickens, Bakken

encouraged people to work with their neighbors out of courtesy. Eagan’s amendment is consistent with chicken ordinances in other cities. To date, 14 Minnesota cities have adopted ordinances allowing small numbers of chickens in residential areas. Although most neighboring cities don’t address coop space for each chicken, Eagan’s ordinance will require coops to have a minimum of 2 square feet of interior floor space for each chicken. This isn’t the first ordinance change to allow new pets within Eagan. The council previously amended an ordinance to allow pet pigeons in residential backyards.
