Markham’s compliance audit committee has rejected applications for compliance audits against Councillor Alan Ho, former Thornhill councillor Howard Shore and Raj Subramaniam. Ho, the only one of the three who was elected in last fall’s municipal election, was also audited after the 2010 vote, after a complaint was filed by Jim Kwan who was runner-up in Ho’s ward. That audit found Ho had a number of breaches, but he was ultimately cleared by the audit committee. This time, resident Joyce Ramer requested the audit. One of the reasons given was because Ho had held a press conference announcing his candidacy on May 7, which was before officially
filing his nomination papers on May 16. “The expenses ... for the press conference, would have been part of the expenses for his candidacy,” Ramer said during the July 20 committee meeting. She also complained that he had some misleading election signs and unclaimed expenses related to signs and T-shirts. Ho was represented by Jack Siegel, who addressed the issues, including the press conference. He said Ramer did not actually identify which section of the act was contravened by Ho, and the application did not raise any expense issues. “We’ve raised them in the interest of identifying expenses, in the interest in full disclosure and transparency in this process,” said Siegel.

When Jordan Belchos rollerbladed his way to Canada’s lone medal in roller sports at the 2015 Pan American Games — a bronze in the 10,000-metre points race Monday — he pointed out were it not for speed skating, a trip to the medal podium might not have happened. The 26-year-old former Thornhill resident, who made his Pan Am Games debut, revealed his time as a member of the Markham Speed Skating Club was instrumental in the success he’s attained in roller blading. He took up inline blading before donning a pair of skates when he was just seven years old. “My training for speed skating was what gave me the confidence to believe I had a shot to medal in that race,” said Belchos, who currently resides in Calgary, where he’s a student at the University of Alberta. Having competed in the World Inline Championships twice as a junior, Belchos said his interest in speed skating started in 2005, when he was recruited by the Own the Podium Program to convert to long track speed skating. That move proved to be fortuitous, as Belchos has skated his way to medals at the World Cup level, finishing third at the 2012-13 ISU Speed Skating Mass Start World Cup. First joining the Markham Speed Skating Club in 2005, Belchos remains a member to this day and was quick to offer thanks: “They’ve always been so supportive and I’ve always been so proud to be a member of the Markham Speed Skating Club,” he said.
Thornhill’s Patricia Bezzoubenko was among the York Region athletes who had Canadian Pan Am gymnastics fans on their feet during the individual club and ribbon finals Monday. Bezzoubenko set the bar high, being the first on the mat for the club routines. Her sequence costume enhanced her seemingly effortless movements, tumbles and pivots, all done while tossing the baton. Among her impressive moves was balancing the club on her foot, tossing it into the air, pivoting and catching the apparatus. Not only was she a crowd pleaser, but the judges awarded her the silver medal, with a score of 15.93. “I felt a little nervous performing in front of so many Canadians, but I just let go and gave it my all,” Bezzoubenko said after her performance. While she didn’t rank as high in the individual ribbon performance, taking fourth place with a score of 15.3, she said she is still proud of all of her performances. Her score was changed from 15.25 following an inquiry from her coach. Bezzoubenko said her objective was to continue to make inroads each day when she competes and was quick to praise the supportive audience in spurring her on. “We have to try every day to be better than yesterday,” she said. “I’m really proud of my performance today. I felt like I had good energy from the audience.” The crowd was especially pleased with her ribbon waves, circles and snakes and the split balance stance touching her toe to her head, which demonstrates tremendous flexibility and strength. While Aurora gymnast Carmen Whelan, who trains in Newmarket, didn’t bring home any hardware, she is grateful for the experience and to show Canada what she can do on home soil. Her final score was 13.73, placing her sixth. “I think it was good for my first time,” Whelan said. “It was an amazing experience.” Bezzoubenko also won an individual bronze medal in the all-around competition Saturday, while Whelan placed sixth. Team Canada, including Richmond Hill’s Maya Kojevnikov and twin sisters Anjelika and Victoria Reznik from Vaughan, earned a bronze for their spectacular performance that displayed impeccable precision, imaginative apparatus tosses and a lift. The Canadian team also won bronze in group ribbons Sunday. Canada placed fifth in the all-around group competition Saturday. In the hoop event, Bezzoubenko placed ninth and didn’t qualify for Sunday’s final, while Whelan placed 5th. In ball, which also took place Sunday, Bezzoubenko placed seventh and Whelan, fourth. There will be no rest for the two York Region athletes, as Bezzoubenko begins

NOTICE OF STUDY COMPLETION Municipal Class Environmental Assessment Study Proposed Collector Street between Huntington Road and Regional Road 27 West Vaughan Employment Area – Block 59 STUDY PROCESS The City of Vaughan and the Block 59 Landowners Group as co-proponents have completed a Municipal Class Environmental Assessment (EA) to identify a preferred solution and design for a proposed east-west collector street extending from the intersection of Trade Valley Drive and Huntington Road and connecting to the intersection of Martin Grove Road and Regional Road 27 in support of development of Block 59 in the West Vaughan Employment Area. The study has been conducted in accordance with the planning and design process for Schedule ‘C’ projects, as outlined in the Municipal Class Environmental Assessment (October 2000, as amended in 2007 and 2011), which is approved under the Ontario Environmental Assessment Act. Public and external agency consultations were key components of this study. Public Information Centres (PIC) were held on June 17, 2014, December 2, 2014 and March 12, 2015, providing the public and interested stakeholders with the opportunity to meet with the Project Team and to discuss and comment on the problem and opportunity, alternative solutions, evaluation criteria, environmental considerations/impacts, design options, and mitigation measures. The Municipal Class EA study has identified a preferred preliminary design of the proposed east-west collector road through Block 59 to connect Huntington Road with Regional Road 27. The preliminary road design will accommodate four lanes of traffic and include active transportation facilities. It will be constructed at-grade, with bridges across both the Rainbow and Robinson Creeks, and traverse beneath the future provincial Highway 427 extension and associated transitway.

The principal of St. Elizabeth Catholic High School’s summer school sent out a letter to parents Monday after the attempted mugging of a student outside of Promenade Mall. “The student is safe and York Regional Police as well as the summer school administrative team are extensively involved in investigating this case and in ensuring student safety,” the letter from Principal John Babic said. The letter goes on to say: “If a student leaves the campus to go to the Promenade Mall, they do so at their own risk”. The male student got off of a bus near the school before 8 a.m. Monday and walked to the mall. He went inside for a short time, then left the mall and noticed someone following him. A man in his early to mid 20s pulled out a knife and asked for money, police said. The attempted robbery was interrupted when other people noticed the suspect. The man ran away. Nothing was taken and there were no injuries. The suspect has a medium build, is fiveft.-eight inches tall and was wearing a gray hooded sweatshirt and black track pants. The investigation is ongoing, said York Region Police Const. Andy Pattenden.
Woman has minor injuries after car collides with tractor trailer A woman is lucky to have escaped with only minor injuries after her car was hit by a tractor trailer in Vaughan early Monday morning. The woman had to be extracted from her vehicle by emergency crews, after a truck travelling eastbound on Hwy. 7 collided with her car, which was making a right-hand turn from the northbound ramp of Hwy. 400.
Worker electrocuted in Richmond Hill The Ministry of Labour is investigating an industrial accident in Richmond Hill last Thursday afternoon after a worker was electrocuted. The 39-year-old man was pronounced dead in hospital following the incident at a commercial building on Mural Street near Leslie Street and 16th Avenue at about 4:20 p.m. July 16, according to York Regional Police. Two men were on a scissor lift, when the equipment came in contact with a live wire. The victim was rushed to Mackenzie Health without vital signs and was pronounced dead. - Lisa Queen

Same residents filed complaint against Shore and volunteered with Ho before and during his campaign. “There is no beating around the bush, the press conference took place before he registered as a candidate,” said Siegel. “If expenses were incurred, if these are attributable to his campaign, they were incurred contrary to the Act. And that would be a concern.” And while he said the conference was a mistake, these expenses did not affect the election, give Ho an unfair advantage or bring him over his expense limit. During the lengthy discussions, Siegel also questioned if taxpayer money should be spent on an audit, noting the last time Ho was audited it cost the city $29,000. Ho also addressed a few questions himself, but he appeared to struggle to give straight answers, which frustrated some members of the committee, but in the end they rejected the application. Former councillor Shore also faced the committee. During a June 30 meeting, four applications were filed against him by residents Marilyn Ginsburg, Gerald Diner, Ricardo Mashregi and Paul J. Glionna. Gilonna filed on behalf of the same group of residents who filed a complaint against Shore to the integrity commissioner earlier this year. The four applications were treated as one by the audit committee. In the application, the residents said they believed Shore had unclaimed expenses from his election campaign that would have put him over his spending limit of $31,979.
Shore claimed just under that amount. “I believe there were numerous expenses as described under section 67 of the Municipal Elections Act that would put him well over his spending limit,” the complaint read. According to the report, some of the events, such as the Movie in the Park, were not claimed. However, the integrity commissioner had concluded it was a campaigning event. The residents wanted to see Shore claim the costs, which included the movie rental, the giant screen, free ice cream and entertainment. They also wanted Shore to claim other advertising, sponsorships and campaign contributions. According to the meeting’s minutes, Siegel, who was also Shore’s agent, said the audit process was not for a code of conduct violation and it was not to discuss the integrity commissioner’s report. He said the events mentioned by the applicants, such as the Movie in the Park, were reoccurring events and not campaign events. He said the costs of an audit were high to prosecute the minor alleged contravention, which did not meet the threshold test that is outlined in the Act. The committee decided that the applications for a compliance audit of Shore’s election campaign finances should be rejected. The committee also decided to reject the application of a compliance audit against Subramaniam made by Councillor Colin Campbell. For copies of the reports or minutes, visit markham.ca

May was treated to a “Scotsman ice cream float,” which is a mixture of ice cream and ginger beer. After May drank some of her float, she noticed a decomposed snail had poured out of the ginger beer bottle. She became ill and was later diagnosed with gastroenteritis, attributed to the snail. She sued the company that produced the beer and claimed £500 in damages. The law, as it stood, was against her. The beer company’s
lawyers relied on a wellestablished legal defense: May had no right to sue the beer company because she did not buy the bottle of beer directly from the manufacturer and therefore had no contract. They even had a case with similar facts to support them. The court had recently held that the beer company was not responsible when a dead mouse was found in its beer bottle. To quote Mr. Bumble in Charles Dickens’ Oliver Twist, “If the law supposes that, then the law is an ass, an idiot!” Undeterred, May’s lawyers took her case all the way to the highest court, the House of Lords, arguing what is now unquestioned: a company should be held legally responsible if, through its negligence, its product causes harm to any consumer, not just those with contracts. After two days of argument, the House of Lords agreed that May had a right to sue the beer company for negligence, with or without a contract. The court stated “the rule that you are to love your neighbour becomes in law, you must not injure your neighbour”. Who is your neighbour? Anyone you reasonably expect that may be injured by your negligence. As intuitive as this outcome seems in retrospect, at the time it was groundbreaking. Before Donoghue, a person’s ability to sue
for personal injuries was hampered by a rigid set of archaic legal rules that conspired to prevent injured people from receiving compensation. Donoghue created a new general right for injured people to seek justice, and the case continues to serve as a foundational precedent in the field of personal injury law.

Donoghue also demonstrates how lawyers who are prepared to take difficult cases to trial can make a positive difference for society as a whole. May was fortunate to have found a group of principled lawyers like that. After all, May could not afford to pay legal fees, and even swore an affidavit stating, “I am very poor. I am not worth five pounds in all the world.” At Boland Howe, we are most proud of our trial decisions that have changed the law for the better, such as: •making Ontario winter motorists safer, by causing winter road patrolling regulations to be improved (Thornhill v. Shadid); •expanding access to compensation for good Samaritans (Pelletier v. O.P.P.); •ensuring that landlords cannot contract out of their maintenance obligations with residential tenants (Taylor v. Allen); •forcing municipalities to pay more attention to poorly designed roadways (Roycroft v. Kyte). EW

It’s perfect time to perfect the art of doing nothing

ears ago, my neighbour and I sat watching our then younger children run through the water sprinkler in her backyard, enjoying the sounds of their laughter and the soft droplets that the wind swept our way. Basking in the above average temperatures of June, she closed her eyes and said “ah, only two weeks to go.” “To what?” I enquired. “To no more early morning routines, school lunches, punctual 3 p.m. pick-ups and extracurricular activities. I can’t wait for school to end.” She echoed my sentiments. It’s not just kids who appreciate summer vacation, but many parents, too. Some parents look forward to the freedom of their kids being away at overnight camp. For others, it’s more about not having to get the kids up at a certain time, breakfasted and out the door. It’s about not having to do as much clock watching, about not having to conjure up interesting, healthy lunches and then despairing when they come home uneaten. It’s more about spending some quality family time together. For some families, day trips are the answer. A trip to African Lion Safari or to the zoo can be just the trick to bind a family unbound by too many individual activities throughout the year. Better yet, a weekend away camping or a few days at a resort or cottage can be the magical solution to relaxing after a stressful school year. Summer can be a time to linger over simple pleasures, such as board games (even though I admit to calling them “bored” games), playing frisbee or catch at the local park. It’s true that with all the pro-
Sara Dimerman Parenting columnist gramming and intense schedules that children — and their parents — manage all year, children often have a tough time transitioning from being busy every waking moment to taking on the slower, lazier pace of the summer. It may be for fear of their whining “I’m bored” that parents organize similar busy schedules during the summer. I recognize that not all parents have the luxury of hanging out with their children during the summer months, but for those of us fortunate to work part time or have summers off, it’s an opportunity to reconnect with our children. I’ve found that while some summer time planning is certainly warranted – three to four weeks of camp and a couple of weeks of family time, it’s great to leave half of the school summer break for kids to relax and invent ways to entertain themselves. And then, just when you and they get the hang of lazy days and perfect the art of doing nothing in particular, it’s time to begin counting down the days to the start of another school year.

We are writing to express our disappointment that the new hospital will not have a Cardiac Catheterization Lab. Statistics show heart attack is the number 1 killer in North America; we in Vaughan are part of that statistic. I am a heart attack survivor as recently as July 2014. However, my younger brother did not survive his ordeal the same summer. He went to Etobicoke Osler Hospital and had a heart attack while in emergency. Staff tried to revive him many times, however, there was nothing they could do except to transfer him to Brampton Hospital ... he died on the way. What a tragic time for our family. Results may have been different if Etobicoke had a cardiac cath lab. This letter voices our concern of the importance of a cath lab for Mackenzie Vaughan Hospital. Millions are being spent to build this magnificent hospital, only to lack facilities to care for the number 1 killer. Plans have been made to
accommodate other services that are non life-threatening, instead of the most time sensitive heart wing. Mackenzie Vaughan Hospital being associated with Sunnybrook Hospital does not help with time restrictions when a heart attack is happening. It seems to us that the lives of Vaughan residents are not important to the politicians or administrators who are planning this new hospital. Concerning the April 2015 information meeting, we feel the meeting was rushed and residents were not allowed to express their concerns. It seemed organizers had an agenda and nothing else mattered. We wanted to bring this issue up, however, time was not given to pursue the issue. We believe that the heart cath lab was not considered to be an important issue by all levels of government. We are very disappointed and are prepared to push our agenda forward by starting a petition towards this goal.

What happened to pride of ownership? What happened to pride of ownership? I have been a Unionville resident for more than 25 years and have always been so proud to call Unionville my home. Properties were maintained and lawns manicured. However, in the recent past things have drastically changed. Houses are being bought and sold, “for lease” signs appear and many properties are left abandoned. Lawns and gardens are growing wild and pride of ownership seems to have gone by the wayside. For me, it’s such a troubling sign and a very slippery slope.

Thousands mark Eid at Muslim centres in Vaughan By Tim Kelly

Thousands of men, women and children bowed in prayer Saturday morning at the Ahmadiyya Muslim Community Centre in Vaughan as the holy day of Eid-al-fitr was celebrated. Muslims around the world marked the end of the holy month of Ramadan, 30 days of fasting and reflection, which culminates with Eid-al-fitr. “Now we celebrate. We gather with family, children get a small amount of money. We start with morning prayer and a sermon and then we head out to houses with our family and friends,” said Basil Ahmad, a media relations representative of the Ahmadiyya Muslim Community in Vaughan. He also noted it’s common practice on Eid-al-fitr to “replicate the actions of the Prophet Muhammad and eat something sweet,” on the morning of Eid to break the fast. “This community really sprang to life in the late ‘70s after people of Indian origin were expelled from Uganda by Idi Amin, prior to that there were a few families here.” The Ahmadiyya Community, which includes a community centre and a beautiful Baitul Islam Mosque which has hosted Prime Minister Stephen Harper, includes tens of thousands of members across Canada, many of whom live in York Region, according to Ahmad.
JAFFARI IN THORNHILL Shabbir Jaffer, spokesperson for the Jaffari Centre at 9000 Bathurst St. in Thornhill said another important aspect of Eid-al-fitr is to give alms. “The other thing must happen at the mosque prior to the celebration is an obligatory giving of charity or alms to the less fortunate. ... Charity goes to help local people in the community,” said Jaffer. Jaffer said the Jaffari Centre offers members much more than the chance to worship each Thursday evening and Friday afternoon. “We get together for reasons of education, we have lectures from medical experts and social experts, religious lectures, we have gymnasium and sports, recreation. There are so many activities taking place on a week-to-week basis.” And he said, like the rest of the Muslim community in York Region and in Canada, the Jaffari Centre community continues to grow.

Patience helps Costabile qualify for U.S. golf tournaments BY MICHAEL HAYAKAWA

Patience can be a virtue — especially in the game of golf, as Selena Costabile can attest. It has paid dividends for the 17-year-old Thornhill resident this season, as it enabled her to qualify for two major U.S. amateur golf competitions this summer. One started Monday, as she competes in the U.S. Junior Girls’ Amateur Championships in Tulsa, Ok. With little time to dwell on that, Costabile will jet her way to Portland, Ore. next month to take to the fairways at the U.S. Women’s Amateur Championships from Aug. 10 to 16. “I’m so excited to qualify for both events,” the Bill Crothers Secondary School Grade 12 student said, while in Tulsa last week preparating for the U.S. Junior Girls’ Amateur Championships. “I’ve always wanted to qualify for both, but especially the Junior Girls, since this is my last year of eligibility for that event. “But to be able to play in both for the first time — it’s exciting.” In qualifying for the U.S. Junior Girls’ Amateur Championships, Costabile turned heads at a sectional qualifier after she recorded a five-under par 66 at the Owatonna Country Club in Owatonna, Minn. earlier this year. Costabile established a course record and a career best score. For the U.S. Women’s Amateur, Costabile went to a qualifier at the Grosse Ile Golf and Country Club in Grosse Ile, Mich. July 13 and finished in a four-way tie along with fellow Thornhill resident Elizabeth Tong in third place, after carding a 72.
That enabled Tong and Costabile to both qualify. But in qualifying for the U.S. Women’s Amateur, Costabile was just one of two Canadian girls under the age of 18 to have ever qualified for this event. The other was Canada’s up and coming first-year pro Brooke Henderson. Reflecting on the recent success she’s experienced, Costabile said several factors have come into play. Foremost, she said, has been her mental approach to the game. “Staying patient during my rounds are the keys to birdies, and I was really patient during my 66,” she cited in reference to her record-shattering score at the U.S. Amateur Junior Girls qualifier. Assisting Costabile in improving her game has been the guidance she’s received this season from Padraig Kelly, head pro at the Ladies Golf Club of Toronto in Thornhill, where she’s been a member for the last seven years. Under Kelly’s direction, Costabile revealed he’s been having her get more focused on her routine. Logging plenty of practice time at Westview Golf Club in Aurora and the Ladies Golf Club of Toronto, Costabile also credits some of her success to the new clubs she’s been utilizing this season. While she is setting her sights on trying to win both events, a more reasonable objective, she said, is to adhere to her approach. “My objective for the tournament is once again to stay patient and play it one shot at a time. I want to only focus on the next shot being the best one,” she explained.

Millard was always first to volunteer

nyone looking for volunteers never had to look further than the raised hand of M. Paul Millard. When his sons, Jim and Mark, were boys, he was cubmaster with the 2nd Newmarket Cubs and later volunteered with the 1st Newmarket Scouts under the leadership of Jim Nuttall, who was named Ontario Senior of the Year in 2012 for his six decades of community service. Nothing unusual about that, parents often get involved with their kids’ activities. But Millard’s community spirit didn’t end there. In addition to being an active member of the Upper Canada Chordsmen a cappella chorus, he volunteered on the Elman W. Campbell Museum board, the Friends of the Museum, the Newmarket Historical Society and Heritage Newmarket. “He was always taking on jobs. So, when he was with the Chordsmen, he wasn’t just there, he was the money guy, he was the treasurer,” Jim said, adding his father was honoured with awards from the town and the province for his volunteerism. Millard, who died at the age of 85 on Sept. 4, 2012, came by his interest in history honestly, having belonged to one of Newmarket’s most renowned families. His great-great-great-great grandfather was Timothy Millard, who moved to Newmarket in 1792,

Millard’s son Jim said. “He was not a (United) Empire Loyalist because by the time he got here, he’s a Quaker. He was forcibly emigrated from Pennsylvania,” he said. “He came and got his 200 acres (granted by the government to Loyalists) for services rendered during the American Revolution. There is some indication he probably fought on both sides, which really wasn’t that unusual.”
‘He had some interesting hobbies. He was a rock hound. He would go digging for rocks.’ Several streets in Newmarket’s core are named after the Millard family, including Millard Avenue, which was originally the lane leading from Yonge Street to the family farm, Timothy Street and John Street. Jim and his brother grew up in a home at 100 Roxborough Rd., which had served as bachelor officers’ quarters during the Second World War. Millard himself grew up on a family farm in the Cooksville area of Mississauga. He married his wife, Joyce, in 1951 and a few years later, the couple headed off on an adventure. “They were ahead of the curve in a lot of respects,” Jim said of his parents. “They liked travelling. They both quit their jobs and they went
hitchhiking across Europe for six months in 1954 or something like that.” The couple settled in Winnipeg before moving to Newmarket in 1963 when Millard was hired as the credit manager of the Office Specialty Manufacturing Company. After he was laid off in the mid1970s, Millard joined his wife as a real estate agent for about five years before becoming a professional baker, first running a franchise called Bakerman and later opening his own bakery called the Breadman in the Quaker Hill Plaza at Yonge and William Roe Boulevard. “We did breads and pies. A lot of what we did, like butter tarts and that, was the family recipes,” Jim said. Millard retired and the bakery closed in 1990. In addition to volunteering, he liked to keep busy with other pursuits. “He had some interesting hobbies. He was a rock hound. He would go digging for rocks. It could be like semi-precious stones or whatever,” Jim said. “We would go up north and we camped. That is what we did when my parents went on holidays. We went camping and for the two weeks or whatever, we collected rocks.” Millard was also casted and painted model soldiers and liked cooking. What does Jim miss most about his dad? “Probably the stories. He told
