POWER OF ATTORNEY FOR PERSONAL CARE In a previous article, I discussed how a continuing power of attorney for property can protect you. Similarly, we will now look at the manner in which a power of attorney for personal care can be of assistance to you, in the event you lose your ability to make decisions regarding your health and personal care matters. I would like to examine some of the issues you should be aware of as they relate to a power of attorney for personal care.

1. The power of attorney for personal care is often referred to as a medical and personal care power of attorney.

2. With a power of attorney for personal care, you can ensure that someone you trust has the right to step in and make health and personal care decisions for you, in the event that you become incapable of making these decisions for yourself.

3. The power of attorney for personal care is a separate and distinct document from the continuing power of attorney for property. You are allowed to appoint the same person to represent you on both your continuing power of attorney for property and on your power of attorney for personal care.

4. As is the case with a continuing power of attorney for property, it is important to appoint someone you trust to make these very important decisions for you. In many cases, spouses appoint each other and as an alternative, one or more of their children.

5. You may feel it is unfair to appoint one out of three children as attorney for personal care, but would you want all three of your children potentially ﬁghting in front of a doctor? You should pick someone who you feel is the most dedicated to you, and will be the most likely to carry out your wishes. It is not an easy job, so do not think that you are hurting someone’s feelings by not appointing him or her. You should speak with your children and ﬁnd out whether indeed they want to be appointed as attorney for personal care.

6. You should also consider logistics. If you appoint all of your children, are they all able to look after you? You should know that, if there is more than one person you want to appoint, you can appoint them jointly which means that they have to act together, or jointly and severally, which means any one of them can act alone. If you have three people you want to appoint, you may consider including a majority clause. 7. The person or persons you appoint cannot be compelled to act for you, so you should make sure that whoever it is that you appoint will want to act for you. This is why it is important to appoint an alternate, in case your ﬁrst attorney is unable or unwilling to act for you. Your attorney for personal care will have various powers, including the ability to have access to your medical records, to deal with doctors, to deal with the possibility of your admission to a nursing home, etc. Having a power of attorney for personal care in place can help reduce family friction and ﬁghting because in that document, you will be setting out in advance who you want to deal with these matters and what you want them to do.

Markham’s Pradeep Guruge, who lost wife and small child, speaks out JEREMY GRIMALDI jgrimaldi@yrmg.com It might be hard for anyone to conjure up a response if asked how they feel about the activity police believe was responsible for the death of your wife and young daughter. So one might excuse Markham’s Pradeep Guruge for being short of words when asked what he thinks about the number of York Region drivers being caught drunk driving rising 31 per cent from 1,240 to 1,626 between 2012 and 2016. "Drinking and driving is bad," the soft-spoken father told yorkregion.com after being explained the scale of the problem that faces the towns and communities in the vast region containing more than a million people. "It makes me sad when people don’t think of the consequences." However the number of charges actually dropped 70 from 2015. It was on Aug. 29 that Pradeep lost his wife Inoka Athuraliya Liyana Waduge, 42, and child Savani Guruge, 4, after Markham’s Christopher Singh crossed the centre line near both his and Pradeep’s family home. Now all that’s left are he and his other daughter in the Cornell home, which used to be so full of

life. "It’s been terrible because half of my family is gone, it’s impossible to replace them," he added. He’s not the only one suffering. York Regional Police say drinking and driving claimed the lives of nine people in 2016, leaving families from Pefferlaw to Markham mourning the passing of sons, daughters, brothers and sisters. Another frightening aspect, involved two cases in 2016 - the death of Michael Holden and Waduge - the individuals charged with drinking and driving - Tara Gawlik and Singh both had their children in the car, all of whom managed to escape the crash with their lives. "These incredibly disappointing numbers must serve as a wake-up call that something has to change," said York police Chief Eric Jolliffe. "It’s shocking that anyone feels they have the right to risk the lives of innocent people by drinking alcohol or using drugs and getting behind the wheel of a vehicle." With marijuana legalization on the horizon, 2016 also saw 81 drug impaired driving offences a 69 per cent rise from 2015. which technology, called DADSS Project, in cars will detect a driver’s sobriety or lack thereof by

measuring a motorists’ breath, through the air in the car, or his fingerprint via a new car’s start/stop button. He further noted that a bill is working its way through the House of Commons that might allow police to engage in mandatory testing, meaning they would not have to have a reasonable suspicion before forcing a driver to give a breathalyzer test. "There is no sit-tight piece here," he said. "We’ve been working hard to get these through. Mandatory testing is currently the best deterrent globally."

Board must take action to win trust back For a school board that espouses to its students the importance of demonstrating a slew of positive character traits, it certainly seems to have a difficult time living up to them. The Character Matters page on the York Region District School Board’s website lists a total of 10 character attributes it supposedly holds dear including respect, responsibility, empathy, fairness and integrity - yet how does one begin to reconcile those lofty ideals with the body’s actions of late? Following allegations of racism and Islamophobia, which resulted in complaints to the Ontario Human Rights Commission, Education Minister Mitzie Hunter directed the board to take action to address the concerns raised and gave it a Jan. 13 deadline to respond. A letter penned by new trustee chairperson Loralea Carruthers was tabled at a special school board meeting last Wednesday, but, rather than a clearly laid out plan to resolve the problems, the communique spoke of the need for better communication and understanding and made vague references to more professional development for elected members and staff. Furthermore, the message, the final version of which was published on the board’s website, goes on to say the handling of one alleged Islamophobia incident internally, instead of with input from the community as had been hoped for and expected, was due to a "miscommunication" and that the applicable policies will be reviewed to address the "confusion" and "clarify the complaint process". The board also plans to meet with concerned parents and community members. According to a Jan. 11 Toronto Star story, however, York Region parents are treating the letter with skepticism and see little in terms of solutions for the existing problems or an outline of how future issues will be addressed. "Insulting" was how one parent, Naeem Siddiqi of Markham, described the response. As some parents point out in the Star story, the underlying issue is trust - trust that has been eroded due to the recent issues and the board’s handling of them - and it will take more than a series of platitudes on a page to earn that back. In its letter, the board states its belief that racism is always unacceptable and that systemic racism must always be addressed. True, but actions speak louder than words, and action - genuine, measurable steps with quantifiable results - is what’s required. The board can do better.

I realize some people may want monthly billing, but I bet a lot in Richmond Hill are happy with the lower costs of the status quo. creased costs. Ultimately I guess we can just pay an extra amount and have a carryover credit so we only have to pay six times a year. It seems the gas company does fine carrying a credit. I’m sure some people who go away for extended times just might have used this method in the past to prevent the accumulation of interest and negative marks on the credit ratings. So please, as you look at this hostile and anti-Ontarian policy from the government, give us some consideration and flexibility. It will be to your credit as managers of essential services. Don’t let this destructive government

"It made such a big difference - a miracle drug," said Geller, 26. After two years of trying other medications, using Remicade came as a relief to the Thornhill resident. She has now been on Remicade for 12 years. During a recent tour of the Richmond Hill clinic where Geller is treated, employees of Janssen (a pharmaceutical company of Johnson and Johnson), joined Thornhill MPP Gila Martow to speak about their misgivings relating to the government’s Patients First Act (previously Bill 41). On Dec. 7, Ontario passed Bill 41, The Patients First Act, legisla-

tion the government says will help patients and their families better access a more local and integrated health-care system, improving the patient experience and delivering higher-quality care. But Martow’s concern, shared by the Janssen employees who spoke during this clinic tour, is that the government will try to get people to switch to lower-cost alternative medication instead of original medication like Remicade. "The government needs money desperately. Health care costs are rising," Martow said. "These policies are removing the element of choice". The lower-cost alternatives (called ’biosimilar’ - a copycat version) may be similar but not exactly the same. Martow, the Janssen employees and Gillian Geller all said they were worried about

Ulcerative colitis is three to five times more common in Jews than in non-Jews living in western countries, according to an article in the Journal of Gastrointestinal and Liver Diseases 2009 by Ahmed M. El-Tawil. Jews also have higher incidence of Crohn’s disease than gentile populations, according to the article. The government said The Patients First Act "does not apply to clinical decision-making including medication/pharma-

But the government also says "it supports optimizing the use of biosimilars and is committed to working with other jurisdictions to support funding and utilization of biosimilars where the evidence supports these decisions". Biosimilars must provide Health Canada with evidence demonstrating the drug’s clinical effectiveness and safety. The government also points out that Ontario has an established process for reviewing new drugs and indications, including biosimilars. For a new biosimilar, to be funded through Ontario’s public drug program, it undergoes a thorough evidence-based review. Story and photos by Jock McCleary Metroland Media Mercedes-Benz introduced the modestly updated 2018 GLA at the North American International Auto Show in Detroit. The minimal exterior changes include redesigned front and rear bumpers with the addition of Canyon Beige paint. Under the hood remains the same with the 2.0-litre turbocharged inline four-cylinder with a sevenspeed dual-clutch transmission. The GLA will remain front-wheel-drive with the GLA 250 having the variable all-wheel-drive system. Internally there are new seat covers and trims with chromed control panels. The previously optional 8.0-inch freestanding media display becomes standard, as does the rear view camera. An optional 360-degree camera view is now available. Android Auto has been added as well as some of the wood trims being replaced. The GLA was unveiled to the media in the form of the GLA45 AMG “Yellow Night” edition.

This eye-catching AMG Performance Studio Package certainly accentuates the performance elements of the GLA45. Its black colour scheme is enhanced with yellow highlights on the front bumper, rear diffuser and rear wing with yellow coach lines painted along the rocker panel and on the rims. Other external enhancements include matte gray sport stripes on the roof, hood, trunk lid and sides. Internally there are numerous yellow highlights with yellow trim on the AMG performance seats as well as on the performance steering wheel. Under the hood it has the same 2.0L turbocharged engine, but now totally reworked by the AMG engineers. It now produces an incredible 375 hp with 350 lb/ft of torque. It is linked to an upgraded AMG SPEEDSHIFT, dual-clutch, seven-speed sport transmission that rockets it from 0-100km in an incredible 4.3 seconds. The GLA will be available in the summer as a 2018 model and pricing will be made available nearer to launch.

On Boxing Day the ER saw nearly 400 patients, about 70 more than usual and nearly a 25 per cent increase. And the flu epidemic currently sweeping the GTA didn’t spare Mackenzie Health’s urgent care clinic either. On New Year’s Day it saw 90 patients, when 60 to 70 is par for the course. Dr. David Rauchwerger, chief and medical director, emergency medicine program at Mackenzie Health said, "We’ve seen an even greater stress on the system than in even previous years." Southlake Regional Health Centre’s emergency department also saw 25 per cent more patients per day in December com-

pared to the average for the rest of the year. And at MarkhamStouffville Hospital, the emergency department also saw an increased numbers of patients. There was a 30 per cent increase in the MarkhamStouffville ER, or 100 more patients than normal on the busiest days. Kwolek said the spike in holiday-period visits to the ER isn’t all related to the flu. Part of it is because primary care physicians and other healthcare providers either close their offices or go on reduced hours for the holidays leaving the ER an option for patients. The concern now that the holidays are over is the associate medical officer of health’s prediction we’re just at the beginning of a six-week surge of flu activity in the GTA. With that in mind, Kwolek is urging anyone who hasn’t yet received a flu

They have lined up homes in which the family will stay. One temporary home where the family will be staying is at a house in Newmarket. A member of the Islamic centre offered the family this furnished residence for a limited time for no charge, Torabian said. The synagogue and mosque raised $46,000 for the family in three months. Andrew Hazen of Temple Har Zion, explains the message he hopes to convey to the Syrian family about Canada. "I want to support the family," Hazen said. "I want to do it in a way that is Canadian, (to show) it is a different kind of place, a place where collaborations can happen. You don’t need to have animosity between groups like this".

The synagogue teamed up with the mosque to help bring a refugee family from Syria to Canada and assist them in settling here. This program launched in March 2016. They are bringing over the Elendari family which has eight members. The family is Druze, a sect of Islamic origin, located mostly in Lebanon and Syria. Andrew Hazen, co-chair of the refugee project at Temple Har Zion, explains the reason for teaming up with the mosque. "We thought this was a good way to increase collaboration and contact and demonstrate Canadian values in action," Hazen said. The mosque feels a similar "tikkun olam", he said, a Jewish concept which means to heal and repair the world. Hazen acknowledges that some people believe because of Jews’ tumultuous history of fleeing persecution, they are a natural choice to spon-

"It was an argument made that if anyone is doing this, they should be doing this - a Jewish congregation because our parents and grandparents knew what it was like to be a refugee," Hazen said. A lot of the synagogue’s members are first or second generation Canadian, he said. Har Zion is a reform synagogue dedicated to social action and inclusion which includes reaching out to interfaith couples and families and promoting equality of women in religious services.

The synagogue and mosque are situated beside each other on Bayview Avenue on the Markham side of Thornhill. The mosque, founded by Iranian-Canadian Muslims to promote the teaching of Islam, is "proud to have collaborated with its neighbour" says its website (imammahdi.ca). "We are hoping this project will be a starting point of more collaboration between Muslim and Jewish communities in Toronto and Canada," the site says. The synagogue and mosque’s support for the family will include: helping

the family find housing and find their way around York Region and Toronto and helping them connect with ESL classes and government services.
