• Stella Liebeck was 79 years old when her grandson took her through a McDonald’s drive-through in Albuquerque, New Mexico in 1992. She ordered a 49 cent cup of coffee, and her grandson pulled over into an empty spot in the parking lot while she fiddled with the lid in an attempt to add cream and sugar. She was in the passenger’s seat of a 1989 Ford Probe which did not have cup holders. Liebeck placed the coffee cup between her knees and pulled the lid toward her to remove it. Instead, she spilled the coffee on her lap. • This wouldn’t have been such a big deal, except that the coffee was 190 degrees F, just 22 degrees away from boiling. The cotton pants she was wearing trapped the scalding liquid next to her skin. Although her grandson rushed her to the hospital, by the time she arrived, she had received third-degree burns on her legs, hips, and pelvic region. • Liebeck was hospitalized for eight days while she underwent skin grafts. She suffered third-degree burns on 6% of her skin, and lesser burns on 16%. She lost weight, dropping 20 pounds
(9.1 kg) which was nearly 20% of her body weight, ending up weighing just 83 pounds (38 kg). After being discharged from the hospital, Liebeck required nursing care at home for three weeks, which was provided by her daughter. She was partially disabled for two years and remained scarred for the rest of her life. • Stella Liebeck asked the McDonald’s corporation to cover her unpaid medical bills, which amounted to less than $20,000. That included $10,500 for her current out-of-pocket medical expenses; future medical expenses estimated to be $2,500; and her daughter’s loss of income of about $5,000. Instead, McDonald’s offered her $800 total. When they refused to budge, Stella Liebeck got a lawyer and sued. • Texas attorney Reed Morgan accused McDonald’s of gross negligence for selling coffee that was unreasonably hot. Lawyers for McDonald’s refused all of Morgan’s offers to settle out of court, including an offer for $90,000. The case went to trial in 1994. • McDonald’s said that they needed to serve coffee that hot because most people expected to drink it on a long commute to work and didn’t want it to get cold on the way. Morgan showed evidence that most people expect to drink it immediately. McDonald’s argued that all restaurants serve coffee that hot. Morgan showed that most Albuquerque
restaurants served it 20 degrees cooler. Morgan had a doctor testify that liquid that’s 190 degrees will deliver third degree burns within three seconds, while liquid that’s 20 degrees cooler will deliver burns within 12 seconds. • But the tide really turned in Stella Liebeck’s favor when Morgan showed evidence that over 700 people had been scalded by McDonald’s coffee over the previous ten years, and McDonald’s had still refused to turn the temperature down. • After a ten day trial, the jury ruled in favor of Liebeck, who had only wanted her medical expenses covered. McDonald’s was fined $2.7 million, which amounted to two days’ worth of income from coffee sales for the corporation. Of that, Stella Liebeck received around $600,000. • Still, McDonald’s controlled the national narrative surrounding this court case. They ran an effective campaign highlighting ridiculous lawsuits people had filed over the years, implying that hers was equally insipid. Seinfeld mocked the lawsuit. David Letterman ranked it on one of his top ten lists. Long before Stella Liebeck died in 2004 at the age of 91, she had become known as the lazy, greedy lady who blamed McDonald’s for her own clumsiness. Few people know the truth.

COLOR BLINDNESS • Color-detecting molecules are located within the retina, called cone cells. In humans, several genes are needed for the body to make photopigments, and defects in these genes can lead to color blindness. • There are three kinds of color blindness, based on defects in the three different kinds of cones that respond to blue, green, and red light. Red-green color blindness is most common, followed by blue-yellow color blindness. A complete absence of color vision in which people see only in black and white is rare. • Color blindness is hereditary, and is passed from mother to son. Men are much more likely to be color blind than women, with one out of every 12 men suffering from
some type of color blindness while only one out of every 200 women do. • Men are more likely to be colorblind than women because the genes responsible for inherited color blindness are on the X chromosome. Males only have one X chromosome, while females have two. In females, a functional gene on only one of the two X chromosomes is enough to compensate for the loss on the other. • If a woman is red-green colorblind, all her sons will also be color blind. A father can’t pass his red-green color blindness on to his sons. • More women than men are carriers of color blindness, even though they are not colorblind themselves. • In rare cases, some people suffer from a rare form of color blindness called unilateral dichromacy which means they have one normal seeing eye, and one color blind eye. • The average person can detect 100 hues, or gradients of color. If someone is strongly color blind, they can only detect about 20. • Color blindness can also be caused by eye diseases, aging, or retina damage. • Researchers have used gene therapy to cure color blindness in monkeys. All male squirrel monkeys are color blind because males of the species carry either the gene that makes red photopigment, or the gene that makes green photopigment, but never both. Scientists injected the red photopigment gene into the retinas of male monkeys born without it. Afterwards, they were able to see full colors. • Dogs are red-green color blind, where red registers as grey, but they can see other colors. • Owls are the only birds that can see blue. • Bees and butterflies have superior vision and can see colors humans can’t even see. • There is no cure for color blindness. However, people with red-green color blindness may be able to use a special set of lenses to help them perceive colors. These lenses can only be used outdoors under bright lighting conditions. They work by putting two differently colored lenses in front of the eyes. • Color blind people include Paul Newman, Bill Clinton, Prince William, Mark Twain, and Bing Crosby. • The Facebook theme is blue because founder Mark Zuckerberg is red-green color blind. • A railway accident in Sweden in 1875 that killed nine may have been caused by a color blind rail operator who failed to properly read a signal. After the crash, a method to test color vision was developed. • Some countries will not allow color blind people to get a driver’s license. In some places in Canada, the lights on a stop light are different shapes – circle, square, and triangle – to help color blind drivers. • In Britain, electrical wires used to be red, black and green. They were changed to brown, blue and green/yellow to help color blind people see the difference between live wires and grounding wires.

Staying Safe Online It’s getting more and more difficult to stay safe on our phones, computers ... everything that involves communication that someone else can access. If your local senior center holds classes, recommend that it conduct one on how to recognize scams in your email and on websites. Scammers are getting more sophisticated as they try to lure you in, making you feel that it’s safe to click a link or give information. Once you learn how to identify (or at least be suspicious of) what you see online, you increase your safety because you know to stop and think. Realize that phone apps are likely not very safe, especially for things like
