Contracts - Worth the Paper They’re Printed On?
It’s deer hunting season and there is always the mixed bag of feelings ranging from the hard core hunters to the hard core Bambi lovers. Either way, it is a part of our Minnesota life and a very essential one. Deer are pleasant and beautiful to look at to be sure, but you only have to hit a deer once or experience the devastation they can reek on your landscaping to appreciate the need to control the size of this incredibly productive species. In addition to controlling the deer population, the hunting season adds a very significant and dependable impact to our economy. There are 475,000 deer hunters in Minnesota supporting 5300 jobs and generating over $458 million dollars. Some may think it’s just sport but most hunters appreciate and many count on having venison as part of their yearly diet. Let’s look at them both.
The Hunted
White-tailed deer are the smallest members of the North American deer family with the adult female weighing about 145 pounds, and males 170 pounds - roughly the average weight of female and male humans. They are herbivores, leisurely grazing on most available plant foods and are primarily nocturnal or crepuscular browsing mainly at dawn and dusk with a wandering range of about one square mile. Deer are very difficult to spot because of the blending color of their coats. Adults have reddish-brown coats in summer which fade to a duller grayish-brown in winter. Male deer, called bucks, are easily recognizable in the summer and fall by their prominent set of antlers, which grow annually then fall off in the winter. Although previously depleted by unrestricted hunting in the United States, strict game-management measures have helped restore the deer population. Minnesota’s controlled deer population is about 1 million. Texas is No. 1 with 4.7 million. Female deer, called does, give birth to one to three young at a time. A deer’s three main concerns in life are to eat, reproduce, and not be eaten.
The Hunter
In total, more than 800,000 deer hunting licenses and permits (all types) were sold in 2010 with 98% sold to Minnesota residents. License options allow hunters to buy individual licenses for all the seasons and give hunters more choices in where and when they can hunt deer, and hunters can take as many as five deer in many parts of the state. The average hunter spends five days afield during firearms deer season but not everyone bags one. Last year only 38 percent of Minnesota firearm hunters successfully harvested a deer, with seventy percent of those typically occurring during the first three or four days of the season. Last year’s total deer harvest was just over 207,000 and about 47 percent were antlered bucks. Minnesota’s average harvest was 241,000 deer over the last five years. Wisconsin is No. 1 with an average harvest of almost 450,000. The largest typical whitetail buck ever taken in Minnesota had a Boone & Crockett score of 202 and weighed 500 lbs, shot by John Breen in 1918 near Funkley. The DNR Information Center remained open two hours later on the day before last year’s deer opener to answer more than 2,000 telephone inquiries, most of them related to the opener. With nearly a half-million hunters in the state, there are also the occasional hunter violations, some with very stiff penalties. The top 10 are: 1. License not in possession 2. Transporting uncased/loaded firearms 3. No license 4. Hunting over bait 5. Unplugged shotgun 6. No red/blaze orange 7. Untagged deer 8. Failure to have HIP certification on license 9. Failure to validate 10. Trespassing

We have all heard the cynical quip “contracts are not worth the paper they are printed on and the question is: Well...are they? Sometimes it seems even to me, a veteran contract litigation lawyer, that they are not, and there are good reasons for that. The number one issue relates to the cost of fighting. Lawyers are prohibitively expensive and the procedures in court often enable a determined opponent to delay and add cost to an already lengthy and expensive process. The second most important concern is whether the party you are chasing has anything to chase. Often, breaches of contract occur after a party runs out of money. The adage “you can’t squeeze blood from a turnip applies here. On the other hand, in contract lawsuits, the written contract almost always dictates the outcome. Also, the contract often is useful in preventing your opponent from bringing up unrelated or pointless issues in contract lawsuits and often, the contract requires cheaper dispute resolution forums, such as arbitration. Further, the contract may require your opponent to pay your attorney’s fees if you win. Finally, if appropriate, contracts can call for security or guarantees that make it more likely that you will recover if things go wrong. In the end, while it is true that in some circumstances, contracts can become meaningless, carefully drafted agreements can be used to minimize those inevitable uncertainties, and they give the party that complies a definite advantage in the event of a breach.

Fridley, MN 55432 TIDBITSÂŽ LOOKS AT MIRRORS
by Janet Spencer For centuries, mankind's only mirrors were pools of water or polished metal. It was a long journey to figure out how to make a good mirror. Come along with Tidbits as we go through the looking glass! MAKING MIRRORS • The original glass mirror was made by covering the back of a piece of glass with thin tin sheets which were rubbed down smooth. Then the glass (with the tin on top) would be covered with mercury. A piece of woolen cloth would then be laid on top of the mercury and compressed with iron weights for more than a week. Finally the excess mercury would be drained off and the mirror was complete. This method of mirror making was very dangerous to the craftsman because mercury vapors are poisonous. • Craftsmen in Venice were the first to discover this method of mirror making in the 1300s. It remained a carefully guarded secret and for centuries Venice had a monopoly on mirrors. Those who gave away the secret were subject to the death penalty. Mirrors were expensive and rare and people in France were jealous. • In 1665, the French chief minister to Louis XIV went to Venice and - at the risk of death - bribed 18 Venetian mirrorsmiths, using huge sums of money to convince them to move to F rance. • Soon after the Venetian mirrorsmiths arrived in France, the French passed a law making it illegal to import Venetian mirrors. The new French mirror company, set up in the town of Saint Gobain, is still thriving today. • No sooner had France gotten the secret of mirror making than a Frenchman named Louis Lucas beat the Venetians at their own game when he invented a way to make plate glass in
1668. In Venice, they only knew how to make blown glass. Each mirror started out as a bottle or cylinder which was slit open and flattened while still hot before being made into a mirror. The size of mirrors was therefore very limited. But Lucas discovered how to pour molten glass from the pot onto an iron table where it was flattened with an iron roller. There was no limit to the size a mirror could be. Soon France was famous for its mirrors. • Louis XIV was very pleased, purchasing some 700 mirrors and lining an entire hallway at the Palace of Versailles with them in a stunning display. Venice kindly offered to send some of their very best glassmakers to France to "help out" at the factories; France declined the offer, preferring to keep their secret. • It had long been known that silver would make a better mirror than mercury and tin, but the problem was figuring out how to get the silver to stick to the glass. In 1835, German chemist Justus von Liebig invented a method of making mirrors that is still used today. In this method, the glass is flushed with silver salts and then covered with a solution of silver nitrate. After being heated and left undisturbed for an hour, a chemical reaction causes the metallic silver to separate and adhere to the glass. It's then coated with shellac and painted with a black backing.

MODERN MIRROR MAKING • Today silver or aluminum is vaporized and sprayed in aerosol form into the air above glass which is travelling on a conveyor belt below. For finer mirrors such as those used in telescopes, aluminum, chromium, or gold are put into a vacuum tank and heated. When they reach the critical temperature, they "flash" into vapor which fills the entire tank with metallic gas. A film is then deposited on whatever is inside the tank. (Contunued Pg. 4)

• If the mirror is curved in a convex shape so that the reflecting surface faces away from the center of the mirror, light rays reflect away from each other and the reflection becomes smaller. This is handy for use in exterior rearview mirrors ("Objects are closer than they appear") as well as the large fish-eye mirrors used in stores so clerks can keep an eye on customers. • If the mirror is in a concave shape so the reflecting surface faces toward the center of the mirror, light rays are reflected towards each other and the reflection becomes very large. Make-up mirrors and telescope mirrors are built this way. Funhouse mirrors, with their convoluted collection of convex and concave surfaces, twist the reflection into comical contortions. • A one-way mirror uses dark colored glass, such as smoked glass, instead of clear glass. The reflective backing is very, very thin - so thin that if the light is equally bright on each side of the mirror, it merely looks like a pane of glass. But if people behind the mirror are sitting in a dark room looking into a light room, it looks like a mirror. • It's the same principal with the interior rearview mirror in a car. There are two mirrors there. The daytime mirror reflects almost all of the light that hits it, but flip the little button and the nighttime mirror reflects only four percent of the light so the driver is not blinded by headlights.

• Another method of making mirrors involves using liquid metal such as mercury or gallium. The liquid is spun continuously, causing it to take on the parabolic shape needed for telescopes. This is a very inexpensive method of making a very large mirror. The HOW DO MIRRORS WORK? Large Zenith Telescope located near Vancouver, BC is • Mirrors work because they reflect light. Most the largest liquid mirror in operation, with a diameter of objects do not give off any light of their own. They can about 20 feet (6 m). only be seen because light from other sources - the sun, a candle, a flashlight - hits them and bounces off, hitting your eye. When light strikes an object, some of the light is absorbed by the object, some is transmitted through the object, and some of the light bounces back. The part that bounces back is called reflection. Flat shiny YOUR TOWN surfaces like water, metal, and mirrors reflect light well because very little of the light is absorbed or transmitted, and most of it is reflected. When light hits a surface that is dull instead of shiny, the light bounces off in all directions and is scattered. There is no reflection. When light hits a mirror, the mirror sends the light back in exactly the same direction that it came from. This makes it appear as if the image is coming from behind CALL:763-218-0033 the mirror. • When light hits a shiny surface that is curved instead of flat, such as a spoon, doorknob, or ripples on a lake, the light rays hit the surface at a variety of different angles and are therefore reflected back at a variety of different angles, instead of bouncing back straight. This makes the reflection look distorted. It's like a bouncing ball: drop the ball straight down, and it bounces straight up. Throw the ball at an angle, and it bounces up at an identical angle. of Him After Brian proposed to Jill, his father took him to one side. “Son, when I first got married to your mother, the first thing I did when we got home was take off my pants. I gave them to your mother and told her to try them on, which she did. They were huge on her and she said that she couldn’t wear them because they were too large. I said to her, 'Of course they are too big for you, I wear the pants in this family and I always will.' Ever since that day, son, we have never had a single problem." Brian took his dad’s advice and did the same thing to his wife on his wedding night. Then, Jill took off her panties and gave them to Brian. “Try these on,” she said. Brian went along with it and tried them on, but they were far too small. “What’s the point of this? I can’t get into your panties,” said Brian. “Exactly,” Jill replied, “and if you don’t change your attitude, you never will!”
and Her A child asked his father, "How were people born?" So his father said, "Adam and Eve made babies, then their babies became adults and made babies, and so on." The child then went to his mother, asked her the same question and she told him, "We were monkeys, then we evolved to become like we are now." The child ran back to his father and said, "You lied to me!" His father replied, "No, your mom was talking about her side of the family."

● Those who study such things have discovered that if you put a sea sponge in a blender and leave the resulting mess overnight, the remaining cells will find each other and start forming a new sponge. ******************************** Thought for the Day: “We are not retreating -- we are advancing in another direction.” -- Gen. Douglas MacArthur
● If you’re planning a trip to Japan, you might want to add the island of Okunoshima to your itinerary. It’s often called Usagi Jima, or “Rabbit Island,” by locals because the bunnies there are tame and approach humans without fear.
● If you see a group of pugs together, know that they’re collectively called a grumble.
● Squirrels are wonderful foresters. Every year, thousands of trees grow from caches of nuts and acorns that squirrels forgot about.
● It was American writer Gore Vidal who made the following sage observation: “The corporate grip on opinion in the United States is one of the wonders of the Western world. No First World country has ever managed to eliminate so entirely from its media all objectivity -- much less dissent.”
● You know that the Pacific Ocean is large, but you might not be aware of quite how large: It covers fully half the surface of the planet.
● Presidential security was not as always as formidable as it is today. In 1913, former President Theodore Roosevelt was walking down a Milwaukee street, heading to a speech he was scheduled to give. A man named John Schrank pulled out a gun and shot toward Roosevelt, who staggered but did not fall. There was no blood evident, and Roosevelt, who was campaigning for a second term, insisted on delivering his speech. When he pulled from a coat pocket the 100 pages on which his speech was written, he saw a bullet hole through the sheets of paper. Still determined to carry on, he gave the speech before going to the hospital, where it was discovered that the bullet had penetrated 4 inches into his body. After the perpetrator was arrested, it became evident that Shcrank was insane; he claimed that President William McKinley had revealed to him in a dream that Roosevelt was responsible for McKinley’s assassination. Shrank spent the next 32 years in an insane asylum.
● In a recent survey, more than one-third of respondents admitted that they had dinged the car, then lied to their spouse, saying someone else was responsible for the damage.
● It’s interesting that an herbal cold remedy and a type of sea urchin share the same name: Echinacea. Both words are derived from the Greek word “echino,” which means “hedgehog.”

The World Series is scheduled to begin on October 23. Tidbits takes you out to the ball game with the history of baseball’s Fall Classic, and says, “Play ball!” • Although Major League Baseball has had some sort of post-season championship series since about 1884, the World Series as we know it began in 1903 when the Pittsburgh Pirates competed against the Boston Americans. Boston took the Series in what was then a nine-game series, five games to three. • Every now and then, all the World Series games were played in one city, for example, the 1906 Series which was played by the Chicago Cubs and the Chicago White Sox. But it’s pretty rare for all the games to be played in the same ballpark. In 1921 and 1922, both New York teams, the Yankees and the Giants used the Polo Grounds as their park, where all the games were played. In 1944, the St. Louis Cardinals and the St. Louis Browns battled it out in one stadium, Sportsman’s Park. • The World Series ring is a familiar award given to players as a token of their victory. However, up until 1922, players received pocket watches or medallions as a memento. The 1922 New York Giants were the first team to receive rings as a keepsake from the championship.
