We manufacture all our Timberline Made in the UK products in our extensive factory in Chesterfield, Derbyshire. Our team includes not only our administrative staff but also our highly experienced team of workers that process our timber at stage one, process through a CNC machine and at the final stage we assemble and inspect the products, all this work is undertook by our skilled craftsman. By pre-assembling all orders in our factory, we ensure that before the goods even left our premises they are in perfect condition and that onsite installation will happen faster.

Grant Advice

More than ever, budgeting for new outdoor equipment can be daunting. The current economic climate and changes that are occurring in government spending can make the task of finding money which enhances your space even more difficult.

What are the basic types of financial options? Your Annual Budget & The Department for Education The Department for Education are responsible for the education and services of all people under the age of 19. Please visit the website at www.education.gov.uk for a wealth of funding information and guidance. Fund Raising Fund raising is a great way to get the children and local community involved in your project, this method gives locals a sense of ownership of the equipment, which in turn promotes care and pride and reduces vandalism. If you are planning a fund raiser please let us know, we’d be delighted to supply you with a 3D drawing of your project to get things moving. Grants/Lottery and Trust Funds There are countless grants and trusts out there no matter the amount you require, the first step is to fill out a bid application or in the case of many trust funds, just write them a letter, and don’t forget to include as much information as possible, tell a story in your application, why not add images to show how you can implement change in your project. The biggest factor for consideration is a well thought out design and idea, which will be shown through a good plan. It is important that this is readily available during the application process as a way of proving that your plan is worthy of funding. Corporate Sponsorship We feel that we have uncovered a major source of funding that many of our customers have not previously considered, unlike grants and trusts, corporate sponsorship is quite often simply a phone call or letter to the right company in your area. These large companies in your area want to not only reduce their tax bill, but also help the community, and more importantly be seen to help the community. A simple phone call is all it takes, and we will be happy to provide images and a 3D drawing of the area to help your cause. A very important factor to consider when purchasing your equipment is the Critical Fall Height. This is a very important safety aspect which takes into account the highest point of which a child can fall from a piece of equipment. These icons are spread throughout the brochure and should be considered closely before any purchase. You can add numerous extras (please see pages 36-37) and upgrades to ensure your Pavilion exactly fits your needs and budget. Our Sideless and Floorless Pavilions are not only imaginatively but descriptively named! Designed for the outdoor area in need of basic shade, the buildings offer an attractive solution. All our Pavilions, with the exception of the Quarter, come in both Standard and Sideless/Floorless configurations thus giving maximum choice.

All the mechanics are safely located behind shatter-proof Polycarbonate windows and the pull cables are short to prevent any misuse.

While this panel has been designed with safety as the number one priority, it should only be used in a controlled environment, the dials do NOT contain any glass, but they are plastic and not unbreakable, and therefore should be treated like most scientific instruments - with care.

The Scientific Pulleys Play Panel features 2 identical weights (the load) which are connected to a stainless steel wire rope via two different pulley types. One is a straight up and over single pulley which offers no mechanical advantage, and the other features a second pulley wheel which does. Children can experiment with the two different systems and record the differences. An information panel gives the children some experiments to think about and a results and observations dry wipe board insert can be used to record the data.

The Scientific Weather Play Panel is the ideal panel for the children to monitor the local weather over a short, medium or long term. Production Technology Play Maker products are manufactured from the highest quality components. Timber All wooden elements of the products are manufactured using Scandinavian Redwood Pine. The square wooden beams are glued together using our specialised machinery. The gluing process significantly improves the strength properties of the timber in Play Maker products, and eliminates the chance of timber splits. The timber is protected from atmospheric conditions as it is covered with a double layer of a special natural oil based substance. Steel All the steel elements of the products are manufactured using the highest quality powder coated steel. The strong steel goes through a rigorous process of cutting, cleaning, bending, drilling, welding and drying before it makes up part of a Play Maker product. Our powder coating process protects the steel from atmospheric conditions, dents and abrasion. Protective Decorative Boards You will find protective decorative boards on our climbing frame products. The protective decorative boards are made from a polyethylene plate called HDPE. The very nature of this material means that is doesn’t absorb water, doesn’t expand, and doesn’t break! HDPE combines moulded colours, which means that even after scratching as a result of heavy use, the board still has a solid colour. The use of UV stabilisers provides colour stability for many years, without the need to invest in repainting. The surface of the board is resistant to graffiti, paint, maker pens, spray paints, and it is also very easy to keep clean. Connectors In order to provide the quality finish which is expected with Play Maker products we make sure that every screw head is covered with a plastic insert. As well as looking bright and colourful, the connector ensures that the screw will not become lose over time. Ground Poles Above the ground all Play Maker products are made from timber. Below the ground a treated steel pole is concreted into the ground. This procedure isolates the wood from the ground at around 10cm of height, which perfectly extends the life of the wood. Guarantee Period All of our Play Maker products have been made from high quality treated timber so that we can offer you a 10 year guarantee against timber rot and decay!

Do I need Safety Surfacing? If the product is going onto a commercial or educational premises you need to continue reading. Products going onto a residential property does not require surfacing but you may for safety reasons choose to install it.

Safety Surfacing

Introduction What is CFH? Every product in our brochure will have a black and white technical drawing showing its dimensions. What you need to look for is the height from which a child could conceivably fall from the product, such as the platform in a Tower, the highest edge of a Play Boat or the highest climbing point on a Rockwall. This typically does not include the roof of a Tower as it is considered unreasonable to assume that a child will be climbing on and off of it. This height can also be called the Operating Height, Critical Fall Height (CFH). How much surfacing will be required? Again, please refer to drawings on each product page. You will find on any items that require Safety Surfacing a statement stating, “Recommended Safety Surface; Xm2”. This tells you quickly and easily exactly how much surface area you will need for that product. This is how it is calculated: CFH Under 1.5m 1.51m - 1.8m 1.81m – 2.0m 2.1m - 2.2m

Surface Distance from Equipment = 1.5m = 1.7m = 1.83m = 1.96m

If I do need Safety Surfacing, how do I know which ones I can choose from? Preference obviously plays a major role in choosing your Safety Surfacing. We have also bullet pointed pros and cons for each of our surfacing options on the pages to follow. But most importantly you need to know what the CFH is of the equipment the surfacing is going under (see above to find a products CFH). The European standards EN1176 and EN1177 recommend that, “Where the ‘Critical Fall Height’ of play equipment is in excess of 600mm, then Safety Surfacing should be provided. Beneath play equipment not exceeding 600mm, the surfacing should have some impact attenuating properties but in such situations, no test of its ‘Critical Fall Height’ is required”. In other words if a product has a CFH of 0.6-1m you can not install it on tarmac or concrete, but you may be able to install it onto grass.* Here is a quick estimate of the average maximum CFH for each surface: • Grass, very well maintained, can be up to 1.5m CFH* • Loose Rubber Mulch, well maintained and raked, up to 3.5m CFH • Loose Cushion Fall, well maintained and raked, up to 3m CFH • Loose Rubber Bark, up to 3m CFH • Play Sand, well maintained and raked, up to 3m CFH • Lawn Mat, up to 2.1m CFH • Artificial Grass, up to 3m CFH • Wetpour, up to 2.2m CFH

*Grass installations of products with a CFH between 0.6-1.0m please contact your local authority’s Health & Safety Officer to ensure this is within their expectations. How much will it cost? Pits, Loose Fill and Lawn Mat have a set price per square or cubic metre. Wetpour and Artificial Grass have price ranges due to the variables that calculate their price. This includes the surface area to be covered; the colour of the product and whether the product will require base works (determined by what surface it is being installed onto). Please call us for an exact quote. What about warranty or average length of time I can expect it to last? Each surfacing carries it’s own length of warranty, see the following pages for details. But in general, Rubber Mulch is 3 year, Lawn Mat is 3 years, Artificial Grass is 5 years, and Wetpour is 3 years. Labour is included in the warranty throughout the first year. Please note the warranty does not include normal wear and tear, vandalism, Acts of God or damaged caused by activities outside the uses for which the surfacing was intended.

Wetpour is made from rubber granules, which are extremely impact absorbent. Once the resin binds them together they create a very springy surface. Wetpour doesn’t only provide adequate protection for children, but also creates a beautiful environment for children of all ages. All of our Wetpour surfaces comply with British and European standards giving you piece of mind!

Wetpour Critical Fall Height and Wetpour The height of your play equipment defines how thick the Wetpour should be, a higher piece of equipment requires thicker Wetpour which comes with a higher cost per square metre. To reduce your costs on products that may require more than one thickness, we will only install the thicker Wetpour in areas it is required. Black or Coloured? Standard Black is the cheaper option and can be filled with graphics (see opposite page). Colour is more expensive but with an array options available its money well spent. Wetpour going onto an existing hard surface like concrete or tarmac can literally just be laid on top with no digging required! But in most cases it will require a channel cut on edges that are not up against a wall or fence, and will be a slight additional cost. Installing Wetpour onto grass will require baseworks and edging, thus increasing cost, the grass will need to be dug up and appropriate weed membrane control will be added. Please note that sand, stone and edging will need to be prepared prior to the installation of Wetpour. Contact us for more details. UV Degradation All coloured EPDM granules are susceptible to UV (Ultra Violet) degradation. This is where the synthetic polymers are attacked by Ultra Violet radiation, meaning that the colour will fade over time. UV Discolouration UV Discolouration is where the resin, when mixed with the topping granules reacts with the UV rays and takes on a yellow/brown tinge, this masks the true colour of the granulate beneath. This will happen to ALL COLOURS.

SERVICE AVAILABILITY We accept orders under these terms and conditions from businesses organisations in the public and private sectors and from Local / National Government bodies, charitable, not for profit organisations and residential customers based in the United Kingdom. 3. HOW THE CONTRACT IS FORMED BETWEEN YOU AND US All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending an order acknowledgement (Order Acknowledgement) to the delivery or contact email address specified in the Order. The contract between us (Contract) will only be formed when you send us the signed Order Acknowledgement. The Contract will relate only to those Products listed in the Order Acknowledgement. We will not be obliged to supply any other Products which may have been part of your Order until the order of such Products has been confirmed in a separate Order Acknowledgement. You shall be responsible for ensuring the accuracy of the terms of any Order (including any applicable specification) submitted by you, and for giving us any necessary information relating to the Products within a sufficient time to enable us to perform the Contract. Errors and Omissions excepted “E&OE”. We reserve the right to make any changes in the specification of the Products which are required to conform with any applicable safety or other statutory requirements or which do not materially affect their quality or performance. If the Products are to be manufactured or any process is to be applied to the Products by us in accordance with a specification submitted by you, you shall indemnify us against all loss, damages, costs and expenses awarded against or incurred by us in connection with or which we agree to pay in settlement of any claim for infringement of any patent, copyright, design, trade mark or other industrial or intellectual property rights of any other person which results from our use of your specification. Where Products other than our standard products are supplied by us to your specification, the Products may vary in accordance with normal trade tolerances from dimensions specified by you in the Order and you shall not be entitled to make any claim against us in respect of any such variations. 4. CANCELLATION POLICY All products are made by Timberform are specifically for your order. Because of this, no order which has been accepted by us may be cancelled by you except with our written agreement and on terms that you shall indemnify us in full against all loss (including loss of profit), costs (including the cost of all labour and material used), damages, charges and expenses incurred by us as a result of cancellation. Our order cancellation policy is as follows; If the goods are not procured/manufactured cancellation will be charged at 0% of the ex VAT order value If raw materials for the goods have been procured, but the goods have not been manufactured cancellation will be charged at 40% of the ex VAT order value If the goods have been manufactured but not yet dispatched cancellation will be charged at 75% of the ex VAT order value If the goods have been dispatched cancellation will be charged at 90% of the ex VAT order value Order amendments will be assessed/charged on a case by case basis. 5. CONSUMER RIGHTS We only contract with educational, residential, charitable and business organisations and, accordingly, the Consumer Protection (Distance Selling) Regulations 2000 do not apply to any Contract made under these terms and conditions 6. AVAILABILITY AND DELIVERY We shall use our reasonable endeavours to meet any date agreed for delivery. In any event time of delivery shall not be of the essence and we shall not be liable for any losses, costs, damages or expenses incurred by you or any third party arising directly or indirectly out of any failure to meet any estimated delivery date. The quoted prices are based on the assumption that easy access will be provided for our vehicles (which are 8’ wide) to within 25 metres of the area in which the equipment is to be installed. If this is not the case, we reserve the right to levy additional charges. When ground conditions are soft, whilst we take care to ensure that the minimum damage is caused, we are not responsible for any reinstatement unless otherwise specified. It is the customer’s responsibility to ensure no planning consent is required for any equipment or buildings, prior to installation. It is the customer’s sole responsibility to provide us with a site survey plan including a plan of all routes of all pipes, wires, conduits etc on the customer’s property. If the customer fails to provide the plans, we will not be liable for any loss or damage perceived to have arisen as a result of our actions. The customer agrees to indemnify us against any claims made against us. If, having agreed an installation start date, our operatives are unable to commence work on the agreed day due to the site not being prepared as specified, poor or inadequate access for machinery, delays caused by other trades or delays outside of our responsibility, we reserve the right to levy a wasted day charge of £350 per installation team per day. Except where indicated, our prices include for delivery and installation on the UK mainland for all orders with an ex VAT value of over £2000. Pieces of equipment that require non-standard in-ground fixing may also carry an additional charge. In the case of Scotland, South West of England and Wales, a delivery surcharge may be levied. Delivery on items under the value of £2000 ex VAT will be charged at 15% of the ex VAT order value (minimum charge £15). Installation will be charged on a case by case basis. 7. RISK AND TITLE Goods supplied by the company to the purchaser shall remain the

sole and absolute property of the company as legal and equitable owner until such time as the purchaser shall have paid the full price of the goods set in the invoice. The company reserves the right to enter any of the purchaser’s premises for the purposes of searching for, examining, marking or removing any goods which have been supplied by the company but which have not been paid for. Where digging in of play equipment is required and, whilst we take care to ensure that minimum damage is caused, we are not responsible for any reinstatement unless otherwise specified. 8. PRICE AND PAYMENT The price of any Products will be as quoted to you from time to time, except in cases of obvious error. These prices exclude VAT and delivery costs, which will be added to the total amount due and shown on our order acknowledgement. Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you an Order Acknowledgement. PAYMENT TERMS - CREDIT ACCOUNT HOLDERS Deposits paid are non-refundable. Payment terms are strictly 30 days from date of invoice unless otherwise specified on your Order Acknowledgement. For Residential orders, the balance is payable on the installation day. Orders placed through any third party contractors will require full payment prior to installation. You should allow 7 days for normal banking and postal delays when making payment. Timberform reserves the right to charge interest on all overdue balances on credit accounts at a rate of 4% above RBS plc base rate, accruing daily. In the event that the account is passed to a third party for collection of outstanding balances, Timberform will claim reimbursement of all costs incurred in that collection from you. PAYMENT TERMS – NON CREDIT ACCOUNTS Unless you have an account with us, payment must be received in full 2 weeks prior to the despatch of goods. We will send you a Pro-Forma invoice, or alternatively payment may be made by credit or debit card. In the case of credit card or debit card or purchasing card transactions, you will pay the Price of the Goods or Services by such cards at the time of placing the Order and Timberform shall be entitled to recover the Price. No Order will be fulfilled until the full payment amount has been authorised by the appropriate credit, debit or purchasing card service provider. 9. OUR REFUNDS AND REFUNDS POLICY When you wish to return a Product to us (for instance, because you have mistakenly ordered the wrong specification, or because you claim that the Product is defective), you must call our Customer Service team on 01246 454484 to request a Product Returns Request form. Once completed, we will organise the collection of the products concerned. We will examine the returned Product and will notify you of any refund via e-mail within a reasonable period of time. Products ordered in error or which you no longer require must be reported within 7 days of delivery and must be unused. We will process the refund due to you as soon as possible. Products returned by you because of a defect will be either replaced or refunded in full, including a refund of the delivery charges for sending the item to you. In the case of Products returned by you because you have ordered them in error or because you no longer require them we will refund only the price of the Product excluding delivery charges and after applying a restocking charge of 90% of the value of the Product and carriage plus VAT. We will usually refund any money received from you using the same method originally used by you to pay for your purchase. 10. OUR LIABILITY AND GUARANTEE The Timber elements of our products carry a 10-year guarantee against timber rot and decay, all other none timber elements are subject to guarantee variation, please contact us for clarification. Our products also carry a one-year guarantee against faulty materials and workmanship. Faulty workmanship must be reported within 10 working days. The guarantee period is from delivery or such other period as may be set out in the Order Acknowledgement PROVIDED THAT: (i) notice in writing of the defects complained of shall be given to us as soon as they appear; and (ii) such defects shall be found to our reasonable satisfaction to have arisen solely from our faulty design, workmanship or materials. Please note that timber will continue to adapt to atmospheric conditions and it is perfectly natural that some structural variation, cracks, shakes and knots do naturally occur. These do not affect the structural strength of the timber and are not, therefore, covered under the terms of this warranty. Damage due to vandalism, abuse, Acts of God, severe weather conditions, abnormal usage and unauthorized third parties is also not warranted. This warranty will be made null and void if the proper maintenance schedules have not been adhered to. Timberform’s recommended maintenance schedule will be dispatched to the customer after installation. Our Gazova canopies carry a 5-year guarantee as long as the proper maintenance schedules have been adhered to. For the avoidance of doubt, defects will not be regarded as having arisen solely from our faulty design, workmanship or materials in any of the following circumstances: (a) where such defects arise from any drawing, design or specification supplied by you; or (b) where such defects arise from fair wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow our maintenance instructions (whether oral or in writing), misuse or alteration or repair of the Products without our approval. Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the Product you purchased. This does not include or limit in any way our liability: (a) For death or personal injury caused by our negligence; (b) Under section 2(3) of the Consumer Protection Act 1987; (c) For fraud or fraudulent misrepresentation; or (d) For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability. We are not responsible for any indirect losses which happen as a side effect of the main loss or damage 11. EVENTS OUTSIDE OUR CONTROL We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event).

12. WAIVER If we fail, at any time during the term of a Contract, to insist upon strict performance of any of your obligations under the Contract or any of these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under the Contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations. A waiver by us of any default shall not constitute a waiver of any subsequent default. No waiver by us of any of these terms and conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing. 13. TRANSFER OF RIGHTS AND OBLIGATIONS The contract between you and us is binding on you and us and on our respective successors and assigns. You may not transfer, assign, charge or otherwise dispose of a Contract, or any of your rights or obligations arising under it, without our prior written consent. We may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract. 14. SEVERABILITY If any of these Terms and Conditions or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law. 15. ENTIRE AGREEMENT These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of any Contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing. 16. OUR RIGHT TO VARY THESE TERMS AND CONDITIONS Timberform reserves the right to amend the Terms & Conditions at any time without notice. 17. LAW AND JURISDICTION Contracts for the purchase of Products through our site will be governed by English law. Any dispute arising from, or related to, such Contracts shall be subject to the non-exclusive jurisdiction of the courts of England and Wales. Safety Surfacing TERMS AND CONDITIONS 1. It is the customer’s responsibility to ensure adequate Safety Surfacing is provided and the correct free space is available for the equipment. 2. Safety Surfacing products carry the following guarantees: Lawnmat – 3 years; Wetpour – 3 years with appropriate sub base and edge details as outlined in our technical detail sheet (contact us for a copy); Soft Mulch – 3 years. Normal wear and tear, vandalism, Acts of God and damage caused by activities outside the uses for which the surfacing is intended are excluded from the terms of the guarantee. 3. We do not guarantee the performance of our surfacing when laid onto existing Safety Surfacing, slabs, flagstones, or other hard areas not approved by us. Every effort will be made to create a seamless finish on completed surfaces. However, this may not be possible on areas of 100m2 or more or if installation work is broken by adverse weather conditions. 4. Installation is subject to satisfactory weather conditions. 5. Quoted prices are based on the assumption that easy access will be provided for our vehicles (which are 8’ wide) to within 20 meters of the area to be surfaced. If this is not the case, we reserve the right to levy additional charges. 6. When ground conditions are soft, whilst we take care to ensure that the minimum damage is caused, we are not responsible for any reinstatement unless otherwise specified. 7. If applicable, existing manholes/access points will be overlaid with surfacing as standard practice. Any other requirements to accommodate these will be subject to an additional charge, please contact us for prices. 8. Where installation has been quoted, the price assumes good access and digging in a grassed area but should difficulties be encountered, for example hardcore, tarmac, concrete, cables etc in our excavations, we reserve the right to adjust our costings accordingly. 9. It is the customer’s responsibility to ensure good drainage to any site. We cannot be held responsible for any loss or damage caused by any drainage issues, furthermore any additional labour, materials or waiting time costs incurred by Timberline will be charged to the customer accordingly. 10. Where Safety Surfacing is involved we require 72 hours notice in the event of a change in scheduling for our works and reserve the right to charge an aborted site visit charge of £850. 11. Safety Surfacing is intended for the use of fixed outdoor playground equipment only. If you are unsure please contact us. 12. We will not guarantee the adhesion of wetpour surfacing to any other edges apart from Pre-Cast Concrete edges. This includes (but is not limited to) the following; Timber Edges, Cut and Chase Edging Detail, Aluminium Edges, Steel Edges, Block Paver Edges, Plastic Edges. 13. All sub-bases must fall within the parameters specified in our technical data sheet. Any additional costs such as waiting time, additional labour and materials shall be charged for accordingly. All edgings previously installed by others by others must meet Timberforms specification. 14. Wetpour colours are subject to ultra violet light degradation and ultra violet light discolouration and as such total colour stability cannot be guaranteed. 15.
