leading analyst of the Valley’s housing market said the latest home sale data shows the market is cooling at an “astonishing and widespread” rate. The Cromford Report last week observed that “buyers’ disadvantage in negotiations has dropped dramatically.” “This is because there is much less competition from other buyers,” it noted. “Many of these have dropped out due to the eye-popping increase in mortgage rates. There are also many more homes

to choose from compared with a couple of months ago. A big reason for the Cromford Report’s observations is its market index, which bases short-term forecasts of how balanced the market is in 17 Valley municipalities by analyzing the trends in pending, active and sold listings compared with historical data over the previous four years. Values below 100 indicate a buyer’s market, while values above 100 indicate a seller’s market. A value of 100 indicates a balanced market.

It noted that outside of active-adult communities like Sun Lakes and Sun City West, “the decline in CMI values is still accelerating” with double-digit declines in the high 20-percent range. “The largest declines over the past month have been seen in Avondale, Gilbert, Queen Creek, Cave Creek and Chandler,” it said. “The smallest declines can be found in Paradise Valley and Fountain Hills but even here the fall is a massive -21%.” Only 7 cities are still over 300, it noted last week – more than half of the 15 that were over that threshold a month ago. Phoenix was listed as only a few tenths of a percent above that 300 threshold. It was above 350 the previous week. Still, the lowest index marker was 166, in Buckeye, so the market still remains titled toward sellers, it noted. The Cromford Report said “cash buyers remain active, but these are a much smaller

This is now starting to appear as sellers gradually lose confidence. “Some sellers will be in denial for many months yet, and will risk over-pricing their home in current market conditions,” it said. “Others will be more reactive and make sure their asking pricing is competitive.”
It also produced data suggesting the average per-square-foot price “has not managed to break through $365 and is now showing signs of retreating below $360. The maximum was $364.81 achieved on April 27. This is probably going to be the top.” At the same time, the Cromford Report said “closed prices are still blissfully unaware of the change in market conditions. The sale price per square foot remains higher (at around $305) than the list price (around $300).” “The remarkable speed of the change in the market is reflected in the fact that the Cromford Market Index has dropped over 100 points in the last month,” it added. And it warned, “The Greater Phoenix market continues to provide plenty of reasons to be worried. Another domino is wobbling and looks like it might be getting ready to fall – the listing success rate.” “At the moment we are just under 90%, a very strong number. However, if we look at the last five weeks, a clear weakening trend has started.” It gave a chilling reminder of the precrash market in 2005, when “a similar trend developed between June and July.” “By the end of 2005 we were down to just 63% - meaning that 1 in 3 homes listed failed to sell. We cannot say this will happen in 2022,” it said. Cromford Report also said a similar downward trend started last summer “but frenetic buying by investors, particularly large investors, pulled the nose of the air-

New law affects real estate investors, wholesalers BY PATRICK MACQUEEN AFN Guest Writer

f you are a real estate investor or real estate wholesaler, there are new laws that will affect you. Gov. Doug Ducey has signed HB 2747 into law and this new law places disclosure requirements on buyers that enter into residential real estate contracts and then assign the contracts to someone else. In short, HB 2747 applies to real estate wholesalers. Under a typical wholesaling transaction, the real estate wholesaler contracts with a home seller and, thereafter, shops that home around to potential buyers. The
wholesaler then assigns the existing real estate contract to one of the buyers. Under this scenario, the wholesaler makes money on the assignment of the contract and never intends to own the home. Pursuant to the new law, a “Wholesale Buyer” must “disclose in writing to the seller that the buyer is a wholesale buyer.” Similarly, a “Wholesale Seller,” which is ultimately the same party as the wholesale buyer, must “disclose in writing to the buyer that the seller is a wholesale seller that holds an equitable interest in the real property and that the wholesale seller may not be able to convey title to the property.” If a “Wholesale Buyer” fails to make the disclosures required by HB 2747, “the seller may cancel the contract for sale at
any time prior to the close of escrow without penalty and may retain any earnest money paid by the Wholesale Buyer.” In other words, the seller may cancel the purchase contract and retain the earnest money. Notably, if the transaction closes with a contract that does not have HB 2747’s disclosure language, the seller cannot later come back and unwind such a transaction. If a “Wholesale Seller” fails to make the disclosures required by HB 2747, “the buyer may cancel the contract for sale at any time prior to the close of escrow without penalty and shall be refunded all earnest money paid by the buyer.” This allows the assignee or end buyer to terminate the assignment and receive

On average, the number of homes sold fell to 545,706, a decline of 13.2% from the prior year. A recent poll from Gallup found that only 30% of Americans believe now is a good time to buy a house. Housing costs — which can take up a third of a family’s take-home pay for a middle-income household — have increased by 5.1% in the past year, the fastest annual pace since 1991, while rents are up 4.8% from a year ago, according to the Labor Department. Another speed bump for employers, if not for housing markets where people
fled during the pandemic: There is a reluctance to return to the office among many employees. A group that calls themselves “Apple Together” signed an open letter to the company, claiming 1,400 signatures from workers. “We are not asking for everyone to be forced to work from home,” they wrote. “We are asking to decide for ourselves, together with our teams and direct manager, what kind of arrangement works best for each one of us, be that in an office, work from home, or a hybrid approach. Stop treating us like school kids who need to be told when to be where and what homework to do.” Apple did not immediately respond to request for comment. The latest NBER research details the relationship between remote work and house prices. “Using variation in remote work exposure across U.S. metropolitan areas we estimate that an additional percentage

emote work has played a big part in the rise in house prices in the U.S. during the first two years of the pandemic. John Mondragon, an economist at the Federal Reserve Bank of San Francisco and Johannes Wieland, an associate professor from the Department of Economics at the University of California, San Diego, published a paper recently with a bold conclusion: The shift to remote work explains over half of the 23.8% national house price increase between 2019 and November 2021. Our results imply a fundamentals-based explanation for the recent increases in housing costs over speculation or financial factors, and that the evolution of remote work is likely to have large effects on the future path of house prices and inflation,” they write in a paper distributed last month by the National Bureau of Eco-

This does not look as likely in 2022.” “2006 was a full-scale bubble burst,” it said. “People now talk of the 2008 crash, but that was only when Wall Street woke up and entered a full-on panic. The real estate market was in dire straits as early
as the middle of 2006 and 2007 was truly dreadful. “The problem that we faced in 2006 was compounded by all the foreclosures that piled up in 2007. This was largely because so many homeowners had little or no equity in 2006 so by 2007 they had negative equity and no reason to avoid foreclosure. At the moment, we have a more positive situation with a much
higher percentage of homeowners having significant equity. “They should be motivated to protect rather than abandon that equity,” it continued. “That gives us a reason to be less worried, but extreme vigilance is the order of the day. Those who refinanced and took a little too much cash out over the last two years are more exposed than most. Our primary leading indicator is telling that us

This can re-age the account, and if you fall behind again, it will stay on your credit report for another seven years. Lower your credit utilization ratio. Your credit utilization ratio refers to how much you owe compared with the amount of available credit you have. For example, if you have a $10,000 credit limit across all your credit cards and you have balances totaling $9,000, you’ve utilized 90% of your credit. This drags down your score. Scores are updated on an ongoing basis, and creditors typically report once per month, so if you make a payment that lowers your credit utilization, that should be reflected on your score within two months. If you’re regularly using your credit card but you want to keep your utilization low so you can apply for a mortgage, you may
tential lenders, at least that they can see on your credit report. If that’s the case, you may need to open a credit account, such as a credit card, and make payments on it regularly. Try to get a card with no annual fee, if possible. Don’t overspend or use this as an excuse to take out loans you don’t need. Deal with delinquent accounts. If you have bad credit, bringing delinquent accounts current and settling accounts that are in collections can also boost your score fairly quickly. Once the creditor or collection agency reports your account update, you should see a positive bump in your score. Keep in mind, though, that your late payment history will remain on your credit report for seven years. If you have bad accounts that have been on your report

Rate increases can impact new-build mortgages AFN NEWS SERVICES

ou can’t close on a new-construction home—or move into the property—until the home receives a certificate of occupancy. This certificate is a permit that states the construction company safely built the house according to the standards set by local government officials. Yet, with the current double whammy of a construction worker shortage and supply chain issues, many of today’s newconstruction home buyers face building delays that could extend beyond your 30to 45-day rate lock. And your interest rate could expire before the home’s finished. So how does that break down financially? Let’s say you’re buying a $300,000 home with a 20% down payment. If your rate went up 0.5% between your offer and closing, you’d shell out an additional $25,920 over the life of the loan. If you’re facing construction delays and your rate lock is approaching its final days, you might want to consider an extension

to lock in your rate with current market terms. Unfortunately, extensions aren’t usually free. You’re paying more upfront to hold on to your lower interest rate. The options vary depending on the lender you choose, but typically the fee to extend the rate lock is 0.45% of the loan amount, says Polack. So if the loan is $300,000, then a 30-day extension would cost $1,350. A 90-day extension would set you back $4,050. “Some lenders have more flexibility in extending your rate, but others are more rigid,” said Adam Fuller, a senior loan officer at Mortgage 1 in Grand Rapids, MI. “If your lock expires and you’re not with the right lender, you may find yourself bringing more funds to closing—or paying more for your monthly mortgage payment.” Fuller advises asking the following questions when you interview prospective lenders: • What happens when the mortgage rate lock expires? • Is there an option to renew the lock?
•
Is it possible to extend the lock for no charge? • Are there fees to extend the rate lock? • How long can I extend the lock? • What happens if my house is now complete and rates are now lower? • Is it possible to secure a reduced interest rate? Once you’ve talked to at least three lenders about how you can protect yourself with a rate lock extension (or possibly secure a lower rate), you’ll be able to choose the one that offers you the most flexibility.
