Editor’s Letter Airpark Still Soaring

A

bout 15 years ago, my wife and I first set foot in the Valley and liked it so much we made it a planned vacation destination every other year. Upon our return visits we noticed the significant commercial growth in North Scottsdale in and around the Airpark. It often didn’t even look like the same place between trips. I wondered, “What makes such a vibrant economic engine hum here?” Of course, I knew one of the obvious answers because eventually I followed the lead of many a corporate exec who shunned the wicked winters of the Midwest and the East Coast, opting for the warmth and all that it brings, like a round of golf, a hike or walk around in shorts in February. For many of our Airpark neighbors, it’s more than just warm weather providing us with a sunny disposition. For this month’s issue, we paid a visit to a few companies that call the Airpark home for some other unique reasons. Alcor Life Extension Foundation, for instance, moved its headquarters from California to the Airpark because it needed an earthquake-free area for its facilities. It’s important that their cryopreservation canisters stay grounded. A Taser exec shared his love for the surrounding scenery of the McDowell Mountains and the convenience of an airport in the back yard. Speaking of, Geometric Technologies welcomes visitors from all around the world, so it too enjoys the many amenities provided by Scottsdale Airport. If that doesn’t wet your whistle, check out my feature on the Edson Student Entrepreneur Initiative, which if you’re unfamiliar, is the start of something big in Scottsdale. Among other things, the program offers ASU students with innovative ideas the opportunity to get their projects evaluated by accomplished private sector executives and even placed in front of some qualified venture capitalists. What a great way to keep up the economic vitality of our great city. Yes, even in the dead of summer, we certainly enjoy a bit of paradise here. The entertainment venue Livewire, has released a mobile app, which can be downloaded for free through the App Store or Google Play. “The app will be a great way for our concertgoers to connect with us and keep track of upcoming shows they plan to attend,” says Les Corieri, owner of Livewire. “It has a lot of valuable information on the venue and our shows, all in one place.” The user-friendly mobile app allows concertgoers to learn about upcoming events at Livewire, purchase tickets and access Livewire’s social media accounts. Caliber Buys Hotel Near Sky Harbor

An affiliate of a private equity fund managed by Scottsdale-based Caliber Companies has acquired the Holiday Inn Hotel & Suites Phoenix Airport North property. The 44th and McDowell Hotel Group, an affiliate of the Caliber Distressed Real Estate Income Fund, recently announced the acquisition of the four-story, 228-room hotel. The hotel is the Caliber’s third hospitality acquisition in three years. Caliber

Scottsdale Resort Begins $9 Million Renovation

The Scottsdale Resort & Conference Center, A Destination Hotel, is undergoing a $9 million renovation this summer that will transform the independent resort and, according to hotel officials, “revitalize its amenities.” On Sept. 8, the property will be unveiled as The Scottsdale Resort at McCormick Ranch, A Destination Hotel. The renovation’s first phase will introduce a new restaurant and bar, transform the main pool, add significant outdoor meeting and event space and enhance guest rooms. The property is owned by Cornerstone Advisors. The 54 king rooms on site will be completely renovated, 76 of the double-queen rooms will be converted to king rooms and all rooms and suites in the main building will be renovated. Corridors will receive fresh new paint, carpeting and historical artwork to brighten up the appearance of the hallways. The main pool area will be completely remodeled and include

a new full-service restaurant and bar. It will feature 16 new cabanas available for private rental, a shaded trellis in the water and a bridge-like water feature dividing the new larger pool. Home Prices Climb; Inventory Falls

Village at Via Linda Sold

The weather isn’t the only thing that’s hot in Phoenix. For the past few months, the real estate market also is heating up, according to the Scottsdale Area Association of Realtors. The number of homes sold has increased, while those actively listed for sale declined steadily, for the last five months. The heavy demand and low inventory continues to nudge home prices higher. In addition, Realtors are reporting frequent multiple-offer situations, especially on homes under $300,000. SAAR reported

Colliers International recently sold the 35,733-square-foot Village at Via Linda shopping center for $3.75 million as part of a 1031 exchange. Arizona Partners of Phoenix, a real estate developer and investment firm, purchased the center, 8989 East Via Linda, from Village of Via Linda LLC of Los Angeles. Small Wonders Map Released

Local First Arizona recently released the third edition of the Scottsdale Small Wonders map, a pocket-sized guide featuring more than 30 local restaurants, galleries, boutiques, venues and experiences located between Bell Road and Scottsdale Airpark to McDowell Road. Salt River Fields hosting Arizona Taco Festival

The sixth annual Arizona Taco Festival is set to bring another year of fiesta fun with more than 50 teams competing for $10,000 in cash, while an expected 25,000 attendees nosh their way through more than 100 types of tacos from 11 a.m. to 7 p.m. Saturday, Oct. 17, through Sunday, Oct. 18, at Salt River Fields. THE AIRPARK High-flying companies remain partial to an Airpark address

C

ompanies choose to set up headquarters in the Scottsdale Airpark area for plenty of reasons. Prestige, for one. In a city where the hot ZIP code is always changing, the airpark section of North Scottsdale is still a prime location for restaurants, shopping and luxury services. It’s also relatively affordable. Compared with other preferred business locations like Los Angeles, San Francisco, New York and Boston, the combined cost of building lease payments, employee payroll and property taxes runs at least $2 million to $3 million per year less in the Airpark, according to the Scottsdale Chamber of Commerce. But perhaps the company with the best reason for relocating the Airpark area is the Alcor Life Extension Foundation. Founded in the early ‘70s as, originally, a mobile surgical unit for another cryonics organization in the San Francisco Bay area, Alcor has since grown to become the world’s largest provider of cryopreservation services, with more than 1,000 members signed up to be preserved in liquid nitrogen upon their passing with the hope of being revived in the future, when new medical techniques may be developed to cure now fatal diseases or conditions. That future couldn’t be guaranteed,

however, as long as the company operated in earthquake-prone California. So in 1994, Alcor moved from its previous facility in Riverside, a city with a 99.47 percent chance of experiencing a major earthquake over the next 50 years, according to the U.S. Geological Survey, to Scottsdale, where the earthquake risk is only 11 percent. The last time Scottsdale felt any earth move, the USGS says, was in 1974, when a small 2.5 magnitude quake occurred 30 miles away. “California is not an ideal location when you have to care for cryopreservation clients,” says Max More, Alcor’s CEO since 2011 and a member (he’s signed up to have his head neuropreserved) since 1986. “We have to think very long-term. Unlike a lot of companies, we’re going to be storing our patients for many decades, and having big earthquakes nearby is not a good thing. So we spent quite a lot of time searching for a place that’s very stable and that doesn’t have a lot of natural disasters, and we settled on the Scottsdale Airpark. It’s incredibly stable, it doesn’t have earthquakes, it doesn’t have hurricanes, it doesn’t have tornadoes. We have the occasional haboob,” More adds, with a chuckle, “but that’s not really a big deal.”

Alcor also liked the Airpark for its proximity to the Scottsdale Airport, a big plus in a field where time is of the essence. Cryonics patients are placed into cargo containers within minutes of being declared legally dead, then must be delivered quickly to Alcor’s facility to prevent any cell damage should they eventually be revived. “Just as it is with people who are donating organs,” More explains, “it’s critical how much time is involved in getting them here to perform procedures.” It helps that Alcor’s response team can fly in and out of Phoenix Sky Harbor International Airport, which ranks consistently in the top 10 U.S. airports with the lowest number of annual flight delays, More adds. “But for some of our members, if they have the extra money, they can actually get a charter flight directly into the Scottsdale Airport, which is literally minutes up the road from us.”

Of course, being close to the Scottsdale Airport is a benefit for some living bodies as well. “We have offices in 16 different states, so it’s pretty convenient to be able to hop in a plane and run over to an office and come back in the same day,” says Matt …continues on page 20 August 2015 Scottsdale Airpark News | 19

After moving its home base to several locations around central Phoenix—from its original space on 16th Street and Bethany Home Road to its most recent corporate office at 32nd Street and Camelback Road—HomeSmart finally settled in May into its current home just north of Bell Road between Hayden Road and Loop 101. Widdows, who still lives near the company’s previous office near Biltmore Fashion Park, admits he misses the short commute he had before. “I used to have literally a three-minute drive to my office,” he says. “Now I’ve got a 20- to 25-minute commute.” Still, he has a number of reasons to love HomeSmart’s new digs, which practically overlook the Scottsdale Sports Complex and the TPC. “It’s a bunch of things,” he says. “One, I love the area. There are so many shops and vendors that we use up here, and it has real convenient freeway access. Secondly,

the price up here is way better than it was in the Biltmore area. That was a big factor. We were able to get a lot more space for the same amount of money and actually acquire the building. Plus, the Scottsdale

building sits pretty close to the flight path. So I’m giddy all day long watching planes come in and out,” he says, with a laugh. “And my hanger’s over at the Scottsdale Airpark as well, so I can shoot over and be in the plane in five minutes. I just got back today from visiting another of our offices, as a matter of fact.” Not every Airpark business is helmed by jet-setting CEOs who use the nearby airport on a regular basis. “There are a lot of types of businesses where they probably have a select group of wealthy customers who fly into the Scottsdale Airport on private jets for meetings,” says Jim Foster, vice president of channel sales and marketing for Geometric, an international engineering design firm with headquarters in Mumbai, India, that recently acquired the former Machining Training Solutions just off the Greenway-Hayden Loop to handle its CAD/CAM programming work. “We don’t have customers like that.” Still, Geometric’s Scottsdale office gets a lot of international business travelers who arrive at Sky Harbor but stay in North Scottsdale, and Foster says it’s important to have an office close to good restaurants and meeting facilities. “This part of Scottsdale is a really wonderful area,” he says. “We’ll have people come literally from around the world to visit us for business, and when they come here, we know there will always be good food; if we need to rent a facility at a hotel, we know it’ll be first class. Nobody will ever leave feeling like we didn’t have a good environment to support whatever business we needed to do.” Geometric also gets a lot of business clients from Europe, where the old gender roles still come into play. “Sometimes when a guy is coming from Europe, he might bring his wife and, if he does, he knows that she’ll be well-entertained while he’s working,” Foster adds. “For people from certain parts of the world who don’t get to come to America often, that’s important.” For other companies, being located in an area with a large talent pool of software developers and coders, as the Airpark has come to be recognized, is the main draw. “The Scottsdale Airpark area serves an important role in helping HEAT Software achieve its growth objectives,” says Eric Aarrestad, a vice president at the Silicon Valley-based software solutions company that recently merged with IT security provider Lumension and took over its Scottsdale headquarters on East Hartford …continues on page 22

2001, Tuttle says Taser had its choice of locations in which to build its expanded headquarters. “We really could have gone anywhere in the Valley,” he says, “but we loved the access to the Scottsdale Airport, and at that time the 101 was finally completed. So we chose to build a marquee location off the 101 in this showpiece 100,000-square-foot building.” Tuttle says Taser’s management team likes the “high-tech, industrial startup feel” that the Airpark has, and says the company even began running its own fleet of tech buses a few years ahead of Silicon Valley giants like Google, Apple and Facebook to transport its workforce to and from the headquarters. “While many employees work close by the office, there are a lot of production workers who live near north central

Phoenix, so we purchased several large vans to provide transportation,” he says. “We started doing that in 2005, so we beat Silicon Valley to the punch. It just made sense from the get-go—and what a perk.” Taser has plans for continued expansion, but Tuttle says there’s still plenty of room for that just across the street, where those mesquite and palo verde plants quietly stand guard over more untapped business space. “We’re still expanding, and we’re renting space across the street, so the ability to expand easily in the Airpark within walking distance is very helpful. Many of our vendors are close by and if not, getting to our office from either side of the Valley and Sky Harbor is a breeze. If anyone drives by the 101 between Hayden and Princess, they’ll see our building. “It may not be Silicon Valley,” Tuttle adds, waxing lyrically again, “but it sure feels like Startup Valley to us.” 

Gun advocate and entrepreneur Alan Korwin has built a publishing empire based on gun-law books By Curt Blakeney

G

un control is one of the most hotly debated topics in America. With a rise in senseless mass shootings that has gun control advocates in an uproar and gun supporters fiercely clinging to their Second Amendment rights, this debate seemingly has no end in sight. But no matter what side of the fence you’re on when it comes to gun control, no one will argue against better education: Americans becoming more knowledgeable and cognizant of changing gun laws and learning ways to safely and legally handle guns. A Scottsdale businessman, Alan Korwin, is

at the forefront of gun education as book author and publisher. Korwin, a staunch advocate of gun ownership and Washington politicians keeping their noses out of state’s affairs, recently released the 26th edition of his bestselling book, “The Arizona Gun Owner’s Guide.” “It doesn’t make sense to own a gun and not know the rules,” Korwin says. Korwin’s path to publishing gun-law books was paved soon after he moved to Scottsdale in 1984. A New York City native, Korwin worked as a consultant for ITT, American Express and other high-tech firms when he arrived in the Valley. Incidentally, he wrote the origi-

nal business plan that raised $5 million in venture capital and launched the legendary in-flight catalog SkyMall. Surprised to see handguns and ammo being sold at a local supermarket (Smitty’s), he was quickly indoctrinated into Arizona’s controversial gun laws. He became fascinated with gun laws, which became the inspiration and mission for his first book. “The Arizona Gun Owner’s Guide” took more than one year to write. During his arduous trek for the truth, Korwin contacted 20 different federal and state agencies and visited countless law libraries. The book eventually was released in 1989 and sold so well that a second release was issued

Korwin's book highlights Arizona gun laws. less than a year later. “I didn’t know it at the time, but it turned out to be the first book in the country to gather and describe a state’s gun laws,” Korwin says. “No one else had ever published anything like that before. People simply owned guns. That was in 1989. Guns were so taken for granted in America back then it simply wasn’t needed, no one had ever thought to do such a thing. “What did strike me at the time, when I had finished, was that I had become the only person in the state who actually knew what all the gun laws were,” he continues. “No one had spent the full year I just had finding them all, figuring them out, and describing them all in plain English. Of all the so-called experts I had met, some knew a bit of the picture, many had a completely wrong idea, but no one actually knew the whole thing until that point in time.” To coincide with the release of his first book, Korwin also founded Bloomfield Press, his venture into book publishing. By 1992, Korwin’s book was earning more than his consulting work, prompting his wife and business partner, Cheryl, to make a pivotal observation. “Our money is in the books,” she quipped. Korwin also realized it was easier to add books to the company’s lineup than to write them, so he expanded his roster by publishing works from other authors. The product line now exceeds 300 books and DVDs, along with buttons, stickers, package deals and speaking engagements. “There was this pent-up desire in gun owners to know what the laws are,” Korwin says. “They understood that there were risks in gun ownership, legal land mines, but they had no idea what they were or how to find them. ‘The Arizona Gun Owner ’s Guide’ solved that problem and became popular. That’s why I believe the concept ought to be rolled out nationally.” Korwin eventually went on to write or co-write gun-law guides for five states, and unabridged guides to federal gun law and Supreme Court gun jurisprudence, both of which broke new ground because nothing like that had ever been attempted. The sheer size of America’s gun laws had never been tallied, which these books accomplished. “The Arizona Gun Owner ’s Guide” has sold more than 250,000 copies and counting. So what’s next for Korwin,

the author of six books and coauthor of eight others? “Next is the expansion of the company to do what we’ve done locally on an industrial strength scale nationally,” Korwin says enthusiastically. “Mine is basically a cottage business...I’m a writer, working with my wife. What America needs is a full-blown national entity making the complicated gun laws easy to digest, on multiple electronic and paper platforms, from school-based education curricula to constitutional carry basics for the public. Every state should have a clear gun-owner ’s guide, and best practices should circulate fluidly and seamlessly. I think of it as the national rollout of GunLaws.com. T

he commercial real estate market across the United States was at its worst when the recession hit less than a decade ago. Job growth was in decline and many people were sitting on their wallets waiting for the right time to reinvest. The Greater Phoenix Area has come back faster than most, due to higher than normal job growth. This has created what is called a “flight” to quality office space—an upward shift in different classes of office spaces. It remains to be seen if this trend continues, but one thing is for sure— businesses are moving on up in the local market, especially Scottsdale. …continues on page 30 August 2015 Scottsdale Airpark News | 29

across the Greater Phoenix Area. The office search engine, 42Floors, collected data on this market, and noticed some interesting trends. The price of office space is growing much faster in some parts of Phoenix than in others. Moreover, in the midst of this boom, some classes of office space are actually becoming less desirable, and thus less expensive. In Phoenix, we’re seeing a “flight” to quality office space which is resulting in a booming Scottsdale commercial real estate market.

Recession Rebound

By most metrics, the Greater Phoenix Area has rebounded from the latest recession. Four years ago, the unemployment rate in Phoenix peaked at 12 percent; by the end of 2014, it had fallen to 5.8 percent. In Scottsdale, where economic growth has been especially strong, the unemployment rate is just 4.4 percent. And with this growth, the city’s commercial real estate market has experienced an upswing. According to Colliers of Greater Phoenix’s recent market report, this creation of jobs is “directly driving ten-

ant demand for office space,” and has resulted in an office space price surge

A Tale of Two Cities

At the beginning of 2012, office space vacancy rates in the Phoenix metropolitan area and Scottsdale were nearly identical (about 22.5 percent). Today, thanks to the improving economy, vacancy rates in Phoenix have fallen to 18.8 percent— and in Scottsdale, these rates have fallen to 14.7 percent: See Chart A. In Scottsdale specifically, the low supply of vacant office space means that tenants need to pay top dollar for commercial real estate. While Scottsdale has traditionally been more expensive than the rest of the market, the city’s rent prices have increased at a much faster rate than the rest of Phoenix in the last two years: See Chart B. Pete O’Neil, research manager at Colliers International, said that explains why the Scottsdale commercial market in particular is surging so strongly. “In Scottsdale, especially (South) Scottsdale, we’ve seen it become a hotspot for businesses to relocate in the Valley,” O’Neil says. “Scottsdale has tremendous amenities, bars and restaurants, it’s really well located in the city. Businesses coming into town have said this is a great live work play for their employees, so that has driven demand.” But there is another important reason Scottsdale is leading the Phoenix commercial real estate market: During periods of economic growth, businesses upgrade their offices, and the nicest “Class A” buildings are predominantly in Scottsdale. Tenants are trading up— and that means moving to Scottsdale.

Like all commercial real estate, Scottsdale office space is grouped into three categories by the Building Owners and Managers Association (BOMA): Class A, Class B and Class C. Different types of units are all faring differently in the Scottsdale market.


Class A units are typically large trophy buildings that offer more amenities than other buildings. According to BOMA, these units “have high quality standard finishes, state-of-the-art systems, exceptional accessibility and a definite market presence.” Consequently, they also come with the highest rent prices. On the other end of the spectrum, Class C buildings are smaller and cheaper spaces (i.e., converted warehouses or buildings that are only a few stories tall). BOMA classifies these structures as “functional spaces at rents below the average for the area.” Often, they are 20 years or older, are situated in less desired locations, and in need of renova-

tion work—and because of these traits, usually take the longest time to lease. In Scottsdale, the office space market is experiencing a rapid “flight to quality.” This is reflected in 42Floors’ data: At the beginning of 2013, Class C (or the most affordable) spaces were in the highest demand, and nearly a quarter of Class A office space was empty. Today, Class A buildings are the most highly demanded spaces in the city. Since the economy has recovered, many companies have upgraded to better office spaces in Scottsdale, resulting in falling vacancy rates for the city’s topof-the-line Class A buildings. Scottsdale Airpark makes up nearly 50 percent of the total built office space in Scottsdale, and holds almost 60 percent of all of the A Class office buildings. Vacancy has steadily decreased over the last three years to a low of 16.84 percent, while rents have jumped $2.32 per square foot since 2012. Aviation bulletins advise that “the project may involve changes in aircraft flight paths and altitudes in certain areas, but will not result in any ground disturbance or increase the number of aircraft operations at any of the listed airports.” Phoenix is one of 21 areas around the country where the FAA is implementing or wanting to initiate its Metroplex program. A public notice from the Department of Transportation, FAA, advised, “Current navigation technology (Area Navigation or RNAV) and conventional procedures intended to provide an orderly flow of traffic in and out of a busy metropolitan area are not fully optimized due to existing airspace configuration. RNAVbased procedures can direct pilots along more direct routes with predictable location and altitude information” minimizing communication between pilots and air traffic controllers and enhancing efficient use of airspace. requested that the FAA conduct community outreach in preparation for the study. In March, the public was notified via an ad in the Arizona Republic that sought public comment on items like the impact of new flight paths implemented in the fall of 2014. Nine Arizona airport directors submitted formal requests to be a part of the project, according to Marina Landis of the FAA’s Western Service Area. Scottsdale Airport Aviation Director Gary Mascaro submitted comments to the FAA in late April indicating a desire to be involved in the process. In part, his letter read: “As a significant stakeholder in this project, the City of Scottsdale formally asks for ‘a seat at the table’ to actively participate in the design process and to represent the needs of our residents and airport.” Mascaro specifically referred to public input or “public scoping” and said it should be done in a way to obtain meaningful input tailored to the complexity of the situation. “Heightened sensitivity to air traffic changes in the Phoenix area since September 2014 has increased residents’ desire to engage in the process that will determine the future flight path locations in their community,” he wrote. Those flight path changes to and from Phoenix Sky Harbor International Airport that Mascaro referenced caused a lot of public outcry to the point it led to thousands of noise complaints from area residents and had Phoenix Mayor Greg Stanton threatening to sue the FAA for “having no intent to solve the problem or work with the city to find a solution.” In response, the FAA asked for the city to be more involved in a collaborative effort. It didn’t work out that way. On June 1, the City of Phoenix sued the FAA over those 2014 flight path changes. “For decades, we have struck the right balance between operating an urban airport and protecting the quality of life of our residents,” says Phoenix Mayor Greg Stanton. “The FAA upset that balance when they changed departure routes at Sky Harbor. Despite numerous attempts to resolve this, the FAA has not proposed any meaningful changes—we were left with no choice but to sue.” The lawsuit was placed on the U.S. Court of Appeals docket. A decision could take anywhere between 12 and 24 months. Beyond the tort action, Phoenix City


Councilman Michael Nowakowski has promised to “actively pursue collaboration with other cities affected in similar ways due to the FAA’s RNAV changes.” Mascaro was asked if citizen noise complaints had increased at his facility that already has a voluntary noise abatement curfew from 10 p.m. to 6 a.m.: “A couple of months ago, we did see an increase in noise complaints, but as we evaluated them more closely, we discovered a lot of them were not Scottsdale airport traffic, per se, but Sky Harbor traffic. We directed that uptick of concerns back to Phoenix.” Less than a week after the lawsuit was filed, Rep. Ruben Gallego (D-Phoenix) sponsored legislation adding to the Federal Transportation, Housing and Urban Development appropriations bill that could put a halt to the Phoenix Metroplex regional airspace redesign. “It’s a straightforward amendment ensuring the FAA does not proceed with the airspace design around Sky Harbor until issues (like) noise impact from last year ’s flight path changes are resolved in local neighborhoods,” Gallego said.

At nearby Scottsdale Airport, Mascaro said his mission is: “To represent the city as a whole, not just the airport, to make sure three things happen—the FAA hears our voice, we get a seat at the table, and we continue watching to make sure our interests are protected. Mascaro said the FAA was conducting an internal evaluation of design changes with its technical team and he expected information in draft form next spring. “Because the City of Phoenix lawsuit has been filed and our attorneys are evaluating Scottsdale’s position to this point, I can’t discuss the ongoing situation any further except to say that we have no attachment whatsoever to the COP lawsuit,” Mascaro said. “We continue to be in discussion with the FAA in regard to any tweaks that could occur over City of Scottsdale boundaries, so a good way to describe things is to say the attorney button has been pushed and they’re in ready mode if needed. “We want the FAA to know that we’re watching them and want to be partners with them.” 

Scottsdale Leadership Alumni Makes Big Impact on Community By Margaret Leichtfuss, Executive Director Scottsdale Leadership

T

ed Taylor said he believes that his participation as a member of Scottsdale Leadership’s Class 26 was the catalyst for the dramatic growth and change over the last five years at Family Promise of Greater Phoenix, a Scottsdale nonprofit focusing on homeless families. Taylor serves as executive director of the nonprofit and says, “I am a believer in Scottsdale Leadership’s power to change the lives of those who participate in the program who, then in turn, impact our community by their involvement. I am living proof of that.” Originally a business entrepreneur and turnaround professional, Taylor built a successful career turning around businesses for profit. “What few people know is that I wasn’t a joyful businessman. In fact, I was continuously conflicted over a skill for business which was completely separate from a desire to serve my fellow man,” he said. Five years ago his pastor approached him about serving on Family Promise’s board of directors. He had no experience in human crisis or nonprofit management. The organization had struggled to make ends meet, and it was serving about 30 families per year in 2010. The then newly acquired facility, a rundown eight-plex, served three to four families at a time with three staff members. When Taylor was approached to serve as its executive director, he asked the board to reject his application for the position if they were unwilling to grow. They embraced the challenge and his innovation-focused approach to impacting social change for these homeless families. “The short story is that within four years we had tripled the number of families served, over tripled revenue, and nearly tripled the number of interfaith congregations we partnered with to provide free food and lodging to our families without expanding the facility one square inch,” Taylor says. “Candidly, I believe the bulk of our suc-

cess was via blessings. The first blessing was an invitation by a Scottsdale Leadership alum, who is one of our board members, to apply for Scottsdale Leadership.” The connections Taylor made as a Scottsdale Leadership class participant introduced him to the Human Services team at the City, who passionately embraced Family Promise’s unique approach to rescuing homeless families. As a result, Family Promise was awarded with an $80,000 grant to modify its rundown facility to make a second day center—effectively doubling its capacity. The City planning department also helped them modify the organization’s conditional use permit from 20 people served onsite to 50, another blessing, he says. At that time, Family Promise was the only homeless family shelter expanding to serve the growing waiting list of families who were homeless in the Valley. “My Scottsdale Leadership connections and knowledge derived from the Core Program helped our board connect with companies, congregations and individuals who sought to serve those less fortunate. We experienced explosive growth, the ability to completely pay off all our debt, and serve over 350 families in the subsequent three years,” Taylor says. In the spring of 2012, an executive from PetSmart’s national office called Family Promise after hearing about Cardboard City, a Scottsdale event that raises awareness about the plight of homeless families and raises funds for Family Promise. “PetSmart wanted to work with Family Promise,” Taylor says. “Six months later, we opened the first ever onsite pet sanctuary in a homeless shelter to welcome pets with these homeless families.” Today, that program has been duplicated by 182 Family Promise organizations across the nation, thanks to a multimillion dollar grant from PetSmart. This provides

a solution for capturing those homeless families with pets who consistently refuse shelter if their pets cannot come with them to the shelter. “My team understood that children are the ones most harmed by homelessness, and to give up a pet at that time could literally be the last shred of hope for these kids,” Taylor says. “Last year, over a third of our families had pets.” As a member of Scottsdale Leadership’s class 26, Taylor learned about Scottsdale from the inside out—its infrastructure, civic entities and community initiatives. He also became a better steward of the Scottsdale community and the Valley at large. “Frankly, I fell in love with this city, my classmates, and the network of alumni who passionately desire to make a difference for Scottsdale, the Valley and those less fortunate in our community… It helped me discover my passion in life and become a stronger and more knowledgeable person. The Web is celebrating its 25th anniversary, having profoundly impacted Scottsdale, the world and each of us. To put Scottsdale in August 1990 into its pre-World Wide Web context, the population was 130,075 and Herb Drinkwater was mayor. Groundbreaking for the Loop 101 Pima Freeway took place Aug. 22. Although the Scottsdale Airpark was an important employment center, more than 50 percent of its land area was yet to be developed. An upscale shopping mall, The Galleria, was under construction in downtown Scottsdale. Two big issues vexed residents and tourism officials: the lack of an MLK holiday and potential development in and around Scottsdale’s signature landmark, the McDowell Mountains. Iraq had just invaded Kuwait, and Operation Desert Shield was sending U.S. troops to the Middle East. We were still in awe over the crumbing of the Berlin Wall and the disassembling of the Soviet Union. With these issues top of mind, little did we know how the new “Web” would

Compare those numbers to a Google search on July 10, 2015, which brought up approximately 84.6 million listings in a mere 0.49 seconds! In the mid-1990s, the Scottsdale Public Library gave patrons the ability to search its catalog online via the Pegasus system. In 2006, the library began digitizing its collection of Scottsdale’s historical images and making them available, along with City documents, oral histories and other electronic resources, on the library’s website (www.scottsdalelibrary.org) and the Arizona Memory Project website. The Convention and Tourism Division of the Scottsdale Chamber of Commerce began marketing Scottsdale to visitors on the Web in 1996 via www.arizonaguide.com/scottsdale, joining other tourism organizations throughout the state. Several years later, the now-independent Scottsdale Convention & Visitors Bureau created its own website, www.experiencescottsdale.com. In 1996, Scottsdale Healthcare (now HonorHealth) became one of the Valley’s first not-for-profit healthcare providers to launch an Internet Web site. In 2000, Scottsdale Healthcare was named one of America’s “Top 100 Most Wired Hospitals and Health Systems” by Hospitals and Health Networks magazine. In July 1997, the Scottsdale Chamber of Commerce put itself and its entire membership on the Web at www.scottsdalechamber.com. In 1996-98 DC Ranch became Scottsdale’s first “wired” community, with an intranet for residents and other electronic amenities, such as a health concierge linked to Scottsdale Healthcare. In the mid-1990s one of the most popular classes offered at CompUSA on 90th Street south of Shea was how to create a Web page using FrontPage or Adobe PageMaker software. The Scottsdale Public Library began offering Introduction

The Scottsdale Airpark-based company changed its name to GoDaddy in 1999. Today, according to www. godaddy.com, GoDaddy “serves more than 13 million customers worldwide...has more than 59 million domain names under management...provides website creation, hosting and design, ecommerce for small business, security and domains.” In September 1999, Scottsdale and the entire East Valley changed telephone area codes from 602 to 480, recognizing the burgeoning use of the Internet/Web and related telecommunications by business and residents. At the start of the new millennium, we were using many new terms, coined to describe website functions/ environment: URL, cyberspace, netiquette, virtual, virusprotection, QR (Quick Response) codes, digital addicts, streaming, etail, eZine, page views and webcam. Department launched its online One Stop Shop on the City’s website in 2000, offering 24/7 data access for residents and businesses. The following year, residents were offered the opportunity to pay city water/sewer/garbage bills online. In 2001, the city began offering a weekly online newsletter for residents and businesses, City Update. The City of Scottsdale was the recipient of Best of Category–Medium-Sized Cities for participation in a Civic Resource Group research project entitled “Cities on the Internet: E-Government Applied” in 2001. The long-vacant Galleria shopping center reopened in November 2001 as the Galleria Corporate Centre. By 2004, there were 16 businesses and organizations operating from the repurposed shopping center. In 2010, the online search-andrecommend site Yelp! opened a division in the Galleria; in 2014, website development company Weebly opened its North American customer service operational headquarters there. From its “brick and mortar” location at the Galleria, the Scottsdale CVB, via its website, blogs, tweets, Facebook page and other electronic media, promotes Scottsdale as a visitor and meeting destination to a global audience. In 2004, CityCable 11 streamed video

over the City’s website of Scottsdale City Council meetings. The City of Scottsdale began offering wireless network service (Wi-Fi) through select websites in the downtown Scottsdale area in 2006. In 2006, social networking sites were beginning to captivate us. By 2008, we were friending on Facebook, networking on Linked In, promoting on YouTube, tweeting and blogging. SkySong—the ASU Scottsdale Center for Innovation built at the site of the former Los Arcos Mall—completed its first building in 2007 and began accepting tenants in 2008. It became an incubator of numerous high-tech, Internet/Web-based startup businesses. With the Jan. 9, 2007, introduction of the Apple iPhone, access to the Web increased monumentally—and in the palm of one’s hand. The era of smartphone applications, or apps, launched many Scottsdale-area businesses. The Scottsdale Police Department began posting road closure, crime and safety alerts on Twitter.com in 2008. In a compromise between environmental/aesthetic concerns and the need for additional cellphone towers in northern Scottsdale to handle the explosion in mobile phone and wireless technology use, faux saguaros, containing wireless antennae, were installed circa 2010 along Happy Valley Road and other locations.

In May 2015, the district’s Scottsdale Online Learning high school graduated 39 students. When ASU announced availability of a free Massive Open Online Course “Media LIT: Overcoming Information Overload” in summer 2015, thousands around the world enrolled. In 2012, the American Library Association Office for Information Technology Policy and the Library Information Technology Association announced that the Scottsdale Public Library was one of four libraries nationally to be recognized for providing cutting-edge technologies for customers. The specific technology highlighted was the library’s “Gimme!” book recommendation tool found on its website. In 2013, Google named Scottsdale an eCity, an honor that recognized the strongest online business community in each state. According to the City of Scottsdale’s announcement, Google said, “The busi-

nesses in these communities are embracing the Web to find new customers, connect with existing clients and fuel their local economies. Scottsdale joins the ranks of America’s leading cities in the digital economy.” In winter 2014, the Center for Digital Government honored Scottsdale as a top 10 tech-savvy city for using technology to eliminate waste, enhance service levels, improve transparency and engage with citizens in the digital world. In 25 years, the World Wide Web has shifted our lifestyles, connecting Scottsdale to the world and to each other in cyberspace. Although virtual/online businesses have led to the closing of many local brick-and-mortar stores, the Web also has facilitated making international business connections from smartphones at coffee shops. Attorneys offer cyber estate planning and intellectual property protection. Hobbyists, downsizers and entrepreneurs sell directly to customers via eBay, Amazon and other websites. Scottsdale nonprofits fundraise via secure websites

or third parties like PayPal. Businesses like Uber and AirBnB are changing the tourism and transportation landscape here and around the world. Most job searches and applications now occur online. We find long-lost relatives and classmates on the Web or Web derivatives like Facebook. Authors self-publish and sell their books online. We bank, day-trade stocks, even get medical advice via the Web. Accessing streaming media on the Web, we can see newborns and attend memorial services, literally making the Web ‘cradle to grave.’ In addition to the Web—coincidentally—two other 1990 innovations previously mentioned have significantly impacted Scottsdale’s history: completion of the Loop 101 Pima Freeway and the creation of the McDowell Sonoran Preserve. S

tudents don’t have to wait to earn their degrees to begin working on their entrepreneurial dreams. Funded by a $5.4 million endowment, ASU’s Edson Student Entrepreneur Initiative guides students who have great business ideas and innovations to pursue them and start a successful business. Once these teams are accepted into the Edson program, ASU gives the teams tools to advance and develop their venture. Before they enter the program, they must compete with other applicants, and they’ll get a good local dose of “Shark Tank”-type love from mentors and judges on their ideas. The mentors, entrepreneurs who have already been out in the cut-throat world

of business, will help the student entrepreneurs refocus business plans and presentations. Now entering its 10th year, Edson has supported more than 260 student teams and over 1,000 students. In the past three years, Edson teams have raised more than $2 million, filed over 30 patents and hired more than 150 employees. The program was developed at the SkySong campus in Scottsdale under ASU’s Office of Student Entrepreneurship and Innovation. ASU students, faculty and mentors from all disciplines and walks of life work to identify local and global needs and proceed forward to create solutions. Applicants must follow eight design principles: generate awareness, create access, advance ideas, engage multiple perspectives, promote professionalism, invest in the future, commit to progress and impact the world. The program was created through an endowment by Orin Edson, who ran a successful boat company and wanted to support the students not just with the entrepreneurial idea, but their academics as well, according to Dr. Garret Westlake, associate dean of ASU’s Office of Student Entrepreneurship & Innovation. The program accepts 20 teams, which begins in the fall. That pool was chosen from 472 applicants, Westlake says.

hese days, tequila is far removed from its old reputation of a cringe-inducing shot. The process of making fine-aged tequila is just as involved as a fine wine or cognac, and the flavors are just as complex. The former Chauncey Ranch, with its sleek Arabian horses, has given way to sleek rides of another fashion. At Schumacher and its neighboring dealerships along Chauncey Lane, in an exquisite blend of artistry and technology, science and sophistication, gleaming Mercedes-Benz sedans, Rolls-Royces,

Today, son Michael is general sales manager for new vehicles, and son Chris is general sales manager for pre-owned vehicles. With General Manager Kevin Steele, they oversee an operation with 165 fulltime and 10 part-time employees. Steele has been with the company 22 years. Like the Schumachers, Steele has a long history in the motor trade. Steele’s father was a Volkswagen dealer, and Kevin followed him as a VW dealer in the Midwest. The Steeles moved here in 1986, and he worked with Jaguar, Range Rover and Mercedes-Benz dealerships before joining the Schumachers. Last March Schumacher celebrated its 30th anniversary in North Scottsdale. The company was encouraged to move to North Scottsdale in 1985 by thenmayor Herb Drinkwater, Steele says. “From 1985 until 10 years ago we were located on Hayden Road. In March 2005, on our 20th anniversary, we moved to our current location in Chauncey Ranch.”

It was a natural fit—just across the street, Penske Automotive was selling luxury brands. It would be a one-stop experience for customers and windowshoppers who were looking for highend vehicles. “This location made all the sense in the world,” Steele adds. “We’re right off the freeway here. More than 80,000 vehicles a day pass by our location, and there are close to 250,000 cars a day that go past here on the 101.” Mercedes-Benz is the company’s main brand. “In addition to sales, we service about 18,000 Mercedes from all over the United States,” Steele says. “A good share of winter visitors will have their cars trucked here and many drive here. Many others will buy cars here as well. We’ve done business with people who live in all 50 states.” In addition to Mercedes-Benz, Schumacher is the exclusive AMG Performance Center in Arizona. AMG is the high-performance division of Mercedes-Benz. The company also is one of the nation’s largest dealers for the Mercedes-Benz Sprinter commer-

cial van and for Airstream RVs built on the Sprinter chassis. Some Thoughts on Owning Rental Properties By Rod Dennis

O

wning a portfolio of investment properties can be a powerful way to diversify an investment portfolio. Real estate secured by financing creates an opportunity to invest with leverage, further enhancing the opportunities for growth. Real estate is also a good hedge against inflation, as the value of real estate tends to track inflation rates over time. While the value of the home is increasing, the loan balance also declines. And, the payments are being subsidized, or paid entirely by the rent from the tenant. Rents will continue to rise with inflation as well, while the loan payment remains the same creating a further positive cash flow. Buy a good home with three bedrooms or more. Many tenants share rent with roommates. With more bedrooms, the overall rent cost can come down per bedroom, making the property more desirable. Some experts suggest limiting your search to properties near your home so you can visit the property on occasion and respond quickly in case of emergencies. Consider landlord laws for the city in which the property is located. If the neighborhood is managed by a homeowner’s association they may have additional restrictions. Some condo projects, for instance, cap the number of units that can be rented at any given time while areas have restrictions that limit the length of a lease, not allowing weekly or even monthly rentals. Have some reserves. While a property is likely to cash-flow with rent exceeding the mortgage payment, it is important to have adequate reserves to meet possible vacancy, maintenance cost as well as the unforeseen expenses that will likely arise. Consider the possibilities and manage the financial risk accordingly. Holding rentals properties in LLCs is the key to protecting your personal assets. If properly structured and always kept separate and a lawsuit occurs, the LLC will be the defendant and not you. Form a separate LLC to own and manage each property individually. You must sign a deed conveying the real estate to the LLC and record the deed. An attorney can help with this simple process.

Advertise, negotiate and lease the property from the LLC to the tenant, never in your individual name. Write the lease, take deposits and checks only in the name of the LLC and make deposits and payments only through the LLC established bank account. Have the homeowner’s insurance policy reflect the LLC as an insured as well. Buy landlord endorsements to cover the additional risks. The cost is fairly insignificant. This is the first line of defense is something goes wrong. Always have your potential tenant complete a very detailed application that shows the addresses they have lived in for the last several years, and follow up with the prior landlords to see if things rented as agreed. Have the tenant go to www.annualcreditreport.com and obtain their free credit report and supply it to you. Study it for current delinquencies, judgments and other possible derogatory situations. If there is a lot of late payments or collections, plan for problems in collecting the rent. Be prepared to act fast if delinquency occurs. Arizona has a relatively quick eviction process. Starting the process will let the tenant know you mean business and will typically get the rent paid. Check in on the property frequently. Write into the lease the ability for you as the landlord to inspect the property with proper notice. If close, perhaps just schedule to change the A/C filters for them on a scheduled basis. It will increase the life of the A/C, while providing the ability to casually inspect the home. Select a professionally prepared lease form. Make sure it has provisions for nonrefundable and refundable deposits for cleaning, pets, landscaping or other areas of concern. For tenants with animals, rent to them knowing they will cause some deterioration

to the property in some way and plan for it. Have your tax return completed by a professional. As a single-owner, single-asset LLC, a separate tax return is not likely to be needed. Make sure to have the tax professional explain the advantages of being a real estate professional and consider how it may further improve the return on your investment. Don’t price the rent too high. Vacancy is very costly, not only the loss of revenue, but also the added expenses of maintenance and utilities. Price it to minimize vacancy. Take the great tenant with a lower rent as opposed to the high rent with the questionable tenant. Plan to hold the property over the long run to help subsidize retirement. Consider buying a home that you may want to downsize into in the future. SAN: How is business going relative to last year? Mark: We’re experiencing growth. So far 2015 is up, versus 2014. SAN: What plans for growth can you share that might give insight into other things happening in your industry? Jeremy: We are implementing organic growth by adding new products and services. An example of this is our social listening product. By using proprietary software and a social psychologist to analyze the use of language and sorted categories, we are able to provide deeper insights into the consumers who are making comments online. We are also planning to expand market research, as it is critical to marketing to consumers and the development of advertising concepts. For example, we can pretest advertising and packaging concepts for our clients so that they can select the most marketing-effective ideas, messages and images; thus saving time and money. SAN: Are you planning to do any hiring in the next six months? Mark: Yes. SAN: How do you find it best to recruit new team members in this age of technology? Mark: We prefer recruiting through network contacts. We also enjoy train-

ing interns from ASU in our methodology of market research. SAN: How optimistic are you about the economy getting better in the next year? Jeremy: We have a mixed view of the economy. We have noticed a consistent pattern of caution regarding spending among our clients. SAN: What is one thing about your business you believe other businesspeople in the Airpark would be surprised to know? Mark: Our research has shown that brands have “personalities” and that many consumers project their “ideal selves” into brand selection. We developed proprietary psychometric software that provides clients with deeper, richer insights into why consumers behave the way they do. It also matches consumers to brands, which we call “Marketing Matchmaking.” For example, we helped a snack food client quadruple their new product revenue in just two years.

SAN: Who is a role model in business whom you look up to? Mark: I deeply admire Bill Bernbach, legendary copywriter and founder of Doyle, Dane, Bernbach advertising agency. Jeremy: During college I listened to a motivational speaker named Earl Nightingale. He is a radio personality and a well-respected writer. He wrote mostly about the subject of human character development and excellence. He once said, “We can let circumstances rule us, or we can take charge and rule our lives from within.” SAN: What are your business goals over the next 12 months? Mark: We are always looking for new and differentiated services that we can provide our clients to meet their needs. Our primary mission over the next 12 months is to continue delivering outstanding market research insights that improve our clients’ successes while increasing their marketing ROI. 

SAN: What are some of the challenges faced by your industry and how is your company working to overcome them? Jeremy: One is big data. Our goal is to use our experience, training, structure and discipline to guide our clients to the most focused and useful data.

Do Your Investments Have These? The 8 key features of the ideal investment

T

hink about all the things you’ve ever owned that made you money. Real estate, stocks, bonds, cash value life insurance, annuities, mutual funds, 401(k) plans, IRAs, CDs, savings accounts, commodities, options, collectibles, gold, REITs, even managed futures. Why did you buy them? Undoubtedly to make money, perhaps subject to a lot of risk—but to profit, not to lose. What were the characteristics of these investments that attracted you to them—their benefits, perks and advantages? Let’s cherry-pick the best attributes of each and compile a list of the characteristics of the ideal investment. We’ve polled our seminar attendees with this exercise for years. Here are their typical answers:

High Yield Potential.

Everybody wants growth, although the older we get, the more conservative we tend to become. Risk-based investments are great when they succeed, yet they’re the cause of many a sleepless night when they don’t. Still, everyone regardless of age should have some money in the stock market, assuming their investment time horizon is long enough, or the funds aren’t critical to their retirement.

Safety/Stability/Guarantees.

What else do we find in the stock market or real estate that’s not so good? Their answer is either “risk” or “volatility.” So what’s the opposite of those? We all love the safety of CDs; we just wish they were a little higher yielding these days.

Tax Advantages.

To whom do at least 53 percent of us write a check every year in mid-April? Ah, yes, our beloved IRS. In a perfect world, our ideal investment comes with some tax advantages. There’s tax-free, tax-exempt, tax-deferred, etc. What if you could make use of the IRS’ money, alongside of your money, as if it was your money, making you

By Thomas K. Brueckner money within such an account? Better yet, what if you could do so far beyond the age of 70 1/2, when most IRA accounts have to begin their taxable payouts?

Reallocation.

Here’s a philosophical question for you: What are the three certainties of life? While we sometimes have fun with this one, the obvious answer is death, taxes and change. Things don’t always stay the same and change is constant. Smart investors know that there are opportunities as well as risk amid such change, and that being able to adjust one’s allocation to various asset classes (e.g., small-cap growth vs. large-cap value) is critical.

Modest Liquidity.

We have two needs in retirement: income for the current year, and growth without loss for future years. Legendary investor Benjamin Graham described a good investment as one which “upon thorough analysis, promises safety of principal and a satisfactory return,” from which income was sufficient to last the rest of one’s life. Guaranteeing that income would have made Graham very happy.

Diversification.

Putting all your eggs in one basket is never wise. Having linkage to multiple asset classes is the only way to have some parts growing, even when others may be temporarily out of favor.

Probate Avoidance.

Anyone who has ever had to probate a parent’s estate knows that the process can be grueling, expensive and public—and should be avoided whenever possible. IRAs, annuities and life insurance proceeds avoid probate and go directly to the named ben-

eficiaries on the account. Anything else must be placed inside a trust in order to have the same protections, privacy, low expense and brevity of process.

Simplicity.

As we age, do we prefer complexity or simplicity? I have been asking this question of our seminar audiences for years, and while it always gets a knowing chuckle, there’s a serious issue we can’t laugh off. Most marriages have a portfolio manager, the person who tracks the couple’s investments, rebalances the portfolio, buys and sells options and organizes the consequences. The other spouse is disinterested, incapable or happy to let their partner handle it. Question: What happens when that portfolio manager spouse has a medical event— like a stroke—and can’t remember his or her own name a week later? What does the less-involved spouse inherit? A mess. Two months of family care-giver training later, they open the next quarterly investment statement, turn to page 19 of 31, see a large loss and have no idea what to do. Wouldn’t this spouse much prefer to have had the other’s assistance in picking the right adviser for just such times? And so our final encouragement: In addition to all of the characteristics listed above, consider simplifying your holdings together, instead of one being left to do it alone.  Thomas K. Commercial Real Estate and You: Due Diligence By Stephen A. Cross, CCIM

M

aking informed real estate decisions involves identifying properties, conducting negotiations and confirming things...lots of things. This month’s column highlights some “things” prudent people should “do” before leasing or purchasing commercial real estate.

When Leasing

Purposeful sleuthing: Learn as much as possible about vacancies, asking rates and the urgency of various landlords. And don’t be shy about simultaneously negotiating on multiple properties—make landlords compete for your revenue stream. Concessions equals savings: Typical concessions include, but are not limited to, lower rates, free rent, warranties and tenant improvements.

Size matters: The size of a space, including any load factor, directly affects the rent and a tenant’s pro-rata share of the operating costs, so make certain the leasable area and the size of the building are referenced in the contract. Without the square footages set forth in the agreement the tenant will have difficulty challenging charges related to size.

When Purchasing

As-is, where-is: Pay particular attention to the age and condition of the roof, parking lot, HVAC systems and the plumbing, lighting and electrical systems. In addition, confirm that all structures were properly permitted and built to code, and that the building’s advertised size does not include temporary structures, overhangs, canopies or awnings. On investment property, also verify the net operating income (NOI), expenses, the terms of all leases and solvency of each ten-

ant. Promises of upside potential are generally puffery and should be disregarded. Remember, once the contract has been signed and money changes hands, it’s too late for any “do-overs.” While proper investigations can be time-consuming, and may come with a cost, they are preferable to relying on unsubstantiated claims, agents with undisclosed conflicts of interest and possible misinformation. Same-Sex Marriages: The potential impact on borrowers and lenders

enders are always concerned with issues that may prevent their expeditious and successful collection of loans. On the other side, borrowers are concerned with what happens to them if they are unable to repay a loan and how to avoid losing everything. These issues are not as straightforward as one might imagine and are continually in flux as new laws and court decisions change the landscape. The U.S. Supreme Court recently held that states cannot deny the right to marry to same-sex couples and must recognize same-sex marriages that were validly performed elsewhere. Obergefell v. Hodges, 576 U.S. (2015). This decision is likely to have a ripple effect in the interpretation of hundreds of Arizona laws. Arizona is one of nine states that treats most assets acquired during a marriage as “community property,” with each spouse owning one-half. Assets owned before marriage and inherited assets are generally considered separate property, unless commingled with other funds. Arizona has exemption laws intended to protect certain assets from the reach of creditors. Among these exemptions and the potential effect of the recent ruling are the following:

A. Homestead or Residential Property:

Under Arizona law, debtors may exempt up to $150,000 (per debtor or married couple) of the equity in their home or other property covered by the homestead exemption. Under the statute only one homestead exemption may be held by a married couple or a single person. Thus, unmarried persons, which might have previously included same-sex married couples whose marriage wasn’t recognized in Arizona, had the ability to protect $300,000 of equity. Those marriages should now be recognized with the result that the homestead of the married couple is limited to the $150,000.

The airport was build as a basic flight training facility in the early 1940s. The first business jets landed there in 1967. Last year the airport experienced more than 152,500 takeoffs and landings, making it one of the busiest corporate jet facilities in the country. Ferrara said airport officials appreciated that the FAA and Arizona Department of Transportation were funding 95 percent of the project. The remainder will be picked up by the Airport Project Center. 

F. Cash Surrender Value in Life Insurance:

Cash surrender value of life insurance policies, subject to term of ownership requirements and, among other exceptions, that names as beneficiary the debtor ’s surviving spouse, child, parent, brother or sister. It may also apply to other named beneficiaries who are family members and are dependents. This statutory exemption might now apply not only to allow protection of cash surrender value that names the same-sex spouse but may expand the scope to include that spouse’s family members who are dependents of the debtor, such as children by a prior marriage. Under Arizona law both spouses must sign a guaranty in order to bind the community property. If only one spouse signs the guaranty, only that spouse’s sole and separate property is

available to a creditor. In October 2014 Arizona’s ban on same-sex marriages was found unconstitutional in the case of Connolly v. Jeanes. In light of the Connolly and Obergefell cases, lenders need the signatures of both same-sex spouses on guaranties in order to bind their community property. The retroactive effect on lenders who only had one of the spouses sign a guaranty when their marriage wasn’t recognized previously under Arizona law should prove to be an interesting issue.  Dean M.
