No criminal charges filed in Thacher sexual abuse scandal
Authorities said another reason they were prevented from filing any charges was that in August 2020, Thacher officials made the decision to hire a private law firm to conduct an investigation into historical sexual abuse before reporting the allegations to police. The investigation by Munger, Tolles and Olson (MTO) was prompted by reports received by the school of sexual assault, abuse and rape, including statements made on several Instagram accounts in the summer of 2020.
The decision to circumvent law enforcement and publically release the 91-page report in June 2021 hampered investigators, who “routinely seek to obtain incriminating statements from suspects in the course of their sexual assault investigations,” according to the news release from the sheriff and the DA.
“When suspects are alerted to potential crimes in a public report before law enforcement involvement, the likelihood of gathering statements from those suspects to corroborate or negate allegations becomes exceedingly difficult,” the news release stated. “Suspects decline to be interviewed or refer inquiries to retained lawyers. In other instances, they take steps to avoid law enforcement notification and contact altogether, knowing that they have been publicly identified. These scenarios occurred in the course of the Thacher investigation.”
School apologizes in July 2021 letter
Neither Thacher officials nor attorneys from MTO responded to interview requests by the Ventura County Reporter regarding the news release by law enforcement officials. But in a July 2021 message addressed to the campus community, the school’s board of trustees did pledge full cooperation with authorities in the future. The letter also included an apology for failing to identify predatory grooming behavior, report incidents to police, promptly intervene when abuse was occurring, or support students and alumni who came forward.
“These failures were a betrayal of our most fundamental values,” the message from 2021 stated. “We again apologize to those who were subjected to sexual misconduct while in Thacher’s care — you were badly let down, and we will carry both our deep regret and gratitude for your courage with us always.”
The letter detailed steps being taken to prevent abuse such as establishing a board committee on student safety and wellbeing, banning any perpetrators of sexual misconduct identified in the MTO report from campus and stripping the names of former administrators from a campus dining hall and hiking trail.

Ventura County prosecutors have announced that no criminal charges will be filed following an extensive investigation into the sexual abuse of students and failure to report it by teachers and administrators at private boarding school Thacher School near Ojai.
An investigation by the Ventura County Sheriff’s Department and the Ventura County District Attorney’s Office identified more than 100 potential criminal cases from as far back as the 1960s, according to a Dec. 28, 2022 joint news release from both law enforcement agencies.
Three cases were submitted by sheriff’s investigators to the DA’s office for prosecution. According to authorities, however, those alleged crimes happened so long ago that the statute of limitations had expired. In the other potential cases, too much time had passed, no crime could be proven beyond a reasonable doubt, or the victims declined to seek prosecution.
While there were no criminal charges filed against any adults as a result of the investigation, detectives said they did learn of a 2021 on-campus incident between two students that resulted in a juvenile court prosecution and was described by investigators as involving false imprisonment and battery, but not a sex crime.
Former student sues school over sexual abuse by counselor
Even though no former teachers or administrators will be facing criminal charges, proceedings involving at least two civil cases are moving through the courts. In November Paul Mones, a Los Angeles lawyer who specializes in sexual abuse cases, held a news conference detailing a lawsuit filed in Ventura County Superior Court on behalf of a former student who said she was sexually abused in the 1990s by John Friborg, her teacher, college counselor and soccer coach.
The report by MTO said Friborg’s misconduct involved several students and alumni lasting for multiple years and “ranged from grooming to giving students massages to sex-

ual touching.” Friborg also made “unwanted sexual advances” towards former students at five-year reunions.
The lawsuit filed on Nov. 15 seeks damages for sexual assault, intentional infliction of emotional distress and violation of mandatory duty to report suspected child abuse.
The woman who sued Thacher School and numerous individuals asked reporters to use her name, Jennifer Christiansen Vurno, instead of referring to her as Jane Doe, because she doesn’t want victims of sex crimes to be silenced any longer. She said at the news conference that her sexual assaults were “compounded by the silence and inaction of the school.”
Vurno, now 44, said she looked to Friborg for guidance during a difficult time in her life and trusted him completely. “He took this trust and belief and used it against me as a tool to perpetrate the most heinous crimes of sexual violence against my 17-year-old self.”
Investigators from MTO contacted Friborg to arrange an interview for the report they prepared for the school. Friborg declined to talk to the investigators and provided an emailed statement instead.
“I was rightfully fired for my transgression,” Friborg wrote to the investigators. “I have felt deep shame and regret ever since and I have tried to rebuild and live my life with all the righteousness, purity and humility my prayers can find in my effort for redemption.”
Sheriff’s Sgt. Ryan Clark led the department’s investigation into the sexual abuse allegations at Thacher School and told the Ventura County Reporter that investigators did the best job they could to seek justice for the victims
“What’s unique about that investigation is, we were kind of behind the eight ball on being able to jump in and start working it right away, and that creates a lot of difficulties for us,” explained Clark. “So we were able to overcome that after a period of time and get things somewhat back on track for those folks who were willing to speak with us and who answered the phone calls and emails that we sent out attempting to contact them. And for those cases that we investigated, we tried to go through our best practices to get those things handled.”
Clark said it was disappointing to see the investigation conclude with no criminal charges, and realizes many of the victims will be unhappy to hear about that result.
“None of us walk away with any sort of satisfied feeling about, you know, justice being served, because a lot of these perpetrators are not going to be criminally charged. And so I share in their frustration on that end result but, again, because of the delay in time with these reports coming forward and some of the challenges we faced in getting the investigations on track. You know, it’s an understandable conclusion, not a preferred one,” he said.
Clark also hopes to improve the relationship between the school and law enforcement to prevent future abuse and make sure investigations happen quickly when appropriate.
“To streamline the process of reporting and working with the sheriff’s office to hopefully avoid any future issues with delayed reports or things being kind of not apparent to law enforcement,” he said. “So we’ll be working with them and meeting with them in the next couple of months to kind of build that collaboration, whereas before, it wasn’t as solid.”
Prompt reporting key
In an interview with the Ventura County Reporter, Senior Deputy District Attorney Brent Nibecker said he understands the frustration some people might feel since no criminal charges were filed by his office
“Particularly the brave victims and survivors at Thacher, who came forward to report their abuse either to MTO or to law enforcement or in some cases to both. To those individuals, I would just say our inability to bring charges should not be seen as endorsing what happened over the years at Thacher,” Nibecker said. “What was clear is that numerous children were victimized and that some adults who were entrusted with the care of those children violated that trust, while other adults failed to protect those children from others.”
Nibecker also hopes the case sends a message about the need to report sex abuse crimes right away.
“The primary takeaway that we would like to send to schools and other institutions that are entrusted with the protection and care of children is really the need to make a prompt report to law enforcement upon learning even a suspicion that child abuse, particularly child sexual abuse, is occurring,” Nibecker said. “Making a prompt report allows us to get adequate resources to those children to support them and to adult victims if they’re now adults. And it also gives us the best chance to conduct a meaningful criminal investigation and deliver criminal justice and criminal accountability to offenders.”

Naval base requires masks indoors
Just as many Ventura County residents were hoping pandemic-related mask mandates were a thing of the past, Naval Base Ventura County shifted course again on Dec. 23. Officials said masks would be required indoors due to a “significant increase in the weekly case rate of COVID-19 across the county,” and cited “mandated instructions referenced in the Consolidated Department of Defense Coronavirus Disease 2019 Force Health Protection Guidance which requires masks indoors when the community level is at ‘high’ per CDC guidance.”
NBVC officials said they would continue to monitor the weekly community levels as reported by the CDC and adjust mask requirements when community levels drop below “high.”
Post office to be named after Hatcher
On Dec. 27, President Joe Biden signed legislation to honor a local champion of civil rights and equality by naming a U.S. Post Office branch in his honor. The building at 1961 North C Street in Oxnard will be officially designated as the “John R. Hatcher III Post Office Building.” (“Fearless Advocate: Congress passes bill to name Oxnard post office after civil rights leader John R. Hatcher III,” by Alex Wilson, Ventura County Reporter, Aug. 3, 2022.) The bill was sponsored by Congressmember Julia Brownley.
“John was deeply passionate about advancing civil rights and a longtime advocate for the Black community across Ventura County, and this is a fitting tribute to John’s life and legacy,” Brownley said via press release.
Hatcher was an Air Force veteran and son of a civil rights leader in Birmingham, AL during the Jim Crow era. A longtime resident of Oxnard, he led the Ventura County Chapter of the NAACP for nearly four decades. Hatcher passed away in 2017.

A lone cottonwood tree in a grove somewhere along Highway 33 by the Potrero John Trailhead. I purchased a SkyGuider Pro this year in order to start experimenting with shooting the cosmos/ starscapes. I was loving the images of the sky, but, of course, the foreground of my images were muted and blurry, as the SkyGuider is focused on Polaris and moves with the rotation of the Earth. So what I started doing is shooting landscapes at high noon, to get the least amount of shadows and the most amount of light, as well as the ability to shoot at 100 ISO. I would then replace the sky with a starscape, drop the foreground exposure by 5+ stops, and with a 5% brush, gently mask back in the subject and highlights of the photograph. Each photo takes about 20 hours each to develop in Photoshop.

The morning was Feb. 6, 2022. Weather was cold; down in the teens. I had come across an article about an old B-52 bomber located in the Mojave Desert . . . a couple of buddies and I ventured out to see if we could locate the site. We headed out about 3 a.m. on this morning, got to the area and parked about a mile out from the bomber. Chudinova told the Ventura County Reporter that she agreed to take Panchuk’s hand in marriage and set off with him on a global ballet adventure that lasted until he died last month at age 25.

“It was always his dream to try to live in America to see if it fits,” she said. “He was just talking about, ‘I want to go to America. Do you want to go with me?’ And I’m just, ‘Okay, why not?’’’
They were married in Kyiv during September 2019 and arrived in their new country in time to celebrate Halloween, Chudinova recalled. They quickly landed roles dancing with American ballet companies. Panchuk was hired to perform with the State Street Ballet in Santa Barbara prior to the pandemic and garnered glowing reviews for his performances with the company. Montecito Journal reported last March that he won cheers for draping himself in a blue and yellow Ukrainian flag, raising it above his shoulders, and kissing it during a performance as Puss in Boots in Tchaikovsky’s Sleeping Beauty at the Granada Theatre.
With the war in Ukraine escalating this year, Panchuk was conflicted about staying in America to pursue his professional dance career or return to his home country, Chudinova said.
“It was very scary for us,” she explained. “When the war started, he was talking about, ‘I want to go to Ukraine and fight.’ He wanted to protect his country, his family. But then we just decided to stay here because here we can work, we can donate, we can support financially as much as we can.”
Ventura County Ballet hired the couple to perform the lead roles in the annual production of The Nutcracker, which was scheduled for five shows in December at Rancho Campana High School Performing Arts Center in Camarillo.

Chudinova said her husband started feeling sick in August and they went to an emergency room for help, but doctors didn’t find anything wrong with him.
“They did an ultrasound for him and they didn’t see anything. They said, ‘You’re completely healthy. Go home, eat some good food, some salad. Don’t eat burgers and stuff like that.’ And we were just, ‘Okay, we will,’” Chudinova said.

Hanna Chudinova and Zhan Mishel Panchuk fell in love four years ago when they were both 21 and performing with the Kyiv Ballet in their native Ukraine.
Chudinova was 14 when she moved to the Ukrainian capital from her family home in Crimea to study ballet in 2011, three years before the strategic Ukrainian Black Sea peninsula was annexed into Russia. Panchuk grew up in Kyiv, a once-thriving city now so war torn that a shopping mall across the street from his parents’ apartment was destroyed by bombs and missiles.
But before last year’s major escalation of the Russo-Ukrainian War — and just prior to the upheavals to the global artistic community caused by the pandemic — Panchuk already had

A second trip to the ER also left him with inconclusive results, as well as an appointment to see a specialist, but not until months later. After Panchuk got even sicker and went to the ER a third time, he insisted on more tests, his wife said.
“They didn’t want to do anything with him because they said, ‘You’re already for the third time here, and we did all the tests. We can’t find anything,’” she said.
Panchuk, however, continued to demand doctors perform an additional CT scan and they finally agreed. “And then they found a very big tumor,” Chudinova said. “Two days later, we found out that it is really cancer.”
Testicular cancer, in particular.
Despite the fact that the cancer had spread to his colon and back muscles, doctors still gave him a good prognosis. “They said, ‘You’ll be fine,’” Chudinova said. “You’re young, you’re strong. You just need to start your treatment.”
The couple’s confidence was growing now that they knew what was wrong, and they were optimistic that treatment would be successful. They made the decision together that Chudinova would dance in The Nutcracker with a different partner.
“We were very, very sure that he would be fine because doctors told us that. And we were planning to fight this thing. We were planning to get through it,” she said.

Kathleen Noblin, executive director and founder of Ventura County Ballet, told the Ventura County Reporter that she knew Panchuk and Chudinova were special people shortly after they were hired to play the starring roles in The Nutcracker
“He was the kindest, most considerate young man that we’ve ever really had,” Noblin recalled. “He was always considerate of the students, helpful. And Hanna was just the sweetest young woman.”
When Panchuk’s health began to rapidly deteriorate, Noblin said she was shocked to see how much weight he had lost and the color of his skin.
“When he came back to class, I said, ‘You know, Zhan, you’re very, very ill. You need to get some help.’ And then he got this diagnosis and was dead in three weeks. I mean, it was just horrendous,” she said of his passing at the small apartment in Canoga Park the couple shared.
Noblin is no stranger to the medical field. Her husband was a medical doctor who worked in Ventura for many years, and she herself, in addition to running a ballet academy, is also a nurse. She said she was unhappy about the speed of the treatment Panchuk received in his adopted country.
“All of us are very disappointed. I have a bachelor’s degree in nursing, I’m a registered nurse, and I knew there was something very, very wrong with him,” Noblin said. “I wanted him to be treated more aggressively . . . I kept saying, ‘When are they going to start the treatment?’ And she [Chudinova] says, ‘Well, in a few weeks.’ And I said, ‘Oh, he needs to be treated right away. And she said, ‘Well, that’s all they can do. We can’t get our gatekeeper to release us to go to the oncologist.’ You know what the government channels are like.”
BALLET COMMUNITY OFFERS SUPPORT
Jack Stewart, another dancer who had played the lead male role in a past performance of The Nutcracker, was brought in to take over Panchuk’s role as Nutcracker Prince. Noblin said the newlypaired lead performers worked very intensely in the week before the show went on and Chudinova excelled in the role.
“They had to get that timing down because everybody’s different. And, you know, Zhan Mishel was taller than Jack was, you know, so you kind of had to get used to a different kind of partner. But she did a beautiful job,” Noblin said, adding that she was amazed Chudinova could perform at such a high level while dealing with her husband’s diagnosis.
“I just think she’s heroic. You know, I don’t know if I could have done it myself,” Noblin continued. “I lost my husband and so I know the horrible trauma it is. But if I had lost my husband when I was 25 years old, I just can’t imagine. I mean, she’s alone in this country. You know, it’s just heartbreaking.”
Noblin and others with Ventura County Ballet set up a GoFundMe account for Chudinova, which quickly garnered more than $17,000 in donations. “We figured that she needed a helping hand. But I can’t believe how people have opened their hearts. I mean, the money just keeps coming in,” Noblin said.
Chudinova said she’s grateful for the outpouring of love and help from the local ballet community.
“They started to support us before his passing, since everybody knew his diagnosis. Everybody was so supportive and so kind to us,” she said. “After his passing, of course, they did an amazing thing that they collected all this money, and I’m in shock. You know, I didn’t expect that. I knew that they’re supporting us, but I never expected how many people really, really care about us. It breaks my heart and it supports me at the same time.”
Chudinova hopes her husband can be taken back to Ukraine to be laid to rest despite the challenge that will likely pose during wartime. “Because his parents, they didn’t see him for three years. And they really want to see him for the very last time and say their goodbyes.”
She said she will always remember the way her husband moved on the dance floor and the kind person he was. “He dances with his soul. He really felt what he was doing on stage. He was the best person I ever knew in my entire life. And I think he deserves everything that’s happening right now, this support and this love, and I’m so sorry he couldn’t see it.”

Every night before going to sleep, young Jordan Laby would listen to classical music on a small radio beside his bed.
“My mother,” adult Laby recalls, with a smile, “thought that was great, with one exception — my music would keep her awake in the next room. I told her to just turn off the radio once I had fallen asleep.”

And so she did. Eventually, Laby outgrew the bed and the radio, but his love and need for music continued throughout his life. So much so that, after moving to Ventura from the San Fernando Valley in the 1970s, he and his wife, Sandra, became, in a real sense, the godparents of Ventura County’s artistic community.
Today, now in his 90s and six years after Sandra’s passing, Laby remains a principal patron and benefactor of numerous artistic endeavors — music, dance,
theater, art and more — throughout the county. Beneficiaries of the Labys’ support include the Ventura and Ojai Music Festivals, New West Symphony, Rubicon Theatre Company, the Museum of Ventura County, Focus on the Masters, Ventura County Ballet, Ventura College Orchestra, Art City and Camerata Pacifica.
For his decades of contributions to the arts and the community, Jordan Laby will be honored on Jan. 12 at the Ventura Music Festival’s “Celebrate Cabaret” event, to be held at the Ventura Music Hall on Thompson Boulevard, with the Dave Tull Trio performing.
Proceeds from the event will support VMF’s Music in the Schools and New West Symphony’s Laby Harmony Project, both offering opportunities for musical development to hundreds of youth who might otherwise not be able to afford lessons. These projects continue to make a difference in both the artistic and personal growth of those who participate as students and teachers, say program administrators.

“Jordan and his late wife Sandra single handedly put New West Symphony’s Laby Harmony Project on the map, giving access to music for over 160 under-resourced students each year,” says Natalia Staneva, New West Symphony executive director. “Their contributions have helped the entities they support gain more notoriety and diversify the cultural fabric of Ventura County.”
Susan Scott, executive director of VMF (for which the Labys were lead founders in 1994), recalls first meeting the Labys years ago at Bell Arts Factory, and admiring their dedication to supporting the community through the arts.
“Their impact is visible all over the county,” she says. “And Jordan is still giving, still on the Music Festival board, and still a visionary.”
For Laby, that involvement is part of who he is. A product inventor by trade, he and his spouse were involved in “a very active arts community” in the San Fernando Valley when they moved to Ventura.
“We loved our new home, and Ventura is very beautiful,” he says. “But it had very little in terms of opportunities to appreciate the arts locally. We wanted to help change that.”
Change it the Labys have. Virtually every major artistic entity in the county (including those mentioned previously) has been greatly assisted, if not outright launched, by Laby philanthropy, owing to their belief that artistic vitality is essential to the spiritual
health and welfare of the community.
“There are no communities that wouldn’t be improved by bringing the arts forward,” asserts the son of a dentist who was also an accomplished painter. “Exposure to art is part of being educated, and of understanding life. All communities need to be supportive of the arts because there is so much benefit, physically and certainly mentally.”
Laby is pleased that the arts in Ventura have grown over the decades. The Rubicon Theater, he notes, “has played a big role” in bringing the performing arts and live theater to the local community. And he is happy that Laby Harmony Project and Music in the Schools have enabled many underserved youth — who might have otherwise been “left behind” — to experience the benefits of music education: working with others, improving self-discipline and setting higher goals for their future (such as attending college).
Perhaps some of those students have even gone to sleep listening to classical music. If any of them are like Jordan Laby, it bodes well for their future — and that of their community.

Serial rapist expected to be released in four years
A Ventura County serial rapist whose case drew worldwide notoriety might be paroled from state prison earlier than previously anticipated, prosecutors said.
Andrew Luster, 57, was convicted in 2003 of 86 offenses including rape and poisoning for drugging his victims at his Mussel Shoals beach house. He videotaped some of the crimes while the victims were unconscious.
Luster, a purported heir to the Max Factor cosmetics empire, fled the country while his trial was underway but was found guilty in absentia. He was later captured in Mexico by Duane “Dog” Chapman, who then gained fame in the reality TV series Dog the Bounty Hunter
Luster was originally sentenced to 124 years in state prison but prosecutors say the sentence was cut to 50 years in 2013. New sentencing guidelines approved by voters in 2016 under Proposition 57 reclassified Luster’s crimes as “non-violent,” prosecutors said, and allowed him to petition for parole, which was denied on Dec. 21, 2022. But prosecutors said Luster is now scheduled to be released in four years even though they have “vehemently” opposed it.
“As a serial rapist who continues to deny responsibility for his crimes, Andrew Luster continues to present a threat to public safety,” said Senior Deputy District Attorney Anthony Wold, who prosecuted Luster during his trial and participated in the parole hearing. “We strongly believe he should serve his full sentence. His crimes were particularly dangerous, and he has yet to display any regret or remorse for his actions. He remains a dangerous sex predator.”
New mural for Oxnard Transit Center
The Oxnard Transit Center has some spectacular new artwork both inside and outside thanks to coronavirus funding approved by the Oxnard City Council. Artist Maxfield Bala created a 360-degree mural on the second floor mezzanine spanning local history through Chumash times, early agricultural beginnings along with current draws for Oxnard’s tourism industry like beaches and Channel Islands National Park. Bala also painted a 474-squarefoot mural on the outside of the building with a vintage greeting card style.
The project was spearheaded by Visit Oxnard which promotes tourism. “We are so pleased to see this project come to fruition, a direct result of the City’s investment in tourism recovery,” said Julie Mino, Visit Oxnard president and CEO, via press release.
Oxnard Mayor Pro-Tem Bryan MacDonald has worked extensively on transportation issues and said in the press release that the murals will help promote Oxnard to tourists. “The murals both inside and out, pay tribute to the rich heritage of the Chumash people and serve as a message to travelers that Oxnard is a hidden gem on the coastline that has so much to offer to the traveling community.”
Supportive housing facility named for Carmen Ramirez
New facilities slated for formerly unsheltered people in Oxnard will be named after former Ventura County Supervisor Carmen Ramirez, who died last August.
The Oxnard Navigation Center approved at Second and B streets in Downtown Oxnard will combine 56 permanent supportive housing units with one manager unit and a 110-bed, 24-hour emergency shelter in a five-story building.
The supportive housing section of the $46.2 million project will be known as “Casa de Carmen,” in honor of Ramirez.
The facility is currently under development with nonprofit Mercy House, which will manage the property in partnership with the Oxnard City Council and county of Ventura.
Ramirez’s husband, Roy Prince, said in a news release that naming part of the facility after her is a fitting tribute since she was passionate about the project.
“I am grateful for Carmen to be honored by this project that provides affordable housing in Downtown Oxnard,” Prince said. “This is a model for providing our community with pathways out of homelessness, and inspiring innovative housing solutions throughout Ventura County.”

YOU ARE FURTHER ADVISED as follows: At the hearing the Court must choose and implement one of the following permanent plans for the child: adoption, guardianship, or long term foster care. Parental rights may be terminated at this hearing. On 02/08/2023, the Human Services Agency will recommend termination of parental rights. The child may be ordered placed in long term foster care, subject to the regular review of the Juvenile Court; or, a legal guardian may be appointed for the child and letters of guardianship be issued; or, adoption may be identified as the permanent placement goal and the Court may order that efforts be made to locate an appropriate adoptive family for the child for a period not to exceed 180 days and set the matter for further review; or, parental rights may be terminated. You are entitled to be present at the hearing with your attorney. If you cannot afford an attorney, you are entitled to have the Court appoint counsel for you. A thirty-day continuance may be granted if necessary for counsel to prepare the case. At all termination proceedings, the Court shall consider the wishes of the child and shall act in the best interest of the child. Any order of the Court permanently terminating parental rights under this section shall be conclusive
and binding upon the minor person, upon the parent or parents, and upon all other persons who have been served with citation by publication or otherwise. After making such an order, the Court shall have no power to set aside, change, or modify it, but this shall not be construed to limit the rights to appeal the order. If the Court, by order or judgment, declares the child free from the custody and control of both parents, or one parent if the other no longer has custody and control, the Court shall, at the same time, order the child referred to the licensed County adoption agency for adoptive placement by that agency.
