n July 7, the city of Ventura posted information on its Facebook page about the “Free Speech Requirement” for demonstrations on public property in the city. “Individuals throughout the nation, and here locally, have been joining together to have their voices heard through peaceful protests and free speech events. This past Fourth of July there were a number of free speech events held in the City of Ventura. These events did not go through the City’s special event permitting process and were not issued free speech event permits,” stated the post. The post was in reference to protests and demonstrations related to the removal of the St. Junipero Serra Statue and the local Black Lives Matter movement. “Courts have routinely upheld the ability of a government entity to require a permit for any free speech event occurring within a public space so long as the permitting requirements are viewpoint-neutral, serve a government interest, and the permit is issued promptly based on objective criteria,” said Megan Lorenzen, Assistant City Attorney for Ventura, responding via email to the VCReporter. She said the ability of a city to issue permits for these types of events stems from the interest in public safety and the need for “free flow of traffic on roadways and walkways.” “It’s mislabeled,” said Glen Smith, litigation director and attor-

ney with the First Amendment Coalition, a California-based nonprofit organization whose mission is to defend free speech and the public’s right to know about the actions of the government. He said that while the city can require a permit for organized, scheduled events, by calling it a “free speech” permit it is moving into a sticky area. It can of course have a “permit requirement for demonstrations on city property,” but it “can’t be specific for free speech events, and it can’t discriminate based on viewpoints.” He also cautioned the city from basing the granting of any permit on content of the event or the identity of the people who want to demonstrate. Smith also clarified that any person can “set up a soap box” on public property and exercise their freedom of speech, and that it would not be appropriate for the city to attempt to require a permit for that type of action. When the events become “organized,” however, the city does have authority to require a permit. Lorenzen pointed to two chapters in the city’s Municipal Code, Chapters 18.250 and 18.260, that require permits for use of public streets and “other rights of way” and specifically require permits for city facilities and parks. NEWS 2040 General Plan heads to supervisors

n July 16, after an all-day hearing with hours of public input and hundreds of pages of written comments, the Ventura County Planning Commission in a 3-1 vote approved recommendations for the county’s General Plan (GenPlan) and related Environmental Impact Report (EIR) that will now go to the Ventura County Board of Supervisors for final approval scheduled for Sept. 1, 2020. All municipalities in the state are required to have a GenPlan, which governs all land use in that area including resource protection and development. They are updated in full about every 20 years. Ventura County is nearing the end of a four-year process of updating its GenPlan that will be in effect through 2040, with elements related to water, transportation, open space, agriculture and hazards. Extensive input has focused on reducing contributions to climate change. Public comments have either called for strong climate action, or a delay in the process to allow for a proper review of the economic impacts of proposed restrictions on oil and gas operations, especially in light of the ongoing impacts of the pandemic. A comment letter from the city of Moorpark was received stating that the county had not “sufficiently” responded to their previous comments raising con-

cerns about “traffic and noise impacts.” The recommendations include new requirements for oil and gas drilling, including setbacks from homes (1,500 feet) and schools (2,500 feet) and a ban on new natural gas hookups in the county. Restrictions on gas flaring in oil fields have also been recommended, whereby oil well operators would be required to use significant evidence to demonstrate that a pipeline in lieu of flaring gas is infeasible. Natural gas is a by-product of 6—

extracting oil. “The science on setbacks is clear and a minimum of 2,500 feet between homes, schools, sensitive sites and oil wells is needed to protect our most vulnerable communities from toxic emissions,” said Tomás Rebecchi, senior Central Coast organizer for Food and Water Watch. The organization sought to have the 2,500-foot setback expanded to include homes. “We will fight to ensure the Ventura County Board of Supervisors acts boldly to adopt 2,500foot setbacks across the board for oil and gas wells when it goes to a final vote in September.” “While the COVID pandemic has captured our attention for several months, it’s only a precursor to what climate change will inflict on us... We have taken unprecedented steps to deal with COVID, now we should be as bold in our response to climate change,” said Todd Collart of Ventura, speaking in person on July 16. He encouraged the county to “investigate a local oil and gas tax even if it’s opposed by the petroleum industry.” The GenPlan was originally slated to be the county’s Climate Action Plan (CAP), but the EIR demonstrated that the proposed plans and programs fail to meet emission reductions needed for a CAP to be certified. “Our EIR found that our policies and programs do not provide enough greenhouse gas reductions to achieve the emission reduction targets noted in our guiding principle,” clarified Susan Curtis, GenPlan Update manager with the Ventura County Planning Department. Not meeting those targets means that the plan cannot be certified as a Climate Action Plan. “We want Ventura County to be a leader in the state and show how a modern, visionary Climate Action Plan should be written,” stated 350 Ventura County Climate Hub (350 Climate Hub) in a written comment submitted for the July 16 hearing. The organization is made up of Ventura County residents combating climate change, supports the GenPlan mandate for a Climate Emergency Council and suggests it can be tasked with building a CAP that meets all requirements and includes community input. “Much more real, effective community engagement is required, especially including those most impacted. This can be the mandate

to the Climate Emergency Council to develop a Climate Action Plan for climate mitigation with an equal emphasis on a realistic visioning for climate adaptation in a process that ensures full community engagement.” “We request that the county remove policies restricting oil and gas and revise and recirculate the final EIR,” said Ben Oakley with Western States Petroleum Association, an oil and gas lobbying organization. He cited an “inadequate response to public comments” from the county and a “late revision to the final EIR” as reasons the county should delay taking action. He said that the late revision “fundamentally changes the analysis of the role the oil and gas sector plays in meeting the county’s 2030 GHG reduction target,” and that warrants further analysis. The call for more time for public review was echoed by Louise Lampara, executive director of the Ventura County Coalition of Labor, Agriculture and Business (VC CoLAB), citing “notice and due process violation[s]” that she said showed that the commission’s efforts were “actively thwarting public participation.” “The county has not even done a cursory economic impact analysis to figure out how these policies will impact jobs, tax revenue and our cost of living,” said Lampara, responding via email on July 20 to the VCReporter. “Our primary concern needs to be the public health response and economic recovery from the COVID pandemic. We are not in the same world that we were a year ago, when these policies were first proposed.” Ventura County Planning Commissioner Earl McPhail (Dist-3) cast the no vote against the final recommendations, supporting a delay. During final deliberations McPhail, the former Ventura County Agricultural Commissioner, attempted to get the setbacks and natural gas ban removed from the document, but the majority of commissioners did not support that position. Input can be submitted on the General Plan and EIR documents that will be considered by the Board of Supervisors via email to susan.curtis@ventura.org. Supervisors to consider historical protection for Burro Flats On July 28 at 1:30 p.m., the Ventura County Board of Supervisors will consider whether the current boundaries of the Burro Flats area in Simi Valley, which is a protected historical place, should be extended to include the entire Santa Susana Field Lab property and be added to the National Registry of Historical Places. Last month the Ventura County Cultural Heritage Board recommended that the boundaries should be expanded in order to protect over 100 indigenious sites and one object. The recommendation was made over the objection of local residents and some scientists who have been fighting for the area to be properly cleaned up following a partial nuclear meltdown in 1958 and contamination related to rocket fuel testing over the course of the lab being operational. Opponents say the efforts to list the property as a historical place is really an attempt to skirt cleanup requirements. Local indigenous tribes say the historical protection proposal was done at their request. The supervisors are not the final decision makers; they will simply determine what recommendation the county will submit to the state for consideration in the process. More information and documents are online at: vcrma. org/cultural-heritage-boardarchive County going after legacy oil drilling permits On July 30 at 8:30 a.m., the Ventura County Planning Commission will consider proposed revisions to the NonCoastal Zoning Ordinance and Coastal Zoning Ordinance that would constitute a major change in how the county processes requests for new oil and gas drilling on fields governed by decades old permits. The revisions are a result of previous direction from the Board of Supervisors to staff seeking a legislative way to address so-called legacy permits that do not have any limit on the number of wells that can be drilled and have no expiration dates, which allows oil companies to avoid environmental review laws that came into effect after the oil drilling permits were granted. The California Environmental Quality Act (CEQA) mandates that new drilling not previously part of a CEQA review be subject to

Environmental Impact Reviews. The county has come under fire for signing off on new drilling as a ministerial, or proforma rubber stamp, process rather than subjecting these drilling requests to a full discretionary review to which more modern oil drilling permits are subject. Batinica@ventura.org Camarillo Fiesta president pleads guilty to theft Nathaniel Newell Hunnicutt of Camarillo has pleaded guilty to a felony count of grand theft related to him stealing nearly $33,500 from the Camarillo Fiesta Association between February and December 2017, and a second theft of over $12,600 from the proceeds of the Camarillo Fiesta that took place in July 2017. Both thefts occurred while he served as the organization’s president. Hunnicut returned $30,000 of the stolen money before law enforcement was aware of the thefts. If he pays the remaining restitution amount prior to his sentencing hearing set for 9 a.m. on Sept. 3, 2020, in courtroom 23 at Ventura County Superior Court, he will likely serve 180 days in jail and receive formal probation. Based on his charges, Hunnicutt’s maximum possible sentence is three years in jail. Due to the COVID pandemic, it is likely the 2020 youth disconnection rate will spike. The bank manages a paid summer internship program where participants get handson experience in leadership, civic engagement and develop workforce skills. Ariana Torres, a resident of Oxnard who attends Hueneme High School and Nathaniel Yu, a student at Thousand Oaks High School, are participants from Ventura County in the internship program. To adapt to the pandemic, most aspects of the internship are being done virtually and the stipend is $5,000. Torres and Yu will participate in sessions focusing on the role of nonprofit organizations in advancing community health, the importance of public-private partnerships in social change, and aspects of the financial and banking sector. — Kimberly Rivers

An unlikely community Neighbors helping neighbors during the pandemic

What does community look like?

M

erriam-Webster defines community as “a group of people sharing a common interest and relating together socially,” and also as “the feeling of closeness and friendship that exists between companions.” In light of the pandemic, uprisings and protests, and the political bout coming up in November, community and connection seem to have fallen away. But there are pockets of connection. Places where community is thriving and new relationships are being forged. In Ventura, a group of residents organically came together to fill a need and in doing so have become a coalition of volunteers building bonds with those that sometimes fall by the wayside, especially in times of crisis. Those bonds are transforming lives.

At risk on the margins

“Quite frankly, after three months of hiking in, we could learn a lot from them about community and taking care of our neighbors and looking out for each other,” said Karin Muller, 55, of Ventura about those living near the Santa Clara River, a group on the margins. Over the last three months, she has hiked daily into the river bottom community to help those living there during the pandemic. Guessing she has hiked about 500 miles so far, she took a break starting in July, and was able to pass the baton. Rick Nack, a Camarillo resident who works in Ventura, saw the info on social media about what Muller was doing and met her one day at the parking lot to hike in with her. She recalls that he was very quiet that first day, and she was surprised when he said he’d come back the next day. Every Friday Nack picks about 60 pounds of oranges and hauls them in for the riverbed residents each weekend. When Muller expressed a need to step back, he volunteered to hike in every weekend from now on. Muller, an independent filmmaker for distributors such as National Geographic, has kept her Emergency Medical Technician (EMT) license active in the county for exactly this type of event. Her time years ago in the Peace Corps likely contributes to her can-do and service-oriented approach to tough situations. The pandemic hit and Muller was looking “around to be of use.” She contacted the companies that use EMTs (like ambulance operators), but found “nobody had back-up lists” and she didn’t find any volunteer EMT opportunities with organizations that were active. She had heard about the county’s Backpack Medicine outreach program, which was redirected away from the riverbeds due to the pandemic. Instead the program served homeless residents housed at a local hotel. “If the virus gets into this community, it will run through it like fire,” said Muller. She said the community size fluctuates between about 150 and 300 people at any given time. “There are a lot of people with health conditions. The goal from the beginning is to keep the virus out of the entire community.” Muller noted that the “single most useful” thing she may have done is call the county mobile coronavirus testing van when a resident showed symptoms that might indicate COVID-19. She also has helped with minor injuries, within the scope of her EMT license. She began hiking in through the maze of dirt paths that weave through the undergrowth, the invasive arundo and poison oak. It’s a two-mile hike to get in from Harbor Blvd., and she said for a while she would frequently get lost. But then Nack joined the team, and “he has a good sense of direction.” According to Muller, she hasn’t had any bad experiences in 8—

(Photo by Karin Muller) the past three months, and that in fact it’s been “quite the opposite.” She said the people of this community are “incredibly welcoming, warm and generous. They are part of a functioning community and they take extraordinarily good care of each other.” On one of Muller’s early treks, she was handing out sandwiches. “I stopped at the camp of an older woman who had been ill. There were three sandwiches stacked up.” They were the ones Muller had been handing out and she came to learn that a few young men had given their sandwiches to the woman “because she needed it more. That sort of thing happens all the time.” Once an older man had stepped on a rake and injured his foot the night before. “About six different people told me to go see William, he hurt his foot. If I hurt my foot I don’t think any of my neighbors would even know, let alone react if they did.” “I also don’t see them as a threat or a danger to the town or the county, quite the opposite, they are a potential resource,” Muller explained. Many earn money by recycling. Some sell found golf balls back to the nearby golf course. “That is a great example of a service they provide and some of those guys can fix bikes better than any mechanic. I would love to see them reintegrated.” A lot of what is needed is to “change our perception that they are people to be pitied,” she said. Some of their homes are “pretty

impressive...some have lived there for years and years.” While she said “they are not a problem to be solved,” she does think their lives can be improved, “a solution is out there.”

Baking Brigade forms

After hiking alone for a while, Muller posted on Facebook about what she was doing and whether anyone might want to help prepare food for her to take into the community. She was overwhelmed with responses. So many people were offering to bake and make sandwiches. The baking began with brownies and then transitioned to more healthy options. Teri Jenkins, a retired teacher from Ventura, offered to manage the volunteers, and coordinated the team’s schedule using a Meal Train app. Quickly the app hit capacity at about 40 people. “In the first days of the pandemic, the lockdowns created a call to action among many in the community. People were desperate to do something,” said Muller. Dubbed the Baking Brigade, it offered “an outlet, a way people could actually help. There is a pent-up desire throughout America, and certainly in Ventura, to pull together and do something as a community. We see too often the rallies and counter protests, the anger and tribalism. For those three months I felt exactly the opposite.”

(Photo by Karin Muller) The Baking Brigade grew primarily through word of mouth, and morphed into Beyond Baking Brigade with people providing other needed items like bars of soap, flashlights and first aid supplies. Dr. Tipu Khan M.D., the founder and director of the Backpack Medicine program, became a resource for Muller. “He is on my speed dial and he’d answer his phone day or night.” Khan suggested resources and helped ensure a county testing team was deployed if a resident had COVID-19 symptoms. Through Khan the brigade was connected to Jennifer Brynn, a resident of Ojai and local attorney who volunteered to set up a table and help people register for their stimulus checks. Muller says that income became a godsend to some residents, allowing some to move into more traditional housing while others bought cars which allowed them to get jobs.

In the first few weeks of the pandemic, there were a few days of steady rain. Several river bottom residents got flooded out of their homes and they were welcomed by residents living on higher ground. “Tents that hold two to three people were now holding seven or eight, they have such a sense of community.” Muller said, pointing out that immediate needs

Since the pandemic started, the city’s trash pickup at the community has also ceased. And the residents have no other way to get their garbage out. Muller points out that anything that can be recycled is given to those who earn money from recycling. “I’d have more garbage in a month than they have in a year if I didn’t have garbage service,” she said. About 10 days ago, the city hired a private company and about 50 people came through and did a cleanup. Muller described the river bottom neighborhood as a “big family unit,” and it’s clear when she shares about the residents and volunteers she’s met that she’s had a powerful experience. “I think I got a lot more than I gave to them...Friendships, a chance to see a community, what a community can be. I went in thinking I didn’t have any preconceived ideas, but I did. I have had those blown out of the water. To realize what a vibrant, creative, smart, friendly community this is.” “The homeless are not just a problem to be eradicated,” Muller added, suggesting that solutions need to include a way to integrate these individuals back into society in a way that honors their skills as artists, musicians, bike mechanics, etc. that are valuable to the larger community. “The answers are there.” “What I thought was just a band aid response to a crisis has actually evolved into a permanent, informal organization that will carry on long after I’m no longer here. That is the best feeling in the world,” reflected Muller. “Rick [Nack] is the true hero here. It’s one thing to do something for three months; it’s something else to say, ‘this is my passion,’” and devote “every weekend in perpetuity...A hero was created in these three months. It has renewed my faith in humanity.” “When I think of that I have hope again. There are really good people out there, and more really good people waiting in the wings...Give them a chance and they will become community heroes.”

One of the resident’s stimulus checks paid for food and meals were prepared for residents to eat at their camps. “As much as they can, they are trying to keep the virus out,” Muller said.

When Muller first entered the river bottom community, she realized the residents had very little knowledge about the coronavirus. Most don’t have phones or electricity, so they can’t access the news. She prepared a document that described the symptoms and how to protect yourself and others. Today she said the residents are fairly knowledgeable and there are signs around the community reminding people to wash their hands. “They are very aware and very knowledgeable, and that has informed their behavior. They are as careful as they can be,” observed Muller. Handwashing has been made possible by Nack, who coordinated the installation of a handwashing station, refilled each week by the county. The team hands out soap each week. Muller realized the neighborhood is actually fairly insulated from the outside community in terms of viral transmission. There is a class action lawsuit against Plains All American Pipeline, L.P. (“Plains Pipeline”) about the May 19, 2015 oil spill near Santa Barbara. In 2017, the Court decided that this case should be a class action on behalf of a “Class” or group of people, including certain fishers and processors. Based on additional evidence and claims regarding the scope of the oil spill, the Court recently approved a change to the group of people who are included in the Class and ordered this notice. The Court has not decided that Plains Pipeline did anything wrong. There is no money available now and no guarantee that there will be. What is this case about? This lawsuit claims that certain persons and businesses (and their employees) that fished for seafood in certain areas off the Central California Coast (“Commercial Fishers”) or that purchased and re-sold such seafood (“Processors”) suffered financial losses due to the Santa Barbara oil spill. Plains Pipeline denies these claims and denies it did anything wrong. The lawyers for the Class will have to prove their claims in Court. How has the Class changed? The Court recently changed the class definition to include fishing blocks that better reflect where Plaintiffs allege that the oil went and removed some seafood species. hird Eye Blind drummer Brad Hargreaves is excited to perform again on one condition: He looks out at a mask-wearing crowd. “I have this vision of the first show that we get to play again will be us walking on stage and seeing a sea of people in masks or face coverings,” Hargreaves says. “As long as I see that, I’ll feel quite comfortable playing up there. It’s been proven to work — wear a mask, wash your hands and practice social distancing. This is controllable. So many countries have figured this out. Now it’s America’s turn to figure it out.” Known for its hits “SemiCharmed Life,” “How’s It Going to Be” and “Jumper,” Third Eye Blind will headline a drive-in concert in the round on July 25 at the Ventura County Fairgrounds. The show starts at 8 p.m.; the first cars are allowed in at 6:30 p.m. The event will offer room for 600 cars and is designed to comply with all official restrictions. The combination of an extra-high, four-sided stage and five oversized screens will ensure that every seat is the best seat in the house. Sound will be distributed via FM radio. Tick-

ets are sold in advance and online only and are priced starting at $59 per car with up to five people per vehicle. A portion of the proceeds will benefit Food Share, Ventura County’s largest food bank. “I’m very excited to play,” Hargreaves says. “This is the longest stretch Third Eye Blind has gone in 25 years without playing. We haven’t even gotten together and rehearsed or recorded. “This will be the first time we’ve seen each other since the day our March concert was canceled — the day the country shut down all at once. It was like watching dominoes fall down.” Hargreaves doesn’t understand why some folks refuse to wear masks, but he has a theory. “We have a divisive president and he politicized the only effective means we have of controlling the virus: wearing a mask,” he says. “It’s a real shame. We don’t have any national leadership, in terms of leading the pandemic fight. Corporations have had to take over. Walmart just mandated it. atay, pad Thai, curry . . . these are a few of my favorite things. Lucky for me, Lucky Thai in Ventura serves all this and more — and operates its own delivery service within the city of Ventura as well. Yes, there’s a modest fee (which increases the farther you get from the restaurant’s Pierpont location), but it’s a small price to pay for expertly prepared Thai food arriving on your doorstep. The menu — available online; ordering is a snap — is a fairly comprehensive list of Thai specialities. The usual: numerous coconut milk-laden curries, pad Thai and

drunken noodles; tom yum and tom kha soups; crab rangoon and pineapple fried rice. Less familiar to me: curries made with duck, ribeye and green mussels; stir fries that include avocado; chicken wings; curry puffs; an intriguing spinach and tofu soup and other interesting options. Feeling inspired, I determined to mix up my typical Thai selections and try something new. Which is how I found myself ordering ribeye green curry (a chef’s special), a papaya salad, and basil wings in addition to family favorites chicken satay, spicy eggplant and pad Thai. The desserts (mango with sticky rice, coconut and Thai tea ice creams and fried banan-

as) were tempting, but I decided to go with the lighter-sounding Lucky Thai Blender in strawberry. Unpacking the colorful feast once it was delivered to my home definitely whet the appetite — and revealed a few surprises. First: The ribeye green curry is thin; almost like a soup. In fact, I thought a mistake had been made in my order. As I scooped it into bowls, however, I realized this was indeed a curry, with perfectly rectangular strips of ribeye, sliced mushrooms and fresh basil swimming in a delicately scented, light green coconut sauce. After one bite, I didn’t care that I had to eat it with a spoon: It was absolutely delicious, with a touch of herb and citrus and a decent amount of heat from the chilis. I initially mistook the papaya salad for a noodle dish, as the carrots and green papaya were shredded into long, thin strips. Accompanied by green beans, cherry tomatoes and hunks of tofu and dressed in a tangy vinegar dressing, it was an interesting mix of flavors: very fresh and crisp, with sweetness from the dressing, earthiness from the carrots and a cucumber-like character from the green papaya. The salad was a welcome and healthy contrast to the other rich dishes, like the basil chicken wings. Not spicy, but very flavorful . . . I couldn’t quite pick out every element in the tasty sauce, but there was basil and garlic for sure. Simply put: very good, and especially popular with the

I became friends with this awesome guy who moved into my apartment complex. I can tell that he’s into me, but he’s not my type at all. By the way, I find you sexually repellant.” Rejection shouldn’t be thrown around like croutons to geese. Social psychologist Mark Leary notes that romantic rejection can lead to people feeling ashamed for being “inadequately valued” by someone they’re

romantically interested in. The shame comes out of how high social status (being extremely valued by others) evolved to be the Amex Black Card of human interaction. It comes with important benefits, such as better access to resources, including a better choice of romantic partners. However, though shame is painful, the notion that it is a “bad,” maladaptive emotion is based in assumptions that passed for science (from 1971 by clinical psychologist Helen Block Lewis) that failed to look for the possible function of shame. Emotions are evolved motivational tools that drive us to act in ways that enhance our survival and mating opportunities and help us pass on our genes. Accordingly, cross-cultural research by evolutionary psychologist Daniel Sznycer suggests that shame is a “defensive system” that motivates us to behave in ways that keep us from being devalued or further devalued by others in our social world. In a harsh ancestral environment, this could have kept us from being thrown out of our band and starving to death and/or getting eaten by a tiger. In the current environment, where food is plentiful and tigers mainly exist in

cartoon form on cereal boxes, if you can avoid making a guy feel ashamed, it’s a good idea. A feminism- and #MeToo-driven feature (or bug) of the current environment is that men are often afraid to be direct with women they’re into: “Don’t ask for what you want; just stare at it and hope it trips, falls into your lap, and decides you’re attractive.” If this guy seems interested but remains mum, there’s no reason to humiliate him by telling him you don’t find him attractive. Avoid flirty talk and body language and situations that could slide into makeout sessions, like Netflix ’n’ chillin’ together. If he does ask you out or make a move, be immediately clear and direct: “I’m only interested in you as a friend.” (Ambiguous brushoffs like, “It’s not a good time” send the message, “Try again at a later date!”) If you can act like nothing awkward has happened between you, it should minimize his humiliation and shame. Sadly, sometimes “the birds and the bees” is a category that also includes “the vegetables,” as in, “I like you as a person, but I find you sexy like a potato.”
