There are many unhealthy and unproductive distractions that can lead young people down the wrong path. One organization seeks to change that with a focus on service and discipline, with opportunities to earn ribbons for special skills. East Valley Young Marines welcomes all youth between the ages of 8 and 18 who are actively enrolled in a public, private or certified home school and in good standing. The group is not used as a recruiting pool, rather, it is a dynamic program to teach skills, life lessons and discipline Sgt. Lifelong Learning Registration Begins Jan. 22 Open house set for Jan. 17 New Frontiers for Lifelong Learning is offering 69 classes—ranging from cruising the Danube to magic for grandchildren—for the spring semester. By Meghan McCoy Families of children receiving medical treatment will have a place to stay as a Ronald McDonald House will open at Cardon Children’s Medical Center this year. The organization signed a 99-year lease for an existing building at the hospital, said Ronald McDonald House Executive Director Nancy Roach. The rent on the building, a former psychiatric facility, is $1 per year. “The families that stay (will) just have to walk across the parking lot to be with their children,” she said. Ronald McDonald House is now trying to raise funds to renovate the building to create a homey atmosphere. Roach said $1.6 million of the needed $2.1 million has been raised. To donate, call Roach at (602) 798-5089. “The minute the funds come in, we are ready to build,” Roach said. The construction will take about six months to complete. The house will have 16 individual rooms, a dining room, and a common kitchen and living room, as well as a public laundry room and outdoor patios. “We try to provide them with common areas for the ability to be with other families,” Roach said. The rooms, which are about the same size as a hotel room, will have a queen-size bed, dresser and desk area, as well as its own bathroom. “Two of the rooms will even have kitchenettes for families that can’t go into the community kitchen because

their child might have a suppressed immune system,” she said. “In this case, the family can stay out of the general population to protect their child.” A survey of 100 families revealed the need for the Ronald McDonald House. Some respondents said they slept in their cars while their children were receiving care. Others stay with family or in a “nesting room,” a hospital room for mothers. The first Ronald McDonald House in Phoenix opened in 1985 as a 63room facility. In 2008, a second home opened near Phoenix Children’s Hospital. “This will help tremendously,” said Roach of having a house in Mesa. “It’s a great opportunity for these families.” Families who have children younger than 22 years old who are receiving treatment at Cardon Children’s Medical Center can stay at the Ronald McDonald House on a first-come, first-serve basis. Although they ask families to pay $15 a night, they do not turn anyone away who cannot afford it. In 2012, 1,500 families used the Ronald McDonald House in Phoenix and they checked-in approximately 2,200 times. Roach said the families stayed for almost 1,900 nights. Out of those families, only 12 percent could contribute money. “That’s why we raise money in the community,” she said. “We are community funded.” January 2014

By Christina Fuoco-Karasinski From the outside, Randy Shepherd was the picture of health. He actively rode his mountain bike and played in a fairly competitive softball league. Then five years ago, severe fatigue set in. The East Mesa resident lost his appetite and dropped 20 pounds. The symptoms were familiar to Shepherd, who contracted rheumatic fever twice before the age of 16. The disease damaged his heart, forcing doctors to replace two heart valves with metal at 17. This time around, however, he convinced himself he was just tired or had the flu. “In the back of my mind, I knew I had something wrong with my heart,” Shepherd said. He didn’t expect to hear that he needed a heart transplant. As a bridge to the transplant, Shepherd, 39, was fitted with an artificial heart, complete with an external 20-pound backpack motor earlier this year. It is audible as he speaks on the phone from University Medical Center in Tucson, where he was awaiting his new heart. To help defray the transplant’s peripheral costs, Shepherd’s friends and family are hosting the appropriately dubbed Tin Man Boutique from 5 p.m. to 9 p.m. Friday, Jan. 17, and 9 a.m. to 7 p.m. Saturday, Jan. 18, at 1850 N. he said. “It’s a time of a lot of travel. There are a lot of people out on the road. There are DUIs, as sad as it is. I kind of feel like a vulture thinking about it. I’m certainly not trying to hasten anybody’s demise.” Shepherd and his wife, Tiffany, have three children—Krista, 16, Kelsey, 12, and Nathan, 7. “They’ve been taking it really well,” he said. “They know dad’s sick. That’s really all my son has ever known of me. He was a year old when this all started. “With my daughters, it has been a blessing. While they were growing up, I was running my own business. I was a plumbing contractor.” He worked about 100 hours a week, allowing him to only see his family on the weekends. “Being home the last five years, I’ve gotten to catch up with them, and experience those things with my son that I didn’t get to experience with my daughters.” However, the family is taking into consideration that he might not make it through. “We’ve talked about it,” he said. “We’re a really strong religious family. We’ve taught them that this life isn’t the end. We go on to live afterward and we’ll see each other again. If I do die, it’s not the end.” January 2014

They are a lot of fun, but if not used properly they can be dangerous and cause, often avoidable, injuries. According to information published by the U.S. Consumer Product Safety Commission (CPSC), it is estimated there were 94,900 emergency roomtreated injuries associated with trampolines in 2012. Major reasons for injuries include colliding with another person on the trampoline; improper landing while jumping or doing stunts; falling or jumping off the trampoline; and falling on the trampoline springs or frame.

Keeping the kids safe and still allowing them to have fun means taking precautions and implementing rules for trampoline safety. By Brian Hay, Title I specialist Mesa Public Schools is home to one of the few dual language programs in the East Valley. Keller Elementary School offers kindergarten through fifth-grade curriculum, with plans to expand English-Spanish program through sixth-grade in the 2014-15 school year. The Program’s Goal The goal is for students to become bilingual and biliterate, while gaining an appreciation for other cultures. The Keller Elementary model is aligned to Arizona’s College and Career Ready Standards. Students receive instruction in both languages, with the day divided into English and Spanish blocks. They are encouraged to use the learned language and content in group settings and during individualized instruction with the teacher. Cultural diversity is incorporated in the program, through student participation in events that honor important historical figures, traditions and holidays. The Mesa Arts Center’s Dia de los Muertos Festival is one such event. Students utilize their English and Spanish skills to participate in the altar contest honoring the memory of Cesar Chavez. Lourdes Mejia, fourth-grade dual language teacher, said, “The payoff is huge for our students proficient in both languages. Studies show bilingual employees make an average of 5 to 20 percent more than their monolingual counterparts.” Students engage outside of the classroom, using their language skills to help others. Recently, a fifth-grade student was waiting in line at Disneyland when he noticed a woman trying to communicate with an employee in Spanish, but the employee did not understand what she was saying. Kids are used to waking up to gifts from Santa, but the jolly man is nowhere in sight when Christmas morning comes but Mesa residents had the chance to get an early glimpse of him on December 14. Residents woke up to Breakfast with Santa, an annual Mesa tradition that includes a pancake photo page events calendargoody bag, holiday activities and of course, a picture with breakfast, the big guy. It’s

wonderful because they take care of us very well,” said Osborne. “I’ve been very, very fortunate and very blessed to be able to have contracts a lot.” Broadway shows remaining in the 2013-2014 season at The Palms include “South Pacific” (Feb. 27-April 13) and “Burt & Me” (April 24-May 24), in addition to many other concerts and unique shows. Author Publishes Second Book Of ‘Whispers From The Past’ Series By Meghan McCoy Donald Ensenbach’s writing career began when he completed a book for his family and friends who were visiting Arizona in 1990. However, his true love of writing about history has taken hold with the second book in his “Whispers from the Past” series called “Shadows through a Spirit Window.” The 75-year-old Mesa resident tapped into his real love—history— after completing six autobiographies. “I just walked away from the autobiographies in 2010 and started writing my series,” he said. A healthy amount of inspiration comes from his travels with his wife of 54 years. At each stop, Ensenbach absorbs the history and myths of the locals. “We drive everywhere we go, so I have some good ideas for future

books,” he explained. “It’s amazing some of the things I have been able to run into by mistake by many occasions. The stories are fantastic. The legends and myths is what I enjoy writing about.” All of his books are fiction, but they use real locations when appropriate. “Now, I’m having the time of my life,” he said of writing his fiction novels. “I’m fantasizing and putting down what I think is important and using history as much as possible.” The first book in his series, “Kokopelli: Dream Catchers of an Ancient,” focuses on the time period between the seventh and 15th centuries when the Spaniards arrived. Ensenbach said he pieced together a story about Kokopelli by reading anthropologists’ and archeologists’ accounts.

Some of the Gains, In Exchange For None Of The Losses By Thomas K. Brueckner, CLTC

A

s we enter 2014, last year’s bull market faces a myriad of problems. It’s overvalued, subsidized by the Fed, and the artificial quality of its earnings is being driven less by sales than by labor force reductions, outsourcing, automation and efficient technology, the hiring of part-time workers, and wage stagnation. Companies have bought back their own stock with money raised by issuing their own bonds, leaving them rife with cash and debt. The debt bubble we are in requires Yellen’s Fed to keep the QE apparatus humming because if rates were allowed to rise to the historical mean, governments, corporations, banks, and individuals would be subject to tremendous stress, littering the landscape with bankruptcies, business failures, and foreclosures. The Fed is trying to buy time, hoping the world economy improves in time to prevent the inevitable. It’s a colossal gamble on a massive scale with unthinkable consequences if it fails. Individual investors face some challenges too, after The Year No One Expected in 2013. Conditions last seen in early 2000 and late 2007: irrational exuberance, record levels of margin debt, and fund managers with record equity exposure all bode poorly for those trying to convince themselves that the coming “correction” will be shallow and short-lived. Recent history bears different testimony but, as an old mentor once told me, “The only thing we learn from market history, is that investors repeatedly refuse to learn from market history”, so don’t expect scar tissue to deter the foolhardy. Logic, experience, and common sense should dictate that if “buy low, sell high” is the watch phrase of investing, now would be an opportune time to take some profits, and perhaps move to the sidelines. The older you are, the less tolerance you have for risk. As we often ask new prospects with sufficient assets for a sus-

tainable retirement and age-inappropriate risk exposure, “If you’ve already won the game, why are you still out on the field?” While most have “never thought of it that way”, some have a different reply, parroting the advisors who benefit from ongoing management (risk exposure) of those funds: “But we can’t afford not to be at risk, since only equities historically outpace inflation over time…” (Never mind the fact that inflation is currently at 1.2% and has averaged less than 2.3% for a decade.) Translation: No pain, no gain. Really? Guess again. A savings platform first developed by insurance companies in the mid nineties credits market-linked interest (like a CD) during years when the indices (S&P 500, DJIA, etc.) advance—retaining such gains amid a selloff or meltdown the following year. Fixed Index Annuities, or FIAs as they are now called, protected their owner’s account balances during both the -51% “tech wreck” sell-off in 2000-2, and again during the -57% decline that followed the subprime mortgage and financial crisis on Wall Street. They have grown so much in popularity that some of the brokerage firms that once maligned them have recently partnered with the companies that developed them, for the benefit of their more risk-averse clients, lest their advisors lose such clients to other firms. Employing the simplicity of time-tested hedging via the use of options, FIA firms guarantee a) their client’s original principal, b) any bonus monies credited (in exchange for a longer enrollment), as well as c) each year’s market-linked interest gains against losses. Like an ever rising tide leaving a new high-water mark, an FIA owner will only see their account value grow or hold—and only decline when they take a withdrawal. Although they’ll never again hit a market home run, they’ll hit a lot of singles,

doubles, and triples, while never losing the retirement game. Regulators, CFPs and actuaries have long maintained that the older an investor gets (and the further into a sustainable retirement), the less risk they should be taking. Getting market-linked interest of 3-9%—we’ve even seen credits of over 20% during banner years— knowing you’ll never lose those gains to another massive sell-off, makes for many a contented retiree sleeping very well at night. Whatever Janet Yellen or Europe’s central banking elite have up their economic sleeve in 2014, we all know that the reality of a stagnant world economy will eventually overtake the euphoric fantasy that was 2013. The only question is whether you’ll have protected yourself this time. Thomas K. How Can I be Guilty of DUI Drugs if I Possess a Medical Marijuana Card? law talk

As a criminal defense attorney in Arizona, I am consistently meeting people who are downright distraught and confused to have been charged Brian D. Strong with DUI drugs (sometimes referred to as “drugged driving”) when the only drug they were using was medical marijuana. In Arizona, a prosecutor has three possible methods for proving that a driver has violated the DUI statutes: 1) “The Individual Analysis;” 2) “The Legal Limit” and 3) “Zero Tolerance.” biz box

The Individual Analysis Because we all have unique body chemistry and unique tolerance levels, this approach (whether it involves alcohol, drugs or both) is the most factually honest. The bottom line question here is: Was this driver actually impaired (or under the influence) of some substance at the time of driving? Oftentimes, the answer to this question is not easily resolved. This is because almost every indicator of motor skills impairment can be caused by innocent factors. Bloodshot/watery eyes can simply mean an allergy sufferer. Most sober drivers make wide right turns into the wrong lane. Failure to walk a straight line might be because of knee trouble. As a result, most prosecutors dislike the “Individual Analysis” because it makes them work for a living and has a tendency to result in hung juries or acquittals. The Legal Limit In this subsection of the DUI statutes, the legislature has established a precise limit of alcohol or drugs that are permissible in the human body. In Arizona, the current legal limit for alcohol is .08 percent. Like most states, Arizona does not currently January 2014

have a legal limit specified for any DUI drug charge. A small number of states have created such limits. For example, in the State of Washington, five (5) nanograms per milliliter is the legal limit for tetrahydrocannabinol (commonly known as THC—the physiologically active component of marijuana). See, Wash. Rev. Code 46.61.502(1)(b). Zero Tolerance In DUI drug cases, the legislature has made it illegal for a driver to have any amount of drugs in their system if they do not possess a valid prescription for that drug. This might include a driver who has consumed medication prescribed for a family member or friend or in the alternative, has consumed illegal drugs (for which no prescription is ever available). While alcohol and most illegal drugs are cleaned out of the body within a matter of hours, marijuana metabolites remain in the bloodstream for a much longer time. Marijuana metabolites are the remnants of THC in the body after it has gone through the process of breaking down the drug. Even after the body is no longer feeling the effects of THC, there are still modified remnants of it flowing through the bloodstream. For some users, marijuana metabolites can remain in their systems for several weeks, even if the user did not consume any marijuana on the day he or she was arrested for DUI. Historically, DUI drugs in Arizona has been a “zero-tolerance statute.” Any trace of an illegal drug in one’s system resulted in a DUI drug conviction regardless of how long ago the marijuana was smoked. Arizona’s Medical Marijuana Act (AMMA) has erased the “zero-tolerance” standard for those with authorized medical marijuana cards. Specifically, A.R.S. § 36-2802(D) notes that, to obtain a DUI drug conviction for a person with an authorized medical marijuana

card, the prosecutor must prove that the driver was actually “under the influence of marijuana” and, more importantly, “a registered qualifying patient shall not be considered to be under the influence of marijuana solely because of the presence of metabolites or components of marijuana that appear in insufficient concentration to cause impairment.” The AMMA fails to tell us, however, exactly how much marijuana is too much. In like manner, the White House Office of National Drug Control Policy has asked all states to adopt drugged driving laws with specific limits, but never mentions what specific limit should be set for each drug. See www.whitehouse.gov/ ondcp/drugged-driving. In Arizona, the smell of marijuana alone can be enough to give a police officer probable cause to pursue a DUI drug investigation. Because the odor of marijuana in vehicle upholstery can linger for several weeks, DUI drugs has become an extremely common criminal charge. And, in spite of the express language in the AMMA,

many prosecutors are still pursuing DUI drug cases as if they were premedical marijuana “zero-tolerance” cases. These prosecutors are actively fighting to keep a defendant’s medical marijuana card excluded from the jury.
