Important Update from TNLA President, Amy Graham

MESSAGE FROM THE PRESIDENT During its April Board Meeting, the Board of Directors approved the following recommended changes (p. 5) to the Association’s bylaws come to the membership for consideration of approval. The recommendations came from a task force of members that were charged with reviewing the current member types and assuring they still reflected companies and individuals Texas Nursery & Landscape Association has as members as well as chooses to recruit as future members. During the Annual Business Meeting that will be held on Friday, August 12 at 8:30 a.m. at the Henry B. Gonzalez Convention Center, a voice vote of members present will be held on the changes presented. Should you have questions regarding the proposed changes, please contact Amy Graham, agraham@tnlaonline.org.

ACTIVE MEMBER CHANGES: 1. Add word “professional” before word services under definition of Supplier. 2. Add/Rewholesaler to Grower category name. NOTE: They have been counted in this category in the past. Clarified/cleaned the definition to include the Rewholesaler in the definition. 3. Cleaning up after adding the separate irrigation category earlier. 4. Cleaning up and taking out wordiness in the irrigation definition category definition. INDIVIDUAL MEMBER CHANGES 1. Added (Must Not be the Owner of the Company) 2. Clarified in each category that an individual should not currently be an employee of a TNLA member company 3. Certified Professionals: NEW way to engage in education at EXPO! Certified Professionals Get Ready to Begin Your EXPO Journey EXPO is getting closer and we want to make sure you have your game plan ready when it comes to earning CEUs by preparing for your EXPO journey now. We have changed the way we normally offer education. This year we will have a full CEU day on Wednesday, August 10, 2022, before the Tradeshow opens. Now you and your team can spend more time on the show floor receiving expert advice from exhibitors and sourcing much-needed products and materials. EDGERS Objective: Participants will be able to correctly and safely operate and maintain an edger. APPLICATION: Practice with an edger is the best way to learn how to use, control, and maintain the machine. Although most edgers are similar, participants should practice with different makes and models. Opportunities to practice at a work site will also reinforce what is learned. Edgers are used to give a professional and detailed appearance to areas that have been mowed, specifically curbs and paved surfaces. Even though it does not take long to edge a mowing site, it is important that care is taken when edging to create an expert appearance.

1. Regularly service and maintain the edger.  Refer to the owner’s manual for service recommendations. 2. Put on safety equipment. This includes safety glasses, long pants, safety shoes, and earplugs. 3. Visually inspect the edger before operating. Check equipment for wear due to vibrations. Replace cutting blade if needed. 4. Check that all safety devices are attached and working properly. Never operate the edger without proper guards. 5. Check fuel levels before starting edger. 6. If fuel is low, refuel edger with correct fuel mix. 7. Improper use of the edger can cause injury to operator, others, and objects. Inspect area for objects (sticks, stones, glass, etc.) that would injure the operator or pedestrians. Pedestrians should not be near when operating edger. 8. Safely start edger. 9. Keep edger blade away from hard surfaces (stone, brick, concrete) because the blade can damage these materials. 10. Keep guard between sidewalk and blade. 11. Only use edger in designated areas. Do not damage nearby plants, paving material, or irrigation heads. 12. Safely shut down trimmer.

Region III Meeting with Dr. Charlie Hall Region III held its monthly meeting on July 7, 2022 at Sorelle Tree Farm. Attendees enjoyed a tour of the tree farm. Dr. Charlie Hall spoke on the State of the Green Industry. Everyone enjoyed the presentation and dinner at Cowburners BBQ & Taproom in Mineola, TX. Thanks to HC Companies, ICL, Syngenta, and TNLA Region III for sponsoring the dinner.

ADVOCACY REPORT H-2B Amendment Adopted Negotiations Continue of RWE

USDA Announces Phase One Status of the Emergency Relief Program (ERP)

In the last two weeks, the U.S. House Appropriations committee approved an amendment to the Dept. of Homeland Security funding bill to continue the federal administration's authority to release additional H-2B visas. Importantly the amendment also included language to mitigate the "rulemaking process" for the release of these discretionary visas, a mechanism that has been used to delay the release of the additional visas by months. This progress was only possible because of the tremendous work of our advocates over the past year and a half pushing for support of HR 3897.

The USDA has announced over $4 billion in aid has been released nationally through Phase One of the ERP program to growers impacted by weather-related disasters in 2020 and 2021. Of the $6 billion dedicated to Phase One, $557.5 million has been awarded to Texas growers. Growers would have received pre-filled applications for Phase One ERP in the event they had crop insurance or NAP coverage. Phase Two will be for producers impacted by those disasters who did not have crop coverage. TNLA will send out a notice when the details for Phase Two are announced.

Additionally, in exchange for dropping a more drastic cap relief amendment, firm commitments were obtained from labor unions and Democratic Judiciary Chairwoman to oversee formal negotiations between the AFL-CIO (opponents of the H-2B program) and the H-2B Workforce Coalition (including TNLA) to have a compromise agreement securing the Returning Worker Exemption. We remain hopeful these negotiations will be successful and mean better cap relief for FY 23.
