DAY 1 SYDNEY TO PORT STEPHENS. It comes as no surprise that Sydney has some pretty iconic sights to see. We’ll take you to a spot in Kirribilli to get the very best views of the Sydney Opera House and Harbour Bridge. Cue awesome photos of the local surfers as we check out the laidback lifestyle of Manly Beach before heading up the road to meet some local Aboriginal people. Think Rock Art and traditional stories. After a jampacked day we’ll relax in Port Stephens for a filling feast and maybe even a ‘coldie’ at the local pub. (D) DAY 2 PORT STEPHENS. Port Stephens is pretty laid back. You could take it easy today on an optional dolphin cruise to catch a glimpse of these beautiful animals. Feeling more energetic? Hike to the top of Tomaree Head for sensational views, or take up some optional sand dune quad biking and sandboarding. Whatever you do, you’ll work up an appetite. Thankfully this place is known for its seafood, so be sure to check out one of the local restaurants for dinner. (B) DAY 3 PORT STEPHENS TO HUNTER VALLEY. Hunter Valley is synonymous with wine, so we’ll visit a local vineyard, a brewery, and get a chocolate tasting ticked off the list. You’ll even get to hop in an oak barrel and have a go at grape stomping. Talk about an awesome day! Make sure to leave enough space in your suitcase for some foodie souvenirs. (B)

DAY 4 HUNTER VALLEY TO BLUE MOUNTAINS. A scenic drive up the historic ‘Putty Road’ is on the cards today, so prep your peepers for awe-inspiring views over the western plains of Sydney. DAY 1 CAIRNS TO CAPE TRIBULATION. After motoring out of Cairns and heading to the hinterland we’re off for an Aboriginal Bush Tucker walk. Then it’s off along the coast we go to get wet and steamy in the UNESCO World Heritage Listed Daintree National Park. After a busy day of travelling, it’s time for a filling feast and maybe a ‘coldie’ at the local bar. (D) DAY 2 CAPE TRIBULATION. Cape Trib is all yours for exploring today. Got a head for heights? There’s the optional Jungle Surfing zipline. Want to be beach-based? You can choose to go horse riding or snorkelling. There’s also a crocodile cruise for nature lovers and thrill seekers (eek!). Binoculars at the ready! Round out your day on a deserted beach with a glass of bubbles in your hand and your new mates by your side. (B) DAY 3 CAPE TRIBULATION TO ATHERTON TABLELANDS. Hungry for more rainforest action? You’re in luck, we’re off to Mossman Gorge. Besides the many waterfalls, there are some 30,000 plant and animal species to spot here. See where your lattes start life at a coffee plantation before moving on to try some tropical fruit wines or local spirits. Yungaburra is home for the night. Head out to spot platypuses at dusk, and check out even more wildlife on an optional night time kayak trip. (B) DAY 4 ATHERTON TABLELANDS TO MISSION BEACH. Today cool off with a swim in a volcanic crater lake. At lunch, take in the beauty that is Millaa Millaa Falls, then it’s back towards the coast, via a few swimming spots. Tonight we stay in the heart of Mission Beach. (B) DAY 5 MISSION BEACH TO CAIRNS. Start off with a beachside breakfast before exploring this oh-so-pretty part of the world. DAY 1 DARWIN TO KAKADU NATIONAL PARK. Kakadu, here we come. Inside the 20,000 square kilometre park, we’ll head to the village of Jabiru and check out the Bowali Visitors Centre. For the next two nights you’ll be calling the UNESCO World Heritage listed Kakadu National Park home. Tonight, get to know your travel mates over dinner. (D) DAY 2 KAKADU NATIONAL PARK. This morning we venture to Nourlangie Rock to spot some of the most famous Australian Indigenous artworks, and then hit the water in Arnhemland (dry season). Try your hand at spear throwing while you’re there, then we’ll see some ancient Aboriginal rock art at Ubirr before climbing to the top of a rocky lookout for beautiful views over the Nardab floodplain. We’ll also check out the East Alligator River on a Guluyambi Cruise (dry season). (B) DAY 3 KAKADU NATIONAL PARK TO KATHERINE. Explore the magical Edith Falls and have a dip in one of the world’s most idyllic natural pools. Cooled off and refreshed, we’re on the road again and headed for Katherine. As the day draws to a close, round it off with an evening game of lawn bowls and a BBQ with some locals at the nearby Country Club. (B,D) DAY 4 KATHERINE TO LITCHFIELD NATIONAL PARK. On today’s line up we’ve got the option for a cruise through the stunning Katherine Gorge on the cards. Get those cameras ready, it’s gonna be pretty awesome. After, we get back on the famous Stuart Highway as we head for Batchelor, the gateway to Litchfield National Park. (B)

DAY 5 LITCHFIELD NATIONAL PARK TO DARWIN. National Park, pools and a picnic are the order of the day. Then venture over to the Buley Rockholes for another soaking. After lunch outdoors, we’ll take on the short drive and last leg of our discovery trip back into the heart of Darwin. If you’re feeling brave or having a #YOLO moment, take the opportunity to get up (very) close and personal with Australia’s iconic saltwater crocodiles at Crocosaurus Cove. Eek! DAY 1 ALICE SPRINGS TO ULURU-KATA TJUTA NATIONAL PARK. We're hitting the red ground running as we take to the road and head into Yulara (the gateway resort to Uluru). We're off to visit the sacred monolith itself in the afternoon, with a guided walk on the cards. Later, raise a glass of bubbles as we watch the glow of the sunset morph through 50 shades of red. This will be a sunset for the books. Tonight, hone your Aussie BBQ skills and cook your own steak (or veggie burger). Welcome to Australia, mate. (D) DAY 2 ULURU-KATA TJUTA NATIONAL PARK. Forgive the early hour, but this is a sunrise you’ll want to see. Trust us. Then, get a sense of the immense scale of Uluru with a base walk. Gear up for the optional activities today – we’re talking skydiving, camel rides and scenic flights. (B) DAY 3 ULURU-KATA TJUTA NATIONAL PARK TO KINGS CANYON. After breakfast, we spend a few hours back in the National Park. This time get ready for some soul searching as we venture into the heart of sacred Kata Tjuta (The Olgas) and walk amongst the 36 red sandstone giants through the Valley of the Winds. After a drive into Watarrka National Park, live the life of a jolly swagman as we bed down in custom swags (think: the ultimate portable sleeping unit). Keep an eye out for shooting stars, and don’t forget to make a wish! (B,D) DAY 4 KINGS CANYON TO ALICE SPRINGS. Get your hiking boots on! This morning we start with the hardest part of the famous Rim Walk in Kings Canyon, aptly named ‘Heart Attack Hill’. Believe us, it’s worth the effort. Think age-old cycads, eroded dome shapes, a visit to The Lost City – and that's not even the best part. The sheltered valley and waterhole of the Garden of Eden make today even more awesome. After a stop off to grab some lunch, we’ll board the bus back to Alice Springs. (B)

Later, Cairns is calling. Gateway to the Great Barrier Reef, this place is pretty special. Take a stroll around. Then the night is yours to get out and explore some of Australia’s best nightlife. DAY 1 ALICE SPRINGS TO ULURU-KATA TJUTA NATIONAL PARK. After lunch in Yulara (the gateway resort to Uluru) there’s a guided tour of the big red rock itself. Snap away at the gorgeous sunset and tuck into a BBQ for dinner. (D) DAY 2 ULURU-KATA TJUTA NATIONAL PARK. Forgive the early hour, but this is a sunrise you’ll want to see. Trust us. Then, get a sense of the immense scale of Uluru with a base walk. Gear up for the optional activities today – we’re talking skydiving, camel rides and scenic flights. (B) DAY 3 ULURU-KATA TJUTA NATIONAL PARK TO KINGS CANYON. Stroll amongst the 36 red sandstone giants through the Valley of the Winds. Tonight: we experience the true outback with a sleep under the stars in custom swags. (B,D) DAY 4 KINGS CANYON TO ALICE SPRINGS. Kings Canyon starts with a serious set of 500 steps before we get to the Garden of Eden. It’ll be worth the climb. Promise. (B) DAY 5 ALICE SPRINGS. Today, we head out on an excursion to the West MacDonnell Ranges. Optionals include a visit to the Kangaroo Sanctuary (cute!). (B) DAY 6 ALICE SPRINGS TO DARWIN. Cheerio, Alice. We’re flying to Darwin today, the capital of the Northern Territory. (B) DAY 7 DARWIN. You’ve got a day in Darwin to explore. Get your urban fix before Kakadu tomorrow. (B) DAY 8 DARWIN TO KAKADU NATIONAL PARK. For the next two nights you’ll call Kakadu home. Expect phenomenal wildlife, Instagram-worthy scenery and of course local Indigenous culture. (B,D) DAY 9 KAKADU NATIONAL PARK. When will you get to see Aboriginal rock art and wildlife up close? Oh right, today. Bonus: keep your eyes peeled for crocs as we cruise along the East Alligator River (dry season). This evening, soak up a breathtaking sunset at Ubirr. (B)

DAY 1 SYDNEY TO SURF CAMP, CRESCENT HEAD. Wave goodbye to Sydney’s iconic views as we venture toward the surfing cloud nine of Crescent Head. After a tasty BBQ lunch, we’ll be hitting the water with a surf lesson. (L,D) DAY 2 SURF CAMP, CRESCENT HEAD TO BYRON BAY. Our road trip continues with a stop off at the Big Banana before arriving into Byron Bay. Take an afternoon walk and soak up those chilled-out Byron vibes. (B)
DAY 3 BYRON BAY. Byron is so laid back it’s a wonder it hasn’t fallen over. Hit the shops and restaurants, test out those newly-acquired surfing skills, try kayaking to search for dolphins or whales… or, you could always jump out of a plane. Eek! DAY 7 FRASER ISLAND TO MYELLA FARM. Time for a home-cooked meal and cattle station visit – but first, a cheeky jaunt to the Bundaberg rum distillery. Then, it’s on to those dusty plains and wide open spaces. (B,D) DAY 8 MYELLA FARM. Embrace your inner cowboy and prepare for some whip cracking and lassoing – today there’s a full day on the farm to sink your teeth into. Opt in for the chance to explore on horseback (or a motorbike if that’s more your scene). (B,L,D) DAY 9 MYELLA FARM TO THE WHITSUNDAYS (SAILING). Find your sea legs as you board your own private overnight yacht for a two day sailing trip. Sunscreen at the ready! Cue lots of swim stops, snorkelling and some time to sunbake. DAY 1 SYDNEY TO SURF CAMP, CRESCENT HEAD. Let the wave chasing begin! Suit up and hit the beach. With qualified instructors to watch over your every move, you’ll be up and on your feet in no time! (L,D) DAY 2 SURF CAMP TO BYRON BAY. Today we pass Coffs Harbour and that notorious Big Banana (note to self: charge camera) as we continue on to chilled out Byron Bay. (B) DAY 3 BYRON BAY. The ‘Welcome to Byron Bay’ sign says it all: 'Cheer up. Slow down. Chill out.' You’ve got 24 hours to find inner hippie peace. (B) DAY 4 BYRON BAY TO BRISBANE VIA THE GOLD COAST. Buh-bye Byron, we’re headed to Brisbane and the famous Surfers Paradise beach today. (B)

DAY 5 BRISBANE TO FRASER ISLAND. Say farewell, Brisbane and hello Noosa! Later today we catch a ferry bound for Fraser Island. (B,D) DAY 6 FRASER ISLAND. Four-wheel drive along the highway of 75 Mile Beach and make a splash in the crystal clear waters of Lake McKenzie. Epic. (B,L) DAY 7 FRASER ISLAND TO MYELLA FARM. Embrace your inner jackaroo and prepare for whip cracking and lassoing at a real Aussie farm. (B,D) DAY 8 MYELLA FARM. Today there’s a full day on the farm to sink your teeth into. Opt in for the chance to explore those dusty plains on horseback or motorbike. (B,L,D)
DAY 11 AIRLIE BEACH TO MAGNETIC ISLAND. You + island vibes = bliss. Get involved in walks to secluded beaches and maybe even feed some of the local animals. (B,D) DAY 12 MAGNETIC ISLAND TO CAIRNS. Before leaving this island gem, make sure you cuddle a koala (optional activity). Later today we pull into Cairns: the gateway to the Great Barrier Reef. (B) DAYS 13-14 CAIRNS. You’ve got two free days to make the most of Cairns. Bungy, whitewater raft or snorkel, dive and cruise the Great Barrier Reef. (B) (B) DAY 15 CAIRNS TO ALICE SPRINGS. Take to the skies heading south west to meet up with your crew in Alice Springs. (B) DAY 16 ALICE SPRINGS TO ULURU-KATA TJUTA NATIONAL PARK. It’s Uluru in the afternoon for a guided walking tour, a glass of bubbles and an unforgettable sunset. (B,D) DAY 17 ULURU-KATA TJUTA NATIONAL PARK (THE OLGAS). What’s more amazing than sunset at Uluru? Sunrise. Plus, a full base walk. Follow in the footsteps of the traditional owners of this World Heritage site. DAY 1 AUCKLAND TO ROTORUA (MARAE STAY). Maori legends and mythology have been passed down for thousands of years. You have one night in this sacred meeting house, so pay attention. After learning the tongue-thrusting Haka dance moves of the All Blacks and enjoying the finesse of the ladies’ Poi dance, polish off a traditional Maori dinner. Did we mention we’ll also be checking out the Waitomo Caves? (D) DAY 2 ROTORUA. Get muddy in the bubbling, sulphur-soaked town of Rotorua. While you're here, raft over the waterfalls, head to the spa for a massage, or jump into the real-life landscapes of Tolkien's dreams on the Hobbiton Shire escape (all optional). (B) DAY 3 ROTORUA TO TONGARIRO NATIONAL PARK. Geothermal activity gets turned up to 11 with natural hot pools. And if that's not enough, you can bungy jump off a bridge as we pass by the largest freshwater lake in Australasia. (B,D) DAY 4 TONGARIRO NATIONAL PARK. With dual cultural and natural heritage status, and often described as the most epic hike in NZ, Tongariro NP is home to three active volcanoes that will hopefully keep a lid on things. The optional Tongariro Alpine Crossing will quickly top your list of favourites if you don't mind heights and the odd dormant lava chamber (and walks from 20 mins to eight hours). (B) DAY 5 TONGARIRO NATIONAL PARK TO WELLINGTON. From hiking over lava to readjusting to city life, today we hit the nation's capital, Wellington (no, it's not Auckland!). After you conquer the six floors of the Te Papa museum, you'll probably be ready for a big city nightlife hit. With more bars and restaurants per capita than New York and a well-earned spot as the sporting capital of NZ, you can't go wrong with a craft beer and some local rugby action. DAY 1 QUEENSTOWN. A NZ ski trip is always a good idea. Our base for the week is a stone's throw away from all the action of Queenstown, with Lake Wakatipu and the dramatic Southern Alps to keep you company. We’ll get your lift passes and transport cards sorted before a walking tour. Tonight: get to know your snow buddies over dinner at Winnie's. (D) DAY 2 QUEENSTOWN. Put that four day Queenstown Superpass to good use. Head up to Coronet Peak and find your ski legs with a first timer lesson or a refresher course. It’s like riding a bike. Ask the crew for the best trails to practice on, then refuel at a mountain café for lunch before an afternoon ski sesh. Try out your new tricks or stick to the green slopes – if you look like a giant stick insect with oversized shoes on, never fear, you’ll get the hang of it soon. (B) DAY 3 QUEENSTOWN. Pull out the big guns today with an optional Milford Sound day trip and prepare yourself for action with a capital A. Take your pick from bungy jumping, canyon swinging and jet boating. Or, if you’re getting deep into the skiing thing, stay put at the slopes for another day of dashing through the snow. Take the scenic bus drive up to The Remarkables ski area and test out your skills – lessons of all levels are available again to perfect your turns. DAY 1 AUCKLAND TO BAY OF ISLANDS. James Cook named our first stop the ‘Bay of Islands’. Well, you know what to expect. Seeing all 144 islands might take a while, so grab the optional ‘Rock the Boat’ island tour. DAY 2 BAY OF ISLANDS. Ride down 80-100m dunes as many times as your legs can carry you back up (optional). What’s it going to be today? Opt in to grab a kayak and paddle under the Haruru Falls, cruise out to the Hole in the Rock or indulge in an optional spot of dolphin sailing. We’re having fish and chips for dinner so good thing you did all that exercise. (B,D) DAY 3 BAY OF ISLANDS TO AUCKLAND. Departing Bay of Islands, we’ll make two pit stops: first at the gorgeous Whangarei waterfalls, then at Mount Eden for a view of the city from the top of a volcano. (B) DAY 4 AUCKLAND TO ROTORUA (MARAE STAY). Pick up some new travel pals, then head to Waitomo Caves before hitting Rotorua. Tonight, Maori legends and mythology come alive as we bunker down at a traditional Marae stay. After learning the tongue-thrusting Haka dance moves of the All Blacks and the finesse of the ladies’ Poi dance, you’ll polish off a traditional Maori dinner and feel like one of the locals. (B,D) DAY 5 ROTORUA. Get muddy in the bubbling, sulphur-soaked town of Rotorua. While you're here, raft over the waterfalls, head to the spa for a massage, or jump into the real-life landscapes of Tolkien's dreams on the Hobbiton Shire escape (all optional). (B) DAY 6 ROTORUA TO TONGARIRO NATIONAL PARK. After enjoying the geothermal activity of Rotorua, the brave can bungy jump off a ledge as we pass by the largest freshwater lake in Australasia. DAY 1 AUCKLAND TO ROTORUA (MARAE STAY). Today we stop off at Waitomo Caves before trekking south to the heartbeat of Maori culture in Rotorua, a steamy thermal playground. You’ll stay at a Maori Marae, have a traditional dinner and end the night a Haka expert. (D) DAY 2 ROTORUA. The day is yours to play with. There’s an optional trip to the thermal pools, or you could race around on a mountain bike, go whitewater rafting or try the original OGO Zorb. Hobbit fans, the Hobbiton Movie Set Tour is a must. DAY 2 ROTORUA. There are 14 lakes around Rotorua and geothermal steam vents everywhere. Relax in the hot springs, have a traditional Miri Miri massage or get more blood rushing and raft, bike or Zorb around this outdoor playground. (B) DAY 3 ROTORUA TO TONGARIRO NATIONAL PARK. DAY 1 AUCKLAND TO PAIHIA, BAY OF ISLANDS. Leave the city behind and get ready to explore New Zealand in all its breathtaking glory as we step into an adventure 130 million years in the making. Become a tree hugging hippie as you wrap your arms around NZ’s botanical elder, the Kauri tree, then 'Rock the Boat' on an optional overnight houseboat trip.
DAY 2 PAIHIA, BAY OF ISLANDS. The Bay of Islands is big on numbers: 144 islands, a 90-mile beach, and 100-metre-high Te Paki sand dunes, ready for some serious sandboarding action. The islands (and all their optional activities) are your oyster on this free day. (B,D) DAY 3 PAIHIA, BAY OF ISLANDS TO AUCKLAND. Wave bye-bye to the wilds for now – it’s back to the modern world today as we return to Auckland. Take some time to wander the heart of the city at your leisure. (B)
DAY 4 AUCKLAND TO ROTORUA (MARAE STAY). We’ll make a stop to check out the Waitomo Caves, then learn the tongue-thrusting Haka and polish off a traditional Maori dinner. (B,D) DAY 5 ROTORUA. When it comes to optional activities, mud, Middle Earth and massages are the order of the day in the bubbling, gurgling and sulphursoaked town of Rotorua. Also: optional whitewater rafting. Lace up your boots and opt in to tramp the lunar landscape of the Tongariro Alpine Crossing – home to three active volcanoes – or save your feet and take to wheels (or some optional skis). Ferry into the arms of the world’s best Sauv Blanc on the banks of the Marlborough Sounds and enjoy a private tasting in a family-owned vineyard. (B) DAY 10 NELSON. Rolling Deposit
If you cancel your trip more than six weeks before the departure date you may request in writing at the time of cancellation that we provide you with a rolling deposit voucher for use against a future trip. The value and currency of the rolling deposit will be the value and currency of the original deposit paid. The rolling deposit cannot be redeemed by re-booking the same trip for the same departure date originally booked. The voucher must be redeemed within two years from the date of first cancellation. The rolling deposit can be transferred to a friend but cannot be transferred a second time. The passenger must be between 18 to 39 years old to travel. Only one voucher per person per trip is permitted. If redeeming against a trip with a higher deposit the balance will be payable at the time of booking. Rolling deposits cannot be redeemed or refunded for cash. If you cancel your trip within six weeks or less of the departure date you will forfeit your deposit and you will need to pay our applicable cancellation fee. Governing law and jurisdiction
These booking conditions are governed by the laws of Queensland, Australia. Any dispute in relation to these booking conditions shall be subject to the exclusive jurisdiction of the courts of Queensland.

Your contract will be with Topdeck as tour operator, unless you have booked a Locally Operated Trip, in which case your contract for tour services will be with the operator specified above and will be subject to that operator's terms and conditions, in addition to the booking conditions set out below. For any Locally Operated Trip, the operator will be identified on your itinerary or travel documents and their respective terms and conditions will be available directly on their websites or by contacting them. Should we book a flight on your behalf it will be subject to the conditions of the respective airline, including but not limited to deposit/full payment and cancellation terms. Please read these booking conditions carefully. You must not make any booking unless you understand and agree with these booking conditions. Our trips are designed strictly for young people between the ages of 18 to 39. Bookings can be made through your local travel agent or directly with Topdeck and must be secured with a deposit of the amount shown above. A contract between you and us (or between you and the relevant operator of a Locally Operated Trip) will exist as soon as (i); we issue an invoice in response to your request for a booking and (ii); your deposit is paid to us or your travel agent. If your booking is made through a travel agent, we will address all correspondence to that agent. PRICE & PAYMENT The deposit is non-refundable unless we cancel your trip. The balance of your trip must be paid no later than 42 days prior to your trip departure date. If you do not pay within this period we may cancel your booking and your deposit will be forfeited. Full payment is required if you make a booking within 42 days of the departure date. If your booking is a special offer we may require full payment (including any pre and post accommodation and sundry service charges) by such earlier time as specified in the offer Prices quoted in our brochures are calculated on costs and exchange rates as at the Brochure Validity Date. These prices may increase or decrease. We may alter prices and other particulars contained in our brochures and on our website at any time. Before you make a booking we will provide you with details of the current price of your chosen trip. Offered discounts are subject to availability and may be withdrawn at any time without notice. TRAVEL DOCUMENTS Please ensure you carefully read your invoice, tickets and all other documents we send to you as soon as you receive them and contact us or your travel agent immediately if any information appears to be incorrect. We will not accept any liability if you fail to notify us of any inaccuracy in any document within 14 days of us sending them to you or the travel agent. You are responsible for ensuring that you have the correct and valid travel documents including passports, visas and vaccination certificates. We strongly recommend that you verify current documentation requirements with your travel agent or us. Please note requirements change and you must check with your consulate for the most up to date information, including but not limited to visa requirements for the countries visited on your trip. Passports must have an expiry date of at least six months after completion of the trip. IF YOU CHANGE OR CANCEL YOUR BOOKING If you want to change or cancel any aspect of your booking including but not limited to a change to a trip of shorter duration or different departure date you must notify us in writing. We will do our best to accommodate your requested change but it may not always be possible. We will not charge a fee for changes requested more than 42 days before departure except where we incur a cost from a supplier, in which case we will advise you of the relevant fee. All change/cancellation fees must be paid within seven days of the invoice date or on the date of departure, whichever is the sooner. If you are prevented from traveling as a result of illness, death of an immediate family member, jury service, or other reason beyond your control which we consider significant, we may agree to your booking being transferred to another person who satisfies all the conditions applicable to the trip, subject to you and the other person accepting liability for full payment of the trip cost and any additional costs arising from the transfer and provided that you give us not less than 21 days' written notice of the proposed transfer. CANCELLATION OR MODIFICATION BY US Every effort will be made to operate all trips as advertised but it must be remembered that our trips are planned up to eighteen months in advance. We may therefore, at our discretion, modify or cancel any trip, accommodation or arrangement at any time. We will notify you as soon as possible of any changes and they will form part of our contract with you. In the case of any material modification or cancellation, we will, if possible, provide you with three alternatives: (1) a trip of an equivalent or closely similar standard and price, if available; or (2) a trip of a lower standard together with a refund of the difference in price; or (3) cancellation with a full refund of all monies paid. A material modification is one that has a serious impact on your trip and includes a change of departure date, departure point or airport, or change of departure time of more than twelve hours, which would cause substantial inconvenience to you. A change of accommodation, or transport method/style is not a material modification. We may alter or substitute the type or size of vehicle, or method/style of transport mentioned in the brochure, depending on the number of passengers carried, which can vary from trip to trip. Normally the maximum group size is between 36 and 48 passengers. In certain countries there are strict laws governing drivers' hours and this may necessitate utilising public transport in some cities. Topdeck may require a minimum number of participants for certain trips. In the event that insufficient bookings have been made as at 42 days prior to departure, we may cancel the scheduled trip, whereupon all money paid by you for your Topdeck trip will be refunded and no further compensation will be paid. In such circumstances,
you agree to release Topdeck from any further obligations which would have been enforceable had the trip not been cancelled.
We cannot guarantee that special dietary requirements can be met and we cannot take responsibility for any such requirements not being fulfilled.
OUR LIABILITY TO YOU FOR TOPDECK OPERATED TRIPS Save where the provisions of Force Majeure apply, if the trip does not materially comply with the description in the brochure, Topdeck may compensate you to a maximum value equal to the price of the trip. Topdeck will only be liable to pay the maximum amount of compensation where there has been a total failure of consideration for your payment.
If you have a medical condition or require special arrangements that may affect your trip, we ask that you inform us in writing at the time of booking. If we cannot reasonably accommodate your particular needs we may decline the booking or ask for you to be accompanied by a person who is able to provide full assistance to you throughout your trip.
Topdeck will not be liable where any failure in the performance or provision of your trip is due to: (a) your acts or omissions or the acts or omissions of another member in your group (b) any third party not connected with the provision of your travel arrangements (c) unusual or unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised or (d) an event which we or a travel service provider, even with all due care, could not foresee or forestall (including but not limited to Force Majeure and unavoidable technical problems with transport and similar events). Our liability will in all cases be limited in accordance with and/or in an identical manner to any applicable international conventions, including but not limited to the Geneva Convention in respect of carriage by road, the Montreal Convention in respect of travel by air, the Athens Convention in respect of travel by sea, the Berne Convention in respect of travel by rail and the Paris Convention in respect of the provision of accommodation which set time limits for notifications/claims and limit the amount of compensation that can be claimed for death, injury, delay to passengers/guests and loss, damage and delay to luggage. We will not be responsible for any loss or damage sustained by you as a result of a contravention of any law or regulation of any of the countries visited while on the trip. OUR LIABILITY TO YOU FOR LOCALLY OPERATED TRIPS If your trip is a Locally Operated Trip as listed above our obligation to you is to (and you expressly authorise us to) make trip bookings on your behalf with reasonable skill and care and to arrange a contract between you and the relevant operator. We exercise care in the selection of reputable local operators but we have no control over, or liability for, the services provided by third parties. All bookings are made on your behalf subject to the terms and conditions, including conditions of carriage and limitations of liability, imposed by the local operator (available on request). Your legal rights in connection with such trips are against the local operator and are not against us, except to the extent a problem is caused by fault on our part. SEATBELTS You must wear a seatbelt at all times whilst you are in any vehicle. Neither Topdeck nor any local operator will be liable for any injury, death or claim howsoever arising from any accident if you have failed to comply with this requirement. FLEXIBILITY DURING TRIP Your booking is accepted on the condition that you understand, and take responsibility for, the risks inherent in adventure travel. Every effort will be made to operate all trips featured in this brochure but there may be a necessity to vary the itinerary from that stated in the brochure, and delays may occur for a variety of reasons beyond our control. The need for a flexible attitude to this type of travel is important. All decisions relating to a trip itinerary will be taken by the Trip Leader, as appointed by us in the interest of the group as a whole. Please note that due to public holidays some sights or activities may not be available on a particular trip. No refund will be made for services made available by Topdeck but which for whatever reason are not used by you once the trip has departed. OPTIONAL ACTIVITIES AND EXCURSIONS Topdeck and its employees, agents and contractors make no representation or warranty in relation to implied or explicit suggestions or recommendations of services, activities and events not highlighted as included in a trip. You are responsible for all risks associated with the transportation to/from, and your participation in, or visitation to, any place, activity or excursion not listed as an inclusion. During your trip you will be offered the chance to purchase various optional excursions and activities. Topdeck does not own, operate or control any of the companies or individuals which provide the optional activities or excursions. Some of the optional activities and excursions, such as canyoning, are inherently dangerous and risky. If you want to take part in such optional activities or excursions you must be fit enough to do so and must follow all reasonable instructions. The standards of health and safety which will be adopted by the company or the individual providing the optional activity or excursion will be those of the country where the optional activity or excursion takes place. Please note that these standards may not be the same as you would find in your home country. If you wish to book any optional excursion or activity, you may do so subject to the operator’s terms and conditions. Your contract will be with the operator of the activity or excursion and will be governed by local law. Topdeck acts only as their agent. Topdeck’s Trip Leader will have further details and additional information can be found on our website. Topdeck accepts no liability for any act or omission of any operator or operator’s employees, agents or sub-contractors. EXCLUSION OF LIABILITY – FORCE MAJEURE We do not accept liability for any loss, damage or expense resulting from war or terrorist activities threatened or actual, civil unrest, industrial action threatened or actual, weather conditions, fire, flood, drought, closures, unforeseen alterations to public transport schedules, rescheduling of aircraft or boats, epidemic or outbreaks of illness or any other event outside our control which either delays or extends or reduces the trip, or compels a change in the trip arrangements after departure (“Force Majeure”). DIETARY, HEALTH AND SPECIAL REQUIREMENT You must clearly state all your dietary requirements at the time of booking.
YOUR LIABILITY TO US You will not be permitted to embark or continue on the trip if your mental or physical condition is, in the reasonable opinion of any representative of Topdeck, such as to render you incapable of caring for yourself, or where you become objectionable to other passengers, or you become a hazard to yourself or other passengers. We will not be responsible for expenses resulting in you being precluded from completing the trip for any reason, nor will we refund you any part of your trip cost. In all cases we will notify you of the reasons why we have taken this action. We will have no obligation to arrange for your return to the point of the trip departure if your condition manifests itself after the trip departure. Further, if the trip involves travel by air, the captain of your aircraft can refuse to allow you to fly on the aircraft if he believes that you could be dangerous or disruptive to other passengers on the flight. You indemnify us against all third-party actions taken against us for loss or damage caused by you or arising from your participation on the trip. INSURANCE & CLAIMS You must take out comprehensive travel insurance before you travel on your trip. Your insurance protection must include cover for cancellation, medical and repatriation expenses, personal injury and accident, death, and loss of personal baggage and money and personal liability insurance. Evidence of such insurances must be produced to Topdeck on request and normally on day one of your trip. Insurance cover offered by credit card companies or reciprocal medical cover agreements are often not comprehensive. If you make a claim against Topdeck you agree to assign to us or our insurers any rights to take action against any third party supplier/tour operator or any other person or party that may have been wholly or partly responsible for the claim or who Topdeck reasonably considers should be a party to the action. You must co-operate fully with Topdeck should Topdeck or its insurers wish to enforce those rights which have been assigned to Topdeck. If you make a claim against us which is covered by your insurance policy, you agree to pursue the claim through your insurer either in addition to, or in substitution for, your claim against us (if any). We agree to indemnify you in respect of reasonable expenses incurred in successfully pursuing such a claim and acknowledge that any settlement made by the insurer shall not prejudice your rights against us. COMPLAINTS In the event of any dissatisfaction with the accommodation or any other service provided by Topdeck, you must report it immediately to the Trip Leader so that action can be taken to remedy the problem. Failure to immediately notify the Trip Leader of any problem may result in your claim for compensation from us being denied or reduced. Any complaint made to Topdeck following the conclusion of the trip should be made in writing within 28 days of completion of the trip. In the event that you do not notify us in writing within 28 days, Topdeck’s ability to investigate the complaint may be prejudiced. In the UK, we can also offer you ABTA’s scheme for the resolution of disputes which is approved by the Chartered Trading Standards Institute. If we can’t resolve your complaint, go to www.abta. com to use ABTA’s simple procedure. Further information on the Code and ABTA’s assistance in resolving disputes can be found on www.abta.com. DATA PROTECTION We are committed to protecting your personal information and agree to process your personal information in accordance with our Privacy Notice, which is available online at www.topdeck.travel/privacy. In order to make your booking and ensure that your travel arrangements run smoothly, we need to use the information you provide and pass it on to other relevant suppliers who are responsible for parts of your travel arrangements. In many cases this will include transferring your data to overseas recipients (including to recipients outside of the European Union). In making this booking, your consent to this information being passed on to the relevant persons is deemed to be given unless you object and advise Topdeck of your objection at the time of booking. The information may also be provided to public authorities such as customs or immigration if required by them, or as required by law. This consent applies to any sensitive information that you give to us such as details of any disabilities or dietary/religious requirements. SMOKING Topdeck enforces a non-smoking policy on our coaches (although we make frequent stops for breaks) and in most of our accommodation. LUGGAGE There are strict weight limits for coaches when fully loaded. You are only entitled to have one piece of main luggage of standard size (see the pre-departure information or our website for size limits) and not weighing more than 20kg (or 15kg for Outback trips). In addition you may bring a sleeping bag, as required on specific trips, and a daypack. PUBLISHING CONSENT You acknowledge and agree that future Topdeck advertising and publicity material may include statements made by passengers, or their photographs, and you consent to such use of your comments or photographic/video likeness. WI-FI Topdeck will endeavor to deliver Wi-Fi connection as stated on relevant trips to the best of its ability. This service is subject to availability and may not be available in remote areas, on some peak season departures or in the event of technical issues.
