Staff Privacy Notice

At Total Produce we are mindful of our responsibilities when we handle your personal data. Our Privacy Policy outlines the way in which we process all personal data including our practices regarding the collection, use, transfer, disclosure and other handling and processing of your personal data. Please familiarise yourself with the terms of the Privacy Policy. 1.

Summary of the types of your personal data we hold about you The personal data we process about you includes your name, contact details and other data about you which is required where: (a) it is necessary for the performance of our business; (b) we are permitted or required to have it under applicable law; or (c) it is necessary for the purposes of your employment. The categories of personal data we may collect, use, transfer, disclose and otherwise process may vary by country and applicable law, as explained in our Privacy Policy.

Why we have, and how we use, your personal data As set out in our Privacy Policy, we use your personal data for a number of reasons including:

for general business purposes, such as payroll activities, performance management, making business travel arrangements and/or improving products and services;

to comply with any legal requirement, such as record-keeping and reporting, honouring contractual obligations and/or healthcare obligations; and/or

to facilitate communication with you and your nominated contacts in an emergency and protecting the health and safety of staff and others.

Security of your personal data So far as practicably possible, we have in place appropriate legal, organisational, physical and technical measures to protect personal data. In addition, when we retain a third-party service provider, that provider will be required to: (a) use appropriate measures to protect the confidentiality and security of the personal data; and (b) process the personal data in line with relevant legal obligations.

Disclosure and transfer of your personal data Personnel across Total Produce will have access to your ‘business contact information’ such as name, position, telephone number, work address, and email address. Beyond this ‘business contact information’, access to, use of and other processing of personal data generally will be limited to individuals who have a need to know the information, which may include your manager or others appointed by him or her, as well as personnel in HR, IT, Legal and Compliance, Finance and Internal Audit departments. From time to time, we may make personal data available to other entities within the Total Produce group and to other parties, such as legal and regulatory authorities; external


professional advisors (such as lawyers, accountants etc.); and service providers (such as providers of payroll, pension scheme, insurance, medical benefits, human resources services, IT systems and support, and other third parties engaged to assist Total Produce in carrying out business activities) located wherever they operate. Due to the global nature of Total Produce’s operations, it may be necessary to disclose your personal data to persons in locations outside of the European Economic Area. 5.

Your rights in relation to your personal data You have certain rights with respect to our use of your personal data, which include the right: 

to access, amend, update, restrict, delete or object to the use of, your personal data;

to request information about the basis on which your personal data is processed; and/or

to withdraw your consent to the processing of your personal data (where the use of your personal data is based on your consent).

Please note that under applicable laws, certain personal data or certain uses of your personal data may be exempt from these rights. If you would like to exercise any of your rights as outlined above, use the contact details in Schedule 1, who will guide you in the process. 6.

Your obligations in relation to personal data You should keep your personal data up-to-date by informing us of any significant changes to your personal data. It is your duty to abide by all applicable laws and/or internal policies, standards and procedures, as may be amended from time-to-time, relating to the processing of personal data. In particular, you must not access or use personal data for any purpose other than in connection with, and to the extent necessary for, your work with us. Your obligation to keep the personal data of others confidential continues after termination of your relationship with us. Any proven breach of data protection laws and/or internal policies, standards and/or procedures may result in disciplinary action, up to and including dismissal.
