SRI LANKANS SUE PRESIDENTIAL HOPEFUL FOR TORTURE

BACKGROUND Campaign duration: April – June 2019

The International Truth and Justice Project (ITJP) contracted tpr media to provide media support linked to civil cases alleging torture against Sri Lanka’s presidential hopeful, Gotabaya Rajapaksa. There were two phases to the project which took place in April and June 2019. Phase I began on 5 April 2019 when The International Truth and Justice Project (ITJP), in partnership with the international law firm Hausfeld and human rights lawyer Scott Gilmore, filed a civil damages case in California against former Sri Lankan defence secretary, Gotabaya Rajapaksa, on behalf of a Tamil torture survivor, Roy Samathanam. Roy Samathanam made the complaint in the U.S. District Court for the Central District of California against Mr. Rajapaksa, who is a dual U.S. Sri Lankan citizen. A cease-and-desist notice was later filed in court (April 29) after three individuals purporting to represent Mr. Rajapaksa directly contacted Mr. Samathanam and threatened him. In Phase II (June 26), ten new plaintiffs, who remain anonymous in order to secure their safety, joined Roy Samathanam’s complaint, serving papers against Gotabaya Rajapaksa. The cases were brought under the Torture Victim Protection Act, which gives torture victims legal redress in U.S. courts. These cases are the product of a six year-long investigation by the International Truth and Justice Project (ITJP), in partnership with the international law firm Hausfeld.

Methodology

Phase I included a London press conference attended by plaintiff, Roy Samathanam, Yasmin Sooka (ITJP) and Scott Gilmore (Hausfeld). The focus was on media coverage in the UK, US and Sri Lanka. For Phase II, the focus was on getting the story of the new cases – which described horrific violations, many sexual – in the US media. We therefore decided to give a first-run exclusive to the Associated Press and provided advance background briefings. This resulted in widespread coverage in the US as well as the UK, Sri Lanka and India. Dozens of outlets covered the story, generating debate internationally. The following report provides a selection of the key coverage.

BBC World Service SRI LANKA GOTABAYA By Charles Haviland A federal judge in California has unsealed a civil lawsuit against a former top Sri Lankan politician, Gotabaya Rajapaksa, seeking damages over his alleged instigation of the killing of a journalist. Lasantha Wickrematunge, an anti-government newspaper editor, was gunned down in the Sri Lankan capital a decade ago. Mr Rajapaksa was then defence secretary overseeing the war to defeat Tamil separatists, and had declared that dissent was treason. The lawsuit's been filed by Mr Wickrematunge's daughter, Ahimsa. It's being coordinated with another suit in which a Tamil man -- Roy Samathanam -- blames Mr Rajapaksa for severe torture inflicted on him. Gotabaya Rajapaksa, who is a dual Sri Lankan-US citizen, denies guilt. (He's expressed interest in standing in Sri Lanka's presidential elections due this year.)
