TORONTO — As the Compensation Fund showdown wages on between ACTA, CATO and TICO, travel retailers are sounding off to Travelweek.
They say they’re in favour of a consumer-pay model for the Ontario travel industry’s Comp Fund, and some had choice words now that simmering tensions between ACTA and CATO on one side, and TICO on the other, have reached a boiling point.
Just over three weeks ago ACTA and CATO temporarily withdrew their appointees from the TICO board - until the TICO AGM this September, or until they were given a copy of TICO’s recommendations to the Ontario government on TICO’s future fee structure and Comp Fund funding. ACTA and CATO have also requested a meeting with Minister of Public and Business Service Delivery of Ontario, Kaleed Rasheed, to discuss the funding model before TICO’s consultation with registrants and stakeholders takes place this fall.
They were the latest moves in a back-and-forth that has erupted over potential changes to the Fund, after TICO announced the start of a comprehensive review back in September 2022. For months ACTA and CATO have been demanding more transparency on potential changes to the Comp Fund model, which they say could impact their members at a time when the industry is still getting back on its feet.
“ACTA and CATO have been denied details on the fee mechanism despite a decade of advocating for change,” said ACTA President Wendy Paradis last month. “Both ACTA and CATO have appointees on the TICO board and yet, have been excluded from this information despite numerous requests.”
TICO has long maintained that any potential changes to the funding model must be reviewed by the Ontario government first, before they’re made public to anyone - and that includes ACTA and CATO.
Last Friday TICO announced that, per five new orders from Minister Rasheed, TICO will decrease the number of TICO Board members from 11 to 9. ACTA said it was expecting the change.
The new TICO board will be limited to two Industry Directors involved with the industry, and three Public Directors with no stake in travel.
According to the four other orders from Minister Rasheed, TICO must “ensure all Board members possess a positive orientation for proactive consumer protection initiatives.”
TICO must also “ensure no more than 34% of the members of the board are drawn from the travel agent and travel wholesaler industry.”
TICO also must establish a nominations committee with requirements around eligibility criteria for nominated Board members.
Finally, TICO must establish an industry advisory council, “comprised of
members representing the interests of travel agents and travel wholesalers to report to and advise the board.”
According to TICO, these changes will help enhance consumer protection, enhance accountability for the sector; present an opportunity for TICO’s board to lead in governance best practices, mirroring the recommendations given by the Auditor General of Ontario to other Ontario regulators; and provide a forum for industry to identify issues and provide advice to TICO’s board.
“While TICO’s existing board structure has served the organization well for many years, this governance change brings added balance to the board and reflects best-in-class governance practices,” said TICO CEO Richard Smart. “This change allows for a more diverse range of voices to actively contribute to TICO’s consumer protection mandate, while still ensuring the industry has a strong voice at the table.”
When it comes to the Comp Fund, TICO has always said all options are on the table, from a risk-based funding model, to a consumer co-pay funding model, to no Fund at all.
The future of the Fund, and what form it will take, has been up for debate for many years. And just when it seems change is in the cards, along comes a new provincial government.

Travel retailers Travelweek spoke to are in favour of a consumer-pay model like in Quebec. “I absolutely believe it should be a consumer pay model, we should not pay into a system that really only … benefits the public and never ever … benefits the trade,” says Gilbert Manza, owner, Executive Travel Services.
He adds: “I’m sure that most in our industry would like to see TICO disbanded all together and have a different model. It’s a bureaucratic mess … [the system is] broken and needs to be either fixed to be fair to the industry or just dismantle it and let the industry police itself. The less government, the better.”
Christine James, Vice President, Canada, Travel Leaders Network, says she favours a consumer-pay model too, and she shares ACTA’s concerns. “Like most retailers, I’m in support of a model similar to the Quebec one … for obvious reasons, it’s far less of a financial impact for the consumer to pay the fee on their trip than it is for the retail agencies to take on the burden of every transaction they make on behalf of their entire clientele,” she tells Travelweek.
An industry insider says that what the government and TICO are doing is “a travesty. I am shocked that a conservative (and supposedly pro-business) government has done this. And to what end? Where is the huge consumer problem? Where are all the bankruptcies? And why won’t they allow consumer pay like Quebec so that then there could be REAL consumer
protection, and not the one they have now that is all funded on the backs of travel companies? It stinks to high heaven.”
The insider is also concerned about regulatory creep, with more red tape and bureaucracy: “This basically is back to before we ever had TICO and the government ran it all.”
TICO plans to host a webinar in the coming weeks to provide more information about how the Minister’s orders will be implemented and provide an opportunity for registrants and stakeholders to ask questions. “More information will be shared soon,” says TICO.
Meanwhile TICO is making the necessary by-law changes to implement the five orders, which will be presented at its AGM, scheduled virtually for Sept. 26, 2023 at 5 p.m.
TICO adds that similar governance changes have been implemented at other Delegated Administrative Authorities, including the Ontario Motor Vehicle Industry Council (OMVIC), Home Construction Regulatory Authority (HCRA) and Tarion.
ACTA notes that the deadline to apply for the industry position on new TICO board is Aug. 21.
“Regardless of this change in board composition, it is important that the voice of the industry is heard by TICO and the Ontario government – and to this end, there will be two industry directors on the new board and there will be an industry advisory council
formed,” says Paradis. “Anyone interested in being considered for the TICO board must apply by August 21, 2023.”
Paradis adds that ACTA is still in the dark about recommendations for any changes to the TICO fee structure and the mechanism for funding the Comp Fund.
“The Ontario government continuously ‘says’ it is committed to red tape reduction – a reduction in administrative and financial burden on Ontario business. They say…Ontario is ‘open for business’,” said Paradis in her statement earlier this week.
“The message that ACTA has delivered to government is clear. The industry cannot and should not be bogged down by unnecessary administrative burden to run a travel business in Ontario. The industry cannot and should not be required to financially support an ever-expanding regulator with increased unnecessary legislation and fees.
“Our message has been consistent. If the Ontario government is committed to a Traveller Consumer Compensation Fund in Ontario to cover potential bankruptcies, the current compensation should be fixed, including … that the beneficiary of the fund – the travel consumer – should be the contributor to that Fund as is the model in Quebec.”
Paradis adds that the industry “is recovering from a catastrophic global pandemic and should not and cannot support unnecessary administrative and financial burden.”

MONTREAL — Effective immediately, Air Canada Vacations has implemented a new commission payment policy offering enhanced financial protection and stability.
Travel agents will now be entitled to receive standard commission on any cancelled individual bookings made 45 days or more prior to departure (Cancelled with Deposit), with the exception of cruise and group bookings.
In addition, Air Canada Vacations will protect full commission on any schedule change that provides no option of reprotection and results in a cancelled booking.
A statement sent out this week outlining ACV’s commission policy changes, from ACV’s Vice President, Nino Montagnese, said: “Unforeseen schedule changes are an occasional reality, and we understand the challenges that travel agents face when cancellations arise due to schedule modifications beyond their control.”
Montagnese added: “The beginning of this year has been a busy and exciting time for us all as travellers are finally taking those long-awaited vacations. To further solidify our dedication to building stronger partnerships and ensuring shared success within the travel agent community, we are implementing concrete steps to support and empower our trusted travel agent partners with the tools they need to thrive in the
dynamic travel industry.”
In the event of unforeseeable and unavoidable Force Majeure situations that result in cancelled bookings, commission protection will not be applicable.
And for situations where customers voluntarily cancel their reservation due to their refusal to accept ACV’s offered alternatives, commission protection will not be applicable.
Montagnese thanked agents for their feedback. “Rest assured, we are committed to consistently seeking input at every opportunity to enhance the customer experience, promotions and offers,” he said. “Our ambition is to better serve you and make Air Canada Vacations the first choice, every time.”
With this in mind, agents are advised to stay tuned for more details on ACV’s new optional function to request auto-collection of the final payment on the customer’s credit card, similar to the initial deposit process.
ACV is also rolling out new functionality for its Flex Travel Tool, offering agencies greater visibility and control over their commission payout, and making it easier to track and manage their earnings.
“Agencies will have clear visibility of
all commissions paid and pending on their bookings, providing a comprehensive overview of their earnings,” says Montagnese.
Last week ACV debuted its ‘Dream of Sun’ interactive digital brochure, showcasing its 2023-24 Sun Collection. ACV is offering 1,000+, primarily all-inclusive, hotels across 45 destinations for the coming winter.

By Chris KinaszTORONTO — The RIU Hotels & Resorts team, in town courtesy of Sunwing to share updates with the trade, reports that business for RIU properties has recovered strongly following the pandemic with 2022 being stronger than 2019.
“Clients who didn’t travel for a long time are now doing all the travelling they missed,” Armin Kaestner, VP Sales, Contracting & BD for RIU in Canada, USA, Caribbean, Mexico, Costa Rica & Panama, told Travelweek during a recent interview.
For the remainder of 2023, forward booking trends are positive, with double-digit increases. The Canadian market, at several RIU properties in the Americas during the winter, account for 400 rooms daily.
RIU is answering to two major trends, said Kaestner.
“The first, after the pandemic, people are willing to spend a little bit more,” he said. “They’re looking for higher room categories and higher amenities, so this is why we created the Elite Club. We actually never thought about the Elite Club before the pandemic. We started thinking about it when travel started coming back and agents told us that people are looking for higher room categories and are willing to pay extra for,
for example, nice drinks.
“The second trend is that we see more and more groups travelling like groups of friends and multi-generational travel. We have a huge amount of connecting rooms and are the only hotel chain where you can book these rooms and have them guaranteed. This is a huge selling point for us.”

That option didn’t necessarily exist before, since adults-only was traditionally a more expensive rate compared to family hotels. Classic properties have been selling like crazy following the pandemic, Kaestner added.

Air Transat has added Brazilian carrier Azul Airlines to its connectair by Air Transat platform. Quebec-based travellers can now combine select Air Transat and Azul Airlines flights to destinations such as Sao Paulo (VCP) and Manaus (MAO) in Brazil, via a layover in Fort Lauderdale or Orlando. This addition brings the total number of partners accessible through the connectair by Air Transat platform to 12 and the number of additional destinations available in Europe, North Africa, the Middle East, Central and South America and Canada to 280+.
Canada Jetlines has capped off a successful Q2 in 2023. The airline reported Q2 operating revenues of $8.8 million, compared to $5.1 million in the previous quarter, an increase of 72.8%. Canada Jetlines continues to increase the operation of charter and ACMI (Aircraft, Crew, Maintenance and Insurance) flights, generating $6.34 million this quarter as compared to $3.38 million in the previous quarter, an increase of 87.5%. Total operating expenses for Q2 were $9.23 million, compared to $8.15 million in Q1, an increase of 13%. Total assets increased to $27,860,429 at the end of the current quarter, from $27,289,573 as at Dec. 31, 2022. Total liability increased to $33,753,436 at the end of the current quarter, from $28,948,171 as at Dec. 31, 2022.
The Canadian government has updated its travel advice for travellers heading to Hawaii. At its U.S. Travel Advice page, the Canadian government is advising Canadians to avoid non-essential travel to Maui due to the wildfires. Meanwhile both Air Canada and WestJet have extended their flexible change policies, through Aug. 31, 2023, for passengers flying in and out of Kahului Airport (OGG). The Hawaii Tourism Authority is updating the trade via posts on its site and reports that hotels in West Maui have temporarily stopped accepting bookings of future reservations. “While efforts are underway to fully restore electrical power, municipal water and communications, visitors are encouraged to refrain from attempting to reach West Maui accommodations for reservation adjustments until the situation stabilizes,” says the HTA.
The board of directors of The Barbados Tourism Marketing Inc. (BTMI) has mutually agreed to part ways with CEO, Dr. Jens Thraenhart. While the search for a new CEO is underway, CFO Craig Hinds will act as CEO until a replacement is found. “We have reviewed the BTMI’s business and operations and strategy going forward and we have agreed that the BTMI needs to go in a different direction to ensure the growth of Barbados tourism,” said BTMI’s Chairman of the Board of Directors, Shelly Williams, on Thraenhart’s departure. “According to the Central Bank, tourism continues to drive the economy in Barbados, through employment and generating business. Our focus is on making sure we deliver growth by looking at new and emerging markets, increasing airlift and cruise business, and all of the ways that will allow Barbadians to see the financial returns from tourism,” she added.
Beond, billed as the world’s first ‘premium leisure all-lay flat airline’ completed a US$17 million seed round from a group of investors. North America’s not on Beond’s network yet, but the airline says its plans to initiate flights “from a variety of destinations with the latest aviation and luxury travel innovations.” Beond plans to begin operations in fall 2023, with a fleet of A320s in a unique luxury, lay-flat configuration, bringing passengers to Maldives from Europe, the Middle East and Asia-Pacific.
MONTREAL — Air Canada has released its Q2 results, underlining the carrier’s strong performance as the blockbuster 2023 recovery continues.
The airline’s operating revenues for Q2 were $5.427 billion, up 36% from the second quarter of 2022.
Operating income was $802 million, with an operating margin of 14.8%, compared to an operating loss of $253 million in the second quarter of 2022.
“Air Canada’s second quarter results were driven by strong demand and show the effectiveness of our plan. As a result of the hard work of our people, the appeal of our growing global network, as well as our leading brand and product offering, operating revenues in the quarter reached $5.4 billion, an increase of 36% from a year ago. Operating income was $802 million, a year-over-year improvement of over $1 billion, and our adjusted EBITDA reached $1.2 billion with an adjusted EBITDA margin of 22.5 per cent,” said Michael Rousseau, Air Canada’s President and CEO.
Air Canada carried over 11 million customers across its global network in the quarter, a year-over-year increase of about 23%.
Despite having more trained resources than last summer and improved tools, however, Rousseau acknowledged that Air Canada’s operations in June and July “were not at expected levels. We are increasing our efforts to protect the customer journey from disruption, regardless of the cause. This includes using any influence we have, in such instances as pilot attrition at our principal regional partner or global supply chain issues, or working to mitigate the effects of situations beyond our control, such as disruptive storm activity in our key hubs and markets. We are confident that our efforts will generate positive outcomes.”
Rousseau added that Air Canada was particularly pleased with its international performance, propelling nearly 70% of the year-over-year increase in passenger revenues.
Air Canada Vacations continued to see high demand for leisure travel packages, and Aeroplan added compelling new partners and grew its membership.
Based on current passenger booking patterns, Rousseau said Air Canada sees prevailing strength in travel demand over the second half of 2023. “We continue to focus intently on cost discipline and liquidity management. We ended the quarter with more than $9.6 billion in cash, cash equivalents and investments. This will enable us to further invest in our business, deleverage our balance sheet and ensure our company maintains the resiliency and adaptability needed for long-term success and to navigate through evolving market conditions,” he said.
MIAMI — Norwegian Cruise Line’s brand new ship, Norwegian Viva, has set sail from Venice (Trieste).
Norwegian Viva is the second in NCL’s Prima Class, after sister ship Norwegian Prima.
Norwegian Viva departed for its first journey through the Mediterranean, sailing for Lisbon with stops along the way including Salerno, Cannes and Ibiza, among others.
The ship will sail a selection of Greek Isles and Med voyages through November, before homeporting in San Juan, Puerto Rico from December 2023 to March 2024 for a season in the Caribbean, with calls to Tortola, BVI; St. John’s, Antigua; Bridgetown, Barbados; Castries, St. Lucia; Philipsburg, St. Maarten; and St. Thomas, USVI.
In May 2024 Norwegian Viva will return to Europe for more Med itineraries.

TORONTO — A new partnership between Flair Airlines and travel tech company GO7 aims to put Flair bookings front and centre with travel advisors via the GDS, but like with most ultra low-cost carriers, there’s still no commission.
The partnership, using GO7’s travel distribution technology, will enable Flair to connect to global distribution systems (GDS), bringing Flair tickets to GDS-connected travel agents in Canada and around the world. Through its own IATA code (W1), GO7 allows airline customers to immediately sell their flights in the GDS.
It’s all part of Flair’s growth strategy through expanded distribution.
Flair’s growth plan is 50 aircraft by 2025, and back in September 2022 Flair CEO Stephen Jones told a media conference “we’re well on track for that.” With its expanding fleet of B737 aircraft, and 1,000+ employees, Flair, launched in 2017, has expanded to serve 35+ cities across Canada, the U.S., Mexico, and the D.R. Flair’s just-released July 2023 stats include 481,808 passengers flown and a load factor of 88%. The airline says 71% of its flights arrived within 15 minutes of the scheduled arrival time in July, and flight completion factor was 99.3%.

Canada’s other airlines struggled with delays and cancellations.
Earlier this summer Flair also announced it had ramped up its customer service efforts with the formation of a specialist customer service team, after CTA data showed that Flair had the highest number of complaints per 100 flights of all the major airlines in Canada.
Travelweek reached out to Flair to ask about the new GDS availability, and agent commissions.
A spokesperson for the airline told Travelweek: “We look forward to working with partners from the travel trade industry. Although Flair’s primary focus is on direct sales, we recognize that certain segments of the market still value the ability to book through a travel agent. That said, we don’t pay commission. We offer low fares which are attractive for agents’ customers.”
GO7 and Flair say their partnership will help the airline extend its sales reach to a broader customer base via indirect channels such traditional travel agencies and OTAs, who can now book Flair seats directly via the GDS using the W1 code.
“As an ultra-low-cost airline, our business model relies on keeping our expenses low. GO7’s innovative and no-complexity approach to expansion is exactly what our airline needs to grow,” said Garth Lund, Flair’s Chief Commercial Officer.

In 2025, AmaWaterways will launch Imperial Danube, a new seven-night itinerary sailing roundtrip from Budapest on the Danube River.
And the increased demand for longer vacations, AmaWaterways is bringing back its 14-night Magnificent Europe itinerary in 2025, cruising between Amsterdam and Budapest.
AmaWaterways’ 2025 bookings are open to individual travellers and groups, a key market for the cruise line.

MONTREAL — Air Transat is adding Lima, Peru to its portfolio with new direct flights from both Montreal and Toronto starting this winter.
Toronto–Lima flights will be operated twice weekly, on Wednesdays and Saturdays, from Dec. 20 to April 24. In addition, Montreal-Lima flights will be operated once weekly, on Fridays, from Dec. 22 to April 26.
The news follows Air Transat’s previously announced return of Montreal and Cozumel, Mexico service. Montreal-Cozumel flights will be operated once weekly, on Fridays, from Dec. 15 to April 26. Transat offers a wide range of all-inclusive packages to Cozumel at select hotel partners.

In the newly created role, Tanguay will be responsible for driving revenue growth in Aurora’s key markets as well as developing its sales strategy for potential emerging markets.
