ALWAYS QUESTION THE SURVEYOR ABOUT HIS OR HER SERVICES

Most banks, lenders and insurance companies request an elevation certificate if you are buying a property on the lake or any stream that is designated as a flood zone. However, the elevation certificate only calculates the rate that you pay. Your surveyor may be able to remove you completely from the flood zone because FEMA maps may contain slight errors in them. When requesting the elevation certificate from a surveyor, ask if they are capable of performing a Letter of Map Amendment (LOMA), which can remove you completely from a flood zone with no flood insurance premium.

It is important to ask for this service and question the surveyor as well as the bank or lender about submitting a LOMA. Always ask what will be provided when requesting a boundary survey on the lake or any piece of property. It is my opinion that everyone on the lake should request a boundary line agreement with Greenwood County. Question the surveyor about having possession of the 1938 surveys, as well as the capability of providing a plat of survey to submit to Greenwood County. A boundary survey on rural property should have the boundary lines marked, but if you do not ask you will encounter some surveyors who charge extra for this service. Usually, the client does not consider what questions they should be asking until it is too late.

My firm has been in business for over 25 years and has performed many Letter of Map Amendments and elevation certificates on flood zones. I have taken over 60 hours of FEMA courses toward the preparation of LOMA and elevation certificates. I have also been certified by FEMA to do Electronic Letter of Map Amendments, so I can receive the results quickly in one to five days, instead of the conventional 30- to 60-day LOMA. Each of the 1938 Greenwood County maps are compiled at my office for the benefit of my clients. As a purchaser or seller of property on or near Lake Greenwood, it is imperative that you are fully aware of the following information. I highly recommend that you not only work with a knowledgeable REALTOR® but that you also consult with the appropriate Lake Greenwood authorities, with a licensed surveyor, and with a knowledgeable attorney regarding the property and the 440 Contour Line prior to purchasing or selling your property.

Important points regarding the 440 Contour Line: 1

Greenwood County owns Lake Greenwood. It does not matter if your property is in Laurens County or Newberry County. No county official from Laurens or Newberry has any authority with regard to the lake.

Greenwood County acquired the property to build Lake Greenwood in the 1930’s. In most cases, the boundaries of the lake were set as the 440 Contour Line shown on plats maintained in the county engineer’s office. It is also sometimes referred to as the “high water mark” of the lake when it is full, though this term can be misleading since the 440 Contour Line may or may not be near the shoreline.

In many cases, the boundary line along the lake cannot be determined with certainty.

The 440 Contour Line today is not necessarily in the same place as the 440 Contour Line was when the land was acquired in the 1930’s. A contour line ‘moves’ as the ground changes. a

Erosion will cause the contour line in move inland.

Filling, although illegal, causes the contour line to expand into the lake. If filling has occurred on your property, you will never own the filled-in portion unless you purchase it from Greenwood County. It does not matter how long ago the filling was done or who did it. In many cases today, sellers are not even aware that part of their lot has been filled.

Silting can cause the contour line to expand into the lake.

In specific areas and for specific reasons, Greenwood County purchased some land beyond the 440 contour line. It is important to check for these instances.

In some places, Greenwood County owns easements outside of the lake bed. Most of those easements were created at a time outside the parameters of a 40-year title search. Therefore, an attorney may not know that easements actually affect your property.

Some areas of the lake have had problems with algae. Those problems have been treated by county and state authorities. However, there is no guarantee of the success of their efforts or that they will continue their efforts indefinitely.

The 440 Contour Line could have a financial effect on your property if you sell the property or even if you refinance the loan on the property. Make sure you have a clear understanding of this effect prior to purchasing, selling, or refinancing.

Your realtor, while well-trained and knowledgeable, is not an expert on Lake Greenwood, nor is he/she an attorney or surveyor. Do not neglect your due diligence with those experts out of an over-reliance in your realtor.

All new lakefront property owners are required to register the lake encroachments (docks, seawalls, etc) in their name after closing with Lake Management.

I

t’s the sound of the geese that fly over at sunrise. It’s the summer noises of crickets and frogs, and children giggling as they settle in at night. It’s God’s awesome majesty being revealed as the sun sets forming streaks of pink, orange, and purple so incredible you can’t take it all in as hard as you try. There are smells too, of steaks and burgers grilling for an evening meal. Fishermen who came early to cast by the dock are back at night catching just a few more. They will serve up bass, brim, and catfish later – with hushpuppies and cole slaw. Ice cold watermelon and baked beans will be on the table too.

Parents teach their young ones to ride on tubes, then boards, then skis. My Grandaddy’s dental ring is still at the bottom of Hidden Lake. It flew off on one of the last attempts at learning to barefoot on that glassy smooth cove. After slamming my face into the water hard and humiliating myself in front of that cute boy about a dozen times… I quit. Looking back… just wish I had the ring. The boy dumped me for a blonde… but we did have a beautiful summer – a bunch of us playing on the water – just being free. The memories go all the way back to five for me… with my Mom and Dad trying to teach all three of us – first not to be afraid of the water… to swim… and then… oh then we waited for Daddy to come home at night and pull us! Those days were magical. I can still feel them. Our lake irrigated garden demanded a lot during the morning hours – but the evenings were just incredible as it seemed the whole world of blue herons and jumping fish just settled down for the night. Lighting storms across Lake Greenwood still humble me. I can hear my Mom fussing that we had to get off the water… can remember my Dad sitting on our screened porch unafraid… just wanting to watch nature in peace. Fresh rain across the lake makes you feel alive, and glad to be inside safe and warm. This lake has changed in recent decades. We have gorgeous waterfront neighborhoods to rival them anywhere. We have more and more fun loving people coming here to retire and enjoy the beauty of what is yet to be. My 83 year old Dad looks like a child again as we all board the pontoon to watch the Fourth of July fireworks. We go back five generations around this area. The sprinkling of lake cabins he knew as a child have multiplied to what we see today. Yet, we are still so free of traffic compared with most other lakes. My Mom’s people come down from Chesapeake for visits to Lake Greenwood – just as they have since we were children. We board a boat and laugh and talk… and for just a few days act carefree as we used to do. Others are laughing and waving as they go by. Friends – friends who are Realtors out showing their clients. Clients - my clients who become friends even after I let a boat float off as we look at a house. Today I have neon green jet skis for my son to play on. I want Marshall to have the same incredible memories I do… and to share them with you, if you are wise enough to choose to come here. (Watch out for him please… he’s my heart out riding around full throttle.) It’s all good… on Lake Greenwood.
