Mississippi Brownfield Program 2012 Annual Report Statutory Requirement Section 49-35-27 of the Mississippi Brownfields Voluntary Cleanup and Redevelopment Act requires that “the department shall report to the Governor, Lieutenant Governor, Speaker of the House of Representatives, Chairman of the Senate Environmental Protection, Conservation and Water Resources Committee, and the Chairman of the House Conservation and Water Resources Committee on the status of the implementation of the Mississippi Brownfields Voluntary Cleanup and Redevelopment Program. The report shall include a list of all brownfield parties and brownfield agreement sites participating in the program, a map showing the locations of sites, a brief description of the brownfield agreement for each site, including the location of the site, the agreement implementation status of each site and to the extent practicable, information on the redevelopment or reuse of each site. The report annually shall highlight those sites included in the Program since the last annual report.�

Since the Brownfield Program was created in 1998, the Mississippi Department of Environmental Quality (MDEQ) has been able to put three hundred and forty (340) acres back into productive use (i.e., “Ready for Reuse”). In 2002, MDEQ was instrumental in the redevelopment of the former DeSoto County School Bus Lot into a two million ($2M) dollar commercial development along Commerce Street in Hernando. In 2006, eighty-seven thousand ($87,000) dollars in MDEQ services to the Tupelo Redevelopment Authority was able to help leverage over forty-four million ($44M) dollars in public and private investment to transform a former dry cleaner and fairground into Phoenix Award winning “Fair Park”. In 2011, MDEQ’s Brownfield Agreement paved the way for Elevance to commit to an investment of more than two hundred and twenty-five million ($225M) dollars and the creation of one hundred and sixty five (165) full-time jobs in Natchez. In 2012, MDEQ experienced continued interest in the Brownfield Program. This interest has been attributed to the efforts to educate parties about risk-based remediation and liability protection, as well as effective outreach. In 2012, MDEQ reached three (3) new Brownfield Agreements, and the total number of Brownfield Agreements obtained to date stands at twenty-three (23). In 2012, MDEQ received three (3) new applications. As required by the Brownfield Law, the Brownfield Agreements reached in 2012 and the newest applicants are highlighted in this annual report.

2012 HIGHLIGHTS On 10/28/2010, the Commission reached a Brownfield Agreement (#5849-10) with Whirlpool Corporation for the remediation of the Whirlpool facility in Oxford, Mississippi. On August 17, 2012, and in accordance with Section 702 of the MDEQ Final Brownfield Regulations – Subpart I, dated February 28, 2002, Whirlpool Corporation sent a petition to the Commission to make a determination as to the completion of Brownfield Agreement and as to the issuance of a “no further action” letter by the Executive Director. The staff has reviewed the petition, has conducted the required inspection of the Brownfield Agreement Site, and hereby recommends that the Commission issue an order in accordance with the Brownfield Regulations concluding that Whirlpool Corporation has completed Brownfield Agreement #5849-10.

2012 BROWNFIELD AGREEMENT SITES City Center Brownfield Agreement Site Brownfield Agreement Reached – September 27, 2012  Brownfield Party: City of Ridgeland Ridgeland, MS The Commission and the City of Ridgeland reached a Brownfield Agreement regarding the remediation of brownfield property located at the former Madison Materials and Jackson Ready Mix Sites in Ridgeland, Mississippi. The site is hereafter referred to as the “City Center Brownfield Agreement Site." The City agreed to remove and dispose of an Underground Storage Tank (UST) and associated piping. The City plans to redevelop the brownfield property into City Center, with a new city hall, performing arts facility, green space, and commercial/retail developments.

Colle Towing Company Brownfield Agreement Site Brownfield Agreement Reached – September 27, 2012  Brownfield Party: The Colle Company, Inc. 3802 Port River Road Pascagoula, MS On September 27, 2012, the Commission on Environmental Quality reached a Brownfield Agreement with Colle Towing Company. The remediation of a portion of former Colle Towing Company facility lays the foundation for Signet Maritime Corporation to expand its Shipbuilding & Repair Division. Signet Maritime will match $3.6M from the Katrina Supplemental Community Block Grant Program for a $7.2M investment in the Pascagoula facility. Signet Maritime will increase the current workforce in the Mississippi Division by 50 people over the next 3 years. Signet has already started the hiring process for thirty-two of the fifty people in preparation of the construction of a 60 Metric Ton Bollard Pull tractor tug to be named SIGNET MAGIC. The SIGNET MAGIC will increase the Signet Pascagoula Harbor Tug Fleet and lower the average age of the Fleet to 3.2 years. The current construction schedule calls for steel cutting to commence begin immediately to meet the delivery date of July 2013. In addition, the grant funding will provide new berthing, drainage and support buildings to support the Pascagoula repair and construction facility and will aid the growth of Jackson County and the Jackson County Port Authority. CECO Building Systems Brownfield Agreement Site Brownfield Agreement Reached – November 29, 2012  Brownfield Party: Robertson Ceco II Corp. dba Ceco Building Systems c/o Tommy McTaggart PO Box 6500 Columbus, MS 39705 On November 29, 2012, the Commission approved the Brownfield Agreement between the Commission, NCI Building Systems, Inc. and Robertson Ceco II Corporation dba Ceco Building Systems regarding the remediation of brownfield property located at 2400 Highway 45 North in Columbus, Mississippi. The site is referred to as the former “Ceco Building Systems Brownfield Agreement Site." The Site is subject to an Environmental Covenant pursuant to the Uniform Environmental Covenants Act (“UECA”), Miss. Code Ann. § 89-23-1, et. seq. (Rev. 2008) that includes land use restrictions on the property.

Targeted Brownfield Assessments (TBA) MDEQ provides limited contractual environmental assessment services (Phase I / II ESAs) to eligible entities within the State. MDEQ’s TBA Program is designed to help cities, counties, state agencies, and eligible non-profits minimize the uncertainties of contamination often associated with brownfields. TBAs supplement and work with other efforts under MDEQ’s Brownfields Program to promote cleanup and redevelopment of contaminated sites in Mississippi. During this reporting period, MDEQ provided Phase I and/or Phase II

Environmental Site Assessments, resulting in a total savings to communities of almost $82,000 for three (3) properties in the following communities: Cary Pelahatchie Ridgeland Outreach Each year, the U.S. Environmental Protection Agency solicits proposals for communities interested in receiving grant funding for brownfield redevelopment activities. In 2012, communities in 39 states shared $69.3 million in EPA Brownfield grants to help clean up, revitalize, and sustainably reuse contaminated City Leaders receive ask questions about EPA brownfield grants at annual MML Conference properties, turning them from problem properties to productive community use. The grants, awarded by the U.S. Environmental Protection Agency, provide funding to eligible entities through brownfield assessment, revolving loan fund, and cleanup grants. Historically, Mississippi communities have been unsuccessful in securing these competitive EPA Brownfield Grants. In 2010, no Mississippi communities were awarded an EPA Brownfield Grant. In 2009, only one (1) community received a grant (Hattiesburg). Recognizing the competitive nature of the national grant writing field, coupled with a reduction in its own EPA Brownfield grant, MDEQ stepped up its outreach efforts to help communities write better grant proposals. In cooperation with the Mississippi Municipal League (MML) and EPA Region 4, the Mississippi Department of Environmental Quality (MDEQ) for the past two years has been holding an “Advanced Brownfield Grant Writing Workshop� at the Mississippi Coast Coliseum and Convention Center during the annual MML Conference in Biloxi, Mississippi each year. The purpose of the Advanced Workshop is to provide communities in Mississippi that have been unsuccessful in receiving an EPA Brownfield Grant an opportunity to receive feedback on their grant proposals from technical experts who have been successful in securing Brownfield Grants. One goal of the advanced workshop is to identify weaknesses that should be eliminated and strengths that should be highlighted. With three (3) successful grants awarded to Hernando, Columbus, and McComb in 2012, coupled with two (2) grants awarded to City of Quitman and the City of Page 6 of 7


Gulfport in 2011, MDEQ believes that the enhanced outreach efforts have shown positive results. In addition, a fair number of new grantees have applied this year in hopes of receiving an EPA Brownfield Grant in 2012. Among the communities applying for a 2013 Brownfield Grant are: 1) Corinth 2) Greenville 3) Hattiesburg 4) Holly Springs 5) Jackson 6) Meridian 7) Moss Point 8) Pascagoula 9) Starkville 10) West Point In 2012, EPA received 683 proposals, requesting over $263M from across the nation. Because this is a highly competitive grant program, EPA awarded only 172 grants totaling $58.9M. Mississippi’s success rate (i.e., “batting average”) has steadily climbed over the past several years and can be attributed to the collaborative outreach efforts of MDEQ, MML, and the brownfield consulting industry.
