The Federal Government has introduced significant changes to aged care legislation which took effect on July 1 with the goal of making it easier for individuals to

“I heard that if I leave my daughter $1 in my Will, she won’t be able to bring a claim on my estate. Is this true?”

The short answer to this question is “no”. This is a common ‘myth’ but is completely false. In fact, leaving a token gift will most likely have the effect of angering the person you wish to disinherit which may encourage that person to bring a claim on your Estate. In all States of Australia, a child (and other eligible applicants) has a statutory right to make a claim against the estate. The law considers that there are some family members or other people to whom we owe a moral duty to make provision for in our Wills – and such provision must be sufficient in the circumstances. In some cases, the conduct of the child or other applicant can justify limited or no provision from an Estate. Examples include: • Where there has been a substantial failure by the child/spouse to communicate with the deceased over a long period of time, including failing to meet the needs of the deceased where the deceased was suffering ill health; • Where the child of the deceased has made continual threats of violence to the deceased or the deceased property; • Where the person has engaged in serious criminal activity for example murdering their parent/spouse. However, there are some surprising circumstances where actions by a child or other applicant have not been considered by the Court as “disentitling conduct ” . These circumstances include: • Estrangement arising from a parent’s divorce when the child was a minor; • Estrangement caused by the conduct of the deceased;

• Marrying someone of whom the deceased does not approve; • Ceasing to observe a religion; • A child acting otherwise than in accordance with a parent’s wishes (e.g choice of lifestyle); • Misappropriation of a parent’s assets by child may not be conduct disentitling, subject to the extent of the misappropriation. The Court has found that disentitling conduct is conduct “sufficiently egregious as to justify exclusion from a Will”. It’s important to remember that each case will depend largely upon its own circumstances. Nevertheless, many may be surprised that it is difficult to ‘disinherit’ an offending family member. It is therefore necessary when a will maker wants to cut someone from their will that they understand the pitfalls that could follow and obtain proper legal advice from an experienced estate planning lawyer before making their will. A claim by an aggrieved child/spouse could cause your Estate and your loved ones significant expense and delay.

From previous page who can afford it to contribute a higher proportion of the cost of their care, while providing more flexibility and choice. Those entering a residential aged care facility after 1 July 2015 will pay a basic daily fee for their care set at 85 per cent of the pension. They may also be asked to pay a further means-tested care fee if they can afford to. An annual cap for these care fees has been set at $5000 for a part pensioner in home care, $10,000 for a self-funded retiree in home care and a means tested maximum of $25,000 in residential care. There is a lifetime cap of $60,000 for any individual though and once this figure is reached they will pay no more care fees for the rest of their lives. The cost of a room in an aged care facility is up to the service provider and will be determined by market forces. While all facilities set aside a number of beds for those who can’t afford to pay most are reserved for full paying customers. These costs, which can be paid as a lump sum or over time, can be substantial and will usually also require a bond of several hundred thousand dollars to be lodged with the service provider. It is strongly suggested, by the government

and industry insiders, that people seek professional financial advice well before the time when care is needed so they have a clear idea of their situation and are able to plan properly. Keep in mind as well that anyone entering aged care will require an assessment by an Aged Care Assessment Team (ACAT) which can be arranged through your doctor. The ACAT assessment will determine the level of care required – and the accompanying fees – as well as allowing the facility to determine the most suitable room and what type of setup is required. Once you have a clear image of your financial obligations and position it is time to find a home where you or your loved one will be comfortable. It is important at this stage to keep in mind you are talking about finding a new home, not just a place to stay, and the primary consideration should be finding somewhere you are happy. While there may be a perception that aged care facilities are institutional and impersonal this is something which has changed markedly over the years. Most facilities will offer respite services to give you a chance to ‘try before you buy,’ allowing your loved one to meet people and experience what their potential new home will be like. It’s also important to ensure that if residents are still somewhat independent that they have access to shops and services to maintain their quality of life. Effort is made for every person in the aged care system to be handled according to their own unique needs, a situation which can make the process seem incredibly complicated, but there are definitely significant advantages and benefits for everyone involved. Benefits of entering aged care include 24 hour medical supervision, monitoring of medication administration and monitoring of food and nutrition. Just as important from a quality of life perspective are activities programs, social contact and access to in-home allied health services such as physiotherapy and podiatry while for family members there is peace of mind that mum or dad is being cared for, is safe, being fed and has social contact. Seniors Dating

A NEW WORLD OF OPPORTUNITIES

aking the leap and jumping feet first into the dating pool is always something of an intimidating prospect. For seniors who are emerging from long term relationships, with circles of married friends who defined their social circles, the sudden change in lifestyle can come as a huge shock and leave them feeling isolated and alone. Seniors who find themselves suddenly single, whether it be through divorce or the death of a partner, can find themselves in an unfamiliar world of dating apps and hook-ups, a situation which can be even more intimidating to those who aren’t confident with their computer skills. There is no doubt the dating landscape has changed significantly since the introduction of the internet. The old, desperate sounding personal ads in the back of newspapers have evolved into specialised websites with photos, profiles and contact information. Where advertising for companionship was once something of a taboo it has now gone mainstream with people young and old comparing their postings with those of friends and family members.

The good news though is that these sites offer the possibility of making more connections with a wider group of people than has ever before been possible. Where previously the options were limited to the members of your social circle and the single friends they chose to introduce you to, you now have the power to browse through a long list of people in the same situation and to contact them directly. The sites are generally designed to be very easy to use – much easier than the Facebook site many use to stay connected – and most will offer extra assistance to seniors, the fastest growing segment of online daters. When considering whether or not to set up your profile though there are some basic, age old things to consider. First of all, are you ready? Dealing with the fallout from the end of a long term relationship or grieving for a partner who has passed away takes time. Sex and Relationships expert Dr Pepper Schwartz, who has written more than 16 books on the subject, said jumping in too early can lead to more trouble than it is worth. “Just because it’s relatively easy to find a po-

tential partner doesn’t mean you should start dating before you think about your goals and desires,” said Dr Schwartz. “Meeting new prospects before you’re emotionally prepared can feel infinitely worse than sitting home alone every Saturday night.” Dr Schwartz offers a series of statements she says everyone should agree with before they even consider looking for a partner, including ‘I’m totally over my previous relationship,’ ‘I am not bitter about the past,’ ‘I know how to listen,’ ‘I’m ready to have good time’ and ‘I don’t expect instant success.’ “If you agree with all of them, go forth and conquer, if not, pay attention to those areas you need to work on,” said Dr Schwartz. This is a sentiment shared by Kathy Damer, founder of the website www.senior-dating.org which contains a massive amount of articles, posts and other information on the topic. “Even if your friends have been there for you through your loss, you need to make sure you are ready for the next phase of your journey,” said Ms Damer. “Spending some time developing your interests and changing the way you have always put others first – your spouse, friends or kids - to putting yourself first for a change, will help to refocus you. “Believe it or not this will be an incredible time in your life where it’s all about you now, you have done your work raising your family and being a good partner and you now get to choose the people you want as friends and your time is your own, so spend it wisely to find out what makes you tick and associate with people who make you feel good. All of these will also offer some assistance in setting up your profile and advice on how to make it as appealing as possible to others. As a general rule you should avoid sites which are completely free as a nominal fee will deter scammers and time wasters. One final piece of advice is to be wary of people who seem too good to be true. Every profile you see is set up to make people look as good as possible and hide their flaws. Always reserve your judgement on people until you meet in person or at least speak on the phone and can get a good indication of their personality. The following then is a short and by no means complete list of dating websites which make a special effort to cater for Australian seniors. eHarmony While most dating sites allow you to browse photos and profiles and make your own selections eHarmony takes a different approach, with members completing a comprehensive compatibility test and then being matched with others. The reason for this is that when browsing profiles we often make selections for the wrong reasons, or reject those who may be

compatible on the basis of a bad photo or other trivial piece of information. With seniors making up almost 20 per cent of the site’s members the pool of people to choose from is significantly larger than other sites. Due to the in depth profile all members must complete it also tends to weed out the ‘just looking’ types and its membership is made up of people genuinely seeking a long term relationship. This does come with a significant cost involved, however keep in mind you are paying for a service which is aimed at making a good match for you where others are just about presenting possibilities. RSVP If you are looking for the largest possible pool to jump into RSVP is the one for you. Used by 69 per cent of all online daters in Australia – that’s more than a million profiles and another 1200 signing up every day – it is fairly safe to say there is someone on RSVP for everyone. If you’re feeling confident and don’t mind working your way through a large number of profiles to find the right match then this could be the site for you. The site offers a number of tips for seniors along with advanced search options and several different levels of service – at different price points – to cater to all needs. That high number of users can be a bit intimidating for those who are looking to take it slow however as you can be swamped with potential suitors – especially true for women. It also makes it easier to pass quickly by those without

Tinder With all the focus on new relationships and finding the perfect match we can’t lose sight of the fact that it’s not always about finding ‘the one.’ Sometimes it’s just about finding the ‘one for now’ and having fun. As we all know as well going into things with such an attitude is rarely a bad idea and there are plenty of stories of people ‘hooking up’ on Tinder and falling in love forever. Tinder is an incredibly easy to use app which can be downloaded for free to any smart phone and is aimed specifically at those looking to meet first and ask questions later. Once you make the necessary adjustment to the age category you can start swiping left or right to your hearts content. Keep in mind though it is designed and aimed at under 30’s so might not be everyone’s cup of tea.

What’s the best way to restore nutritional balance and prevent or manage chronic lifestyle disease? Australians spend billions per year on nutritional supplements. Put the Tweed Regional Gallery on the top of your list of places to visit. The Gallery is a wonderful venue for spending a few hours or a half day. With its seven exhibition spaces and the Margaret Olley Art Centre there is always a visual feast on offer to indulge visitors to the Gallery. How to start and keep an active lifestyle by Exercise Physiologist Paul Cavendish When exercise is correctly recommended, it has the potential to be as effective as a combination of pills to keep us healthy. In fact your level of fitness is now considered a key marker for defining your health and life expectancy over many other medical measurements as it also relates to quality of life. While the benefits of activity is increasingly accepted in the wider community, it is still difficult to start and keep an active lifestyle for the majority of the population. So here are 5 tips to help you make exercise part of your daily habits: 1. Set aside a time It sounds obvious but once you decide to be active, think about the time you wish to do this. Some of us love waking up early and doing a morning walk or swim. For others this doesn’t work-never has never will. Placing activity on a “To-Do” list helps you prioritise it into your day and you will stick with it until it just starts to become second nature. If you are someone with sore joints, perhaps a later start in the day, or after a shower, may help you to loosen up. Try to avoid the middle of the day as it is always a hard time, especially in our climate… 2. Start small There is more and more evidence that activity is the key. You don’t have to do a lot and any movement counts. Aim to start with activities that you can manage. Don’t worry so much

about the length of time, just start to get into the habit. Before too long you will be finding it easier to exercise for longer periods and your enjoyment will grow with the minutes you are able to put aside.There are many opportunities in our day to increase activity. Common examples that I recommend to my clients are: • p lace small weights or bands next to the couch for strength activity during ads on TV; •w alk a block when you go to check the mail; •d o some window shopping at your local shopping centre (flat paths, good temperature and sitting options make this perfect for a walk each week); •d o some stretches while you wait for the kettle to boil; • s trengthen your arms by lifting the milk or canned goods a few times before putting them away; The benefits of activity are there, whether you can do it all at once or break it up throughout the day. Soon enough you will be finding you meet the recommended time of 30 minutes of activity a day, whether this be in chunks or in one go. 3. Seek help If you haven’t been active for a while, or are taking prescribed medication, discuss some options to be active with your GP or an exercise physiologist (EP). Your doctor may have some good suggestions, or can refer you 71808

to a program or a consultation with an EP to help get you started safely and find a routine that is best suited to you. When you start out, some soreness is normal, but it should go away as you get used to activity. If you feel sick or have strong pain, you have done too much and must monitor this closely. Listen to your body and make sure you stop, or don’t exercise when you are unwell. Activity like walking is a good way to start exercising as it is something your muscles are more used to do but still involves many muscles and therefore gives us great benefits. Another great source of information on the amount of exercise and types of activity that you can do safely for a range of health conditions is www.exerciseismedicine.org.au 4. Join in with friends Your partner, friends and family are probably struggling with keeping up a routine the same as you. Activity that combines social time is very beneficial. Activities such as group exercise classes, bowls, tennis or walking groups, help you stay motivated and engaged. Remember, any activity counts, for example joining in at the Men’s Shed or doing Tai Chi. Group activity helps you stay connected to your community, establish new or more friends and above all, have fun while you improve your physical and mental health. Continued next page

There are many opportunities and it doesn’t need to be long but any activity, especially if you do sit down for extended periods, will help lower your risk of a number of diseases. If you are keen to know how fit you are, you can find out your specific level with an exercise physiologist. You can also try a number of online questionnaires that estimate your “fitness” age. I recommend World Fitness Level (www.worldfitnesslevel.org) as it has had plenty of research behind their justification.

Dementia Support At first glance Graeme and Vicki Noonan look like any other couple living the dream of early retirement on the North Coast. Physically fit, enjoying their freedom after raising a family and financially secure after successful careers these are meant to be some of the best years of their lives, a time when long term plans come to fruition and the focus turns to social engagements and leisure activities. But life took an unexpected turn for the Kingscliff couple when Vicki suffered the first of a series of strokes in 2004, an event which Doctors say triggered Early Onset Dementia. Once a confident, strongly independent school teacher the disease has triggered crippling anxiety and depression issues which make it difficult for her to be in social situations or left on her own. She has become more and more dependent on

Graeme for her basic needs – a situation which will only get worse over time. “People don’t realise what goes on behind closed doors, it’s not a visual condition so people can’t see the extent of the problem,” said Graeme. “It has been incredibly frustrating for Vicki of course but the impact on our whole family has been massive.” “Graeme has to be around a lot or I just don’t feel safe,” said Vicki. “It has been a learning situation for both of us, especially with many of the little things you would never even think about normally but become major issues.” A major report commissioned by Alzheimer’s Australia and compiled by Deloitte Access Economics, Dementia Across Australia 2011-2050, asserts that dementia is “without question the single biggest health issue facing Australia in the 21st century.” Continued next page

From previous page While projections show there are around 315,000 cases in the country by 2020 within 30 years that number is expected to skyrocket to 950,000 by 2050. There is no cure for the disease and as yet no drugs developed to slow its inevitable progression. In her forward to the report Alzheimer’s Australia’s National President Ita Buttrose said those numbers, staggering as they are, only tell a small part of the story. “They do not show the life-changing impact that a diagnosis of dementia can have on a family,” said Ms Buttrose. “They cannot convey the agony of coming to terms with the effect of dementia on a loved one. They cannot capture the struggle of finding appropriate care services, or the slow process of building trust with service providers.” Vicki and Graeme however, like many other couples on the Far North Coast, are full of praise for the efforts of staff and volunteers at Lifebridge Australia, an independent, not-for profit organisation which has been providing a range of support programs in the Tweed Shire since 1987. With 30 staff and more than 100 volunteers they run social programs, group outings and provide respite to more than 150 clients. “I was actually volunteering for Lifebridge at the time of Vicki’s diagnosis, driving their bus for outings, and it has been a tower of strength for me to have their support and know they are a phone call away,” said Graeme. Lifebridge Australia Program Officer Sue Woods said their approach to care which follows the Montessori Education principles of

‘relate, motivate, appreciate’ sets them apart from service providers in other areas. “We are miles ahead of the game in terms of helping people who are not yet at the high level of care requirement,” said Ms Woods. “In the future there will be more and more emphasis put on non-pharmacological methods where the focus is on an individual’s remaining strengths and abilities and tailoring an approach to their particular needs, which is something we are already doing. The goal is to maximise independence and autonomy as much as possible.” Assistant Manager of Aged Services Sue Trickey said one of the main messages they work to get across to clients and their carers is that the diagnosis does not mean an end to positive life experiences. “There is a sense of fear and foreboding in the community when it comes to dementia but the

stigma isn’t fully deserved,” said Ms Trickey. “It’s not a helpless situation, there can still be some real quality of life with the proper levels of support and education and people can still live well as long as their needs are being met. “The key for us is the total commitment of our staff to the programs we have put in place to ensure our clients can still lead a fulfilling life.” Ms Trickey said the industry is going through a number of changes with the client-focused model of care becoming much more the norm. “Many of these changes are being accelerated by people like Vicki who have the early onset variety of the disease and are writing books and blogs about their experience,” she said. “These people are changing the landscape and are forcing the medical industry to change the way they are dealt with. The next step is to get a client-centred funding approach in line with what has been implemented with the National Disability Insurance Scheme which will make it easier to tailor treatment to an individual’s needs.” While Vicki and Graeme Noonan say the diagnosis has certainly turned their world upside down they say it has not meant an end to their ability to enjoy their lives together. “Lots of it is about learning as you go, how to adapt to new situations and challenges, but we still have a laugh,” said Vicki. “It does change your relationship but that’s something you just have to learn to go with and approach with humour whenever you can, it’s not all doom and gloom. “Lifebridge has been a massive support to us. It has meant so much to be involved in their groups and to meet other couples in similar situations to ours.”

60 years on – Meals on Wheels still deliver Meals on Wheels is a known and trusted organisation which for the past 60 years has been helping older Australians remain in their homes. Meals on Wheels Tweed has been part of the fabric of the Far North Coast community since 1986. We continue today with a committee made up of dedicated local people and a band of fantastic volunteers. Meals on Wheels Tweed serves the area from Pottsville in the south, north to the Queensland border and west to Terranora and Bilambil. We assist by providing a large range of nutritionally balanced snap frozen meals in two convenient sizes. We cater to diverse dietary needs such as low salt, gluten free, low fat and diabetic. As well as a large range of soups and desserts we provide texture modified meals. There is no minimum order for Meals on Wheels and no delivery fee. Our friendly volunteers deliver to most areas three times each week. Call us for a chat and to discuss your dietary requirements and delivery times. Our delicious meals are priced at $4.70 for the small meals and $6.70 for the large size meals. We have a range of payment options including credit card, cheque, cash or monthly account. Our philosophy is to help where we can and provide more than just a meal. Our caring volunteers also assist us with Social outings for our meal recipients to help them maintain contact with their community. If you receive meals from Meals on Wheels Tweed you can also participate in our Social outings.

Some of our Meals on Wheels clients enjoying a social outing. Meals on Wheels Tweed is able to assist you with the My Aged Care service registration. Recent changes mean that eligibility is assessed by the Department of Social Services through My Aged Care. We can assist with the process and help make sure that your needs are taken

Meals on Wheels Tweed is based in Kingscliff and operates out of premises next door to the Kingscliff Library in Turnock Street. If you are interested in becoming a volunteer, or if you, or someone you care for, requires assistance with meals then please contact the friendly staff who will be happy to discuss our service with you. Gardening Tips for Seniors G

ardening is good for you on so many different levels, with demands on your muscles that make going to the gym or yoga classes redundant, a connection to the earth that enriches the soul and the intellectual exercise of planning the perfect beds. Add to this the fact that it produces an abundance of highly nutritious and delicious food and there is no wonder it is the favourite activity of hundreds of thousands of Australians. After a few years though, as many gardeners will note, what were once relatively simple tasks become a bit more taxing and jobs around the garden start to take just a little bit longer to complete. Rather than taking this as a cue to hang up the spade and gloves though there are plenty of ways to adapt and ensure you are able to enjoy your garden for many more years. The first step is to look at the tools you are using. Those traditional, old, heavy, steel shovels and forks may have been handed down from your parents and grandparents but these days, thankfully, there are much better options. Continued page 22

From page 21 Look for lightweight hand tools with rubber handles and ergonomic designs which will make everything easier on your hands and greatly reduce the amount of effort required. If you can’t bear to part with your favourites try covering the handles with foam insulation to make them easier on your hands and using handle extenders to save your back. Always keep tools sharpened as well, they will work better and save your strength for where it is needed. If you’re becoming less flexible perhaps it’s time to think about raising your beds or using containers so you don’t have to constantly bend down to ground level. You can have beds built, purchase a custom designed system or create your own containers using recycled materials. Anything from old washtubs to eskies and wheelbarrows can be used to set up a system which will extend your gardening career for years to come. Another tip is to look at what is actually planted in your garden and replace high maintenance plants with ones that don’t require as much work. We all love a garden full of colourful annual flowers but planting natives or bulbs can create a display which is just as varied and pleasing to the eye while drastically cutting down on the amount of maintenance required. A well planned native garden, with plenty of mulch put down to deter weeds, only requires a bit of attention here and there to ensure it continues to thrive and be healthy. While taking a stool, a bench or even a chair into the garden with you might seem too much like crossing over to the ‘other side’ this could be a case of not knocking something until you try it. The amount of stress on your joints you will save will make you a convert. Making use of trellises and vertical gardens is another way to keep from excessive stooping when it comes time to harvest. If your vision is starting to go it’s a good idea to paint your tools in bright colours so they will stand out and can be easily located. It also might be good in such a case to plant varieties which enhance the senses of touch and smell, remember the garden is your space and can adapt to your needs. 71759
