UNIVERSITY OF CENTRAL ARKANSAS ATHLETICS DEPARTMENT ACKNOWLEDGEMENT, RELEASE AND WAIVER OF LIABILITY I am the parent or lawful guardian of the child(ren) named above. I desire to allow my child(ren) to participate in activities involving inflatable equipment (bounce houses) on the campus of the University of Central Arkansas (“UCA”). I have decided to permit my child(ren) to participate in this activity voluntarily. I understand that UCA is not organizing these activities and has no responsibility for the activities. I. Acknowledgment of Risk Involved. I understand and acknowledge that there are certain risks associated with any activity, and that I have been advised that participation in these activities may involve jumping, walking, running, climbing and other physical activities with other children. I further understand that such physical activity and recreation may result in injury, and UCA does not provide insurance for any of the activities, nor shall it be liable for any injuries, which occur. II. Assumption of the Risk. As the lawful parent or guardian of the above-named minor child(ren), I hereby specifically assume any and all risks associated with my child(ren)’s voluntary participation in the activities at the UCA athletic events and his/her use of any and all equipment and/or facilities of the tailgate. This includes, but is not limited to, any activity such as jumping, walking, running, climbing, use of inflatable equipment, and injury from objects or other persons. III. Waiver of Claims and Release of Liability. For myself, the above-named child(ren), and all of his/her heirs, personal representatives, successors and assigns, or any other persons claiming by or through me or my child(ren), I do hereby, for myself and all of the foregoing persons, forever waive, release and relinquish any and all claims, demands, causes of action, liabilities, costs or expenses (including, but not limited to, attorneys’ fees) (all of the foregoing being referred to collectively as “Claims”), against UCA, the UCA Board of Trustees, any officer, employee, or representative of UCA, which are associated with, or arise out of or in any manner are related to, my child(ren)’s participation in activities at the UCA athletics events on the UCA campus. IV. Complete and Full Release. The waiver and release set forth herein waives and releases any and all Claims under any federal or state law, as well as any common law cause of action, whether in contract, tort or any other legal theory. V. Miscellaneous. I certify that I am at least 18 years of age and the lawful parent or guardian of the child named above. If my child is under the age of five (5) I will stay in the Kid Zone area. I understand that no food or alcoholic beverages may be brought into the area.
By agreeing to the terms of this document, I am committing to abide by the rules of the University of Central Arkansas – Kidz Bounce Zone/ Kidz Club athletics events. If failure to corporate I understand that I can be subject to being removed from the game. Make check payable to: UCA Foundation
