Pursuant to Article 17 of the Law on the Council of Ministers of Bosnia and Herzegovina (BiH Official Gazette, issue No. 30/03, 42/03, 81/06, 76/07, 81/07, 94/07 and 24/08) and in accordance with recommendations made by the Ministry of Foreign Affairs of BiH, the Council of Ministers of Bosnia and Herzegovina, at its---- session held on --------- hereby issues the following.

BACKGROUND

The Strategy is a comprehensive document aimed at enhancing the efficiency of all stakeholders in the area of SALW control in Bosnia and Herzegovina. The document focuses in particular on bringing the legislation into line with international standards, improving control over the internal and external trade in weapons, decreasing the rate of incidents involving illegal weapons and the numbers of illegal weapons owned by the population, boosting citizens’ confidence in BiH bodies at all levels and reducing surplus SALW in the possession of the Ministry of Defence of BiH. By implementing the set strategic objectives and building on international and regional cooperation within this field Bosnia and Herzegovina will not only contribute to advancing the general level of security locally but also regionally and globally. Pursuant to the requirements of the 2001 UN Programme of Action1 and the OSCE Document on SALW, which was initially passed in 2000 and reissued in 20122, as well as other international documents concerning the issue, Bosnia and Herzegovina adopted a systematic approached to the problem through the adoption and implementation of the 2006-2012 SALW Strategy. 1 UN A/CONF.192/15, New York, July 2001 2 OSCE FSC.DOC/1/00, November 2000; OSCE FSC.DEC/3/12, June 2012


The 2013-2016 Strategy is a continuation of the effort by BiH institutions to reduce the safety and security risks that arise due to the presence of SALW. The presence of illegal weapons enables organised crime and terrorism to thrive and thus represents a key security risk that slows down economic growth and development in Bosnia and Herzegovina. The number of incidents involving illegal weapons is a matter of great concern. Recognition and acknowledgment of the international community’s recommendations concerning curbing the aforementioned negative repercussions of illegal weapons entails the requirement to act in an efficient and coordinated manner in order to suppress the negative effects and the illegal manufacture, procurement, possession, smuggling and trading in SALW. The process of developing and adopting the Strategy was initiated by the BiH SALW Control Coordination Board, which is an inter-institutional panel of experts founded by the Council of Ministers of BiH.

The Coordination Board for SALW Control was founded through a Decision of the Council of Ministers of Bosnia and Herzegovina (BiH Official Gazette, issue No. 72/05 and 58/07) and is mandated to plan, coordinate, direct and supervise activities aimed at implementing the SALW Control Strategy and, consequently, the provision of a safer environment. The Coordination Board is tasked with identifying and assessing the impact of SALW on society, population safety and security as well as economic and social development. In addition, the Coordination Board closely observes the process of implementation of the Strategy and publicises activities envisaged within the Strategy document to the public, supports the relevant institutions in mobilising the resources required to conduct the envisaged activities and coordinates activities amongst stakeholders involved in the Strategy implementation process.

Another task of the Coordination Board is to review and update the Strategy document in response to operational changes that result from the implementation process. The Coordination Board is also obliged to report regularly to the Council of Ministers of BiH on progress made in achieving the Strategy goals as well as to report to the UN in line with the UN Programme of Action and to the OSCE in line with the OSCE SALW Document.

In the course of its work, the Coordination Board has become aware of the clear interconnection between SALW control mechanisms, as defined under the UN Programme of Action, and those activities aimed at the prevention of armed violence described in the Geneva Declaration on the Prevention of Armed Violence and Development; the latter signed by Bosnia and Herzegovina in 2006. The Coordination Board is responsible for implementation of the Geneva Declaration and reporting on the progress made towards achieving its implementation.

DEFINITION OF SMALL ARMS AND LIGHT WEAPONS (SALW) At present there is no internationally agreed upon definition of the term ‘small arms and light weapons’ (SALW). As a rule, the Strategy uses the following definition:

For the purposes of the implementation of the Strategy and taking into consideration the risks that SALW represent for Bosnia and Herzegovina the Strategy also includes weapons and ammunition beyond those listed in the above definition. By taking this approach the Strategy contributes to the adequate treatment of all aspects of SALW control.

“Small Arms and Light Weapons are hand held weapons made or modified to military specifications for use as lethal instruments of war. Small arms are broadly categorised as those arms intended for use by individual members of armed or security forces. They include revolvers and self-loading pistols, rifles and carbines, semiautomatic rifles, assault rifles and light machine guns. Light weapons are broadly categorised as those weapons intended for use by several members of armed or security forces serving as a unit. The category also includes heavy machine guns, hand held and mounted grenade launchers, portable anti-aircraft guns, portable antitank guns, recoilless rifles, portable launchers of anti-tank missile and rocket systems, portable launchers of anti-aircraft missile systems and mortars under 100mm calibre”.

2008 - 2012 SALW STRATEGY IMPLEMENTATION RESULTS During the implementation period 2008-2012 the relevant BiH institutions achieved evident results in the advancement of SALW control. Results were achieved in the following fields: improving the legal framework, setting up SALW electronic registers, enhancement of control mechanisms for both the internal and foreign trade in weapons, destruction of surplus weapons and ammunition, harvesting and destroying weapons possessed by civilians and conducting awareness campaigns as well as meeting the requirements for regular reporting to international organisations, namely the UN and the OSCE.

In order to enhance control mechanisms for foreign trade Bosnia and Herzegovina has enacted the Law on the Control of Foreign Trade in Goods and Services of Strategic Importance for BiH Security (BiH Official Gazette, issue No. 103/09).

There are presently twelve laws on weapons and ammunition in Bosnia and Herzegovina. These laws are neither harmonised amongst themselves nor in relation to international standards and this often results in different treatment and actions related to this issue. However, numerous legislative initiatives have been undertaken to harmonise the laws on the possession and carrying of weapons in BiH with the relevant EU regulations. These initiatives resulted in the enactment of the Law on Weapons of BrÄ?ko District of BiH (BrÄ?ko District of BiH Official Gazette, issue No. 02/10). This Law has been brought into line with the aforementioned international regulations. Such initiatives also resulted in the passing of the RS Law on Weapons and Ammunition (RS Official Gazette, issue No. 070/07) and the Law amending the RS Law on Weapons and Ammunition (RS Official Gazette, issue No. 24/09) as well as cantonal laws on weapons in the Federation of BiH that have been partially harmonised with international regulations. Significant progress has been achieved in the digitisation of data on weapons possessed by civilians. Based on Article 4 of the Agreement on the Establish-


ment of an Electronic Data Exchange System for Data in Police and Prosecutors’ Records, the exchange of weapons related data has been made possible. The electronic system, namely the data exchange server, is situated in the Police Agencies Coordination Directorate of BiH. In addition, the entity and cantonal ministries of internal affairs and BrÄ?ko District police all have electronic records on weapons. The BiH Law on Movement Control of Weapons and Military Equipment has been enacted (BiH Official Gazette, issue No. 53/09) and an electronic system has been set up to track the movement of weapons and military equipment in Bosnia and Herzegovina. From 2009 up until October 2012 a total of 4,522.70 tons of surplus ammunition and explosive ordnance were destroyed along with 30,081 pieces of surplus SALW from the Ministry of Defence and Armed Forces of BiH stockpile. The decreasing trend in the destruction of weapons and ammunition (see diagram 1.1) is a result of limitations concerning the infrastructure, technology, personnel and budget.

More than 5,000 pieces of illegally possessed weapons owned by the population were destroyed over the observed period. A campaign to raise awareness on the negative aspects of possessing illegal weapons was implemented in 2010. The campaign was focused on various cities in Bosnia and Herzegovina and aimed at raising awareness amongst the population, NGO sector and the media as to the dangers and repercussions of being in possession of illegal weapons. The Coordination Board for SALW Control in Bosnia and Herzegovina reports regularly to the UN and the OSCE on the level of progress achieved in the area of small arms control in Bosnia and Herzegovina. These reports contribute largely to achieving transparency within the relevant processes, but also to the international standing of Bosnia and Herzegovina. In the latest report on small arms (Small Arms Survey 2012)3 Bosnia and Herzegovina was rated 18th out of the 159 countries that presented reports on their implementation of the commitments stipulated in the UN Programme of Action and the International Tracing Instrument.

PRINCIPLES USED FOR STRATEGY DEVELOPMENT

The Coordination Board for SALW Control in Bosnia and Herzegovina developed the 2013-2016 Strategy for SALW Control in Bosnia and Herzegovina. UN development programme methodology for strategic planning was applied during the development of the Draft Strategy. This document was developed through a comprehensive process of consultation with all of the stakeholders in SALW control and is based on the international commitments of Bosnia and Herzegovina, experience gained through implementation of previous strategy documents, the realistic requirements of institutions in BiH, the identified problems that BiH faces in this field and the definition of projects and activities required to improve SALW control in BiH. 3 Small Arms Survey, Graduate Institute of International and Development Studies, Geneva 2012


The Strategy incorporates international SALW standards. In addition, all activities of the Coordination Board for SALW Control in BiH, including the development of the Strategy, use the guidelines contained in the following documents:

• UN Convention against Transnational Organised Crime; • UN Protocol Against the Illicit Manufacturing of and Trafficking in Firearms, Their Parts and Components and Ammunition;

• UN Programme of Action; • Geneva Declaration on Armed Violence and Development; • OSCE Document on SALW; • EU Common Position on Arms Exports; • EU Strategy to Combat the Illicit Accumulation of and Trafficking in Moreover, this strategic document points to the issue of support and assistance for the victims of SALW, the importance of an even-handed approach towards males and females during the process of implementing relevant control mechanisms as well as the clear commitment of Bosnia and Herzegovina to implement adequate measures of environmental protection where control processes could have a negative impact on the environment. The Strategy includes specific projects to facilitate activities defined by the strategic goals. When determining project costs and identifying sources of funding an analogue method was used to estimate costs by comparing the cost of previous similar projects to future ones; the bottom-up method was used to identify the required resources and estimate the cost of individual activities as well as a parameters assessment; the latter being a method based on standardised parameters that indicate the unit cost of an activity.

The Strategy will not create an additional burden upon the budgets of BiH Institutions but it will direct relevant bodies to acknowledge the need for planning and allocating budget funds for carrying out SALW control activities. The projects described within the Strategy that require additional funding will be funded through international assistance programmes and donations.

TASK In order to improve the level of security in Bosnia and Herzegovina and the region as well as globally institutions in Bosnia and Herzegovina have taken measures and actions to improve all aspects of SALW control based upon the principles of efficiency, transparency, merit and professionalism, in keeping with international commitments.

VISION

Bosnia and Herzegovina provides a safe and secure environment for all of its citizens, has a regulated system of SALW control that is in line with international standards and its obligations to contribute to regional and global security.

SIGNIFICANT FACTORS AND RISKS FOR STRATEGY IMPLEMENTATION Successful implementation of the Strategy will depend largely on the timely identification of the risks and the application of risk management measures. For the purposes of this Strategy, risk is defined as the likelihood of developments that could have a negative impact on the achievement of the strategic goals. Identified risks pertaining to the implementation of the Strategy can be divided in three main groups of aspects.

• Security


• Financial • Political

Security aspect. The growing complexity of resolving the SALW issue, both legally and illegally owned, primarily requires a focus on the security aspect. SALW and their ammunition by themselves pose a security risk; however, there is no absolute security and therefore a certain degree of risk is always present. The intention behind implementation of the Strategy is to reduce the risks to a permissible level. Security risks related to Strategy implementation refer in particular to those strategic goals that stipulate SALW and ammunition disposal and the conduct of illegal weapons harvest campaigns. Furthermore, the risks include (a) health hazards and a threat to the lives of those individuals who are in illegal possession of weapons and those who guard or handle weapons and ammunition stores or are involved in surplus weapons disposal, (b) the risk of the illegal use and illegal trade in weapons and (c) risks related to weapons and ammunition storage and stock management.

The Strategy also acknowledges the risks pertaining to the environment and thus it envisages the development of an environmental study. When implementing campaigns to harvest illegal weapons it is necessary to apply measures to prevent the illegal trade in weapons and similar negative effects that can occur during periods of amnesty. The Strategy underlines the importance of ensuring that adequate protective equipment is available and that the highest safety standards are adhered to throughout the process of implementation aimed at achieving the strategic goals in order to reduce the potential for accidents. Financial aspect. Implementation of the Strategy will depend significantly on the availability of funds for the realisation of the strategic goals/programmes/

projects. As a measure to manage this risk, the Strategy is based on projects that included clearly defined budget requirements for each of the projects. This method of strategy development will provide a clear insight for donors into Bosnia and Herzegovina’s commitment to improve specific areas defined by the Strategy. Political aspect. In order to successfully implement the Strategy and achieve the strategic goals prescribed in the document it is necessary to have the full commitment and effort on the part of the authorities in BiH at all levels. Throughout the process of developing of the Strategy the distribution of constitutional competencies relevant to the issue in BiH has been given careful consideration; therefore, the Strategy aims to advance the coordination of activities aimed at SALW control and enhance political stability. When developing the project proposals contained in the Appendix to the Strategy identification, measurement and control of the risks pertaining to all three of the aspects described above were taken into consideration.

STRATEGY IMPLEMENTATION MONITORING AND EVALUATION PROCESS

Accomplishment of the implementation of the SALW Control Strategy will be rated through continuous monitoring of project implementation and periodic evaluations of the achieved results. Continuous monitoring of the implementation will be conducted by the Coordination Board for SALW Control. The project realisation success rate will be measured against previously defined indexes. Strategy evaluation will be led by the Coordination Board for SALW Control in cooperation with other governmental, nongovernmental and international organisations.


OBJECTIVES AND PROGRAMMES The Strategy recognises areas of strategic importance for SALW control improvement in Bosnia and Herzegovina and defines them through the four strategic goals as outlined below. Objective 1: Improvement of the legal framework and SALW legislation implementation to be introduced through the strategic programmes below.

Harmonisation of weapon laws, both internally and in relation to international standards

Enhancement of IT supported systems for SALW control

Objective 1 Enhancement of control over the domestic and foreign trade in SALW

Brining the legal framework into line with international standards is the basis for quality SALW control as practiced by the relevant authorities in Bosnia and Herzegovina. The existing laws on weapons and ammunition in BiH are all put in place on the basis of the constitutional competencies of Republika Srpska (entity), the ten cantons of the Federation of BiH and BrÄ?ko District of Bosnia and Herzegovina, respectively. These laws are not coordinated. The Coordination Board for SALW Control in Bosnia and Herzegovina will work on bringing about the conditions for the synchronisation of BiH laws on weapons both internally and in relation to international standards. Recognising the importance of the role that both legislative initiators and lawmakers have in this process, it will focus on the entity and cantonal ministries of interior as

well as the entity/cantonal parliaments in order to promote the basic requirements for coordinating the existing laws on weapons with relevant international standards. Prevention of the illegal trade in SALW is an important segment of SALW control. Preventing the Illegal trade not only contributes to security in BiH but also in the region and beyond. The relevant institutions in BiH will continue to strengthen their human resources capacities through training programmes and the procurement of equipment needed to combat this illegal trade. Additionally, the Strategy underlines Bosnia and Herzegovina’s commitment to and the importance of the continued improvement of the legal framework and complementary mechanisms to serve as control measures for the prevention of the illegal trade in weapons.

The Strategy acknowledges the requirement for closer inter-agency cooperation on implementing legislation related to both the internal and foreign trade in weapons and the need to facilitate adequate information and position exchanges amongst the different bodies involved in weapons trade control and their respective competencies.

In order to keep up-to-date with the pace of contemporary trends in information technology applications BiH institutions will advance the data registries and IT systems in line with the required implementation regulations. This applies especially to ballistic and mechanoscopic analysis systems, movement control of weapons and military equipment and IT systems for foreign trade in weapons.


Objective 2: Reduction in the presence of illegal SALW will be achieved through implementation of the below strategic programmes.

In order to establish proper mechanisms for SALW control it is necessary to have accurate statistical data. As statistical data is collected at different levels of government and there is no unique methodology for its collection the Strategy underlines the importance of defining the minimum requirements for a common approach towards data collection. For this purpose it is necessary to develop a single form for the collection and monitoring of statistical data pertaining to SALW in Bosnia and Herzegovina. Illegal weapons pose a security threat to Bosnia and Herzegovina and there has been an increase in the number of incidents involving the use of illegal weapons. Competent police agencies in Bosnia and Herzegovina recognise the need to act on this issue and are ready to put into effect procedures laws/acts on amnesty. Amnesty for the voluntary submission of weapons is a prerequisite for a weapons collection campaign. This Strategy underlines the commitment of BiH to launch a comprehensive campaign for the collection, registration and disposal of illegal weapons over the forthcoming period. equally important aspect of the Strategy. The Coordination Board for Control of Small Weapons shall coordinate implementation of such a campaign through cooperation with the media and the non-governmental sector. It is necessary to improve the capacities for the safe keeping, storage and disposal of small arms and light weapons. Police agencies, judicial bodies and civil protection units have limited capabilities for the storage and safe keeping of weapons. There will be a comprehensive analysis of their current capacities and requirements in order to improve safety standards in the field of the storage of weapons. Objective 3: Management of small arms and light weapons in the possession of the competent institutions and agencies in Bosnia and Herzegovina shall be carried out through implementation of the below strategic programmes.

Improving capacities for the safe keeping and storage of SALW

One of the greatest security challenges that Bosnia and Herzegovina faces is the threat of the uncontrolled explosion of ammunition and explosive ordnance stored at military storages. It is necessary to act urgently to resolve the issue of surplus weapons and ammunition in accordance with the principles adopted by the Presidency of BiH (through sale, donation or destruction). The disposal of surplus weapons and ammunition shall be carried out by em-


ploying civilian and military capacities for the disposal of ammunition in Bosnia and Herzegovina, through implementation of national and international contracts and agreements and application of strict regulations of control and supervision over the disposal process. The Ministry of Defence of Bosnia and Herzegovina shall conduct control, supervision and verification of the disposal of ammunition and explosive ordnance. As an additional mechanism, in order to improve the transparency of the process the non-governmental sector and other parties shall be given the chance to independently monitor the disposal process. The safety standards required for the storage of ammunition and the prevention of the theft of ammunition from storages shall be improved. In order to ensure safe keeping and storage of ammunition and weapons it is necessary to improve the safety of the infrastructure in accordance with international standards. In order to maintain accurate records and lists of weapons, ammunition and explosive ordnance there will be a comprehensive IT system for stockpile management at the Ministry of Defence of Bosnia and Herzegovina.

Multilateral and bilateral cooperation regarding control over SALW

Cooperation with civil society organisations

Multilateral and bilateral cooperation pertaining to the control of small arms and light weapons represents an important area. Bosnia and Herzegovina shall continue to meet its obligations from the United Nations Action Programme and the OSCE Document on small arms and light weapons. II. SPECIAL PART OBJECTIVE 1 IMPROVEMENT OF LEGAL FRAMEWORK AND IMPLEMENTATION OF SALW LEGISLATION Programme 1.1: Harmonisation of Laws on Weapons Internally and with International Standards

Project aim:

Laws on weapons in Bosnia and Herzegovina that are harmonised internally and with international standards.

End users:

Entity and cantonal ministries of internal affairs and BrÄ?ko District police.

Project relevance:

Bosnia and Herzegovina, as signatory to the Agreement on Stabilisation and Association Agreement, is obliged to harmonise its legislation with the acquis communautaire. There are currently twelve laws on weapons in Bosnia and Herzegovina that regulate this area in different ways, which results in different practices within the territory of Bosnia and Herzegovina.

Project description:

Conferences and workshops on topics pertaining to the harmonisation of laws on weapons and ammunition in Bosnia and Herzegovina shall strengthen the awareness of decision makers as to the importance of harmonising the laws on weapons with international standards. This project is based on an assessment by experts and professionals concerning the basic provisions of laws on weapons that ought to be harmonised with international standards, such as Directive 91/477/EEC and 2008/51/EC, as well as with the UN Protocol on Weapons. Project description:

the United Nations Development Programme, a series of thematic workshops with representatives from entity, cantonal and BrÄ?ko District judicial and executive bodies will be held. Thematic workshops shall serve as a platform for discussion aimed at strengthening the awareness of authorities concerning the importance of harmonising the laws. A draft law on weapons and ammunition that is harmonised with the above international standards shall be developed and shall serve as a foundation for the adoption of harmonised draft laws at the entity, cantonal and BrÄ?ko District level.

Expected results:

A proposal of the draft law on weapons and ammunition harmonised internally and with international standards, bearing in mind the constitutional competencies in Bosnia and Herzegovina. Representatives of the ministries of internal affairs, governments and parliaments at the entity, cantonal and BrÄ?ko District level will become familiar with the need for harmonisation of the laws on weapons and ammunition internally and with EU Directives. Programme 1.2: Strengthening Capacities for Combating the Illicit Trade in Small Arms and Light Weapons

Objective:

To improve the capacities of the police agencies in Bosnia and Herzegovina, the Intelligence-Security Agency, Indirect Taxation Authority and prosecutors’ offices and ensure that they are equipped to combat the illicit trade in small arms and light weapons.

End users:

Police agencies in Bosnia and Herzegovina, Intelligence-Security Agency, Indirect Taxation Authority and the prosecutors’ offices.

Project relevance:

In order to achieve their goals, criminal organisations are coming up with new ways to conduct the illicit trade in small arms and light weapons. It is necessary to ensure permanent training and education for law enforcement agencies in this field, provide equipment for their work and more efficient cooperation on preventing and fighting the illicit trade in small arms and light weapons.

Project description:

Organise interactive training, courses and workshops aimed at familiarisation with the specificities of research and processing of this aspect of organised crime, with a focus on education on the applicability of special investigative enquiries. The project should meet the actual and most urgent needs of the competent institutions in BiH in their fight against the illicit trade in small arms and light weapons. There will be a list of required equipment for this purpose.

Expected results:

Improved efficiency amongst competent agencies and institutions in BiH to combat the illicit trade in small arms and light weapons, which will be reflected in greater numbers of investigations and prosecutions.

By adopting best practice and benefiting from external experiences by joining initiatives at the regional and global level that deal with the control of weapons and military equipment Bosnia and Herzegovina shall improve its own standards in this field. Bosnia and Herzegovina shall also be able to offer its own experience and know-how to other countries.

Project relevance:

In addition to meeting its international obligations Bosnia and Herzegovina will achieve a better position in the region and ensure closer cooperation within the region through the tracking of marked weapons and ammunition; this will result in a strengthening of institutions and the overall system for the removal of weapons that find their way into communities through the illicit trade and provide for easier and more simple monitoring of the trade in weapons and their components.

“In its main intention, the Protocol is designed in such a way as to assist member countries to promote and strengthen cooperation in their fight against the illicit trade in weapons and their components and ammunition.�

Bosnia and Herzegovina ratified the Protocol against the illegal manufacturing of and trade in small arms, their components and ammunition (hereinafter the Protocol) on 1 April 2008, seven years after the Protocol was adopted by the UN General Assembly on 8 June 2001. Component 1. Adoption of legislation. Component 2. Procurement of equipment and training.

The Ministry of Foreign Trade and Economic Relations of BiH, which is responsible for regulation of the area of manufacturing of weapons and military equipment and their external trade, is responsible for implementation of the Protocol. The Ministry is currently in the process of submitting a proposal to the Council of Ministers for adoption of a legal act that will enable implementation of obligations from the Protocol. Since the Protocol stipulates as basic guidelines the establishment of closer cooperation amongst country signatories to the Protocol in the fight against the illicit manufacturing of and trade in weapons, its components and ammunition this can be taken as a good foundation for its implementation. In regard to compliance with the guidelines defined under Article 8 of the Protocol and in accordance with Article 5, paragraph (3), both of which regulate the marking of weapons, it is clear that this issue should be quite high on the priority list for our country. The project will rest on legislation that has yet to be developed, which is an obligation from the Protocol, and on supporting instruments still to be created, i.e. regulations that will enable that the obligation from the Protocol referring to the marking and tracking of weapons be implemented.


Project description:

In addition, the legal framework, when adopted, must contain appropriate instruments that will make implementation on the ground possible. Within further activities it will be necessary to establish a functional filing/archive system created in such a way that it is easy to consult and simple to access information. Furthermore, being guided by the framework introduced earlier and guidelines from the Protocol, it is necessary to procure equipment that will facilitate the implementation of the Law. Upon obtaining expert advice through coordination with the appropriate authorities, modalities for the conduct of training should be identified so that appropriate bodies can achieve a working capability within the newly established legal framework as well as be able to use the archive and equipment for tracking marked weapons. Then the process of implementation of the obligation to the operational level will follow i.e., oversight of companies that are obliged to do the marking. Thus, once the training has been completed the marking of items and their tracking will start both within the national territory and internationally if exported. The Protocol also contains the guideline that whatever is done must rest on a simple system which will be easy to put into operational use. This is a clear provision that has to be adhered to within the implementation of project activities.

Expected result:

• marking and tracking of weapons and components; • filing/archiving of the received data. Organisations and individuals gain an increased capability to implement the Protocol, which is primarily the responsibility of the Ministry, namely MoFTER, and all services that deal with the supervision of production. Authorised personnel in the police agencies and border police are introduced to the modalities of implementation of the Protocol and the use of available instruments. Increased cooperation on the issue of weapons and component tracking in the region will be achieved through the establishment of contact and joint activities in a field that is new to BiH. This will be built up in a complementary way to the existing models of cooperation with neighbouring countries on the issues of arms smuggling and border security. At the same time, the practice of marking weapons and components will contribute to an easier way of identifying weapons within the territories of the neighbouring countries and thus facilitate a more efficient effort to have illegal weapons removed from communities. Support the creation of a legal framework (working seminars and expert advice). 1. Conduct training of responsible institutions and individuals in the implementation of the Protocol and OSCE Document on small arms and light weapons. 2. Training on the general principles of marking and monitoring of weapons in accordance with other international standards and obligations. 3. Procurement of equipment that will facilitate the tracking and archiving of data (software and hardware equipment for the responsible ministries) and, once a joint decision has been made, the further procurement of a marking machine. 4. Establishment of regional cooperation pertaining to the implementation of the Protocol by making data on the marking contained in the archive available and through cooperation amongst the countries in the region on creating simple weapon signs to be used.

Brokering services for the trade, import and export of weapons is an area of business that requires restriction. It is necessary to additionally strengthen the capacities of institutions in Bosnia and Herzegovina in control mechanisms for the monitoring of brokering services and in the international standards and obligations of Bosnia and Herzegovina in this area.

Project description:

This project will provide support to the responsible institutions in Bosnia and Herzegovina in acquiring new knowledge in the area of arms brokering. It will ensure that they participate in regional training programmes, with training also taking place in Bosnia and Herzegovina. Special attention during the training will be placed on the obligations of Bosnia and Herzegovina towards international organisations in this area and the standards laid down in international documents that Bosnia and Herzegovina has joined.

Provide support to the ballistic laboratories in Bosnia and Herzegovina in achieving international standards and best practice in the area of ballistic and mechanoscopic analysis, thus becoming an example of quality ballistic scientific practice and consequently an important factor in reducing the number of incidents committed with the use of firearms. Establish complementary systems for ballistic and mechanoscopic analysis in Bosnia and Herzegovina and improve the existing capacities. Analyse the possibility of providing mutual services amongst the forensic and ballistic institutions in Bosnia and Herzegovina so that they can be of use to all interested parties.

Project description:

The project should meet the actual requirements of the ballistic laboratories in order to contribute to the improvement of the investigative capability of judicial authorities in BiH, thus also increasing the percentage of identified perpetrators of crimes and offences committed with firearms. To this end it is necessary to make a list of equipment required by the existing ballistic laboratories in Bosnia and Herzegovina. When making this list and also later when procuring the required equipment special attention will be paid to the compatibility of equipment amongst the responsible institutions as well as with the neighbouring countries, namely in the region. Thus, the equipment must facilitate an exchange of information and best practice between cooperating institutions and also provide mutual services amongst institutions. Furthermore, possibilities will be sought for using the existing resources and those yet to be procured across Bosnia and Herzegovina, based on submitted requests for services; this would contribute towards compatibility and would also reduce the resources required for the procurement of equipment for each institution individually. It is also necessary to ensure that the procurement of each item of equipment is accompanied by training provided by the supplier/manufacturer; this will be given special consideration when conducting the bidding process.

Expected results:

Equipment for ballistic and mechanoscopic analyses will be procured and it will be compatible with that in the responsible institutions in Bosnia and Herzegovina, thus enabling the mutual provision of services and information exchange. This project will provide an analysis of the efficiency of the existing electronic system for the control of foreign trade. On the basis of this analysis the required modifications and improvements will be made to the existing system so that the system can become fully functional. Once the system is improved, personnel will be trained in how to use it.

The registry for the control of the movement of weapons and military equipment is an important segment of maintaining records on the movement of weapons and equipment in Bosnia and Herzegovina as well as across its borders.

The electronic registry for the control of the movement of weapons and military equipment will be improved and additional equipment for the use of the registry procured.

The trade in small arms and light weapons is an area of business that requires restriction. Several agencies are involved in the process of clearance issuance. The system of information exchange and cooperation between agencies needs to be improved to allow for more frequent direct contact and discussion on various subject areas. Cooperation and the flow of information will be improved through the organisation of thematic meetings.

Project description:

Ensure exchange of information and close cooperation between the responsible agencies for the control of the domestic and foreign trade in small arms and light weapons by means of organising periodically thematic meetings. At present there is no mechanism for the systematic organisation of cooperation between the agencies monitoring the trade in small arms and light weapons. By organising meetings the system of information exchange will be improved and this will ensure that relevant decisions are made in a coherent manner and that they are in line with polices and plans of the agencies involved in this process.

Expected results:

The information exchange system is improved and clearances and approvals for the domestic and foreign trade in SALW based on information that is immediately available and exchanged amongst the responsible agencies.

Statistical indicators are an important segment in the creation of policies in the area of small arms and light weapons. Given the fragmented responsibilities in this area and the fact that different institutions keep statistical indicators in different ways it is currently impossible to make a comparison of statistical indicators in Bosnia and Herzegovina at various levels of authority. This fact makes the monitoring of the area and the creation of policies that will improve the prevention of incidents involving SALW more difficult.

Project description:

The project adopts an analytical approach towards the current statistical indicators for SALW so that an insight can be gained into the ways in which statistical data is kept in the field of SALW. Based on an analysis, a single form will be developed which will represent a single methodology for the collection of data in this area. Once the form has been developed it will be launched and the adoption of this method of data collection advocated for in order that trends in this area can be more easily monitored and as a result reporting to the responsible international institutions improved.


Expected results:

Statistical data in the area of SALW will be kept on the basis of a single methodology throughout Bosnia and Herzegovina at all levels of authority.

Through detailed reports on statistics and the operation of police agencies an independent picture will be gained as to the situation in the area of SALW and their prevention and or sanctioning. Reports will be sent to the relevant media in Bosnia and Herzegovina so that they can inform the public.

A Media Monitoring Report on SALW is made on the basis of the RMDS methodology for monitoring media reporting. The methodology includes categories related to SALW incidents. In order for the analysis to be comprehensive a report is based on the monitoring of at least three dailies situated in different geographic areas of Bosnia and Herzegovina. An analysis of data collected on the basis of monitoring is carried out and published semi-annually and annually. The report is in addition to the official reports issued by the authorised bodies.

Project relevance:

With the raising of awareness amongst young people and children on SALW risks it is to be expected that they will influence their elders (parents and elderly persons) to turn over and illegal weapons they possess to the authorised institutions and thus reduce the danger they pose. This project will achieve a reduction in the use of weapons primarily amongst children and young people. The project will raise awareness amongst the said population about the dangers associated with SALW and influence a reduction in the number of casualties of SALW.

Within this project a survey will be carried out in all primary schools in BiH with the aim of gathering information in connection with the implementation of the curriculum (the part that pertains to mine awareness and SALW awareness) and the availability of teaching aid sets. Workshops for headmasters and pedagogues of primary schools in BiH will be organised in each canton/region/BrÄ?ko District in order to promote teaching material and the importance of implementing educational programmes on the risks associated with SALW; this will be followed by the distribution of teaching aids sets to all primary schools in BiH. School pedagogues will organise meetings with teachers in their respective schools to inform them that teaching material for classes on the risks associated with SALW, as foreseen in the curriculum, have been made available to schools, while teachers will give lectures on the negative impact and dangers of landmines and SALW during the class consultations.


Expected results:

Primary schools in BiH will possess sets of teaching aids and material for education on mine awareness and SALW awareness. Education is carried out in primary schools in accordance with the current curriculum and using the sets of teaching aids and material. Reduction in the use of SALW by young people. Project aim:

Through school competitions, at all levels, children adopt knowledge, exchange experiences and accept safe practices with regard to the dangers of SALW.

End users:

Primary school pupils from the 6th to 9th grade, teachers and parents.

Project relevance:

Sports activities present an excellent opportunity for raising awareness amongst children and young people. Sports competitions will be organised under slogans that point to the risks that SALW pose to society. This will be a preventive action aimed at children and young people, while the contest will have an educational character in the form of additional education for children and young people on this specific issue.

Project description:

The project will be led by an Organising Board for competitions which will prepare the material for competitions (rules and tasks). This material will be submitted to the ministries of education for approval and agreement upon implementation of the project. Once approved the promotional material will be prepared and printed. During the competitions school children will be tested and competing teams will be formed to participate in other levels of competition (municipal, regional/cantonal, entity, BrÄ?ko District and state). By involving the media in the promotion of competitions this problem will be placed in the public eye. Monitoring will be carried out at all levels of competition by the Organising Board, which will carry out an analysis and prepare a report at the end.

Expected results:

During one year 3,200 pupils will be directly involved in competitions, while over 100,000 children will be involved indirectly through testing. Reduction of the use of SALW among young people. Reduction in the number of casualties of SALW.

Project relevance:

It will increase the capacities of law enforcement agencies and authorities to prevent future incidents and conflicts involving the use of weapons and to reduce violence. The aim of this initiative on collecting weapons is not simply to transfer the illegal weapons from the hands of citizens to the hands of official bodies but is intended to contribute to the overall objective of reducing the damaging influence that SALW have on society. This will be achieved by reducing the number of SALW, better prevention of their misuse and through reconciliation and trust building measures. Thus, the collection of weapons will be a development programme striving to achieve the aforesaid goals.

Project description:

A successful weapons collection programme consists of five main elements: understanding the factor of demand, use of appropriate incentives, raising awareness and changing attitudes concerning ownership of weapons, the timing and duration of weapons collection and destruction campaigns.

Strategy for Small Arms and Light Weapons Control in BiH 2013-2016

This programme is an initiative based on amnesty. At present owning an unregistered weapon is a criminal offence and is punishable by law in most of BiH. With the aim of establishing an appropriate legal framework, government in BiH will adopt decisions on amnesty for a predetermined period of time during which citizens will be able to voluntarily turn in weapons without sanction. After the period of amnesty has expired there will be a period of strict implementation of the law, which will in turn be followed by another decisive period of amnesty.

A successful weapons collection campaign requires a preliminary assessment of the problem that needs to be resolved. Otherwise it would be impossible to set clear standards for success. The factor of demand will be approached through a comprehensive assessment aimed at determining the attitude and perceptions of weapons owners. This assessment will be made before collecting weapons begins. In order for the collection of weapons to be successful the security of citizens needs to be maintained. Over the past two years measures for improving the perception of security through building better relations between citizens and the police, such as police community work, have had positive results throughout BiH. Consequently, the campaign to collect weapons will be tied to the broader theme of security and reform of the justice system, in particular to the work of the police in the community and community security programmes.


Project description:

The concept of a balanced collection of weapons will be applied. The balance will be achieved between individual and collective motivation. Individuals will be motivated through a lottery system through which individuals will receive lottery tickets for turning in weapons. Individual motivation to turn in weapons will also have a social aspect. The choice of lottery prizes will be based on a prior assessment of the needs of the people. Collective motivation will also be based on offering development programmes in exchange for weapons.

Expected results:

Reduction in the number of illegally owned weapons. Increase in the number of registered weapons.

Police agencies in BiH possess limited capacities for guarding and storing SALW. The existing capacities do not meet security and other standards. Project description:

The state of SALW storage facilities will be assessed in accordance with the standards for security, fire safety and the capacity to store B materials. At the same time the study needs to determine practical proposals and ways as well as proposed equipment to clearly, on the basis of structural proposals, state what is necessary to be invested in order to bring the said facilities up to the required level. The study should also contain a detailed financial plan for the modernisation of these facilities. The teams that will work on the study should carry out the below tasks.

1. A thorough inspection of the facilities and current conditions for storage, followed by a determination of the possibilities for improvement. 2.Determine the precise cost estimate for improvement of the facilities.

Project relevance:

For the first time in BiH, the study will merge all data on the amount of weapons currently available in BiH and assess the threat that these weapons pose to the civilian population and the development of Bosnia and Herzegovina.

Project description:

The project includes the preparation of a study encompassing available data on the amount of military and civilian weapons in BiH. On the basis of the collected data, a risk assessment will be made into the threat that such weapons pose to the civilian population and development in Bosnia and Herzegovina. The assessment process will take into account the different impact that weapons have on men and women. A risk assessment of ammunition and landmines and explosive ordnance possessed by the Ministry of Defence of BiH will be based on the age of the ammunition and the probability of an uncontrolled explosion. The inhabited areas in the vicinity of military ammunition storage sites will be taken into consideration and the impact that an uncontrolled explosion would have on such areas.

In addition, a risk assessment of the weapons possessed by citizens and data on SALW incidents will provide a picture indicating how these phenomena affect the development, economic prosperity and international reputation of BiH. The study will not only be useful for those stakeholders in BiH that make policies for the fight against the negative effects that SALW have on the population and development but also for those NGOs that suggest directions that these institutions should take in order to improve the situation in this field.

Destruction of high risk and conventional ammunition and complex weapons systems aimed at preventing uncontrolled explosions at ammunition and explosive ordnance storage sites.

Project relevance:

The Ministry of Defence of BiH possesses over 17,000 tons of surplus ammunition. The average age of this ammunition is in excess of 30 years. The risk of an uncontrolled explosion of the ammunition is very high. Uncontrolled explosions take lives and cause considerable material damage to both military and civilian facilities.

Project description:

Destruction of surplus ammunition and explosive ordnance prevents the uncontrolled explosion of chemically unstable ammunition. Considering the large amount of such ammunition in Bosnia and Herzegovina it is necessary to expedite the process of ammunition destruction by using all available military and civilian capacities for ammunition destruction in BiH. The primary methods of destruction will be decommissioning and the methods of open detonation and open incineration as required. Although approximately 1,000 tons of ammunition is destroyed each year in BiH the estimated optimum capacity for ammunition destruction is between 2,000 and 2,500 tons per year. In this regard, this project will ensure the use of all available capacities and expedite the process of ammunition and explosive ordnance destruction. During ammunition destruction the risks that can have a negative impact on the environment shall be minimised and strict control and oversight by the Ministry of Defence, civilian parliamentary authorities, international institutions and the NGO sector shall be ensured as will full transparency during the process.

Project relevance:

In addition to surplus weapons, the Ministry of Defence of BiH has prospective ammunition intended for the future needs of the Ministry. The prospective ammunition includes combat kits amounting to approximately 7,500 tons of ammunition. Some of the ammunition is stored at non-prospective ammunition storage sites and should be transported to the prospective ones.

Project description:

With the aim of disposing of non-prospective ammunition storage sites it is necessary to transport prospective ammunition in order to systemise the process of managing the ammunition and explosive ordnance stockpiles.


Project description:

The standards for managing the ammunition stockpiles shall be complied during the transportation and the prospective ammunition shall be stored at the prospective storage sites in accordance with international standards and good ammunition storage practices. Thus, the non-prospective ammunition storage sites will be made available for further use in accordance with the process of the use of immovable defence property. A long-term goal of this process, along with surplus ammunition destruction, is to relieve the budget of the requirement to allocate funds for safekeeping and maintenance of non-prospective ammunition storage sites.

Around 3,000 tons of ammunition transported from nonprospective to prospective ammunition storage sites.

To establish an independent mechanism for monitoring the process of SALW destruction, aimed at enhancing the transparency of the process.

Project relevance:

SALW destruction shall be carried out in the presence of the commission for the verification of SALW destruction or other responsible commissions and or representatives of the responsible institutions in BiH. However, it is necessary to improve the control process by establishing an independent procedure for monitoring and verification of SALW destruction.

With the aim of enhancing the transparency of the process of SALW destruction this project shall establish an independent mechanism for monitoring and verification of SALW destruction. The continuous presence of independent verifiers at the SALW destruction sites shall further strengthen the mechanism for monitoring and verification. The verifiers shall certify the amounts of destroyed SALW and monitor compliance with SALW destruction standards.

The reports on SALW destruction, which shall be made on a daily, weekly and monthly basis, shall include all necessary details on the destroyed quantities. The reports will be used as a supplementary mechanism for monitoring and verification, in addition to the official reports of the responsible institutions in BiH. Expected results:

The amount of destroyed SALW verified by an independent verifier/ agency. An independent report prepared and presented to the responsible institutions in BiH and the public.

Ammunition destruction by open detonation can have a negative environmental impact if not in compliance with the strictest standards for environmental protection. Considering that the destruction is carried out by open detonation it is necessary to assess the method of ammunition destruction by open detonation and prepare recommendations to reduce the negative impact to the greatest possible extent.

Project description:

An environmental study on ammunition and explosive ordnance destruction by open detonation represents an important segment in the process of surplus SALW destruction. The study will provide an insight into the process of SALW destruction by open detonation and offer recommendations for additional capacity building of the Armed Forces of BiH to apply international standards for ammunition destruction by open detonation in an environmentally friendly manner.

With the aim to appropriately inform the public about the process and its significance it is necessary to launch a comprehensive media campaign and make the public aware of the process. This will additionally enhance public confidence in the defence and security institutions of BiH.

Project description:

Through various media formats, this project will inform the public about the significance of the process of surplus SALW destruction in Bosnia and Herzegovina from the aspect of security of the country and the wider region. The media campaign will strengthen public confidence in the responsible institutions through the transparency of the process.

Expected results:

The public made aware of the significance of the process of solving the issue of SALW from the aspect of security and the international reputation of Bosnia and Herzegovina.

Exchange of information on the process of solving the issue of surplus SALW and an improvement in inter-agency cooperation within this field.

End users:

The Ministry of Defence of BiH, Parliamentary Committee on Defence and Security, Ministry of Security of BiH and the Ministry of Foreign Trade and Economic Relations of BiH.

Project relevance:

In terms of the exchange of information and improvement of inter-agency co-operation, the organisation of thematic roundtables is a very special method of cooperation. Several agencies are currently engaged in the process of solving the issue of surplus SALW and they will be provided with opportunities to exchange views and information on specific areas related to solving the issue of surplus SALW during the roundtables. The exchange of information will result in improved cooperation and decisions makers will benefit from better inter-agency cooperation.

Project description:

The project will arrange thematic roundtables on six different topics as follows: surplus ammunition destruction, surplus ammunition sale, surplus ammunition donation, control of the export of surplus SALW, the capacities and legal framework for solving the issue of SALW, and the sale of secondary raw material produced during SALW destruction. The participants of the thematic roundtables will be representatives from the responsible agencies, the NGO sector and the institutions that carry out civilian oversight over the process of solving the issue of surplus SALW.

Expected results:

Improved transparency of the process of solving the issue of surplus SALW through improved exchange of information and closer inter-agency cooperation.

Lessen the risk of SALW proliferation and improve standards for the physical security and management of stockpiles through the improvement of the security infrastructure for weapons and ammunition storage sites.

Project relevance:

SALW storage sites need to be improved. In accordance with the OSCE Document on small arms and light weapons (2000) and the Document on conventional ammunition stockpiles (2003), Bosnia and Herzegovina committed itself to improve the management and security of its stockpiles.

Project description:

The project will result in an improved security infrastructure for prospective weapons and ammunition storage sites in BiH in accordance with best practice concerning small arms and light weapons and conventional ammunition. The objective of the project is also to adopt the prevailing standards for an improved storage sites infrastructure as part of the system of physical security and stockpile management.

Expected results:

Achieve a considerable reduction in the risks that a proliferation of weapons and ammunition would pose to the population of BiH, military personnel and the environment

Project 3.3.2: Improvement of the Conditions for SALW Storage at the Prospective Storage Sites of the Armed Forces of Bosnia and Herzegovina Project aim:

To improve the conditions of SALW storage at military storage sites.

End users:

The Ministry of Defence of BiH.

Project relevance:

SALW storage sites need to be refurbished and the infrastructure improved. The conditions for the storage of SALW are not appropriate for the quantities of ammunition and weapons held by the Ministry of Defence of BiH. Improvement of storage conditions will reduce the risk of the uncontrolled explosion of unstable ammunition.

Project description:

In 2010 and 2011, the Ministry of Defence of BiH in cooperation with international organisations prepared three studies on the current conditions at ammunition and weapons storage sites. This project will improve storage conditions by means of construction works on the infrastructure of ammunition storage sites, the purchase and installation of equipment for regulating moisture, air temperature and other elements.

Project relevance:

SALW management requires well trained personnel and these personnel must be certified to carry out this activity. Currently, there is a need for additional training and certification of about 60 officers of the Ministry of Defence and Armed Forces of BiH.

Project description:

Implementation of training programmes covering SALW inspections, SALW storage, storage facility management, transportation, SALW destruction and other related topics for personnel of the Ministry of Defence and Armed Forces of BiH. The training, which will aim to educate and certify cadre in this field, will be conducted in cooperation with a certified institution from within the academic community or international organisations. The training will be conducted through three different training modules on the above topics. Training activities will be focused on both high level management within the Ministry of Defence and the Armed Forces and personnel at the operational and tactical level. The training will include both theoretical and practical programmes. At the end of the training there will be a test on the topics covered and certificates will be issued to those students who successfully pass. The training will attempt to include as many female personnel from the Ministry of Defence of BiH as possible in order to contribute to the balanced inclusion of female and male personnel in the training process.

Expected results:

Up to 60 employees of the Ministry of Defence and Armed Forces of BiH trained and certified for SALW stockpile management.

The Ministry of Defence does not have an electronic system for SALW management. The SALW quantities are recorded in several stock lists. This project will integrate computer centres and enable the digitalisation of data with the aim of improving SALW stockpile control.

Project description:

Software for electronic SALW stockpile management will be procured through this project. In this way, SALW stockpile data will be digitalised and SALW management done electronically. This will further improve control over SALW stockpile management and the accuracy of the SALW stock lists of the Ministry of Defence. The project will ensure that personnel of the Ministry of Defence are trained in using the software. Hardware required to use the software for the electronic management of SALW stockpiles will be procured.

The project will bring subject-matter experts from Bosnia and Herzegovina and countries in the region to a conference aimed at the improvement of regional cooperation and exchange of good practice in the area of SALW between the countries of the region. The conference will aim to reach concrete conclusions that can lead to improved regional cooperation and a systematised exchange of good practice in this field.

In view of the fact that in some cases legally exported weapons end up on the illegal market there is a need for verification of end user certificates and to obtain a receipt for the goods delivery to the final destination as well as for screening of all those involved in the weapons trade. Therefore, it is necessary to establish a network of institutions that deal with these issues both within the region and globally. Improvement of regional and international cooperation will strengthen the capacities of institutions in BiH and make them more capable of providing an adequate response to the challenges inherent to the control of small arms and light weapons at the state and regional level. Project relevance:

At present the number of non-governmental organisations that deal with issues related to SALW is limited. Institutions in BiH should have credible partners from within the non-governmental sector working in this field. The nongovernmental sector should be strengthened to be better able to advocate certain policies. Therefore, it is necessary to strengthen the capacity of the non-governmental sector so that it can take a more active role in the field of SALW control.

Project description:

The project will make the non-governmental sector stronger by means of the active participation of NGOs in the work of the SALW Control Coordination Board. There will also be programmes to present the Strategy with the aim of encouraging the non-governmental sector to become more actively involved in this field. The project will present a Guide to Advocacy of SALW Policy. The guide will be made available to the non-governmental sector for its use and will contain all the tools required for the active inclusion of organisations interested in this field. The guide will be presented through various training activities and at Coordination Board meetings. In addition, the project will aim to establish a network of trainers in specific fields pertaining to small arms and light weapons control in order to strengthen the human capacities of the non-governmental sector.

To develop a database of SALW victims and their needs in selected municipalities in BiH (pilot project).

Project relevance:

Incidents resulting from the use of SALW occur regularly in Bosnia and Herzegovina and the number of victims is getting higher every day. SALW victims are a socially marginalised group. The number of victims as well as their needs is unknown.

Project description:

This pilot project will estimate the number of SALW victims in the selected municipalities in Bosnia and Herzegovina. The municipalities will be selected based on pre-determined criteria. Data on the victims will be obtained by going directly to the competent institutions.


Project description:

Within the project, a standardised form for the collection of basic information on victims as well as their basic needs will be developed. The form will be used by workers gathering information in the field. These field workers will have received training on information gathering. Based on the results of the field work and information gathered in this way, a report describing a precise methodology for the identification of SALW victims and their needs will be developed. While developing the methodology different needs of female and male victims will be taken into account and an equal approach to and treatment of females and males will be ensured.

Expected results:

SALW victims in selected municipalities will be identified. Using statistical data on victims attention will be drawn to the problem of the presence of large quantities of SALW in BiH.
