Statement of Borrower’s Rights and Responsibilities A student loan is a serious legal obligation. It is extremely important that you understand your rights and responsibilities. When signed, this statement indicates that you understand your obligations, and you agree to honor them. 1. I understand that I must, without exception, report any of the following items to the USD Loan Administration Office in Hughes, Administration Center. a. If I withdraw from school; b. If I transfer to another school; c. If I change my name (for example, because of marriage); d. If my address, or my parents’ address changes; e. If I am unable to make a payment on time. 2. I understand that when I graduate or withdraw from the University of San Diego, I must arrange for an Exit Interview by calling (619) 260-4130. Failure to do so may result in a hold being placed on academic transcripts and/or diploma. 3. I understand that my loan account will enter billing six months from the time I leave the University of San Diego, and that I am given a five (5) year period to repay the loan; payments shall be at the rate of no less than $30.00 per month. 4. I understand the School may, based on its discretion, place my loan in forbearance when extraordinary circumstances temporarily affect my ability to make scheduled loan repayments. Interest will still be due, but principle will be deferred. Forbearance will be limited to 12 months and would be applied 6 months at a time. 5. I understand that the annual percentage rate of 5% will be the finance charge based on the unpaid balance, and that it will begin to accrue six (6) months after leaving the University. 6. I understand that I may, at any time and without penalty, prepay all or part of the principal, plus the accrued interest. 7. I understand that in the event of a failure to meet a scheduled payment of installments when due, I may be subject to pay the total cost of collection, including but not limited to reasonable attorney fees, collection agency fees and charges, court costs, other incidental costs incurred and/or litigation. Furthermore, the entire unpaid balance, including accrued interest, shall, at the option of the lending institution, become immediately due and payable.
8. I understand that the University of San Diego may impose a late charge, not to exceed twenty percent (20%) of my monthly payments, should I fail to meet a scheduled payment. 9. I understand that the interest will not accrue, and installments need not be paid during any period in which I am enrolled and in attendance as at least a half-time student at an institution of higher education; I must provide the necessary documentation of this to be considered for deferment. 10. I authorize the University of San Diego to contact any school, which I may attend, to obtain information concerning my student status, my year of study, my dates of attendance, graduation or withdrawal, my transfer to another school, or my current address. 11. Security Interests. Payor grants to Payee and to USD a security interest in all transcripts, diplomas, certificates or grade reports. Payor also agrees that Payee or USD may withhold said security upon and following any default in payment hereunder. Such security interests shall not be discharged by bankruptcy or other creditor arrangements. 12. Waiver of Statute of Limitations. To the extent permitted by Section 360.5 of the California Code of Civil Procedure, Payor hereby waives all rights conferred by the statute of limitations in any action on this Note. 13. Notices. Any notice or communication to the Payor required or permitted by this Note shall be in writing and sent to the Payor at the address below or such other place as the Payor may from time to time designate in writing. Payor agrees to promptly notify Payee, in writing, or any changes in name, address or student status. 14. Governing Law. This Note and the rights and obligations of the undersigned, the Payee and any subsequent holder shall be governed in all respects by the laws of the State of California.
I certify that I have read and understand the rights and responsibilities on this form.
