W h i l e p a r k h e a r i n g s w e r e g o i n g o n , N a t i o n a l P a r k Service p e r s o n n e l s u r v e y e d t h e n e w areas at C a p i t o l Reef a n d m a d e t h e i r o w n b o u n d a r y suggestions. D u r i n g t h e next few years, political reality set in, as t h e center of d e b a t e m o v e d from local t o w n m e e t i n g s t o Senate a n d H o u s e c h a m b e r s in W a s h i n g t o n . In U t a h , t h e m e e t i n g s h a d b e e n d o m i n a t e d b y local voices o p p o s e d t o President J o h n s o n ' s expansive p r o c l a m a t i o n s . I n W a s h i n g t o n , s u p p o r t e r s of t h e n e w m o n u m e n t areas, i n c l u d i n g e n v i r o n m e n t a l i s t s , were in t h e majority. R e p u b l i c a n p r o p o s a l s s t o o d virtually n o c h a n c e of b e i n g passed w i t h D e m o c r a t s in c o n t r o l of b o t h c o n g r e s s i o n a l b o d i e s . S e n a t o r B e n n e t t ' s s m a l l n a t i o n a l p a r k h a d relatively few s u p p o r t e r s . C o n g r e s s m a n B u r t o n ' s u n i q u e c o m p r o m i s e t h a t divided Capitol Reef's acreage into a national p a r k with a multiple-use recreational area attached died w h e n h e gave u p his seat in t h e H o u s e to r u n unsuccessfully against F r a n k M o s s . As a r e s u l t , S e n a t o r M o s s ' s n a t i o n a l p a r k p r o p o s a l b e c a m e t h e o n l y o n e seriously considered. W h e n t h e n e w C o n g r e s s c o n v e n e d in 1971 S e n a t o r M o s s r e i n t r o d u c e d his "bill to establish t h e C a p i t o l Reef N a t i o n a l P a r k in t h e State of Utah." S o m e w h a t different from earlier versions, it i n c l u d e d 12,000 fewer acres t h a n P r e s i d e n t J o h n s o n ' s 1969 e x p a n s i o n of t h e n a t i o n a l m o n u m e n t a n d w o u l d supersede t h e presidential p r o c l a m a t i o n . After D e m o c r a t K. G u n n McKay, w h o h a d t a k e n over B u r t o n ' s seat, i n t r o d u c e d a bill similar t o Moss's in t h e H o u s e , t h e fight was v i r t u a l l y over. Differences in t h e t w o versions w e r e reconciled, a n d P r e s i d e n t R i c h a r d M . N i x o n s i g n e d t h e bill c r e a t i n g C a p i t o l Reef N a t i o n a l P a r k o n 18 D e c e m b e r 1971. O f significance to r a n c h e r s , t h e conference c o m m i t t e e d r o p p e d Moss's twenty-five-year or longer p h a s e - o u t of g r a z i n g in t h e p a r k in favor of McKay's p l a n t o l i m i t grazing to " t h e t e r m of t h e lease, p e r m i t , o r license, a n d o n e p e r i o d of r e n e w a l thereafter." T h e Secretary of t h e I n t e r i o r was a u t h o r i z e d to regulate use of t r a d i t i o n a l stock driveways. 3 4
