I am from Vadapalani. My uncle met with an accident and died a week ago at Kancheepuram. We came to know about the death 3 days before only. When we went to claim the body, the doctors told us that since nobody claimed his body for 48 hours they considered it as unclaimed body and they have removed a few of his organs to donate it. Can they do so? If it is illegal what action can we take against them? According to the Transplantation of Human Organs Act, 1994, Section 5, (1) In the case of a dead body lying in a hospital or prison and not claimed by any of the near relatives of the deceased person within forty-eight hours from the time of the death of the concerned person, the authority for the removal of any human organ from the dead body which so remains unclaimed may be given, in the prescribed form, by the person in-charge, for the time being, of the management or control of the hospital or prison, or by an employee of such hospital or prison authorised in this behalf by the person in charge of the management or control thereof. But, (2) No authority shall be given under sub-section (1) if the person empowered to give such authority has reason to believe that any near relative of the deceased person is likely to claim the dead body even though such near relative has not come forward to claim the body of the deceased person within the time specified in sub-section (1). The hospital authority can remove the organs only when nobody claimed the dead body within 48 hours and they did not find any belonging with him which will give reason to believe the dead body is not an orphan and it will not be claimed by anyone. But, As per section 5 (2), though the body has unclaimed for 48 hours, if the hospital authorities found any of his identity from the person who admitted him viz., mobile, employee identity card, pocket diary etc., which will be an evidence that the dead body will have some near relative who will come forward to claim the body in the near future even they did not come within 48 hours, then no hospital authority have right to remove any organ without such authority’s permission. You can file a complaint against the hospital and the concerned authority will be punished with an imprisonment for a term which may extend to five years and with fine which may extend to ten thousand rupees for the removal of the human organ without authorization. You can send your queries related to legal problem to “menaka_joy@yahoo.com you will get the feed back in our next edition.
