There are some employees who are struggling in cramped space at home, desperate to once again commute and return to some semblance of business normality.” Due to the slowdown in activity caused by the pandemic, office deals activity was down by 29% compared to the previous 12 months. Vail Williams, which merged with commercial property consultancy Fareham-based Hughes Ellard two years ago, topped the leaderboard with 261,685 sq ft in 2018/19. Prior to that, Hughes Ellard was in the number one spot for four out of five years. As well as leading the latest league table, Vail Williams was highly commended in the 2020 silver anniversary Property Awards category for niche or regional agency team of the year. Last year the firm also won a clutch of awards in the South Coast Property Awards. These included offices consultancy of the year, property client service and business park innovation of the year (Lakeside North Harbour).

PERMITTED DEVELOPMENT RIGHTS: HOW THE CHANGES COULD CREATE MORE FLEXIBILITY The Government has passed the Permitted Development changes from the consultation process in January 2021, but what does it mean for you? Jamie Hanna explores some of the options.

Future Permitted Development Rights The Government is also consulting on an introduction of a new PD right to convert Class E uses (commercial, business and service) to residential. This would allow the following uses to convert to residential use: 1. More opportunity to change to residential: The proposed change will allow many more uses to convert to residential than the previous regulations did with restaurants, indoor sports and crèches being able to change to residential. 2. Impact on existing Article 4 Directions:

Over the last year, the Government has sought to expand Permitted Development rights to encourage additional housebuilding on brownfield sites and streamline the planning process.

Existing Article 4 Directions which removed previous PD rights may no longer apply to the new right. This depends on the final legislation wording, however there could be a period where residential conversions can take place when residential conversions required planning permission.

3. More opportunities in Conservation Areas:

In August 2020, the Government passed a suite of new Permitted Development rights for commercial and residential buildings:

Some of the old PD rights were not applicable in Conservation Areas (e.g. retail / financial services to residential). While there is some consideration of this for the ground floor, this is no longer a blanket restriction, meaning that more uses could convert to residential use under this PD right.

• B1 (a, b and c) buildings (under 1,000 sqm) built before 31 December 1989 and rebuild residential • Upward extensions (up to 2 storeys) for existing commercial and mixed uses (Class A1, A2, A3 and B1(a) uses) • Upward extensions (up to 2 storeys) for existing residential buildings to create new flats • Upward extensions (up to 2 storeys) to enlarge existing dwellings • These new Permitted Development rights provide additional options for landowners. However, the regulations are rather complex and applicants will require technical advice to determine if the rights are applicable to their building.

4. Lack of floorspace restrictions will enable complete conversion: There are no floorspace restrictions for the new PD right. Some of the old PD rights had floorspace restrictions (e.g. retail to residential had a floorspace limit of 150 sqm). This means that buildings that could only benefit from a partial conversion (due to the floorspace restriction) could be completely converted to residential. Overall, this provides much more flexibility to landowners, especially when combined with the upwards extension PD rights.
