DESCRIPTION OF VARIANCE AND REAR YARD MODIFICATION SOUGHT: The project is to demolish two existing one-story commercial buildings and construct two new fourstory buildings, each reaching a height of 40 feet, containing one dwelling unit and ground-floor retail space. T'he subject properties are through-lots between Pacific Avenue and Lynch Street. 'The proposal includes two separate buildings on separate lots, filed under separate building permit applications. However, the requests for a Variance and a Rear Yard modification apply to both individual buildings, and are referred collectively herein as the "Project". Section 134 of the Planning Code. requires a rear yard area in the Pacific Avenue Neighborhood Commercial District (NCD) measuring 25% of the lot depth (equivalent to 15 feet on the subject properties), at the lowest level containing a dwelling unit, and at each succeeding story. It should be noted that there is a discrepancy in the Planning Code on this topic, because Section 732.1 specifies a 45% rear yard requirement at all levels of the building. The Project, as modified by the Planning Commission through its Discretionary Review (DR), would provide a minimum three-foot setback from Lynch Street at the basement and first level, a 9' — 9" setback at the second level, a 19' — 4" setback at the third level, and a 28' — 8" setback at the fourth level. Section 145.1 of the Planning Code limits the width of parking entries to no more than 20 feet, or onethird of the building frontage, whichever is less. Given the narrowness of each lot, this Section would allow a vehicular entry of approximately 6.5 feet (for 1364 Pacific Avenue) and six feet (for 1370 Pacific Avenue). The project is requesting a Variance to provide a 10-foot wide vehicular entry for the building at 1364 Pacific Avenue, and an 8-foot wide vehicular entry for the building at 1370 Pacific Avenue.

REAR YARD MODIFICATION CRITERIA: Section 134(e) of the Planning Code states that, in order to grant a modification of rear yard requirements within an NCD, the Zoning Administrator must determine that the facts of the case are sufficient to meet the following three criteria: CRITERION 1. Residential uses are included in the new or expanding development and a comparable amount of usable open space is provided elsewhere on the lot or within the development where it is more accessible to the residents of the development.

4. At the same hearing on August 13, 2015, the Zoning Administrator held a public hearing on Variance/Rear Yard Modification Application Nos. 2013.0883V and 2013.0884V.

DECISION: Requirement Met.

GRANTED,in general conformity with the plans on file with this application, shown as EXHIBIT A, to construct two new four-story buildings, each reaching a height of 40 feet, containing one dwelling unit and ground-floor retail space, constructed with a minimum setback of three feet at the basement and first levels of each building, with increased setbacks at the second, third, and fourth floors of each building, a 10-foot wide vehicular entry for the building at 1364 Pacific Avenue, and an 8-foot wide vehicular entry for the building at 1370 Pacific Avenue, subject to the following conditions:

A. The Project contains two residential dwelling units in two separate buildings. As noted above, there is an existing discrepancy in the Planning Code regarding the depth of a required rear yard in the Pacific Avenue NCD (either 25% or 45% of the lot depth). For the property at 1364 Pacific Avenue, acode-complying rear yard would yield an open space of either 263 square feet or 473 square feet. The building at 1364 Pacific Avenue includes approximately 566 square feet of usable open area in the form of decks at the third level, fourth level, and roof. For the property at 1370 Pacific Avenue, acode-complying rear yard would yield an open space of either 300 square feet or 540 square feet. The building at 1370 Pacific Avenue includes approximately 473 square feet of usable open area in the form of decks at the third level, fourth level, and roof. It should be noted that additional decks were proposed at lower levels in prior iterations of the Project, but were deleted by the Project Sponsor to address noise and privacy concerns raised by the neighbors of the site and by the DR Requestors.

Any future physical expansion, even in the buildable area, shall be reviewed by the Zoning Administrator to determine if the expansion is compatible with existing neighborhood character and scale. If the Zoning Administrator determines that there would be a significant or extraordinary impact, the Zoning Administrator shall require either notice to adjacent and/or affected property owners or a new Variance application be sought and justified. 2. T'he proposed project must meet these conditions and all applicable City Codes. In case of conflict, the more restrictive controls apply.

CRITERION 2. The proposed new or expanding structure will not significantly impede the access of light and air to and views from adjacent properties.

A. The purpose of the rear yard requirement is to provide a sense of openness between structures and promote a pattern of mid-block open space, and the sunlight access plane reflected in the Project reinforces the sense of openness and preservation of light on the alley. Planning Code Section 261.1 requires that the buildings observe a 45-degree sunlight access plane, measured beginning at the property line on the north (opposite) side of Lynch Street. This results in a terraced configuration of the Project above the second story, so that the upper stories would be minimally visible from Lynch Street, and sunlight will be allowed to reach Lynch Street itself, as well as the other existing buildings which abut Lynch Street. Although the measured overall height of the buildings would be taller than several other buildings on the subject block, the rear of the buildings along the Lynch Street frontage would be expressed as a two-story element. This two-story expression is consistent with the majority of buildings fronting on Lynch Street, and would be lower than several other buildings expressing three- and four-story elevations on the street. T'he proposed configuration of the project is consistent with a traditional urban pattern of buildings built to the edge of the sidewalk, and is consistent with the scale of other existing buildings on Lynch Street.

the Planning Code limits the width of parking entries to a maximum of one-third of the building frontages of the Project, application of this ratio would allow a vehicular entry of approximately 6.5 feet (for 1364 Pacific Avenue) and six feet (for 1370 Pacific Avenue). The subject lots are narrower than many other lots in the vicinity, and for properties containing residential development in general.

Requirement Met. The purpose of the rear yard requirement is to provide a sense of openness between structures and promote a pattern of mid-block open space, and the sunlight access plane reflected in the buildings reinforces the sense of openness and preservation of light on the alley. There is currently no pattern of mid-block open space for lots located between Pacific Avenue and Lynch Street. Separation is provided instead by the presence of Lynch Street itself. The Project would be built close to the rear properly line, consistent with the pattern of the remainder of the block. Given the narrowness of Lynch Street, this development pattern creates the intimate, granular scale of an 'outdoor room'.

Section 305(c) of the Planning Code states that in order to grant a variance, the Zoning Administrator must determine that the facts of the case are sufficient to establish the following five findings: FINDING 1. That there are exceptional or extraordinary circumstances applying to the property involved or to the intended use of the property that do not apply generally to other properties or uses in the same class of district.

B. Multiple properties in the vicinity consist of residential buildings or mixed-use buildings that do not include off-street parking. These conditions are particularly found on those properties that were developed prior to the enactment of zoning regulations. The Planning Code regulations for the Pacific Avenue NCD require a minimum of one off-street parking space for each residential unit.

ISSUE

FINDING 2. That owing to such exceptional and extraordinary circumstances the literal enforcement of specified provisions of this Code would result in a practical difficulty or unnecessary hardship not created by or attributed to the applicant or the owner of the property.

A. The subject properties are each narrow, with the property at 1364 Pacific Avenue measuring 17.5 feet in width, and the property at 1370 Pacific Avenue measuring 20 feet in width. Because

A. This development is consistent with the generally stated intent and purpose of the Planning Code to promote orderly and beneficial development. Planning Code Section 101.1 establishes eight priority-planning policies and requires review of variance applications for consistency with said policies. The project meets all relevant policies, including conserving neighborhood character, and maintaining housing stock.

A. Due to the narrowness of the lots, strict application of the maximum vehicular entry widths would create driveways and garages in the Project which are too narrow to provide physical access for passenger vehicles. As such, the Project would not be able to meet the off-street parking requirements of the Planning Code, creating both a practical difficulty and an unnecessary hardship. The narrowness of the lots is apre-existing condition, and is not a condition created by the applicant or property owner.

1. Some existing neighborhood retail uses which are currently operated by the property owner will be removed by the project, however, each building in the Project will include small-scale ground-floor retail uses in keeping with the mixed residential/commercial character of Pacific Avenue.

FINDING 3. That such variance is necessary for preservation and enjoyment of a substantial property right of the subject property, possessed by other property in the same class of district.

3. T'he proposed project will have no negative effect on the City's supply of affordable housing, and will increase the supply of housing by adding two dwelling units.

Requirement Met. 4. T'he proposed project does not adversely affect neighborhood parking or public transit.'The granting of the variances will enable the project to comply with the off-street parking requirements of the Planning Code. Access to these spaces will be from Lynch Street, and will not conflict with the operation of buses on Pacific Avenue.
