FBI GUIDANCE: DEFENDING AGAINST VIDEO TELECONFERENCING HIJACKING, ZOOM-BOMBING The U.S. HHS Office for Civil Rights (OCR) recently issued guidance that providers may provide “good faith provision of telehealth using such non-public facing audio or video communication products during the COVID-19 nationwide public health emergency.” Vaya has received inquiries from providers about the security and privacy of video teleconferencing (VTC) technologies, particularly Zoom. While we expect providers to make their own appropriate VTC platform selections and consider any associated risks, you may find the following FBI guidance helpful.

OCR ISSUES ALERT: INDIVIDUAL POSING AS OCR INVESTIGATOR The OCR reports that an individual posing as an OCR investigator has contacted HIPAAcovered entities in an attempt to obtain protected health information (PHI). The individual identifies themselves on the telephone as an OCR investigator but does not provide an OCR-complaint transaction number or any other verifiable information relating to an OCR investigation. HIPAA-covered entities and business associates should alert their staff and can take action to verify that someone is an OCR investigator by asking for the investigator’s email address, which will end in @hhs.gov, and asking for a confirmation email from the OCR investigator’s hhs.gov email address. If organizations have questions or concerns, please email OCRMail@hhs.gov. Suspected incidents of individuals posing as federal law enforcement should be reported to the FBI. Additionally, the FBI has issued a public service announcement about COVID-19-related fraud schemes. Read more: FBI Sees Rise in Fraud Schemes Related to the Coronavirus (COVID-19) Pandemic
