Jennifer Harry
Jennifer Harry was called to the British Columbia Bar in 1991. She practiced with Fasken Martineau in Vancouver until 2007 when she moved to Vernon to join Nixon Wenger. Jennifer’s areas of practice include debt collection, banking and commercial litigation, and insolvency matters. She is a member of the Southern Interior Insolvency Discussion Group, the Insolvency Section of the Canadian Bar Association BC Branch, and was a member of the CBA Advisory Committee to the Judicial Council until May, 2010. Jennifer and her husband live on an acreage near Lumby, where they enjoy the many outdoor activities the area has to offer.
Leanne received her Bachelor of Arts in Criminology and Psychology from the University of Manitoba in 1984, followed by her Bachelor of Laws in 1987. Leanne began her practice in Manitoba and has lived in BC since 1989, first in Vancouver and then in Kelowna where she operated her own successful law firm for eight years. She joined Nixon Wenger in July 2002. Leanne’s practice focuses on residential and commercial real estate, mortgages and land development, business law, corporate law, wills, estates and estate planning. Leanne is involved with various charities and organizations and she and her family live on an acreage near Lumby where they enjoy gardening and their numerous pets.
Elise Allan
Elise Allan grew up in Vernon and obtained both her Bachelor of Arts in Psychology and her Bachelor of Laws from the University of British Columbia. Elise joined Nixon Wenger in 2006 and her practice focuses primarily on real estate, mortgages, wills, estates and estate planning, business law and corporate law. Elise enjoys being actively involved in the community and is currently a director on the board of the Vernon Jubilee Hospital Foundation and a director on the board of the Vernon Community Music School. She has also served on the board of the Downtown Vernon Association and Saint John Ambulance. In her spare time, Elise enjoys golfing, playing volleyball, and spending time with her family.
Christina Vinters
Christina Vinters completed her Honours Bachelor of Arts degree in Sociology at the University of Toronto in 2006. She continued her studies at the University of Victoria where she received several awards, including the Horne Coupar Prize in Family Law, and she completed her Bachelor of Laws degree in 2009. Christina was recently called to the Bar and she is delighted to be practicing in Nixon Wenger’s Family Law Group. Christina is interested in helping individuals take a solutionsoriented approach both before conflicts arise as well as after the dissolution of a relationship. Back to Square One I would like to share a story with you about a young entrepreneur right here in Vernon: Rachelle Dixon. Rachelle started sewing at the age of seven, following in her mother’s footsteps and learning from her mother’s love for sewing. I could see on Rachelle’s face the fondness and pride she has for her mother and the childhood memories she treasures. Rachelle knew she wanted to pursue a career so continued learning in the regular high school courses. Her first job was with Legacy Leathers in Armstrong which earned her an apprenticeship, partially funded through a government student program that provided Rachelle the opportunity to learn industrial sewing and working with leathers, then moving on to creating prom dresses and dance apparel inspired by her love for dance. During this time, she also worked part time doing alterations and repairs, which I know from experience can be very repetitive but does teach you that good speedy work brings in money! Rachelle’s parents invested in her creativity, buying her two machines to work with at home. At the age of 18, Rachelle was working in a Kelowna factory 4 p.m. to
3:30 a.m. sewing on an industrial line, something I could never do. She perservered and used the experience for what it was - learning the industrial business side of things, mass production and design. She then moved on to another factory in Armstrong that massproduced ski safety and military gear. Tough job! Rachelle was determined to go alone in her quest, so she moved back home, took out a couple walls to create a space to design and created her own dance wear. She was pleasantly shocked that one style alone generated a huge order!

Back to Square One Cont.. Rachelle decided to move to Vernon and live on her own, taking on more orders. She remembers well cutting fabric on the kitchen floor - bolts, threads and machines wherever, just trying to get deadlines met and designs out, still having to find time to do her alterations and custom sewing orders. Rachelle decided to take on retail, opening Square One Apparel four years ago in downtown Vernon. Now her business is evolving. Her short-term goal is to only sell her Square One label clothing, with over 100 active wear styles and a full fashion clothing line, only purchasing accessories from other suppliers. This is not an easy task! I cannot imagine a 27-year-old extremely talented young girl having to deal with all the stresses from lease payments to suppliers, weathering the storms of our ecomony and the longest winter ever. There is zero time for
social life - she is the dream! Without her 100% commitment and her incredible work ethic there would be no business. Design is such a consuming passion that it cannot be ignored and definitely takes its toll ... you are married to it. I can so relate to this after having to make a decision to completely sever myself from it … but now I always wonder “What if?” Not so with Rachelle. Even while I was talking with her, I could see her eyes sparkle with pride as she was showing me her new spring line just waiting for her creative touch. Hat’s off to you, Rachelle! Keep up the incredible work, take time to breathe and know that you have done so remarkably well for such a young woman. Strappy sandals: a fashion essential With the arrival of the summer season, the time has come to rotate the footwear in your wardrobe and rediscover your toes. For a few years now, the Spartan sandal has monopolized the sidewalks. Created with several horizontal straps at the front, from which it gets its name, the cage sandal is known for its comfort. As well as being pleasing to the eye, its many straps support the arch of the foot. With its Sex and the City look, it is, without doubt, the major fashion trend of this summer. Be careful, though, because once perched upon these breathtaking heels, you’ll have to master the art of walking elegantly. But with a bit of practice, we should all be able to achieve the elegance of the sublime Carrie Bradshaw!

Potentials Learning Centre: We Solve the Learning Riddle! How a student learns is sometimes a riddle. Since 1989, Potentials Learning Centre for Vernon and area has been helping students solve that riddle successfully. Students who are years behind in reading, math, and/or spelling catch up and go on to excel at school. This unique program, directed by Ms. Leanne Topham, a specialized learning therapist, has helped students who have suspected or diagnosed learning disabilities (like dyslexia) to overcome their challenges. Joyce Penner has been teaching with Leanne since 2005. It is their biggest reward to see a student finally ‘get it’, and see the difference that also makes in his confidence and self-esteem. Does a TFSA make sense for you? Many Canadians are talking about the merits of investing in a Registered Retirement Savings Plan (RRSP) versus a Tax–Free Savings Account (TFSA). The truth is, it is ideal to do both because they are designed to complement each other. While the RRSP has been around longer, TFSAs can play a very important part in helping Canadians save for all sorts of financial goals, including supplementing RRSP savings for retirement. If you have limited funds available, how do you choose? Canadian residents aged 18 and over can contribute up to $5,000 per year into a TFSA. The contributions do not reduce your taxable income, which means you won’t get an income tax refund. Like an RRSP, investment returns such as capital gains, interest and dividends, earned within a TFSA accumulate tax–free. With RRSPs, however, withdrawals are taxed as regular income, while TFSA withdrawals are not taxed. Here are some important tips to remember if you want to make the most of your TFSA: Choose your investment wisely: There is a broad range of investments you can use in your TFSA, and they are generally the same as those you would include in your RRSP. So, you can consider expanding beyond a traditional savings account for medium–to–longer term financial goals. There are many mutual funds that offer a balance of low–to–moderate risk and higher potential returns. Strategic Income Fund. It’s important to work with a financial advisor when selecting investments.
Use your tax refund: Investors looking to stretch their RRSP contributions further should consider investing their RRSP tax refunds into a TFSA. This can add considerable assets to one’s savings. Reduce taxes in golden years: For retirees, remember money withdrawn from a TFSA is not taxed as income, which means withdrawals will not trigger clawbacks of Old Age Security benefits. Start early: For young people, TFSAs allow savings to grow more quickly than taxable investment accounts or bank accounts. Give some to your spouse: If your partner can’t afford to contribute to a TFSA themselves, you can allocate money to it, effectively doubling your family’s contribution. You won’t get taxed on any investment income either. Use it as another place to save money: For people who have maxed out their RRSP contributions, TFSAs offer another tax–effective savings vehicle. Resist temptation: Since income can grow tax–free but is easily accessible, TFSAs are a great way to save for a big–ticket item such as a down payment for a home, a car or vacation – as long as you keep it in there. Ingredients: 1 small red onion 1 tbsp (15 mL) olive oil 1 pint cherry tomatoes 1 large jalapeno, cut in half ¼ tsp (1 mL) salt 1 small garlic clove, minced 1 tsp (5 mL) red wine vinegar ¼ cup (60 mL) basil leaves, shredded 1 cup (75 mL) peanuts, coarsely chopped 1½ lbs (750 g) rib eye steak, at least 1 inch (2.5 cm) thick Kosher salt and pepper Directions: 1. Preheat oven to 400°F (200°C). Slice onion into 1–inch (2.5 cm) wedges. Place on a baking sheet and toss with 1 tsp (5 mL) oil. Roast, stirring occasionally, 10 minutes.

Add both to roasting pan along with remaining 2 tsp (10 mL) oil and salt. Toss. Continue to roast just until tomatoes begin to wilt, about 5 to 6 minutes. 3. When cool enough to handle, chop onion into pieces about the same size as tomatoes and finely chop jalapeno. Place all in a bowl along with garlic and vinegar. Just before serving stir in basil and peanuts. Taste and add a little more salt if you wish. 4. Grease grill and preheat barbecue to medium–high heat. Remove steak from fridge while barbecue is preheating. Season generously with salt and pepper. Place on barbecue and grill about 12 minutes, turning once for medium–rare. Serve sliced with relish on the side.

Women and Stress in a Modern World We are all familiar with stress it’s a constant element in women’s busy lives. Too much stress, however, can seriously affect physical and mental well-being. The body’s response to stress and the overall cumulative effects on both physical and emotional health can be dramatic and insidious. A woman’s role has changed a lot since the 1950s and 1960s. With over half of Canadian women being in the workforce, a 56% gain since 1950, women have begun to have multiple roles such as mothers, employees, caregivers and spouses in their daily lives. Working mothers often feel pressured to do more and find themselves in the “Super Mom” role trying to multi-task demands from the office as well as meeting the needs of their families. Stay at home Moms are equally stressed with being asked to join group projects or organizing events for children, filling up their schedules to the brim. And all women, regardless of their family structure, are finding themselves in a world where old belief systems about a woman’s role have been abolished and where we are now able to accomplish anything we want with hard work and determination. Women are natural multi-taskers and as we meet the pressures of the modern world, we increasingly take on more and more roles. But women are also more prone to stress and our biology hasn’t caught up to the new demands of our multiple roles. Due to the complexity of our hormones and the various changes a woman will go thru in her lifetime (puberty, pregnancy, birth control, menopause, HRT), the effects that stress can have on a woman

can be more dramatic and challenging to diagnose. The stress hormone cortisol that is produced from our adrenal glands can trigger the “flight or fight” response. This response in a woman’s body can be amplified by our other hormones. Stress is usually short-term (an argument, loud noise, an exam, a bad driver on the way to work) or long-term (marriage issues, aging parents, physical illness). Our adrenals glands kick into gear in all situations and release adrenaline, which makes us more alert and focussed, and cortisol, which gives the body fuel from glycogen to respond quickly. Our heart rate increases, blood pressure goes up and the body prepares to respond to the stress. But when stress becomes chronic, the adrenal glands are forced to continually try to meet the needs of the body but don’t get a moment to rest. Either they go into overdrive (with symptoms of insomnia, anxiety and the “tired but wired” feeling) or they become depleted (fatigue, depression, weight gain and mood swings). Living in a world where most women are over-worked, over-stimulated (put down the iPhone now!), under-rested and are worrying about others, it is no wonder that the number one reason women seek out medical support is that they are fatigued. Adrenal health is an important consideration in many health concerns such as IBS, depression, insomnia, weight gain and poor immune functioning. Although it is still an area in medicine that is controversial in its role in other illnesses, many patients that I have seen have a tremendous response when diagnosed and treated accordingly.

Women and Stress in a Modern World Cont.. Acknowledging stress and its many sources can be the first step in trying to find a healthy way to relieve it. I encourage women to make a list of their stressors, especially those that are ongoing or self-imposed, and start to simplify their lives. We don’t want to get rid of our families but we might be able to drop a meeting or an event that is taking up a lot of time and isn’t fulfilling. Fast stress relievers could be as simple as catching a nap during lunch, talking to a friend, walking the dog, dancing, journaling or simply taking five minutes to breathe and to be alone and quiet. Spend time doing things that
are meaningful and important to you. And always remember that food is medicine. Chips and alcohol may feel like a good way to escape but the brain and the waist are not so forgiving! However, a little dark chocolate never hurt anyone. And finally, find out if your adrenal glands are part of the health issues you might be struggling with and get the right support to get you back to being healthy and happy again.

Recovery is essential for reaching fitness goals Post–workout recovery is often overlooked, yet it has a considerable impact on attaining fitness goals and improving sports performance. Recovery after exercise is essential for muscle and tissue repair and strength building. During a workout, especially if it involves strength training, a portion of the muscle tissue is broken down. This signals the need for the muscle tissue to be rebuilt with extra resistance. This rebuilding and associated improvement in muscle strength, size and tone happens during the recovery period. Without the necessary conditions for recovery in place, it’s difficult for improvements to happen. Following are some essential recovery steps that help to ensure the body is healed and prepared for its next gym visit: 1. Stretch – Gentle stretching after a workout can help reduce muscle soreness, and is a simple way to help your muscles recover. 2. Refuel – The b o d y craves nutrients after a workout to help repair tissues and prepare for its next c h a l l e n g e . Chocolate milk, such as Neilson’s The Ultimate, is a great source of protein, calcium and electro-
lytes, and a delicious way to kick–start the recovery process. 3. Rest –This is an effortless and effective way to recover, as the body has the ability to heal itself with the right amount of time. Five tips to help you hydrate The body’s need for water is vital, yet many of us fail to properly hydrate ourselves. Common problems include mistaking dehydration for hunger, not drinking enough water, or forgetting to drink it altogether. It is recommended that adults drink eight to 10 glasses or two litres of water every day (yes, really).

1. As your wake–up call: While sleeping, you lose fluids as your body works hard to metabolize much needed vitamins, minerals and essential nutrients. Combat morning dehydration by drinking a glass of water as soon as you wake–up. 2. At the office:Keep water on your desk at all times. According to Carvey, one litre bottles make it easy to keep track of how much water you’ve consumed. glacéau smartwater is available in one–litre bottles – two of these in a day and you are set. 3. When hunger strikes: We often mistake dehydration for hunger. Instead of immediately reaching for food, drink a glass of water, then re–evaluate your hunger pains. 4. During happy hour: It is always
easier to reach for a cocktail than water but the day–after effects can be damaging. Instead of matching drink to drink with a friend, chase each of your cocktails with water. If you’re planning on bar hopping, bring a bottle of water with you to hydrate in–between locations. Also, remember that bumping and grinding on the dance floor is a workout – be sure to re–hydrate to replace the fluids that you’ll lose. 5. While working on your “fitness”: Like water, working out does the body good. It is important to hydrate before, during, and after any sweat session. Finally a retirement statement that makes sense A survey conducted by Ipsos–Reid for Standard Life recently unveiled that nearly half of Canadians with group savings and retirement plans do not know the current financial status of their plan, nor whether the funds will suffice at retirement. This means that not many have taken an active role in their retirement planning. “What this survey is saying is that the status quo is not working and action is needed to make group savings and retirement statements more relevant and effective,” said Anna del Balso, Standard Life’s assistant vice–president of research and intelligence. Today, 3.3 million Canadians are responsible for their retirement income planning as defined contribution plan members and their numbers are only expected to rise in the future. This is why providing clarity and actionable recommendations for this group is particularly important. Standard Life recently launched a revamped statement that highlights important customized information where members are able to immediately see if changes need to be made to their personal profile, understand why, and make some adjustments when necessary. “Canadians need to take control of their financial future. To help them do so, we need to offer various tools that are easy to understand, effective, educational and engaging. We believe that armed with a better understanding,
members will become more inclined to take hold of planning their retirement,” adds del Balso. With this goal in mind, Standard Life recently took the innovative step of venturing into the social media and launched a series of three short, action– oriented videos to help people understand their group retirement statements and hopefully, motivate them to get more involved in their retirement planning. Entitled “How to read your group retirement statement, in plain English,” the videos focus on three questions Standard Life believes are fundamental to evaluating your financial situation: “How am I doing? Take the bite out of your migraines Chronic migraine sufferers are finding relief where you would least expect it – in a dentist’s chair. According to experts, a trip to a specially–trained dentist could provide relief from pain caused by temporomandibular (jaw joint) disorder, or TMD – which is at the root of migraine and tension headaches for numerous Canadians. In addition to chronic headaches and migraines, TMD has been linked to grinding of the teeth, breathing problems and sleep disorders, as well as facial pain, neck, shoulder and back pain, clicking or popping in the jaw, limited jaw movement and tingling fingers. This disorder affects men, women and children and in many cases patients go misdiagnosed or undiagnosed. In fact, only one out of five people suffering from these symptoms seek help from a doctor and on average, they wait four years to do so. According to Dr. Mark Duncan, clinical director at the LVI Global, a leading post graduate dental training centre, the cause of the disorder is related to muscle strains from a bad bite. “When the teeth are misaligned, called malocclusion or a bad bite, the jaw muscles and those around your head and neck are strained from constantly trying to find a more relaxed position. This strain is what causes the symptoms to occur. TMD is treatable non–surgically by neuromuscular dentists.” Using pain–free computer analysis, the neuromuscular dentist locates your jaw’s most comfortable resting position so they can fit you with an orthotic. If
the new jaw position eliminates the pain and discomfort, crowns and veneers can be used to permanently hold this new relaxed position. Treating this jaw disorder commonly improves symptoms and in many cases, permanently eliminates migraines. This is good news for those dealing with the disorder, as the cost related to migraines for Canadian sufferers is significant. In a survey of 25 countries and more than 2,600 patients, Canadian workers reported the second highest number of lost workdays monthly, 2.1 on average, and the second highest number of lost work hours due to ineffectiveness on the job from migraines, an average of 15 hours monthly. But these figures don’t even take into account the loss of human potential that migraines cause. Dr. Duncan added that only five percent of the world’s dentists are trained in neuromuscular dentistry, so it’s important to find the trained professional in your area. www.newscanada.com

Anything goes in the summertime It’s warm, the grass is greening up, and restaurant patios are welcoming us again. As you go for a stroll to your local market, shopping basket in hand, you can once again luxuriate in the freedom of fewer layers and open-toed sandals. The best thing about warm weather is that anything goes: capris one day, short skirt the next, and lightweight pants whenever you feel like it. Spring and summer fashions are great for their wide range of choice, style, and affordability, but if you’re looking for a theme around which to structure your summer wardrobe, just look at the big name designers. In his 2011 spring-summer fashion show, Canadian designer Helmer proposes a range of tiered evening dresses. From his summer collection, mermaid-cut gowns end in an explosion of material, a pure visual delight. Frills are used to adapt this trend to a ready-to-wear look. Shorter skirts composed of multiple layers of superimposed tulle are all the rage. They are the very image of extravagance and bring to mind the shape of the classic ballerina tutu, conferring a fairy-tale look to all who adopt it. Many Hollywood stars have espoused the style in the past: think Madonna in Who’s That Girl or, more recently, Avril Lavigne, using the tutu-skirt as a punk accessory. Establish a budget to better manage your finances Establishing a clear, precise and realistic budget is the best way to control your expenses according to your revenue and to save for bigger projects. Whether you have modest means or not, a budget will show you the expenses you can afford and how much you can treat yourself. Establishing a budget will allow you to have a clear understanding of your financial situation. By putting down on paper your assets and expected revenues, you can assure yourself that you are able to meet any given financial obligations, that you are able to prevent
or control debt and that you can save money for future projects. In order to set up a budget properly, your monthly revenue must be calculated first, taking into account all sources of income — salary, benefits, pensions, investment revenues, etc. After this, calculate your monthly expenses, setting a precise and realistic amount for each one. These include basic needs such as food and lodging or leisure expenses like restaurant meals or outings to the cinema. Don’t forget to calculate an amount for unforeseen expenses! Compare the two columns of your budget to ensure that your revenues are high enough to support your expenses. If this isn’t the case, you will have to take steps to balance the budget, either by reducing some of your expenses or finding a way of increasing your revenues. Our goal in 2011 is to raise $85,000 for equipment for VJH and support of CBCF’s work which will benefit women throughout the North Okanagan – right here at home! The tournament kicks off with a “Jazz It Up for Wine Women and Woods” featuring the Neil Fraser Ensemble on Friday, September 9, 2011 at the Vernon Golf & Country Club beginning at 6:00 pm. In addition to wine and appetizers, there will be a live and silent auction and live music.

Vintage Chic Antiques had a busy year. I bought some property in October of 2010 and decided that moving the shop there would be the best move for me and my family. We love it! It has more of what I had wanted the whole antique shopping experience to feel like. The shop here on the property is bigger than the space I had downtown and is full of windows and natural light. There is more room to work on pieces that need a bit of paint or a new finish. There is also room to expand if one day I decide I need more space. I would love to have a salvage area one day. It’s just a little jog over 39th Avenue to get here and adds to the whole thrill of the hunt in shopping for antiques. You won’t be disappointed. I have been buying and buying and buying, I too love the thrill of the hunt and am always on the lookout for that unique piece of furniture or awesome collectable. I am very creative and enjoy giving new life and purpose to things that we no longer use. My website got up and running recently and has alot of the inventory pictured on it, of course the pictures don’t do justice to most of what is here but it gives you a good idea about what is in stock and what kinds of things I carry. I really love the antique business and find it amazing that furniture that is over 100 years old is still in as good a shape as it was when it was built, I’m hoping that more people my age start to see the quality and uniqueness that antiques have to offer. That one of a kind piece that you won’t be able to pick up anywhere else, with the quality that will last for generations to come. Don’t make the mistake of thinking a will is not a priority Did you know that many Canadians mistakenly believe that having a will is not a priority? Nothing could be further from the truth. In fact, a will is probably the most important document you will ever write. If you die without a will, the province in which you live will decide how to distribute your estate. And if you have children who are minors, the provincial government (through the Public Trustee) will decide who will raise and care for them. Children might be taken into public custody until guardians are identified. The provincial government has its own common and impersonal formulas for the distribution of your estate. Some money or assets may end up going to places and persons you may have not intended. For example, under these laws, each child would receive a proportion of the Estate created by a pre–established formula. So a son or daughter who was already well–established, completed university and had their own home and a secure income, might end up receiving the same amount as another child with very different needs. As well, without a will there could be no special gifts to your lifelong friend, or a bequest to your favourite community or non–profit organization such as a health charity or a group like Amnesty International. In sum, no concerns for your thoughts on the size of any bequests to anyone would be addressed without a proper will. Avoid family disputes Having a proper will also goes a long way to preventing family tiffs. A current study showed that one in five Canadians has experienced family disputes over inheritances. It is likely many of these involved circumstances where there was no will. With a properly–written will the guess-
work is eliminated, and the family is clear on your intentions. The emotional turmoil which is natural at such a time can be greatly reduced by having made your wishes clear in a written will. Avoid unnecessary delays and costs Another compelling reason to have a will is to save money. Many people mistakenly think their estates are too small to warrant having a will, but the contrary is true. The smaller the estate, the greater the need to have things settled quickly. Without a will, a person’s affairs are managed by provincial authorities, who often have hundreds of files to attend to, which could cause unnecessary delays and extra costs. There are many reasons why people never get around to writing a will, including the belief that it is costly–a common misconception, and it doesn’t have to be.
