GeneralInformation

TheStudentHandbookcontainsimportantinformationaboutVirginiaWesleyanUniversity’s expectationsregardingstudentconduct,studentrightsandresponsibilities,relevantprocesses andprocedurestoaddressallegedmisconduct,andavailablesupportservices.

TheStandardsofStudentConductinthe Student Handbook applytoconductthatoccurson VirginiaWesleyanUniversitypremisesandatUniversity-sponsoredactivities,including off-campuseventsandprograms. TheStandardsofStudentConductalsoapplytostudents studyingawaythroughaUniversity-approvedprogram. Finally,theStandardsofStudent ConductapplytoconductbyVWUstudentsatotherlocationsorinconnectionwithother activities.

Eachstudentshallberesponsiblefortheirconductfromthetimeofmatriculationthroughthe actualawardingofadegree,eventhoughtheconductmayoccurbeforeclassesbeginorafter classesend,aswellasduringtheacademicyearandduringperiodsbetweentermsofenrollment.

TheStandardsofStudentConductshallapplytoastudent’sconductevenifthestudent withdrawsfromtheUniversitywhileadisciplinarymatterispending.Aprospectivestudent’s behaviorpriortomatriculationisalsosubjecttoreviewandmaybeutilizedasacontributing factortodetermineenrollment.

PlacementonanylevelofprobationthroughtheUniversity’sArbitrationorHonorCodeSystems mayimpactand/orrestrictparticipationinavarietyofcampus-wideprogramsoropportunities. Examplesinclude,butarenotlimitedto,participationinUniversitysponsoredtrips,campus employment,athletics,orabilitytoserveinaleadershippositionofaclubororganization.

UniversityMissionandHeritageofVirginiaWesleyanUniversity

MissionStatement. Aninclusivecommunitygroundedintheliberalartsandsciencesand dedicatedtoscholarship,service,lifelonglearning,andenvironmentalstewardship,Virginia WesleyanUniversityinspiresstudentstobuildmeaningfullivesthroughengagementinCoastal Virginia’sdynamicmetropolitanregion,thenation,andtheworld.

ProudofourPast,FocusedonourFuture. TheconceptforVirginiaWesleyanUniversity beganin1959whenMethodistministerJosephJohnstonproposedafour-year,private college—thefirstofitskindinSouthHamptonRoads.Withintwoyearsofplanning,theschool hadaname,acharter,andanexpandingbodyofsupportersfromtheMethodistChurch(now

UnitedMethodist)andtheregionalbusinesscommunity.Charteredin1961,VirginiaWesleyan Collegefirstopeneditsdoorstostudentsin1966.

VirginiaWesleyanCollegereceivedfullaccreditationinitsfirstyearofeligibility,enjoyed steadyenrollmentgains,andattainedmembershipintheselectiveVirginiaFoundationfor IndependentColleges.TheCollegehelditsfirstcommencementinMay1970,graduating41 pioneeringstudents.Sincethen,theUniversityhasgrowntoapproximately1,600studentsand 10,000alumni.

RootedintheliberalartstraditionaswellasitsMethodistheritage,VirginiaWesleyanprovidesa broadacademicfoundationwhilecultivatingproductiveandengagedcitizens.Theenhanced curricularmodelatVirginiaWesleyan,implementedin2011,preparesstudentsbyproviding themwithexpandedopportunitiestolearnbydoing,toconnecttheorytopractice,andtolinkthe classroomtotheworld.

In2016,theinstitutionorganizeditsacademicprogramintothreeschools—theSusanS.Goode SchoolofArtsandHumanities,theJoanP.BrockSchoolofMathematicsandNaturalSciences andtheBirdsongSchoolofSocialScience.TheBattenHonorsCollegewasalsoinitiatedin2016 andestablishmentofUniversityCollegeandtheD.HenryWattsSchoolofProfessionalStudies followed.In2020,theUniversitylaunchedVirginiaWesleyanUniversityGlobalCampus,to includeEveningandWeekendPrograms,VWUOnline,non-creditprogramsandapartnership campusinTokyo,Japan,namedLakelandUniversityJapanandVirginiaWesleyanUniversity Global. ThenewventurebuildsuponandreplacestheexistingUniversityCollegestructure.

LUJ/VWUGlobalisaninstitutionthatteaches400studentsfrom30countriesinan English-speakingassociate’sdegreeprogram.OneofonlytwoapprovedAmericanuniversities inJapan,LUJ/VWUGlobalisfullyaccredited(underLakelandUniversity)bytheHigher LearningCommission.

VirginiaWesleyanCollegewasauthorizedbytheStateCouncilofHigherEducationforVirginia tobecomeVirginiaWesleyanUniversity,effectivewiththestartofthe2017-18academicyear Manyinstitutionalachievementsledtothispivotalmomentintheinstitution'shistory,most notablythestructuringoftheacademicprogram,initiationoftheBattenHonorsCollege, completionofacomprehensivecampusmasterplanningprocess,andamovetoLevelIIIstatus withtheSouthernAssociationofCollegesandSchoolsCommissiononColleges.Thechangein statusenabledtheadditionoftwonewgraduateprogramsandanonlinedegreeprogramfor adults.

FreedomofExpressionPolicy

VirginiaWesleyanUniversityisaninclusiveenvironmentthatappreciatesandcelebrates freedomofexpression.TheUniversityunderstandsthatwithfreedomcomesresponsibility. We trustthatourcommunitymemberswillpracticegoodjudgmentandconsidertherightsofothers, aswellastheirownwhenpracticingsuchfreedom.Moreover,ourcommunityrecognizesthat, onoccasion,somemembersofthecommunitymayviewtheexpressionofcertainideasofothers asoffensive,insensitive,orevenharmful. UniversitySeal,MascotandColors,AlmaMater,andFightSong

UniversitySeal. In1964,theVirginiaWesleyanCollegeBoardofTrusteesadopted theoriginalsealtoreflecttheCollege'sUnitedMethodistheritage.Theofficialsealwas displayedonthefirstdiplomasandwasusedforallsubsequentcommencementmaterialsand otherdocumentsuntilMay31,2017,whenanupdatedversionwasimplementedreflectingthe transitionfromCollegetoUniversitystatus.Thesealisanembellishedcircle,withthe University'snameanddateofcharter,featuringacrossandtheinitialsofVirginiaWesleyan entwinedinadiamond.

UniversityMascotandColors. ThebluemarlinwaschosenastheUniversity mascotin1964tosignifythefightingspiritofoneoftheAtlanticseaboard'slargestandmost difficultfishtoconquer. VirginiaWesleyanUniversityathleticteamsareknownasTheMarlins andwearschoolcolors,navyblueandsilver.

Forthesafetyandwelfareofourcampuscommunity,VirginiaWesleyanUniversitymayinstitute interimregulationstoaddresscertainemergencyorsituationalconditions.Adjustmentsto existingpoliciesand/ortheintroductionofinterimregulationswillbesharedwiththemembers ofthecommunityeffectivelyandinatimelyfashion.

IntheeventofanycrisisthataffectstheVirginiaWesleyanUniversitycampus,stepswillbe takenimmediatelytoassurethesafetyandsecurityofthecampuscommunity. CommunicableDiseases.CommunityistheheartofVirginiaWesleyanUniversity Learning, living,andengagingwithoneanotherisaninvaluableaspectofcampuslife. Asweareall managingtherealityoflivinginapandemicera,VirginiaWesleyanwillmakeeveryeffortto provideasafecampusenvironment.Similarly,theUniversityencouragesallmembersofour communitytoassistinthisregardbypracticingtheCentersforDiseaseControl’s(CDC) recommendedguidelinestoincludeappropriatesocialdistancing(sixfeetormore),maintaining properhygienethroughdisinfectingandwashinghands,andthroughtheuseoffacemasks. UnforeseenLife-ThreateningEmergencies. AnUnforeseenLife-ThreateningEmergencyis definedasacrisiswheretheactionsofanindividualorgroupofindividualsmayresultinserious injuryand/ordeathtomembersofthecampuscommunity AnUnforeseenLife-Threatening Emergencyisnotasituationsuchasahealthconcernorothernon-urgentmatterthatcanbe managedthoughmeansthatwillnotdisruptthecampuscommunity. Gunfire,bombthreats,and hostagesituationsareallexamplesofUnforeseenLife-ThreateningEmergencies.

AllUnforeseenLife-ThreateningEmergencieswillrequiretheresponseoftheVirginiaBeach PoliceDepartment,andtheUniversity’sprimaryresponsibilityduringanUnforeseenLifeThreateningEmergencywillbecommunication.

MissingStudent

ThepurposeofthispolicyistoestablishproceduresforVirginiaWesleyanUniversitytorespond toandassistwiththereportsofmissingstudentsasrequiredundertheHigherEducation OpportunityActof2008.

Forthepurposeofthispolicy,astudentatVirginiaWesleyanUniversitywillbeconsidered missing:

● Ifafter24continuoushours,astudent’slocationisnotknownandwithreasonableinquiry,it cannotbedeterminedwheretheymaybe. OR

● Whenastudent’sactionsarecontrarytoanestablishedpatternofbehaviororthereare unusualcircumstancesthatmayhavecausedtheirabsence.

Allstudentshavetheopportunity,throughWebAdvisor,todesignateanindividualorindividuals tobeemergencycontacts,whomaybenotifiedbytheUniversity24hoursfromthetimethe

studentisdeterminedtobemissing. Thedesignationofemergencycontactwillremainineffect untilchangedorrevokedbythestudent.

PolicyandProcedure

● AllreportsofmissingresidentstudentsshallbedirectedtotheOfficeofResidenceLife and/orCampusSecurity

● Aninvestigationwillbeinitiatedtodeterminethevalidityandcredibilityofthemissing personreport. Staffwillgatherallessentialinformationaboutthestudentfromtheperson makingthereportandfromthestudent’sacquaintances. Theinformationobtainedincludes, butwillnotbelimitedto,personaldescriptors,clothinglastworn,locationswherethe studentmaybe,personsorwitnesseswhomayhaveinformation,vehicledescriptions,and informationregardingthephysicalandmentalwell-beingofthestudent,up-to-date photographs,andclassschedule.

● Staffwillmakeeveryefforttofindthestudentoncampus. Staffwillalsodetermineifthe student’svehicleisoncampus,ifthepersonhasaccessedanyareaviathekeycardsystem, orifthestudenthasregisteredanyguests. Otherstudents,friends,andacquaintancesmay alsobeinterviewed.

● Afterasearchofthecampushasbeencompleted,andiffurtherinformationisnot forthcoming,theDirectorofSecurityordesignee,inconsultationwiththeSeniorVice President,maychoosetonotifythecampuscommunitytoaskforhelpinlocatingthe missingperson.

● InconsultationwiththeSeniorVicePresident,campusofficials,thestudent’semergency contact,orthereportingpartymaychoosetofileamissingpersonreportwiththeVirginia BeachPoliceDepartment. Allpertinentinformationrelativetotheincidentwillbeprovided totherespondingpoliceofficerandtheUniversitywillcontinuetocooperateinthe investigationinaccordancewiththelawsgoverningtheCommonwealthofVirginia.

● AllcommunityinquiriesintothematterwillbereferredtotheOfficeofMarketingand Communicationsoradesignatedspokesperson.

● After24hoursoftheinitialreport,themissingperson’semergencycontactwillbenotified byCampusSecurityoraCampusLiferepresentative. Ifastudentislessthan18yearsold, thestudent’sparent(s)orlegalguardian(s)willbenotified.

● Inthecaseofamissingstudentthatisover18yearsoldandhasnotdesignatedanyonetobe notifiedorifothercontactinformationcannotbelocated,theUniversitycommunication withtheVirginiaBeachPolicemaybesufficient.

● Asperstandardoperatingprocedure,adetailedreportoftheincidentwillbegeneratedand sharedwiththeappropriatecampusadministrators.

ReleaseofUniversityDocumentsandInformation

TheFamilyEducationalRightsandPrivacyAct(FERPA)(20U.S.C.§1232g;34CFRPart99) isaFederallawthatprotectstheprivacyofstudenteducationrecords.Thelawappliestoall schoolsthatreceivefundsunderanapplicableprogramoftheU.S.DepartmentofEducation.

FERPAgivesparentscertainrightswithrespecttotheirchildren'seducationrecords.These rightstransfertothestudentwhenheorshereachestheageof18orattendsaschoolbeyondthe highschoollevel.Studentstowhomtherightshavetransferredare"eligiblestudents."

● Parentsoreligiblestudentshavetherighttoinspectandreviewthestudent'seducation recordsmaintainedbytheschool.Schoolsarenotrequiredtoprovidecopiesofrecords unless,forreasonssuchasgreatdistance,itisimpossibleforparentsoreligiblestudentsto reviewtherecords.Schoolsmaychargeafeeforcopies.

● Parentsoreligiblestudentshavetherighttorequestthattheschoolcorrectrecords,which theybelievetobeinaccurateormisleading.Iftheschooldecidesnottoamendtherecord, theparentoreligiblestudentthenhastherighttoaformalhearing.Afterthehearing,ifthe schoolstilldecidesnottoamendtherecord,theparentoreligiblestudenthastherightto placeastatementwiththerecordsettingforthhisorherviewaboutthecontested information.

TheUniversityseekstoencouragecreativityandinnovationamongitsfaculty,students,and staff.Tosupportthisendeavor,theUniversityprovidesequipment,facilities,information resources,andpersonnel.TheUniversityalsoseeksspecificsupportforcreativeactivityfrom externalsources,bothprivateandpublic.

ThisIntellectualPropertyPolicyisimplementedaspartofourmissionasanot-for-profit institution.ThespecificaimsofthePolicyareto:

IntellectualpropertyandtechnologytransferaremattersofimportancetoVirginiaWesleyan becauseoftheirpotentialtoadvancethestateofknowledgeandcontributetothegreatersocial good;toabsorbsubstantialinstitutionalresourcesintheircreation;togenerateincome;andto raiseethicalandlegalquestionsofactualorperceivedconflictofinterestfortheinventorandthe

University.Traditionally,ininstitutionsofhigherlearning,theownershipofliterary,artistic,and scholarlyworkshasrestedwiththecreator.

Thepolicyexiststoencouragecreativity,innovation,andresearch,clarifyownershipof intellectualpropertyrights,createopportunitiesforpublicuseofUniversityinnovations,and providefortheequitabledistributionofmonetaryandotherbenefitsderivedfromintellectual property.Itsfocusisonthedeterminationofaproperty’sownershipandtheequitabledivisionof therewardsstemmingfromit.Thispolicydoesnotreversethetraditionalownershipbythe creatorof,forexample,apoem,apainting,orascholarlywork.

SectionII: Purpose

Thispolicyisimplementedaspartofourmissionasanot-for-profitinstitution.Thespecific aimsofthepolicyareto:

RegularAcademicWorkProduct. Regularacademicworkproductmeansanycopyrightable workproductwhichisanartisticcreationorwhichconstitutes,orisintendedtodisseminatethe resultsof,academicresearchorscholarlystudy.Regularacademicworkproductsinclude,but arenotlimitedto,books,classnotes,thesesanddissertations,coursematerialsdesignedforthe web,distanceeducationandothertechnology-orientededucationalmaterials,articles,poems, musicalworks,dramaticworks,pantomimesandchoreographicworks,pictorial,graphicand sculpturalworks,orotherworksofartisticimagination.Softwarespecificallyneededtosupport aregularacademicworkproductorwhichisdesignedtodisseminatetheresultsofacademic researchandscholarlystudyisalsoconsideredaregularacademicworkproduct.

SpeciallyCommissionedWork Speciallycommissionedworkmeansaworkspeciallyordered orcommissionedbytheUniversityandwhichtheUniversityandthecreatorexpresslyagreeina writteninstrumentsignedbythemshallbeconsideredassuch.

SectionIV: Application

Application. ThispolicyappliestoallintellectualpropertymeetingthecriteriaforUniversity ownershipasdescribedinSectionVI,producedbycoveredindividuals,actingindividuallyorin groups,performingresearchorengaginginworkorstudyatVirginiaWesleyanorinconnection withaUniversityprogram.

SectionV: AdministrativeProcedures

Thedevelopmentofaworkofintellectualpropertythatmaybecopyrightableorpatentableand meetsthecriteriaforUniversityownershipasdescribedinSectionVIshouldbereportedfully andinwriting,attheearliesttimepossible,totheProvostandVicePresidentforAcademic Affairs. Theywillpromptlymeetwiththeinventortoconsidertheissuesofownership, copyright,andpatent,allaspectsoftheinvention,includingbutnotlimitedtotheextentto whichUniversityresourceshavebeenusedandthedistributionofpotentialproceeds.Itis assumedthatinmostcasesatimelyandamicableagreementwillbereached.

Ifanagreementcannotbereached,thedivisionchairpersons(ortheappropriatevicepresidentor supervisorinthecaseofastaffmember)willreviewthecircumstancesattendingthe developmentoftheintellectualproperty,includingthepriorinvestmentofUniversityresources, andmakearecommendationtotheProvostandVicePresidentforAcademicAffairs.

SectionVI: UniversityOwnership

TheUniversityshallowncopyrightinthefollowingcircumstances:

● TheUniversityexpresslydirectsafacultymembertocreateaspecifiedwork,ortheworkis createdasaspecificrequirementofemploymentorasanassignedinstitutionaldutythat,for example,maybeincludedinawrittenjobdescriptionoranemploymentagreement.

● Thefacultyauthorhasvoluntarilytransferredthecopyright,inwholeorinpart,tothe institution.Suchtransfershallbeintheformofawrittendocumentsignedbythefaculty author

● TheUniversityhascontributedtoa“jointwork”undertheCopyrightAct.Theinstitution canexercisejointownershipunderthisclausewhenithascontributedspecializedservices andfacilitiestotheproductionoftheworkthatgoesbeyondwhatistraditionallyprovided tofacultymembersgenerallyinthepreparationoftheircoursematerials.Sucharrangement istobeagreedtoinwriting,inadvance,andinfullconformancewithotherprovisionsof thisagreement.

SectionVII: ExceptionstoUniversityOwnership

ContractualAgreements Forintellectualpropertycreatedinthecourseoforpursuanttowork doneunderagreementbetweentheUniversityandexternalsponsor(s),ownershipwillbe

determinedinaccordancewiththetermsoftheUniversity’sagreementwiththeexternalparty andapplicablelaw.

CourseRequirement. Intellectualpropertycreatedsolelyforthepurposeofsatisfyingacourse requirementisownedbythecreatorandnottheUniversity.

Pre-ExistingRights. IftheintellectualpropertyreferredtoinCourseRequirementandRegular AcademicWorkProductisaderivativeoforotherwiseusespreexistingUniversity-owned intellectualproperty,thissectionshallnotpreventtheUniversityfromassertingitspreexisting rights.

RegularAcademicWorkProduct

Aregularacademicworkproductisownedbythecreator andnottheUniversity.

SectionVIII: UseofIntellectualProperty

RightstoPublish

Nothinginthispolicyshallbeconstruedasaffectingtherightsofacreatorto publish,exceptthatincaseswhenUniversityownershiphasbeenestablishedthecreatormust agreetoobserveabriefperiodofdelayinpublicationorexternaldisseminationiftheUniversity sorequestsandsuchadelayisnecessarytopermittheUniversitytosecureprotectionsfor intellectualpropertydisclosedtoitbythecreator.

UnauthorizedUse. UnauthorizeduseoftheUniversity’sname,seal,logo,mascot,oranyother wordsorsymbolsimplyinganaffiliationwiththeUniversityisprohibited.

UseofTeachingMaterials

.Inordertofacilitatejointworkonteachingmaterialsandsupport collaborativeteaching,andnotwithstandingtheownershiprightsotherwisegrantedbythis policy,individualswhocontributeteachingmaterialsusedinjointlydevelopedandtaught Universitycoursestherebygrantanonexclusive,nontransferablelicensetotheUniversityto permitothercontributorstothecoursetocontinueusingthosejointlyproducedteaching materialsinUniversitycourses.

SectionIX: DistributionofIncome

IncaseswherenousehasbeenmadeofUniversityequipment,facilities,oremployeeand/or studenttime,orintraditionalcasesinvolvingthecreationofliterary,artistic,andscholarlywork, theUniversitywillhavenoclaimofequity Incaseswherethisapplies,theinventorisatliberty

topursuepatentnegotiationsindependently.However,insuchcases,thenameoftheUniversity maynotbeusedinconnectionwithinventionsinwhichtheUniversityhasnoequityinterest withoutpriorwrittenpermission.

IncaseswheretheUniversitydoeshaveequityrightsaccordingtoSectionVIandtherehasbeen normaluseofUniversityequipment,facilities,oremployeeand/orstudenttimedevotedtothe invention,theUniversitywillbedeemedtohavea40%ofgrossequityinterestintheinvention.

IncaseswheretheUniversitydoeshaveequityrightsaccordingtoSectionVIandtherehasbeen significantlyabovenormaluseofUniversityequipment,facilities,oremployeeand/orstudent timeorUniversitycontributions,includingadditionalsalary,devotedtothedevelopmentofthe invention,theUniversitywillbedeemedtohavea60%ofgrossequityinterestintheinvention.

Incasesthatwouldnormallybecoveredbyequityrights,butwheregrossequityhasbeen determinedtobelessthan$5,000,theUniversityshallassertnoclaimofapercentofgross equityinterest.

SectionX: UniversityResponsibilities

TheUniversityshallhavetheresponsibilityto:

● Provideoversightofintellectualpropertymanagementandtechnologytransfer;

● Establisheffectiveproceduresforlicensingandpatentingintellectualproperty;

● Promoteeffectivedistributionandmarketingofintellectualproperty;

● ProtecttheUniversity’sintellectualproperty;and

● Informindividualscoveredbythispolicyaboutitsprovisions.

SectionXI: ResponsibilitiesofApplicableIndividuals

Coveredindividualshavearesponsibilityto:

● Adheretotheprinciplesandproceduresembodiedinthispolicy;

● Create,retain,anduseintellectualpropertyaccordingtotheapplicablelocalstate,federal, andinternationallawsandUniversitypolicies;

● DisclosepromptlyinwritingintellectualpropertyownedbytheUniversitypursuanttothis policyorcreatedpursuanttosponsoredresearchorothercontractualarrangementswith externalpartiesthataregovernedbySectionVII,ContractualAgreements,andassigntitle

tosuchintellectualpropertytotheUniversityoritsdesigneetoenabletheUniversityto satisfythetermsofanyapplicablefundingorcontractualarrangement;and

SectionXII: Compliance

Failuretocomplywiththeprovisionsofthispolicyisaviolationandmayresultindisciplineof anemployeeinaccordancewithapplicableUniversitypoliciesandprocedures.

PolicyandRegulationsGoverningUniversityHousing

VirginiaWesleyanUniversityisdedicatedtoprovidingasafe,inclusive,andengagingliving environmentforeachstudent.

TheUniversitymaintainsaresidentialrequirementthatrequiresmoststudentstoresidein recognizedUniversityhousingfacilities. Universityhousingisexclusivelyforfull-time, traditionallyagedundergraduatestudents.

Giventhenatureoftheprogram,studentsintheBattenHonorsCollegearerequiredtoresideon campuswhileenrolledattheUniversity Dependingonscholarshiplevel,membersoftheBatten HonorsCollegewillliveinHonorsVillageforeithertwoorfouryears.

Gender-inclusivehousingisaresidentialoptionthatisavailabletostudentsofallgender identitieswhodesirealivingcommunitycommonlyreferredtoas“gender-neutral”or “inclusive.”

StudentswhohavebeenresidentsofoneofthesevencitiesrecognizedasHamptonRoads (VirginiaBeach,Chesapeake,Norfolk,Portsmouth,Suffolk,NewportNews,Hampton)forthe yearpriortotheirinitialapplicationforadmissiontotheUniversityhavetheoptionof commutingfromthehomeoftheirparent(s)orlegalguardian(s). Marriedstudentsarenot requiredtoliveinUniversityhousing,however,theUniversitydoesnotaccommodatemarried couples.

Studentswhoare17yearsofageoryoungerorwhoare23yearsofageoroldermustrequest permissiontoliveintheUniversity’sresidentialfacilities. Requestsshouldbedirectedtothe DirectorofResidenceLife.

TheUniversityreservestherighttorequirestudentsresidingwithinacommutabledistance,as definedbytheResidentialRequirement,tocommutetocampuswhenthedemandforhousing exceedsavailability. Additionally,theUniversity’shousingselectionprocess,conductedeach spring,maybealteredappropriatelytoaccommodatestudentsfrombeyondacommutable distance,aswellasstudentsnewtotheinstitution.

HousingSelection Housingselectionwilltakeplaceduringthespringsemester Advertising andinformationsessionsprovidedbytheOfficeofResidenceLifewillbeheldinadvanceto discusstheprocessandtoaddressconcerns. Studentsareresponsibleforadheringtothe proceduresassociatedwithobtainingahousingassignmenttoincludesatisfyingfinancial balancesandobtainingafullcourseschedule. Studentsmayalsobringquestionstotheofficein personinBatten220orviaemailatreslife@vwu.edu.

ResidentialADAAccommodations. VirginiaWesleyanUniversityiscommittedtoproviding fullaccesstoitsprograms,services,andfacilitiesforallpeople,regardlessofdisabilityand/or otherspecialneeds.VirginiaWesleyanrecognizesthattheassistanceofserviceoremotional supportanimalsmaybenecessaryforsomeindividualstogainaccesstoprograms,services,and facilitiesortobettermanagetheirparticulardisability.VirginiaWesleyanisalsomindfulofthe healthandsafetyconcernsofthecampuscommunity.TheUniversityseekstobalancetheneeds andrightsofcampusandcommunitystakeholdersineffectingthispolicyonemotionalsupport andserviceanimalcampususe.Thispolicyseekstoencourageinformationflowanddialogueas necessarytoassurethebestpossibleenvironmentforanimalusers,animals,andotherVirginia Wesleyancommunitymembers.

StudentsSeekingAccommodations. Studentsseekinghousingaccommodations,toinclude singleoccupancyroomsorservice/emotionalsupportanimals,mustobtainapproval/proper registration.StudentsmustsubmitalettertotheOfficeofResidenceLifefromtheirattending physician/counseloroutlining:(1)theconditionrequiringaccommodationanddateofdiagnosis; (2)thelengthoftimethestudenthasbeeninthephysician/counselor'scareforthecondition;(3) thetreatmentprotocolforthediagnosedcondition;and(4)reasonsexplaininghowasingle room/emotionalsupportanimalwillenhance treatmentprotocol.Asingleroomoremotional supportanimalarenotconsideredinandofthemselvesa"treatment." Life,andUniversity'sExecutiveDirectorofAcademicSupportServices.TheOfficeof ResidenceLifewillsharewiththestudenttheUniversity'sdecisionregardingtheirrequestfor accommodation.Whileallattemptswillbemadetohonorrequests,conditionssuchasspace availability,forrooming,andtheintegrityofmaintainingasafeandcomfortableliving environmentforallstudents,forcompanionanimals,arefactorsthatmaylimittheUniversity's abilitytomakeappropriateaccommodations.

Gender-InclusiveHousing. Studentsmaybeassignedtohousingbasedonthegenderwith whichtheyidentify Furthermore,studentsmaynoteinterestingender-inclusivehousingon theirhousingapplication. Theywillthenproceedintheusualhousingselectionprocess,which involveschoosingfromdesignatedhousingavailableduringtheirassignedselectiondateand time.InformationregardingrequestsforGender-InclusiveHousingisavailableduringthe housingapplicationprocess.

Basedonavailability,acertainnumberofspaces(suites,Jack&Jillrooms,apartments,and townhouses)maybedesignatedgender-inclusiveandmadeavailableforstudentsalreadyeligible toselectsuchspacesthroughthehousingselectionprocess.

Gender-InclusiveHousingisnotintendedforromanticcouples. Studentsarenotrequiredto disclosetheirreasonforrequestingaspecificroommate,however,theOfficeofResidenceLife stronglyrecommendsagainstromanticpartnerschoosingtolivetogetherregardlessofgender identity.

SpecialInterestHousing. Personslivinginspecialrecognizedhousing,suchasthemedor GreekhousingorHonorsVillage,maybeaskedtoadheretospecialregulationsassociatedwith theprogram.

StandardsofResidentialLiving. InadditiontotheStandardsofStudentConduct,whichapply toallUniversitygroundsandbuildings,otherpoliciesarenecessaryintheresidential community Thesepoliciesapplytoresidentstudents,aswellasallotherstudentsandpersons whovisittheUniversityhousing. Eachresidentstudentisresponsibleforknowingand observingtheprinciplesandpoliciesgoverningconductandproceduresrelativetotheStandards ofResidentialLiving,whicharepublishedinthisdocument– Student Handbook,postedbythe OfficeofResidenceLife,and/orgivenasamemorandumfromtheSeniorVicePresidentor designee.

Allresidentsareexpectedtoberespectfulandresponsiblemembersofthecommunitieswithin Universityhousing. Studentsareexpectedtorefrainfromactionsthatpreventindividualsfrom havingasafeandrespectfulcommunitylivingexperience.

MealPlanRequirement. AmealplanisrequiredforallstudentsresidinginUniversity recognizedhousing. Themealplanassociatedwithastudent’sassignedroomcannotbe separatedfromtheroomcharge.Mealplansareassignedtostudentsbasedontheirhousingstyle. Studentshavetheoptiontoincreasetheirmealplan,butmaynotdecreasetheirmealplan.Meals areservedatregularlyscheduledtimesintheBoydDiningCenterwithextendedhoursformeals availableintheHarborGrill.

HousingAgreement. Eachresidentisrequiredtosign,electronically,anagreement acknowledgingtheirreceiptofUniversitypolicieswhencompletingthehousingapplication. In theeventthattheregulationsintheagreementarechanged,eachresidentstudentwillsignanew agreementthatdisplaysthenewregulations. Failuretosigninstitutionalpolicydocumentsdoes notrelieveoneoftheirresponsibilityforadheringtoUniversityregulations.

CourtesyHours CourtesyHoursareineffect24hoursaday Studentsareexpectedtorespect therightsofothersbykeepingnoiseatareasonablelevel. Theuseofstereoequipment,radios, andtelevisionsispermittedsubjecttotheconditionthattheyareusedinsuchawayasnotto interferewiththerightsofothers.Excessivesoundequipmentormusicalinstrumentsmaynotbe usedinresidencehallrooms.Limitationsmaybeplacedontheplayingofmusicalinstrumentsin theresidencehallsbasedonnoiselevel.

QuietHours. QuietHourshavebeenestablishedtoensureadequatestudytimeandproperrest, andwillbestrictlyobservedinallUniversityhousingasfollows;SundaythroughThursday, 12:00midnightuntil8:30a.m.;FridayandSaturday,2:00a.m.until8:30a.m. QuietHours applytoallrooms,hallways,commonareas,andsharedspaces.

VisitationRegulations

.AllcampushousingwillbeopenSundaythroughThursdayfrom8:30 a.m.until12:00midnight;FridayandSaturdayfrom8:30a.m.until2:00a.m. Visitationhours applytoallrooms,hallways,commonareas,andsharedspaces. Childrenundertheageof12are notpermittedinUniversityhousingwithoutexpressedpermissionfromtheDirectorof ResidenceLife,unlessthechildisvisitingbrieflywithaparentorlegalguardian. Babysittingon Universitypropertyisprohibited.Exceptionsmaybemadeforchildrenofemployees. Resident studentsareallowednomorethantwoguestsatonetime. Example:Tworesidentssharinga doubleroomshouldhavenomorethanfourguestsatanyonetimeforatotalofsixpeopleinthe room.

OvernightGuests

.Guestsarenotpermittedtostayovernightwithahostoftheoppositegender. ArrangementsmustbemadewiththeOfficeofResidenceLifepriortoaguest’sarrival.Students mustregistertheirguestsaccordingly. Ifguestshavenotbeenpre-registeredbyastudent,the guestmaybeinstructedtoleavecampus. Guestsmustbeacceptabletoallroommates. Thehost studentshallberesponsiblefortheirguest’s(overnightanddayvisitors)adherencetoall

UniversitypoliciesaswellasforanydamagestoUniversityorpersonalpropertytheirguestmay cause. NoguestmaystaymorethantwonightswithoutpermissionfromtheDirectorof ResidenceLife.

RoomAssignments. AllUniversityhousingistobeoccupiedonlybythosestudentstowhom specificroomshavebeenassigned. TheUniversityreservestherighttomakechangesinroom assignments,touseunoccupiedspace(s)inaroom,ortorelocatestudentsshouldtheneedarise. StudentswhoseektochangeroomsmustconsultwiththeOfficeofResidenceLifewhowill determinewhetherthemoveisnecessaryandagreeabletoallpartiesinvolved. TheOfficeof ResidenceLifemustapproveallroomchangespriortothestudent(s)changingrooms. Students changingroomswithoutpriorapprovalwillbechargedanadministrativefeeof$100.00,and/or bemovedbacktotheirassignedroom. TheUniversityalsomaintainstheabilitytoaffecta student’sparticipationinhousingselectionbasedondisciplinarysanctionsandotherrelevant concerns,andtochangeorremoveastudentfromhousingfordisciplinaryandotherbehavioral reasons.

RoomConsolidationPolicy. TheOfficeofResidenceLifereservestherighttomoveor reassignastudenttootherfacilities;assignroommates;consolidatevacanciesbyrequiring residentstomovefromsingleoccupancydoubleroomstodoubleoccupancy;consolidate vacanciesbyrequiringstudentsoccupyingdoubleroomsasasingletopayanadditionalfee; designatethenumberofvacantdoubleroomsavailabletootherstudentsasasingleoccupancy foranadditionalfee;designatevacantroomsforalternatepurposes;andconsolidatevacancies byclosingpartsoforcompletehalls.

Atthebeginningofeachsemester,asituationmayoccurinwhichastudentwillhaveasingle occupancyinadoubleroom. Inthissituation,thestudentwillbeassignedthestatusofa “doublesingle.” Inordertoaccommodaterequestsforhousing,twostudentslivingalonein doubleroomsmayberequiredtomovetogetherintooneroom. TheOfficeofResidenceLife reservestherighttouseallspacesshouldtheneedarise.

GeneralRuleRegardingAnimalsonCampus. TheUniversitygenerallyenforcesa“no-pet” policyoncampus,allowingonlyfishinaquariumsthatare10gallonsorlessinresidencehalls. Exceptionsaremadeforserviceanimalsandmaybemadeforemotionalsupportanimalswith appropriatedocumentation. Aserviceanimalisdefinedasadogthatisindividuallytrainedto doworkorperformtasksforpeoplewithdisabilities.Alternatively,anemotionalsupportanimal isapetownedandusedbythatindividualtomanageadisability Emotionalsupportanimals mustremainintheirresidentialspace.TheyarenotpermittedincommonareassuchasBatten StudentCenter,classrooms,orBoydDiningCenter.Furthermore,campuscommunitymembers

andgueststraversingcampusorattendingUniversity-sponsoredeventsmustensurethattheir animalsarekeptsecuredonleashesatalltimes.

KeyCards. Studentsareissuedroomkeycardstohelpprotecttheirprivatepossessionsand increasecampussecurity. Toensurethissecurity,ifaroomkeyislostorstolenduringa semester,thestudentwillassumethecostofreprogrammingkeycardlocksandareplacement feeforanewkeycard($30.00).Keycards,forsecuritypurposes,arenottobeloanedor transferredtoanotherperson.Personsviolatingthisrulewillbesubjecttodisciplinaryaction. Shouldakeycardbelostorstolen,pleasereportitimmediatelytoCampusSecurity Campus Securitywillcancelthelostorstolencard,whichrendersthemissingcardinoperable,andissue areplacementkeycard.

LockOuts StudentswhoarelockedoutoftheirroomsandrequestaccessfromCampus SecurityortheOfficeofResidenceLifestaffmaybechargeda$10.00feeperoccurrence.

StudentID. StudentsarerequiredtocarrytheirUniversityissuedidentificationcardatalltimes includingclassesandUniversitysponsoredevents. Studentsmustpresenttheiridentification cardwhenrequestedbyaUniversityofficial.ThecostofareplacementIDis$30.00.

RoomCondition. Priortoastudentoccupyingaroom,theconditionoftheroomisassessed withspecialattentiongiventoexistingdamage. Studentsareheldresponsibleforthecondition oftheirrooms,roomdoor,androomfurnishings.Itisthestudents'responsibilitytoreportall roommaintenanceconcernstotheOfficeofResidenceLifeorFacilitiesManagementassoonas theconcernisdiscovered. Inthecourseofasemester,theUniversityexpectsacertainamountof normalweartooccur. However,studentsmustpayfortherepairofanydamagesbeyondnormal wearaswellasforadditionalcleaning. Inthisregard,studentsareexpectedtoutilizeroom furnishingsforthepurposetheywereoriginallydesignedtoserve. Thepracticeofstacking furnitureorusingbedframesasroomdividersisnotpermittedasthispresentsaseverehazard. Studentsmaynotinstallpersonallockingmechanismsonroomorbathroomdoors. Closet, room,andbathroomdoorsmaynotberemovedandscreensmustremainintactandinwindows atalltimes. Studentsmaynotpainttheirrooms. Nailsandthumbtacksshouldbeusedsparingly indecoratingrooms. Allfurnitureassignedtoaresident’sroommustremaininthatroom. A studentmaynothaveintheirroomanyUniversityfurniturenotassignedtothatroom. Ifthe missingfurnishingsarenotreturned,theOfficeofResidenceLifemayconductroomsearchesto retrievethemissingitem(s). Itisthestudent’sresponsibilitytohaveallUniversityfurniturein itsoriginalplaceintheroomattheendoftheresidenceperiod.

HealthandSafetyInspections. Allresidentialspaceswillbesubjecttomonthlyinspectionsby theOfficeofResidenceLife. Whenpossible,theseinspectionswillbeannouncednolaterthan

24hoursinadvance. Inspectionswillbeconductedforthepurposeofassuringstudentsafety andtoidentifymaintenanceissues,propertydamage,andsanitationconcerns.

CommunityDamageorCleaningCharges. Damagetopublicareas,furnishings,equipment, orUniversityhousingfacilitiesaswellasmessesthatriseaboveandbeyondnormalusethat cannotbechargedtoanyindividual(s)willbeproratedbetweenallresidentsofthefloor,hall, building,etc.,asappropriate. Thecostofdamagesorcleaningmaybechargedagainsta student’sdamagedepositifotherarrangementsarenotmade.

RoomEntry Whenenteringresidentialspaceoccupiedbystudents,thefollowingguidelines willbeobserved:

● RoomsmaybeenteredforthepurposeofenforcementofUniversitypoliciesand regulations. AstheOfficeofResidenceLifeandCampusSecurityareprimarilyresponsible fortheenforcementofsuchpoliciesandregulations,theyhavetherighttoenterrooms whenthereisreasonablecausetobelievethataviolationisoccurringorhasoccurred. A student’sabsencewillnotpreventsuchroomentries.

● RoomsmaybeenteredtoinspectandmaintainUniversityfacilities,thusassuringthe sanitation,safety,andpropermaintenanceofsuchfacilities. Astudent'sabsencewillnot preventsuchinspectionsormaintenanceentries.

● RoomswillbeenteredduringrecognizedUniversitybreaksbytheOfficeofResidenceLife toassurethatallwindowsarelocked,appliancesareunplugged,andallgarbageis removed. Objectsorsubstances,whichareconsideredviolationsofUniversitypolicy,will benotedandremovedfromrooms. ViolatorsofUniversitypolicywillbeheldaccountable.

RoomSearch Whenasearchofaresidentialspaceoccupiedbystudentsbecomesnecessary, thefollowingguidelineswillbeobserved:

● OfficeofResidenceLifestaffand/orCampusSecurityonlywillconductaroomsearch.

● Astudent’spermissionmaybesoughtbeforetheirroomissearched,butisnotrequiredfora searchtobecompleted.

● Theresidentsoftheresidentialspacemaybegivenanopportunitytobepresentduringa roomsearch. However,asearchmaybeconductedintheabsenceoftheresidents.

● AnyillegalitemsorothermaterialsthatareprohibitedbytheUniversitymaybeseizedand usedasevidenceintheUniversity’sCommunityArbitrationSystemeveniftheyarenot materialsforwhichthesearchwasinitiallymade.

● AnyillegalitemsorothermaterialsthatareprohibitedbytheUniversityarethe responsibilityoftheoccupantand/orownerunlessthereissufficientevidencetoprove otherwise.

● Theabovestatementsarealsoapplicabletostudents’automobilesandpersonaleffects.

PropertyDamage. TheUniversitymakeseveryefforttoprotectthepropertyofstudentsbut cannotberesponsibleforlossordamagetoastudent'spersonalpropertyduetofire,theft,flood, orothercauses. Studentsarestronglyencouragedtokeeptheirroomdoorslockedatalltimes. Rentersorhomeowner’sinsuranceisstronglyencouraged.Studentsshouldstronglyconsider obtainingrenter’sinsurancetoprotecttheirbelongingswhileinresidence.

BreakClosings. Studentsareexpectedtoleavecampuswithin24hoursaftertheirlastexamat theendofeachsemesteroratthedesignatedhallclosingtime,whichevercomesfirst. Whenthe Universityisnotinsessionduringholidaysandbreakperiods,studentsshouldfollowtheposted timesfordepartureandarrival. StudentsmaynotoccupyUniversityhousingduringthese periodswithoutpermissionfromtheDirectorofResidenceLife. Studentsgrantedspecial permissionwouldbeexpectedtocomplywithallUniversitypoliciestoincludepoliciesduring breaks(forexample,noalcohol). Additionally,mealsconsumedatthedininghallwillcomeat thestudent’sexpenseasrecognizedbreakmealsarenotpartofthesemesterlymealplan. PermissiontostayduringarecognizedbreakisatthediscretionoftheDirectorofResidence Lifeandstudentsmaybeassessedaweeklyfee. Astudentmaybeassesseda$75feefor unauthorizedorunapprovedpresenceinUniversityhousingduringrecognizedUniversity breaks. Additionally,studentswhoarrivebeforetheirapprovedarrivaldatemaybedenied entry. Ifgivenemergencyapprovalorfoundintheirspacewithoutapproval,studentsmaybe chargedaperdiemforeverydaytheyoccupyaspacepriortotheirapprovedarrivaldate. This feemaybecontestedwithin72hoursofreceiptofchargesduringwhichtimeastudentmay choosetohavethematterreviewed.

FireSafety. ThefollowingregulationsaredesignedtoprotecteveryindividualinUniversity housingfromthethreatoffire.

● Firedrillsarerequiredbylaw. Wheneverafirealarmsounds,occupantsmustleavethe buildingquicklyandinanorderlymannerbytheclosestexit.

● Settingoffafalsefirealarm,dischargingaUniversityfireextinguisherforotherthanfire fightingpurposesandtamperingwithanyfiresafetyequipment,suchasroomsmoke alarms,constitutesaviolationofUniversityregulationsand/orviolationoffiresafetylaws. Improperuseofcookingappliancesthatengagefirealarmsorsuppressionsystemsviolates Universitypolicy Theseactionsmayresultinsanctions,fines,orotherdisciplinary responsesdeemednecessary

● Rooms,hallways,andbuildingexitsmustremainfreeofobstructions. Therefore,students arenotallowedtohangsheets,blankets,orotheritemsinsuchafashionaswouldhinder theexitingfromaroomandstudentsarenotallowedtoblockbuildingexitswithfurniture orinanyothermanner. Personalitemsarenottobeleftincommonareas,toinclude

hallways. Itemsfoundinsuchareasmayberemovedanddiscarded.(Examples:bicycles, athleticequipment,shoes,etc.)

● Studentsarenotallowedtohaveanyofthefollowingintheirresidentialspace(toinclude commonareas)atanytimeduetothepotentialfirehazardtheypose:candles,incense, halogenlamps,liveChristmastrees,toasters,toasterovens,electricskillets,campstoves, hotplates,spaceheaters,hoverboards,andanythingwithanopenflameorexposedheating element.MajorappliancesnotsuppliedbytheUniversity,andapplianceswhichmaycreate anelectricoverload,arenotpermittedatanytime.

● Notapestries,flags,orfabricsmaybehungfromceilingsorwallsinanyresidentialspaces, commonareas,closets,bathrooms,orhalls,norcananymaterialcoveranysmokedetector orsprinklerhead.Nomaterialsmaycoveranysmokedetectororsprinklerhead.(A tapestryisdefinedasanyfabricobjectthatmaybehungordrapedtobeusedasa decorationandwhichmaybedeterminedtobecapableofbecomingafireaccelerant).

Curtainscoveringwindowsarepermittedaslongastheyareflameretardant,hungon springtensionrods(rodsthatscrewormustbenailedintothewallarenotpermitted),and neitherhangpastthewidthoftheactualwindownorhanglowerthanthewindowsill.

Studentsinviolationofthispolicywillhavetheirtapestries,flags,orfabricsconfiscated andaresubjecttoimmediatedisciplinaryaction,toincludethepossibleremovalfromor reassignmentwithinUniversityhousing.

● Studentsmaynottamperwithelectricalwiring,outlets,orfixtures.

CheckingOut

. Allresidentstudentsmustbecheckedoutoftheirroomspriortoturningintheir keycardsattheendoftheacademicyear,orwhentheyareleavingtheUniversity. Amemberof theOfficeofResidenceLifewillbeavailabletocheckeachroomtoensurethatitisinthesame conditionaswhenthestudentmovedin. Failuretobecheckedoutwillresultina$75fine. Itemsleftintheroomwillresultinanadditionalchargefortheirremoval.

ProhibitedItems

Thefollowinglist,whichisnotmeanttobeall-inclusive,detailsmanyofthe itemsprohibitedinresidentialareasoncampus.

● Studentsarenotallowedtohavewaterbedsincampushousing.

● Streetsignsandother“publicsigns”arenotallowedincampushousing.

● Otherthanfishinaten-gallonaquariumorless,petsmaynotbebroughtintoorkeptin Universityhousingfacilities.

● Privateexteriorantennasandwirelessroutersarenotpermitted.

● Weapons,includingknivesotherthanthoseusedforculinarypurposes,arenotpermittedon campus. Kniveswhicharelongerthan3½inchesarenotallowedforanypurposes.

Studentscannotcarryutilitykniveswhileoncampus.

● Hookahs,vaporizers(vapepens),andothersmokingdevicesmaynotbeusedinUniversity housingorothercampusbuildings.

● EmptyalcoholcontainersretainedpurposefullyfordisplayareprohibitedinUniversity housing,regardlessofastudent’sage,duetotheunsafeandunsanitaryconditionstheymay create.

Violations. Violationsofthe"StandardsofResidentialLiving"and“HousingAgreement”may resultindisciplinaryaction. Thisactionmayincludesanctions,fines,restitution,and/orhousing reassignmentorremovalfromUniversityhousing.

RegisteredStudentOrganizations

Studentshavetherighttoorganizeintospecialinterest,academic,social,orservicegroupsatthe University;providedthesegroupsdonotviolatetheUniversity’snon-discriminationpoliciesand thattheyalignwithinstitutionalvalues. Thesemaytaketheformofstudentorganizations. Somecampusgroupsrequireapplications,specializedcriteria,orformalrecruitmentprocesses formembership. ExamplesincludeHonorSocieties,StudentGovernmentAssociation, FraternitiesandSororities. Thisdoesnotviolatepolicysolongastheseprocessesareethicaland equitable.

VirginiaWesleyanUniversityprovidescertainprivilegestostudentorganizationsingood standing. Astudentorganizationcanbeconsideredin“goodstanding”ifitregisterswiththe OfficeofStudentEngagementeachsemester,hasafaculty/staffadvisor,anditsmembersabide bytheStandardsofStudentConductand The Wesleyan Creed duringstudentorganization function. Thoseprivilegesinclude,butarenotlimitedto,reservingcampusfacilitiesand equipmentatnocostorforminimumcost,requestingcateringserviceswithadditionalcost, postingadvertisingmaterialsinapprovedlocations,andhostingeventsoncampus. Forsecurity reasons,studentorganizationsmayberequiredtocoverthecostofadditionalsecurityorpolice personnel.

Allactivestudentorganizationsarerequiredtohaveafaulty/staffadvisor.Studentorganizations willsubmittheirrecommendedadvisortotheDirectorofStudentEngagement. TheSeniorVice Presidentwillreviewallrecommendations. Conflictsofinterestandotherconcernsmaylimit one’sabilitytoadviseastudentorganization. Faculty/Staffadvisorsareabletoadviseatmost twostudentorganizations.

StudentComplaints

VirginiaWesleyanUniversityhasacomprehensivesetofpolicies,programs,andproceduresfor respondingtostudentcomplaints.

TheSeniorVicePresidentordesigneeisresponsibleforrespondingtostudentcomplaintsand/or lettersofconcernfromstudentsandparentsregardingmattersofcampuslife.TheSeniorVice Presidentmaintainsthesecomplaintselectronically. TheProvostandVicePresidentfor AcademicAffairs,inasimilarmanner,addressesquestionsandconcernsregardingtheacademic program. RecordsofthesecomplaintsaremaintainedbyAcademicAffairs. Incasesinvolvinga facultyorstaffmember,andwhenthesituationwarrants,theDirectorofHumanResourceswill beinformedandconsulted,andrecordswillbemaintainedaccordingly.

Responsestocomplaintswillbemanagedinapromptandefficientmannerandinafashionthat willbestaddresstheissuepresented. Inmostcases,aresponsewillbeprovidedwithinseven daysfromthereceiptoftheconcern.

Insomecases,studentsmaypursuethegradereviewprocessbywritingalettertotheProvost andVicePresidentforAcademicAffairs. Letterswrittenbystudentsmayalsobecomepartof theinformationutilizedforreviewingallegedviolationsofUniversityregulations.

StudentswithGrievanceRegardingAccessibility. Onoccasion,aVirginiaWesleyanstudent withadocumenteddisabilitymayhaveaconcernordisputewithregardtoreasonable accommodation(s)incourses,architecture,orcommunication. Ifsuchaconcernarises,itisthe student’sresponsibilitytopresenttheirconcerntotheappropriatefacultyorstaffmemberwhois involvedandrequestatimelyresponse. Thefacultyorstaffmembershouldlisten,giveserious attentiontothecomplainant’sconcern,andattempttoresolveitinamutuallysatisfactorywayor referthestudenttoanappropriateofficeoncampus. Introductions

TheStandardsofStudentConductdescribeconductthatisacceptableandprohibitedatthe Universityandsetsforththeproceduresbywhichstudentconductmatterswillbemanaged. Studentconductmattersshallbeprocessedinaprompt,fair,andimpartialmanner The StandardsshallgoverntheconductofstudentsandtheirguestsoncampusandatUniversitysponsoredactivitiesandfunctions.

AllstudentsareexpectedtoconductthemselvesinsuchamannerastobeacredittoVirginia WesleyanUniversity. StudentsareexpectedtoabidebyandupholdtheUniversity’spoliciesand aretoreportviolationsofwhichtheybecomeawaretotheappropriateUniversityofficials. Failingtodosomayresultindisciplinarysanctions,whichmayincludesuspensionordismissal fromtheUniversity.

AsresponsiblecitizensandmembersoftheUniversitycommunity,studentsareexpectedto complywithFederal,Commonwealth,andlocallaws,andwithallpublishedUniversitypolicies andregulations.

PolicyGoverningSexualHarassment

Introductions

StudentsafetyisaprimaryconcernforVirginiaWesleyanUniversity. Unfortunately,instances ofsexualharassmentarearealityatcollegesanduniversitiesacrossthecountry.Affirmed consentservesastheprimarydeterminantastowhetherornottherewasaviolationofthe University’ssexualharassmentpolicy. Initiatorsofsexualactivityareresponsibleforobtaining effectiveconsent. Silenceorpassivityisnoteffectiveconsent.TheUniversitywillinvestigate andresolveallegationsofsexualorgender-basedharassmentoflesbian,gay,bisexual,and transgenderstudentsusingthesameproceduresandstandardsthatitusesinallcomplaints involvingsex-basedharassment. Inadditiontoathreattosafety,theseformsofsexual harassmentinterferewithstudents’rightstoreceiveaneducationfreefromdiscriminationand mayconstituteacrime.Sexualharassmentmayaffectone’sabilitytoparticipateinorbenefit fromtheUniversity’sprograms,academic,athletic,orextracurricular,andis,therefore,a potentialviolationofcivilrights. Becausetheseviolationsmayviolateaperson’scivilrights,it isimportanttounderstandthatanycomplaintofthistypewillbeinvestigatedasbothapotential violationofUniversitypolicyandasapossibleviolationofTitleIX,ViolenceAgainstWomen Act(VAWA),and/orotherlaws.

Theindividualsresponsibleforexaminingthe mattershallhenceforthbereferredtoastheSexualHarassmentReviewCommittee(SHRC). ThisCommitteewillbemadeupoftheTitleIXCoordinatororadesignee,CampusLife representative,andtheDirectorofSecurityoradesignee. Thiscommunicationwilloccurwithin24 hoursafterthisdeterminationisreached. Uponsuchdisclosure,theTitleIXCoordinatorora designeeshallnotifythevictimthatsuchdisclosureisbeingmade.

ThelawsoftheCommonwealthofVirginiaalsorequirethattheUniversityprominentlynoteon astudent’sofficialacademictranscriptastudent’ssuspension,dismissal,orwithdrawalwhile underinvestigationforviolatingpoliciesgoverningsexualharassment. TheUniversityshall removefromthestudent’sacademictranscriptanynotationplacedonsuchtranscriptupon completionofatermofsuspension,orincaseswherethestudenthadwithdrawnfromthe institution,butwassubsequentlyfoundnotresponsibleforviolatingsexualharassmentpolicies. InstancesofsexualharassmentmayviolateboththeUniversity’ssexualharassmentpolicyand thelaw.Asaresult,theUniversityencouragesvictimstopursuetheircomplaintsthroughboth theUniversity’sprocessforsexualharassmentandthroughthecriminaljusticesystem. The criminalinvestigationisindependentfromanyinquiryundertakenbytheSexualHarassment Committee(SHRC)underthispolicy.

Regardlessofwhetheravictimdecidestopursueacriminalinvestigation,theSHRCwilltake immediatestepstoinvestigatethecomplaint,toprotectthevictim,andtoensurethesafetyofthe

campuscommunity. IfacriminalcomplaintisfiledinadditiontotheUniversitycomplaint,the Universitywillcontinueimplementingitsownproceduresregardlessofthetimelineofthe criminalproceedingsortheiroutcome.

Withlimitedexceptions,ifacaseinvolvesunderagedrinking,theUniversityshallnotchargethe followingindividualswithaviolationoftheUniversity’salcoholpolicy: thecomplainant,the witnesses,andotherindividualsreportingincidentsand/orassistingvictimsofsexual harassment.

Assoonasemployeesbecomeawareofpossiblesexualharassment,theymustreportand studentsarestronglyencouragedtoreporttheincident(s)totheTIXCoordinatororoneofthe University’sDTIXCoordinators.

Onceacomplaintismade,whetherverbalorwritten,theTIXCoordinator/DTIXCoordinators willpromptlycontactthecomplainantconfidentiallytodiscusstheavailabilityofsupportive measures,considerthecomplainant'swisheswithrespecttosupportivemeasures,informthe complainantoftheavailabilityofsupportivemeasureswithorwithoutthefilingofaformal complaint,andexplaintothecomplainanttheprocessforfilingaformalcomplaint.TheTIX Coordinator/DTIXCoordinatorswillinformtheSHRCwhowillgatherasmuchinformationas possibleaboutthecomplaint(s). ● AnyonemayfileaformalcomplaintwiththeUniversity’sTitleIXCoordinator. Anonymousreportsarealsopermitted.

● AllformalcomplaintswillbeinvestigatedbytheUniversity.

● Tofileaformalcomplaint,complainantsmaycompletetheSexualHarassmentFormal ComplaintFormorprovidewrittenorverbalconfirmationtotheTitleIX/DeputyTitleIX Coordinators

● TheUniversityisrequiredtodismissformalcomplaintsif:

a. ThecomplaintdoesnotmeetthedefinitionofSexualHarassment

b Theincidentdidnotoccurwithintheinstitution’seducationalprogramoractivity

c. ItdidnotoccuragainstapersonintheUnitedStates.

● Reportsmadethatdonotmeettheaforementionedcriteriamaybeadjudicatedthroughthe University'sstudentconductprocess.

● TheUniversitymaydismissformalcomplainantsshould:

RespondingtoComplaintsofSexualHarassment

AfteraformalcomplaintisfiledwiththeUniversity’sTitleIXCoordinatortheUniversitywill:

● Offersupportivemeasuresavailabletothecomplainantandrespondentthataredesignedto supportcontinuedaccesstoaneducationprogramoractivitywithoutunreasonably burdeningtheotherparty.

● TheUniversity’sSexualHarassmentReviewCommitteewillconveneto:

a. Takestepstoprotectthecomplainant,includinginterimmeasuressuchasissuinga"no contactorder"ora"notrespassorder"astheinvestigationisongoing.

b. Takestepstopreventoraddressretaliation,whichisprohibitedunderTitleIXandthe StandardsofStudentConduct.

c Determineifenoughevidenceexiststowarrantadditionalinvestigationandsubsequent adjudicationthroughtheSexualHarassmentBoard

d Conductariskanalysistodetermineifanaccusedstudentposesanimmediatethreatto thehealthorsafetyofastudentorotherindividual.ShouldtheSHRCdeterminea threatispresent,theUniversityisallowedtoremovesuchastudentfromcampus, providedthatthestudentreceivesnoticeandanopportunitytorespond.

e Determineiftheallegedviolationofstudentconductwouldconstituteafelonious chargethroughVirginiaStateLaw.Iftheallegedviolationmeetsthiscriteria,the UniversityisrequiredtocontacttheVirginiaBeachCommonwealth’sAttorneyOffice. Identifiableinformationisonlysharedifanimmediatethreattocampusispresent.

SexualHarassmentInvestigation

WhentheSHRCdeterminesthatfurtherinvestigationiswarranted,TheUniversitywill:

● Providewrittennoticetobothparties(complainantandrespondent)oftheallegations containedwithintheformalcomplaint.

o Writtennoticemustincludenameofcomplainant,dateofallegedincident, locationofallegedincident,andallegedUniversitypolicyviolated.

● Uponreceiptofwrittennotice,thecomplainantandrespondentwill:

a. Receiveadequatetimetoprepareforaninitialinterview.

b. Beassignedorselectanadvisoroftheparty’schoice.

c. Advisorsmaybepresentduringallinterviewstoprovidesupportforthecomplainantor respondent.Advisorsmaynotactivelyparticipateintheinvestigation.

● Evidencedirectlyrelatedtotheallegationswillbepresentedtothecomplainant,respondent, andrespectiveadvisorswithatleast10daysforpartiestorespondbeforearesponseis required.Thesematerialsmaybesentinelectronicformatorhardcopyuponrequest.

● Thecomplainantshallbeaffordedtheopportunitytodiscusstheallegedharassmentwith theDTIXCoordinator(s). Thepurposesofthismeetingaretoadvisethecomplainantofthe hearingprocedures,his/herrightsinconnectionwiththehearing,andtoobtainaninitial statement.

● Therespondentshallbeaffordedtheopportunitytodiscusstheallegedharassmentwiththe DTIXCoordinator(s). Thepurposesofthismeetingaretoadvisetherespondentofthe hearingprocedures,his/herrightsinconnectionwiththehearing,andtoobtainaninitial statement.

● Additionalmeetingswiththecomplainant,respondent,andifnecessary,witnesseswilltake placeifdeemednecessary.

● TheDTIXCoordinatorshallcreatesufficientcopiesofanevidencepacketcontainingall submittedinformationtobeconsideredduringthemeetings.

● Boththecomplainantandtherespondentwillbepermittedtoviewthedocuments(packet), butwillnotbeallowedtoretainaphotocopyorotherwiserecordtheinformationitcontains.

● Thecomplainantandrespondent,uponthisrequest,willbeprovidedaccesstoviewthe documentwithin72hourspriortotheSHBhearing. Atthistime,thecomplainantand respondentmaybegintoformulateandsubmitquestionsforsubmissiontotheSHBChair forconsiderationduringproceedings. Uponrequest,thecomplainantandrespondentwill alsobeprovidedaccesstotheevidencepacket24hourspriortotheSHBhearing. Questionsshouldbesubmittedatthattime. Theadvisorsforbothofthecomplainantand respondentwillbeallowedtoaccompanythem.

SexualHarassmentBoard

OnceaninvestigationiscompleteandadeterminationismadebyTitleIX/DeputyIX CoordinatorsthatapotentialviolationofstudentharassmentasitrelatestoTitleIXhasoccurred, theSexualHarassmentBoard(SHB)willmeet.

● TheSHBshallconsistoftheSeniorVicePresident,actingasChair,andtwo(2)other non-studentvotingmembers.

● TheSHBshallmaintainapoolofindividualsrepresentingthefacultyandstaffwhomaybe chosentoserveasthetwoadditionalmembersoftheSHB. Theseindividualsshallbe appointedannuallybytheSeniorVicePresident,andwillreceiveannualtrainingonissues relatedtosexualharassment,theinvestigativeanddisciplinaryprocess,andthehearing process. ThetrainingoftheseindividualsshallbetheresponsibilityoftheTIXCoordinator andtheDTIXCoordinators.

● AnymemberselectedtoserveontheSHBmustrecusehimorherselfforanybiasor conflictofinterest. Thecomplainantandtherespondentwillbenotifiedoftheidentitiesof theSHBhearingpanelistsandmayrequestachangeifthereisaconflictofinterest.

● MeetingsoftheSHBwillnotbedelayedbasedonthecomplainant’sorrespondent’swork scheduleortheschedule/availabilityofthementor(s). Thecomplainant’sandrespondent’s classschedulewillbeconsideredwhenschedulingSHBhearings.

● MeetingsoftheSHBareconfidentialandshallbeclosedtothepublic. Formalrulesof process,procedure,and/ortechnicalrulesofevidence,suchasareappliedinacriminalor civilcourt,arenotusedinameetingoftheSHB.

● InaccordancewiththeDepartmentofEducation,andmoreSpecificallyTitleIXunderthe jurisdictionoftheOfficeofCivilRights,decisionsmadebytheSHBshallbebasedon evidencethatisclearandconvincing.

● Thereshallbeasingleverbatimrecord,typicallyadigitalrecording,oftheSHBhearing (notincludingdeliberations).Deliberationsshallnotberecorded.Therecordshallbethe propertyoftheUniversityandmaintainedsecurelyontheUniversity'sserver.

● Ifnecessary,theChairoftheSHBmayorderthattheproceedingsbetranscribedinaddition totherecording.

● TheSHBmayacceptpertinentrecords,exhibits,resultsoforpendinginformationregarding policeinvestigationsrelatedspecificallytothecase,andwrittenstatements(including studentimpactstatements)forconsideration. Medicalrecordsmayalsobeconsidered. The DTIXCoordinatorconductingtheinvestigationwillbringtheseitemsorinformationtothe Chair'sattention. TheChairmayconferwithothermembersoftheSHB,butshallmakeall rulingsonacceptinginputforthehearing.

● AllproceduralquestionsaresubjecttothefinaldecisionoftheChairoftheSHB.

● IfrequestedbytheChairoftheSHB,CounselingandStudentHealthwillbepresentatSHB hearingsasobservers.

● Beforeadjourning,theSHBwillmeetprivatelywithCounselingandStudentHealthto addressanyissuesthatmayhavearisenfromthemeeting.

● AfterthisportionoftheSHBhearingconcludes,allpertinentinformationhasbeen reviewed,andallrelevantquestionshavebeenanswered,theSHBshalldeliberate,in private,todeterminewhethertherespondentisresponsibleforoneormoreviolationsof prohibitedconduct. Iffoundthataviolationhadoccurred,theSHBwilldeterminean appropriateresponsefromtheUniversitybasedontheseverityorfrequencyofviolations, includingpastviolationsifany,andconsideringprecedent.

● TheSHB'sdeterminationshallbemadebasedonwhetheritismorelikelythannotthatthe respondentengagedinprohibitedconduct. InaccordancewiththeDepartmentof

Education/OCRRegulations,theprocessforinvestigatingandadjudicatingmattersof allegedsexualharassmentwillberespondedtopromptlyandinamannerthatisnot deliberatelyindifferent.

GeneralProceduralRulesoftheSexualHarassmentBoard. TheChairshallpresideoverand conductthehearingandisspecificallyempoweredtodoorassurethefollowing:

● Thattherightsandresponsibilitiesofthecomplainantandrespondentareobserved.

● Controltheadmissionofpersonstothehearing.TheChairmayorderanypersonin attendancethatdoesnotconducthimorherselfinanorderlyandrespectfulmannertoleave. Obstructive,contemptuous,ordisruptiveconductinthepresenceoftheBoardbyany person,includingthecomplainantandrespondent,mayresultinthatpersonbeingcharged withaviolationofprohibitedconductandexcludedfromthehearing.

● Thecomplainantshallnormallybeexpectedtoattendthehearinginpersonandpresentthe basisforhis/heraccusations. Incasesinwhichoneormorecomplainantscannotbepresent duetoacompellingreason,thecasemaybepostponeduntiltheindividualmaybepresent orhe/shemayparticipatebytelephone,video,orotherelectronicmeans.Absence,dueto graduation,withdrawalorotherseparationfromtheUniversity,shallnotbecompelling reasonssufficienttojustifyparticipationwithoutbeingpresent. Ifthecomplainantdoesnot attendthehearing,theirclosingstatementwillnotbedeliveredduringtheSHBhearing.

● ControltheconductoftheSHBmembers,thecomplainantandrespondent,aswellas witnesses,toprotectthemfromimproperquestions,insultingtreatment,offensivebody language,andunnecessaryinquiryintotheirprivateaffairs.

● Excludewitnessesfromthehearingroomexceptwhentheyareprovidinginformation requestedbytheSHB.

● AllmembersoftheSHBmustbepresentthroughoutthehearing.

● IfamemberoftheSHBmustleavebeforethehearingiscompletewithgoodcause,the Chairmay,athis/hersolediscretion,placethehearinginrecessandreconvenethehearing within24hours.

● Ifavotingmemberrecuseshim,her,orthemselvesorforgoodcausemustwithdrawfrom thehearing,theChairshallselectareplacementfromthepoolofqualifiedindividuals. The Chairshall,afterconsultationwiththerespondentandthecomplainant(ifapplicable), providethereplacementwithasummaryofallpriorproceedings.

● NopersonshalladdresstheSHBorsubmitquestionstotheChairforanywitnesswithout firstbeingrecognizedbytheChair.

● Crossexaminationmaynotbeconductedbyapartypersonally.Ifastudentdoesnothave anadvisortoconductthecrossexamination,theUniversitywillappointanadvisorofits choice.

● Onlyrelevantcrossexaminationandotherquestionsmaybeaskedofapartyorwitnessas determinedbytheSHBChair.TheChairmustprovidereasoningforexclusionofquestions duringcrossexamination.

● Crossexaminationmaynotincludequestionsaboutacomplainant’ssexualbehavioror dispositionunlessevidenceofsuchbehaviorisofferedtoestablishconsentorto demonstratethatanotherpartyisresponsibleforcommittingtheviolationofstudent conduct.

● Attherequestofeitherparty,aninstitutionmustpermitcrossexaminationtooccurwiththe partieslocatedinseparaterooms.

● TheUniversityisnotallowedtorelyonstatementsmadebyapartyorwitnesswhodoesnot submittocrossexamination.

● Takingofphotographsinthehearing,broadcastingfromthehearing(withtheexceptionof videoconferencingperrequestanddiscretionoftheChair),orrecordingthehearingfor non-officialuseorforlaterreleaseorbroadcasttothepublic,shallnotbepermitted.

● Failureofindividualstoappearatproceedingsmayrendertheirstatementsand/ortestimony ineligible.

OrderoftheHearing

● TheChairwillaskthemembersoftheSHB,therespondent,therespondent'smentor,the complainant(ifapplicable),andthecomplainant'smentor,witnesses(ifapplicable),and othersinattendancetointroducethemselves.

● TheChairremindsallpartiesthatthecasewillusetheclearandconvincingstandard, whethertherespondentisastudentoranemployee(includingfacultymember)todetermine culpability,meaningthatinordertofindtherespondentresponsible,theSHBmustfind, basedontheevidencepresentedattheproceeding,thatitisclearandconvincingthe respondentisresponsiblefortheviolationscharged. Itissharedthatmentorsthat accompanythecomplainantandrespondentshallnotbeprovidedtheopportunityto participateinthemeetingorotherwiseinterferewiththeproceedings.

● TheDTIXCoordinatorshallpresenttheallegationsofharassmenttotheSHBandfacilitate thereadingofreports.

● TheDTIXCoordinatorshallpresentasummaryoftheallegedharassmentbasedonhis/her investigationleadinguptothehearingandcallonUniversitycommunitymemberswith reportedknowledgeoftheallegedharassmentandinformationdeemedrelevanttothe matterbeingreviewed.

● Witnesses,andallothersparticipatingintheproceedings,shallprovideinformationunder affirmationof The Wesleyan Creed.

● TheSHBmembersshallhavetheopportunitytoaskquestionsofthecomplainant, respondent,andwitnesses. ThecomplainantandrespondentmayrequestthattheChairask aspecificquestiontotheotherpartyorawitness.

● Evidencesubmittedbythecomplainantorrespondentwillbereceivedatthediscretionof theChairinconsultationwiththeDTIXCoordinatorsandothers.

● Writtenstatementsofwitnesseswhocannotattendthehearing,suchasmedicalormental healthprofessionals,mustbesubmittedinadvanceoftheSHBhearingandmaybeentered perthediscretionoftheChairandupontherecommendationoftheDTIXCoordinator(s).

● SHBwillrecesspriortotheconclusionofthehearingtodiscussmattersinexecutive session,whichmayincludeconsultingCounselingandStudentHealth,CampusSecurity, theOfficeofResidenceLife,andtheDTIXCoordinator(s).

● Thecomplainantshallbegiventheopportunitytomakeaclosingstatement.

● Therespondentshallbegiventheopportunitytomakeaclosingstatement.

● ThehearingwilladjournsothatthemembersoftheSHBmaydeliberateinprivateand determinetheUniversity'sresponse.

● Uponadjourningthemeeting,theChairwillscheduleatimetomeetseparatelywithboth thecomplainantandrespondenttodelivertheresponsefromtheUniversity

● Afterdeliberationsarecomplete,theChairwilldraftalettercontainingthefindingsforboth thecomplainantandrespondent.

● TheChairwillmeetwithboththecomplainantandtherespondentinthepresenceofa CampusLiferepresentative,andthestudent'smentorifavailable,atthescheduledtimeand provideinformationrelatedtothedecisionoftheSHBandinformationrelativetoappealing totheSexualHarassmentCommitteeofAppeals.

AppealingtheDecisionoftheSexualHarassmentBoard. Whenrequestedbythe complainantorrespondent,thedecisionsoftheSHBcanbereviewedbytheSexualHarassment CommitteeofAppeals(SHCA):

● Thecomplainantandtherespondenthavefive(5)businessdaysfollowingreceiptof outcometoappealthedecisionoftheSHB.

● ShouldanindividualwishtoappealthedecisionoftheSHBbeyondfivedaysafter receivingnotificationoftheUniversity’sdecision,theyshouldbringthemattertothe attentionoftheSeniorVicePresidentcitingreasonsfortherequest. Thistypeofappealis reservedforspecialcircumstances,suchasnewinformationthatwasnotavailablepriorto theexpirationofthefive-dayappealperiod.

● ThisappealmustbeprovidedinwritingtotheSeniorVicePresident. Thisappealmustbe basedononeormoreofthefollowing: (a)newevidencerelevanttothereviewedmatter andareasonwhyitwasnotavailableatthetimeofthehearing,(b)aperceivedviolationof dueprocessandjustificationfortheclaim,(c)unjustsanctionsoralackthereofwithan explanationforthereasonforsuchclaim. TheSeniorVicePresidentwillprovidetheTitle IXCoordinatorwiththeappealandsupportingevidence.

● Shouldthebasisforappealmeetthecriteriapreviouslymentionedandbedeemedvalidby theTitleIXCoordinator,thematterwillbereferredtotheSHCA.

● TheSHCAiscomprisedofthreefaculty/staffmembers,oneofwhomshallpresideasChair

● TheSHCAisnotahearingbodybutratherareviewcommittee. Therefore,itwillnot conductanadditionalhearingbutwillberesponsibleforreviewingdocuments,recordings, reports,transcripts,andfindingsoftheSHBforproceduralerrorspertinenttotheSHB hearingorforareasitbelievestheSHBshouldreconsider.

● Whennecessary,theSHCAmaycontactmembersoftheSHBtodiscusstheirdeliberations andtherationalefortheirfindings.

● UponthecompletionoftheSHCA'sreview,theSeniorVicePresidentmeetswiththe respondentorcomplainantinthepresenceofarepresentativefromtheSHCAandsharesthe findingsoftheSHCAinwriting. ShouldtheoriginaldecisionoftheSHBbeamended,both therespondentandcomplainantwillbenotified.

● Minorproceduralerrors,whichtheSHCAdeterminesdidnotaffectanyportionofthe outcomeofSHBproceedingsmaybenoted,butsucherrorsneednotresultinaremandto theSHBformodificationofitsdecision.

AppealTranscriptNotation.ItistheresponsibilityoftherespondenttoappealtotheSenior VicePresidentwhenandifnewinformationbecomesavailable. TheSeniorVicePresident,in

consultationwiththeTitleIXCoordinator,willdetermineifthenewinformationwouldhave changedtheoutcome.Ifthisisdeterminedtobethecase,usingclearandconvincingasthe standard,thenotationwillberemovedfromthetranscript.

ComplainantandRespondentRightsandResponsibilitiesinSHBProceedings.Complainant andrespondentshallbeaffordedthefollowingrightsandresponsibilitiesthroughouttheconduct process:

● Ahearingconductedinaccordancewiththepoliciesandpracticesoutlinedinthe Student Handbook.

● Ahearingprocessandoutcomebasedonreliableevidenceandtestimony,including reasonableinferencesdrawnfromsuchevidenceandtestimony,andreasonable determinationsbytheDTIXCoordinator(s),whoshallserveasthechiefinvestigator(s).

● AcopyoftherulesandproceduresoftheUniversity'sprocessformanaginginstancesof allegedTitleIX/SexualHarassmentviolations.

● Theservicesofamentorofhis/herchoice. Thementormaybeanattorney,parent,friend, counselor,oramemberofthefacultyorstaff.

● MentorsmayattendthepreliminarymeetingswithTitleIXinvestigatorsandallother relatedmeetingswiththecomplainantorrespondentorinvestigativeinterviewswiththe complainantorrespondentoncetheprocesshascommenced.

● Theroleofthementoristoprovidesupport,guidance,andadvicetothecomplainantor respondent.Thecomplainantandrespondentareresponsibleforpresentinghisorherown information,andtherefore,otherthanprovidingadviceandguidancedirectlytothe complainantorrespondent,mentorsarenotpermittedtoparticipateinthepreliminary meetings,interviews,otherinvestigativematters,orinmakingoralargumentsorstatements, questioningwitnesses,orraisingobjectionsataSHBhearing. Amentormayrequestabrief recessoftheproceedingstoprovideadvicetothecomplainantorrespondent.

● Thecomplainantandrespondentshouldselectasamentorapersonwhosescheduleallows attendanceatthescheduleddateandtimefortheSHBhearing,asdelayswillnotnormally beallowedduetotheschedulingconflictsofamentor.

● Toremainsilentandtobeadvisedthatanystatementtheymakemaybeusedagainstthem.

● Toreadthecomplaintduringpreliminarymeetingsandinvestigativeprocesses.

● Seektohavethecharge(s)heardand/orthesanctionsdeterminedbytheSHBinaccordance withtheseprocedures.

● TheDTIXCoordinatorshallprepareanddelivertothecomplainantandrespondentanotice ofhearing.Thenoticemaybedeliveredtothecomplainantandrespondentinperson. CommunityArbitrationSystem

DueProcess. Dueprocessisfundamentallyaseriesofprovisionsdesignedtoassuretheproper presentationofallrelevantfactsandbeliefsinanopenandforthrightmanner. Additionally,due processensurestherightsofindividualsallegedlyinviolationofUniversitypoliciesandprotects individualsfromfacelessaccusers. Duringspecifiedandnovelsituationsrequiringinterim regulations,theUniversitymayrespondtoconcernsthroughunconventionalmeanstypically associatedwiththehealthandwelfareofthecampuscommunity.

● Areasonableportionofthebudgetforaneventshallbedesignatedforthepurposeoffood items(chips,cheese&crackers,pretzels,orothersnacks)andnon-alcoholicbeverages (sodas,icedtea,fruitjuices,orotherbeverages-notwater). Foodandnon-alcoholic beveragesmustbeasprominentlydisplayedasanyalcoholicbeverages,mustbeprovided insufficientquantitiesforthosewhochoosenottoconsumealcohol,andmustbeavailable throughouttheevent.

RegulationsGoverningStudentConduct–Marijuana. EffectiveJuly1,2021,changesto Commonwealthlawregulatingtheuseofmarijuanapermitanindividual21yearsofageorolder to:

● possessuptofourmarijuanaplants.

RegardlessofCommonwealthlaw,VirginiaWesleyanreceivesfederalfundingthroughstudent financialaid,andthereforemustupholdallfederalguidelinesandlaws.Underfederallaw,the possession,distribution,andconsumptionofmarijuanaandparaphernaliaremainsillegal.

Studentsofanyageareprohibitedfrompossessing,using,manufacturing,ordistributing marijuanaandotherparaphernaliaontheVirginiaWesleyanUniversitycampus.Sanctionsfor

● TheUniversitymaytakeoneormoreofthefollowingactionsinresponsetoviolationsin Greekfacilities,inadditiontoUniversitydisciplinaryactions:(a)theUniversitymaynotify theinternational/nationalheadquartersofviolationsorsuspicionsandrequestaresponse and(b)whenwarranted,theUniversityreservestherighttorevokeachapter’scharter

● Theillicitsale,possession,use,cultivation,production,manufacture,extraction, preparation,offering,offeringforsale,distribution,purchase,deliveryonanyterms whatsoever,brokerage,dispatch,dispatchintransit,transport,importationandexportation ofstimulant,depressive,hallucinogenic,narcoticordaterapedrugs,oranyothersubstance listedbylawenforcementasacontrolledsubstanceisprohibitedonthecampus,property ownedorleasedbytheUniversity,andatUniversityactivities.

● Theunlawfulpossession,use,ordistributionofprescriptiondrugsisprohibitedonthe propertyownedorleasedbytheUniversityoratanyUniversityactivity Thepatientto whomthedrugwasprescribedfortheuseintendedandinthemannerprescribedmayonly takeprescriptiondrugs.Non-prescriptiondrugsmustbetakeninamannerconsistentwith theiruseasidentifiedonthepackagingorasdirectedbyaphysician.

● Thepossessionanduseofsyntheticcannabinoidsandsimilarsubstancesisprohibited.

● Thepossessionofdrugparaphernaliasuchas,butnotlimitedtobongs,pipes,clips, grinders,rollingpaperandvaporizersisprohibited.

● Astudentwhoisinthepresenceofanillegalsubstanceorparaphernaliamaybefoundin violationofUniversity’sdrugpolicy.

PolicyGoverningFireworks,Explosives,andFireSafety

FiresafetyisaseriousconcernoftheUniversity Thefollowingregulationsaredesignedto protecteverymemberoftheUniversitycommunityfromthethreatoffire.

● Nostudentmaypossessorusefireworksorexplosiveson-campusorinleasedhousing facilities.

● OpenflamesareonlypermittedindesignatedareaswithpriorapprovalfromCampus Security.

● Thelawrequiresfiredrills. Therefore,theUniversityconductsseveralfiredrillsevery semester. Wheneverafirealarmsounds,leavethebuildingquicklyinanorderlymannerby thenearestexit. Allwindowsanddoorsshouldbeclosed. Donotre-enterthebuildinguntil instructedtodosobyamemberofthefiredepartmentorCampusSecurity.Personsrefusing toleaveabuildingwhenanalarmsoundsareendangeringthemselvesandareinviolationof thelaw. Disciplinaryactionmaybeimposedforfailuretovacateabuildingduringafire alarm.

● Settingoffafalsefirealarm,thedischargeofaUniversityfireextinguisherforotherthan firefightingpurposesorthetamperingwithanyfiresafetyequipment(e.g.,smokedetectors) constitutesaviolationofUniversityregulationsandstatelaw Anypersonwhoisfoundin violationoftheUniversityfiresafetypolicywillbesubjecttoUniversitydisciplinaryaction and/orstatecriminalpenalties.

● Roomandbuildingexitsmustremainfreeofobstructions. Therefore,studentsarenot allowedtohangsheets,blankets,hammocks,orotheritemsinsuchafashionaswould hindertheexitingfromaroomandstudentsarenotallowedtoblockbuildingexitswith furnitureorinanyothermanner.

● Notapestries,flags,orfabricsmaybehungfromceilingsorwallsinanyresidentialspaces, commonareas,closets,bathrooms,orhalls,norcananymaterialcoveranysmokedetector orsprinklerhead. (Atapestryisdefinedasanyfabricobject,whichmaybehungordraped tobeusedasadecorationandwhichmaybedeterminedtobecapableofbecomingafire accelerant.) Curtainscoveringwindowsarepermittedaslongastheyareflameretardant, hungonspringtensionrods(rodsthatscrewormustbenailedintothewallarenot

permitted)andneitherhangpastthewidthoftheactualwindownorhanglowerthanthe windowsill. Studentsinviolationofthispolicywillhavetheirtapestries,flags,orfabrics confiscatedandaresubjecttoimmediatedisciplinaryaction,toincludethepossibleremoval fromorreassignmentwithinUniversityhousing.

● Eachstudent’sroomisprovidedwithasmokedetectorasrequiredbylaw. Replacement batteriesareavailablethroughtheResidentAssistant.

● Firesafetyequipmentandalarmsystemsareintendedforthestudent'ssafetyandforthe safetyofthosearoundthestudent. Donottamperwiththisequipmentunlessanactualfire emergencyexists.Shouldstudents,throughtheirownnegligence,setoffafirealarmthey maybesubjecttodisciplinaryactiontoincludefines.

PolicyGoverningProhibitedDevices

Hoverboards. Thepossession,use,storage,andchargingofHoverboards(alsoknownasSwag ways,IOHawks,orSkywalkers)isprohibited. Theseproductshavebeendeemedafirehazard andhaveaccountedfornumerousinjuries. TheCommonwealthofVirginia’sFireMarshal's recommendation,policiesimplementedbyinsurancecompaniesservicinginstitutionsofhigher education,andtheUniversity’sgenuineconcernforthewell-beingofcommunitymembersare thebasisforthispolicy

Drones. TheuseofDronesandotherremote-controlflyingdevicesisprohibited.Thispolicy complieswiththeFederalAviationAdministration(FAA),whichprohibitstheunauthorizeduse ofdronesandsimilarproductswithinfive(5)milesofanairport. Thispolicyalsoappliesto individualswithFAApermit. TheUniversity,inaccordancewithFAAregulations,reservesthe righttoutilizethesedevicesforofficialUniversitybusiness(i.e.surveyingorpromotional purposes).

PolicyGoverningOtherProhibitedBehavior

Thefollowingisalistofactionsthatconstitutemisconductand,undertheguidelinesofthe CommunityArbitrationorotherestablishedprocesses,studentsmaybedisciplinediffoundin violationofoneormorepolicies. Thislistisnotmeanttobeall-inclusive.

● Actionsthatdisruptortendtodisrupttheprivacyofothersand/ortheacademicmission; actionsthatendangerortendtoendangerthesafety,health,orlifeofanyperson.

● FailuretocomplywiththerequestofaUniversityofficial.

● Causingorcontributingtoadisturbance.

● Knowinglyfurnishingfalseormisleadinginformation,unauthorizeduseofidentification, failuretoproviderequestedinformationtoUniversityofficials.

● Deliberate,malicious,careless,ornegligentdestructionofUniversitypropertyorthe propertyofothers;usingUniversitypropertyotherthanforitsintendedpurpose.Whilethe Universitywelcomeselectricandplug-inhybridelectricvehiclesoncampus,studentsare prohibitedfromutilizingcampusutilitiesforchargingpurposes.

● CreatingunsanitaryconditionsinUniversityhousingandadjoiningpropertyoutside Universityhousing.

● Stealing,taking,orpossessinganother'spropertywithoutpermission.

● ImproperconductinUniversityhousing;failuretoabidebyregulations.

● Possessionoffireworksorexplosives,inappropriateuseofsafetyequipment,failureto evacuateabuildingwheninstructedtodosobyUniversityofficials.

● Violationofprevailingfederal,Commonwealth,orlocallawsundercircumstancesthat createsanexusbetweentheviolationandtheUniversitycommunity.

● RemovaloffoodorotheritemsfromthediningcenterotherthanintheUniversityapproved take-outcontainers,refusaltowearshoesinthediningcenter,lockoutproceduresandother specificpoliciesregardingcampusresourcesandfacilities.

● Recordingordistributinganotherperson’simageorvoice,withoutpermission,wherethat personhadareasonableexpectationofprivacy,isprohibited.

● Playingsportsorskateboardinginsideresidentialfacilities.

TheUniversitydoesnotattempttoregulate,nordoesittakeresponsibilityfor,theoff-campus behaviorofitsstudents. TheUniversitywill,however,takeactionagainststudentswho’soffcampusbehaviorimpedesordisruptstheUniversitycommunityand/orunderminesorthreatens thewelfareoftheUniversityormembersoftheUniversitycommunity.

PolicyGoverningViolence

TheUniversityisfullycommittedtomaintaininganenvironmentinwhichallmembersofthis communitycanbeconfidentthattheyaresecurefromphysicalviolence,whetherthreatenedor actual. Anystudentfoundtohavethreatenedand/orcommittedactsofphysicalviolenceagainst anypersonissubjecttoimmediatedisciplinaryaction. Astudentfoundtohavecommittedan actofphysicalviolenceagainstanotherpersoncanexpecttoreceivethesanctionofsuspension ordismissalfromtheUniversity. Inexceptionalcases,mitigatingcircumstanceswillbe consideredwhichmayresultinlessersanctionsforlessseriousviolations. Additionalconditions andsanctionsmaybeimposedasdeemedappropriatebytheCommunityArbitrationBoard

and/ortheSeniorVicePresident. Thosewhocommitactsorthreatsofphysicalviolenceare subjecttobothstateand/orlocalprosecutionand/orcivillitigation.

PolicyGoverningHarassmentandHazing

Harassment. NooneintheVirginiaWesleyancommunityshouldbehaveinanymannerthat canreasonablybeconstruedasharassment. Theseactionswillnotbetolerated,asitisthe opinionofthisacademiccommunitythatthiskindofinsensitivityisinjurioustoboththepeople involvedandtheinstitutionitself.

Theterm"harassment"appliestoanyconductthatreflectsademeaningattitudetowarda person'srace,gender,ethnicorigin,religiousbeliefs,sexualorientation,genderexpression, disability,orothercharacteristicsthatcreatesanintimidating,hostile,oroffensiveenvironment thatinterfereswithaperson'sperformanceandequanimity.

Hazing. Hazingisanactthatareasonablepersonwouldconsiderendangeringtoone’sphysical ormentalwellness. Itisoften,butnotexclusively,associatedwithadmission,involvement, association,orcontinuedmembershipinagroup,team,ororganization. Hazingmayinclude humiliation,intimidation,and/ordemeaningtreatment. Itmayalsoinvolvealcohol,drugs,or othersubstances.

TheNationalCollegiateAthleticAssociation(NCAA)defineshazingasanyactcommitted againstsomeonejoiningorbecomingamemberormaintainingmembershipinanyorganization thatishumiliating,intimidatingordemeaning,orendangersthehealthandsafetyoftheperson. Hazingincludesactiveorpassiveparticipationinsuchactsandoccursregardlessofthe willingnesstoparticipateintheactivities. ReadtheNCAAHazingPreventionHandbook.

HazingisacriminaloffenseintheCommonwealthofVirginia. HazingisaviolationofVWU’s policyandisprohibitedinallforms. Itappliestoallstudentorganizations,clubs,and individuals. Concurrently,theNCAA,NorthAmericanInterfraternityConference,theNational PanhellenicConference,andtheNationalPan-HellenicCouncilagreethathazinghasnoplacein thecollegiateexperience.

Organizationalleaders(presidents/chairmen)andteamcaptainsareresponsibleforinforming membersandprospectivemembersofthehazingpolicyeachsemester

Anystudentwhobelievesthatheorshehasbeenharassedorhazedisencouragedtoreportthe activity.

ShouldamatterbebroughttotheattentionofUniversityofficialsrelativetobehaviorreasonably construedashazing,whichontheperipheryinvolvespossibleviolationsofUniversitypolicyto includesubstanceuseorabuse,andareportismadeingoodfaith,theUniversitywillnothold thereportingpartyresponsibleforviolationoftheStudentCodeofConduct.

PolicyGoverningGambling,Solicitation,andDistributionofLiterature

Gambling. Gamblingisnotpermittedonthecampus,inUniversitybuildings,oratoff-campus Universitysponsoredfunctions/facilities.

Solicitation. Individualstudents,aswellasoutsidepersonsandorganizations,maynotsolicit funds,sellitemsanywhereon-campusorusethecampussystemforsolicitationorpromotion withoutauthorizationfromtheSeniorVicePresidentordesignee.

DistributionofLiterature. Registeredstudentorganizationsmaydropoffflyerstobeapproved andhungbytheOfficeofStudentEngagement(4forBattenCenterandupto87forUniversity housing). Flyersareremovedaftertwoweeks.

PolicyGoverningSmokeFreeEnvironmentandTobaccoUse

Smokingisdefinedastheactoflighting,smoking,orcarryingalightedorsmolderingcigar, cigarette,pipe,ore-cigaretteofanykind.

VirginiaWesleyanUniversityprohibitstobaccouseincludinge-cigarettesandsmokelesstobacco inclassroomsandadministrativebuildings,diningareas,athleticfacilities,andUniversity owned-vehicles. SmokingisprohibitedinUniversityhousingandwithin25feetoftheoutside ofanybuilding. Smokingshouldbedoneinareasthatpreventsmokeande-cigarettevapors fromenteringthroughentrances,windows,ventilationsystems,orothermeans.

Forstudentswishingtostopsmoking,theymayobtaininformationthroughtheOfficeof CounselingandStudentHealth.

TheUniversityprohibitsthesaleandpromotionoftobaccoproducts.

Smokingurnsare25feetormorefromselectbuildingentrances. Smokersareencouragedtouse themtokeepthegroundsbeautiful.

PolicyGoverningParkingandTrafficRegulations

Studentsmayhavemotorvehiclesoncampusprovidedtheyholdavaliddriver'slicense,are drivinganinsuredvehicle,complywithtrafficlaws,andobeyallUniversitytrafficandparking regulations. Vehiclesoncampusaretheresponsibilityofthestudentwhoregistersand/ordrives thecar,andarehereatthestudent'srisk. TheUniversitydoesnotassumeanyriskor responsibilityforvehiclesdrivenorparkedoncampus.

AllvehiclesmustberegisteredwiththeCampusSecuritywithinoneclassdayofthevehicle's arrivaloncampus. StudentsmustgoonlinetoWebAdvisortoregistertheirvehicle. Alicense platenumber,VINnumber,companynameofvehicleinsurance,anddriver’slicensenumber willberequiredtoregisterastudent’svehicle. Uponpickingupthedecalfortheregistered vehicle,a$150.00parkingfeewillbechargedtothestudent’saccount. Decalsareineffectfor oneacademicyear. TheUniversityreservestherighttoremoveanydecalnotincompliance,i.e. expiredoraffixedtothewronglocation. Decalsmustbeaffixedtotheinside,frontwindshield, driver’sside,uppercorner.Ifthevehiclehasatintedstripatthetop,thedecalshouldbeaffixed underthetintedareasoitcanbeseen. Thosepersonswhohavemorethanonevehicleavailable tothemandwhodesireparkingprivilegesforeachvehiclewillberequiredtoregistereach vehicleandpaythe$150.00decalfee.Theremaybetimeswhenastudentisdrivingavehicle thatdoesnotbelongtothemonatemporarybasis. Duringthosetimes,astudentmustreportto theCampusSecurityOfficetoobtainatemporaryparkingpermit. Thereisnocostforthis temporarypermit. Avehiclerequiringatemporarypermitlongerthanfourteendaysconstitutes asecondvehicleandanadditionaldecalmustbepurchasedforthatvehicle.

GUESTREGISTRATIONANDPARKINGREGULATIONS-Studentsareresponsiblefortheir guest’stickets.GuestsmustberegisteredthroughWebAdvisorandobtainablueparkingpass uponenteringthecampus.Guestsmustvacatecampuspriortotheendofvisitinghours. OvernightguestsmustberegisteredwiththeOfficeofResidenceLifeandwillbegivenan overnightpassuponenteringthecampus.Anyguestvehiclewithoutanovernightpassontheir dashboardfoundoncampusaftervisitinghourswillbeticketedandthestudentwhoregistered theguestwillbecharged.

Parkingisauthorizedandrestrictedaccordingtothefollowingguidelines:

● Parkinglotsarecheckedandparkingregulationsenforced24hoursaday,sevendaysa week.

● Whenparking,vehiclesaretobeparkedinaparkingspacebetweentwo(2)whitelines.

● Parkingisprohibitedinareasmarkedasfirelanesorareaspaintedwithyellowcurbs.

● Sixty-nine(69)parkingspacesforpersonswithdisabilitiesarelocatedaboutcampus.

● ParkingonSmithDriveoronanyroadwayisprohibited. Parkinginentrances,loading zones,andotherrestrictedareasisprohibited.

● VehiclesmaynotbeparkedingrassareasunlessdesignatedbyCampusSecurityasparking spaces.

● Specialeventsheldoncampusmayrequiretheuseofdesignatedparkinglotsforotherthan intendeduse. CampusSecuritywillrestricttheseareaswithparkingcones. Campus communitymembersandguestswillbedirectedtoalternativeparking.

● Undercertaincircumstances,illegallyparkedvehiclesaresubjecttotowingand/orhaving wheel-lockingdevicesplacedonthevehicle. Allrelatedexpenseswillbetheresponsibility oftheregisteredownerandmustbepaidwhenrecoveringthevehicle.

● Attimesitmaybenecessarytoparkinaprohibitedareatoloadandunloaditems.Hazard lightsmustbeengagedandthereisastricttimelimitof15minutes.Driverswhofailto followthisprocedurewillbesubjecttoa$25to$100finedependingonthelocation.

Trafficviolationswillbehandledinthefollowingmanner:

● Ticketswillbewrittenintwo(2)parts. Onepartwillbeplacedontheviolator'svehicleand CampusSecuritywillretainthestub.

● Finesshallbeautomatic.Iftheviolatorfeelsthattheparkingfinewasissuedinerror,the violatormustcontactCampusSecuritywithinseven(7)workingdaysaftertheviolation occurredtodiscussthefine. Iftheviolatorisnotsatisfiedwiththeoutcome,theymayfilea requestthroughtheCommunityArbitrationSystem. Therequestforthehearingmustbe

madeinwritingwithinthree(3)daysofappearinginCampusSecurityortheviolation standswithouttherightofappeal. IftheviolatordoesnotappearinCampusSecurityto discussthefineorrequestahearing,theywillbebilledforthecharge.

PolicyGoverningAcceptableUseofUniversityComputerSystems,Networks,and SocialMedia

AccesstocomputersystemsandnetworksownedoroperatedbyVirginiaWesleyanUniversity imposescertainresponsibilitiesandobligationsbyfacultyandstaffaswellasstudentsenrolled inUniversityclasses. ThisaccessisgrantedsubjecttoUniversitypolicies,federal, Commonwealth,andlocallaws. ReadthecompleteAcceptableUsePolicyhere

WithdrawalandSeparationfromtheUniversity

SeparationfromtheUniversityreferstoatemporaryorpermanentperiodofabsencefrom campusand/orclassesthatmaybeinitiatedbytheinstitutionorastudent. Separationincludes:

(a)AcademicDismissal,(b)AcademicSuspension,(c)AdministrativeWithdrawal,(d) AdministrativeWithdrawalforNon-Attendance(NoShow),(e)DisciplinaryDismissal,(f) DisciplinarySuspension,and(g)GeneralWithdrawal,(h)MedicalWithdrawal.

AcademicDismissal. Inrarecasesofacademicnon-performance,theCommitteeofAcademic Standingmay“dismiss”astudentforaperiodofuptofiveyears.

AcademicSuspension.“Suspension”occurswhentheCommitteeofAcademicStanding determinesthatastudent’sacademicperformancemeritsseparationfromtheinstitutionfortwo terms(withsummerandwintercountingasaterm.)

AdministrativeWithdrawal/Leave. Shoulditbedeterminedthatastudentisariskto themselvesorothers,basedonexhibitedand/ordocumentedbehavior,orifastudentcontinues toremainacademicallyunengagedafterreasonableinterventionfromtheUniversity,thestudent maybeadministrativelywithdrawn. TheSeniorVicePresidentcoordinatesthisprocess.

Financialandacademicmattersrelatedtoanadministrativewithdrawalwillbehandledona case-by-casebasis,thoughtheywillnormallyadheretoexistingUniversitypoliciesand practices. Basedonastudent'sobservedanddocumentedbehavior,specificallyasitrelatesto his/herwelfareorthesafetyofthecampuscommunity,theSeniorVicePresidentordesignee may,inconsultationwithandconcurrencefromotherUniversityofficials(OfficeofCounseling

andStudentHealth,SentaraStudentHealthCenter,CampusSecurity,andOfficeofResidence Life),separateastudentfromtheUniversitypermanentlyorforastatedperiodoftime. A temporaryseparationmayalsoincluderequiredactiononthestudent'sbehalfasacriterionfor readmission. Thismayincludecounselingorotherhealth/behavioralmodificationinterventions.

InaccordancewithUniversitypolicyspecifictoendangeringbehaviorandadministrative withdrawal/leaveprocesses,individualswhodisplaybehaviors(toincludeideations)that endangerorintendtoendangerthesafety,healthorlifeofanyperson,includingself,maybe subjecttotemporaryorpermanentseparationfromtheinstitutiontoensurethewellbeingofthe studentandcampuscommunity InaccordancewithCommonwealthlaw,familyand/orguardian notificationandinvolvementisnecessarytoensurethesafetyandwellbeingofthestudent. ThisprocessiscoordinatedbyCounseling&StudentHealthandCampusLifeleadershipin conjunctionwithnon-affiliatedindependent,licensedmentalhealthprofessionals.Thestudent’s abilitytoreturntocampusiscontingentupondocumentedandverifiedabilitytoliveinan unsupervisedsettingwithoutcontinueddangertoselforothers.

TheOfficeofCounseling&StudentHealthcoordinatesthenotificationofthestudent’sabsence withtheOfficeofAcademicAffairstomitigatenegativeconsequencesassociatedwitha prolongedabsencefromclasses.Studentsareencouraged,asmedicallyandemotionallyable,to communicatedirectlywithprofessorsregardingtheabsenceanddevelopanindividualizedplan tomaintainacademicpaceincourses.

Administrativeseparationwillonlybeutilizedundercertaincircumstances,inmattersofgrave concern,andwhentheUniversity'straditionalmethodsforpartingwithastudentmustbe compromisedduetourgencyandforthesakeofsafety. Anoticeoftheadministrative withdrawalwillbepresentedtothestudentandcopiedtoallappropriateparties. Thisnotice, whichwillappearinletterformatandmaybedeliveredelectronically,willcommunicatethe conditionsthataccompanythewithdrawalastheymayrelatetoastudent'spermanentor temporaryseparationfromtheUniversity,aswellasconditionsthatmustbesatisfiedasa requirementforeligibilityforconsiderationforreadmission.Additionally,theUniversitymay communicatethenatureoforcauseforthewithdrawaluponrequestfromanotherinstitutionor agencyfollowingstandardhighereducationpractice. Financialandacademicimplicationsofan administrativewithdrawalwillbemanagedonacase-by-casebasis,inconsultationwith appropriateUniversityofficials,andinaccordancewiththeUniversity'spoliciesandpractices.

AdministrativeWithdrawalforNon-Attendance(NoShow). Studentswhoregisterfora semesterofcourseworkbutdonotattendclasssessionsofanyoftheircoursesduringthefirst weekofthesemesterarewithdrawnfromtheUniversityadministratively,andnotifiedofthat actionbyalettersenttobothhomeandcampusaddresses. Thosestudentsareresponsiblefor

10%oftuitionandroomchargesplustheadministrativecostallowance. However,thestudent willbeineligibleforanyfederal,Commonwealth,orinstitutionalfinancialaid. Thisincludesall grants,scholarships,andloans.

Thispolicydoesnotapplytostudentswhoattendsome,butnotall,oftheircourses.Inthiscase, studentswillreceivegradesincoursesthattheydidnotattendbutdidnotformallydrop. Studentsareresponsibleforalltuitionandfeeschargedforthosecourses.

DisciplinaryDismissal. ApermanentseparationfromtheUniversity Incasesofdismissalfor violationoftheSexualHarassmentPolicy,theUniversitywillmakeanotationonthestudent’s academictranscript.

DisciplinarySuspension. AperiodofseparationfromtheUniversity,usuallyfromonetotwo semesters,oruntilcertainconditionsaremet. Ifsuspended,thestudentmustvacatecampus typicallywithin24hoursofnotification. Thecompletionoftheperiodofsuspensiondoesnot guaranteereinstatement. IncasesofsuspensionforviolationsoftheSexualHarassmentPolicy, theUniversitywillmakeanotationonthestudent’sacademictranscript. Onceastudentis suspendedfromtheUniversity,thestudentwillnotbeallowedontheVWUcampusforany reasonduringthestatedperiodofsuspension.

GeneralWithdrawal. Ifastudentwithdrawsafterthedrop/addperiod,thestudentwillbe awardedaWithdrawal(W)upuntilthedeadlinedatetodropacoursewithoutanautomatic WithdrawFailing(WF). AWgradewillnotcounttowardsthestudent'sCumulativeGPA.A WFgradewillcounttowardsthecumulativeGPAasazero.

Incompletes:Ifastudentdoesnotcompleteacourse,he/shewillhavetocompletetherequired workthefollowingsemesterifgrantedanincompletebythecourseinstructor Ifthe requirementsarenotmet,thestudentwillreceiveagradebasedonthecompletedwork. Thisis atthediscretionofthefacultymember Ifthestudentdoesmeettherequirementsduringthe followingsemester,thestudentwillreceiveanIA,IB,IC,ID,IF(whichwillbecountedthe sameasanA,B,C,D,orFGrade).

AstudentwillbeautomaticallyplacedonWarningifmorethanoneincompletegradeisreceived inanysemester.

MedicalWithdrawal. Withproperdocumentationfromamedicalprofessional,toinclude certifiedclinicianswhocanspeaktoastudent’sconditionandhowitimpactsacademic performanceorinhibitstheirabilitytocompletecourserequirementsoranacademicterm,a studentmaybeaffordedamedicalwithdrawal. Basedonthecircumstancesandsupplied documentationandatthediscretionoftheProvostandVicePresidentforAcademicAffairsor

designeeand/orthatofthestudent'sprofessors,astudentmaybeawardedaWorWFforeach course. Financialimplicationsofamedicalwithdrawalwillbemanagedonacase-by-casebasis, inconsultationwithappropriatecampusoffices,andinaccordancewiththeUniversity'spolicies andpractices.

ReturnofFederalFinancialAid. TheFinancialAidOfficeisrequiredbyfederalstatuteto recalculateFederalTitleIVfinancialaideligibilityandMilitaryTuitionAssistance(TA)for studentswhowithdraw,dropout,aredismissed,ortakealeaveofabsencepriortocompleting 60%ofapaymentperiodorterm.

Ifastudentleavestheinstitutionpriortocompleting60%ofapaymentperiodorterm,the FinancialAidOfficerecalculateseligibilityforTitleIVfundsandMilitaryTA. Recalculationis basedonthepercentageofearnedaidusingthefollowingFederalReturnofTitleIVfunds formula:

● Percentageofpaymentperiodortermcompleted=thenumberofdayscompleteduptothe withdrawaldatedividedbythetotaldaysinthepaymentperiodorterm. (Anybreakoffive daysormoreisnotcountedaspartofthedaysintheterm.)Thispercentageisalsothe percentageofearnedaid.

Ifastudentearnedlessaidthanwasdisbursed,theinstitutionisrequiredtoreturnaportionof thefunds,andthestudentisrequiredtoreturnaportionofthefunds.WhenTitleIVfundsare returned,thestudentborrowermayoweabalancetotheinstitution,whichmustbepaidwithin 30daysofwithdrawal.

Ifastudentearnedmoreaidthanwasdisbursed,theinstitutionowesthestudenta post-withdrawaldisbursement,whichmustbepaidwithin120daysofwithdrawal.The institutionmustreturntheamountofTitleIVfundsforwhichitisresponsiblenolaterthan45 daysafterthedateofthedeterminationofthedateofwithdrawal. TocomplywiththeDepartmentofDefensepolicy,VirginiaWesleyanUniversitywillreturnany unearnedTAfundsonaproratedbasisthroughatleastthe60%portionoftheperiodforwhich thefundswereprovided. TAfundsareearnedproportionallyduringanenrollmentperiod,with unearnedfundsreturnedbaseduponwhenastudentstopsattending. Thesefundsarereturnedto themilitaryservicebranch. Instanceswhenaservicememberstopsattendingduetoamilitary serviceobligation,VWUwillworkwiththeaffectedservicemembertoidentifysolutionsthat willnotresultinstudentdebtforthereturnedportion.

Withdrawingordroppingcoursespriortothestartofclasses,100%ofTAisreturnedtothe militaryservicebranch. 15-weekcoursewithdrawalsubmitted,the60%ofcourseiscompleted at9weeks. 12-weekcoursewithdrawalsubmitted,the60%ofcoursecompletedat7.2weeks. 7.5-weekcoursewithdrawalsubmitted,the60%ofcoursecompletedat4.5weeks.

WithdrawalandRefundPolicies. SincetheUniversitymustmakefinancialcommitments,the tuitionandroomdepositsarenonrefundable. Thewithdrawalpolicyappliestostudentswho attendatleastoneclassandthen“officially”withdrawfromtheUniversity Anofficial withdrawalmeansthestudentneedstogothroughtheproperchannelsassetforthbythe University Simplyfailingtoattendclassesdoesnotconstitutean“official”withdrawal. In ordertoinitiatetheprocess,astudentmustvisittheOfficeoftheRegistrartoobtaina withdrawalform. StudentswhowithdrawfromtheUniversitycompletely(withdrawingfromall classesinwhichhe/she/theyisregistered)mayreceiveapartialrefundasfollows:90%during thefirstweekofclasses,50%thesecondweekand25%thethirdweek. Afterthethirdweekof classes,thereisnorefund. Calculationsarebasedonthedatethewithdrawalformiscompleted andsubmittedtotheOfficeoftheRegistrar TheUniversitywillchargeanadministrativecost forastudentwithdrawal. Thecostwouldbefivepercent(5%)oftuition,room,andmeals originallycharged,however,itwouldnotexceed$100.00. Studentfeesarenon-refundable.

WithdrawalWhileUnderInvestigation. TheUniversitywillprominentlynoteonastudent’s officialacademictranscriptastudent’swithdrawalwhileunderinvestigationforviolating policiesgoverningsexualharassment. TheUniversityshallremovefromthestudent’sacademic transcriptanynotationplacedonsuchtranscriptincaseswherethestudenthadwithdrawnfrom

theUniversity,butwassubsequentlyfoundnotresponsibleforviolatingsexualharassment policies.

GradePolicy. StudentssuspendedordismissedfromtheUniversityfordisciplinaryreasonswill receiveagradeofWorWFineachcourseinwhichtheyarecurrentlyenrolledatthediscretion oftheinstructorofthatcourse,unlessworkinagivencoursehasalreadybeencompleted,in whichcasethestudentwillreceivethegradealreadyearned.

RefundPolicy. Shouldastudentbesuspendedordismissedfordisciplinaryreasons,the Universitywillretainthefollowingamountoftuition,roomandboard,andfederal, Commonwealth,andinstitutionalfinancialaid. CommonUniversityTerms

AdministrativeWithdrawal. Shoulditbedeterminedthatastudentisarisktothemselvesor others,basedonexhibitedanddocumentedbehavior,orifastudentcontinuestoremain academicallyunengagedafterreasonableinterventionfromtheUniversity,thestudentmaybe administrativelywithdrawn. TheSeniorVicePresidentinconsultationwiththeProvostandVice PresidentforAcademicAffairs,theVicePresidentforFinanceandAdministration,andDirector ofFinancialAidcoordinatesthisprocess. Financialandacademicmattersrelatedtoan administrativewithdrawalwillbehandledonacase-by-casebasis,thoughtheUniversitywill normallyadheretoexistingpoliciesandpractices.

AlcoholProbation. Whileonalcoholprobation,students,regardlessofage,areprohibitedfrom consuming,possessing,orbeingundertheinfluenceofalcoholwhileonthecampusofVirginia WesleyanUniversity,andsubsequentinfractionsmayresultintheirsuspensionfromthe University

Appeal(SexualHarassmentBoard). IncasesinvolvingTitleIX/sexualharassment,the complainantandrespondenthavetherighttoappealthedecisionoftheSexualHarassment Board(SHB). Thecomplainantandrespondentalsohavetherighttowrittennoticeofany changeintheoutcomeorsanctionsimposed.Thisappealmustbeprovidedinwritingtothe SeniorVicePresident. Thisappealmustbebasedononeormoreofthefollowing:(a)new evidencerelevanttothereviewedmatterandareasonwhyitwasnotavailableatthetimeofthe hearing,(b)aperceivedviolationofdueprocessandjustificationfortheclaim,(c)excessive sanctionswithanexplanationforthereasonforsuchclaim. TheSeniorVicePresidentwill providetheTitleIXCoordinatorwiththeappealandsupportingevidence. Shouldthebasisfor appealmeetthecriteriapreviouslymentionedandbedeemedvalidbytheTitleIXCoordinator ordesignee,thematterwillbereferredtotheSexualHarassmentCommitteeofAppeals (SHCA). TheCRBmaysuggestchangestotheproposedsanctionsnecessitatingadiscussionamong theCABandCRBmembers. Inmostcases,thisdiscussionmayonlyinvolvetheChairofthe CRBandtheSeniorVicePresident;however,significantsuggestedmodification(s)tofindings mayrequireconsultationofallmembersorameetingbetweentheCABandCRB.

Bystanders. Bystandersareindividualswhowitnessemergenciesorsituationsthatcouldleadto criminaleventsorviolationsofUniversitypolicyand,bytheirpresence,mayhavean opportunitytoprovideassistance,donothing,orcontributetothenegativebehavior.

BystanderIntervention. BystanderInterventionisaphilosophyandstrategyforpreventionof varioustypesofviolence,includingbullying,sexualharassment,andintimatepartnerviolence.

CampusWorkService. Adisciplinarymeasurethatestablishesanopportunityforastudentto contributetothebettermentofthecampuscommunitythroughworkassignedthroughthe University’sArbitrationProcessandcompletedthroughtheOfficeofResidenceLife. While completingcampusworkservicehours,studentsmayparticipateinavarietyoftasksranging fromclericalduties,generalmaintenance,and/orgroundsimprovement. Asaconditionof sanctioning,studentsareobligatedtocompletecampusworkservicehourswithinastated period. Aninabilitytocompletehourswillbepromptlyevaluatedandmayresultinfurther sanctioning.

CleryReporting/StudentRighttoKnowAct. Thecollectionandreportingofcampuscriminal activityisarequirementoffederallawandanimportantpartoftheUniversity'sCampus Securityfunction. ThelawwasoriginallynamedtheStudentRighttoKnowandCampus

The UniversitycompilesandpublishesanAnnualSecurityandFireSafetyReport(ASFSR),and ongoingcampuscrimeandfirelogs. Informationandprotocolregardingtheseandothercrime preventioneffortsaredescribedbelow. TheUniversityadvisesprospectiveandcurrentstudents aswellasUniversityemployeesofVirginiaWesleyan'sCampusSecurityReport.TheCampus SecurityReportincludescrimestatisticsthatareannuallyreportedtotheU.S.Departmentof Education.

TheDirectorofSecurityisdesignatedasthedatagatheringcoordinatorfortheAnnualSecurity FireandSafetyReport(ASFSR). CampusSecuritycollectsdatafromrelevantcampusentities, mostnotably,theOfficeofResidenceLife. AllstatisticaldataonCleryreportablecrimessuch asmurder,non-negligentmanslaughter,sexoffenses(forcibleandnon-forcible),robbery, aggravatedassault,burglary,motorvehicletheft,arson,hatecrimes,arrestsandreferralsfor disciplinaryactionforliquor/drug/weaponslawviolations,domesticviolence,datingviolence, andstalkingareincluded. Ifanyoftheseareallegedtohavehappenedon-campusorduringa University-sponsoredtrip,theymustalsobereported. Therearenoprivacyexemptions. The crimestatisticsalsoreflectanyreportableoffensesthatoccurredoncampus,incertainnoncampusbuildings,oronpublicpropertythatisimmediatelyadjacenttoandaccessiblefromthe campus.

Coercion. Coercionisanunreasonableamountofpressuretoengageinsexualactivity. Coercionbeginsnotwhenyoumakethesexualadvance,butwhenyourealizetheotherperson doesnotwanttobeconvincedandyoucontinuetopush.

CommunityArbitrationBoard(CAB). TheSeniorVicePresidentordesignee,afaculty memberandastudentselectedthroughStudentConductOfficerprocessshallconvenetohear thefollowingmatters: whenastudentappealsthedecisionofanEducationalConferenceor whentheallegedincidentoritsconsequencesaresevereenoughtobebroughtbeforetheCAB. TheCABwillorganizeitselfinternallyandwillproceedaccordingtothearbitrationprocess. Theovertonesofacourtroomaretobeavoidedandtheproceduralrulesheldtotheminimum consistentwithefficientproceedingsanddueprocess. Themajordistinctionbetweenthislevel ofdiscussionandthoseprecedingitisthattheCABwilldevelopitsowndecision,whichwillbe bindingonthepartiesconcerned. TheCABhastheauthoritytoimposesanctions,levyfinancial penalties,requirecampusworkservice,makeacounselingreferral,removeorreassignstudents fromcampushousing,andrequirecompliancewithotherspecificrequestssubjecttoreviewby theCommunityReviewBoard. CommunityArbitrationSystem. TheUniversity'sprocessformanaginginstancesofalleged misconduct,excludingmattersofallegedTitleIX/Sexualharassment. Thissystemincludes EducationalConference,CommunityArbitrationBoard,andCommunityReviewBoard.Due processisfundamentallyaseriesofprovisionsdesignedtoassuretheproperpresentationofall relevantfactsandbeliefsinanopenandforthrightmanner. Dueprocessrulesout“testimony” fromfacelessaccusers. InanyproceedingwithintheCommunityArbitrationSystem,aperson accusedofaviolationofUniversitypolicywillreceivewrittennoticeofhisallegedmisconduct; begivenaspecifictime,date,andplacewheretheallegationswillbemediatedorarbitrated;and beassignedamentortoguidethemthroughthearbitrationprocess. Astaffmemberfromthe OfficeofResidenceLife,notinvolvedintheallegedincident,willserveasthefactfinderto presenttheirreporttotheappropriatearbitrationhearingbody.Thisindividualwillbepermitted toappear,presentevidenceandtestimony,andrequestotherswhohavefirst-handknowledgeof theincidenttodosoonhisbehalfatthemediationorarbitrationhearing. Inthosesituations wheretheCommunityArbitrationBoardmakesabindingarbitrationdecision,itfirstmustbe reviewedandaffirmedbytheCommunityReviewBoardbeforethedecisionisfinal. Theprimeconcernofthisreviewshallbetodeterminewhetherornotthe CABconductedareasonablyfairandthoroughhearing,andtoevaluatetheimposeddecision basedonprecedenceandasitrelatestoequityforthosepersonsinvolvedandtheUniversity community. Thisboardismadeupoftwofacultymembers,withoneactingaschair,andtwo students.

Complainant. Apersonwhobelievestherehasbeenanactofdiscriminationagainstanyperson orgroupinaprogramoractivityandbringsanactionthroughthearbitrationprocess. Thisterm ismostutilizedincasesofallegedviolationsofTitleIXandsexualharassment.

ConductProbation Adisciplinarymeasurethatsetsforththeconditionthatifwhileon conductprobation,astudentisfoundguiltyoffurtherviolationsofanyUniversitypolicy,he/she shouldexpectmoreseveredisciplinaryaction. Theprobationperiodusuallylastsfromoneto twosemestersdependingupontheseverityoftheviolation. IfattheendoftheConduct Probationperiodnofurtherviolationshaveoccurred,thestudentisautomaticallyremovedfrom probationarystatus. Withconductprobation,atthediscretionoftheSeniorVicePresidentor

ConfidentialReportofAllegedSexualHarassment/TitleIXViolations. Acomplainttoa Universityrecognizedconfidentialresource:(1)OfficeofCounselingandStudentHealthstaff, (2)theDirectorofCampusMinistries,and(3)SentaraStudentHealthCenter.

Consent. Consentisavoluntaryandaffirmedagreementtoengageinsexualactivity Someone whoisincapacitatedcannotconsent. Initiatorsofsexualactivityareresponsibleforobtaining effectiveconsent. Silenceorpassivityisnoteffectiveconsent. Pastconsentdoesnotimply futureconsent. Silenceorabsenceofresistancedoesnotimplyconsent. Consenttoengagein sexualactivitywithonepersondoesnotimplyconsenttoengageinsexualactivitywithanother Consentcanbewithdrawnatanytime. Coercion,force,orthreatinvalidatesconsent. Incapacitation,duetotheuseofdrugsoralcohol,whenapersonisasleeporunconscious,or becauseofanintellectualorotherdisability,preventsanindividualfromhavingthecapacityto giveconsent.

CounselingandStudentHealthReferral. Basedoncertaincircumstancesandpreliminary assessments,studentsmaybereferredtotheOfficeofCounselingandStudentHealthbycampus administratorsbasedonbehavioralconcerns. Thisactionisimplementedincaseswherethe student’swelfareorbehaviorwarrantssuchaction. Asaconditionofsanctioning,thestudentis expectedtoarrangeameetingandfollowanyadditionalassessmentsandrecommendations madebythecounselor.

DatingViolence. Violencecommittedbyapersonwhoisorhasbeeninasocialrelationshipof aromanticorintimatenaturewiththevictim,andwheretheexistenceofsucharelationshipshall bedeterminedbasedonaconsiderationofthelengthofarelationship,andthetypeof relationship. Thefrequencyofinteractionbetweenthepersonsinvolvedintherelationshipis alsoaconsideration.

DisciplinaryProbation Aprobationarystatus,whichismoreseriousinnature,usuallylasts fromonetotwosemestersandisusuallyadministeredbytheCommunityArbitrationBoard. A studentwhocommitsfurtherviolationswhileondisciplinaryprobationmaybesubjectto suspensionordismissalfromtheUniversity. AtthediscretionoftheSeniorVicePresidentor designee,disciplinaryprobationcouldincludeasecondnoticetoparents. Acopyofthehearing materialswillstayinthestudent'sfolderuntilthefolderisdestroyed.

Dismissal. ApermanentseparationfromtheUniversity. TheUniversitywillnoteonastudent’s academictranscriptastudent’sdismissalforviolatingtheSexualHarassmentPolicy. Oncea

DomesticViolence. Afelonyormisdemeanorcrimeofviolencecommittedby:(1)acurrentor formerspouseorintimatepartnerofthevictim,(2)apersonwithwhomthevictimsharesachild incommon,(3)apersonwhoiscohabitatingwithorhascohabitatedwiththevictimasaspouse orintimatepartner,(4)apersonsimilarlysituatedtoaspouseofthevictimunderthedomesticor familyviolencelawsofthejurisdictionreceivinggrantmonies(underVAWA),or(4)anyother personagainstanadultoryouthvictimwhoisprotectedfromthatperson’sactsunderthe domesticorfamilyviolencelawsofthejurisdiction.

DrugProbation Whileondrugprobation,shouldastudentbefoundusing,possessing,or beinginthepresenceofdrugparaphernaliaorcontrolledsubstancesonthecampusofVirginia Wesleyan,theymaybesubjecttosuspensionordismissalfromtheUniversity

EducationalConference. AmeetingbetweenUniversityadministrator(s)andastudentwho hasallegedlyviolatedUniversitypolicy. Afterdiscussingthereportedincident,thestudentwill beinformedbytheadministratorsinvolvedwhetherornottherewasanactualinfraction. This mayresultinappropriatesanctioning. EducationalConferencesarereservedforstudents'initial and/orminorinfraction(s).

EmergencyResponseTeam(ERT). ERTiscomprisedofkeyadministratorswhoare responsibleforpreparingforandrespondingtocampusemergenciesofallvarieties.

ExternalEvaluation. Incaseswhereastudent’sbehaviormayindicateasignificantdegreeof problematicsubstanceuseand/ordifficultycontrollingthatuse,orinmatterswhenastudent's well-beingandmentalhealtharequestionable,theadministration,inconsultationwiththe DirectorofCounselingandStudentHealth,maymandateasaconditionofcontinuedenrollment, thatthestudentreceiveevaluativeservicesand/ortreatmentbeyondthatavailableintheOffice ofCounselingandStudentHealth. Withsuchinstances,theDirectorofCounselingandStudent Healthmaybeabletoassistthestudentwithlocatingalocalpractitionerwhospecializesinthe desiredareaandwillactasliaisonfortheUniversity,withthatpractitioner Studentsare expectedtofollowtheassessmentandtreatmentrecommendedbythepractitionerandauthorize anyreleaseofinformationnecessaryforthatpractitionertocommunicatewiththeDirectorof CounselingandStudentHealthregardingcomplianceandprogress. Failuretocomplymay resultinastudent’stemporaryorpermanentseparationfromtheUniversity.

FERPA(FamilyEducationalRightsandPrivacyActof1974). Inaccordancewithfederal law,itisnecessaryforaVirginiaWesleyanUniversityschoolofficialtohavewrittenconsent fromastudentpriortoreleasinginformationfromthestudent'seducationalrecordtoanysource

outsidetheUniversitythatisnotanagentoftheUniversity. Theexceptiontothissituationis informationconsidered"DirectoryInformation."

FormalComplaintofSexualHarassment/TitleIX(alsoreferredtoasa"FormalReport"). AreportofabelievedviolationoftheUniversity'sSexualHarassment/TitleIXpolicytoa ResponsibleEmployee. AllreportstoResponsibleEmployeesmustbeconveyedtotheSexual HarassmentReviewCommitteeortheTitleIXorDeputyTitleIXCoordinators. This informationwillincludeallrelevantinformation,toincludethecomplainant’snameandthe nameoftherespondent.

GradePolicy. StudentssuspendedordismissedfromtheUniversityfordisciplinaryreasonswill receiveagradeofWorWFineachcourseinwhichtheyarecurrentlyenrolledatthediscretion oftheinstructorofthatcourse,unlessworkinagivencoursehasalreadybeencompleted,in whichcasethestudentwillreceivethatgradealreadyearned.

HateCrime. Acriminaloffenseagainstapersonorpropertymotivatedinwholeorinpartbyan actualorperceivedoffender’sbiasagainstrace,religion,gender,genderidentity,sexual orientation,ethnicity,nationalorigin,anddisability.

Hazing. Hazingisanactthatareasonablepersonwouldconsiderendangeringtoone’sphysical ormentalwellness. Itisoften,butnotexclusively,associatedwithadmission,involvement, association,orcontinuedmembershipinagroup,team,ororganization. Hazingmayinclude humiliation,intimidation,and/ordemeaningtreatment. Itmayalsoinvolvealcohol,drugs,or othersubstances. HazingthatinvolvessexualharassmentwillbeinvestigatedbytheSexual HarassmentReviewCommitteeandtheUniversity’sDeputyTitleIXCoordinatorsinadditionto othercampusofficials.

Incapacitation. Thephysicaland/ormentalinabilitytomakeinformed,rationaljudgmentsthat voidsanindividual'sabilitytogiveconsent. Incapacitationmaybecausedbyapermanentor temporaryphysicalormentalimpairment. Incapacitationmayalsoresultfromtheconsumption ofalcoholortheuseofdrugs. Theuseofalcoholordrugsmay,butdoesnotautomaticallyaffect aperson'sabilitytoconsenttosexualcontact. Theconsumptionofalcoholordrugsmaycreatea mentalincapacityifthenatureanddegreeoftheintoxicationgoesbeyondthestageofmerely reducedinhibitionandreachesapointinwhichthevictimdoesnotunderstandthenatureand consequencesofthesexualact. Insuchcases,thepersoncannotconsent. Apersonviolatesthe sexualharassmentpolicyifheorshehassexualcontactwithsomeoneheorsheknowsorshould knowismentallyincapacitatedorhasreachedthedegreeofintoxicationthatresultsin incapacitation. Thetestofwhetheranindividualshouldknowaboutanother'sincapacitationis whetherareasonable,soberpersonwouldknowabouttheincapacitation. Anaccusedstudent cannotrebutasexualharassmentchargemerelybyarguingthatheorshewasdrunkorotherwise

impairedand,asaresultdidnotknowthattheotherpersonwasincapacitated. Apersonwhois passedoutorunconsciousbecauseoftheconsumptionofalcoholordrugsisphysicallyhelpless andisnotabletoconsent.

InclusiveCommunity. VirginiaWesleyanUniversityfostersacommunitywhereeveryonefeels welcomedandvaluedregardlessofrace,religion,color,creed,gender,nationalorethnicorigin, age,maritalstatus,coveredveteranstatus,handicap,sexualorientation,genderidentityand expression,oranyotherlegallyprotectedstatus. Asaninclusivecommunity,VirginiaWesleyan Universityprohibitscrimesofdatingviolence,domesticviolence,sexualharassment,and stalking.

InterimSuspensionandClassRemoval. Incertaincircumstances,theTitleIXand/orDeputy TitleIXCoordinators,SeniorVicePresident,orotheradministrator,afterconsultationwith relevantUniversityofficials,mayimposeaUniversityorahousing“interim”suspensionpriorto theresolutionofaconductcasebeforetheSexualHarassmentBoardorCommunityArbitration BoardInterimsuspensionmaybeimposedwhentheTitleIX/DeputyTitleIXCoordinators,or otherUniversitystaffmemberhasareasonablebasistoconcludethat:(a)thecontinuedpresence ofastudentoncampusorinUniversityhousingmaycreatearisktothehealthorsafetyof studentsorofothermembersoftheUniversitycommunity;or(b)astudentposesanongoing threatofdisruptionof,orinterferencewith,thenormaloperationsoftheUniversity.Duringan interimsuspension,astudentmustleavecampusimmediatelyandshallnotparticipatein academic,extracurricular,orotheractivitiesoftheUniversityexceptasauthorizedbythe Universityadministrators. Provisionsmaybemadeforastudenttotendtoacademicobligations atthediscretionofUniversityadministrators. Intimidation. Intimidationcanbedefinedasanimpliedthreatthatresultsinafeelingoffear. LiveSafe. Anopt-inprogramthatallowscommunitymemberstoeasilyshareinformationand safetyconcernswithCampusSecuritybysubmittingtexts,pictures,andaudio,withanoptionof remaininganonymous. StudentsmayalsolivechatwithCampusSecurity,viewahelpfulsafety map,andallowfriendstomonitortheirlocationforeverydaysafety Usersmaycreateaprofile, whichincludesoneemailaddressandonetelephonenumberthatwillbeusedbytheUniversity tonotifycampusmembersofemergenciesandothertimelyinformation. TheLiveSafeapp workswithmostsmartphonesandisavailablefordownloadinthe iTunes and Google Play app stores.

MemorandaofUnderstanding(MOU). InaccordancewiththelawsoftheCommonwealthof Virginia,VirginiaWesleyanUniversityhasenteredamutualaidagreementintheformofMOUs

withlawenforcementagenciesintheCityofVirginiaBeach. Thisagreementdefinesthe relationshipbetweentheUniversityandVirginiaBeachintimesofcrisisorinothermattersthat wouldinvolvecooperationandorcollaboration.

Mentor(CAB). Duringtheprocessleadinguptoandculminatingwithameetingofthe CommunityArbitrationBoard,astudentwhoseactionsarebeingarbitratedmayselectamentor fromthefaculty,staff,orstudentbody. Theroleofthementorisprescribedandlimitedas follows: Theprovisionofsocialandemotionalsupportforthestudentthroughoutthearbitration process. TheprovisionofadviceregardingUniversitypolicyandprocedures,bothpriortoand afterthehearing,toincludereviewofthedecisionrationalesforsimilarcases. Duringthe hearing,thementormaybepresent,butisnotawitnessandsomaynottestifyorargueor expressopinionsinthehearing. Amentormayspeakwiththestudent,offeringsupportand informedadviceduringthehearing.

Mentor(SHB). IncasesofallegedTitleIX/SexualHarassmentcases,thecomplainantand respondentmaychoosetheirparent,legalrepresentation,orotherpersontoserveastheirmentor. However,regardlessoftherelationshipwiththestudent,amentorshallnotbeaffordedtheright toparticipateorinfluencetheproceedingsorthefindingsoftheSexualHarassmentBoard.

NoContactAgreement. Anagreementsignedbytwoormoreindividualstopractice“social avoidance”andpreventretaliationwhileaninvestigationisongoingand,often,continuedasa portionofthesanctiondelivered. Aftersigningthenocontactorder,ifastudentmakescontact (inperson,electronically,throughpeers,etc.)withapersontheyhaveagreedtohavenocontact withtheymayfacefurthersanctionsforfailuretoabidebythesignedagreement.

NoTrespassOrder. AnorderissuedbyCampusSecurity,theOfficeofResidenceLife,orthe SeniorVicePresidentthatindicatestoanindividualthattheyarenotpermittedoncampusuntil furthernoticeandmaybesubjecttoarrest.

Non-ConsensualSexualContact. Anysexualcontactthatoccurswithoutconsentconstitutes non-consensualsexualcontact.Examplesofsexualcontactinclude,butarenotlimitedto, intentionaltouchingofaperson'sgenitalia,groin,breast,orbuttocksortheclothingcoveringany ofthoseareas,orusingforcetocausethepersontotouchhis/her/theirowngenitalia,groin, breast,orbuttocks.

Non-ConsensualSexualIntercourse. Theactofsexualintercoursethatoccurswithoutconsent constitutesnon-consensualsexualintercourse. Sexualintercourseisdefinedbypenetration (anal,oral,orvaginal)byapenis,tongue,finger,orinanimateobject.

OfficialReprimand. Awrittennoticeexpressingdisapprovalofthestudent'sconduct. This noticeshallincludeareminderthatrepetitionoftheviolationcouldresultinamoresevere sanction. Acopyoftheletterisplacedinthestudent'srecordfolderwhereitwillremainuntil thefolderisdestroyed.

OngoingAwarenessProgramsandCampaigns. Inanefforttoeducatethecommunityand maintainasafeandwelcomingenvironment,theUniversityoffersongoingpreventionand awarenesscampaignsandprogramsforbothstudentsandemployees. Thisincludes programmingrelatedtodiversity,sexualharassment,andriskybehaviors. Inanefforttoeducate itscommunityandmaintainasafeandwelcomingenvironment,theUniversityoffersongoing preventionandawarenesscampaignsandprogramsforbothstudentsandemployees.Primary programsincludeworkshopsfocusingondiversityfornewstudentsandeducationfornew facultyandstaffofferedthroughtheOfficeofHumanResources. Allstudents,faculty,andstaff arealsorequiredtocompleteamandatoryTitleIXtrainingprogram. Newandreturning studentsarerequiredtoattendTitleIXtrainingfacilitatedbytheDeputyTitleIXCoordinators andfacultyareupdatedannuallyaboutTitleIXandchangestoregulationsduringFacultyPresession. Newstudentsalsoattendabystanderinterventionpresentationatthebeginningofeach academicyear TheUniversityhasstandingMemorandumsofUnderstanding(MOUs)withthe ThirdPrecinctoftheVirginiaBeachPoliceDepartment.

OtherSanctionsasImposed. TheUniversityreservestherighttomakeexceptionsor adjustmentstospecificsanctionswhen,initssoleopinion,circumstancesdictateitforthe well-beingoftheUniversitycommunityand/orwhenitisintheUniversity’sbestintereststodo so.

PetitionforReview. Shouldastudent,afterbeingsuspendedfromtheinstitutionforviolation ofUniversitypolicy,choosetopetitionforareviewoftheimposedsanction(s),thestudentmay dosoafteronemonth. Petitionsshouldbereviewedduringthetenureofthecurrentmembersof theCommunityArbitrationBoardandCommunityReviewBoard. Petitionsreceivedduringthe summermonthswillbereviewedinthefall.

PhysicalForce. Forceequatedwithviolence,ortheuseofaweapon,constitutesphysicalforce. Nomatterhowslight,anyintentionalphysicalimpactuponanother,useofphysicalrestraint,or thepresenceofaweaponconstitutestheuseofforce.

Proceeding. Theterm"proceeding"shallrefertoahearingormeetingusedbytheCommunity ArbitrationandSexualHarassmentprocessesinanattempttoresolvemattersofactualoralleged violationsofUniversitypolicy. Fromcallingameetingtoordertoadjournment,a"proceeding" mayincludethereadingofreports,witnesstestimony,andquestionsfromindividuals representingthevariousarbitraryboards. Aproceedingculminatesinaresultorfinding

Rape. Penetration,nomatterhowslight,ofthevaginaoranuswithanybodypartorobject,or oralpenetrationbyasexorganofanotherperson,withouttheconsentofthevictim.

ReassignmentofUniversityHousing. Whentheallegedmisconductofastudentisofasevere nature,thestudentmayberemovedfromhiscurrenthousingassignmentandreassignedto anotherspaceinUniversityrecognizedhousing. Astudentwillreceiveawarningbeforebeing reassigned,however,inmoreseriousmattersofallegedmisconduct;astudentmaybereassigned withoutwarning. Thissanctionmaybegivenbecauseofanarbitrationmeeting,butitisalsoat thediscretionoftheSeniorVicePresidentandDirectorofResidenceLifetoadministerthis sanctionoutsideofthearbitrationprocess. Reassignmentmaybemaintainedafterthe conclusionofacaseinwhichnoonewasfoundinviolationasameansofmaintainingpeaceand afeelingofsafetyintheresidentialcommunity

Referrals Asasanction,theCommunityArbitrationBoardmaychoosetoreferthestudentto campusservicesormakeotherrecommendationsandrequirements,whichitdetermines appropriate.

RefundPolicy. Shouldastudentbesuspendedordismissedfordisciplinaryreasons,the Universitywillretainthefollowingamountoftuition,roomandboard,andfederal, Commonwealth,andinstitutionalfinancialaid. Thetuitionandroomdepositsarenonrefundable. Studentsmayreceiveapartialrefundasfollows:90%duringthefirstweekof classes,50%thesecondweekand25%thethirdweek. Afterthethirdweekofclasses,thereis norefund. Calculationswillbebasedonthedatethesuspensionordismissalissubmitted. The Universitywillchargeanadministrativecostallowanceforanystudentsuspendedordismissed. Thecostwillbefivepercent(5%)oftuition,room,andmealsoriginallycharged,butwillnot exceed$100.00. AnyfederalfinancialaidwillbereturnedbasedontheFederalReturnPolicy. PleaseseethefullrefundpolicyontheUniversity’swebsiteunder“Financeand Administration.”

RelationshipViolence. Physicalassaultorcrediblethreatofbodilyharminvolvingadultswho areinanintimaterelationship.

RemovalfromUniversityHousing Whenthemisconductofastudentisofaseverenature,the studentmayberemovedfromUniversityhousing. Insuchacase,thestudentwillberequiredto liveoffcampusforagivenperiod,andwillnotreceivearefundofroomandboardfeesforthe currentsemester. ThisperiodofseparationfromUniversityhousingfacilitieswillnottypically beinplaceforthebalanceofastudent’stenureattheUniversityand,therefore,thestudentmay berequiredtoliveinUniversityrecognizedhousingattheendoftheseparationperthe University’sresidentialrequirement. Astudentwilltypicallyreceiveawarningbeforebeing removedfromUniversityhousing;however,inmoreseriousmattersofmisconduct,astudent

mayberemovedwithoutwarning. Thissanctionmaybegivenbecauseofanarbitration meeting,butitisalsoatthediscretionoftheSeniorVicePresidentandDirectorofResidence Lifetoadministerthissanctionoutsideofthearbitrationprocess.

ResidentialHousingProbation. ActionpermittingthestudenttoremaininUniversityhousing onprobationarystatus. Duringtheperiodofprobation,ifthestudentisfoundresponsiblefor additionalviolation(s),thestudentmaybereassignedtoanotherspaceinUniversityrecognized housingorremovedfromUniversityhousing.

Respondent.AnindividualwhoisallegedtohaveviolatedUniversitypolicy Thistermismost utilizedincasesofallegedviolationsofTitleIXandsexualharassment.

ResponsibleEmployee. Individualsthathaveanobligationtoreportincidentsofsexual harassmenttoCampusSecurity,theSexualHarassmentReviewCommittee,theTitleIX Coordinator,orDeputyTitleIXCoordinators. Certainindividualsareexemptfromreporting andmayspeakwithacomplainantinconfidence. Theseindividualsmaymaintain confidentialityunlessthereisabeliefofimminentdangertothecommunityoranindividual. ExemptemployeesareCounselingandStudentHealthprofessionalstaff,theDirectorofCampus Ministries,andSentaraStudentHealthCenterpersonnel. Allotherindividualsinemploymentor avolunteercapacity,part-orfull-timeatVirginiaWesleyanUniversityareresponsiblefor reporting.

Restitution. Whentheactionsofastudentresultsindamage,destruction,misuse,or misappropriationofanotherstudentorUniversityproperty,thestudentmaybeassesseda reasonablefineforthecostfortherepairorreplacementofthepropertyatthesatisfactionofthe impactedindividualortheUniversity.

Restriction Shoulditbedeterminedthatastudent’spresenceoncampusorinacertainareaof campussuchasavillageorahallposesathreatorjeopardizesthesafety,well-being,orcomfort ofanothercommunitymemberormembers,thatstudentmaybeprohibitedfromvisiting designatedplacesforastatedperiodoftime. Restrictionmaybepartofsanctioningthroughthe University’sCommunityArbitrationSystem,butmayalsobeenactedbytheSeniorVice Presidentordesigneegiventhecircumstances.

Result. Thefinding(s)oftheSexualHarassment/TitleIX,andCommunityArbitration proceedings. Resultsmayrangefromanunfoundedreporttopermanentdismissalfromthe University. Boththecomplainantandtherespondentwillbenotifiedoftheresultsper compliancewithTitleIX.

ReturnofUniversityProperty. StudentssuspendedordismissedfromtheUniversitymust relinquish,toaUniversityofficial,theirVWUstudentID,parkingdecal,androomkeycard (whenapplicable).

RiskReduction. StudentsafetyistheoverarchinggoalofVirginiaWesleyanUniversity.Risk reductionisaphilosophyandpracticethatincorporatesprograms,workshops,trainings,policies, practices,campaigns,andotherinitiativesdesignedtoeducatecommunitymembersaboutrisky behaviorssuchassexualharassmentandalcoholanddruguse. Riskreductionincorporates educatingthecommunityofreportingmechanismsandmethodstoreducethelikelihoodofharm orvictimizationthroughalteringattitudesandchoicesassociatedwithsex,sexualharassment, genderinequity,alcoholanddruguse,andotherbehaviors.

SexualHarassmentwithanObject Touseanobjectorinstrumenttounlawfullypenetrate, howeverslightly,thegenitaloranalopeningofthebodyofanotherperson,withouttheconsent ofthevictim,includinginstanceswherethevictimisincapableofgivingconsentbecauseof his/her/theirageorbecauseoftheirtemporaryorpermanentmentalorphysicalincapacity.

SexualExploitation. Takingsexualadvantageofanotherpersonwithouteffectiveconsent constitutessexualexploitation.Thisincludesbutisnotlimitedtocausingtheincapacitationof anotherpersonforasexualpurpose;causingtheprostitutionofanotherperson;electronically recording,photographing,ortransmittingintimateorsexualutterances,sounds,orimagesof anotherperson;allowingthirdpartiestoobservesexualacts;engaginginvoyeurism;distributing intimateorsexualinformationaboutanotherperson;andknowinglytransmittingasexually transmittedinfection,includingHIV,toanotherperson.

SexualHarassment. Sexualharassmentisabroadrangeofbehaviorthatincludesbutisnot limitedtonon-consensualsexualintercourse,non-consensualsexualcontact,sexualexploitation, relationshipviolence,andstalking.Sometimesstudentsareunsureifwhattheyortheirfriends experiencedwassexualharassment,whenunsure,astudentshouldcontactoneofthe University'sDeputyTitleIXCoordinators.

Unwelcomesexualadvances,includingrequestsforsexualfavorsorotherverbalorphysical conductofasexualnatureconstitutessexualharassment,whenoneormoreofthefollowing occur: Submissiontoorrejectionofsuchconductismadeatermorconditionofanindividual's employmentoracademicsuccess. Submissiontoorrejectionofsuchconductisusedasthe basisforemploymentoracademicdecisions. Suchconducthasthepurposeoreffectof interferingwithanindividual'sworkoracademicperformanceorcreatesahostile,intimidating, oroffensiveworkoreducationalenvironment.

SexualHarassmentBoard(SHB). TheSeniorVicePresident(whowillpresideaschair),a facultymember,andastaffmembershallconvenetohearincidentsinvolvingallegationsof misconductofasexualnature. ShouldtherebeotherallegedinfractionsofUniversitypolicy reportedtohaveoccurredrelevanttotheallegedincidentofsexualharassment;thoseinfractions willbeadjudicatedbytheSHB. Theovertonesofacourtroomaretobeavoidedandthe proceduralrulesheldtotheminimumconsistentwithefficientproceedingsanddueprocess. The SHBwillusea“clearandconvincing”standardtodevelopitsdecisions,whichwillbebinding onthepartiesinvolved. SHBhearingsmaybevideotapedand/oraudiotapedforrecordkeeping andreviewpurposes.

SexualHarassmentCommitteeofAppeals(SHCA). TheTitleIXCoordinatorwillconvene themembersoftheSHCA,whichshallconsistofthreeindividualsdrawnfromapooloffaculty andstaff. TheSHCAisnotahearingbody,butisratheranappealscommittee. Therefore,itwill notconductanadditionalhearing,butwillberesponsibleforreviewingdocuments,reports, transcripts,andfindingsoftheSHBforproceduralerrorspertinenttotheoriginalhearing.

Whennecessary,theSHCAmaycontactmembersoftheSHBtodiscusstheirdeliberationsand therationalefortheirfindings.

SexualHarassmentReviewCommittee(SHRC). Theindividualsresponsibleforexamining theallegationsshallhenceforthbereferredtoastheSexualHarassmentReviewCommittee (SHRC). ThisCommitteewillbemadeupoftheTitleIXCoordinatororadesignee,Campus Liferepresentatives,andtheDirectorofSecurityoradesignee. TheCommitteewillmeetwithin 72hoursofthematterbeingbroughttotheattentionoftheTitleIXCoordinator,theDeputyTitle IXCoordinators,ortheirdesignees. TheSHRCwilldeterminewhetherornottheallegationof sexualharassmentrequiresadditionalinvestigationandsubsequentadjudicationthroughthe SexualHarassmentBoard. IntheeventthattheSHRCcannotreachconsensuswithregardto whetherornottheallegedmisconductconstitutesafelony,theDirectorofSecurityoradesignee shallimmediatelydisclosesuchinformationtothelaw-enforcementagencythatwouldbe responsibleforinvestigatingtheallegedactofsexualharassment. Incasesinwhichthealleged sexualharassmentmayconstituteacrime,asdeterminedbyconsensusorpertheopinionofone ormoremembersoftheCommittee,theSHRCwillinformalocalattorneyforthe Commonwealth. Thisnotificationwilloccurwithin24hoursafterthisdeterminationisreached. Uponthisdisclosure,theTitleIXCoordinatororadesigneeshallnotifythevictimthatsuch disclosureisbeingmade. SexualViolence. Sexualviolencereferstophysicalsexualactsperpetratedagainstaperson’s willorwhereapersonisincapableofgivingconsentduetothevictim’suseofdrugsoralcohol. Anindividualalsomaybeunabletogiveconsentduetoanintellectualorotherdisability. A

numberofdifferentactsfallintothecategoryofsexualviolence,includingrape,sexualassault, sexualbattery,andsexualcoercion. Allsuchactsofsexualviolenceareformsofsexual harassmentcoveredunderTitleIX.

SocialProbation. AtthediscretionoftheSeniorVicePresidentordesignee,studentsresiding inrecognizedUniversityhousing,i.e.anapartmentortownhousemaybeplacedonsocial probationforastatedperiod. Thisactionsuspendstheprivilegetoregistersocialevents.

Sodomy Oraloranalsexualintercoursewithanotherperson,withouttheconsentofthevictim, includinginstanceswherethevictimisincapableofgivingconsentbecauseofhis/her/theirage orbecauseofhis/her/theirtemporaryorpermanentmentalorphysicalincapacity

Stalking. Engaginginacourseofconduct,directedataspecificpersonthatwouldcausea reasonablepersontofearforhis/her/theirsafety/thesafetyofothersortosuffersubstantial emotionaldistress. Repeatedlycontactinganotherpersonwhenthecontactisunwanted constitutesstalking. Contactincludesbutisnotlimitedtocommunication(inperson,byphone, orbycomputer),followingaperson,andwatchingorremaininginthephysicalpresenceofthe otherperson.

StudentConductOfficer. Apositionofferedtosixstudentsforanacademicyear. These studentsareselectedtoserveontheCommunityArbitrationBoard(CAB)orCommunity ReviewBoardbyacommitteeconsistingoftheSeniorVicePresident,theDirectorofResidence Life,andtheChairoftheCommunityArbitrationBoard.

Suspension AperiodofseparationfromtheUniversity,usuallyfromonetotwosemesters,or untilcertainconditionsaremet. Ifsuspended,thestudentmustvacatecampuswithin24hours ofnotification. NotificationissenttotheCenterforEnrollmentServices,OfficeofAcademic Affairs,FinancialAidOffice,andtheRegistrar'sOffice. Thecompletionoftheperiodof suspensiondoesnotguaranteereinstatement. TheUniversitywillpermanentlynoteona student’sofficialacademictranscriptastudent’ssuspensionforviolatingtheUniversity’sSexual HarassmentPolicy TheUniversityshallremovefromthestudent’sacademictranscriptany notationplacedonsuchtranscriptuponcompletionofatermofsuspension. SeeCodeof Virginia(§23-9.2:18). OnceastudentissuspendedfromtheUniversity,thestudentwillnotbe allowedontheVWUcampusforanyreasonduringthestatedperiodofsuspension.

Threats. Threatscauseapersontodosomethingthathe/she/theywouldnothavedonewithout thethreat(forciblecompulsion).

TitleIXCoordinator(TIXCoordinator)andDeputyTitleIXCoordinator(s)(DTIX Coordinator). TheTIXCoordinatorandDTIXCoordinatorsseekfirsttoensurethatthevictim

issafeandthatthecampuscommunityisprotected. Theywillmeetwiththecomplainantofthe reportedsexualharassmentandtherespondenttodiscusstheallegedmisconductandprovide informationaboutUniversitypoliciesandprocedures. Duringtheinquiryprocess,theDTIX Coordinatorswillmeetwithotherindividualsandvisitrelevantlocationsasneeded. TheDTIX CoordinatorsaretrainedinUniversitysexualharassmentandwillprovideexpertandempathetic counseltothecomplainantandrespondent. TheTIXCoordinatorservesasamemberofthe SexualHarassmentReviewCommittee.

Transcripts(SexualHarassment). TheUniversitywillprominentlynoteonastudent'sofficial academictranscriptastudent'sSuspension,Dismissal,orWithdrawalwhileunderinvestigation, orafterhavingbeendisciplined,forviolatingpoliciesgoverningsexualharassment. The Universityshallremovefromthestudent'sacademictranscriptanynotationplacedonsuch transcriptuponcompletionofatermofsuspension,orincaseswherethestudenthadwithdrawn fromtheinstitutionbutwassubsequentlyfoundnotresponsibleforviolatingsexualharassment policies. StudentsdismissedfromtheUniversityforviolatingpoliciesgoverningsexual harassmentwillretainapermanentnotationontheofficialacademictranscript. CodeofVirginia (§23-9.2:18)

UnfoundedCrimeandStatistics. Reportsofcrimethathavebeenunfoundedmayberemoved fromUniversityrecordsifandwhentheyaremadeanonymouslyand/orreceivedfromsecondor thirdhandsourcesandasubsequentinvestigationbyCampusSecurityprovesthatthecomplaint wasfrivolousinnature. Formattersrelativetosexualharassment,theSexualHarassment ReviewCommittee(SHRC)determinesifaninvestigationiswarrantedandwhetherornotto communicatewithlocallawenforcementandtheCommonwealth'sattorney'soffice.

AllnotedunfoundedcrimesasrequiredbytheCleryActwillbereportedassuchinthe statisticaldatasectionoftheAnnualSecurityandFireSafetyReportandmarked"Unfounded Crime"accordingly.

UniversityOfficial. AUniversityofficialisanindividualwhohassignificantresponsibilityfor studentandcampusactivities,including,butnotlimitedto,studenthousing,studentdiscipline, andcampusjudicialproceedings. Anofficialisdefinedasanypersonwhohastheauthorityand thedutytoactorrespondtoparticularissuesonbehalfoftheinstitution.

Withdrawal(SexualHarassment). TheUniversitywillprominentlynoteonastudent’sofficial academictranscriptastudent’swithdrawalwhileunderinvestigationforviolatingpolicies governingsexualharassment. TheUniversityshallremovefromthestudent’sacademic transcriptanynotationplacedonsuchtranscriptincaseswherethestudenthadwithdrawnfrom theUniversity,butwassubsequentlyfoundnotresponsibleforviolatingsexualharassment policies.
